Philippines, removed from the U.S. Trade
Representative (USTR) Piracy Watch List
The United States Trade Representative (USTR) has removed the Philippines from
the Piracy Watch List after 20 years of being consistently on the list. The Philippines
first appeared on the Piracy Watch List in 1989 and stayed in the list since 1994. It
was only in 2014 that the country was removed from the list due to the significant
legislative and regulatory reforms that the Philippine government has undertaken to
protect and enforce intellectual property rights in the country… (cont. on page 5)

held last March 19, 2014 in the
Diosdado Macapagal Hall,
Landbank Plaza Bldg. at
Malate, Manila. The Music
Stakeholders convened to
unite and propel our local music industry towards new directions.
The convenors of the Pinoy Music summit are led by the Filipino
Society of Composers, Authors and Publishers, Inc. (FILSCAP),
along with the Organisasyon ng Pilipinong Mang-aawit (OPM),
Philippine Association of Record Industry (PARI), Assosasyon ng
Musikong Pilipino Foundation Inc. (AMP), Music Copyright
Administrators of the Philippines (MCAP) and Philpop

Philippine-Korea Copyright Forum
The Korea Copyright Commission conducted a forum last
September 18, 2014 at Dusit Thani Hotel, which aimed to promote
closer cooperation between the two countries in the field of
copyright. PARI was invited to join the event and was represented
by PARI Chairman Atty. Marivic Benedicto, PARI President Alvin
F. de Vera, PARI Office Manager Cely Cruz and PARI Industry
Dev’t Officer Alexei Camurungan. - AC

The 27 th Awit Awards
The 27th Awit Awards night is scheduled on the 12th of December,
2014, 6PM at the Resorts World Manila. The Awards night is
presented by the Philippine Association of the Record Industry,
Inc. (PARI) and will be produced by 360 Degrees International
Music Production. It will be a red carpet event and will be highly
publicized. The screening and
judging of entries were concluded
in November and were sponsored
by
STI
Colleges
and
PricewaterhouseCoopers. - AC
PARI meeting with US Embassy Representatives
PARI met with Representatives of the US Embassy in Manila to discuss
the status of Online Music Piracy in the Philippines.
Mr. Brian
Breuhaus, the new Economic Officer of the US Embassy in Manila,
together with Ms. Mary Rose Rolda, US Embassy Trade and
Investment Assistant met with PARI Chairman Atty. Marivic Benedicto,
PARI Office Manager Cely Cruz, and PARI Industry Development
Officer Alexei Camurungan to solicit information on several illegal online
markets. They also asked information on what the private sector and
the government are doing to address the problem. The US Embassy
representatives were given an overview of how we handle online music
piracy here in the country. They were also informed of the rampant
digital piracy (hard disk loading / illegal downloading) in the country,
which is equally affecting the local music industry aside from online
piracy. - AC

According to the statistics from PARI, Physical CD sales continue to decline over the years as seen on the table
above. Despite this, Digital sales steadily increase year after year. This is a sign that the local market’s acceptance
of Digital Music is improving. It is predicted that in a year or two that the digital sales will surpass the physical CD
sales. In order for the Digital platform to succeed, we must make sure that the technology in the country is up to date
to meet the Digital demands of the market. We must also make sure that measures to protect Digital contents are
already in place. To enjoy and experience the digital music platform, legitimate online music providers are already
operating in the Philippines like Spotify, Deezer, Spinnr, Youtube, MyMusicStore, OPM2Go, Itunes, Smart, Globe,
and Sun. - AC
OMB “Bawal Kumopya” Billboard
Campaign coordinated by PARI
The PARI Anti-Piracy Committee headed by Mr. Ramon
Chuaying spearheaded two billboard projects for the Optical
Media Board (OMB) to increase anti-piracy awareness under
the supervision of PARI Anti-Piracy Committee member, Mr.
Johnny Sy. One is the electronic billboard in EDSA near
Connecticut street, San Juan (photos on the right). The other is a
full 60x40 feet billboard (photos on the left) located in the North
Luzon Expressway (NLEX), left side, northbound, between
Malinta and Meycauayan exits. These projects are in
cooperation with United Neon, Sygoo Outdoor Enterprise, and
Mega C vitamins. The projects are supported by the Intellectual

Philippines Removed from USTR Piracy Watch List
The announcement was made last April 28, 2014, the
day US President Barrack Obama visited the country. Officials
said that the decision by the USTR will boost investor confidence in
the country. According to Director General Ricardo Blancaflor of
the Intellectual Property Office of the Philippines, the removal of
the Philippines from the Watch List creates the proper investment
climate and the foreign trading partners can feel secure in doing
business in the country.

The Intellectual Property Office of the Philippines (IPOPHL) and
the Optical Media Board (OMB) under the Office of the President
have been instrumental in the removal of the Philippines from the
Special 301 Piracy Watch List. Significant amendments to the
Intellectual Property Code (Republic Act 8293) and efficient
enforcement functions were key to this major accomplishment. - AC
OMB / IPO visit to USTR Washington DC, USA
The Optical Media Board Chairman Ronnie Ricketts and
IPOPHL’s Deputy Director General Atty. Allan Gepty were
invited by the US Trade Representative in Washington, DC,
USA last January 2014, to discuss recent amendments to
the Intellectual Property Code (Republic Act 8293) and the
unique enforcement strategy that the OMB has been
implementing in the past years that earned the Philippines
positive feedbacks from the USTR.
The USTR officials were quite impressed with how the OMB
manages to effectively enforce their mandate given the low
budget and minimal manpower.
ICTP Caucus:
This visit has been very instrumental in the removal of the
Philippine from the watch list. In this visit, the IPO and OMB
representatives were given a chance to discuss the current
and future plans of both agencies to continue protecting
intellectual property rights in the country. - AC
The International Creativity and TheftPrevention (ICTP) Caucus was formed in 2003 to call attention to
the rampant theft of Intellectual Property, both online and in
physical marketplaces. Highlighted the high levels of piracy and
the lack of legal protections for copyright in the following
countries: China, Russia, Switzerland and India.
The report also highlights and applauds Italy and the Philippines
as countries in transition following the enactment of stronger legal
frameworks for the protection of copyright in both nations. The
caucus said the Philippines and Italy have made progress.
Although online piracy rates remain high in Italy, the report found
that Italian authorities have been more cooperative in combating
the issue. The Philippines has moved toward addressing
shortfalls in copyright laws.

…GMA Network (TV and Radio) entered into an agreement with Music Video
Performance, Inc. (MVP), a private organization represented by President Mr. Chito Ilacad,
that serves as the collecting agent for performers and recording companies, for the use of the
sound recordings of the
latter’s principals, Philippine
Music Public Performance Society, Inc. (PMPPSI) and
Performers Rights Society of the Philippines (PRSP). Both
agreements are retroactive and would cover royalty payments
since the demand were laid back years ago.

DotPH, which hosted the pirate site
KAT.PH or kickasstorrents.ph before
entered into an agreement (MOA) with
PARI last May 2014. The company was
implicated with PARI's case against
KAT.PH, which was filed before the
Intellectual Property Office (IPOPHL)
Bureau of Legal Affairs (BLA). DotPH
agreed to provide PARI with (1) KAT.PH
registration information and (2) providing
a complaints link/email where copyright
owners could file a complaint against
illegal websites under the PH domain. In
exchange, PARI will be dropping dotPH
from the case. DotPH has already
complied with the MOA and they
provided us with the KAT.PH registration
information which we will use to pursue
the case against KAT.PH, which is now
operating under the domain name
www.Kickass.so (Somalia), and they
have provided a complaints email where
copyright owners could send their

This
campaign aims to
create
anti-piracy
awareness, spread the
“Bawal Kumopya” antipiracy battle cry, and
create a feedback
system where people
could report complaints
on
copyright
infringement.
The
stickers were already
sent to our partners
nationwide for display
and these are also
being used by the
Optical Media Board as
anti-piracy
campaign
tool in their nationwide

PARI / MCAP meeting with OMB
PARI and MCAP (Music & Copyrights Administrators of the Philippines) met with
OMB Chairman Ronnie Ricketts and OMB Licensing head Ms. Beth Red to
discuss licensing issues between the associations and the agency. It was agreed
that the agency will review the present MOA between the parties. Present are the

PARI Chairman Atty. Marivic Benedicto, MCAP Chairman Mr. Alvin de Vera,

Last April 26, 2014, the international community, through the World
Intellectual Property Office (WIPO) arm of the United Nations (UN) celebrated
the role of intellectual property in the creation and innovations in film, music,
literature and other recorded art mediums. The OMB, IPO, PNP and PARI
came together to reinstate and reaffirm their commitment to curb piracy,
illegal cam-cording and other IPR violations.
