CALL TO ORDER The Planning Commission meeting was called to order at 7:01 p.m. by Chair Brown. 2. APPROVAL OF MINUTES a. September 10, 2012 Motion (Bond/Edwards) to accept the minutes of September 10, 2012. Passed 5/0. (Commissioner Braden had not yet arrived.) 4. CITIZEN COMMENT PERIOD None. 5. PUBLIC HEARING a. Comprehensive Plan Amendments Chair Brown opened the Public Hearing at 7:03 p.m. Planner Pasinetti explained the Comprehensive Plan Amendment process, including the three routine items for 2012 and the annual open window in November for privately initiated amendments (there were none). Shawn Hoey with the Master Builders Association addressed the Commission, drawing attention to his comment letter submitted today (copies provided at meeting). He said that MBA recommends keeping school impact fees at or below the Pierce County’s adopted level. Chair Brown closed the Public Hearing at 7:10 p.m. 6. ACTION ITEMS a. Comprehensive Plan Amendments 1 Fife Planning Commission Minutes of Meeting October 1, 2012 Commissioners discussed the history of school impact fees in Fife and clarified the position of Pierce County. Motion (Edwards/Waldner) to recommend the findings of fact contained in the staff report and the 2012 Comprehensive Plan Amendments as shown in Attachments A through D to the City Council, with the recommended provision that Puyallup School District’s school impact fee be reduced to match Fife’s asking. Some additional discussion ensued. Vote – motion passed 6/0. 7. NEW BUSINESS a. Medical Marijuana Director Osaki first thanked the Planning Commission for their action on the Comprehensive Plan Amendments, adding that a major update to the Comprehensive Plan is required by the end of 2014. He reported that the annual time period for the private sector to initiate amendments will open November 1 and will stay open into March, rather than closing after only one month as in years past. Director Osaki reported that he is putting the topic of Medical Marijuana on the minds of Commissioners, expecting much to be in the news related to the coming election on Initiative 502 that can serve as background for decisions that will be made for Fife in the next year. 8. DIRECTOR’S REPORT Director Osaki reported that the stakeholder committee meeting on the South Campus Master Plan was a good one; Commissioners Lemoncelli and Fagundes are participating on that committee. Kelsey Lane housing development plans to build out in the next 12-18 months, and Valley Haven also in the next 6-12 months. KPG and Seth Harry, consultants for the City Center Visioning project, will be meeting with staff later this month while Mr. Harry is in town for another project. This may possibly produce some additional City Center related discussion (without Seth Harry in attendance) for the Planning Commission at the November 5, 2012 meeting. The Harvest Festival is October 6. The meetings in November and December will cover more on medical marijuana, phase 2 of the sign code, discussion regarding liquor stores, and city center visioning work. Next year’s work will include the new transportation plan and city center code work, to include a subarea plan and policy development. 9. REPORT IN BRIEF: Larson Automotive has applied for a Comprehensive Sign Design Plan for their location in Fife on what was previously Alexander Avenue East. With approval from the Planning Commission, the comprehensive sign design plan process would allow the applicant to install a new (replacing the old) 25 foot tall, 36 square foot sign freestanding sign at the corner of Pacific Highway East and Alexander Avenue East in a Regional Commercial (RC) Zone. The new sign would include logos from the neighboring Audi, Nissan and Porsche. BACKGROUND: Larson Automotive recently completed a very large retail vehicle sales lot within the City of Fife. This development includes four (4) new dealerships, Audi, Porsche, Mercedes and Nissan. Larson Automotive purchased the Nissan Dealership in 2008. In 2010, Larson Automotive purchased the Korum RV site (directly to the east of the Nissan site). In 2010, that site was redeveloped into Porsche, Audi and Mercedes. Part of that redevelopment included the vacation of Alexander Avenue making the entire site contiguous (see attached Ordinance No. 1710). The four (4) lots upon which these dealerships are located are all owned by Larson Automotive (also known as RJ1700 LCC). Two of the lots (totaling 9.28 acres) are contiguous to one another on the east side of what was previously Alexander Avenue and have no direct street frontage on Pacific Highway East. The other two lots (totaling 4.31 acres) are contiguous to one another on the west side of Alexander Avenue, with approximately 80 feet of street frontage on Pacific Highway East. DISCUSSION AND FINDINGS: 1. On October 15th, 2012, the applicant submitted an application for a Comprehensive Sign Design Plan to install a new 25 foot tall, 36 square foot freestanding sign adjacent to Pacific Highway East. The property upon which the proposed sign is to be placed is zoned Regional Commercial, as are all of the properties with uses to be advertised on the proposed sign. 2. The Comprehensive Sign Design Plan application relates to the freestanding sign on a separate lot located along Pacific Highway East. The sign code specifically prohibits off-premises signs, except as permitted for agricultural businesses or as permitted through a Comprehensive Sign Design Plan (see Fife Municipal Code (FMC) 16.09.020 H). The new freestanding sign would replace an existing 20 foot tall, 50 square foot sign located at the intersection of Pacific Highway East and Alexander Avenue East. 4. The new freestanding sign would be considered an off-premises sign (as it will advertise certain Larson automotive products located to the east (across Alexander Avenue) and must be approved through a Comprehensive Sign Design Plan as provided for in Fife Municipal Code Chapter 16.11 (“Comprehensive Sign Design Plans”). 4. The applicant’s submittal states that the Porsche & Audi dealerships’ location requires an off-premise sign in order to be viewed by the traveling public. 5. The applicant’s submittal, states that, because of the location of the site(s) in relation to Pacific Highway East, indicates, the proposed sign would give the traveling public better visibility to gain access to the Larson Automotive Dealerships (Porsche, Audi and Nissan). The applicant also cites regular feedback from customers asking why there is not a sign at the entrance. 6. FMC 16.11.010 states that the purpose of the Comprehensive Sign Design Plan is “…to allow for some flexibility from the sign code. There will be situations where some flexibility from the sign code is desirable, but where the variance proceedings are not the appropriate forum for an application. This section sets out the criteria for the comprehensive sign design plan” 7. FMC 16.11.020 provides the criteria for review for a comprehensive sign design plan application and states, “16.11.020 Criteria for review. Applicants requesting consideration of a comprehensive sign design plan must meet one of the following criteria: A. The sign and building structures on the lot are of a similar architectural design. The design of both the building and the sign shall be of a distinctive type of architecture providing a pleasing aesthetic appearance; or B. The location of a sign is more appropriate on a frontage or facade other than, or in addition to, that allowed by the sign code. The applicant shall bear the burden of proving that such a sign is necessary for the sign to be visible to the traveling public. Except under special circumstances, such as a note on a short plat limiting use, signs will only be permitted on the premises of the business or parcel asking for the comprehensive sign design plan; or C. The application meets the criteria for mural as defined in FMC 16.02.300. (Ord. 1488-03 § 1, 2003).” (Emphasis added) The applicant is basing the requested application on the criteria that the location of [the] sign is more appropriate on a frontage or façade other than, or in addition to, that allowed by the sign code as well as on the similarity of architecture “to the buildings, & existing freeway and Nissan sign.” Page 2 Z:\Planning Commission\Packet ready items ONLY\2012\11 November\Larson_CSD2.doc 8. The following is a staff analysis of the application in relation to the criteria for review identified in FMC 16.11.020. A. “The sign and building structures on the lot are of a similar architectural design. The design of both the building and the sign shall be of a distinctive type of architecture providing a pleasing aesthetic appearance; or” Staff Analysis: The application meets FMC16.11.020(A) because the sign and building structures on the lot are of a similar architectural design. The remodel of Nissan and the new Porsche, Mercedes and Audi dealership (Attachment 3 & 4) and the proposed sign are all of a similar architectural design. B. “The location of a sign is more appropriate on a frontage or facade other than, or in addition to, that allowed by the sign code. The applicant shall bear the burden of proving that such a sign is necessary for the sign to be visible to the traveling public. Except under special circumstances, such as a note on a short plat limiting use, signs will only be permitted on the premises of the business or parcel asking for the comprehensive sign design plan;” Staff Analysis: Photographs taken by the applicant and staff show the approach (Attachment 1) to the Larson Automotive site shows how the sign is necessary for the viewing public because of the lack of visibility of the new site for the Mercedes, Audi and Porsche dealerships. A letter from Larson Automotive group provides feedback on the difficulty for new customers searching for the dealership(s) (Attachment 2). The location of dealerships is difficult to determine from Pacific Highway East based on their location. The Pick-Quick is located directly north of Mercedes, Porsche & Audi dealership and very large poplar trees are planted along the southern edge of their property. These trees block the visibility from Pacific Highway East. The Nissan Site does have property frontage along Pacific Highway East (80 feet of frontage). This limited amount of frontage has a vegetated barrier from an enhanced buffer along Wapato Creek. 9. FMC 16.11.030, provides for the allowable actions under a comprehensive sign design plan and states: “16.11.030 Allowable actions. The planning commission shall review submittals for comprehensive sign design plans. The planning commission can allow one or more of the following actions under a comprehensive sign design plan: A. Allow one wall sign to be up to 20 percent larger than allowed under the sign code; B. Allow one freestanding sign to be up to 10 percent larger than allowed under the sign code; C. Allow freestanding signs to be up to 10 percent closer together than allowed under the sign code; D. Allow one additional freestanding sign on a parcel; E. Allow directional signs to be larger than permitted when necessary for view purposes; and Page 3 Z:\Planning Commission\Packet ready items ONLY\2012\11 November\Larson_CSD2.doc F. Allow a mural to be painted or affixed to an exterior wall of a building. The planning commission may require that the applicant provide additional landscaping as a condition of allowing a comprehensive sign design plan. The planning commission can also require that the applicant return to the planning commission for review of any changes to the signs issued under the comprehensive sign design plan. Other conditions can be required by the planning commission as necessary to preserve the purpose and intent of the sign code and the zone code. (Ord. 1488-03 § 1, 2003).” (Emphasis added) The applicant’s request meets the allowable action provided for in FMC 16.11.030. In addition, the allowable actions by the Planning Commission can require that the applicant return to the planning commission for review of any changes to the signs issued under this comprehensive sign design plan or other conditions to preserve the purpose and intent of the sign code and zone code. The Purpose and Scope of the Sign Code is as follows: “16.01.020 Purpose and scope. It shall be the purpose of the Fife Sign Code to provide minimum standards to safeguard life, health, property, and public welfare by regulating and controlling the design, quality of materials, construction, location, and maintenance of all signs and sign structures. (Ord. 1488-03 § 1, 2003).” The Purpose statement for the Regional Commercial Zone Code is as follows, “19.44.010 Purpose. This district is intended to provide for retail, service and office uses which primarily serve the businesses, tourists and general population of the Puget Sound region. The district is further intended to provide for a variety of housing densities and types. The uses are intended to exist in a compatible and complementary manner with surrounding uses and districts. Street-based store frontages and plazas are encouraged in order to provide for a pedestrian atmosphere. (Ord. 1317 § 3, 1998).” Conclusions 1. The application is an allowable action in the Fife Municipal Code under comprehensive sign design plan review (FMC 16.11.030). 2. Based on the information provided by the applicant, a site visit by staff, and findings of this staff report, the applicant’s request meets the minimum requirements of FMC16.11.020(A) & (B) related to “Criteria for Review.” The dealerships are difficult to see from the main entrance. The addition of Porsche, Audi, and the Larson logos along Pacific Highway will provide better visibility for their customers looking to access the site. STAFF RECOMMENDATION: Staff recommends that the Planning Commission approve the Comprehensive Sign Design Plan to allow the sign as shown in Attachment 4 with the following conditions: 1. The foundation for the existing sign shall be removed as part of the replacement of the new sign to make room for new landscaping area. 2. Sign face replacements shall be allowed for flexibility to any future tenants without the need for a comprehensive sign design plan. Any replacement or enlargements this sign shall, however, require a new Comprehensive Sign Design Plan application. 3. Prior to issuance of the sign permit, a landscaping plan shall be reviewed and approved by the City that provides a landscaping area equal to or greater than ½ the square foot of the sign area (minimum). RECOMMENDED MOTIONS: I move to adopt the findings and conclusions contained in the staff report and approve the Comprehensive Sign Design Plan application for Larson Automotive subject to conditions 1-3 as contained in the staff report.
