RE: Small lots at Griffin Park
Dear Liberty Consolidated Planning Commission:
Since the inception and design of Griffin Park, there has been a shift in urban
neighborhoods to have less front yard area and more back yard area. This shift has been
apparent for years as front porches have become a thing ofthe past and fences have taken
over for the safety of children and pets. In Griffin park the "small" lot was designed to
have 20 foot front setbacks yielding a close to even split between the front and rear yards.
It has become apparent that the customers want what the large part of the nation has been
building for several years, to have a small front yard and a larger back yard for family
gatherings, grilling, and as mentioned above safety. Because of the above we request to
change thd front setbacks to 15' instead of 20' . This 5' difference is a meager request that
will have a large impact on sales, satisfied customers, perceived homeowner safety and a
very small, if any, impact on the inner workings of the subdivision such as traffic,
drainage, water or sewer.

BACKGROUND: Proposed Ordinance #2011-04 amends the City Charter for the
purpose of creating new City Council Districts necessitated by the 2010 Decennial
Census. Proposed Ordinance #2011-04 was advertised in the Coastal Courier and a
notice was placed on the City of Hinesville Website. The first adoption of Ordinance
#2011-04 was at the July 21, 2011 Council Meeting.

Sec. 9-99. Health club business.
(a) Definitions. The following words, terms and
phrases, when used in this section, shall have the
meanings ascribed to them in this subsection,
except where the context clearly indicates a dif­
ferent meaning:
Health club means a place of business with
equipment and facilities for exercising and im­
proving physical fitness. The term "health club"
includes a massage parlor.
Masseur means a person who gives massages
professionally.
(b) License required; application. Each person
engaging in or carrying on the business of health
clubs within the corporate limits of the City shall
be required to obtain a license from the City Clerk
in the manner specified in this Code. Application
for a health club license shall also contain the
following additional information:

cerning the applicant and the manager or
other persons principally in charge of the
operation of the business:
a. Name, complete residence address,
and residence telephone number;

whether or not such person has had
such a license denied, revoked, or
suspended and the reason therefore;

All criminal convictions other than
misdemeanor traffic violations fully
disclosing the jurisdiction in which
convicted and the circumstances
thereof;

A complete set of fingerprints taken
and to be retained on file by the
Chief of Police;

hearing thereon. Notice of such hearing shall be
published in the official gazette of Liberty County.
(e) Inspection of premises. All premises pro­
posed to be used by licensees shall be inspected by
the Chief of Police, the Building Inspector and the
Fire Department Inspector for the purpose of
assuring that such premises comply with all the
building, sanitation, and fire prevention require­
ments.

ground, including a diploma, certifi­
cate, or other written proof of grad­
uation from a recognized school or
institution of learning which has for
its purpose the teaching of the the­
ory, method, profession, or work of
massage, which school requires a
resident course of study of not less
than 70 hours; and
The names and addresses of three
adult residents of Liberty County
who will serve as character refer­
ences; such references must be per­
sons other than relatives or business
associates.
(c) License fee. The annual license fee for per­
sons engaging in the health club business in the
City shall be $300.00. No half-year licenses shall
be issued.
(d) Public hearing. Upon the filing of an appli­
cation for a health club business license, the City
Clerk shall fix a time and place for a public

General operating requirements.
(1) Each person licensed shall display his
license, and the permit of each and every
masseur employed in the establishment.
(2) Every person who operates a health club
business shall at all times keep an ap­
pointment book in which the name of each
patron shall be entered. Such appoint­
ment book shall be available during reg­
ular business hours for inspection by the
Chief of Police.
(3) The licensee shall have the premises su­
pervised at all times when open for busi­
ness and at least one person who qualifies
as a masseur shall be on the premises at
all times while the establishment is open.
(4) No person who operates a health club
business shall permit any massage ser­
vice or practice to be carried on within
any cubicle, room, booth, or other area
that is fitted with a door capable of being
locked.
(5) No person shall permit any person under
the age of 18 years to come unto or remain
on the premises of any health club busi­
ness as masseur, employee or patron.
(6) No person shall sell, give, dispense, pro­
vide or keep any alcoholic beverage on the
premises.
(7) Any health club business license or
masseur's permit issued shall be subject
to suspension or revocation by the City
Council upon proof of any violation of this
section, proof being substantiated by the
Chief of Police.
§ 9-99 HINESVILLE CODE
(g) Zoning and distance requirements. No ap­
plication shall be considered by the City Council
unless proposed site of the health club business is
located in an area zoned C-2 or C-3. The site of the
health club business must be at least 300 feet
from any church or school and at least 2,000 feet
from another existing health club. These dis­
tances are to be measured from property line to
property line.
Sec. 9·100. Tattooing, etc.
(a) Description. The term "tattooing" means to
mark or color the skin by pricking in, piercing, or
implanting indelible pigments or dyes under the
skin.
(b) License fee. The annual license fee for tat­
tooing as described shall be $200.00, or such
license fee review through official action of City
Council. Such license fee shall not be prorated.
(h) Masseur's permit required. No person shall
practice massage as a masseur, employee, or
otherwise, unless such person shall have obtained
a valid masseur's permit issued by the City. The
practice of massage is defined as any method of
treating the superficial parts of a patron for
medical, hygienic, exercise, kneading, tapping,
pounding, vibrating, or stimulating with the hands
or any instruments, or by the application of air,
liquid, or vapor baths of any kind whatever.
(c) Zoning restriction. Such business of tattoo­
ing shall be located only in the business zones in
the City and such business of tattooing shall not
be located within one mile of any church, public or
private school, alcoholic beverage establishment
and at least 300 feet from residential property as
measured from property line to property line by
way of access over public streets and roads of the
City.
(1) The use of the masculine gender shall
include in all cases the feminine gender
as well.
(2) The application for a masseur's permit
shall include all personal information re­
quired of an applicant for a health club
business license.
(3) Each application for a masseur's permit
shall be accompanied by a permit fee in
the amount established in the schedule of
fees and charges.
(i) Exceptions. The provisions of this section
shall not apply to hospitals, nursing homes, san­
itariums, or persons holding an unrevoked certif­
icate to practice the healing arts under the laws of
this State, or persons working under the direction
of any such establishment, nor shall this section
apply to barbers or cosmetologists lawfully carry­
ing out their particular profession or business.
(d) License application and issuance. No li­
cense to engage in the business of tattooing shall
be issued until an application therefor has been
completed and filed with the City Clerk, and no
person shall engage in the business of tattooing
within the City limits until such license has been
issued by the City Council.
(e) Contents of application; information to be
furnished under oath. An application containing
the following information shall be completed and
filed with the City Clerk by each applicant for a
license to conduct any business involving the art
of tattooing on forms provided therefor, together
with payment ofthe applicable license fee. Before
the undersigned attesting officer duly authorized
by law to administer oaths personally comes the
applicant for a license to conduct the hereinafter
described business, and being first duly sworn on
oath, says that the information hereinafter given
and the statements hereinafter made in answer
to the following questions are true:
~ ) Penalty for violation. There shall be a $250.00
fine levied against each violation of the rules and
regulations set up in this section.

PURPOSE: To inform Mayor and Council on the Cycles for Charity Event held on
August 27, 2011 at the Liberty County Recreation Department Stafford Pavilion.
Cycles for Charity helps raise money for the Mayor’s Motorcade.
BACKGROUND: Cycles for Charity has been a fundraiser for the Mayor’s
Motorcade since 2007. This event helps to purchase gifts for Georgia Regional
Patients. Each year Mayor, Council, and staff participate in a parade in Savannah
and distribute gifts to the patients.
FUNDING: Donations are made from local businesses. At the event participants are
asked to pay a $10 registration fee or bring a gift. Local restaurants and stores have
agreed to supply food, drinks, and paper products.
RECOMMENDATION: Mayor and Council participate and encourage others in their
districts to participate on August 27, 2011.

PURPOSE:
To inform Council that the Resident Member appointment expires
August 6, 2011.
BACKGROUND: Susan Albright is the Resident Member on the Hinesville Housing
Authority and her appointment expires August 6, 2011. Ms. Albright is moving from
the Housing Authority. Recommendations are submitted by Debra Williams,
Executive Director because that individual has to live in the Housing Authority. An
appointment will be made once a recommendation is received from the Housing
Authority Board.

Acts. The general authority and powers of the
Authority are created and defined by the Act and related laws.
The Authority shall
engage only in such activities as are consistent with the purposes enumerated in the Act
or otherwise authorized by law.
Section 3.04.
Governing Instruments.
The Authority shall be governed by
the Act and these Bylaws, as the same may be duly and lawfully amended from time to
time, together with any and all other laws of the State of Georgia governing its affairs.
ARTICLE FOUR
Commissioners
Section 4.01.
Commissioners
Generally;
Appointment.
The powers and
duties of the Authority shall be vested in a body of Commissioners,
who shall be
appointed as provided in the Act. Unless otherwise prescribed by the Act, the mayor or
council (as required by the Act) of the City of Hinesville, Georgia shall appoint five (5)
persons as Commissioners of the Authority, together with one (1) or two (2) additional
Commissioners of whom at least one is directly assisted by the Authority in Hinesville,
Georgia

Section 4.02.
Term
of
Office.
As
established
by
the
Act,
each
Commissioner of the Authority shall serve for a term of five (5) years (except that each

Resident Commissioner shall be appointed for a term of office of one (1) year), and
shall continue in office thereafter until his or her successor shall have been appointed
and qualified or until his or her earlier death, resignation, disqualification or removal.
Unless otherwise provided in the Act, there shall be no limit to the number of terms of
office to which a person may be appointed to serve as a Commissioner of the Authority.
Section 4.03. Removal from Office.
In addition to any other general laws
permitting removal of a Commissioner from the Authority, a Commissioner may be
removed from office by the mayor of the City of Hinesville, Georgia pursuant to Section
8-3-53 of the Act for inefficiency or neglect of duty or misconduct in office; provided
that a Commissioner shall be removed only after he or she shall have been given a copy
of the charges at least ten (10) days prior to the hearing thereon and shall have had an
opportunity to be heard in person or by counsel.

thereon, shall be filed in the office of the clerk.
Section 4.04.
Vacancies. In the event a vacancy occurs for any reason, such
vacancy shall be filled by the mayor or city council (as required by the Act) of the City
of Hinesville, Georgia as provided in the Act.
Any person appointed to fill such
vacancy shall serve for the remainder of the unexpired term of office and until the
appointment and qualification of such person's successor. No vacancy on the Authority
shall impair the power of the Authority to exercise all of the rights and powers of and
perform all of the duties and obligations of the Authority.
Notwithstanding
foregoing, in the event any person serving as Resident Commissioner

Workshop.

BACKGROUND: The Mayor and City Council of the City of Hinesville will have a
Planning Workshop at the Sea Palms Resort, St. Simons Island, Georgia,
August 10-13, 2011. The purpose of the Planning Workshop is to discuss future
plans for the City of Hinesville.

Farmer’s Market: The Hinesville Downtown Development Authority hosts a Farmer’s
Market in Bradwell Park every Thursday from 4-8 p.m. See attachment
School Supply Giveaway: Sistaz with Vizionz Social Club will host its 1st Annual
School Supply Giveaway August 7 from Noon to 3 p.m. at the Liberty County
Recreation Department. The event is first come, first served. For more

Progress Through People Luncheon: The August Progress Through People
Luncheon is August 18 at the First Baptist Church from Noon to 1 p.m. Tommy
Linstroth, Founder and Principal of Trident Sustainability Group is the guest
speaker on “LEED and Sustainable Business Growth.” The event is sponsored
by Keep Liberty Beautiful.
SAVE THE DATE: The City of Hinesville will host its new City Hall Grand Opening
