emember my opening line in last month’s column? It
was… ”Good news; Bad news, I’m afraid”. The good
news is that the coming of spring in Hawaii means that
summer and Ahi season is right around the corner. The bad
news? As you know, normally when the “bite” is on, 200 boat
teams (and a waiting list of even more) sign up to participate in the annual Waianae Boat Fishing Club’s “Ahi Fever”
tournament. If you were thinking of signing on for this year’s
event, you’re going to be very disappointed. If you visit the
WBFC’s web site www.wbfc.net right there on the home
page you’ll see the message: “WBFC Will not have an Ahi
Spinners Ahi Shootout Poster
Fever 2015. Sorry for any inconvenience”.
OK, now the REALLY good news…long time Waianae coast
businessman Victor Lozano of Spinners Café and Waianae Boat &
Storage and Dolphin Excursions will be the tournament chair along
with a group of volunteers to the rescue. It‘s the Spinners Ahi
Shootout !! OK, it’s not the Waianae Boat Club’s Ahi Fever
Tournament, but it isn’t too shabby! Lots of the boat club’s members will be helping out, along with helpers from all over the coast
as well. It is only a one-day event, Saturday June 20, with similar
rules as the Ahi Fever and lots of ways to WIN. I’ll be updating the
event every Saturday at 4pm and Sunday at 7am on the “Go Fish”
show, so stay tuned! At the publishing date of this issue there were
still openings, only 100 boats this time, so don’t wait……otherwise

LOOK….The Council Funds Study for Potential Uses of Fish Processing Waste! At the
162nd meeting of the Western Pacific Regional Fishery Management Council in March,
Warren Dominy, of Aquafeed Consulting, presented the results of a Council-funded study
conducted throughout the state of Hawai‘i on the potential use of processing fish-waste as
fish meal, fish oil, fertilizer and more. Our commercial fishing industry harvests various
types of fish, of which tuna comprises approximately 60% of the total fish landings. Once
the fish are processed, a residue, or fish processing
waste (FPW) is generated and has to be disposed
of properly. Some is converted and sold as an
organic soil amendment by the local rendering
plant on O‘ahu. Some farmers are also composting
it and feeding it to pigs. However, much is treated as
garbage and trucked off to the land fill for disposal,
especially on the neighbor islands. Currently, the
wholesaler cost to dispose of fish waste on O‘ahu is
more than $100,000 annually, and statewide the
Fish Cleaning Waste
estimated cost is more than $1 million per year.
With an estimated 4,215 tons of fish waste (about 40 percent of the fish landings) being
produced in Hawai‘i each year, this waste could generate up to $3 million annually, instead
of filling landfills.
The study concluded that the current waste generated in Hawai‘i, if maintained and
processed properly, can meet or exceed the fishmeal market standards for the various fish
meals and fish oils that are sold commercially today. Potential products from a FPW include
a dry, high quality fishmeal; fish oil; ground, fresh frozen fish blocks; and fish silage. These
products could be added to feed formulations for pet foods as well as livestock and aquaculture feeds that could be manufactured locally. Or, with the high demands and shortages
of fishmeal and fish oils on the commodity markets, it could be exported and sold to markets
overseas. FPW that does not meet the quality and specification for a high quality fishmeal,
fish oil or fish silage could be converted into a liquid or dry fish fertilizer for use by farmers
to raise local plant crops.
The effective recycling and utilization of FPW would help create a more sustainable
ecosystem based management that the Council envisions for the fisheries industry throughout the US Western Pacific Region. The report is available at: http://www.wpcouncil.org and

pring has arrived and Hawaii Yacht Club held the annual Spring Pokai Race on
March 28th and 29th. The first race started near the Ala Wai and finished near the
KR2 buoy off the Kalaeloa Harbor Channel entrance.
All wind predictions seemed opposite the actual weather. Saturday’s prediction was
10-15 with gusts to 25, however, shortly after the race started the winds dropped. The
X class boats completed their run to Diamond Head and for a while ended up sitting
near the start line watching the rest of the fleet sit in doldrums off Ewa Beach. Because
of the wind drop the A/B fleet was able to boast that they beat the X class fleet boat

Sunday’s race back was supposed to be light winds and after a brisk start the racers were faced with
several sail changes to match winds that would alternate between light and heavy. Most of the boats
short tacked up the coast but a few sought better winds outside. The combined race results were:

The Wahine Invitational was held by Waikiki Yacht Club in Cal 20s on April 11th. This is the second race
of the Wahine season. Winds were 10-15 with gusty periods. Three windward/leeward races constituted

Rounding out the races for the month, Waikiki Yacht Club held
the Masaji Beach Fleet on April 25th. And finally, the Waikiki Yacht
Club will be defending the Lipton Cup by holding the challenge
on May 2 and 3. Results for those events will be published next
month.
Bruce Olsten from Maui reported the following: Lahaina Yacht
Club held its annual Opening Day celebration at Canoe Beach on
Sunday, March 29th. A large turnout, lots of great food, and cold
kegs of beer made for a GREAT day on the beach. Members of the
Junior Sailing Team sailed 4 RS Fevas from their base at Mala and
took some of the shore-side party goers out for rides off of Canoe
Beach. Bill Myrter brought 2 radio-control Lasers and the club
yacht Snickers showed up all dressed up for the occasion. There
was music, dancing, and merriment for all.

You Are Now Likely Subject to DLNR’s Commercial Permitting Rules!
Over the past few years, the Department of Land and Natural Resources (“DLNR”) has been
fielding more and more complaints from people on the beach that they can’t access the best
spots due to too many commercial operators being in the area. Certainly we’ve all been to a
beach where you have to step over and around 15 kayaks laid out on the beach or 20 people
from the Smith Family who are all going to learn how to snorkel in the very best, calmest
waters on a Saturday, the only day you have to enjoy a snorkel adventure of your own. But is
regulation by DLNR the right answer?
As a result of the complaints, and very likely as a result of a desire to create another revenue
source, the DLNR promulgated rules during the spring and summer of 2014 which allowed

them to regulate commercial activities not just from a state operated boat ramp or harbor,

for any activities occurring on the state ocean waters, regardless of where they launched

from. DLNR states that “this new permitting scheme serve the important dual purpose of
monitoring commercial activity levels on state waters as well as protecting public safety by ensuring that operators
are carrying sufficient liability insurance and adhering to State standards”. So, despite almost no one being aware
of the hearings regarding these rules (they were publicized in the local newspapers in accordance with the law),
the rules were put to vote and were effective as of September 25, 2014.
Well, “Do the rules apply to me?” you might ask. Here are the basics:
WHO: Anyone who operates a commercial vessel, watercraft and watersports equipment. See HAR§ 13-250-51 .
WHERE: Any State ocean waters (which means any ocean waters within three miles of the shoreline).
WHEN: Any time of the day, any time of the week, and any time of the year.
WHAT DO I DO? Get a permit. You have to apply through the local DOBOR office for a commercial permit or go to
the website www.dlnr.hawaii.gov/dobor/commercial-use-permit-qa/ and fill out the Commercial Use
Questionnaire.
You will be obligated to provide to DOBOR the following items: GET license; commercial insurance naming the
State of Hawaii as an additional insured (see HAR § 13-231-65 for specifics); certificate of compliance from Hawaii
Compliance Express (or DLNR’s alternative list of items); articles of incorporation or the operating agreement for the
entity; PUC for vehicles being used by the entity; Certificate of Documentation or Certificate of Inspection for vessels;
permits or letters of permission which show you can gain access to the ocean waters from the shoreline.
WHAT DOES IT COST? There is no initial permit application fee however the fee structure depends on what you
are doing2.
Once you are granted a permit, if you are operating from state land, you have the obligation to pay either $200.00
per month of your gross receipts or 3% of your gross receipts, whichever is greater. The definition of gross receipts
is broad so cross-selling of merchandise and/or equipment may fall within the definition.
If you are operating from private land and/or a County land/facility, you have to pay $200.00 a month. For those
of you with CORA permits, you now have to pay both County and State fees for your operation.
If you already have a commercial use permit for streams or ocean waters or catamarans, you can append the new
use to the existing permit and will not be responsible for an additional 3% of your gross revenue though the
reported gross under the existing permit has to reflect the revenue from the new activity.
After reading this you might ask whether you really need to deal with this new set of DLNR rules. The answer is
yes. The DOCARE division of DLNR is warning people right now and advising of the need to obtain permits but at
some point will likely start sending out warning letters. We do not know if they will exercise their rights to simply
ticket violators (which has criminal implications as DLNR violations are misdemeanors) or if they will move toward
confiscation of equipment. Either way, you as a commercial operator don’t want to be on that particular radar
screen!

Nasty things to talk about when it comes to boats. If you want info on your engine, Google it. You can find
every specification, recommendations, parts, and probably a Youtube video to show you how to rebuilt it. I
want to talk about what I see when I meet your engine(s). I come from a mechanically religious background.
In the 70's I was a mechanic for Porsche of America, a total immersion experience. I worked with them for 7
years and was converted. Cleanliness is next to....you know. Lots of times engines look like nobody cares for
them. There leaky, rusty, dirty, grimy, live in a low rent district, and barely eek by. But I know they will get
even with you some day. You stinkpotters (power boaters), it's probably when your done fishing at the bank
and want to come home. Ragbaggers(sail boaters) on the way into the harbor, and at a very crucial time,
they get even.

You need to clean it up some. Start with the air filters. Try breathing through a dirty sock? No paper
filter? Stick your finger in its throat and check to see how much soot is struck in that intake. Engine oil?
Sorry, 20 hours of engine use on 18 month old oil? It became "acidic". Like acid in your engine? Oil filters
don't filter acid. How about fuel filters and fuel. You can't see through the filter bowl, or see water in the
bottom of it? You probably have water in the tank and maybe bugs! The bugs are bacteria, fungi, and yeast.
Humans have "counteractive systems" to fight bacteria, fungi, and yeast, engines do not, you have to add
them. Without those "counteractive systems" we stop too.
And for heavens sake, wash that bloody thing (engine) and maybe paint it? So far, I have not seen a monitor
that will tell you, HEY I AM LEAKING HERE! A clean, painted engine and engine room will tell when and where
that thing is hurting and maybe going to fail. You can paint it any color you want, even "tie dyed". (Send me
a photo of that!) One Saturday afternoon, some degreaser, couple cans of high heat spray paint, maybe
some music. Fifty bucks and elbow grease.
You have all of these problems? Hell, you need some of my religion! My legal opinion, you are killing that
engine, outright murder or manslaughter by neglect. You got lots of money? We can get you off. We got
people lined up to replace it all, nobody will ever know. Uh, it'll cost you thousands.
