IN THIS ISSUE Super Conference Highlights NEWSLETTER 2008 Over 150 people gathered at the Turning Stone Resort and Casino in Verona, NY for the FCPNY Super Conference on March 10th and 11th. Participants included publishers and staff from sales, classified and graphics departments. On Monday night, graphics awards were presented to the winners at the 2008 FCPNY Graphics Awards Ceremony. The 2008 FCPNY Salesperson of the Year honor was presented to Jean Clarke of the Scotsman Pennysaver, Syracuse, NY. All attendees had the benefit of visiting 11 industry vendors & associate members. AFCP provided presenters from The Leadership Institute and IFPA sponsored the classified keynote speaker. Exceptional networking opportunities, sound educational programs and some good food made for a valuable experience for all attendees. Look throughout this newsletter for highlights! 2 FREE COMMUNITY PAPERS OF NEW YORK April 2008 Greetings From the Desk of Your Executive Director Dan Holmes T he enthusiasm and talent within this industry never ceases to amaze me. 150 people joined the learning experience at Turning Stone Resort and Casino on March 10th and 11th to further their careers in the Free Paper business. The Super Conference provided training to sales reps through the AFCP Learning Institute. Thanks to Dave Tomasini, Charlie Delatorre and Tom Cuskey for sharing their knowledge and insights. Classified managers and representatives were the recipients of IFPA’s generosity. IFPA paid for Janet DeGeorge from Classified Executive Training who shared her expertise in classified revenue growth. The classified attendees also had the opportunity to refresh their customer service skills with Tim Smith. Our Graphics participants were reacquainted with Kevin Slimp who shared tips and techniques regarding color correction and Adobe Photoshop and our publishers had their horizons expanded regarding the importance of keeping up with the fast-paced changes in the electronic publishing world. Everyone in attendance had the additional opportunity to interact with the 11 industry vendors in attendance for the two-day conference. Congratulations to all of the winners in the Graphic Awards competition. Nearly 900 entries were received for this year’s contest, a record amount. Judges had a tough time analyzing all of the professional entries. Our graphics professionals have come a long way in this ever-changing facet of our business. distribution of “junk” mail can be detrimental without a specific definition of what constitutes “junk.” We had productive conversations and walked away with the agreement that our community publications need to be written out of the pending legislation. Just the opportunity to raise awareness of the importance of our publications to our communities was priceless and every assemblyman and Senator we spoke with was able to relate our message to their own local community publication. We are safe for now but we will have to remain vigilant in our effort to protect our interests from a legislative perspective. Welcome New Members! Napaul Publishers, Inc. Jean was nominated by her publisher at Scotsman Community Publications, Tom Cuskey. She was then screened and judged by four board members of the Sales Management Division of FCPNY. It was an extremely tight competition and Jean edged out a dozen other nominees, all of whom are clearly the cream of our sales representative crop. The next opportunity for professional training is the Sales Manager’s meeting to be held at the Esperanza Mansion on Keuka Lake June 8th, 9th and 10th. There are only 25 rooms available for this annual event and you don’t want to miss this chance to learn and network. Additional information is available in this newsletter. Your FCPNY staff is also busy on other fronts. In March we chose Hinman Straub Associates as our Government Relations representative. They have hit the ground running and on March 27th Dan Alexander and myself visited the State capital to visit with the sponsors of a bill that could impact our right to distribute our products to our readers. You will be hearing a lot locally and nationally about Do Not Deliver or Do Not Mail initiatives that mimic the Do Not Call registry. I t’s April!! I hope this finds everyone well. Spring has arrived and hopefully more sales than this past winter will follow. FCPNY has been quite busy since the last newsletter. Some items of note: Our Spring conference at the Turning Stone Casino and Resort was well attended and the Graphic Awards were terrific. I want to thank the eleven vendors recognized elsewhere in this newsletter for attending our conference and sharing their services with our membership. We have hired a lobbyist – Hinman Straub, located in Albany. Our contact person, Mara Ginsberg, spent Monday evening and Tuesday morning with us at Turning Stone. This allowed a proper introduction for Mara and a chance for her to learn more about our industry. She is busy working with Dan Holmes to deflect “Do Not Deliver” initiatives from affecting our community publications. They visited the Statehouse on March 27th and sat with the sponsors of a Do Not Deliver bill, Assemblywoman Aurelia Greene and Senator Carl Kruger. They also met with the chairs of the consumer affairs committees. The result of the meetings is the opportunity to define our publications and protect them as not included in the proposed legislation. Thanks to all of the members of the legislative committee who took the time and provided their expertise during the search for our new Government Relations firm. It is my pleasure to welcome two new publications to FCPNY; Hi, Neighbor publications was approved at our October Board of Directors meeting. Published by Brent Selleck Hi, Neighbor adds 13,000 circulation to our membership. Napaul Publishers was approved for membership at the January 28th Board of Director’s meeting. James Cole is the publisher of the Rensselaer County Shopper, the Dollar Stretcher and the Wise Shoppers with offices in Hudson Falls, NY. They bring 60,727 circulation to our membership total of 7,381,302. Your Board of Directors is a vibrant, committed group of leaders of the Free Paper industry in New York State. Due to acquisitions and consolidations we have some vacancies on our Board at this time. We would appreciate nominations of individuals that you think would add to the growth and momentum of FCPNY. Please give me a call with any suggestions. To help protect the integrity of the CPAN program and the results that our advertisers have come to expect we will be implementing an affidavit auditing process in the near future. We are trying to keep it simple and unobtrusive to you but we need verification that the ads that are distributed are run in all of your papers. Lastly let me be the first to invite you to the Sales Manager’s meeting to be held at the Esperanza Mansion on Keuka Lake and the Publishers Summit to be held at the Otesaga Resort in Cooperstown. The Sales Manager’s meeting is June 8, 9, and 10 and the Publisher’s Summit is September 19, 20 and 21. I have learned so much, met so many of you - our fabulous members, & have truly experienced the “magic” of the legacy that Mary so kindly left behind. Ad Group includes the Newark Pennysaver and the weekly CourierGazette newspaper, as well as the SodusWilliamson Pennysaver and the LyonsClyde Savannah Shopping Guide. “Many years of publishing in Wayne County have allowed me to witness and participate in an unprecedented amount of change and innovation. In January the chairmanship of PaperChain passed from Loren Colburn to Dan Holmes and when the leadership transition occurs we often schedule a strategic planning session to set the course for the next two years. Participants at this session made a clear directive, it is time for PaperChain to get back to the business of marketing the Free Paper industry. This is evident in the slight change made to the PaperChain Mission statement. It has changed from: “PaperChain enhances the profitability of its members by coordinating unified education, marketing and sales programs”, to: “PaperChain enhances the value of the members and the free paper industry by coordinating unified standards, education and marketing.” This simple change turns our PRIMARY emphasis towards the mission of education and marketing. We will continue to provide the industry with the Link & Learn educational tool on a monthly schedule. We will also strive to renew our marketing of the industry. Since we hit a home run associating with SRDS we have focused on direct sales vs. general marketing. The success we have enjoyed from our relationship with SRDS and the advertising some of our members have received as a direct result of that relationship verifies the importance of a marketing strategy. During our attempt to create a working database for use in national advertising sales efforts we backed away from the marketing function that has been the foundation of PaperChain’s existence. This was a strategic decision to avoid any overlap and lack of consistency with the efforts contracted with Gemstone Media. Our success with Gemstone and the data collection process has been limited due to a variety of reasons and due to short-comings on both sides of the relationship. Tim Bingaman at CVC has expanded his data collection process to include the compilation of rate information. All audited publications provide demographic and circulation information to CVC on a quarterly schedule and Tim will secure rate information on this same schedule, information that he will share securely with PaperChain and our internal database. Based on the success of this process we will continue to pursue direct sales in addition to our emphasis on marketing our industry and our products. We hope you will provide your rate information based on the faith and comfort you have with CVC, a long-time provider of audit services for our industry. We have much to do and through the Strategic Planning process conducted in Chicago we have created a structure to accomplish our goals. Three primary initiatives were created at the meeting and leaders have been chosen for each initiative. In the next month our action steps will be developed and PaperChain will announce our specific direction at the AFCP meeting on April 24th in Palm Springs. Steflik, Jr., Esq. • Coughlin & Gerhart, LLP Many employers have, over the last several years, instituted both Employee Assistance Programs (“EAP”) and wellness programs to aid employees with emotional, physical, addictive, and social problems and reduce medical insurance costs. Unfortunately, both have become the subject of lawsuits and federal regulation. EAP EAPs are employer, union, or joint counseling services designated to aid employees in the identification and resolution of personal and/or work-related problems. These problems may require the intervention of medical or counseling personnel. Such intervention may involve extremely personal and private matters – drug and alcohol abuse, family disputes, domestic violence, financial problems, gender identity issues, health, etc. Almost all programs promise privacy. Recent developments in the law necessitate an evaluation of the programs with regard to employer liability which may result from their use by employees. Both the Americans with Disabilities Act (ADA) and the New York Human Rights Law (HRL) prohibit discrimination against an employee with a disability or who is perceived to have a disability. Holihan v. Lucky Stores, Inc. (CA 9 1996), a federal case involving an EAP and perceived disability under the ADA, reflects the dangers to employers. There the employee had been the subject of fiftyone (51) abusive behavior complaints by co-employees. He was given the choice of suspension or leave pursuant to the company EAP. The court held: 18 “Lucky called Holihan into two separate meetings to discuss his aberrational behavior. At one of these meetings, Lucky District Manager Church asked Holihan if he was having any “problems”; at the other, Church strongly encouraged Holihan to seek counseling through Lucky’s EAP. Lucky also received several doctors’ reports diagnosing Holihan with depression, anxiety and stress, …. From these facts, a reasonable jury could infer that Lucky regarded Holihan as suffering from a disabling mental condition that substantially limited his ability to work.” An EAP was also the focus of litigation in a recent New York federal case, Jackson v. University of Rochester (NDNY 2006), where an employee allegedly told an EAP counselor that he would go home, get his gun if someone in the department ever made him angry, and he previously brought a gun to work with the intent to use it but no one upset him that day. The counselor notified the university and the employee was terminated. The court dismissed the case. However, both cases are instructive as to the conundrums faced by employers – recommendation to employees to seek assistance pursuant to an EAP may be an acknowledgement of a perceived disability; failure to direct such assistance may put co-employees at risk, and privacy concerns may involve both issues. Employers should carefully review their EAP and how they intend to utilize it. WELLNESS PROGRAMS Wellness programs may contain a variety of items – health club memberships, nonsmoker discounts, waiver of co-payments, health education, etc. The United States Department of Labor has recently issued guidelines to determine if a wellness program complies with the nondiscrimination provisions of the Health Insurance Portability and Accountability Act (HIPAA). The first issue is whether the wellness program is part of a group health plan (subject to HIPAA rules) or merely an employment policy (not subject to HIPAA rules). A wellness program subject to HIPAA must follow the following rules: 1. The amount of the reward must not exceed 20 percent of coverage. When calculating the 20 percent, the plan sponsor must include all of the plan’s wellness programs that require individuals to meet health-related standard. 2. The program must be reasonably designed to promote health or prevent disease. 3. Individuals must have a chance to qualify for the reward at least once a year. 4. The program must have a reasonable alternative standard for obtaining the reward for individuals for whom it is unreasonably difficult due to a medical condition to satisfy the standard or it is medically inadvisable to attempt to satisfy the standard. 5. All plan materials that describe the program must disclose the availability of a reasonable alternative. Thus, if a wellness program varies benefits based on meeting a healthrelated measurement, it must satisfy the five-factor test. Employees who fail to meet the requirements will be directed to correct their health plan and make participants whole for any violation. SUMMARY EAP and wellness programs serve a beneficial service for both employers and employees. However, be careful to craft the programs to accomplish your purpose and not expose your company to increased liability.
