October/November 2015 CARS of WI Scholarship Winners The Cars of Wisconsin Scholarship Committee announced the winners of three scholarships. The Bob Hoffmann Memorial Scholarship was established in the name of longtime member Bob Hoffman. Bob was a board member for many years. During his time he served as CARS President from 1990-1991 and 1991-1992. He was employed with Rhinelander Auto Salvage and LKQSmart Parts. He designed and implemented QRP and the QRP express system. One of his final projects was designing and helping with the implementation of the CARS Warranty Program. This years scholarship of $1,000 was awarded to Ryan Ross (Badger Motors) who will be attending UW Stevens Point. Robert R Morrison Scholarship. On behalf of the family of Robert R. Morrison, Concerned Auto Recylers adminsters a $1,500 scholarship to a graduating senior of a salvage yard owner or employee. Students may choose to attend a college, university, technical or trade school. The scholarship is awarded after the student presents evidence of successful completion of one semester and has enrolled in as second semester. This year the scholarship was awarded to Jacob Novak (Norb’s Salvage) who will be attending Northwestern Technical College. Cheryl A Rastia Memorial Scholarship is offered to salvage yard owners, employees and their families to assist in continuing education. Cheryl Rastia worked for over 30 years in the industry and served as the Executive Secretary for CARS from 1990 until 2002 when she lost her courageous battle with cancer. Four scholarships for $500 each were awarded to the following students: • Danica Duellman (Elmer’s Auto Salvage), attending Wartburg College • Kari Strandberg (Strandberg Auto), attending University of North Dakota • Katie Garrity (Bay Auto), attending Carroll University • Carissa Vruwink (TJ’s Auto), attending UW Eau Claire Inside this issue... It was held at the Days Inn, Eau Claire, WI. have the DNR do a presentation on the storm water program. Hermann will look into a “Health Insurance” seminar. Board Members present: Bellin, Dowd, Strandberg, Krumenauer, Hermann, Koepp, Joas, President Rademacher, and Executive Secretary Dumke. Guest at the meeting was Bob Remington from Remington Auto Salvage. Education Committee: No report. Board Members absent: Smits, Rowe, Harper, Goetsch, Tisler, and Hawk. Koepp made a motion to minutes from the June 9th 2015 meeting. Bellin seconded, motion passed. Treasurers report: Report was reviewed. Koepp motioned to accept the report. Hermann seconded, motion passed. Legislative Committee report: Rademacher reported that Hubbard is still working on the draft for the junk bill of sale vehicles. There was discussion on the titles vs Title Loan Companies with liens without a release form. It was suggested for best practice would be not to purchase those vehicles. Bylaw Committee: No report . Convention Committee: Strandberg presented information on having a presentation for “Insurance” at the Annual Meeting. Will be looking into having 2 seminars. Also, the “Warranty” program will have a presentation. Would like to Motion to ajourn at 9:08pm by Dowd. Hermann seconded, motion passed. Insurance Committee: No report. Membership Committee: No report. Treasurers Report: Smits reviewed the reconciliation for June/July. Profit at the convention for the auction was $7447.64 which included the spin wheel. This will be split between ARMS and CARS. Final numbers for the convention should be available in August. No final report from the Bob Hoffmann golf outing. Motion to accept report by Strandberg, seconded by Novak. Motion passed. Legislative Report: President Rademacher reported that there was no new info on the draft for defining salvage bill. Lein bill passed in the budget committee. IAA/Senator Ross looking at the definition of junk bill of sale cars again. Bylaw Committee: No report. Convention Committee: Dumke reported that there were approx. 20 teams for the 1st Bob Hoffmann golf outing. Annual meeting schedule was discussed, still looking for an afternoon training seminar. Would like to do an environmental subject. Cost to attend will be $50.00 per person to cover meals with a $100.00 discount to any member facility off their yearly dues if they attend the annual meeting. Newsletter Committee: Need articles. Recycling Committee: Harper reported that prices keep dropping. Scholarship Committee: Novak reported that there were six applications received for the scholarships. Old Business: 1. Stickers - Dumke gave prices on the stickers, Krumenauer made a motion to purchase large stickers and the small stickers. Novak seconded the motion. Members will be able to pickup the large ones at the annual meeting to display on their front door or vehicle. Also will be able to purchase extra ones. Motion passed. October/November 2015 5 Concerned Auto Recyclers of Wisconsin News Association News From the Secretary’s Desk By Sandy Dumke The Concerned Auto Recyclers of Wisconsin will be having the Annual Membership Meeting by the time you receive this newsletter. If you have not sent in your registration you can still attend the meeting as a walk-in and still be qualified for your $100 dues discount coupon. We have worked really hard to get great speakers and put together a relevant lineup of programs, FOR YOU. Here is a look at the seminars that will be offered this year: • • • • INSURANCE is important and expensive to all of you so we have asked Dave Bishop to be a speaker. He is director of account management for United Healthcare. He manages the small group business with 2 to 100 employees. Dave is well versed in the changes to the Affordable Care Act and many other topics. DATA BREACHES are problems we are all worried about and how to stop them will be presented by William Velin, Senior Vice President of Wells Fargo Ins. Bill is a very good speaker that has had many seminars at the ARA. He has been in the insurance industry for over 40 years and over 20 years in the automotive recycling and salvage industry. AUTO BODY SHOPS AND THE USED PARTS INDUSTRY has been a delicate balance for years. Larry Terrian is the President of The Wisconsin Auto Collision Technicians Association Ltd (WACTAL). It is the statewide trade association comprised of independent and dealer collision repair centers, technical colleges, and businesses affiliated with the collision industry. Larry works at MJ Collision Center in Green Bay. He will discuss what the body shop is looking for when they buy used parts. This will help us be better equipped to supply them with the best parts we can. C.A.R.S. of WI WARRANTY GROUP Bob Remington is the Secretary of the CARS Warranty Group and will be presenting a training program to everyone interested in learning more about the Warranty Program. If you are a member already or are interested in finding out how it works so you can sell part and labor warConcerned Auto Recyclers of Wisconsin News ranty’s to your customers, this is the time to find out how it works. If you have a special person that record’s your warranty’s or if it is your sales staff it is important to train them on the process. You can make more money for your business and give your customers a better warranty they can have confidence in. There will be the Annual Membership Meeting, where we will present the Officer and Committee Reports about the things we have done in the past year on your behalf. Greg Hubbard will be discussing the new bills being being introduced in Madison. We will have election for directors; every year we have 5 director positions open, if you are interested in becoming a director please contact one of the directors listed on page 3 or you can just nominate them at the meeting. All events will be held at the Radisson Hotel in Green Bay, which is also near other interesting area attractions like the Oneida Casino, and the Packers Stadium. 6 October/November 2015 Association News CARS of WI Helps Members Improve Their Safety Practices By David Kendziorski, WICAR Program Manager Our workers are exposed to many potential safety hazards. While strains, sprains, bruises, and cuts may be our most common hazards, I believe that fires and forklift accidents pose our most dangerous risks. As many of you know, we have had several serious fires within the past few years, usually related to gasoline fumes or spillage. In 2013, a Wisconsin auto recycler was killed in a forklift rollover accident. We can do a much better job of using safe practices. A new Wisconsin Safety Compliance Manual is available to all CARS of WI members to help improve your employee safety practices and comply with OSHA regulations. The Manual addresses about 20 safety regulations that most commonly apply to auto recyclers. Each section briefly describes the regulation, explains how to comply, and provides all the documentation that you will need – including sample and fill-in-the-blank plans or reports, inspection forms, and training records. A DVD is included, and the documents are provided as Word files, so you can easily fill out the documents with your company-specific information. In a few short hours, you can develop a written Safety Program for your company that is compliant with OSHA regulations and, most importantly, helps ensure that your employees go home healthy and safe each night. Some of the safety topics addressed include fire prevention, lockout/tagout for equipment maintenance, forklift training, airbag transportation training, eyewash stations, personal protective equipment, and electrical safety. Most of the training you can do yourself, and those members who participate in ARA University have access to excellent online safety training. Safety training is also offered at the Annual Convention – don’t miss the outstanding forklift operation training provided by Paul Secker from SAS Forks. About half of the CARS of WI members participate in the WICAR program. WICAR members receive recognition for meeting stringent safety and environmental practices, and each WICAR member benefits from onsite assistance each year. I spent 15 years as a Small Group underwriter and have been in my current role for the past two. I live in Green Bay and work across the state, managing our existing 2-100 employee book of business. My team works on the renewals for those groups and we have individuals who handle escalated service issues as well. I’m very well versed on changes related to the affordable care act, especially when it comes to pricing. I’ll be talking about Adjusted Community Rating, Transitional Relief, the various counting methodologies used to determine the applicability of certain ACA provisions, and what options small group customers have in 2015, 2016, and beyond. All C.A.R.S. members are invited and highly encouraged to attend this seminar. This is the only legal way in Wisconsin to sell labor warranties with your parts. You will be surprised to know how easy it is to sell warranties and give your customers the chance to add a labor warranty to their parts warranty. Customers want the peace of mind to know their used part is covered and it also has the labor covered. All C.A.R.S. members need to give this Warranty Program another look or a new look if they want to increase their bottom line and allow their customers the security that their parts have a good warranty that includes labor. Concerned Auto Recyclers of Wisconsin News Association News Cheap Insurance – The Least Expensive? By Wells Fargo Insurance, Bill Vellin The old adage “the cheapest insurance isn’t always the least expensive” has never been more true than it is today. The ultra-competitive nature of the insurance marketplace today has lead to insurance companies offering many coverages that were not offered in the past, as well as adding exclusions and limitations that take out coverages that you thought you had. The smart insurance buyer knows how to read his policy and where to look to find the coverages he or she knows is needed to protect his business. The policies written for todays automotive recycling industry are particularly tricky to construct and read due to the many different and diverse exposures found in the typical recycling operation today. These exposures can range from dismantling and recycling cars and trucks to the sale of new and used parts to the sale of used cars and/or trucks, in addition to U-Pull-Your-Own yards and the recycling of scrap metal. These coverages all have idiosyncrasies that , if not covered properly, could mean the difference between a claim being paid or denied outright. In addition, each of these exposures have different coverages including but not limited to Property , General Liability, and auto that all could contain exclusions or limitations that can render your perceived coverage very restrictive or make it very broad, depending on the carrier and the policy forms. For example, just a simple property policy for a typical recycler can be a trap when you think you are covered very well. That is because most property policies are written with a coinsurance clause. If the property policy, for example, has been issued with a 90% coinsurance clause, that means that the value you have your building insured for has to be at least 90% of what it would cost to REPLACE after a loss. As an example, you have your building insured for $900,000 at 90% coinsurance. A fire damages one portion of the building and the estimate to repair it is $300,000. AFTER the loss, the insurance company will come in and do a replacement cost calculation using a normally accepted replacement cost analysis. Let’s say, for the sake of argument, that they come up with a replacement cost of $1,200,000. The coinsurance clause will be enforced in this case, since you were required to have the building insured for a minimum of Concerned Auto Recyclers of Wisconsin News $1,080,000(90% of $1,200,000). However, you only have the bujilding insured for $900,000, which is 83% of what you were required to have it insured for per the coinsurance clause ($900,000 /$1,080,000 = 83%). Therefore, you will receive only 83% of the $300,000 fire loss or $250,000 minus your deductible. You are not going to be a happy insured in this case, which is a perfect example of a situation where the cheapest insurance is not always the least expensive. Another prime example is in the garage liability section of the policy. Many recyclers perform mechanical repairs on customers vehicles. That means they could have several customers vehicles on their premises – sometimes overnight. This creates a “bailees exposure” for customers vehicles in your care, custody or control. If damage occurs to a customers vehicle while in your care, custody or control, , you want to be able to assure your customer that you have coverage for the damage to his vehicle.However, even though you have a garagekeepers liability policy, you do not necessarily have coverage for your customers vehicle. That is because garagekeepers liability can be written in a number of different ways – from “legal liability” which covers damage to your customers vehicles that you be LEGALLY OBLIGATED to pay (ie. Damage caused only by your negligence) to “direct primary coverage, which covers just about anything that happens to a customers vehicle. Quite obviously, Legal Liability is much cheaper than Direct Primary. However, it may cost you much more in lost customers than you saved in premium for going with the cheaper option – especially if you are not aware of what you are buying. Again here, the cheapest option will probably turn out to be more expensive in the long run. It is more important than ever to find an insurance agent that is willing to spend time teaching you to become a better and smarter buyer. Once you learn to be a smarter buyer, you will not only save money in the long run, but you will sleep better knowing your business is covered properly. Wells Fargo Insurance Services USA, Inc., Bill Velin 800-328-6311 ext. 3039 • [email protected] 14 October/November 2015 Association News Marquette Poll By Greg Hubbard, HWZ The Capitol Column - 8/20/2015 The results of the latest Marquette Law School Poll show that Governor Walker’s job approval rating has fallen below 40 percent. According to the poll, the governor’s job approval rating has fallen to 39 percent with 57 percent of registered voters saying they disapprove of how he is handling his job as governor. In comparison, in the previous poll conducted in April, Governor Walker’s approval rating among registered voters was 41 percent with 56 percent disapproving of his performance. The poll interviewed 802 registered voters by landline and cell phone from August 13th-16th. The margin of error for the full sample is +/- 4.3 percentage points. For Republicans and Independents who lean toward the Republican Party, the sample size is 334. For Democrats and independents who lean toward the Democratic Party, the sample size is 396. Other results from the poll include: State Conditions Of those polled, 46 percent say Wisconsin is headed in the right direction while 52 percent say the state has gotten off on the wrong track. In April, 43 percent said the state was headed in the right direction and 53 percent said the state was on the wrong track. In regards to job creation, 50 percent say the state is lagging behind other states in creating jobs, 36 percent say it is creating jobs at about the same rate as others and 9 percent say the state is growing jobs faster than other states. In April, 52 percent said Wisconsin was lagging, 34 said it was adding jobs at the same rate as others and 8 percent said the state was adding jobs faster. After the completion of the 2015-2017 budget, 41 percent of those polled say the state budget is in worse shape than a few years ago while 36 percent say it is better and 19 percent say it is about the same. In April, 38 percent said the budget was worse, 33 percent said better and 25 percent said it was about the same. October/November 2015 15 Political Issues When asked whether the university system could absorb the $250 million cut that was approved in the budget, 38 percent of those polled say it could while 58 percent say the cut would reduce educational quality. However, 52 percent say the university could absorb the extension of a tuition freeze on in-state students, while 44 percent say this would reduce educational quality. More than half of participants, 52 percent, say they agree with the U.S. Supreme Court ruling in favor of legalizing same-sex marriage throughout the country, while 40 percent say they disagree with the ruling. Among Republicans and independents who lean Republican, 25 percent agree with the ruling while 68 percent disagree. Among Democrats and independents who lean Democratic, 76 percent agree with the ruling and 18 percent disagree. For independents who lean toward neither party, 52 percent agree with the ruling while 31 percent disagree with it. Presidential Race Governor Scott Walker is leading in the race for the Republican presidential nomination in Wisconsin, with 25 percent of voters who are Republican or lean Republican saying that he is their first choice. Following are Ben Carson at 13 percent, Donald Trump at 9 percent, and Ted Cruz at 8 percent, Carly Fiorina and Marco Rubio at 7 percent, Jeb Bush at 6 percent and other candidates at 4 percent or less. For Democrats, Hillary Clinton leads with 44 percent, followed by Bernie Sanders at 32 percent and Joe Biden at 12 percent. Lincoln Chaffee, Martin O’Malley and Jim Webb each receive less than 1 percent support.
