Thank you for your efforts in facilitating this discussion We certainly appreciate your help in this
matter However as a collective we cannot agree with the conditions you have provided below for
the following reasons
1 All major andor minor events hosted in the Vietnamese community always have following
tradition protocol The chairman or head organizer will do open remarks include welcoming the guest
and dignitaries This is following the official open ceremony with the Vietnamese and US National
Anthems
As for your information when our delegation met with Sup Nguyen
s representatives on April 2 the
supervisor office has suggested a similar proposal to have Supervisor Nguyen speaks first and then
s
introduce our chairman of the organizing committee The proposal was subsequently rejected due to
the breaking of the protocol as we have stated While this protocol might seem to be least important
to some people it is very important to our community and we don
twant the City or our groups to be
heavily criticized by the community at large
2 Furthermore having the Supervisor speaks before other federal and state elected officials is also
inappropriate because it does not follow the normal protocol for dignitary introduction we are sure
you are very familiar with that
The most important point that we would like to focus here is that we view the annual Black April
Commemoration as a very solemn occasion and cannot be hijacked for political creditpoints by any
elected official regardless of whether they are Vietnamese descendant or not This is out of respect
for more than 58
000 American soldiers and 3 millions Vietnamese who sacrificed their lives for the
ideal of Freedom and Liberty We hope you understand our objectives We are not here to pick a
fight but our intention is to stand for what is right for our community
We would also like to note that our organizing committee has offered Supervisor Nguyen
s office a
few recommendations including we can have Chairmen from both sides Mr Nguu Phan is
representing our committee and Mr Thuan Pham is representing Supervisor Nguyen
s committee to
speak at the open remarks following the introduction of guest and dignitaries
Please also note that according to the information released from the Supervisor
s office Supervisor
Janet Nguyen is not the Chairwoman of the committee on her side it
s Mr Thuan Pham Therefore
you can see having Supervisor Nguyen speaks before either chairman violates protocol not just once
but And it is very cleared by doing so turn the event into a major point of political gain
and this is far from the meaning of the event

My name is Hung Nguyen a Vietnamese American Activist Freelance Journalist Reporter also
member of Tet Parade Foundation My business is located in Westminster city
I am here tonight to request the Westminster City Councils to revoke the Intent to meet
permit which was granted to Supervisor Janet Nguyen I know that in trying to resolve the
matter City Manager Don Lamm has worked very hard I am also aware that the City of
Westminster is facing a tough decision on this controversy But I am also here to clearly clarify
that Black April Commemoration is the event of Vietnamese Community and it should be left to
the community to resolve internally
Nobody even elected official can step in and take over this event from Vietnamese

are they Since Tony Lam the first Vietnamese American became elected official as councilman
until today there are many other Vietnamese American elected officials like Van Tran Joseph
Cao Hubert Vo Janet Nguyen Hoang Duy Hung Dina Nguyen Andrew Do Andy Quach Tri Ta
Tyler Diep and so on But there is no one has stepped up I repeat no one ever step in to claim
this event from Vietnamese Community except Supervisor Janet Nguyen who used her elected
official position for her political gain purpose
Supervisor Janet Nguyen got our tax money when she ordered her employee Matthew Harper to
use his working time as Orange County salaried employee to file the application for this event on
April 30 I believe this event is not on the Orange County Supervisor Board

This is not threat but as Vietnamese American voters we will use our voting power in
the next election We may lose this event today but we will tell the world by our

County Commissioner seat in Tarrant county Texas from an incumbent lady and today
Council candidate District 7 of San Jose Mr Phu Huu Le is leading far away and may
out incumbent Madison Nguyen too

I support Mr Nguyen Phuong Hung to request the Westminster City Councils to revoke the Intenttomeet permit

The VN WAR Memorial Park near City of Westminster is not the regular public site that
anyone can use for they own personal political gain More than ten year ago We
attended the public concert to raise money to build this park the event took whole day
on the vacant lot in the place of our Freedom park now resides Thousand of Vietnamese
from every where in the country emptied their pocket money to raise few hundred
thousand dollars final cost is 1
2 Million to build the park and hoping some day we
can visit the park on Black April to remember our suffering sorrow and thank you to
America saving our lives So this PARK IS NOW PARTIALLY BELONG TO OUR
VIETNAMESE COMMUNITY to use on the most important day of this park

Black April Program
Hello all
From what I know the office of Supervisor Janet Nguyen has already been granted the permit to conduct the
Black April Commemoration ceremony I believe that it is fair to give the permit to the person who shows up
first to ask for it In this case Janet should be the one in charge and that it is unnecessarily to hold another
hearing to discuss this matter If you haven
t already known there are about 40 different organizations that are
supporting the office of Janet Nguyen in this event A tremendous amount of hard work and time has been put
forward to make this Black April event a memorable one It will sadden me as a member of the community to
see the hard work of these organizations be wasted Please rethink this issues again and just let the office of
Janet Nguyen keep the permit to organize the event I hope you understand that this Black April event means so
much to us

Orange County Southern California to join together in commemorating the Mourning Day
4 solemnly and significantly This is an opportunity to unify equally all Political Parties

Religious Military Youth and Friendly Associations in equality in the Community of all
Vietnamese Refugees overseas regardless of its large or small number of members This is not
only to represent the spirit of solidarity mutual affection and mutual interest in order to express
deeply the meaning of the Mourning Day 30
4 but to praise also the Vietnamese overseas
spirit to fight against the Vietcongs for freedom of religion and the human rights in Vietnam

Forces Advisor to the Asian American Senior Citizens Association AASCA Chairman of the
Organizing Committee of King HUNG Commemorative Day would like to express my opinion on
the issue of Vietnamese Black April Commemorative Day April 30th Event The AASCA is
located within the City of Westminster
The reason for the Vietnamese Americans to do the said event yearly is well known by all of you as
well as of all of us Every Vietnamese American has reasons to submit an application to the city of
Westminster requesting a gathering somewhere within the city for the event It happens that the
office of the Chair of OC Board of Supervisor Sup Janet Nguyen did submit the application
for the said event at the right and significant location which is the War Memorial in Freedom Park
on All American Way It is a joyful news to all Vietnamese who want to have a right place to do a
ceremony commemorating the sad day of April 30th The reason for the joy of having an approved
place for the event is very simple Every body has equal right to do that Now Supervisor Janet
Nguyen has done that for them meaning a phase of the plan for the Commemorative Day has been
completed It is time for them to do what needs to done next That is why they the Vietnamese
Americans should feel pleased and thankful for what Supervisor Janet Nguyen has done for them
Talking about community I think we need to look into the scope of the issue The so called
Community A or Community B is just the name of a corporation which is merely an
organization a single one within the community It is NOT an entire community It definitely has
NO authority to represent the whole community In addition there are nearly 40 organizations and
associations gathering behind the approved permit to do the event at the War Memorial which was
initiated by the office of Supervisor Nguyen They are part of the community They see the fact
that someone has done something ahead of time for them applying for the permit is a time saving
factor for them as a group of major social political organizations and parties within the community

As all of you have clearly known that the Vietnamese community is not a united entity But we do
not use this issue directly or indirectly as a bargaining tool to pressure any of you The election
which is coming this year or in the future has nothing to do with the issue we are talking about
today
With all of the above my organization the AASCA and I are confirming our support for the group
who are working to develop the plan for the Commemorative Day of April 30th as applied by the
Office of Supervisor Nguyen and as approved by the city ofWestminster There is nothing that
needs to be changed

I just got back from Korea and am finally available to deal with the issues revolving around this year

Black April Commemoration I have seen the email sent by anh Nguu to Chief Mitch Waller wherein anh
Nguu claimed that an agreement was reached with our group to recognize your group to be the official
organizing committee I have also heard about Nguyen Xuan Nghia
sstatements about Supervisor Janet

the Community and the need for her to apologize These statements were made by Nghia
even though the compromises that we reached as a group on April 2 were proposed by Nghia himself
Remember that it was your group that rejected the arrangement that we all you I Nghia and others spent over
5 hours to hash out Needless to say I am troubled by these misstatements
Be that as it may Supervisor Nguyen has always put the interest of the community first Therefore given the
little time left for planning and wishing to help our Community put on the best Black April Commemoration
possible Supervisor Nguyen is willing to make the ultimate sacrifice and offers the followings As my email
will be dissected and possibly be quoted out of context I am reiterating that these sacrifices that are proposed
by Supervisor Nguyen do not constitute in any way as conceeding to any legitimacy or accuracy regarding any
claims made by your group
1 Supervisor Nguyen has agreed that she will not deliver the welcoming remarks She will speak when elected
officials are asked to speak per normal protocol
2 The 2010 Black April Commemoration will be a joint event between the 40 plus community associations
and organizations led by Col Pham Van Thuan and the community groups led by Mr Phan TanNguu
3 Mr Pham and Mr Phan will be coChairs and will come on stage to welcome guests at the same time
however Mr Pham by virtue of his rank which is higher than Mr Phan
s will be the first to deliver the
welcoming remarks
4 There will be no joint Organizing Committee Both sides will invite guests and community members under
their own names The 10 people 5 from each side that were involved in the April 2 negotiation will work out
the logistics of the event as well as prepare a list of honored guests to be recognized
5 Both sides will have the same amount of speakers and shall share equally in all stages of the proceedings
and
6 Since Black April is a time to commemorate not a time to celebrate there shall be no introducing of
members of any officers boards members community organizations interfaith associations etc

from your group as to the offer being made above by Supervisor Janet Nguyen I would like to emphasize that
this is not an invitation to further negotiate The response as to whether to accept or reject this offer shall be
