Facts supporting this request:
1) The proposed use would not dimin ish surrounding property values because:
The site plan application before the planning board includes plantings for screening of
the southern residential abutter . This conversion will not adversely effect property
values .
2) Granting the variance is not contrary to the public interest because: The public interest in
providing a ground distrubance buffer within 25 feet of a wetland is preserved with this
proposal . By replacing an existing gravel driveway and parking lot with a self contained
porous pavement surface and infiltration bed, the original characteristics of the buffer
are restored .
3.) Denial of the variance_would result in unnecessary hardship to the owner because of the

4.) Granti ng the variance would do substantial justice because: rt would do substantial
justice to the mutual land owner to be allowed to install this stormwater system

3.) Denial of the variance would result in unnecessary hardship to the owner because of
the fo!lowing special circumstances of the property:
These two abutting parcels are commonly owned by Wissler Properties, LLC and the
proposed rehabilitated parking area will have an easement area which will be enjoyed
by Wissler Auto Group, LLC (OBA Volkswagen of Rochester) . The prohibitions of the
25-foot no-ground-disturb buffer prevents the installation of proper safety lighting on the
existing pavement and operation but also places the hardship of not being able to
rehabilitate the existing parking lot.
5.) The use is not contrary to the spirit of the ordinance because:
The intent of the 25-foot is to protect wetlands from adverse impact. This wetland and
buffer have previously been impacted over time since the 1960's and early 1970's.
Runoff from the existing gravel parking leaves the surface completely untreated .
Replacing the compacted gravel and crushed stone parking area with a porous asphalt
pavement surface and infiltration bed will restore values within the buffer area . Surface
water runoff will not only be filtered in the aggregate medium but also have a chance to
infiltrate into the subsoil.

Variance Request - 42.12 h.2.H - To allow Land Disturbance within 25 Feet of
the Wetland Edge
Mr. Chairman and Members of the Rochester Zoning Board of Adjustment,
Pursuant to the Zoning Ordinance standards the following variances
are hereby requested to Article 42.8.C to allow pavement within the 5-foot
side pavement setback within the Granite Ridge District (GRD}, Article 42.12
h.2 to allow parking within the Conservation Overlay District, and Article
42.12 h.2.H to allow ground disturbance within the 25-foot no-disturbance
buffer of a wetland.
Wissler Properties, LLC is the land owner for two abutting properties, Lot 1, Tax
Map 216 and Lot 162, Tax Map 221. Wissler Auto Group, LLC operates (OBA)
Volkswagen of Rochester which has historically been located on Lot 1, previous owned
by Beranger Realty, Inc. and operated the previous business Beranger Volkswagen. In
January of 2014, Wissler Properties, LLC purchased the second parcel, Lot 162, with the
intent of expanding the business. Wissler Properties, LLC received a minor site plan
review to park up to 10 cars on a gravel parking lot primarily on Lot 162.
At the present time, Wissler Properties, LLC has submitted an application for
Major Site Plan Review to the Planning Board in which they are request to pave the

parking area with porous asphalt pavement and create an infiltration bed.
completing this they will be removing a compacted gravel and crushed stone parking
lot. They are also requesting to install lights for operations and safety.
