LEGAL AID SOCIETY OF GREATER CINCINNATI A N N U A L R E P O R T 2 011 SERVING COMMUNITY, FAMILIES AND INDIVIDUALS Legal Aid represents the residents of this now attractive and livable apartment complex in Avondale that was almost vacated due to the landlord’s neglect. Over forty families, and the surrounding neighborhood, benefited by this turnaround — a direct result of the action of the Legal Aid Society. LEGAL AID SOCIETY OF SOUTHWEST OHIO, LLC DEAR GOVERNING BODY OF LEGAL AID SOCIETY OF SOUTHWEST OHIO, LLC COMMUNITY, FAMILIES AND INDIVIDUALS Dear Friends: 2011 was another challenging year for the Legal Aid Society and its client communities. But with a commitment to strategic focus, we have continued to have an impact on individual clients, families, and the broader community. Our annual report illustrates the life-changing effect of legal services — for children struggling to succeed in school, for families on the verge of losing their homes, and for adults in need of a hand up to better employment opportunities. This report includes the stories of several clients who overcame these challenges with Legal Aid’s help. In addition, Legal Aid continues to provide a safety net — for veterans who need legal representation to establish eligibility for benefits, for women and children who need to escape from abuse, and for families with no food in the house and no decision on their applications for Food Stamps. Legal Aid cases also improve neighborhoods and the broader community. Forty families living in the apartment complex illustrated on the cover of this report faced homelessness. Tenants were living without heat, water, or electricity. Several months’ worth of garbage was piled up everywhere and the yard was overgrown and unkempt. Legal Aid stepped in to remedy the situation: we filed a lawsuit to get emergency court orders to restore the utilities. Due to the landlord’s extreme neglect, Legal Aid convinced the judge to appoint a receiver to collect rent, ensure garbage collection, and provide other basic services. Eventually, over the course of a year, Legal Aid’s representation of the residents resulted in renovation of the building, repairs in apartment units, new appliances, roof repairs, and landscaping to eliminate weeds. Now several multi-family residential buildings in Avondale have become attractive properties, and serve as a concrete example of how legal intervention can be an effective tool to achieve community revitalization. Phillips President A FIVE-YEAR OLD WITH SPECIAL NEEDS SUCCESSFULLY ADAPTS TO SCHOOL Troy* was diagnosed with autism at Cincinnati Children’s Hospital. As the pre-school year was ending, Troy’s doctor became concerned about the boy’s ability to successfully transition to kindergarten, so she referred Troy and his parents to Legal Aid’s Child HeLP program. In operation since 2008, Child HeLP is a medical-legal partnership that promotes children’s health and well-being through legal assistance. Troy’s Legal Aid attorney attended a late spring meeting with school officials to ensure he had an IEP (individualized education plan) in place before the fall term began. But, at the start of the school year, Troy’s parents were told there were no placements available that would meet the agreed IEP requirements. Legal Aid intervened again on Troy’s behalf and a placement was found. Because of Legal Aid’s intervention and the resulting positive kindergarten experience, Troy has modified his behavior in many ways. He now enjoys music instead of covering his ears and yelling when music is played, and he is getting a much better report card. Troy’s parents have been in touch with Legal Aid during the course of the school year to relay their pleasure with his progress and their belief that now Troy has a real chance to succeed in school. *Name changed to protect client privacy. PERSEVERANCE AND WORK ETHIC OF LEGAL AID CLIENT AN EXAMPLE FOR ALL Sandra Bowman** came to Legal Aid seeking representation to get an expungement, something she had tried to obtain on her own without success. Over the years she had worked hard, at difficult minimum wage jobs. She knew she had the drive and discipline to go back to school and train for better paying, more fulfilling work. But a criminal record from her youth stood in the way. Legal Aid discovered that Ms. Bowman was not eligible for an expungement, and agreed to try a more ambitious legal strategy to help Ms. Bowman get a fresh start in mid-life. Legal Aid decided to seek a pardon from the Governor, and represented Ms. Bowman at hearings before the Parole Board in Columbus. The Board recommended a pardon. Now, with pardon in hand, Legal Aid had her criminal record expunged. Ms. Bowman is on her way to earning an Associate Degree in criminal justice. She plans to put it to use in two ways: to secure higher paying employment, perhaps in court administration, and to become better qualified for her work at the City Gospel Mission where she helps women who, as she puts it, “are really down on their luck,” and need help turning their lives around. **Ms. Bowman, proud of her personal story, has requested her real name be used. LEGAL AID & PRICE HILL WILL PARTNERSHIP BENEFITS FAMILIES AND COMMUNITY Restoring a large number of blighted properties requires legal and community development expertise. The home pictured here is a single family, three-bedroom, 1.5 bath, 1904 square foot house with a completely renovated interior, a restored façade and definite curb appeal! For this reason, Legal Aid and Price Hill Will, a nonprofit whose mission is to create systemic change through economic development and physical revitalization, are now working together with the shared goal of reversing neighborhood decline and helping working families become Price Hill homeowners. In 2011, Price Hill Will rehabbed its fiftieth property! Before Price Hill Will stepped in, these foreclosed homes had deteriorated to the point where they were uninhabitable neighborhood eyesores. Now, through the joint efforts of Legal Aid and Price Hill Will, fifty foreclosed properties have become, safe, attractive and affordable. Each house represents a new beginning for a low or moderate income family. These photos document the squalid state of the interior before Legal Aid and Price Hill Will stepped in and how the house looked when it was placed back on the market in 2011. As Price Hill Will’s legal counsel, Legal Aid researches property ownerships, advocates with the City to step up housing code enforcement, files public nuisance lawsuits, negotiates for key properties through litigation against banks holding neglected properties, and secures tax abatements for new homeowners. CLIENTS AND ATTORNEYS BENEFIT FROM INVOLVEMENT WITH VOLUNTEERS LAWYERS PROJECT In 2011, over 500 attorneys participating in the Volunteer Lawyers Project (VLP) opened 1,462 new cases. Behind these impressive numbers are the individual stories of grateful clients and the enriching experiences afforded to the attorneys. One such story involves Catherine Cummings* and James R. Barton, the 2011 VLP Attorney of the Year. James R. Barton, Foreclosure Averted for Long-time Homeowner and VLP Attorney of the Year Working Mom Jim Barton retired in 1992 after a thirty-year career in the insurance/ mortgage and real estate industry. In 2008 he signed on as a VLP attorney and since then has handled seventeen foreclosure cases. Jim Barton explained to Ginny Whitman, Managing Attorney for the VLP, how he became a VLP attorney in an area of law new to him. Catherine Cummings purchased a home in Middletown in 2003. For nine years she made timely mortgage payments, but then a medical hardship and reduced work hours caused her to fall behind. Despite her own efforts to work out something with the lender, Bank of America filed for foreclosure. Jim Barton was able to negotiate a loan modification with payments Catherine could afford, so the foreclosure was dropped. Here is an excerpt of a letter from Catherine to Jim. So why jump into pro bono foreclosure practice? I attended a CLE course and remember listening to your colleague talk about her neighborhood being devastated by foreclosure and neglect after the bank acquired title. She spoke with such passion that it aroused my sense of right and wrong. I thought of all the deserving folks losing their most important asset… To have someone sincerely thank you for helping them save their home is so gratifying it makes one forget all the effort it took and look forward to working on the next case. I had a good Christmas because I have my house for me and my sons. You have fought this battle for me and you have no idea how appreciative I am for that. I am trying to budget all things so that my house payment comes first. It’s taking discipline but it’s going great. I just want you to know I hope blessings come your way because you really pulled me out of the bad situation. *Name changed to protect client privacy. This award, given to individuals who demonstrate a strong commitment to legal justice and who lead others by example, was presented to Mr. Greene at a reception in celebration of National Pro Bono week. Mr. Greene began working at Legal Aid in 2002 after a 33-year career at P&G. In the ten years he has been at Legal Aid he has become an invaluable member of the Family & Immigration Practice Group helping numerous women achieve safety and economic self-sufficiency. Noel Morgan, Senior Attorney for the Housing & Consumer Law Practice Group, was named the 2011 Cincinnati Bar Association Real Property Law Practitioner of the Year. Mr. Morgan is a recognized leader in foreclosure defense. He has won several important Court of Appeals cases that have expanded defenses for homeowners facing foreclosure, as well as a variety of other consumer-related issues. Mr. Morgan represented the residents of Valley Homes to obtain a complete redevelopment of that historic Lincoln Heights community. Mr. Morgan joined the staff of Legal Aid in 1997. Prior to that he was head of the City of Cincinnati’s consumer protection division (1975-84) and an investigative reporter for WLW-TV covering consumer issues (1984-89). John Schrider, Director of the Legal Aid Society of Southwest Ohio, LLC, was presented with Housing Opportunities Made Equal’s (HOME) 2011 Founder’s Award. This award was given in recognition of Mr. Schrider’s many decades of legal advocacy, representing low-income tenants in major litigation involving fair housing rights. Mr. Schrider has been with Legal Aid since 1974 and was Director of Litigation before assuming his current position. He continues to mentor staff attorneys and provide strategic leadership for Legal Aid’s litigation and public policy advocacy.
