CSSP - 2015-16 2-24-16 Page 4 of 17 The Comprehensive School Safety Plan shall identify appropriate strategies and programs that will provide or maintain a high level of school safety and address the school's procedures for complying with existing laws related to school safety. School Overview of Current Condition An Assessment of the Current Status of School or School-Related Crime A review of our school indicates that the students, parents, and staff of Miraleste Intermediate School are safe on campus, off campus, at school sponsored events, and traveling to and from school. Miraleste Intermediate School participates in disaster and lock down drills, both of which are evaluated by PTA and local law enforcement. During the 2015-2016 school year there were 22 suspensions and 0 hate crimes. Campus security includes 2 staff as well as security cameras. Visitors are required to sign in at the main office and obtain a visitors badge for identification, and sign out upon their leaving. Cabinet, School Site Council and PTSA 4th Vice President review the security and safety at Miraleste. All students are educated on the policies and procedures that address bullying, harassment, sexual harassment, discrimination and cyber bullying. Presentations are made by the administration in September and are followed up throughout the school year via Guidance Lesson plans delivered by the Safe School Coordinator. Parents are also educated through Parent University Meetings, information nights, and PTSA meetings. Child Abuse Reporting and Procedures Consistent with Penal Code Section 11164 Reporting of child abuse is the responsibility of the mandated reporter who suspects physical or emotional abuse or neglect. Reporting can be made with or without the assistance of the Safe School Coordinator, Principal or Assistant Principal The initial report is made by phone through the hotline number then followed up in writing (electronically or handwritten form) within 36 hours of the initial phone call. Before submitting the form to DCFS, forms are photocopied and kept in a locked cabinet by the Safe School Coordinator and Office Manager. In event of an investigation, the badge or business card of the social workers is placed in a file for future reference. Every year the staff is updated on the laws and procedures surrounding the reporting of suspected child abuse. This year all Miraleste staff completed a new online Mandated Reporter Training module per AB1432. The procedures for reporting abuse are excerpted from the PVPUSD Board Policies and Administrative Regulations guidelines and are included in Appendix A. Routine and Emergency Disaster Procedures, including Students with Disabilities in accordance with the American Disabilities Act. The Miraleste Intermediate School (MIS) Emergency Plan provides faculty, staff, parent volunteers, and students with site-specific emergency instructions for an emergency crisis or disaster. The Plan delineates responsibilities of all Miraleste employees and is organized according to the Standardized Emergency Management Systems (SEMS). Miraleste personnel designated to carry out specific emergency responsibilities are expected to understand the policies and procedures written in the plan. Training and exercises are ongoing throughout the year. The plan is reviewed and updated annually by the Principal, PTSA, staff and district personnel. Drills and exercises are conducted annually. There is always the possibility that an emergency or disaster may occur when classes are not in session or when Miraleste is being used for before/after school activities. While the structure of the plan remains the same, the management system may expand or contract depending on the emergency and the availability of personnel. The disaster container with emergency food, water, supplies, and equipment is located in the stadium. Contents are inventoried and replenished annually. Additionally, each classroom is equipped with some emergency supplies and class lists by period. Procedures are in place to provide care to students with disabilities in case of emergencies. Protocols are in place for outside agencies, such as American Red Cross to access school grounds for mass care and welfare shelters during emergencies. Policies Pursuant to Education Code Section 48915(c) and Other School-Designated Serious Acts Which Would Lead to Suspension, Expulsion, or Mandatory Expulsion Recommendations Administrators regularly review school discipline and classroom discipline plans with teachers. School discipline is a specific agenda item at staff development at the beginning of each school year and is addressed frequently throughout the year. Policies, guidelines, and instructions are reviewed with students regularly and discipline is a specific agenda item at the Guidelines Assemblies held at the beginning and middle of each school year. Suspension and expulsion guidelines are articulated in the Safe Schools Policy, which is part of the registration packet every school year. Discipline is also addressed in the student handbook. Suspension is considered a serious consequence as it removes a student from the educational environment. Alternatives to suspension are employed when possible. Suspension is administered for patterns of defiance, significant disruptive behavior, fighting, sexual harassment and intolerant behavior. Expulsion is a mandatory consideration for Category I Violations, a recommended consideration for Category 2 Violations, and a possible consequence for Category 3 Violations in the Safe Schools Policy. The District developed a Student Discipline Team and a Discipline Handbook in 2008-2009. The handbook identifies procedures to support students with behavior problems, including students with special education needs and those who are supported by a 504 Plan. The Handbook provides strategies and procedures for administrators to follow when students are suspended or recommended for expulsion. The Student Discipline Team is made up of administrators and school psychologists, all trained in the district discipline plan and serve as an expulsion board. Procedures to Notify Teachers of Dangerous Students Pursuant to Education Code Section 49079 When the principal at Miraleste Intermediate School is made aware that a student has caused or has attempted to cause another person serious bodily injury, or any injury that has required professional medical treatment, a specific file is created for that child. Information based upon written District records or records received from a law enforcement agency are also contained in the file. When any such student is assigned to a teacher’s classroom, the principal provides the teacher with written notification. Also, the teacher is asked to review the student’s record in the office. A Discrimination and Harassment Policy Consistent with the Prohibition Against Discrimination Pursuant to Education Code Sections 200-262.4 Miraleste Intermediate School is a safe working and learning environment for both employees and students. Sexual Harassment and Non-Discrimination Harassment is reviewed at the beginning of each school year and employees sign that they have read and agree to follow the guidelines preventing sexual harassment via the Annual Policy Review. In addition, these forms are part of the Teacher Handbook which is reviewed annually. Any reports of sexual harassment must be reported immediately to the Principal or Assistant Principal, or the appropriate personnel department official. The school principal successfully completes the training required by the district to ensure a safe working environment. The school district’s Safe Schools Policy (Appendix C) lists sexual harassment as a Category 3 Violation. Students in grades 4-12 who are guilty of sexual harassment are faced with disciplinary consequences that can include suspension and probable reassignment to a school away from the home campus, or recommended expulsion. Teachers and administration discuss this policy in age appropriate ways to assure students that they need not endure any form of sexual harassment. Miraleste Intermediate School posts the Williams Act in all classrooms and faculty and parents are aware of the rights guaranteed to all students. Procedures to file a complaint are reviewed annually and posted in each classroom. The Provisions of a School-Wide Dress Code Prohibiting Students from Wearing “Gang-related Apparel” Pursuant to Education Code Section 35183, the Provisions of the Dress Code and the Definition of “Gang-Related Apparel” The Board believes that appropriate dress and grooming contribute to a productive learning environment. The Board expects students to give proper attention to personal cleanliness and to wear clothes that are suitable for the school activities in which they participate. Students have the right to make individual choices from a wide range of clothing and grooming styles, but they must not present a health or safety hazard or a distraction which would interfere with the education process (Reference: Board Policy 5132). Miraleste Intermediate is conservative in defining appropriate attire for students. District policies and expectations are outlined and included in the registration packet at the beginning of school. In addition, the Miraleste Student Handbook outlines the dress code policy. Students who are in dress code violation are provided with clean P.E. clothes to change into and are able to pick up the inappropriate articles of clothing when they return the borrowed P.E. clothes. Student names and type of infraction is documented with the school registrar. For years, Miraleste staff have discussed, established and reevaluated the dress code policy. In addition to the district’s restrictions that include no clothing items that reference sex, alcohol or drugs, violations specific to our campus include exposed undergarments (bra straps, underwear), exposure of one ‘s midriff, no excessive dressing up during one’s birthday, no pajamas. When/if gangs constitute a danger to students, the Superintendent or designee may act to restrict student dress and grooming as necessary to comply with Board policy related to gang activity (Reference: Board Policy 5132) Comprehensive School Safety Plan – Miraleste Intermediate School – 2015-2016 Page 11 of 17 Exhibit M - Miraleste Int. Procedures for Safe Ingress and Egress of Students, Parents/Guardians, and Employees To and From School Due to the narrow roads and steep hills surrounding our campus, Miraleste students primarily arrive and depart via public or parental transportation. Monitoring traffic flow and safety are Lomita Sheriff at the main entrance and two district employees in the parking lot. Students who do enter school on foot are provided safe crossing via a crossing guard at the east side of campus and Lomita Sheriff at the west side of campus. Students are encouraged to walk on the south side of Palos Verdes Drive East where there is better visibility and somewhat of a curb. Rules regarding the dropping off and picking up of students, pedestrian expectations and behavior on public transportation are outlined in the Student Handbook. In case of a disaster, student release would occur at the football field and vehicular traffic would be directed to follow the daily pattern of school ingress and egress. A Safe and Orderly Environment Conducive to Learning Throughout the school year, there are numerous educational and prevention procedures coordinated and delivered by both administration and the Safe School Coordinator. Bullying Prevention Procedures are reviewed by the Assistant Principal and Safe School Coordinator via Guideline Assemblies, and Guidance Lesson plans delivered to all students. Reporting systems are in place (incident reports) and two counselors on staff. Guidance Lesson plans include Sexual Harassment, Harassment and Bullying (all grades), Internet and Technology Safety (all grades with a parent component), Relational Aggression(7th) , Conflict Peer Mediation (7th), and Drug Awareness and Refusal Skills (all grades with parent component). Intervention procedures include the Outlook Program, Precious Life, counseling support groups. There is a strong community liaison between Miraleste Intermediate School and Torrance Memorial’s educational outreach and Thelma McMillan Chemical Dependency Programs, The Gathering Place for grief, Freedom4U, Marymount California University, to name a few. Student academic incentive programs include Mighty Marauder Club and Student of the Month. Character incentive programs include the HELP Program (Help Everyone Live Peacefully), Ben’s Bells Programs and Principal’s “Pat on the Back”. The Ambassador Program serves as a community service group to discuss concerns on campus from a student perspective and to support students new to the district and transition from the elementary level to middle school. Mr. K’s Kids is a diverse population of 8th grade students who meet bi monthly to discuss concerns on campus. Component #1: People and Programs Through a variety of educational programs, Miraleste is invested in making all digital behavior, both in the school and home setting, as Comprehensive School Safety Plan – Miraleste Intermediate School – 2015-2016 Page 13 of 17 Exhibit M - Miraleste Int. Grade level presentations reinforcing online safety as well as establishing a positive digital footprint were delivered in October via the Safe School Coordinator and retired Law Enforcement, as well as by Josh Ochs. This presentation was made available to parents via Parent University. Component #2: Place Cohesion with staff and students is fostered through a variety of school activities, some sponsored by Booster Club, ASB, or teachers through academic enrichment. Students and staff have the opportunity to design Miraleste spirit wear online which supports Miraleste while highlighting a student's unique interests or talents. Spirit wear is worn on Fridays. Students also have the opportunity to design this year's Miraleste sweatshirt, the Miraleste Flag and school book marks through school wide contests. The track meet and boys Basketball game vs Chadwick promote school spirit and a special bell schedule enables the entire student body to cheer on their classmates. Marauder Madness occurs each Friday and allows the student body and teachers to participate in friendly competition during lunch. All students are welcome to participate in Friendship Circle, a lunch group that combines regular education students with our special needs population. The Rules and Procedures on School Discipline Adopted Pursuant to Education Code Sections 35291 and 35291.5 Each year the effectiveness of discipline procedures are reviewed extensively at the beginning of the year and as needed throughout the year. When classroom consequences are deemed ineffective, teachers may use referral forms for lunchtime paper pick up. Discipline concerns that go beyond the scope of the teacher’s ability are referred to the Assistant Principal or Principal in the form of a Student Referral form. Incident Reports provide a forum for students to write in their own words a description of the incident. Disciplinary steps, counseling, parent contact, suspension and/or expulsion are options exercised. Rules for school discipline are outlined in the Safe Schools Policy document distributed in the online registration packet annually. The Miraleste discipline policies and procedures are discussed in class as well as during the Guidelines Assemblies. Hate Crime Reporting Procedures Hate crimes are defined according to Penal Code Section 422.55: For purposes of this title, and for purposes of all other state law unless an explicit provision of law or the context clearly requires a different meaning, the following shall apply: (a) "Hate crime" means a criminal act committed, in whole or in part, because of one or more of the following actual or perceived characteristics of the victim: (1) Disability. (2) Gender. (3) Nationality. (4) Race or ethnicity. (5) Religion. (6) Sexual orientation. (7) Association with a person or group with one or more of these actual or perceived characteristics. (b) "Hate crime" includes, but is not limited to, a violation of Section 422.56 For purposes of this title, the following definitions shall apply: Penal Code Section 422.56: (a) "Association with a person or group with these actual or perceived characteristics" includes advocacy for, identification with, or being on the ground owned or rented by, or adjacent to, any of the following: a community center, educational facility, family, individual, office, meeting hall, place of worship, private institution, public agency, library, or other entity, group, or person that has, or is identified with people who have, one or more of those characteristics listed in the definition of "hate crime" under paragraphs (1) to (6), inclusive, of subdivision (a) of Section 422.55. (b) "Disability" includes mental disability and physical disability as defined in Section 12926 of the Government Code. (c) "Gender" means sex, and includes a person's gender identity and gender expression. "Gender expression" means a person's genderrelated appearance and behavior whether or not stereotypically associated with the person's assigned sex at birth. (d) "In whole or in part because of" means that the bias motivation must be a cause in fact of the offense, whether or not other causes also exist. When multiple concurrent motives exist, the prohibited bias must be a substantial factor in bringing about the particular result. This subdivision does not constitute a change in, but is declaratory of, existing law under In re M.S. (1995) 10 Cal.4th 698 and People v. Superior Court (Aishman) (1995) 10 Cal.4th 735. (e) "Nationality" includes citizenship, country of origin, and national origin. (f) "Race or ethnicity" includes ancestry, color, and ethnic background. (g) "Religion" includes all aspects of religious belief, observance, and practice and includes agnosticism and atheism. (h) "Sexual orientation" means heterosexuality, homosexuality, or bisexuality. (i) "Victim" includes, but is not limited to, a community center, educational facility, entity, family, group, individual, office, meeting hall, person, place of worship, private institution, public agency, library, or other victim or intended victim of the offense.
