Salient features of AGREEMENT CONDITIONS for the successful Rate Tenderers
1. The successful “Rate Tenderer/s”, hereinafter referred to as “Supplier” shall
ensure that the supplies strictly be made within a period of 15 days from the date
of receiving the indent from the concerned Deputy Conservator of Forests.
2. For the purpose of this tender the Forest Nursery season 2013-14 constitutes the
period between November 2013 to October 2014
3. The supplies shall be in accordance with the quality and quantity indicated in the
indent to be placed by the respective Deputy conservator of Forests during the
Financial year 2013-14
4. The materials are to be delivered to the concerned
Division Head Quarters of the
respective Forest Divisions annexed to this agreement at the cost of the supplier
manufacturing industry.
5. If indenting Deputy Conservator of Forests, on such inspection/ investigations/
enquiries finds that any of the material supplied is of sub-standard quality shall
have right to reject the whole or part of the consignment/material within 15 days
from the date of receiving the delivery of the supplies and direct the supplier to
replace it within 10 days failing which necessary action shall be taken to blacklist
the erring supplier.
6. The supplier shall furnish a Security Deposit for ` Rs. 3,00,000/- (Rupees Three
lakhs only) per unit by furnishing a Bank Guarantee for the said amount, as a
surety for the due fulfillment of all the agreement conditions.
7. The Bank guarantee shall have a currency during the period from the date of
signing agreement upto April
30th
2015 and shall be issued by an Insurance
Firm/ Nationalized Bank having its branch at Bangalore.
8. In the event of any (successful Rate Tender) supplier failing to adhere to the
supply time schedule, the Security Deposit and Bank Guarantee concerned shall
be forfeited and the supplier black listed against participating in the process of
supply of
polythene bag/sheet/woven sacks to the forest Department
next three Forest Nursery seasons.

9. Bill Payment:
The indenting Deputy Conservator of Forests will take action to settle the
bills on receipt of the supplies. The suppliers should deliver the goods to the Head
Quarters of concerned Division
authorized
by the concerned
directly.
After receipt of the supplies, officer
Deputy Conservator of Forests would check the
quality of the supplies through Drop test and Gauge test as per the method
prescribed and would certify that the quality of the supplied materials are of
approved quality. If the materials are found to be of approved quality he should
submit a report to the concerned DCF about the quality of the supplies. In the
event of the material supplied being found to be sub-standard, the Deputy
Conservator of Forests or Asst. Conservator of Forests should reject the entire part
consignment within 15 days from the date of receiving the delivery of the supplies
and ask the supplier to replace the consignment with that of the specified quality
within 10 days failing which action will be taken against the suppliers as mentioned
above.
After receipt of the report from the Officer, the indenting Deputy
Conservator of Forests should take action to release 90% of the bill amount if the
supplies are certified as approved quality within 60 days from the date of the
receipt of supplies subject to release of budget from the Government. The
Concerned Head Quarters Range Forest Officer/ Asst.Conservator of Forests should
keep some samples (approximately ½ kg) of the PBs of different size upto 6
months(with code). During the course, if the supplied materials are found to be
sub-standard, he should intimate the concerned Deputy Conservator of Forests.
The Deputy Conservator of Forests should forfeit the balance 10% of the bill
amount and cancel the agreement made with the concerned supplier. In the event,
if the supplier opposes/litigates the action of the Deputy Conservator of Forests,
the samples of the concerned consignment may be sent to CIPET, Mysore for
detailed examination of the quality of the PBs. The opinion given by the CIPET,
Mysore is final. The charges of CIPET, Mysore for quality check shall be born by
the concerned supplier.
10 The supplier should supply the PBs of Standard “ IS-2508-84” as prescribed
by the CIPET, Mysore. The supplier should not supply the PBs manufactured
from the recycled material. During the course, if it is found that the supplied
materials were manufactured form recycled material, the EMD of the
concerned supplier will be forfeited to the department and necessary action
will be taken to blacklist the concerned supplier.
11 The EMD of Rs.25,000-00 paid by the supplier which would be considered as
Security Deposit
shall be
released to the supplier after 6 months of the
completion of agreement period. The Security Deposit of Rs.3,00,000-00

deposited and furnished as Bank Guarantee by the supplier will be released
to the supplier after 6 months of the completion of agreement period subject
to fulfillment of tender conditions by the supplier.
12 The Karnataka Forest Department shall not stand guarantee to any of the
financial institutions/Banks, raw material suppliers, power supply authorities,
pollution control board agencies, municipalities etc. It is the responsibility of
the successful Rate Tendered manufacturing industry to obtain clearances to
the satisfaction of the concerned organizations. Any disruption, arising in the
polythene bag / sheet & woven sack supplies, on account of any of the above
violations, the manufacturing industry cannot advance it as a reason for not
meeting the supply schedule.
13 The orders of supply indent from any of the Deputy Conservators of Forests
shall not constitute an authorization by the Karnataka Forest Department to
the manufacturing industry to enter into any financial or other commitments
with any public or private institutions. All such transactions are purely at the
sole risk of the concerned manufacturing industry only.
14 In the event of any dispute regarding supplies, appeals shall lie with the
concerned jurisdictional Chief Conservator of Forests of the Circle in which the
said Forest Division lies.
15 In the event of any inferior material being supplied, contrary to the agreed
quality and in violation of the terms and conditions of the agreement/contract,
the Department reserves the right to cancel the said contract, and not make
any payment for such inferior product, besides initiating appropriate action
under the tender conditions and law.

In case of manufacturers belonging to other State participate in the Tender,
price preference of 15% will be allowed to the goods manufacturing units
located in within the State as per Government Order No.CI 233 SPL 2008
Bangalore dated 28.02.2009.
17 This tender notification is subject to the Government Orders and directions of
the Government of Karnataka issued from time to time.

Supply of Polythene bags / Sheets, Woven Sacks
and to determine Rate per tonne of Polythene
Bags / Sheets & Rate per 1000 No’s of Woven
Sacks from manufacturing industries.
   
It is hereby notified, calling attention of the desirous LDPE Polythene Bag, HDPE
Polythene Sheet and HDPE Woven Sacks’ manufacturing Industries, that the Karnataka
Forest Department intends to short list prospective manufacturing industries to Supply
Polythene Bags, Polythene Sheets and Woven Sacks, in manner to be specified, for the
period 2013-14 between the period November 2013 to October 2014.
Note: The system followed will be “Two cover system” both “TECHNICAL” &
“FINANCIAL” bids tender through e-Procurement Portal Only.

2. The entire state has been divided into 3 units for the purpose of this e-tender for
2013-14. The bidders are directed to furnish EMD and Bank Guarantee for each unit
individually and separately as given below.
3. Rs.550/- (Rs. Five hundred fifty) only to be paid online as tender processing fee as
per directions contained in the e-procurement portal.
4. Rs.25,000/-(Rs. Twenty-five thousand) only to be paid as EMD through any of the
following four modes only. The bids will be evaluated only on confirmation of receipt
of the payment (EMD) in the GoK’s central pooling a/c. The EMD of unsuccessful
bidder will be refunded and EMD of the successful bidder will be considered as
Security Deposit till completion of the Tender period.

5. Time for receipt of tenders is up to 05.30 PM on 19.10.2013.
6. The Technical Bids will be opened in this Office on 22.10.2013 at 11.30 AM.
7. The Financial Bids of the qualified firms will be opened on 25-10-2013 at 04.30 PM.
8. If the above mentioned dates are declared as holiday for any reason, the subsequent
working day shall be the tender submission or Tender opening day as the case may be.
9. The rate should be quoted as actual price plus applicable statutory taxes,
separately.
Rate per Tonne of Polythene Bags/ Sheets and rate per 1000 Nos. of Woven
Sacks is to be determined by receiving Rate Tenders from such of the short listed
participants subsequently. The successful Rate Tenderer/s shall execute an agreement
with the PCCF (HOFF). The rates to be determined will be valid till 31-10.2014. In case
of any change in the applicable taxes it will be applicable.

10. Size and Quality for the following specifications of Transparent LDPE
Polythene bags /LDPE Black Polythene sheets and White HDPE Woven Sacks
to offer Rate Tender Quotes.
i) The supplier shall supply the PBs of Standard “IS-2508-84” as prescribed by the
CIPET, Mysore. The supplier shall not supply the PBs manufactured from the
recycled material. During the course, if it is found that the supplied materials
were made from recycled material, the Security Deposit of the concerned
supplier will be forfeited to the department and necessary action will be taken
to blacklist the concerned supplier.
b) To check the quality of the material before accepting the Goods, The drop
test would be conducted by the Deputy Conservator of Forests, or any Officer
authorized by him.

separately and inclusive of transportation & handling charges for delivering the material
to Divisional Head quarters of indenting Deputy Conservator of Forests.
NOTE: The LDPE polybags are required to be in use for 6 to 12 months period and HDPE
woven sacks / sheets for 8 to 20 months in the forest nurseries under the sun and rain.
They must withstand the load of nursery ingredients and shifting & transportation/

handling of full grown seedlings.
Considering this, any suitable alternate technology/
quality and material specifications may be furnished appropriately while offering the
prequalification details. Supportive technical documents etc. may also be furnished.
The supplies shall be in accordance with the Quantities indented by the
respective Deputy Conservators of Forests during the Nursery Season 2013-14
depending on the Budget grants and approvals accorded as per the Annual Programme
of Operations of respective Forest division/s. The supplies of approved quality material
are to be made within 15 days from the date of receipt of the indent from any Forest
Division. The materials are to be delivered to the headquarters of the respective Forest
Divisions as listed in the Annexure-IV
11. Particulars to be furnished :
i)
Certificate of Registration/ownership of the manufacturing industry issued by a
competent authority, specifically mentioning LDPE bags / black sheets/ HDPE Woven
Sacks.
ii) Location of the manufacturing industry office with full postal Address, Telephone and
Fax Nos. & e- mail ID.
iii) Particulars of the actual location of the industrial unit along with full postal Address
& Telephone/Fax Nos. of the industrial unit.
iv) Value Added Tax (VAT) Registration issued by the competent authority and VAT
Clearance Certificate for 2011-12 and 2012-13
v) Income tax Clearance Certificate issued by the competent authority for the
assessment year 2011-12 and 2012-13.
vi) Type and quality specifications of the products produced by the industry along with
details of installed capacity of the manufacturing industry and technology adopted.
vii) Raw material source and arrangements the industry is currently having to procure
the raw material.
Connected documents are to be enclosed, duly indicating
limitations if any in this regard.
viii) Official Bankers of the manufacturing industry with due certificate from the Bank.
ix) With respect to which units it is logistically convenient for the manufacturing
industry to effectively meet the supply requirement of the above material.
x) Employees/workers’ strength in the manufacturing industry.
xi) Particulars of the individual authorized to deal with the Department indicating the
status/position of the individual in the manufacturing industry along with the name
in full and postal address, telephone and fax numbers & e-mail ID.

xii) Supply/Business particulars of the manufacturing industry for the last three years
indicating the details of quantities supplied to different office/firm/company along
with the dates of supply (Invoice copies may be enclosed).
xiii) Samples of the LDPE Bags/Sheets, HDPE Woven Sacks shall be submitted to office
of the Principal Chief Conservator of Forests, Bangalore before the last date for
receipt of tenders and scanned copy of the acknowledgment shall be uploaded in eprocurement portal.
xiv) Supplier should submit Satisfactory Certificate along with documents in regard to
the quality of the materials and timely supplies, obtained from the Deputy
Conservator of Forests to whom he has supplied the material during the year
2012-13 or earlier.

Bids shall be submitted in Format as given in Annexure-I (Technical Bid Form) and
Annexure II(Financial Bid Form).
13.
Submission of bids.
a. Bids should be submitted through E-Procurement portal.
b. Bids sent by any other mode like in person, post, Telex or Fax or E-mail will be
rejected.
14.
Rate Tender Bank Guarantee
The Bank Guarantee for Rs.3,00,000/- (Rupees Three Lakhs) only for each unit is to
be submitted by successful tenderers before entering into agreement.
15.
Salient features of AGREEMENT CONDITIONS for successful Rate Tenderers.
Agreement Conditions are enclosed as Annexure-III
16. Agreement
Successful “Rate Tenderer/s” shall be notified after due process and intimated. After
the intimation, the successful “Rate Tenderer/s” shall execute an agreement, with the
PCCF within 3 days (Three days) from the date of the intimation letter, on a stamp
paper of Rs.200/- to be Purchased by the successful “Rate Tenderer/s”. In the event
of failure on the part of the successful “Rate Tenderer/s” to sign the agreement, the
EMD shall be forfeited and such Tenderer/s will be black listed and declared not
eligible to participate in the Departments’ poly bag/sheet/woven sack supply process
for the next three Financial years.
17. In the event of any of the above-indicated days happening to be declared as
Holidays by the Government, the process shall automatically get shifted to the
next working day.

18.
Supply, Time schedule & Bank Guarantee :
The successful “Rate Tenderer/s” shall ensure that the supplies strictly be made
within a time period of fifteen days from the date of receiving the indent from the
concerned Deputy Conservator of Forests. The Bank Guarantee of
Rs. 3,00,000/-
(Rupees Three lakhs only) which will be in the form of irrevocable Bank Guarantee in
the name of Principal Chief Conservator of Forests and its validity will be upto
30-04-2015, as a surety to adhere to the above mentioned quality and punctuality
of supply of the materials. In the event of any short listed supplier failing to adhere
to this quality and timely supply of the products, his/her Bank Guarantee shall be
forfeited and the supplier black listed against participating in the Forest Department’s
poly bag/sheet/woven sacks supply process for the next three financial years.
Supplier has to submit manufacturers Test Report at the time of supply of material to
the concerned DCF and the material has to be of approved specifications as per this
notification.
If the indenting Deputy Conservator of Forests finds that any of the
material supplied is of sub-standard quality he shall reserve the right to reject the
whole or part of the consignment/material, within 15 days from the date of receiving
the delivery of the supplies and ask the supplier to replace the consignment with that
of the specified quality, within 10 days failing which the contract of concerned
supplier will be automatically cancelled. He will be levied 2% fine on bill amount and
the material will be purchased from the other supplier of the approved panel.
19. The
Karnataka Forest Department shall not stand guarantee to any of the
financial
institutions/Banks,
raw
material
supply
agencies,
power
supply
authorities, pollution control board agencies, municipalities etc. for any of their
transactions / dealings. It is the responsibility of the successful Rate Tenderer to
obtain clearances to the satisfaction of the concerned organizations. Any
disruption, arising in the poly bag/sheet & woven sack supplies, on account of
any of the above violations, the manufacturing industry cannot advance it as a
reason for not meeting the supply schedule.
20. The
orders of supply indented from any of the Deputy Conservators of Forests
shall not constitute authorization by the Karnataka Forest Department to the
manufacturing industries to enter into any financial or other commitments with
any public or private institutions. All such transactions are purely at the sole risk
of the concerned manufacturing industries only.

21. The
Bank
Guarantee
of
such
of
the
successful
Rate
Tendered
Manufacturer/Industry that has satisfactorily supplied the indented consignments
will be discharged by the end of 30-04-2015.
22. Bill Payment:
The indenting Deputy Conservator of Forests will take action to settle the bills on
receipt of the supplies. The suppliers should deliver the goods to the Head quarters
of the concerned Division directly. After receipt of the supplies, the Officer authorized
by the concerned Deputy Conservator of Forests would check the quality of the
supplies through Drop test and Gauge test as per the method prescribed and would
certify that the quality of the supplied materials are of approved quality. If the
materials are found to be of approved quality he should submit a report to the
concerned DCFs about the quality of the supplies. In the event of the material
supplied being found to be sub-standard, the DCF or ACF should reject the entire
consignment within 15 days from the date of receiving the delivery of the supplies
and ask the supplier to replace the consignment with that of the specified quality
within 10 days failing which action will be taken against the suppliers as mentioned in
condition No.18. After receipt of the report from the t Officer, the indenting Deputy
Conservator of Forests should take action to release 90% of the bill amount if the
supplies are certified as approved quality within 60 days from the date of the receipt
of supplies subject to release of budget from the Government. The Concerned Head
Quarters Range Forest Officer / Officers should keep some samples (approximately ½
kg) of the PBs of different size upto 6 months (with code). During the course, if the
supplied materials are found to be sub-standard, he should intimate the concerned
Deputy Conservator of Forests. The Deputy Conservator of Forests should forfeit the
balance 10% of the bill amount and cancel the agreement made with the concerned
supplier. In the event, if the supplier opposes/litigates the action of the Deputy
Conservator of Forests, the samples of the concerned consignment may be sent to
CIPET, Mysore for detailed examination of the quality of the PBs. The opinion given
by the CIPET, Mysore shall be final. The charges of by the CIPET, Mysore for quality
check shall be born by the concerned supplier.
23. The
EMD of Rs.25,000-00 paid by the supplier which would be considered as
security Deposit will be released to the supplier after 6 months of the completion
of agreement period.
24.
The Security Deposit of Rs.3,00,000-00
deposited and furnished as Bank
Guarantee by the supplier will be released to the supplier after 6 months of the

completion of agreement period subject to fulfillment of tender conditions by the
supplier.
25.
In case manufacturers belonging to other States participate in the Tender, price
preference of 15% will be allowed to the goods manufacturing units located
within Karnataka as per Government Order No.C1 233 SPL 2008 dated:
28.02.2009.
26. This tender notification is subject to the Government Orders and directions of the
Government of Karnataka issued from the time to time.
27. Appeals:
All appeals connected to the successful Rate Tender, Bank Guarantee and Rate
Tendering process shall lie with the PCCF (HOFF), For any disputes, arising after the
supplies or connected to supply indents, appeals shall lie with the concerned
jurisdictional Chief Conservator of Forests of the Circle in which the said Forest
Division lies.
