Sean Whalen, Nelle Barr and Elizabeth Barr; Dr. Lonnie Fallin; Dr. Jack Wasinger; and Ms. Shauna Vollmer King Each May, MDDS formally recognizes individuals whose leadership has been transformative — whose efforts have mobilized and unified the oral health cause and elevated the image of the profession. Recipients were selected from the hundreds of local dentists who give back to the community. The 2008 awards were presented to the following members of the dental community at the MDDS 111th Annual Meeting and Society Dinner at the Mt. Vernon Country Club in Golden on May 8, 2008. Community Service Recognition Awards Golfing and Giving — Support the Metro Denver ™ Dental Foundation’s Smile Again Program™ Children’s Dentistry, the pediatric dental practice of Elizabeth (Betty) Barr, DMD, MS, Nelle Barr, DMD, MS and Sean Whalen, DDS, MS, received the 2008 Outstanding Service to Children Award. Children’s Dentistry was honored for providing great care in a fun, kid-oriented environment to vast groups of underserved children. They are recognized by the ADA as the national example for implementation of Give Kids a Smile Day events in private offices. Established 30 years ago in Westminster, Children’s Dentistry is also involved with The Sean McCauley Hope Foundation — dedicated to helping families who have a child with cancer. Lonnie D. Fallin, MS, DDS, a retired general practitioner who practiced in Littleton, received the 2008 Outstanding Service to the Underserved Award. Dr. Fallin was recognized for his dedication in providing free/low-cost services to patients through The Tri-County Health Department Senior Dental Clinic (serving 55 years and older, low-income and uninsured Arapahoe County residents). Described by his colleagues as “superhuman” in his commitment, volunteering consistently every Thursday for the last 7½ years, Dr. Fallin’s patients appreciate his kind and humorous manner. Jack L. Wasinger, DDS, a Lakewood-based general practitioner, received the 2008 Outstanding Contributions to the Dental Profession Award. This issue’s discussion focuses on universal challenges observed by our panel of experts. Stay tuned for our October/November 2008 issue as the discussion turns to the most important quality a dentist can possess to create and sustain a successful practice. What is the biggest challenge facing dental practices today in the Denver metro area? Lynda Kizer: There are two major challenges that practices are facing today. The first is the economic downturn. Practices that have high overheads can be stressed by a slowdown in productivity with the expenses remaining high. Managing cash flow and investing in the practice should always be monitored, but it is imperative when you have the outside influence of a tight economy. Patient retention is always key to growing and maintaining a successful practice and becomes even more important as people reassess their financial priorities. New patient growth may slow down, especially in practices that have not been proactive in both internal and external marketing. The practices that have a healthy overhead percentage, good systems in place and a consistent marketing plan will be better positioned to weather this situation. The second challenge is the difficulty hiring qualified people. The education issues that are in the news on a daily basis affect the pool of available candidates from which to choose. As a profession, we need to be more proactive in creating attention to the excellent career opportunities available in dentistry. The difficulty in finding quality people makes it even more important to take care of our current team members. Even as we manage our overhead to keep the employee expenses in line, we need to remember that the people who work with us are our most important investment. Reward your team with opportunities for training and growth. Hire for attitude and train for skills. And remember that the team must understand your vision and believe in it! Our intention is to establish an ongoing dialogue with members about professional conduct and offer perspective in regard to ethical dilemmas. In the early nineteenth century, ethics dealt with a person’s character. It was the perception of the day that a person’s honor and virtue led them to act ethically. As true professionals there was no need for written instructions on how a person should act or conduct their affairs. However, in the early to mid-nineteenth century, English doctor Thomas Percival proposed a list of ethical rules. This code gave physicians and surgeons a means of assessing the conduct of their fellow practitioners as well as their superiors, employers and other medical professionals (source: Canadian Appraiser). As a condition of membership in organized dentistry, we have agreed to abide by the ADA Principles of Ethics and Code of Professional Conduct, also known as The Code. Here is what we have agreed to… The Code’s Five Principles of Conduct: n Patient Autonomy (“self-governance”) The dentist has a duty to respect the patient’s rights to self-determination and confidentiality. n Nonmaleficence (“do no harm”) The dentist has a duty to refrain from harming the patient. n Beneficence (“do good”) The dentist has a duty to promote the patient’s welfare. n Justice (“fairness”) The dentist has a duty to treat people fairly. n Veracity (“truthfulness”) The dentist has a duty to communicate truthfully. In order for The Code to maintain its merit and respect, it must have procedures for monitoring members’ actions and measures for disciplining those who fail to act in accordance with these standards. As CDA’s ethics chair, I am not interested in being the “ethics police” or your personal judge. The committee is charged with resolving complaints between dentists in accordance with the ADA Code of Ethics and Colorado law. Most disciplines handed down are usually a result of naiveté or ignorance. One of the most common mistakes in Colorado, although it is very well-defined by the law, is the misrepresentation of training in advertising — listing unearned, non-health degrees or the announcement of credentials in non-specialty interest areas, i.e., you can’t say you are a “cosmetic dentist” but you can say you offer cosmetic dentistry. Where to begin? “Repetitio est mater studiorum” — repetition is the mother of all learning. We are required to examine The Code on a regular basis, just like we continuously update our clinical knowledge and skills. Following is a brief review. Of course we are all ethical! Why do we need The Code? As professionals, we have a duty to maintain the highest standards of professionalism in our work, while at the same time acting in the public interest. We contribute to society and human wellbeing in a very specific and unique way and hold a position of high trust. As a result, society affords us certain privileges that are not available to the public-at-large, like the privilege and obligation of self-government. Stuck passed away at his home April 18, 2008. He was 81. Dr. Stuck’s mentorship, friendship, zest for life and sense of humor will be greatly missed by those who knew him. Dr. Robbins, a past MDDS president, practiced dentistry in Denver for 50 years. What should you say to a drug-seeking patient? While this topic is worthy of its very own presentation, it was briefly discussed in a useful exchange during the audience participation portion of the program. According to the ADA’s survey of Current Issues in Dentistry (last conducted in 2007) more than half of dentists responding indicated that they do not ask their patients about alcohol or illegal substance use. Of those who do not ask, more than half feel either somewhat uncomfortable or not at all comfortable about asking the question. Of those that answered yes, 86% would recommend a referral to a substance abuse professional, but don’t know what resources are available to help the patient; or how to speak to a patient so that it is effective. It is important to recognize and effectively manage the drug-seeking patient. As so many dentists have experienced, these patients can be relentless, manipulative and inventive in their efforts to acquire a prescription and can become angry when their attempts are rebuffed. If handled correctly, dentists have a unique opportunity to make a life-altering difference. When you address a drug seeker, it is imperative that you do so in a caring, but direct manner — with no implication of shame. Be sure to ask questions. Make sure you have identified referral resources. Following is some phasing recommended by our presenters: n n Contact MDDS I have given you an appropriate amount of medication for the procedure. While I understand that you are in pain, I suspect you may have a tolerance issue. I would like to make a treatment recommendation that you consult a physician to monitor and manage the pain. I can’t help you directly, but I can point you toward help. Here is the name and number of an addiction counselor who can help you. Great Resource: Prescription Drug Monitoring Program Colorado State Board of Pharmacy’s Electronic Prescription Drug Monitoring Program (PDMP) is now live and available for queries from prescribers of controlled substances. This program provides a database of controlled substance prescriptions that have been dispensed by Colorado pharmacies and from non-resident pharmacies that ship prescriptions into Colorado. The purpose of the database is to provide objective information to assist practitioners and pharmacists in providing appropriate treatment for their patients. For instance, if a patient is taking OxyContin, the prescriber would be able to review when the patient was first prescribed the drug, how many providers prescribe for the patient, how often and from what pharmacies the patient is receiving controlled drugs. The prescriber would determine whether the patient is taking the medication appropriately or making other uses of it. Many older dentists are choosing to (or have to) practice longer and most female dentists work full-time versus the part-time prediction. Therefore, the biggest challenge the metro Denver area dental practices face today is attracting new patients and retaining quality patients. In our research, the average full-time dentist needs approximately 1200–1500 active patients to maintain a productive schedule and realize a healthy practice profit. However, some patients are leaving practices based on their insurance plan and new patients often choose their dentist based on an insurance list on a website versus a personal referral. Many dentists are proactive and staying competitive in this economy with a consolidated schedule, implementing an internal and external marketing plan, offering early morning and late hours, updating their facility and integrating a higher level of technology in their office. Until the “Golden Age” of dentistry arrives, the biggest challenge is keeping the schedule full with quality patients who accept quality care. Denver, according to what is shared with me among dentists and team members, is the challenge of hiring and retaining the dental team. Dentists are asking themselves how to go about finding the right people and how to keep them. Of course, there are many opinions regarding this subject. In order to address this challenge, we must start at the beginning and evaluate the protocols that are in place. First, is there a written job description for each member of the team? Second, be patient. Do not just hire someone because they are a warm body and you need someone fast. It is better to let the hiring process take longer so that your new team member is a fit for your office. Third, be sure your interview process includes gathering all the right information. For example, does the potential candidate express the same norms and values as you do? Are your philosophies similar? Do the candidate’s goals match your goals? What are their skill levels along with how and where they have received their experience? Believe it or not, money should not be the bottom line. During the interview process, allow the candidate to review the written job description and get feedback regarding what their duties will be. Howes, MBA, CFP® If you are an investor who really follows the markets, I don’t have to remind you that so far 2008 has not been boring. Since October 2007, the S&P 500 was down about 18% and then made a nifty “recovery” in March. However, this “recovery” just didn’t last very long. More recently, due to some investor fears, the S&P 500 went down again in May and now a bit more in June and, as of this writing, it might be a reasonable buy. From my perspective, these market swings, although annoying and painful, are indicative of the market returning to more normal volatility when compared to the dullsville market swings that we have experienced since 2001. Change is good in the stock market. Taking a hard look at the price of things helps keep the game honest and less likely to let prices or stock values simply keep climbing until something collapses. A good example of unfettered valuations are the balance sheets and reputations of many commercial banks and wire houses that used to be respected names. I encourage consumers and especially investors to be price sensitive. If the price of, for example, a gallon of gasoline, an ounce of gold or a share in Bank of America, seems like it costs too much, then perhaps it costs too much and seeking an alternative might be prudent. Right now the price of bonds is a bit high, which means their yield is low. I believe that the price of most bonds will likely come down soon. With the current fears of inflation wafting in the wind, the yield on bonds will likely come up. Stocks are a tiny bit high, but that is changing with these down days in the S&P 500 so stocks are becoming a better buy. There are times in the markets when investing is like throwing bananas at monkeys. It is easy and the results are predictable. This is not one of those times. For a variety of reasons, the price of everything is likely to keep changing and changing rapidly until late 2009, and so the markets for the remainder of 2008 will likely be unpredictable and down right unpleasant. C ompliance Alert New Red Flag Rules May Apply to Your Dental Practice In December 2007, the Federal Trade Commission (FTC) and five federal bank regulatory agencies (FDIC, OCC, Federal Reserve, OTS and NCUA) jointly issued the final rules and guidelines implementing sections 114 and 315 of the Fair and Accurate Credit Transactions Act (FACTA). Under these regulations, the “Red Flag Rule” was adopted which requires the development, implementation and maintenance of an Identity Theft Prevention Program by covered companies that hold any customer accounts. Effective January 1, 2008, FACTA mandates compliance by November 1, 2008. You’ve never heard of the Red Flag rules? Join the crowd. These rules are not well known. The information is relatively scarce because the rules stem from a 2003 law that took five years to implement. This new set of laws places absolute liability on business owners and executives with absolute liability both civilly and criminally. These new laws pierce the corporate veil and allow for individual as well as class action lawsuits with no statutory limitation at the same time specifically allowing for responsibility of damages. There is also criminal liability for what is referred to as willful non-compliance. The rules offer 26 examples of suspicious behavior that creditors can use as red flag guidelines. The presentation of altered documents, a suspicious address change, a fraud alert on a credit report and other unusual account activities are potential red flags. When identifying Red Flags, creditors must consider the nature of their business and the type of identity theft to which they may be subject. For instance, creditors in the healthcare field may be at risk of medical identity theft (i.e., identity theft for the purpose of obtaining medical services) and, therefore, must identify Red Flags that reflect this risk. MDDS Leadership Awards The Honus Maximus Award, the highest leadership honor MDDS bestows upon its members, was received by Major W. Tappan, DDS. Dr. Tappan, a Denver-based general practitioner, was recognized for his progressive vision, selfless dedication to children and numerous contributions to the profession over the span of his 60-year career. Most recently, as a leader in the quest to eliminate childhood cavities, he founded the Dr. Major Tappan Total Oral Prevention Strategies (TOPS) program which provides preventive care to preschool aged children. With the goal being to keep them cavity free and engaged in oral health, Dr. Tappan’s concept illustrates what early intervention, education and treatment can do to alleviate the extreme needs of underserved children.
