Dix, offers to its guests. Gera, the
second largest town in the Free
State Thuringia is situated on the
banks of the river “Weiße Elster”
among an attractive hilly landscape.
During a tour through the former
Ruthenian Residence of the Princes
of Reuss Younger Line, guests who
are interested in arts and culture
will discover villas built in the end
of the 19th century – the years of
rapid industrial extension in Germany, or the birth house of the famous
painter and graphic artist Otto Dix
who is the most popular son of the
town.
The theatre with its long tradition,
the culture and congress centre and
four museums provide a life full of
diversity and culture. A further
special attraction is to be found 11
m deep under the Museum of Natural
History: the Caves of Gera. This is a
labyrinth of passages and nooks
which was used for storing beer in
the 16th to 18th century.

The system of caves, the so-called
“Höhler”, presents a speciality in

17th and 18th centuries, about 230
caves (subterranean cellars) were

Haus Schulenburg
The factory owner Paul Schulenburg of
Gera assigned Henry van de Velde to
build a country home in 1913. Today,
Haus Schulenburg is probably the only
completely preserved villa in the style
of Jugendstil from the Belgian
architect. The main and adjoining
building with gateway and coach house,
yards and interior are reconstructed
after original schemes. The garden of
about 3,500 m2 is presented in the
original way of 1919. This fabricant’s
villa accommodates a centre for
exhibitions and events for about 60
persons, a private museum containing
the worlds’ second largest collection
of book decoration of Henry van de
Velde, drafts, textiles, furniture of the
artist and a cafeteria.

In this house which is situated directly
next to the church St. Mary Otto Dix
was born in 1891. In honour of his
100th anniversary the house was
opened as a museum. The visitor can
walk along a gallery with paintings
from all working periods of Otto Dix
and have a look at the exhibition
showing the household of a worker’s
family at the beginning of the 20th
century, including information material
about the artist’s life and work. The
extensive collection contains for
instance one of his most important
works – “The Holy Christopherus”.
Orangerie
1729-1732 built as a semicircular
baroque complex in Gera’s “Kitchen
Garden” It served as military hospital,
a stable, barracks, a gym and finally
housed the Gera Art Association. The
Orangery has been the home of the
Gera Art Collection since 1972. It is
now a presentation hall for permanent
and changing exhibitions, paintings
and sculpturing of the 16th-20th
century.

Museum in the cave “Höhler no. 188“
See the hidden cellars of Gera, used throughout the centuries
to store beer. The second largest and with 11 m the deepest
cave which was built at the beginning of the 18th century
for storing beer is an extraordinary attraction of Gera. It is
situated under the Museum for Natural History and accommodates the impressing exhibition “Minerals and Mining in the
East- Thuringia” presenting approximately 700 minerals.

Town Museum
The town museum is located in the
city centre. It was built as
penitentiary and orphanage from
1724 to 1739. Between 1911 and
1913 an urban museum was
established. Nowadays it contains
one of the most meaningful historicocultural collections of Thuringia.
Worth mentioning is not only the
inventory concerning the history of
the Princes of Reuß but also the
evidences of Gera’s textile history,
regional production of tin and
porcelain and extensive photographic
and graphic collections. The industrial
history of Gera is of current thematic
priority.

Natural History
The Natural History Museum is
located in the oldest preserved
citizens' house of Gera within the
town wall, the "Schreibersche
House". Since 1984 a landscapeecological exhibition for the region
of East Thuringia designed after
modern point of views takes place
in this building of high cultural
heritage. The focus lies on geology,
flora and fauna as well as on the
usage and protection of this
landscape.

Hofwiesenpark
The “Hofwiesepark Gera” is the second
exhibition area of the Federal Garden
Show BUGA 2007, aside from the “New
Landscape Ronneburg”. Located on the
banks of the river “Weiße Elster” it offers
on an area of 300,000 m2 for recreation
and relaxation.

Garden of the Villa Schulenburg
The Kitchen Garden was originally used
for providing the royal family who lived
in the Castle Osterstein with herbs,
vegetable and regional food. Between
1729 and 1732 it was redesigned into a
park after French standard. At the same
time the Orangery was built. In the 18th
century the Kitchen Garden was used as
an open-air-theatre.

served as an exhibition
space for famous breeders of Gera and Bad
Köstritz. In the centre
there is a fountain
made by Thilo Schoder
in the architectural style “Bauhaus”,
1930 called “The Dahlia”.
The garden of about 3,500 m2 is presented
in the original way of 1919 including typical
plants. With the help of historical drafts of
the architect Henry van de Velde the pergola,
pavilions, fountain arrangement, bounteously laid out green and gardening spaces
surrounded by hedges were restored.

Zoo
The Botanical Garden of the
Natural History Museum
On an area of 0.7 ha the garden shows
the unique flora of East Thuringia en
miniature in several parts such as:
deciduous and coniferous forest, heath,
moor, dry and wet grassland and gravel
areas. This green oasis near the city
centre is completed by a pond, a geological didactic board and the “Turmhaus”.

The little zoo built in 1962 is located
in the middle of the forest of Gera, in
the attractive “Martinsgrund”. On an
area of 20 ha it accommodates more
than 200 animals thereunder
approximately 80 species of the northern
hemisphere. Our young visitors are
attracted by the petting zoo, the farm
and little narrow-gauge railway.

Garden of the Villa Jahr
This garden is a striking example for
historico-cultural meaningful buildings of
villas and their gardens in Gera. It serves
as an evidence for the representative
constructions of the upper classes in the
19th and 20th century. With the help of
original photos the park and even the then
existing bridge were rebuilt on the occasion
of the Federal Garden Show BUGA 2007.

General Conditions of Business
Dear Guest in Gera, With your booking, you have accepted the
after-mentioned tour conditions for the after-mentioned services
of Gera Tourismus e.V.:
Thematic city tours, day-trips, guided tours, package tours.
1. Tour Contract
1.1. With his/her booking, the client offers the Gera Toursimus
e.V. the conclusion of a binding tour contract. The booking
should be made in writing or as a telefax.
1.2. The offer is binding on the client for 2 weeks. The tour
contract only becomes binding on us when we have confirmed
the booking and the tour price in writing.
1.3. In so far as the client makes a booking for additional
participants, he/she is bound by the contract for his/her own
booking as well as for that/those of the other participant(s);
i.e. he/she is liable as the co-debtor, along with the other
participant(s) booked by him/her, for the fulfilment of the
contractual duties.
1.4. Should the content of the tour confirmation differ from
the content of the booking, we shall draw the attention of
the client to this fact expressly. We shall be bound for 10 days
to this new offer. The contract arises on the basis of this new
offer if the client informs us within 10 days of his acceptance,
or accepts this offer by payment of a deposit on the total
amount, or by an advance payment of the total amount.
3.6. Should individual tour services not be claimed by the client
due to an early return journey or due to other cogent reasons,
we shall endeavour to obtain a refund from the provider of the
service, as far as the non-claimed services
are not negligible, or as far as statutory or official ordinances
do not stand in the way of a refund. Should our endeavours to
obtain a refund of the expended costs be successful, we are
entitled to demand the expenses incurred by us in so doing from
the client, and are entitled to withhold an appropriate sum.
3.7. In the case of a delayed arrival, there is no entitlement to
the complete performance of the service. In the case of thematic
city tours or other tours, the guide shall wait for 1 hour. Should
the group arrive more than 30 minutes later than agreed, the
guide may demand a payment for waiting of 10 Euros or shorten
the tour accordingly. In the case of a delay of more than 60
minutes, the tour shall be considered to have been cancelled.
Cancellation costs in the amount of 25 Euros for each booked
tour will be incurred.
4. Reduction for Children
The age of the child/children at the commencement of the tour
is decisive for a reduction in price for children. We are entitled
to check the age of the child/children by means of identity
documents. Should the stated age not correspond to the age
given in the booking, we are entitled to raise the price for travel
subsequently.
If the contract is cancelled for this reason, we may demand an
appropriate compensation for the services already performed
or for the services which become necessary in order to bring
the service to a conclusion. § 651 j BGB is supplementary to
this stipulation.
7. Liability
7.1. Our contractual liablility for damages which do not constitute
bodily damage, is limited to the threefold value of the tour
price, in as far as damage to the client has not been caused
willfully or through gross negligence, and in as far as we are
liable for damage to the client which has been caused only by
the fault of the provider of a service (§ 651 h BGB). The same
applies to all claims of the client for damages against us due
to impermissable action which was not performed willfully or
through gross negligence.
7.2. We are not liable for a disturbance of the service in
connection with services which have merely been negotiated
as external services of others and which are stated in the tour
description expressly to be services of others.
7.3. If international conventions or statutory ordinances based
on such conventions apply to any of the tour services performed
by our providers of services, according to which a claim for
damages only arises or can only be made or is excluded under
certain conditions or limitations, then our liability is limited
or excluded accordingly (§ 651 h II BGB).
5. Cancellation/Rebooking by the Client
2. Payment
2.1. On conclusion of the tour contract, 25% of the total tour
price is due for payment immediately. The remaining sum must
have been paid, to the stated account, by 10 days before the
commencement of the tour at the latest. On payment of the
total amount, the tour documents will be sent to the client.
5.1. The client can withdraw from the contract at any time
before commencement of the tour (§651 i BGB). For the purpose
of evidence, we advise that the cancellation be made in writing,
attaching all the tour documents to the declaration of cancellation.
The cancellation is valid from the time of the receipt of the
cancellation by us.
2.2. We are entitled to withhold the service entirely and to
demand compensation from the client for non-fulfilment of
the tour contract, if the client is in arrears with the payment
of the tour price and the client has been given prior notice in
writing by us of the withholding of service.
5.2. In the case of the cancellation of the contract, we may
demand an appropriate compensation for the tour arrangements
already made and for our expenses. Depending on the date of
the receipt of the cancellation, the following flate-rate percentages
of the tour price are agreed as compensation:

due immediately.

or in the case of non-appearance
2.4. For the booking of thematic city tours, day-trips and other
guided tours, the payment of the tour is due, after confirmation
of the booking, by bank transfer by 10 days before the date
of the tour at the latest. In the case of bookings at short
notice, the payment is due before the commencement of the
tour to the accompanying guide, who is duly empowered to
accept payment.
2.5. In the case of international money transfers, the charges
arising will be charged to the bill separately.
3. Services, Prices
3.1. The extent of the contractual services corresponds to the
description of services valid at the time of the conclusion of
the contract, and given in our prospectus or in our Internet
advertisement, as well as in accordance with further agreements
concluded on the basis of the tour booking and tour confirmation.
The right to alterations in this information in the form of
special announcements before the conclusion of the contract
are reserved. The concept "tour price" in these tour conditions
refers to the price of the respective offer of a package tour.
3.2. Alterations and discrepancies in individual tour services
over against the agreed content of the tour contract, which
are not foreseeable for us, are only valid in so far as the
alterations and discrepancies are not considerable and do not
impair the total arrangement of the booked package. In this
case, the client will be informed by us of the alterations
immediately. In this case, the client is entitled to withdraw
from the contract or, instead, to demand participation in
another package which is at least equivalent, as long as we
are in a position to offer the client such a package without
additional cost.
3.3. Services of transportation are only then a part of the
package offer if they have been agreed expressly. The client
is responsible him/herself for the transportation from the place
of residence to the area defined under our package. This also
applies to luggage.
3.4. The client will be afforded accommodation and - as far as
agreed - catering, corresponding to the booked category.
Should the accommodation not correpond to the contractual
agreement as well as to the details contained in our catalogue
of package offers, the client must report the deficiency
immediately to Gera Tourismus e.V., Heinrichstrasse 35, 07545
Gera, in order to place us in a position to check the deficiency
in accommodation and to rectify the shortcomings which have
occurred.
3.5. Subsidiary agreements which extend the content of the
service are only valid when confirmed in writing by us. Special
wishes are only valid as agreed, as long as they have been
noted in writing by us on the confirmation of booking.

7.4. If we point out in our tour description and/or in the tour
confirmation that transportation will be performed by public
transport services, then this is for us the external service of
others. In such cases, we are not liable for the performance of
the service. The liability is defined in such cases by the conditions
of transportation of the respective enterprise. We will willingly
provide the client with a copy of these conditions of
transportation.
8. Guarantee
8.1. If we do not perform the service for the client according
to contract, then the client has a claim to redress in as far as
this requires no inappropriate effort and expense. In order to
fulfil our obligation of redress, we will offer an equivalent
service as a substitute.
The charge for cancellation is due for payment immediately.
8.2. The client is entitled to demand a corresponding reduction
in the tour price for the duration of the non-performance of
the service due to the contravention of the contract on our
part.
5.3. Rebookings to another date of tour within the period of
validity of the package offer, may only be made depending on
the possibilities and with the agreement of the provider of the
service who has been contractually bound by us. The charge for
rebooking amounts to 5 Euros per participant.
8.3. The client is bound to inform us immediately of any
deficiency in our service, so that, in the case of the occurrence
of a disturbance of the service, damage may be avoided or kept
to a minimum. If the customer does not give notice of damage
culpably, then he/she loses the claim to a reduction.
5.4. Until the commencement of the tour, the client may have
him/herself replaced by a third person. Additional expenses
which have been incurred in fact, must be assumed by the client.
We are entitled to reject the alteration in the person of the
participant if this third person does not seem suitable for the
package offer or legal ordinances or official instructions stand
in the way. Should a third person enter into the contract, then
both he/she and the client are liable to us as co-debtors for the
tour price and for the additional expenses which have been
incurred due to the entry of the third person.
9. Superannuation

5.5. If we have ordered entrance tickets for the client, e.g. for
the theatre or other events, we have no liability to accept them
back.
5.6. In the case of thematic city tours, day trips and other
guided tours, it is agreed that cancellation until 3 days before
the commencement of the tour is without costs. If the cancellation
is made 2 days before the commencement of the tour or later,
a cancellation charge of 15 Euros per booked tour is due.
6. Withdrawal or Cancellation by Gera Tourismus e.V.
We are entitled to withdraw from the contract before or after
commencement of the tour in the after-mentioned cases:
6.1. Without a period of notice when the client, after a prior
warning, disturbs persistently the performance of the tour
through his behaviour or conducts him/herself in non-negligible
contravention of the contract, so that the immediate cancellation
of the contract is justified. If we make use of this exceptional
clause, we maintain our claim to the tour price, with a reduction
for the value of the saved expenses as well as of those benefits
which we may derive from the use elsewhere of the services not
performed.
6.2. We are entitled to cancel the contract until 2 weeks before
commencement of the tour if, by this date, the minimum number
of participants, as stated in the prospectus, has not been reached.
In this case, we are bound to inform the client immediately of
the non-performance of the tour and to declare our withdrawal
from the contract. The already paid tour price will be refunded
to the client immediately.
If the tour is hindered, endangered or impaired considerably by
acts of God which could not be foreseen, both we and the client
may cancel the contract merely on the basis of this stipulation.
According to the statutory stipulation, the client must make
a claim against us for the non-performance of the tour services
in contravention of the contract within a month after the
contractually stipulated conclusion of the tour. After the expiry
of this period, the client can only make a claim if he/she had
been hindered, through no fault of his/her own, in making the
claim within the time limit. Claims of the client are superannuated
after 6 months. The period until superannuation begins on the
date on which the tour should end according to contract. If
the client makes such a claim, then the commencement of the
period until superannuation is delayed until the date on which
we reject the claim in writing.
10. Salvatory Clause
The invalidity of any stipulations of these general conditions
of tours does not invalidate the remaining stipulations of these
conditions of business. An arrangement is then deemed to have
been agreed between the parties which corresponds most exactly
to the will of the parties as expressed in these conditions of
business.
11. Tour Operators
In so far as services are not designated expressly as "package
tours" in our offers, yet, on the other hand, are supplemented
with the complete address, telphone number and, when occasion
arises, with the telefax number, then Gera Tourismus e.V. is
only the intermediary agent. In this case, the stipulations of
§ 651 a I BGB apply.
12. Competent Court
The client can only take legal action against us at or location.
The venue of the competent court is thus the lower court of
Gera (Amtsgericht Gera). In so far as we make claims arising
from contracts of which the contractual partners are commercial
agents in their own right and/or
persons who have no general competent court in Germany,
and/or against persons who have removed their place of residence
or their usual place of sojourn abroad since the conclusion of
the contract, and/or whose usual place of sojourn is unknown
at the time of initiating legal proceedings, then Gera is agreed
to be the sole venue of the competent court.
