At a MONTHLY MEETING of the Board of Directors of the Town of Tonawanda
Development Corporation (TTDC) held on Tuesday, October 22, 2013 at the offices of the
Town of Tonawanda Youth, Parks and Recreation Department (299 Decatur Road, Tonawanda,
NY), there were present: Supervisor Anthony Caruana, John H. DenBeste, Robert Gilmour, Greg
Ivancic, Cliff Mason, Paul Saffrin (Mike Stankowski) and David Vance.
Absent: Councilman John Bargnesi, Timothy Boyle, Carl Carleton, Daniel Dirrigl, Karen
Ginnane, Joseph Hatch, Warren Hoy, Tracey Lukasik, Gary A. Marchiori, Gary Roesch, Carl
Savarino and Keith Waldron.
Staff: Robert L. Dimmig (Executive Director).

CALL MEETING TO ORDER
The meeting was called to order at 8:07 a.m. by Robert Gilmour. He announced that a
quorum was present, and asked board members to introduce themselves.

APPROVAL OF MINUTES.
Minutes of the September 17, 2013 meetings were distributed via email prior to the
meeting and copies were available for review.
A motion to approve minutes for the September 17, 2013 meeting was
made by Greg Ivancic and seconded by John DenBeste. Motion carried.

TREASURER’S REPORT.
A Treasurer’s Report for the period ending October 21, 2013 was presented by Bob
Dimmig. He reviewed income and expenses, budget v. actual and balance sheet
statements for the report period:
Income and Expenses. Expenses for the period of Sept. 18, 2013 through Oct. 21
were $11,178.49 and income was $17,498.32 with net income of $6,320.
Expenses were regular salary items.
Budget vs. Actual. We have spent $85,923 against a total budget of $130,000.
He will review budget lines and propose budget reallocations at either the
November or December meetings.
Balance Statement. We had $15,119 in the bank, receivables of $4,333, payables
of $7,294 and net income of $(3,977) on September 30.
A motion to approve the Treasurer’s Report for the period ending
October 21, 2013 was made by John DenBeste and seconded by David
Vance. Motion carried.

REPORT OF THE EXECUTIVE DIRECTOR.
Bob provided an update on activities in the North Youngmann Commerce Center
(NYCC). A Steering Committee has been meeting every two weeks to oversee the
infrastructure project and the initial development project (i.e. - Zaepfel/Tzetzo).
Construction of the bridge over Two Mile Creek Road is expected to start in late
November.
The Town has launched an update of its Comprehensive Plan, which was last revised in
2005. Bob met with a project consultant to brief her on economic development issues and
opportunities – from Niagara Falls Boulevard to the Niagara River. This is an important
project, as it sets the broad framework for policies and individual projects for a ten-year
horizon.
Bob also informed the board that he had arranged a meeting between chief elected
officials of the Town of Tonawanda, City of Tonawanda and Grand Island and
representatives of the University of Buffalo. Recent media coverage of the Tonawanda
Coke Settlement has focused on a health study that would be led by UB, if funded. The
meeting provided an opportunity for elected officials to meet the UB team, and learn
more about their concept of the study.

The Town has been awarded a $275,000 (+/-) grant under the state’s Brownfield
Opportunity Area (BOA) program to conduct detailed studies in the waterfront region.
The funds will be used to examine land assembly, conduct site market analysis,
sustainable development zoning and multi-modal designs (i.e. – trails).
A meeting of the Tonawanda Sustainability Council has also been set for November 12 at
which presentations will be made by FMC, 3M and Dunlop.

DISCUSSION.
Bob Gilmour asked board members for any items to share with the board:


Greg Ivancic suggested that Bob send out a poll to board members to see if there
is a better day of the month to host regular board meetings.

David Vance notified board members that FMC is expected to announce a new
buyer in the near future. There are 3 potential buyers. He reviewed the strengths
of the Tonawanda plant.

Supervisor Caruana provided an update on several activities in the Town,
including: the status of the Town’s preliminary budget; a recent article on the tax
base which inaccurately ranks the Town; opening of Kenmore Mercy’s new
orthopedic center; postponement of sentencing in the Tonawanda Coke
Settlement; ECIDA search for a new CEO, and; port security grant.
ADJOURNMENT.
The meeting was adjourned at 9:04 am. The date of the next meeting will be Tuesday,
November 19, 2013 at 8 am. The location will be at 299 Decatur Road (Youth, Parks, and
Recreation Offices).

WHEREAS, pursuant to Local Law 3-89, the Town Board of the Town of Tonawanda is the Lead
Agency in connection with the SEQRA review of the Project and there is no other permitting or approving
authority; and
WHEREAS, pursuant to Local Law 3-89, the Town Board of the Town of Tonawanda, as lead
agency, caused the Environmental Assessment Short Form (EAF) completed by Deputy Town Attorney
John W. Dorn, and all other relevant data, to be referred to the Town of Tonawanda SEQR Committee for
review and recommendation; and
WHEREAS, the Town Board of the Town of Tonawanda, as lead agency, has conducted its own
independent review of the EAF and all other relevant data furnished by the Technical Support
Department, and also reviewed the minutes of the SEQR Committee meeting held on December 11, 2013
in which the SEQR Committee has recommended to the Town Board, as lead agency, that the Local Law
is an unlisted action which will not have a significant impact on the environment and therefore a negative
declaration should be issued; and
WHEREAS, the Town Board, as lead agency, has applied the criteria listed in Section 6l7.7 of
Part 6l7 of the N.Y.C.R.R. to this activity and considering all the relevant documentation and information
submitted, determines that this activity will not have a significant impact on the environment; and
WHEREAS, the Town Board of the Town of Tonawanda, as lead agency, concurs with the
recommendation of the SEQR Committee;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Tonawanda, as
lead agency, and sole approving authority for this SEQRA review, hereby issues a negative declaration
in connection with this activity; and

JANUARY 13, 2014
WHEREAS, the Town Board of the Town of Tonawanda (the “Town Board” and the “Town”
respectively) in the County of Erie, New York has, pursuant to Town Law, created the Town of
Tonawanda Consolidated Sanitary Sewer District (the “District”) and has directed Conestoga Rovers &
Associates (the "Engineer"), a competent professional engineering firm, selected by the Town and duly
licensed by the State of New York, to prepare a map, plan and report for certain increases and
improvements to the sanitary sewer system facilities of the District in the Town, including but not limited to
engineering, and legal services necessary to establish sanitary sewer system flows and response to wet

All of the foregoing shall include flow meter installation and monitoring and other activities required to
establish and quantify the influence of Inflow and Infiltration on system flows; and reporting all findings to
the New York State Department of Environmental Conservation in response to the Order on Consent (the
“District Improvements”). Pursuant to the direction of the Town, such engineering firm will complete and
file with the Town Board such map, plan and report for said District Improvements, the Engineer has
estimated the total cost thereof to be a maximum amount of $600,000.00; such cost to be financed by the
issuance of serial bonds and/or notes of the Town in the amount of $600,000.00 to be authorized
pursuant to bond resolution;
NOW, THEREFORE, BE IT ORDERED, that a meeting of the Town Board will be held at the
Municipal Building, 2919 Delaware Avenue, Kenmore, New York, on January 13, 2014, at 7:30 P.M.
(prevailing Time) to consider said District Improvements and to hear all persons interested in the subject
thereof concerning the same and for such other action on the part of the Town Board with relation thereto
as may be required by law; and
BE IT FURTHER ORDERED, that the Town Clerk be and is hereby authorized to publish at least
once in the KEN-TON BEE, a newspaper designated for such publication, and post on the sign board of
