shorten retail lobby hours and close at noon on these

According to the police department, Officer Timothy Loehmann,
26, who shot Rice after he said Rice
would not comply to three verbal commands and went for his weapon in his
waistband, is on paid administrative
leave. The Cuyahoga County Medical
Examiner ruled Rice’s death a homicide on December 12.
Clevelanders overwhelmingly support Samaria Rice’s call for
justice for her son and her request for
changes be made in the Cleveland Police Department’s policy on excessive
force.
Some residents have blamed
the parent.
Ann Clifford, a Lakewood resident wrote an editorial
in the Plain Dealer in which she
wrote: “Small child” and “little
boy” have been frequently used
to describe 12-year-old Tamir
Rice. The 12-year-old was 5 feet,
7 inches tall and weighed 195
pounds (“Details on boy released
in autopsy,” PD, Dec. 13). He was
hardly a small child in appearance; more the stature of an older
teen and could easily be mistaken
as such in a crucial moment. If
only his mother had not allowed
her son to have a realistic-looking
toy gun (“Chain of events led up
to Tamir Rice’s killing,” PD, Dec.
14), Tamir Rice would still be
with us today.”
Before a Browns’ game,
Andrew Hawkins, a player on the
team came out for warm-ups wearing a T-shirt that read, “Justice for
Tamir Rice and John Crawford.”
Crawford was shot and killed by
police in August while holding an
air gun in a Wal-Mart in Beavercreek, Ohio.
Jeff Follmer, president
of the Cleveland Police Union
demanded an apology from the
Browns tweeting “It’s pretty pathetic when atheletes think they
know the law. They should stick to
what they know best on the field.
The Cleveland Police protect and
serve the browns stadium and the
browns organization owes us an
apology.”
William Frances. Boyd, Sr.,
chairman of the board of E.F. Boyd
& Son Funeral Home and Crematory
and one of the longest serving funeral directors in America, died on December 7. He was 99 years old. Services for Boyd were at the Antioch
Baptist Church, 8869 Cedar Avenue.

Home and Crematory, the funeral
home founded by his father, Elmer,
110 years ago in 1905, is one of the
oldest black businesses in Ohio.
Boyd was born February 7,
1915 on East 38th Street and Central
Avenue.
He moved with his parents,
Elmer F. and Cora S. Boyd and sister Lucille Elaine in 1917 and lived
above his father’s funeral home on
East 43rd Street and Central Avenue.
The family later moved in 1925 to
East 81st Street and Cedar Avenue.
Boyd attended Quincy Elementary School and Central Junior
High School.
Elmer Boyd moved his
family in 1930 to an upscale, predominantly Jewish neighborhood at
10704 Drexel Avenue off East 105th
Street in the Glenville area, but shortly thereafter, relocated to East 81st
Street in 1932
Boyd graduated from Glenville High School in 1933, and took
post-gratuate studies at Central
High School. He graduated from the
Cleveland College of Embalming in
1938.
When Elmer F. Boyd purchased the Slaughter Funeral Home
at 2165 E. 89th Street in 1938, he
added the ‘& Son’ to the firm name.
Boyd married Mary E.
Webster, daughter of Dr. Franklyn
Delk and Ina Guy Webster at Lane
Metropolitan C. M. E. Church on
Boyd
August 19, 1939, and the couple
had three children.
The funeral home has
remained a family business, and
it is now run by his children and
grandchildren: Marina Grant,
Victoria Boyd, William “Pepper” Boyd, Lisa Taylor and Marcella Boyd Cox.
For Boyd’s years
of service to the community,
Cleveland City Council honored
Boyd with a distinctive street
sign ‘William Boyd Sr. Way’ at
East 89th between Carnegie Avenue and Quincy Avenue in June
of 2012.
Boyd was active an
member of Antioch Baptist
Church, past vice president of
the Cleveland School Board,
board member of Eliza Bryant
Village, and a lifetime member
of the NAACP.
He was preceeded in
death by his wife, Mary, and his
children, Marina, William, and
Marcella.
Arragements were handled by E.F.Boyd and Son Funeral Home, 2165 E. 89th Street,
and interment was at Lake View
Cemetery.

Protesters from Furgeson
marched last week in Cleveland to
show support for the community as
they seek justice for Tamir Rice, the
12 year old boy who was shot and
killed by a Cleveland police officer
outside of the Cudell Recreation
Center on Novemeber 22. Officers
believed Rice was armed, but he had
a BB gun.
Tensions between the protesters and police have increased
since the shooting deaths of two
New York City police officers by a
mentally unstable gunman.
Samaria Rice, the mother
of Tamir Rice, renewed her call for
peaceful demonstrations in wake of
the mounting tension on policing.
She made the announcement at the
Greater Abyssinia Baptist Church
on E. 105th Street on Tuesday.
Walter Madison, who is
representing the Rice family, made

the following statement: “The Rice
family’s singular focus has been and
always will be the pursuit of justice,
and the pursuit of that justice by any

Gasoline prices spiral downward

prices dropped nearly 17 cents
this week, according to AAA
East Central’s Fuel Gauge report.

Holiday cheer has come
early for the motoring public,
with the average for retail gasoline at its lowest level in more
than five years.
Today’s national average price for regular unleaded
gasoline is $2.55 per gallon.
The average price at the pump is
more than a dime less than one
week ago and more than a quarter less than a month ago.
The national average is down 69 cents from this
same date last year and has now
dropped on 81 consecutive days
for a total of 80 cents during this
stretch.
The average price at the
pump has fallen nearly 25 percent since the start of the year,
and if the global price of crude
continues to register new multi-
year lows, these lower prices are
likely to persist. Barring any unexpected spikes in global prices,
or declines in domestic production, the price at the pump should
remain relatively low approaching the New Year and into 2015.
Concerns of sluggish
global oil demand combined
with abundant supply continue to
leave global oil markets searching for a bottom.
Last week, for the first
time since 2009, the price of
West Texas Intermediate dropped
below $60. WTI is now approximately 40 percent cheaper than
the start of the year and nearly
50 percent below the high in June
($107.26).
The Organization of
Petroleum Exporting Countries
(OPEC) continues to maintain
production levels, and the cartel’s three biggest members are
reportedly ramping up exports to
Asia in an effort to sustain market
share in that region.
Reductions in global oil
prices have ultimately meant a
welcome savings at the pump for
motorists; however sustained low
prices could impact U.S. production.

prices hit a record low of $1.95at Gas Mart Gas Station at Deforest Avenue and
Lee Road. The $1.95 is the lowest price in Cuyahoga County.

Franklin Cohen to retire from orchestra Five advances in 50 years of progress against cancer
The Cleveland Orchestra today announced that
Franklin Cohen, principal
clarinet since 1976, will retire
from the ensemble in the summer of 2015. After 39 seasons,
Cohen will have had the longest tenure of any solo clarinetist in the orchestra's history.
The title of Principal Clarinet
Emeritus will be bestowed
on Cohen next summer upon
retiring. He will be the first
Cleveland Orchestra musician
officially recognized with this
honor.
Cohen joined The
Cleveland Orchestra at the
invitation of Music Director
Lorin Maazel. In 1968, he
gained international recognition as the first clarinetist to
win the First Prize at the prestigious Munich International
Music Competition.
Cohen is one of the
few musicians of his time to
combine a world class solo,
chamber, and orchestral career. He is widely considered
among the great musicians of
his generation. Acclaimed
for the strength, passion and
beauty of his playing, he is one
of the most frequent concerto
soloists in the history of The
Cleveland Orchestra, appear-
ing as soloist at Severance Hall,
Blossom Music Center, Carnegie Hall, and on tours throughout the United States, Asia and
Europe to critical acclaim.
During the span of
Cohen’s career, he has been
heard in many thousands of
concerts and broadcasts. His
commercial recording credits won a Grammy Award and
much critical acclaim. His
unique, expressive sound and
musicianship have brought a
distinctive voice to The Cleveland Orchestra for many years.
He has earned glowing praise
for his poignant musicality and
technical mastery. Cohen has
performed with many of the
great string quartets of the 20th
Century.
He has taught and
performed at virtually all the
major American music festivals
and has served as Department
Head at the Cleveland Institute
of Music for 39 years. He has
been an honored juror at many
prestigious international music
competitions.
Two special concerts in tribute to Cohen’s distinguished career are being
planned for June 19 — Celebration Concert, ChamberFest
Cleveland, at Harkness Chapel
and July 26— Blossom Music Festival Concert with The
Cleveland Orchestra , conducted by Jahja Ling.
In demand internationally as a performer and
teacher, Cohen looks forward
to an expanded career as soloist and collaborative artist, in
addition to mentoring the next
generation of young musicians.
His new multi faceted artistic
life will take him to Asia, Italy,
Scandinavia, France, South
America, Canada and throughout the United States.
Cohen will continue as co-artistic director of
the acclaimed ChamberFest
Cleveland, will launch a new
custom-made clarinet mouth-
piece company and also plans
to conduct. He also looks forward to traveling the world
with friends and family.
With his daughter,
violinist Diana Cohen, Franklin Cohen is the co-artistic
director of the critically acclaimed ChamberFest Cleveland, the first international
summer chamber music festival in Cleveland, which presented its inaugural season in
2012. ChamberFest’s huge
success has led to an expanded
vision for growth locally and
internationally.
A native New Yorker, Franklin Cohen started music lessons with his mother, a
professional pianist. He began
clarinet studies at the age of
10, and his professional music career was launched when
Leopold Stokowski chose him
as principal clarinet of the
American Symphony Orchestra while a student at Juilliard.

America’s women veterans deserve better treatment at home
By GARRY J. AUGUSTINE
More than a quartermillion American women
served honorably in the Iraq
and Afghanistan wars. These
brave women sacrificed
much to keep us safe. Now
that they are home, our country has a solemn obligation to
help them transition back to
civilian life.
Yet there is mounting evidence that America is
not fulfilling this obligation.
Based on currently available
data, it is clear that our country isn’t fully meeting the
unique physical, emotional
and employment needs of
women veterans. When they
return home, they receive
less support than their male
counterparts from government programs primarily designed for men.
Today, nearly one
in five women veterans has
delayed or gone without
necessary health care in the
past year. One in 11 is unemployed. Former servicewomen experience homelessness
at between two to four times
the rate of their civilian counterparts.
It’s unacceptable
that the women who honorably served our country-our
mothers, spouses, sisters and
daughters-are at risk. A new
report released by my organization, Disabled American
Veterans, finds that the federal, state, and community
programs to support women
transitioning out of military
service have serious gaps that
put some women veterans in
jeopardy.
Consider medical
care. Today, one-third of the
Department of Veterans Affairs medical centers lack a
staff gynecologist and 18 percent of VA clinics have yet to
hire at least one doctor specializing in women’s health.
To help consumers
enter the New Year with a
better understanding of their
spending habits and overall finances, Charter One is
encouraging consumers to
take the time now to establish their savings goals and
to consider some simple, but
effective budgeting strategies
as part of their financial planning for 2015.
“The end of the
year is the perfect time for
consumers to review their
finances and to conduct a
simple financial tune-up that
can help them recognize any
patterns they want to change
or new opportunities to save
in the year ahead,” said John
Rosenfeld, head of Everyday
Banking for Citizens. “We
encourage consumers to take
the time to review their budgets and start thinking about

To help consumers
manage their money, prevent
the accumulation of debt and
make sure they are best positioned for the New Year,
Citizens Bank suggests the

1. Review your
spending in 2014 and adjust
your 2015 budget – Budgeting is not just about saving
money. It also is about taking
control of your spending and
gaining a better understanding of where your money is
going. Small, but recurring
expenses like your morning
latte can add-up. Compare
your monthly income to
what you’re spending every
month. Adjust your 2015
budget accordingly so you
start the New Year with realistic goals and expectations.
2. Make a plan to
pay off holiday spending
debt – Many people use credit cards for holiday spending
to earn cashback or rewards
points, but that really only
makes sense if you pay it off
quickly. If you paid for your
holiday costs with a credit
card (e.g. gifts or travel), set
a plan to pay off your debt by
a specific date, such as Valentine’s Day. This will force

not have enough sexual trauma specialists on staff.
We are not doing
much better when it comes to
helping women veterans gain
post-military employment.
Former servicewomen are
highly skilled, with unique
life experiences that give
them valuable leadership
qualities and the know-how
to operate effectively in highstress situations.
Yet the unemployment rate for female veterans
has steadily climbed for most
of the past decade. What’s
more, two-thirds of women
veterans report that the career
service help offered by federal agencies has been sub-par.
These
problems
could soon get worse. The
military has started on a major draw-down of personnel. As a result, more than
200,000 current servicewomen are expected to rejoin the
civilian workforce in the next
five years.
Now is the time for
action.

3. Max out your retirement savings – There’s
not much time left - contribute as much as possible to
your 401(k) before December 31 – most worker can
contribute up to $17,500. To
make the most of your IRA,
you have until you file your
tax return in 2015 to max out
your contribution, which is
set at $5,500, with an extra
$1,000 “catch-up” option for
people over the age of 50.
4. Refinance or consolidate your student loans
– A lot of people don’t realize that you can refinance a
student loan just like a mortgage, even if it was a Federal
Student loan. Refinancing
can help you lock in a lower
interest rate and save money
going into 2015. Consolidating your loans will make it
easier to keep track of your
payments and also perhaps
get a lower interest rate.
5. Review your
credit card interest rates -- If
you’re still planning to carry
a high amount of credit card
debt into 2015, check for end
of year specials that allow
you to transfer credit card
balances with low fees and
offer 0% interest for the first
year. A few banks may even
waive the balance transfer fee
(Typically 3 percent). Look
for lower credit card rates
and consider consolidating
high balances to the card with
the best rate. It’s a quick and
easy way to save on interest
while you pay off the debt.
If you are carrying balances
from holiday shopping, make
paying them down as quickly
as possible a priority.
6. Seek advice –
Talk with your banker, financial advisor or accountant
for additional suggestions.

A Look At My World
Do Christmas temptations really count?

All my life I have
been careful about succumbing to the temptations of life.
I have not always been successful and have fallen into
some. Oscar Wilde famously
said, “I can resist anything
except temptation.” We all
know the end of his life.
Temptation is the
hardest thing in life to resist.
I have watched myself and
in spite of watching myself,
I have succumbed to temptation. Just when I think I have
overcome everything and
have stepped beyond temptation, I find myself tempted.
It is not being
tempted that is difficult, because everybody is tempted.
The hymn writer said, “Yield
not to temptation, for yielding is sin.” So the temptation
is not sin, it is how I react to
that temptation.
I must say I have
had some abundant help from
the Gracious Mistress of the
Parsonage whose major role
in life is to keep me from
yielding. She has kept me
from who knows how much
yielding I will never know. I
do know this, I do not want to
yield to some temptation and
then have to face her. Enough
said.
But this is the
holiday season, celebrating
Christmas and everything
that goes with it. One major
activity that goes with this
kind of holiday is eating.
Now eating is something we do all the time; at
least I do. It is not the eating; it is what I am eating that
poses some problems. The
Christmas holiday offers so
many cookies and cakes and
pies that I cannot eat them all,
but I try. Oh boy, do I try.
“Don’t you think
you have had enough cake?”
She always asked me in the
middle of eating a piece of
cake. If my mouth was not
full with cake, I would like
to tell her, “No, I don’t think
I have had enough cake and
when I do I’m certainly not
going to tell you.”
You all know where
that will get me!
What I want to
know is simply this; how
much cake or cookie or pie is
really too much? It is a simple question and I would like
to have a simple answer.
Where I get into
trouble is when my wife and
I go to some Christmas party.
I feel as a responsible partygoer I need to taste all of the
cake and cookies that the gracious host has provided for
us. That’s just the way I think
about it. I believe it would be
insulting to go to a party and
not eat all of the party vittles,
at lease sample them.
My wife, as you
may guess, has an altogether
different view of it. She has
this strange notion that when
I go to a party, particularly
when she is accompanying
me, the less I eat the more I
honor the hostess. According
to her, I should leave a party
hungry.
My idea is simply
that if it is a holiday party
with Christmas cakes and
cookies the calories are on
holiday and do not count.
At least I am not counting
them. I think at Christmas

Legal Court Interpretation
Records and frivolous conduct serves to hinder

Immediately following a meeting of the West
Licking Joint Fire District
Board of Trustees – at about
9 p.m. on Thursday, December 8, 2011 – John H. Davis
made a request under the
public-records act for the
personnel records of six employees of the district.
Davis made the
request to Terra Woolard
Metzger, who was responsible for public records for the
district. The requests were
similar and sought records
regarding work performance,
disciplinary actions, and any
other documents that would
indicate that the employees
couldn’t perform their jobs.
On Tuesday, December 13, at about 11:30
a.m., Davis called Metzger
to ask about the status of the
requests. Metzger told Davis
that the requests were being
reviewed by legal counsel
before release. Davis didn’t
raise any objection during
the phone call. But, later that
day – at 1:59 p.m. – he filed
a lawsuit with the court of
appeals because the district
hadn’t produced the records.
Meanwhile,
the
district’s legal counsel completed the review of the requested records the same day,
and Metzger sent the documents to Davis by e-mail at
3:28 p.m. that very afternoon.
Nevertheless, the next day
Metzger was served with the
complaint Davis had filed.
The court of appeals eventually held that
Metzger’s production of the
requested documents less
than three business days after
the requests were made was
reasonable. It also found that
Davis had engaged in unnecessary discovery and motion
practice in the case, and it
awarded Metzger attorney
fees and costs – subject to
a hearing to determine their
amount and reasonableness.
But before that hearing occurred, Davis filed an
appeal with us – the Supreme
Court of Ohio.
Davis argued that
the requests he made were
virtually identical to one that
had previously been sent to
the district in May 2011, apparently requesting his wife’s
employment file. He maintained that the district didn’t
find the May 2011 request
ambiguous, but the district
claimed – in its letter producing the records at issue in this
case – that Davis’s requests
were in part ambiguous.
That letter also invited Davis to resubmit the
requests with clarification.
Davis argued that because
the district failed to inform
him of the manner in which
records were maintained by
the office and never provided
him with a written explanation of why some records
were not provided, the district had denied his request.
But he never informed the
district that its response did
not satisfy his requests.
As Davis himself
pointed out, previous court
decisions have established
that it is the requester’s responsibility to identify with
reasonable clarity the records
he wants to inspect. Therefore, it wasn’t unreasonable
for the district to ask Davis
to clarify his requests. In fact,
Ohio law states that a public
office may deny an ambiguous request but must provide
the requester with an opportunity to revise the request.
Davis also argued
that the reason Metzger gave
for asking counsel to examine the records before they
were produced was not an
acceptable reason under the
public-records act. However,
the act gives the public office
an opportunity “to examine
records prior to inspection
in order to make appropriate
redactions of exempt materials.”
Davis argued that
the district sought the advice of counsel because of
pending litigation involving
his wife and the district. He
maintained that the review
was requested to gain an advantage in that litigation.
We found that his
argument lacked merit. Legal
counsel for the district had
access to the records even
before Davis’s request, and
thus any inspection of them
before production would
have been of no advantage in
the lawsuit. The review had a
minimal impact on the timeliness with which the district
produced the records. And
personnel files require careful review to redact sensitive
personal information about
employees that does not
document the organization or
function of the agency.
Simply put, the district was not remiss in delaying the response for a short
time to allow counsel to review the records before they
were produced.
Additionally, Davis
argued that the response was
incomplete because a personal evaluation of one employee – and associated e-mails –
was not produced. But Davis
never amended his complaint
to allege that the district had
withheld those documents.
Finally, Davis asserted that the court of appeals abused its discretion
when it found – without
holding a hearing – that he
had engaged in frivolous
conduct. The Ohio law dealing with “frivolous conduct”
defines it, in part, as conduct
that “obviously serves merely to harass or maliciously
injure another party to the
civil action ... or is for another improper purpose, including, but not limited to,
causing unnecessary delay
or a needless increase in the
cost of litigation.”
The court of appeals concluded that Davis’s
conduct met this definition
because he filed his action
within hours of being told
that his records request was
being reviewed and then
failed to dismiss the action
once he received the documents from Metzger. And
despite the production of the
records, Davis engaged in
lengthy discovery and filed
numerous motions. Plus,
he never amended his complaint to indicate that he had
received at least some of the
documents that he had requested.
But Davis did point
out – rightly – that the court
had not held the hearing that
is required by law before
awarding attorney fees and
costs for frivolous conduct.
That hearing never took
place because Davis filed his
appeal with our court.
After reviewing the
case we concluded – by a
seven-to-zero vote – that the
district substantially complied with Davis’s publicrecords requests in less than
three business days. That
response time was reasonable. We therefore affirmed
the court of appeals’ grant of
summary judgment dismissing Davis’s complaint.
However, because
the court of appeals did not
hold a hearing before it determined that Davis had engaged in frivolous conduct,
we reversed the judgment on
that finding, and we sent the
case back for the court of appeals to conduct a hearing in
accordance with the law.

Raise awareness for

personalized
advice: Throughout the military career lifecycle, active
military, reservists and retired
military personnel have access
to specific savings, investing
and spending resources. But
nothing takes the place of personalized financial/tax advice
and lifetime personal finance
education.
Veterans can view
and download resources such
as budgeting tips, tax break
information and educational
games from the Veterans Financial Coalition. As part of
the Coalition’s free resources,
the AFCPE also provides an
online database to locate a
certified professional financial
counselor to help with savings,
spending, investing and tax issues.
On the credit front,
Wells Fargo has partnered
with the National Foundation
for Credit Counseling and its
Sharpen Your Financial Focus
initiative to deliver Wells Fargo’s Hands on Banking (http://

servicemembers.

U.S. Department of Veterans
Affairs (VA) is a first-step
clearinghouse for information
on VA career, educational, financial and vocational rehabilitation assistance. Workshop
and video guides are available
on the site in addition to links
to the Veterans Opportunity
to Work (VOW) program and
other VA training and career
success programs.
The U.S. Department
of Labor’s Career One Stop
site also offers additional information on military-specific

Avoid scams. Sadly,
active and returning military
personnel are often targets
for a diverse range of financial fraud. Veterans Financial

Survival Guide for Servicemembers and Veterans.
Get tax help. The Internal Revenue Service website provides a variety of tax
resources for active military
and veterans. It is also worthwhile to work with a licensed
tax professional with expertise in military transition issues. It’s a good idea to rely on
trusted friends and family for
referrals to tax professionals
who have experience working
with active military and veterans, but you can also contact your state CPA (Certified
Public Accountant) society to
gather names of professionals
in your area. Always remember to interview professionals
before you hire them.
Go deeper on education breaks. Check the U.S.
Department of Veterans Affairs website for its education
benefits. The Post-9/11 GI Bill,
for example, may cover the
full cost of in-state tuition and
fees for a public college for up
to 36 months (four years) after release from active duty.
A combination of VA tuition
and training programs can offer more assistance. Student
aid programs also exist for
the children of deceased and
disabled veterans. FinAid.org
offers background on many of
these programs.
Bottom line: If
you’re a veteran or know one,
take advantage of the full
range of financial, career and
training resources to secure a
bright, post-military future.

Q: What is a health
care power of attorney?
A: A health care power of attorney (HCPOA) is a
legal document authorizing a
person you trust (your “agent”)
to make health care decisions
with or for you in any health
care situation (involving, for
example, hospitals, nursing
homes, dentists, doctors, pharmacists and EMTs).
Q: When can my
agent make health care decisions?
A: Depending on the
option you choose, your agent
can make health care decisions
with or for you:
with you, beginning
immediately and at any time
for as long as the HCPOA is in
effect;
for you, beginning
immediately, but ending on a
specific date (following surgery, for example, or continuing if, on the end date, you
cannot make health care decisions for yourself);
for you, but only
when you cannot make health
care decisions for yourself.
Q: What if I want to
name a different agent?
A: You can execute a
new HCPOA, which automatically revokes the earlier document.

the burden of end-of-life decisions from your health care
power of attorney agent. If,

only a health care power of
attorney, you are authorizing
your agent to make all health
care decisions, including the
use or termination of life-support and artificial nutrition
and hydration, subject to the
restrictions noted above.
Q: Must I choose a
family member to be my health care power of attorney
agent?
A: No. You may
appoint any adult you wish,
except for your doctor or
the administrator of a health
care facility in which you are
being treated, or any employee of your doctor or a health facility in which you are
being treated.
Q: Can I use a health
care power of attorney to take
care of my mother’s finances?
A: No. You must
use a different (“financial”)
power of attorney document
to address your mother’s bu-
siness affairs.
Q: Can I use a health
care power of attorney to nominate a guardian for me, my
minor children, or my adult
disabled children?
A: Yes. With a health
care power of attorney, you
can usually avoid the need
for a guardian, but you can
nominate a guardian through
this document. Your guardian
should be someone you trust
to handle your person, your
estate, or both (and those of
your minor or adult disabled
children). You may also allow
the guardian you name to nominate a successor guardian.

form? Can I draw up my own?
A: The Ohio State
Bar Association has developed standard health care
power of attorney and living
will forms with Midwest Care
Alliance, the Ohio State Medical Association, the Ohio
Hospital Association and the
Ohio Osteopathic Association. For a copy of these forms,

or attorney. You do not have
to use the standard form, but
the standard form is widely
recognized, and includes the
necessary specific language
required by Ohio law.
Q: What do I do after I complete my health care
power of attorney?
A: Make several copies. Keep copies with your
personal papers and in your
car, and give copies to your
agent, family members, your
physician and your lawyer.

Rural areas could beneifit from closing digital divide
“A big win for rural
communities.” That’s how
the National Rural Assembly
views President Obama’s endorsement of treating broadband service like telephone
service.
Edyael Casaperalta,
who coordinates a national
coalition of groups advocating for those who live in rural
areas, said Obama’s call for
the Federal Communications
Commission to reclassify
broadband as a Title II service under the Telecommunications Act not only protects
an open Internet, but “also
begins a conversation about
how do we bring high-speed,
affordable, quality Internet
to rural areas? Because that
is what we have done before,
with telephone.”
While supporters of
the idea claim it would close
the digital divide in broadband-starved areas of Ohio,
House Speaker John Boehner
has called it a “misguided
scheme to regulate the Internet.”
Casaperalta said regulating broadband like basic
telephone service should not
be a partisan issue.
“It should be about
how do we collectively work
together to improve the information and communications infrastructure of our
country,” Casaperalta said,
“because it benefits us all,
right?”

Group of the National Rural
Assembly, of the 19 million
Americans who don’t have
Internet access, more than 14
million live in rural areas.
Talk-to-text, microphone headsets and voice
navigation systems may keep
your eyes on the road, but a
new study finds hands-free
technology in newer cars is
not risk free.
According to the
research from the American Automobile Association
(AAA), three out of four drivers believe hands-free technology in their car is safe to
use, but that may not always
be the case.
Bill Purpura, a
spokesman for AAA-Ohio,
says these newer technologies can give drivers a false
sense of security.

Joe Thomas, LT, eighth Pro Bowl: Thomas has become an annual no-brainer at left tackle, as his play puts
him among the best in the league at the position every

Connor Shaw to start as QB for Browns
To solve their quarteback problem, the Browns on Tuesday signed veteran quarterback Tyler Thigpen, and he’ll now begin
preparing to play Sunday against the Ravens, according to a league
source. The Browns attempted to convince quarterback Rex Grossman to sign with them, but a source said he declined their offer.
Browns rookie quarterback Connor Shaw took the first-team snaps
in practice Tuesday and is preparing to start. Thigpen is expected to
back him up. Johnny Manziel is out for the season with a significant
hamstring injury and Brian Hoyer is dealing with a shoulder injury.
Thigpen, who was with the Browns during the preseason before being released, has passed for 3,222 career yards, 21 touchdowns, and
18 interceptions for a 72.5 quarterback rating.
In search of a Browns QB for final game

If someone were to
suggest making an episode of
that famous old Sci-Fi whodunit series and entitle it, “In
Search of…a Browns QB,”
Leonard Nimoy would probably turn down the role as
voice-over host because the
episode would be considered
too bizarre and implausible.
Sadly, that’s where we stand
today in Brownstown.
A lot of falling occurred during last Sunday’s
17-13 loss to Carolina. Johnny Manziel literally and figuratively fell on his derriere
again and then had a couple
of Panthers fall on him during
an ill-advised scramble for an
extra couple of yards.
Brian Hoyer, the
hometown hero who fell
out of favor after losing his
throwing accuracy almost
overnight, returned to action
and put up 10 points, but still
fell short. Also, 315 pounds.
of Carolina BBQ shoulder
fell on his shoulder late in the
game on a particularly harsh
sack as the Browns centerfor-the-day (that’s another
“In Search of…” subject),
did his best Matador impersonation. Ole’!
Coach Mike Pettine
already has ruled out Manziel
for the season finale against
the Ravens, who are fighting for their playoff lives,
and isn’t sure if sore Hoyer
will be healthy by Sunday.
That means that practice
squad undrafted Rookie QB
Connor Shaw would get the
start. If so, he would be the
22nd starting QB for the
Browns since their rebirth
in 1999. Shaw has not seen
playing time during the NFL
regular season, so no one really knows how he would
do. Plus, somebody at least
would have to be his backup.
So, veteran QB Rex
Grossman, who had a tryout
with the Browns in Training
Camp before being cut, was
contacted, but he turned them
down. It was reported at press
time that the Browns next
were looking to veteran Tyler Thigpen, who was cut in
Training Camp even before
Grossman. If he turns them
down, they can’t look to the
Dawg Pound for volunteers,
because it’s an away game.
Hello? Does anyone out there
want to be a Browns QB?
Looking back at
the loss to the Panthers, the
defense permitted 209 yards
rushing and allowed 201
yards passing to Cam Newton, returning to play less
than two weeks after suffering two back fractures in a
car crash.
To his credit, Newton called his own fans
“classless” for cheering when
Manziel went down, saying,
“Anytime when a person gets
hurt, you don’t celebrate,”
and said, “We’re better than
that.”
Meanwhile,
the
Browns offense, for the second straight week, failed to
break double digits in 1st
Downs. They totaled eight,
a week after scraping out a
mere five. The Browns gained
just 84 yards rushing and
144 passing (32 by Manziel,
132 by Hoyer, before sacks),
with 81 of those coming on
one play – a Hoyer to Jordan
Cameron TD pass. Pettine
summed it up after the game,
saying, “Offensively, we’re
not near good enough to win
in this league.”
After Cameron’s TD
reception temporarily gave
the Browns the lead, RB Jonathan Stewart, who gained
122 yards rushing, caught a 9
YD TD Pass for what proved
to be the winning TD halfway through the 4th Quarter.
On the following series, Panther DB Josh Norman made a
spectacular interception of a
Hoyer pass, returned the ball
33 yards while carrying it
like a loaf of bread, and Travis Benjamin, for whom the
pass was intended, tracked
down Norman, clubbed the
ball out of his hand, and recovered the fumble to give
the Browns a second chance.
Unfortunately, after gaining
two 1st Downs, the Browns
punted and never got the ball
back.
Knowledgeable fans
have noted that the Browns
offense began to unravel
when the team lost Pro Bowl
Center Alex Mack. All-Pro
T Joe Thomas, addressing
the media, gave this premise some credence as he laid
much of the problem with
the offensive line to the loss
of Mack, saying, “The center
position is the guy that kind
of orchestrates the blocking…and there’s a lot of communication that has to happen
between the center and the
rest of the guys… It becomes
difficult at times having a
bunch of different centers in
there, especially after having
one guy for so long.”
Cavs win big at home against top teams

In a game on Tuesday night at the ‘Q’, the Cavs
beat Minnesota 104-125 as
they had won two big games
during their pre-Christmas
homestand. First, before a
contingent of Big Apple media, they beat Brooklyn, 9591, and next they welcomed
the Nets with the second best
record in the NBA, and came
away with a solid 105-91
win.
In the Nets game,
they didn’t have to think
about royal protocol like they
did when they won two weeks
ago in Brooklyn before Prince
William and Duchess Kate.
This time, they just played
good basketball. Mike Miller
was given the start following
a seven-game hiatus while
recovering from concussion
symptoms and responded by
scoring 21 points by going 7
of 8 from three-point land.
Afterward, Coach
David Blatt gave props to
his hot shooting night, quipping, “When the fire is hot,
you want to let it burn. It was
burning tonight.”
Shawn Marion, who
was displaced by Miller,
came off the Bench to score
eight on 4 of 6 shooting.
LeBron James led the Cavs
with 22. The only reason that
Cleveland didn’t win by more
was that Kevin Love was a
horrid one of 10 from the
field and subsequently was
used as a decoy throughout
the 4th quarter. He still contributed with 14 big rebounds
and 3 blocks.
The Nets were still
without C Brook Lopez, but
Mason Plumlee continued
his fine play inside, with 14
points and nine rebounds. PG
Deron Williams sustained a
calf strain early on by chasing Kyrie Irving around the
court.
Old Friend Jarrett
Jack came in for Williams
and did admirably, by being mostly responsible for
holding Irving to a lackluster 6 of 18 from the field for
16 points, while scoring 13
points himself. Jack told Mi-
nority Publishers Assn, “It
was nice to be back. It’s good
that they put together this
team for the fans and they
showed that they appreciate
it. They’re very good and
LeBron is a real load.”
A couple of nights
later, the Cavs changed leading man as Miller was scoreless and Dion Waiters came
through with 21 points, 13 of
them in the 4th quarter when
Cleveland ran away. Marion,
off the Bench, was 5 of 6 for
11 points. Also, Anderson Varejao parlayed that short hook
shot of his into 18 points
while pulling down seven rebounds. The Cavs constantly
ran to the basket and the
Grizzlies couldn’t stop them
as Cleveland posted 60.5%
shooting. Five Cavs hit double figures as James led them
with 25 points and 11 assists.
Irving had 17 points and also
11 assists.
Its amazing that
Memphis even stayed in the
building as they shot an eyepopping bad 6.3% (1 of 16)
from the perimeter, while
the Cavs were 50% (7 of 14)
from Downtown. Officials
rarely called shooting fouls
as the Cavs were 6 of 10 from
the Charity Stripe, while the
Grizzlies went 12 of 15. C
Marc Gasol led Memphis
with 23 points and 11 rebounds. The Cavs won the
game, 105-91.
Afterward, Memphis Coach David Joerger
heaped praise on the Cavs,
saying, “I don’t think the
game was as close as the
score indicates. This is a super team. They have three
guys that are max (contracts)

as they are second ranked in
the NFL on offense, while being historically uncharacteristic, 20th in defense.
Yet, in last Sunday’s
battle, the Steelers defense
crown next week in Pittsburgh. The NFL TV contract
was invoked to change the
original 1 p.m. start to the
Sunday Night Football game.

Seki challenges five times for titles
Mitsunori
Seki
was good enough to challenge for a world title no
less then five times during
the 1960′s.
Seki first attempted to win the flyweight
title from Thailand’s Pone
Kingpetch in 1961. On this
occasion Seki lost a close
decision. Seki would move
up to bantamweight but he
met disaster at the hands of
Mexico’s Joe Medal who
stopped him in five rounds.
Seki then entered
the featherweight division
and eventually earned a
shot at champion Sugar
Ramos in 1964. The talent-
Seki
ed Ramos proved to be too
much for Seki and retained
his crown.
Ramos would later
lose his championship to
the great Vincente Saldivar.
Seki would get yet another
chance at the title as he met
Saldivar in 1966.
It was a tough
fight but Saldivar would
retain his title. It was close
enough to justify a rematch
so Saldivar and Seki went at
it again in 1967. This time
Saldivar proved he was the
best featherweight in the
world.
Saldivar
would
then relinquish the title after
defeating Howard Winstone
for the third time. The WBC
matched Seki with Winstone for the vacated crown.
Seki would lose
by a controversial stoppage
thus failing in his fifth attempt at world honors.
Seki would retire
after the loss to Winstone
with an outstanding 61-11-1
record. He scored 35 knockouts.
Seki along with
Hiroyuki Ebihara, the great
Fighting Harada and others
helped follow 1950′s flyweight titlist Yoshio Shirai
in establishing Japan as a
force to be reckoned with in
the world of boxing.
At the time of his
death in 2008, Seki was a
successful and a respected
trainer. May he rest in peace.

show's fifth season. His guest

at the Apollo.” She was part of
the record-breaking “Queens of
Lowdown
Comedy” tour in 2000 in which
she was registered in Guinness'
Book of World Re-cords when
she performed to a captivated
audience of more than 50,000
people in Atlanta, Georgia.
The 2001 made-for-television
movie based on that tour was
the highest-rated and longest
running special in the history
of the Showtime Net-work.
Sommore was a featured comic in the “Latham Entertainment Presents” tour in 2002,
where she was the only woman
performer.
In 2002, Sommore
made her film debut in Friday
After Next. She has been featured in a number of other films
including, Family Reunion
(2002), Soul Plane (2004),
Something New (2006), and
Dirty Laundry (2007).

To ensure freshness
of your baking powder, the

To get the best leavening, it’s not only important
to know the expiration date,
but also to remember when you
opened the can.
Baking powder starts
to react as soon as the can is

on the bottom refers to the latest date you should open the

½ c. vegetable shortening
½ c. butter
1½ c. granulated sugar
2 c. cake flour

½ tsp. salt
⅓ c. sour cream
3 Tbsp. bourbon whiskey
4 eggs
¾ c. chopped pecans

Instructions:
Set oven rack to middle
location and preheat oven to 350
degrees F.

In a large bowl, cream
together shortening, butter and

aside. In a medium bowl,

salt; combine well, add to
creamed mixture, and mix
on low speed 1 minute.
Add sour cream, whiskey,
eggs, and beat on medium
speed 2 minutes; mix in

Herbie Hancock
Pianist-composer Herbie Hancock was born in 1940
in Chicago. Early music studies
led him to play Mozart's Piano
Concerto in D major with the
Chicago Symphony Orchestra
by age 11. But Hancock preferred jazz and formed a high
school ensemble.
By 1960, he was performing in Chicago jazz clubs
with Coleman Hawkins and
Donald Byrd. Hancock joined
Byrd's group and moved to New
York.
Following his first
recording session with Byrd, he
was signed by Blue Note and
made his recording debut
with Takin Off in May 1962,
gaining notice with his original
tune, "Watermelon Man."
Hancock joined the
Miles Davis quintet in 1963
and remained for five years,
creating tunes that have become
standards.
Leading his own sextet
from 1971-73, Hancock melded
elements of jazz, rock, with
African and Indian themes by
using electronic devices and
instruments.
After his Headhunters
album, Hancock produced
more commercialized music
throughout the 1970s, occasionally returned to jazz with
his V.S.O.P. band and piano duos
with Chick Corea. By the 1980s,
Hancock was creating
fascinating music using complex innovative electronic technology.
Hancock recently released his first acoustic recording in many years, The New
Standard, where he and
his veteran sidemen reinvent
nine time-honored tunes, sometimes backed by a studio
orchestra.

'Jungle Fever' served as launching pad for actors

The once controversial subject of interracial racemixing in film began with the
motion picture ‘classic’, Birth
of a Nation (1915). However,
because of societal, institutionalized racism, black male/white
female relationships were always more frowned upon than
their white male/black female
counterparts.
In 1957, Harry Belafonte (black) had an ‘arm’slength’, implied romance with
Joan Fontaine (white) in Island
in the Sun. In One Potato, Two
Potato (1964), Barbara Barrie
(white) and Bernie Hamilton
(black) were an interracial, married couple who go to court to
win custody of her white daughter from her first marriage.
In A Patch of Blue
(1965), a blind, white girl (Elizabeth Hartman) falls in love with
a kind, black man (Sidney Poitier). In 1967, Poitier stars as a
black doctor who, with his white
fiancé (Katherine Houghton),
brings their parents together to
announce their engagement.
In the western 100
Rifles (1968), football legend
turned actor Jim Brown beds
white beauty Rachel Welch.
And, in The Great White Hope
(1970), James Earl Jones portrays the first, black, heavyweight boxing champion who
has a tragic relationship with a
white, English, ex-society belle
(Jane Alexander).
With this cinematic
history before him, AfricanAmerican director Spike Lee
decided to do his own take on
the black male/white female,
interracial relationship. Known
already for his racial, hot-topic
films like School Daze (1988)
[about colorism issues between
lighter-skinned and darkerskinned factions at a black college] and Do The Right Thing
(1989) [about multiracial prejudice amongst various, racial
and ethnic groups in a Brooklyn
neighborhood], Lee
made his contribution to
the genre with Jungle Fever
(1991).
It begins with Flipper
Purify (Wesley Snipes): a successful, dark-skinned, AfricanAmerican architect who is happily married to Drew (Lonette
McKee): a very light-skinned,
white-looking mulatto. Together, they have a cute, brownskinned, seven-year old daugh-
ter named Ming and live in an
upscale, Harlem brownstone
apartment. Flipper’s two, white,
executive supervisors, Jerry
and Leslie, assign an attractive,
white, Italian-American, tempsecretary named Angie Tucci
(Annabella Sciorra) to work under him.
At Angie’s modest
home in Bensonhurst, she comes
home every evening to cook
dinner for her father, Mike, and
her two, adult brothers, Charlie
and Jimmy. Flipper and Drew’s
similarly-professional, married
friends, Cyrus (Spike Lee) and
Vera (Veronica Webb) associate in an educated, middle-class
atmosphere, while Angle continues to date long-time, kindhearted boyfriend Paulie Carbone (John Turturro).
Flipper’s
parents,
‘The Good Rev. Doctor’ (Ossie
Davis) and Lucinda (Ruby Dee),
are often visited by Flipper’s
drug-addicted, homeless older
brother, Gator (Samuel L. Jackson).
Gator regularly bums
money from his soft-hearted
mother against his strict father’s
wishes. After working late several nights and becoming more
at easewith each other, Flipper
and Angie cross that forbidden
line and become sexually intimate.
At Paulie’s father
Lou’s (Anthony Quinn) Candy/
Soda Shop-Store, Paulie must
contend daily with the Italian locals (Sonny, Veeshay, Patty and
Frankie Botz) who are ‘led’ by
the hot tempered Vinny (Nicholas Turturro). They tease Paulie
for defending a black, female,
store regular named Orin Goode
(Tyra Ferrell). When Jerry and
Leslie refuse to make Flipper a
partner in the firm, he quits and
walks out.
One night at a park, Flipper tells
Cyrus about his affair with Caucasian Angie. Cyrus tells Flipper he has ‘Jungle Fever’ and
that he has ‘bad feelings’ about
this ‘news.’ They run into Gator and his ‘crack-ho’ girlfriend,
Vivian (Halle Berry). Flipper
gives him some money. Also,
in Bensonhurst, Angie tells her
friends Denise and Louise she’s
dating a black man.
After Vera tells Drew
that Cyrus told her about Flipper’s white mistress, a furious
and enraged Drew throws Flipper out of their home. That
night, Drew and Vera have a
‘War Counsel’ with their girl-
friends Nilda, Inez and Angela
to debate why ‘brothas’ go after
‘white girls’.Cyrus apologizes to
Flipper for telling his secret.
Flipper tries to make up with
Drew at her job as a buyer for
Bloomingdale’s, but she sends
him away. Angie breaks up with
Paulie, who is heart-broken.
Angie’s father Mike curses and
beats her severely after discovering her affair and he must be
restrained by his two sons before
he throws her out.
Flipper and Angie
move into their own apartment.
When Flipper and Angie have
dinner with his parents, the
Good Rev. Dr.preaches to them
on the historical significance
of white/black, American racemixing before piously walking
out on them. Meanwhile, Paulie
finally asks Orin out on a date.
When Gator takes his
parents’ TV, Flipper searches the
streets and finds him at a crackhouse nicknamed ‘The Taj Mahal’. When Gator confesses to
his brother that he sold the TV
for
drug money, Flipper disowns
him for good.
After discussing their
bleak future, Angie leaves Flipper and returns to apologize to
Paulie, who politely dismisses
her. When Paulie tells Lou he
is going out with Orin, his dad
chastises him as Paulie is later
harassed by Vinny and the store
locals. Flipper and Angie formally end their relationship.
When Gator sneaks in to talk
with Lucinda while the Good
Rev. Dr. walks his dog, he goes
into a manic rave, trying to find
money in the apartment. When
the overtly religious father returns, he feels his only recourse
is to shoot hisson in the stomach.
While Mahalia Jack-
son wails on a stereo record,
Lucinda wails in agonized
grief over the loss of her first
born. In the end, Flipper and
Drew reconcile in emotional
love-making, leaving viewers
the probability that they will
be a family once more.
Jungle Fever’s music soundtrack was composed
by R&B/Soul/Pop legend
Stevie Wonder. The movie
also served as the launching
pad for the careers of Wesley
Snipes, Samuel L. Jackson,
Annabella Sciorra and Halle
Berry. And, the film continues to be one of Lee’s finest.

alike than we are different. Basketball brings us
all together,” Christensen
said.
As one of the
‘Ambassadors of Goodwill” Christensen greeted
patrons at the Dunkin
Donuts, and bought their
morning cups of coffee
on Wednesday morning.
Later in the afternoon, Christensen surprised students at several
Cleveland area schools
and he brought presents
for the students.
Not only is
Christensen one of the
Globetrotters’ premier
ball handlers, he also has
a great set of pipes; he
once won a karaoke contest in Montana. “I come
from a singing family;
we sang a lot in church.”
He even sings
on the bus now and then
when the Globetrotters
are traveling from city to
city and he also keeps his
teammates entertained
by popping in one of the
DVDs from his massive
collection of more than
700 movies.
The Globetrotters will face a great
challenge this year, as
the infamous Washington
Generals are more determined than ever to match
the franchise’s historic
last victory over the Globetrotters nearly a half
century ago.
According to
Christensen, it has been
five years since the Globetrotters and the Generals have faced off, as
the Generals have been
searching far and wide
for the best players to retool their roster and have
been preparing for one
thing: victory over the
Globetrotters.
In addition to
the highly-anticipated
match up on the court,
the Globetrotters are
known worldwide as the
Ambassadors of Goodwill.
The Globetrotters will honor a Hometown Hero at the “Q.”
The team is
searching for active,
wounded or retired members of the military who
have made their community proud with their
brave service and exemplary character. Fans
can nominate a Harlem
Globetrotters Hometown

The Globetrotters will also play a portion of each game with
a camouflage basketball
as a sign of respect to all
who protect our freedom.

Allmond eulogized at funeral
Services were
held for Janet Doretha
Allmond on Saturday,
December 6 at Olivet
Institutional
Baptist
Church, 8712 Quincy
Avenue, and Rev. Gloria Chaney officiated the
service.
Allmond was
born on December 21,
1933 to the late William
and Sylvia Jackson in
Cleveland. she had two
siblings, Marilyn and
Hayes.
Allmond attended Case Woodland Elementary School and Empire Junior High School.
She graduated from the
old Central High School
in 1951.
Allmond married her high school
sweetheart,
Montana
Allmond, on September
29, 1951. The couple had
nine children.
Succeeding her
husband in politics, All-
Allmond
mond became a Garfield
Heights councilwoman
in 1981. During her tenure, she organized voter
registration initiatives
and initiated drives to
clean-up the community. She was involved
in the campaigns of
Jane Campbell, Marcia Fudge, and the late
Stephanie Tubbs-Jones.
She also worked on the
presidential campaign of
President Jimmy Carter.
In 1988, she
was employed as a housing inspector for the city
of Garfield Heights until

The Government
Finance Officers Association of the United States
and Canada (GFOA) recently gave the city of
Shaker Heights its Certificate of Achievement for
Excellence in Financial
Reporting for the city’s
2013 comprehensive annual financial report.
The Certificate
of Achievement is the
highest form of recognition in the area of governmental accounting and
financial reporting. Its attainment represents a significant accomplishment
by a government and its
management.
This award is
presented to: Matthew
Rubino, director of finance; Cheryl Arslanian,
CPA, assistant director of
finance; Paul Beckwith,
CPA (inactive), accountant; and Lorraine Miller,
CPA, accountant.
The city’s comprehensive annual financial report was judged by
an impartial panel to meet
the high standards of the
program including demonstrating a constructive
“spirit of full disclosure”
to clearly communicate
its financial story in a way
that invites users to read
the report.

nonprofit
professional
association serving approximately 17,500 government finance professionals.
she retired from the position in 2003.
She enjoyed her
retirement by being involved with her church,
Olivet Institutional Baptist Church, and her family.
She is survived
by her children Monette,
Brent, Robin, William, Clayvonne, Keith,
Lamont and Jamal.
Her husband
and two children, Tanya
and Hazel, preceded her
in death.
Arrangements
were handled by Boyd
and Son Funeral Home,
2165 East 89th Street. Interment was in Cleveland
Memorial Gardens.
Scooter, one of his most
memorable moments that
he experienced with the
Globetrotters is when he
went with the team to entertain the troops in Afghanistan and Iraq.
“I could never
imagine playing basketball on a navy carriers
with F-16 fighters landing along side of us,”
Scooter said.
The Globetrotters Smile Patrol is the
proprietary hospital community outreach program
designed to brighten the
day and lift the spirits of
some very special fans
unable to attend a Globetrotters game.
Smile Patrol
visits more than 200
children’s hospitals annually, with Globetrotter stars sharing laughs,
taking pictures, signing

their amazing ball handling skills.
