Any exceptions to, or deletions from, this practice are described in Section 1.4 of this report. This assessment has revealed no evidence of recognized environmental conditions in connection with the property. Findings: SESI did not identify any RECs associated with the site. SESI did not identify any historical REC (HRECs) associated with this site. SESI did not identify any “de minimis” environmental conditions. Conclusion: Based on our visual inspection of the property and the limited amount of information gathered, SESI did not find any obvious indications that hazardous materials were ever improperly disposed of on or adjacent to the site. ENVIRONMENTAL SITE ASSESSMENT Dale Property Dale Road Daphne, Alabama ______________________________________________________________________ 1.0 INTRODUCTION SESI was authorized by Ms. Jody Wise Campbell of Clerk of the Circuit Court of Baldwin County to conduct a Phase I Environmental Site Assessment (ESA) on the Dale Property located at Dale Road in Daphne, Alabama. The Baldwin County Commission identifies the site as Parcels 43-09-29-2-000-050.000, 43-09-29-0-000002.000 and 43-09-29-0-000-004.000. The site assessment was conducted in accordance with the guidelines outlined in the ASTM Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process Designation E 1527-05. Topographic and site maps are included as Figures 1 and 2. 1.1 Purpose for Performing Phase I ESA The primary purpose of this assessment was to identify Recognized Environmental Conditions (RECs) associated with the site. The Phase I ESA was conducted in accordance with the requirements of the ASTM Standard Practice for Environmental Site Assessments: Phase I for Environmental Site Assessments Process, Designation E 1527-05. A REC, according to ASTM, is defined as the presence or likely presence of any hazardous substances or petroleum products on site under conditions that indicate an existing release, a past release, or a material threat of release of hazardous substances or petroleum products into structures on the site or into the ground, groundwater, or surface water of the site. In addition, environmental conditions that in the past would have been considered a REC, but which may or may not be considered a REC currently, are identified as Historical RECs (HRECs) in this report. De minimis conditions are not considered RECs. A de minimis condition generally does not present a material risk of harm to public health or the environment and generally would not be the subject of an enforcement action if brought to the attention of appropriate governmental agencies. 1.2 Scope of Work In accordance with the above-referenced agreement, SESI performed a walk through the site, noted use of adjoining properties, and conducted a search of certain readily available historical and regulatory records. More specifically, the scope of services included the following: ____________________________________________________________________________________ SESI Project No.: M14-073 -1- PHASE I ENVIRONMENTAL SITE ASSESSMENT Dale Property Dale Road Daphne, Alabama ______________________________________________________________________ Site and Adjoining Property Observations Visual observations of the site, structures, and surrounding properties were made to identify potential sources or indications of chemical contamination such as underground storage tanks (USTs), aboveground storage tanks (ASTs), potential sources of polychlorinated biphenyls (PCBs), chemicals and hazardous materials, and areas with surface stains or stressed vegetation. In addition, the immediately adjoining properties were observed from the site, without being entered, for potential sources of contamination or environmental impairment, which could likely migrate to the site via surface water runoff, groundwater transport, or other pathways. Photographs depicting the site and adjoining sites are included as Appendix A. Geologic Information A review was made of available published geological and groundwater information obtained from the United States Geological Survey and other referenced sources for the site vicinity. Historical Review A review of reasonably ascertainable information such as Sanborn maps, city directories and aerial photographs was conducted to evaluate previous land use. Regulatory Records Review Environmental Data Resources, Inc. (EDR) was retained to perform the government records search requirements outlined by the ASTM standard. The following regulatory databases were reviewed to identify use, generation, storage, treatment, or disposal of hazardous materials, or releases of such materials that may impact the site: National Priorities List (NPL); Comprehensive Environmental Response, Compensation, and Liability Information System (CERCLIS); CERCLIS No Further Remedial Action Planned (NFRAP); Resource Conservation and Recovery Information System-Treatment, Storage, and Disposal facilities (RCRIS-TSDs) and Corrective Action Facilities (CORRACTS); RCRIS Large Quantity Generators (RCRIS-LQG); RCRIS Small Quantity Generators (RCRIS-SQG); Emergency Response Notification System (ERNS); an in house database for state records are maintained by the Alabama Department of Environmental Management (ADEM) and include the Leaking Underground Storage Tank (LUST) List, Permitted Solid Waste Facilities (SWF), and Alabama Registered Underground Storage Tanks (UST). ____________________________________________________________________________________ SESI Project No.: M14-073 -2- PHASE I ENVIRONMENTAL SITE ASSESSMENT Dale Property Dale Road Daphne, Alabama ______________________________________________________________________ Interviews with Site Representatives Site representatives and other persons familiar with the site were interviewed with regard to the possible past or present use of hazardous substances and petroleum products at the site. Municipal Records Review Contact with certain regulatory agencies such as local building and health departments and fire officials as to relevant historical information regarding the site and surrounding parcels. Prior Report Review When provided, a review was made of previous environmental assessments and records of previous environmentally related activities with the purpose of identifying RECs. There may be environmental issues or conditions that exist that are outside the scope of the ASTM standard. The following non-scope considerations were addressed as part of this assessment: Wetland Identification An inspection of the property was performed to determine if any portion of the +/-22acre site has conditions that are inundated or saturated by surface or groundwater at a frequency and duration sufficient to support and that under normal circumstances, do support a prevalence of vegetation typically adapted for life in saturated soil conditions. Wetlands generally include swamps, marshes, bogs and similar areas. 1.3 User Reliance This report is for the use and benefit of and may be relied upon by Clerk of the Circuit Court of Baldwin County or third parties authorized by Clerk of the Circuit Court of Baldwin County including the lender(s) in connection with a secured financing of the property and their respective successors and assigns. Any third party use or reliance on this report shall be limited by the exceptions and limitations in the report and with the acknowledgment that actual site conditions may change with time, and that hidden conditions may exist at the site that were not discoverable within the scope of the assessment. In order to claim protection from CERCLA liability, as an innocent landowner, bona fide prospective purchaser or contiguous property owner, the acquisition of the site should be ____________________________________________________________________________________ SESI Project No.: M14-073 -3- PHASE I ENVIRONMENTAL SITE ASSESSMENT Dale Property Dale Road Daphne, Alabama ______________________________________________________________________ completed within 180 days after research documentation was first consulted (EDR, February 28, 2014). 1.4 Exceptions/Data Gaps Exceptions/ Data Gaps Encountered: City directory information for this area was limited to data beginning in 1980. Sanborn map information for this area was unavailable. These exceptions/ data gaps are not expected to alter the outcome of the report since other historical information was available. 1.5 Significant Assumptions SESI made the following assumptions in this report: SESI relied on data received from secondary sources including governmental agencies, the client, representatives of the client, property owners, property owner representatives, computer databases and interviews. Unless reported, SESI has made no attempt to verify the accuracy and completeness of the information derived from secondary sources. SESI assumes information provided by or obtained from governmental agencies, including information obtained from government websites, is accurate and complete. Groundwater flow is assumed based on contour lines shown on the United States Geological Survey topographic maps. SESI assumes that the property has been correctly and accurately identified by the client, representatives of the client, property owner and property owners’ representatives. 1.6 Special Terms and Conditions This Phase I ESA was prepared in accordance with the stated and agreed upon Scope of Work. No special terms and conditions are applicable to this Phase I ESA. ____________________________________________________________________________________ SESI Project No.: M14-073 -4- PHASE I ENVIRONMENTAL SITE ASSESSMENT Dale Property Dale Road Daphne, Alabama ______________________________________________________________________ 2.0 SITE DESCRIPTION The property is located at Dale Road and is located in a residentially developed area in the City of Daphne. The site is +/22 acres in size and is located in the northwest corner of Section 29, Township 6 South, Range 2 East in Baldwin County, Alabama. The property is physically located on the north right-of-way of Dale Road and bordered by US Highway 98 on the west and Daphmont Drive on the east. Topographic and site maps are included as Figures 1 and 2. The United States Department of Agriculture (USDA) Soil Survey of Baldwin County, Alabama, was reviewed in an effort to determine the soil type associated with the site investigated. The major soil type found was the Marlboro. This soil type is classified under the Unified Soil Classification System as very fine, sandy loam (SM) with a seasonal high water table that is expected to be 2.5 to 4.0 feet below ground surface. 2.1 Current Use of Site The site is currently vacant. purposes in the past. However, it was utilized for residential and farming 2.1.1 Descriptions of Structures, Roads, and Other Site Improvements Currently there are no buildings on site. However, a concrete foundation is present along the southern border of the property which indicates the location of a former residential structure. Owner, Property Manager & Occupant Information Ms. Jackson is the owner of the property and previously resided on site. 3.6 Reason For Performing Phase I The reason for this assessment is so Ms. Velma Dale Jackson may be able to qualify for the innocent landowner, contiguous property owner or bona fide prospective purchaser defense to CERCLA liability. In addition to satisfying one of the requirements to qualify for the Innocent landowner, contiguous property owner or bona fide prospective purchaser defense to CERCLA liability, another reason for performing this Phase I ESA includes the need to understand potential environmental conditions that could materially impact the operation of the business associated with the site. ____________________________________________________________________________________ SESI Project No.: M14-073 -7- PHASE I ENVIRONMENTAL SITE ASSESSMENT Dale Property Dale Road Daphne, Alabama ______________________________________________________________________ 4.0 STANDARD ENVIRONMENTAL RECORDS REVIEW A review of databases from federal, state, and local environmental regulatory agencies was conducted to identify use, generation, storage, treatment or disposal of hazardous materials and chemicals or release incidents of such materials, which may impact the site. Environmental Data Resources (EDR) was retained to perform the database search. The databases identified on the EDR report have been examined in an effort to locate sites that lie within search distances specified by the ASTM standard. A complete copy of the EDR report is included in Appendix C. 4.1 Federal Records The federal environmental databases listed below were reviewed to obtain information pertaining to the site and properties within the listed approximate search distance. These databases are maintained by the USEPA. However, two 92) of the facilities (Jubilee Stop and Eagle Cleaners) are mapped incorrectly. Both facilities are located greater than one-mile from the site. The remaining facility (Jubilee Landscape, Inc.) is not within the specific search radius and is not considered a potential environmental concern at this time. Twenty (20) orphan summary sites were listed that SESI has identified and verified that none of the orphan properties are within the specific search criteria. In addition EDR also identified two (2) public/water wells within a one-mile radius of the site. SESI has not observed these wells. ____________________________________________________________________________________ SESI Project No.: M14-073 -9- PHASE I ENVIRONMENTAL SITE ASSESSMENT Dale Property Dale Road Daphne, Alabama ______________________________________________________________________ 5.0 SITE HISTORY AND RECORDS REVIEW In an effort to identify historical practices or conditions, which may have impacted the site, past land uses were investigated through a review of historical records. SESI researched prior use of the property through readily available, practically reviewable record sources. 5.1 Topographic Map Based on the USGS Daphne, Alabama, Quadrangle Topographic Map 1953, photorevised 1982, the site is located approximately 100-140 feet above mean sea level (msl) and has a generally level topography. The direction of groundwater flow in the uppermost aquifer generally conforms to the topography in the area, which would indicate a northwestern flow direction towards Red Gully. Three (3) structures are visible on the south border of the site. No potential environmental concerns were noted. 5.2 Aerial Photography In an effort to determine historical land use that may have involved hazardous substances, SESI reviewed historical aerial photographs for the site and surrounding areas. The following aerial photographs were reviewed. 1938 and 1974 –University of Alabama Archives 1997, 2003, 2006, 2008, 2010, 2011 and 2013 – Google Earth Table 5: Aerial Photographs Site Description The site is shown as undeveloped. The site is cleared and a structure is visible on the 1974 southwest and southeast corners of the property. 1997 Five (5) structures are visible all along the southern border of the site. 2003, 2006, 2008, 2010, An additional structure is visible on the 2003 aerial 2011 and 2013 photograph also on the southern border. No major changes were noted to the site with the remaining aerial photographs. Year 1938 Based on the review of aerial photographs, no items of environmental concern, such as landfills or dumping, were observed in the reviewed aerial photographs. ____________________________________________________________________________________ SESI Project No.: M14-073 - 10 - PHASE I ENVIRONMENTAL SITE ASSESSMENT Dale Property Dale Road Daphne, Alabama ______________________________________________________________________ 5.3 Sanborn Fire Insurance Maps The Sanborn Map Company produced maps of urban areas and gave existing structure ratings for fire insurance purposes. Sanborn Maps for the area were not available at this location. 5.4 Historical City Directories EDR provided historical city directories information. EDR consulted the RL Polk directories for the following years: 1965, 1969, 1974, 1980, 1984, 1989, 1994, 1999, 2003, 2008 and 2013. Dale Road was listed in the 1989, 1994, 2003, 2008 and 2013. Tenants included residential listings. No adjoining tenants of potential environmental concern were identified based on the information reviewed. A copy of the city directory search is included in Appendix B. 5.5 Property Tax Files According to the Baldwin County Revenue Commission the property owner of each parcel is Zeolia Dale. No previous ownership was noted. 5.6 Recorded Land Title Records Recorded land title records were accessed as part of this investigation via the Baldwin County Probate Court online records on March 10, 2014. According to the property owner, Ms. Velma Jackson, the buildings were razed in autumn 2013. 5.8 Zoning/Land Use Records According to the City of Daphne Planning Commission the site is zoned B-2, general business. ____________________________________________________________________________________ SESI Project No.: M14-073 - 12 - PHASE I ENVIRONMENTAL SITE ASSESSMENT Dale Property Dale Road Daphne, Alabama ______________________________________________________________________ 6.0 Site Reconnaissance SESI personnel conducted a site visit on March 11, 2014. The site visit consisted of a walk over the perimeter of the site and neighboring properties and a drive along streets surrounding the site perimeter. Photographs depicting conditions observed during the site visit are provided in Appendix A. 6.1 Exterior Observations 6.1.1 Underground Storage Tanks (UST) No visual evidence (pipes, vents, pumps, stains) that would indicate past or present USTs on site was apparent. Furthermore, review of historical records, the regulatory database report (see Section 4.2.2), and interviews with the site contact revealed no USTs on site. 6.1.2 Aboveground Storage Tanks (AST) No visual evidence that would indicate past or present ASTs on site, such as concrete foundations or containment walls, pedestals or steel support structures, was apparent during the site visit. 6.1.3 Polychlorinated Biphenyls (PCBs) PCBs are toxic coolants or lubricating oils used in some electrical transformers, light ballasts, electrical panels, or other similar equipment. Alabama Power Company provides power to the area. Utility companies often own transformer equipment and typically assume the responsibility for repair or replacement of damaged or leaking units and for required cleanup or remediation activities. Indications of damage or leakage should be immediately reported to the responsible utility company. One (1) pole mounted transformer was noted on site along the south border of the site. Those areas that are inundated or saturated by surface or groundwater at a frequency and duration sufficient to support and that under normal circumstances do support a prevalence of vegetation typically adapted for life in saturated soil conditions. Wetlands generally include swamps, marshes, bogs, and similar areas. SESI consulted the National Wetland Inventory (NWI) website. The site is not located within a wetland. The NWI map is included in Appendix D. 6.3.4 Other Non-ASTM Scope Issues No additional non-ASTM scope issues were investigated at the site. 6.4 Previous Assessments No previous reports were submitted to SESI for review. ____________________________________________________________________________________ SESI Project No.: M14-073 - 15 - PHASE I ENVIRONMENTAL SITE ASSESSMENT Dale Property Dale Road Daphne, Alabama ______________________________________________________________________ 7.0 INTERVIEWS The objective of the interview process is to obtain information regarding the site history and any recognized environmental condition associated with the property. 7.1 Interview With Property Owner Representative Ms. Velma Dale Jackson was interviewed during the course of this assessment. According to Ms. Jackson her father bought the property more than 50 years ago. Her father farmed the land until he passed away in 1960. After that time the property was utilized for residential purposes. Ms. Jackson is not aware of any potential environmental concerns associated with the site. 7.2 Interview With ADEM Representative Ms. Azure Jones with ADEM was contacted in an attempt to discover if any records were on file for the property that might pose an environmental concern. Ms. Jones indicated there were no records on file for this site. 8.0 FINDINGS SESI has performed a Phase I ESA in conformance with the scope and limitations of ASTM Practice E 1527-05 of the property located at Dale Road in Daphne, Alabama. Any exceptions to, or deletions from, this practice are described in Section 10.0 of this report. SESI did not identify any RECs associated with the site. SESI did not identify any historical REC (HRECs) associated with this site. SESI did not identify any “de minimis” environmental conditions. 9.0 OPINIONS AND CONCLUSIONS Based on our visual inspection of the property and the limited amount of information gathered, SESI did not find any obvious indications that hazardous materials were ever improperly disposed of on or adjacent to the site. It does not appear that this site was ever used for a landfill or other industrial purposes that would result in regulatory levels of contamination at the site. ____________________________________________________________________________________ SESI Project No.: M14-073 - 16 - PHASE I ENVIRONMENTAL SITE ASSESSMENT Dale Property Dale Road Daphne, Alabama ______________________________________________________________________ 10.0 LIMITATIONS/EXCEPTIONS SESI has prepared this Phase I Environmental Site Assessment using reasonable efforts in each phase of its work to identify recognized environmental conditions associated with hazardous substances or petroleum products at the property. The scope of work for this Phase I ESA was consistent with the ASTM E 1527-05. Findings within this report are based on information collected from observations made on the day of the site investigation and from reasonably ascertainable information obtained from governing public agencies and referenced sources. Reasonable efforts have been made during this assessment of aboveground and underground storage tanks and ancillary equipment. “Reasonable efforts” are limited to information gained from visual observation of largely unobstructed areas, recorded database information held in public record and available information gathered from interviews. Such methods may not identify subsurface equipment that may have been hidden from view due to paving, construction or debris pile storage, or incorrect information from sources. The database search focuses on the property and neighboring properties that could impact the property. Neighboring properties listed in governmental environmental records are identified within specific search distances. The search distance varies depending upon the particular government record being checked. The regulatory research is designed to meet the requirements of ASTM E 1527-05. Our conclusions regarding the potential environmental impact of nearby off-site facilities are based on readily available information from the environmental databases and the assumed groundwater flow direction. A detailed file review of each facility was beyond the scope of work. Actual groundwater conditions, including direction of flow, can only be determined through the installation of monitoring wells. Regardless of the findings stated in this report, SESI is not responsible for consequences or conditions arising from facts that were concealed, withheld, or not fully disclosed at the time the assessment was conducted. SESI makes no other representation to any third party except that it has used the degree of care and skill ordinarily exercised by environmental consultants in the preparation of the report and in the assembling of data and information related thereto. These data are accessible only by subsurface material and groundwater sampling through the completion of soil borings and the installation of monitoring wells. The scope of work, determined by the client, did not include these activities. This report is not definitive and should not be assumed to be a complete or specific definition of all conditions above or below grade. Information in this report is not intended to be used as a construction document and should not be used for demolition, renovation, or other construction purposes. Mrs. Guarino has worked in the environmental industry prior to graduation from Florida Atlantic University. Her experience includes soil and groundwater remediation, soil analysis and classification, site investigations including Phase I and Phase II environmental audits, and tank closures. ERIC A. GUARINO Mr. Guarino has over sixteen (16) years experience in site investigations and environmental remediation. This experience includes supervision of drilling operations including the design and installation of field monitoring equipment such as wells and piezometers to aid in the evaluation of subsurface conditions.
