Summary The State of Texas’ primary criminal records database is missing 36% of the criminal records included in an October 2008 study by Imperative Information Group, a Fort Worth-based private investigations firm specializing in background investigations and corporate due diligence. The Texas Department of Public Safety’s (DPS) Computerized Criminal History (CCH) database is relied upon by state licensing agencies and many employers as their primary source for criminal records information on occupational licensing and employment applicants. In many cases, these applicants will be working in safetysensitive positions including public education, in-home services such as air conditioning repair 1, and a variety of healthcare related services. Because of the large number of serious criminal records missing from Texas DPS’ CCH database, Texas consumers are at risk when state licensing agencies or employers rely primarily on CCH data as the source for criminal history information. Overview of Study and Use of Texas DPS’ CCH System According to the Texas Department of Public Safety’s website, the CCH system is defined as follows: “Chapter 60, Code of Criminal Procedure (CCP) defines the Computerized Criminal History System (CCH) as the statewide repository of criminal history data reported to DPS by local criminal justice agencies in Texas.” 2 In other words, the CCH system is a database of criminal information provided to the state by local jurisdictions across Texas. This database is used by licensing agencies and businesses for the purpose of screening applicants for employment purposes. By Texas DPS’ own admission, keeping the database “accurate and up-to-date is a true public safety responsibility for both criminal and noncriminal justice purposes.” 3 However, Imperative found that the CCH system is missing more than one in three criminal cases researched in this study. While this failure does fall in part to the state, some failures can be attributed to a lack of information provided to the Texas DPS by local jurisdictions. The following details explain why relying on the CCH system can be dangerous to any organizations using the state’s data as a reliable means of employment-related background checks. 1 For example, during the 2007 legislative session, House Bill 463 directed the Texas Department of Licensing and Regulation (TDLR) to conduct background checks on applicants for air conditioning contractor licenses. Of the 562 criminal cases analyzed in this study, 400 involved felony cases and 162 cases involved misdemeanor offenses. The felony cases studied included offenses as extreme as capital murder to lesser offenses such as possession of a controlled substance, forgery, and burglary. The charges for the misdemeanor cases ranged from disorderly conduct to theft by check to driving while intoxicated. Overall, 36% of the investigated cases did not appear in Texas DPS’ CCH system. The table below indicates the percentage of records missing from the CCH database by case type. This table provides a strong indication that the CCH system is consistent in its inaccuracy, failing to report more than one in every three reportable cases, regardless of offense type. Percentage of Missing Records by Case Type Capital Murder 34.1% Felony 35.9% Misdemeanor 40.1% The 361 capital murder cases chosen for the study are associated with offenders on Texas’ Death Row as of October 1, 2008. Therefore, at the time of the study, over onethird of the death row population did not appear in Texas DPS’ database. Although the discrepancy in the percentage of missing records was negligible between case types, the difference in the percentages between dispositions varied to a much greater extent. Of the 562 criminal cases studied, the CCH database missed 34% of the cases that ended in guilty convictions but almost 60% of all cases ending with an order of deferred adjudication. The CCH database does not include any cases that are pending before the court or that have been dismissed, even though such records can be crucial to employers in certain situations. Organizations such as the TLDR have statutes allowing the examination of criminal cases ending with an order of deferred adjudication (in addition to convictions ending in a guilty plea); however, they are relying on a system that misses almost 60% of deferred adjudication cases. 4 How Effective are Individual Counties at Reporting Criminal Records? The Texas DPS indicates on their website that the CCH system obtains the information included in the database from individual counties, local arresting agencies, and prosecuting agencies. 4 H.B. 463, Section 2. 2 The DPS notes that records are absent from the CCH database for either of two reasons: - A criminal case was reported but the original arrest associated to the case was not, and therefore, the case is placed in the DPS “suspense” file until a matching arrest report is received, or - The appropriate reporting agency failed to report the case to the state. 5 In addition to analyzing the completeness of the CCH database, Imperative also surveyed the counties in which the convictions originated for all studied cases. The ten counties included in the following table were responsible for the most cases in this study. They are arranged by the number of cases studied. A missing record does not necessarily indicate the county failed to report the case to the state; however, it does provide a clear indication of how well each county is communicating with the state. Summary of Results and Implications The results of this study indicate that employers who are relying on Texas DPS’ CCH system as a primary source for background investigations have a better than one-inthree chance of missing criminal records. Direct searches of county court indices is the only way to circumvent the possibility of missing records due to failures in communication between local jurisdictions and the state. Directly searching the criminal records in each county where an individual has lived, worked, and attended school is the most effective way of obtaining a detailed criminal history. However, use of the Texas DPS CCH provides the opportunity to identify criminal records originating in counties not associated with an applicant’s residential history. Any records obtained from a database search should always be verified at the county level in order to avoid the risk of relying on incomplete or out-dated information. Randall Mays 05/16/2008 In 2007, police were dispatched to Mays' home in response to a domestic disturbance call. Upon arrival, Mays broke free from the police and ran into his home where he armed himself with a 30-06 rifle and a handgun. Christopher Wilkins Antonio Williams In 2005, Wilkins murdered two men in Fort Worth after a misunderstanding after a drug deal. 03/12/2008 12/28/2007 Note: The Texas DPS lists prior records for this inmate, but the death row conviction is missing. On 08/05/2006 in Harris County, Texas, Williams fatally shot a black female and a black male after an argument. Witnesses positively identified Williams and he was arrested on 09/23/2006. Kosoul Chanthakoummane 10/18/2007 On 07/08/2006, Chanthakoummane attacked Sarah Walker in a model home in McKinney, Texas. He stabbed Walker 27 times and left her to die. Note: The Texas DPS is missing all records related to Chanthakoummane's criminal history. 5 Selwyn Davis 10/17/2007 On 08/22/2006 in Travis County, Davis entered the unoccupied apartment of two Hispanic females through a window. When the 15 year-old female arrived home, Davis sexually assaulted her. He then waited until the second victim, a 57 year-old female, returned home. At that time, the subject pumched her several times with a closed fist, and then stabbed her six times in the chest and back area, later causing her death. Joseph Gamboa Juan Segundo 06/29/2007 Gamboa murdered the owner and an employee of a Taco Land on 06/24/2005. Another employee was shot but survived. Note: The Texas DPS lists prior records for this inmate, but the death row conviction is missing. 02/15/2007 On 08/03/1986 in Tarrant County, the subject entered a residence in Fort Worth and, after raping her, strangled an 11 year-old Hispanic female. Tilon Carter 12/12/2006 On 04/28/2004 in Tarrant County, Carter and his codefendant entered the residence of an 89 year-old white male, bound him at the hands and feet and beat him to death. Clifton Williams 10/27/2006 On 07/09/2005 in Smith County, Williams entered into the residence of a 93 year-old white female, stabbed, beat and strangled her, and burned her body. On 05/21/2005 in Dallas County, Long sexually assaulted and asphyxiated an 11 year-old white female. Steven Long 10/19/2006 Note: The Texas DPS is missing all records related to Long's criminal history. 6 Ramiro Gonzales Stephen Barbee 09/27/2006 On 01/15/2001 in Medina County, Gonzales kidnapped an 18 year-old female, sexually assaulted and fatally shot her. Note: The Texas DPS lists prior records for this inmate, but the death row conviction is missing. 02/27/2006 In February of 2005, Barbee murdered his pregnant exgirlfriend and her 7 year-old son to cover up an affair. Barbee smothered the victims and then buried them in a shallow grave in rural Denton County. Note: The Texas DPS is missing all records related to Barbee's criminal history. Edward Lee Busby, Jr. 11/18/2005 In February of 2004, Busby and codefendant kidnapped a retired TCU professor in an attempted robbery. Busby placed duct tape around the professor's face so that she was unable to breath, causing the professor's death. The defendants later dumped the body in Davis, Oklahoma. Alfred Brown 11/10/2005 On 04/03/2006 in Harris County, Brown and two codefendants fatally shot a store clerk and a Houston police officer while robbing a check cashing establishment. Noah Espada 10/27/2005 On 03/18/2004 in Bexar County, Espada entered the home of his former employer, a 32-year-old male, and waited for him to return home. When the victim returned home Espada shot him multiple times, resulting in his death. Note: The Texas DPS is missing all records related to Espada's criminal history. Rodolfo Alvarez Medrano Jimmie Urbano Lucero 09/08/2005 On 01/05/2003 in Hidalgo County, Texas, Medrano and 10 co-defendants entered a private residence. After demanding drugs, money and guns, the subjects fatally shot 6 Hispanic males. Note: The Texas DPS lists prior records for this inmate, but the death row conviction is missing. 08/24/2005 On 09/06/2003 in Potter County, Texas, Lucero entered the residence of a neighbor and killed a 74-year-old Hispanic female, a 32-year-old Hispanic female and a 72-year-old Hispanic male with a shotgun. Two other family members were also shot, their injuries were serious but not fatal. Note: The Texas DPS lists prior records for this inmate, but the death row conviction is missing. 7 Chelsea Lea Richardson 08/10/2005 On 12/11/2003 in Tarrant County, Texas, Richardson and three co-defendants entered the residence of a 46year-old white male and a 46-year-old white female. Richardson and co-defendants fatally shot and stabbed both victims. Note: The Texas DPS is missing all records related to Richardson's criminal history. Justen Grant Hall Andre Thomas 05/11/2005 On 10/28/2002 in El Paso County, Texas, Hall fatally stangled a female (race and age unknown) with a black electrical cord. Note: The Texas DPS lists prior records for this inmate, but the death row conviction is missing. 03/16/2005 On 03/27/2004 in Grayson County, Texas, Thomas entered the residence of his wife, a 20-year-old female, and fatally stabbed her. He then fatally stabbed his son, a 4-year-old male, and his step-daughter, a 13-monthold female. Thomas then left the scene, walked home and stabbed himself three times in the chest. John Manuel Quintanilla, Jr. 12/08/2004 On 11/24/2002 in Victoria, Texas, Quintanilla and two male co-defendants entered an action amusement center through a partially opened back door, demanded cash from an employee and advised all other patrons to get down on the floor. An adult white male attempted to disarm Quintanilla and was fatally shot three times. A second victim, and adult white female, was also shot, but the injury was not fatal. Juan Raul NavarroRamirez 12/23/2004 On 01/05/2003 in Hidalgo County, Texas, NavarroRamirez and 10 co-defendants entered a residence to steal a large quantity of marijuana. During the course of stealing the marijuana, Navarro-Ramirez and his codefendants killed six Hispanic males. Tracy Beatty 08/13/2004 On 07/25/2003 in Smith County, Texas, Beatty strangled his mother, a 62-year-old white female, placed her in the bathtub for two days and then buried her in a shallow grave in their backyard. Note: The Texas DPS lists prior records for this inmate, but the death row conviction is missing. 8 Barney Ronald Fuller, Jr. 07/21/2004 On 05/14/2003 in Houston County, Texas, Fuller entered the residence of his neighbors, a 43-year-old white male and a 39-year-old white female and fatally shot both of them multiple times. Anthony Dewayne Doyle 05/28/2004 On 01/16/2003, in Dallas County, Texas, Doyle placed a phone order for food and requested delivery. Upon arrival, Doyle demanded money from the 37-year-old Asian female that was making the delivery. When the victim told Doyle that she did not have any money, he struck her in the head with a baseball bat, causing her death. Doyle then placed her body in a dumpster and fled in her vehicle. Juan Reynosa 05/21/2004 On 03/02/2003, in Harris County, Texas, Reynosa approached an adult male and female, pointed a gun at them and demanded their money. The male victim complied, but the female told him that she did not have any money. Reynosa struck the female with his fist causing her to fall to her knees where he fatally shot her in the chest. Mario Swain 04/08/2004 On 12/27/2002, in Gregg County, Texas, Swain broke into a residence with the intent to steal money. While the burglary was in progress, the victim, a 44-year-old white female, returned home. After a struggle, Swain struck the victim in the head with a tire tool and placed her body in the trunk of her car. He transported her body to an abandoned car and placed her in the trunk. Swain returned to the home and stole money, jewelry and credit/debit cards. Note: The Texas DPS is missing all records related to Swain's criminal history. Rodrigo Hernandez 04/07/2004 On 02/19/1994, in Bexar County, Texas, Hernandez abducted a 38-year-old white female from a grocery store parking lot. Hernandez restrained the victim by placing his hands around her neck and then sexually assaulted her. When Hernandez realized the victim was not breathing, he transported her body to a park and left her in a garbage can. Allen Guy 03/24/2004 On 04/03/2002, in Travis County, Texas, Allen engaged in a physical altercation with his girlfriend, a 47-year-old black female. After witnessing the assault, the victim's daughter, a 19-year-old black female, called the police. Upon arrival, the police found both female victims stabbed to death. Note: The Texas DPS lists prior records for this inmate, but the death row conviction is missing. 9 William Irvan 03/03/2004 On 02/14/1987, in Harris County, Texas, Irvan entered the home of a 24-year-old white female, sexually assaulted her and stabbed her multiple times, resulting in her death. Cleve Foster 03/01/2004 On 02/14/2002, in Tarrant County, Texas, Foster and co-defendant Shelton Ward sexually assaulted and shot a 28-year-old black female, resulting in her death. Foster and Ward then moved the body of the victim to a ditch where it was discovered by workers who were laying pipe. Note: The Texas DPS is missing all records related to Foster's criminal history. Robert Garza 12/18/2003 On 09/05/2003, in Hidalgo County, Texas, Garza and co-defendants killed four Hispanic females by firing into the victims' car. It was later discovered that Garza and his co-defendants were members of the Tri City Bomber Gang, carrying out orders to murder one of the females who was a witness to their weapons activity. Terry Edwards 12/04/2003 On 07/08/2002 in Dallas, Edwards and co-defendant Kirk Edwards entered a restaurant, fatally shot an adult male and an adult female, took money from the cash register and fled the scene. John Allen Rubio 11/24/2003 On 03/11/2003, in Cameron County, Texas, Rubio and co-defendant Camacho fatally stabbed and beheaded Rubio's 2-month-old daughter, his 1-year-old son and Camacho's 3-year-old daughter. Martin Robles 09/23/2003 On 11/12/2002, in Nueces County, Robles and codefendant, Padron, entered a residence and fatally shot a 20-year-old Hispanic male and a 19-year-old Hispanic male. Note: The Texas DPS lists prior records for this inmate, but the death row conviction is missing. 10 Derrick Dewayne Charles 05/27/2003 On 07/02/2002, Charles was visiting his girlfriend when he attacked and strangled a black male who lived at the residence. When his girlfriend and her mother arrived back at the residence, Charles sexually assaulted her mother, bound both of them and placed ligature on them, resulting in their deaths. Abel Revill Ochoa Pete Russell, Jr. 05/15/2003 On 08/04/2002, in Dallas, Texas, Ochoa fatally shot his 29-year-old wife, his 7-year-old daughter, his 9-monthold daughter, his father-in-law and his sister-in-law. Note: The Texas DPS is missing all records related to Ochoa's criminal history. 02/26/2003 On 08/13/2001, in Houston, Texas, Russell fatally stabbed a 40-year-old black female. Russell believed that the victim had set him up on a delivery of cocaine charge. Russell was sentenced to ten year on the cocaine charge, and committed this offense while on bond from the court to get his personal affairs in order before serving his sentence. Chris Wayne Shuffield 02/05/2003 On 07/29/2002, in Simms, Texas, Shuffield and one codefendant went to the residence of a 36-year-old white male. Shuffield retrieved a shotgun from the victim's bedroom and shot the victim one time. Shuffield then retrieved a .380 caliber pistol and shot the victim two more times, resulting in his death. The subjects then took the victims wallet, guns, knives, pills and truck. Note: The Texas DPS is missing all records related to Shuffield's criminal history. Keith Steven Thurmond 11/14/2002 On 09/25/2001, in Magnolia, Thurmond murdered his estranged wife and her boyfriend. The boyfriend, a 35year-old white male, was shot inside the victim's residence. The wife, a 32-year-old white female was shot outside the residence. Note: The Texas DPS is missing all records related to Thurmond's criminal history. 11 Licho Escamilla 11/01/2002 On 11/25/2001, in Dallas, Escamilla was engaged in a fight in the parking lot of a nightclub. When Dallas City police officers arrived to stop the fight, Escamilla shot an adult white male police officer two times. The officer died en-route to the hospital. Ramon Torres Hernandez 10/21/2002 On 03/31/2002, in San Antonio, Texas, Hernandez and two co-defendants abducted, robbed, sexually assaulted and murdered a 37-year-old Hispanic female, later transporting her body to a wooded area and burying her in a shallow grave. Hernandez asked one co=defendant to purchase the shovel used to dig the grave while the victim was still alive and being assaulted. Gregory Lynn Russeau 10/15/2002 On 05/30/2001, in Tyler, Russeau struck a 75-year-old white male numerous times in the head causing his death. Russeau also took the victim's wallet and a vehicle from the victim's place of business. Note: The Texas DPS lists prior records for this inmate, but the death row conviction is missing. Vaughn Ross 10/01/2002 On 01/31/2001, in Lubbock, Ross shot and killed an 18year-old black female and a 53-year-old white male. The bodies of the victims were found in a car in a ravine. Jesse Joe Hernandez 08/08/2002 On 04/11/2001, in Dallas, Texas, Hernandez struck an 11-month-old Hispanic male and his sister in the head with a flashlight. The children had been left in the care of Hernandez when the incident took place. The sister survived her injuries, but the 11-month-old did not. Note: The Texas DPS lists prior records for this inmate, but the death row conviction is missing. 12 Ronnie Paul Threadgill 07/22/2002 On 04/14/2001, in Navarro County, Texas, Threadgill murdered a 17-year-old black male. The victim had received a single gunshot to the upper body and was taken to Navarro County Regional Hospital where the victim died. Threadgill also took a vehicle during the incident. William Josef Berkley 07/18/2002 On 03/10/2000, in El Paso, Texas, Berkley kidnapped an 18-year-old Hispanic female from a private residence and took her to a deserted area, where he sexually assaulted her, robbed her and shot her five times in the head with a .25 caliber pistol. Berkley then left her body in a deserted area. Note: The Texas DPS lists prior records for this inmate, but the death row conviction is missing. Jonathan Marcus Green 07/17/2002 On 06/21/2000, in Montgomery County, Texas, Green kidnapped a 12-year-old white female from a private residence. Green took the victim to his residence, where he killed her by strangling her to death. The victim was also sexually assaulted. Green buried the victim in his backyard, then dug up the body and placed it inside the residence, behind a chair. Geronimo Rene Gutierrez 05/21/2002 On 05/29/1999 in San Antonio, Texas, Gutierrez abducted and murdered an adult Hispanic male. The victim was abducted in a parking lot of a convenience store by Gutierrez at gunpoint with a piston grip 12guage shotgun. The victim was taken to a secluded location where Gutierrez shot him five times with the 12guage shotgun. After seeing the media coverage of the incident on the news, Gutierrez went back on 05/31/1999 and set fire to the body. Perry Allen Austin 04/25/2002 On 08/19/1992, Austin went to the Harris County home of the victim (a 9-year-old white male), looking for the victim's older brother. The victim got in the car with Austin and left, presumably to look for the older brother. The skeletal remains of the victim were found on 04/23/1993 in a landfill located in Harris County. Robert Gene Will II 01/28/2002 On 12/04/2000 in Houston, Will, who was attempting to burglarize a vehicle, was being chased by a white male police officer. Once the officer reached Will and attempted to apply restraints to him, Will shot the officer seven times in the head, resulting in the officer's death. Note: The Texas DPS is missing all records related to Will's criminal history. 13 William Speer 10/30/2001 On 07/11/1997 at the Telford Unit in Bowie County, Speer strangled to death a 47-year-old white offender in the victim's cell. Alvin Avon Braziel, Jr. 08/09/2001 On 09/21/1993 at 9:00 p.m. in Mesquite, Braziel approached a newlywed couple walking on a jogging trail of a community college. Braziel demanded money. When it was discovered that neither of the two had any money in their possession, Braziel shot the 27-year-old white male, resulting in his death. Braziel then sexually assaulted the 23-year-old white female. Braziel linked to the crime in January 2001 when his DNA was found to match the DNA taken from the female victim. Jedidiah Isaac Murphy 07/26/2001 On 10/04/2000, in Garland, Murphy forced a 79-year-old white female to give him a ride at gunpoint. After riding for about 30 minutes, Murphy forced the victim into the trunk of the car. The victim was shot while getting into the trunk. Murphy then drove the victim's car to Van Zandt County, where the victim was removed from the trunk and drowned in a creek. During the robbery, Howard shot a 42-year-old white female clerk one time in the chest, causing her death. Howard took $114 from the cash register during the robbery. William Earl Rayford 01/04/2001 On 11/16/1999 in Dallas, Rayford murdered a 44-yearold black female by strangulation, stabbing, and blunt force. Bernardo Aban Tercero 12/13/2000 On 03/13/1997, Tercero and one co-defendant entered the Park Avenue Cleaners and shot and killed an adult male in the presence of his 3-year-old daughter. An unknown amount of cash was taken from the business and Tercero and his co-defendant fled the scene. Tercero further fled to Florida, while his co-defendant fled to Mexico. Robert Wayne Harris 10/06/2000 On 03/20/2000 at a car wash in Irving, Harris entered his former place of employment and began shooting coworkers. Harris has been fired three days prior to the shooting after exposing himself to two women. Five people were killed during the shooting. After the shooting, Harris fled the scene on foot. Larry Ray Swearingen Ronnie Hyde On 12/08/1998, Swearingen kidnapped and strangled a 19-year-old white female. 07/12/2000 05/24/2000 Note: The Texas DPS lists prior records for this inmate, but the death row conviction is missing. On 05/08/1998 in Bedias, Hyde burglarized the residence of a 72-year-old white male. Hyde had worked for the victim in previous weeks, and therefore was acquainted with the victim. Hyde beat the victim in the head with a hammer, killing him. Hyde took $1,000 and fled on foot. Note: The Texas DPS lists prior records for this inmate, but the death row conviction is missing. 15 Robert Hudson 04/06/2000 Hudson was convicted in the 05/07/1999 stabbing death of a 35-year-old black female and the attempted murder of her 9-year-old son. Hudson caught the victim with another man and stabbed her seven times in the upper torso with a knife. The victim's son tried to intervene and Hudson slashed him two times in the throat with a knife. The victim died at the scene and her son ran out of the apartment to a neighbor, who called the police. Hudson was arrested at the scene. A 30-year-old white male police officer stopped the vehicle and attempted to arrest Williams. Williams shot the officer in the chest and fled the scene. Roderick Dasha Netwon Arturo Eleazar Diaz 03/15/2000 On 03/09/1999, Newton and one co-defendant carjacked a 20-year-old Hispanic male, forced him to an ATM at gunpoint, then shot and killed him. Note: The Texas DPS lists prior records for this inmate, but the death row conviction is missing. 02/20/2000 On 04/03/99, in the nighttime, in McAllen, Texas, Diaz and one co-defendant, murdered one male by stabbing him 94 times in the upper chest with a knife at the victim's apartment and stabbed another male, who was also at the apartment, two times in the face. Diaz and the co-defendant went to the apartment looking for drugs and also intended to rob the victim. Diaz and the co-defendant robbed the victim of an unknown amount of money and fled the scene by vehicle. Ramiro Hernandez 02/11/2000 On 10/15/1997, during the nighttime, in Kerrville, Texas, Hernandez was working as a hired hand for a 49-yearold white male. Hernandez broke into the victim's residence and beat the him to death with a metal bar. Hernandez then tied up the victim's wife and raped her repeatedly. Note: The Texas DPS is missing all records related to Hernandez's criminal history. 16 Ray Jasper 02/04/2000 On 11/29/98, Jasper and two co-defendants were responsible for the death of a 33-year old white male, which took place during a robbery. The victim was a musical engineer who owned a recording studio in San Antonio and was a business partner of Jasper. Jasper had created his own record label and had his own rap group. Jasper went to the recording studio of the victim. He walked up behind the victim and grabbed him by the hair and slit his throat. The victim was then stabbed to death. Jasper covered the victim with a black sheet in order to "not have to look at him." Jasper then began loading vehicles with the equipment inside the studio, estimated to be worth between $10,000 and $30,000. Jasper and his codefendants made several trips taking the property from the studio, and upon returning to the scene of the crime, he was observed to be suspicious, and eventually apprehended by police. Derrick Lamone Johnson 12/22/1999 On 01/21/99, in Dallas, Texas, Johnson and one codefendant were responsible for the death of a 25-yearold black female during the commission of a robbery. The courts indicate that Johnson and his codefendant beat the victim about the head with a board and then suffocated her with a shirt and sweater. Manuel Vasquez 11/30/1999 On 03/19/98, in San Antonio, Texas, Vasquez and codefendants strangled to death and robbed a 51-year-old Hispanic female as an ordered hit from the Mexican Mafia because she was not paying 10 percent to the Mafia. Yowell 11/23/1999 On 05/19/98 in Lubbock, Texas, Yowell shot his father, strangled his mother with a cord, and set fire to their house. The victim's grandmother died several days later from injuries sustained because she was disabled and unable to get out of the house. Two other male victims were also shot during the incident. Mamou drove another victim, a black female to an abandoned house and shot and killed her. Her body was discovered two days later. Note: The Texas DPS is missing all records related to Mamou's criminal history. On 06/20/98 in Houston, Texas, Alvarez and three codefendants participated in two drive-by shootings. On 06/06/98, Alvarez fired an SKS assault rifle at a group of people at an apartment complex. Alvarez suspected that some of the group were members of a rival gang. Two of the co-defendants fired handguns. Although ballistics test determined that Alvarez did not fire the fatal bullets, testimony revealed he helped plan the drive-by shooting and supplied one of the cars used. Two people (who were brothers) were killed and 6 were injured by gunfire. Juan Carlos Alvarez 11/17/1999 On 06/17/98 Alvarez shot and killed 2 young males with shotguns in an apartment complex in Southwest Houston. The victims were shot at close range in the back and face. In this shooting, Alvarez supplied the shotgun and the same SKS assault rifle. Alvarez was identified at trial as the shooter. Officers found the shotgun and the SKS assault rifle in his closet. Testimony showed that none of the 4 victims in these incidents were members of the rival gang. Evidence presented at the punishment faze of the trial showed that Alvarez shot and killed a Hispanic in an apparent random attack on 05/30/98 as the victim was driving home on IH-45 in Houston, Texas. Anthony Cardell Haynes Louis Perez On 05/22/1998, in Houston, Texas, Haynes and one codefendant shot and killed a Houston police officer. 11/03/1999 10/20/1999 Note: The Texas DPS is missing all records related to Haynes's criminal history. On 09/10/98, in Austin, Texas, Perez entered the residence of a 38-year-old white female and a her daughter, a 10-year- old black female. Also occupying the home was a 30-year-old white female. Perez struck the two adult victims on the head with a cast iron skillet, resulting in their deaths. Perez then strangled the 10year-old with a pair of panty hose, also resulting in her death. Note: The Texas DPS is missing all records related to Perez's criminal history. 18 Lawrence Russell Brewer 09/23/1999 Brewer was convicted in the murder of a black male occurring on 06/07/98. The offense involved Brewer and two co-defendants torturing and killing a 49-year old handicapped black male during the nighttime hours, in rural Jasper County, Texas. The victim was observed in the back of a pickup truck occupied by Brewer and his co-defendants. This was the last occasion the victim was seen alive by persons other than Brewer and his co-defendants. Brewer and his co-defendants drove to an isolated spot on a logging road where they beat and tormented the victim, then tied him to a logging chain, which was hooked to the pickup truck. Brewer and his co-defendants then dragged the victim to his death, leaving his decapitated and dismembered body to be found the following day by citizens and law enforcement officials. It was argued in court that Brewer and his codefendants engaged in this criminal act, in part, due to their racially separatist affiliation with the Confederate Knights of America and the Ku Klux Klan. Douglas Alan Feldman 09/22/1999 On 08/24/98, during the nighttime, in Plano, Texas, Feldman fatally shot a male driver as he was driving an 18-wheel truck. Witnesses observed Feldman ride up beside the truck on a motorcycle and fire multiple shots into the cab of the truck, dropping back and again returning and firing additional shots into the cab of the truck. Reports indicate that a total of 12 shots were fired into the truck resulting in the death of driver. Approximately 30 minutes later, in Dallas, Texas, Feldman rode up beside a parked 18-wheel truck and fatally shot a male victim. Four shots were fired on this occasion, resulting in the death of the victim. On 08/23/98, approximately 9 shots were fired into the Central Volkswagen Dealership in Richardson, Texas, breaking windows and other items. On 09/05/98, a victim received 2 gunshot wounds in the parking lot of a restaurant in Dallas, Texas. Ballistics reports verified that all of the attacks were performed by the same 9millimeter weapon that Feldman possessed. Ricardo Ortiz 06/24/1999 On 08/17/1997, while confined in El Paso, Texas, the subject and two other inmates were cooking heroin. The subject made a triple dose of heroin and injected it into the victim, a 22-year-old Hispanic male. The victim died of an overdose of heroin. The victim was found when officers did a count in the cellblock. Note: The Texas DPS lists prior records for this inmate, but the death row conviction is missing. 19 Richard Vasquez 06/24/1999 On 03/05/98, during the daytime, in Corpus Christi, Nueces County, Texas, Vasquez struck a 4-year-old Hispanic female multiple times in the frontal part of her head with a closed fist. Vasquez then sent the victim outside to play, Vasquez took a nap. Later, Vasquez called the victim in from outside to brush her teeth. The victim got a small stool so she could reach the sink area. She got on top of the stool and fell backwards onto her back. Vasquez went into the bathroom and saw the victim laying on her back. David Lynn Carpenter 04/08/1999 On 08/28/1991, during the daytime hours, the subject murdered a 52-year-old white female while burglarizing the victim's residence in Dallas, Texas. Charles Don Flores 04/02/1999 On 01/29/98, during the daytime hours, in Farmers Branch, Texas, the subject and the co-defendant, Richard Lynn Childs, murdered a 64-year-old white female, during the course of a burglary. Flores and the co-defendant broke into the victim's house and shot the victim with a pistol. Flores and the co-defendant were looking for money but did not find any. Pablo Lucio Vasquez 03/30/1999 On 04/18/98, during the nighttime, in Donna, Texas, the subject and co-defendant, Andy Chapa, murdered a 12year-old Hispanic male. Vasquez struck the victim in the head with a piece of pipe and a shovel. The victim's body was buried behind a residence located on Stites Road and FM 493. John William King 02/25/1999 On 06/07/98, during the nighttime hours, the subject and co-defendants, Lawrence Brewer and Shawn Allen Berry, murdered James Byrd Jr., a 49-year-old black male, by dragging the victim behind their 1982 gray Ford pickup truck, located on Huff Creek Road, in Jasper, Texas. The subject and the co-defendants picked the victim up while he was hitchhiking in Jasper. Note: The Texas DPS lists prior records for this inmate, but the death row conviction is missing. 20 Felix Rocha 12/16/1998 On 11/26/1994, Rocha and one co-defendant murdered a security guard at an apartment complex in Houston. Rocha had been involved in a physical confrontation with the security guard a week before the murder. On the night of the murder, Rocha and his co-defendant approached the security guard and attempted to take his gun. The security guard was shot twice in the face, resulting in his death. Ignacio Gomez 12/10/1998 On 11/23/96, during the nighttime, in El Paso, Gomez fatally shot an 18-year-old white male and two 16-yearold white males with a .357-caliber pistol. Gomez observed the three males walking down the road near his mother's residence. Gomez thought they were the ones who had broken into his mother's residence. Gomez and three co-defendants got into a fight with the three males. Gomez shot the three white males repeatedly in the head and then buried them in the sand dunes in the desert. Kimberly Lagayle McCarthy 12/07/1998 On 07/21/97, McCarthy entered the residence of a 70year-old white female in Lancaster with the intent to rob the victim. A struggle took place and victim was stabbed numerous times resulting in her death. McCarthy then used the victim's credit cards and used the victim's vehicle for transportation. Note: The Texas DPS lists prior records for this inmate, but the death row conviction is missing. Luis Cervantes Salazar 10/11/1997 On 10/11/1997, Salazar murdered a 28-year-old Hispanic female. Salazar crawled through a front window of a private residence. He tried to sexually assault the victim when she woke up. Salazar then stabbed her multiple times in the chest when her 10year-old son heard her screaming. The victim’s son rushed to his mother’s aid and was stabbed one time in the chest. Her son was able to get up and run to a neighbor’s house and call the police. When they returned to the home, they found the victim unresponsive on the bedroom floor with multiple stab wounds to her chest area. A kitchen knife was lying on the floor by her head. The victim’s 2-year-old daughter and 4-month-old baby were also in the bed with her. Note: The Texas DPS lists prior records for this inmate, but the death row conviction is missing. 21 Anthony Bartee 09/03/1998 On 08/15/1996, in San Antonio, Bartee murdered 37year-old white male by using a 9-millimeter pistol to fatally shoot Cook in the head and neck. Elroy Chester 09/26/1998 On 02/06/1998, in Port Arthur, Chester broke into the residence of Kim Ryman Deleon. Chester raped her 14year-old and 16-year-old daughters. Willie Ryman III (uncle to the girls) entered the home and was shot and killed by Chester. Chester took jewelry from the home and fled the scene. While in police custody, Chester confessed to this crime, two other murders, and three attempts to commit capital murder. Chester stated that he committed these offenses because he was out his mind "with hate for white people" due to a disagreement with a white staff member over a disciplinary report during a previous TDCJ incarceration. Julius Jerome Murphy John Adams 08/18/1998 On 09/19/1997, the subject shot a 26-year-old male one time in the head with a .25 caliber semi-automatic weapon during a robbery. Note: The Texas DPS lists prior records for this inmate, but the death row conviction is missing. 08/12/1998 On 03/23/1997, in De Soto, Adams and his codefendant murdered a 52-year-old white female. Adams and Wright were at the victim's home when they held her down and fatally stabbed her in the neck and chest with a kitchen knife taken from her own kitchen. They took her TV, VCR, weed eater, and her car. The car was later found abandoned in Lancaster. Note: The Texas DPS is missing all records related to Adams' criminal history. 22 Ruben Ramirez Cardenas 07/29/1998 On 02/22/97, in Edinburg, Cardenas and a co-defendant committed the offense of capital murder against a 16year-old Hispanic female. Cardenas entered the victim's residence through a window, tied her up with duct tape, then put her in a vehicle with the co-defendant and drove to a remote location. Cardenas raped the victim, beat her severely with his fists, and strangled her, causing her death. Cardenas dumped her body into a nearby canal. Michael Rosales 07/16/1998 On 06/04/1997, Rosales was in the process of committing burglary of a habitation when he entered the home of a 60-year-old female. Rosales claims he did not know she was home, and he was subsequently discovered while committing burglary. Rosales grabbed a kitchen knife from the victim's kitchen, stabbed her 137 times, and struck her with a hard object resulting in her death. Rodney Reed 05/29/1998 On 04/23/1996, during the nighttime, Reed strangled and killed a 20-year-old white female during an aggravated sexual assault. Larry Wooten 05/21/1998 On 09/03/1996, Wooten murdered an 80-year-old black male and his 86-year-old wife. Wooten stabbed the victims and cut their throats. Also, the female victim was beaten with a pistol with such force that the grips and portions of the trigger mechanism of the pistol broke off. Wooten then robbed the couple of $500.00 to $600.00 in cash. Note: The Texas DPS lists prior records for this inmate, but the death row conviction is missing. Allen Bridgers 05/14/1998 On 05/25/1997, Bridgers murdered a 53-year-old black female. Bridgers had been living with the victim and took a .38-caliber revolver and fatally shot her in the throat. Bridgers then stole her 1985 Lincoln Town car, which he later left at a bus terminal in Dallas, Texas. Then Bridgers took a bus to Florida. He was arrested in Ft. Lauderdale, Florida on 05/28/1997. Note: The Texas DPS is missing all records related to Bridgers' criminal history. 23 Larry Edgar Estrada 04/01/1998 On 02/21/1997, in Houston, Estrada and one codefendant robbed a convenience store. During the robbery, one Arab male clerk was shot and killed. The other clerk was shot and assumed dead. Estrada and his co-defendant took the clerks' wallets and more that $23,000 in cash from the store's safe. The surviving clerk survived and was able to identify Estrada and his co-defendant. Gregory Edward Wright 02/05/1998 On 03/21/1997, in DeSoto, Wright broke into the home of a white female. Wright stabbed the victim with a knife, causing her death. Ramiro Rubi Ibarra 12/10/1997 On 03/06/1987, Ibarra sexually assaulted and murdered a 16-year-old Hispanic female. The victim was looking after her two young nephews inside her home when she was attacked by Ibarra, a family acquaintance. She was beaten, raped and then strangled with an electrical cord. When questioned, Ibarra was found with scratches on his face and torso. Skin from under the victim’s fingernails was later identified as Ibarra’s. Ibarra was released from custody after a judge suppressed certain evidence in the case. Legislative changes in laws ruling the presentation of evidence allowed prosecutors to pursue the case nearly 10 years later. Ibarra was living in Bell County when arrested on October 10, 1996. Rogelio Cannady 12/05/1997 On 10/10/1993 Cannady caused the death of a 55-yearold Hispanic male Texas prison inmate inside a medium custody housing area at the McConnell Unit in Beeville. The victim, who was Cannady’s cellmate, was beaten with a steel lock attached to a belt and kicked repeatedly in the head with steel-toed boots by Cannady. The victim, who was serving a 15-year sentence for murder from Tarrant County, died two days later. Cannady was the first Texas prison inmate to be prosecuted under a 1993 statute that allows for capital murder convictions if the offender is serving 99 years or life as a result of previous murder convictions. Note: The Texas DPS lists prior records for this inmate, but the death row conviction is missing. 24 Carlos Trevino 08/06/1997 Trevino was convicted in the June 1996 rape and murder of 15-year-old Linda Salinas at a San Antonio park. Trevino, a member of the Pisteleros street gang, and three accomplices sexually assaulted Salinas at Espada Park, 8700 Padre Drive. She was left for dead there after her throat had been slashed with a knife. Note: The Texas DPS lists prior records for this inmate, but the death row conviction is missing. Jose Noey Martinez 01/29/1997 Martinez was convicted in the February 1995 stabbing deaths of a 68-year-old Mission woman and her 4-yearold granddaughter during a burglary of their residence. Martinez told police he broke into the victim's residence with the intention of stealing a stereo and television. He said he stabbed the elder woman when she confronted him with a baseball bat and then sexually assaulted her when she fell to the floor. Martinez said he stabbed the woman's granddaughter to death when she started crying and then ejaculated on her body. Martinez reportedly showed no remorse for the killings. While being escorted from the courtroom following his conviction. Martinez reportedly looked at the family of the victims and said, "It's not over yet." Frank Moore 11/20/1996 Moore was convicted in the January 1994 shooting deaths of Samuel Boyd, 23, and Patrick Clark, 15, outside a San Antonio nightclub. The two victims were shot with a .30-caliber rifle as they sat in a car outside the Wheels of Joy Club at 2803 E. Houston. Boyd was shot in the chest and Clark in the head following an argument with Moore inside the club. Both died at the scene. Prior to his arrest, Moore reportedly threatened to kill family members of witnesses if they cooperated with the police investigation. Jorge Villanueva 11/01/1996 Villanueva was convicted in the August 1994 rape and murder of 77-year-old Jova Montiel, who lived across the street from Villanueva. villanueva raped the victim and then brutally beat her over the head with a bottle and strangled her to death with his hands after breaking into her home. Montiel's nude body was later found in her blood-soaked bed. Villanueva became a suspect when he was found with fresh scratch marks on his face and neck. He was arrested October 24, 1994 when DNA evidence linked him to the murder scene. Note: The Texas DPS is missing all records related to Villanueva's criminal history. 25 Victor Saldano 09/12/1996 Saldano was convicted in the November 1995 abduction and murder of Paul Ray King. King was reportedly abducted from outside the Sack-N-Save market in Plano and driven to the Tickey Creek area of Lake Levon where he was shot to death. He was also robbed of his cash. Ricky Eugene Kerr 12/19/1995 Kerr was convicted in the murders of Garry Lawrence Barbier, 42, and Elizabeth McDaniel, 57, in San Antonio. The victims were Kerr's landlords, and has been in a dispute with him over the terms of his lease. On the day of the murders, Kerr was reportedly angry with them because the water to his residence had been turned off. He went to their residence at 307 Overlook and shot them both to death with a .25-caliber revolver. Barbier was also struck several times in the head with a hammer. David Martinez 12/08/1995 Martinez was convicted in the slayings of his girlfriend Carolina Prado, 37, and her 14-year-old son, Erik Pardo inside their San Antonio home. Both victims were beaten to death with a baseball bat. Following his arrest in San Marcos two days after the murders, Martinez said grabbed the bat and began to beat his girlfriend when she awoke to find him standing over her in the bedroom. Fearful that Erik might discover his murdered mother, Martinez walked into the living room where he was sleeping and struck him repeatedly in the head with the bat. Scott Louis Panetti 09/25/1995 Panetti was convicted in the September 1992 shooting deaths of his in-laws, Joe Caitan Alvarado, Jr., 55, and Amanda Carrion Alvarado, 56, inside their Fredricksburg home. Panetti, armed with a .30-06 rifle, forced his way inside the home and assaulted his wife who was staying there with her 3-year-old daughter. Confronted by his inlaws, Paretti shot the both of them and then kidnapped his wife and daughter, taking them to cabin where he held them for some time at gunpoint before releasing them. Arrested the same day, Panetti told police that it was his alter ego "Sarge" who did the killing. Note: The Texas DPS lists prior records for this inmate, but the death row conviction is missing. 26 Humberto Leal, Jr. 09/01/1995 Leal was convicted in the abduction, rape and bludgeoning death of 16-year-old Adria Saveda of San Antonio. Saveda was raped with a piece of lumber and her head crushed by a 35-pound piece of asphalt after being abducted from a party by Leal. Her nude body was found near a creek off Reforma Drive with the piece of lumber still protruding from her vagina. When arrested, police found scratches and cuts on Leal's face and body. Note: The Texas DPS is missing all records related to Leal's criminal history. Carl Henry Blue 06/14/1995 Blue was convicted in the murder of Carmen RichardsSanders. Blue, who once dated his victim, went to her apartment on George Bush Drive in College Station with a cup of gasoline. When Richards-Sanders opened the door, Blue doused her in gasoline and ignited her clothing with a lighter. Blue then threw the remaining gasoline on a second person in the apartment. Larence Williams, when he attempted to come to the aid of Richards-Sanders and ignited his clothing. RichardsSanders died of her burns at Herman Hospital in Houston on September 7, 1994. Williams survived his injuries. Blue turned himself into police, saying the incident was a prank and the victim's death accidental. Arnold Prieto 05/02/1995 Prieto was convicted in the robbery and murder of three people, including Prieto's great uncle and aunt, in Carrollton. Killed were Rodolfo and Virginia Rodriguez and Paula Moran. Each of the elderly victims were stabbed to death after offering Prieto and two codefendants breakfast at their home. The three assailants fled with money and jewelry stolen from the home. Note: The Texas DPS is missing all records related to Prieto's criminal history. Cathy Lynn Henderson 06/01/1995 Henderson was convicted in the abduction and murder of 3-month-old Brandon Baugh. Henderson had been babysitting the young boy and his 2 1/2-year-old-sister Megan for three months prior to murder without incident. Henderson later told police that Brandon died after she dropped him accidently on his head. She said she panicked, buried the body, and fled to her native Missouri, where she was later arrested. Using a map drawn by Henderson, authorities found Brandon's body inside a cardboard box buried in a shallow grave outside of Temple on 02/08/1994. An autopsy determined that Brandon died of a fractured skull. Hall in Dallas. Hall was shot twice in the back of the head and his body dumped in the 1400 block of E. Wheatland. His car was stolen and later found stripped of its stereo and wheels. Note: The Texas DPS is missing all records related to Jones' criminal history. Roland Ruiz, Jr. 05/04/1995 Ruiz was convicted as the triggerman in the murder-forhire of 29-year-old Theresa Rodriguez. Rodriguez was shot once in the head with a .357 magnum revolver in the garage of her home at 1118 Grey oak as she stepped from her car. Police discovered that the victim's husband, Michael Rodriguez, and brother-in-law, Mark Rodriguez, paid Ruiz $2,000 to kill her, apparently so Michael Rodriguez could collect on life insurance policies totaling $250,000. Before the killing, Michael Rodriguez had also applied for additional life insurance policies of $150,000 each on himself and his wife. Joseph Roland Lave 10/07/1994 Lave was convicted in the killing of two sporting goods store employees during a robbery. Killed during the robbery of the Herman's Sporting Goods store at 1718 E. Beltline in Richardson were Frederick Banzhaf, 18, and Justin Scott Marquart, also 18. A third employee, 22-year-old Angela King, survived to later identify a fourth store employee, James Langston, as an accomplice to the robbery and murders. The three victims were beaten with a hammer and had their throats cut. Langston was shot to death by police after attempting to run down an officer with his vehicle. A third accomplice later confessed his role in the robbery, compelling Lave to surrender. Taken from the store was $2,950 in cash, 21 rifles and shotguns, tennis shoes and various articles of clothing. Kenneth Wayne Morris 09/02/1994 Morris was convicted in the robbery and murder of James Moody Adams of Houston. Morris and two accomplices kicked in the door to Adams' home while he and his wife were sleeping in an upstairs bedroom. Adams awoke and confronted the intruders who demanded firearms. Adams told them he had no firearms in the house but would hand over all his money, approximately $1,800. When Adams gave Morris his money, Morris shot him four times for no apparent reason. Adams' wife hid in a closet during the robbery and shooting and was unharmed. Note: The Texas DPS is missing all records related to Morris' criminal history. 28 Elkie Lee Taylor 07/26/1994 Taylor was convicted in the robbery and murder of 64year-old Otis Flake in Fort Worth. Taylor and an accomplice forceably entered Flake's home at 926 East Terrell and tied him up. The two then packed up several items from the home, including dishes, pots and pans, and a television, and later sold them for a total of $16. A friend of Flake's found him dead inside his bedroom later in the day. He had been strangled with to wire coat hangers. Gerald Cornelius Eldridge 06/24/1994 Eldridge was convicted in the shooting deaths of Cynthia Bogany, his former girlfriend, and her 9-year-old daughter, Chirrisa Bogany. Eldridge broke into Bogany's apartment and shot Chirrisa as she slept on a couch. After chasing Cynthia's boyfriend from the apartment, Eldridge returned to the living room and shot his natural 7-year-old son Terrell in the shoulder. He then chased down Cynthia on a stairwell outside the apartment and shot her to death as she begged for her life. Jose Alfredo Rivera 06/02/1994 Rivera was convicted in the sexual assault and strangulation of 3-year-old Luis Daniel Blanco in Brownsville. The young victim was led to Lincoln Park by a neighbor, where he was sexually assaulted by Rivera and strangled with the elastic from his own underwear. Marvin Lee Wilson 05/09/1994 Wilson was convicted in the shooting death of 21-yearold Jerry Robert Williams. Wilson abducted and shot Williams following a physical confrontation between the two in the 1500 block of Verone in Beaumont. Rick Allan Rhodes 12/31/1992 On 09/13/1991, one day after being paroled, Rhodes entered the home of two white male brothers while they slept. Rhodes attacked them with a steel bar and a butcher knife, resulting in their deaths. Rhodes also took money from the billfold of one of the victims.
