In this context, he referred to the various measures which are being taken by the Shrine Board for solid and waste water management in a scientific manner. He informed that a number of reputed expert agencies in the country have been approached by the Shrine Board for putting in place most effective approaches and technologies for finding solutions to the solid waste management, particularly mule dung generated on the track.He added that the Shrine Board is also promoting in a big way the use of biodegradable materials for prasad pouches and for other packing material besides taking several other measures for effective solid waste management. He added that the Shrine Board has constructed a chain of Sewage Treatment Plants at various locations on the track, in the Shrine area and at its different establishments. He emphasised the need for putting in coordinated and concerted efforts by all the stakeholders for addressing the issue of solid waste management and other related matters in Katra town and the area around to secure the desired results expeditiously. Haji Shamsheer Ali Bokan, the state president of the Forum while addressing a large gathering here stated that Public Service Commission is openly suppressing and ignoring over tribe. He added that in a number of select lists of PSC for various jobs, the Gujjar Bakerwal candidates have been largely sidelined and ignored. He said that Gujjars and Bakerwal Communities constitute 80 percent of the total ST population and in each select list under this category the PSC has largely given preferences to candidates, other tribes which is unfair and unjust. He said out of total 55 candidate selected by PSC under ST category for different jobs only 09 belongs to Gujjars and Bakerwals, hence the 80 percent population of Gujjar Bakerwal under ST getting less than 20% share in the category while 20 percent population in the category have been given 80% share in the job which is against the set system of justice. He said the PSC was constituted by the Government to maintain a fair balance between various tribes, castes, communities and Universities but it fails to protect the rights of their communities. Ch Hasham Din Dhakar Vice President of the forum said that this is a matter of great injustice that out of total 10% reservation for STs the Gujjar Bakerwals who are a major group are getting less than 2% which a matter of great concern. He appealed the commission to draw a balance between various tribes and communities while selecting candidates under marginalised groups. He said that Gujjars who are mainly nomads could not compete with affluent tribes of Ladakh who have been enrolled outside state and getting education from main universities of India but PSC has to maintain a balance and equality among different groups under ST. All know that PDP is the creation of LAL Krishan Advani and Atal Behari Vajpayee in 1999 repeatedly against cash payment of Rs 24.00 crores just to challenge National Conference and attempt its downfall as attempts in the past to do so in 1953, 1977, 1984 and 1990 had failed to achieve. GOF Staff Reporter Expressing grave concern over the prevailing deteriorating conditions in Kashmir valley, the Dogra Sadar Sabha observed that there is no Government and law enforcing authorities visible anywhere in Jammu and Kashmir especially in Kashmir valley which has given agony and pain to the right thinking citizens. Under such circumstances and with a view to provide better environment, peace, harmony and healing touch to the people, the Sabha demanded immediate imposition of Governor Rule in the State. The Sabha which represents holistic socio and cultural heritage of Jammu region since its inception for more than a century, in its executive body meeting discussed in detail about the socio political scenario and expressed its views in order to maintain peace and tranquility in its far flung and hilly districts including Rajouri and Poonch. Reiterating its resolves to preserve and maintain the pristine heritage “Mubarak Mandi Complex”, Jammu, which is presently suffering destruction due to ongoing rainy season, the Sabha unanimously decided to stress upon the Government for its proper care and protection. Separatists thrive not only on turmoil in Kashmir but also on deaths Jammu, August 17: Separatists, both moderates and hardliners, do not thrive only on turmoil in Kashmir but now they have started thriving on bloodshed of people. This is indicated by their repeated calls for shutdown during which clashes do occur between the protesters and the security forces. Now these separatists, both moderates and hard liners, have given a call to people to organize a 72-hour march to the UN headquarters. Once they start their march will be placed under restrictions and barricades and barriers were to be set up by the police which the protesters may try to break. This would result in severe clashes between the security forces, trying to enforce restrictions and the protesters keen to start the march. Again many civilians would be killed and this would not spare security personnel. And if ten people have been killed in last three days six security personnel including the CRPF commandant were killed. And separatists count their success on the number of deaths per day. Since each death ignites anger among the people separatists believe that enraged people could measure muscles with the security forces. Experts believe that even the use of pepper guns, chilli grenades and sound cannons may not end the violence in Kashmir. Yes their use can simply reduce the rate of killing and the separatists want more blood to get spilled on the roads which would give them a chance to rake up the Kashmir issue. In this connection Chief Minister, Mehbooba Mufti should invite these separatists for talks and suggest to them to stop giving calls for hartals and marches which may be the only way to end violence, turmoil and killings. But at the same time he regretted that the resentment which people of Jammu Province has because of unequal treatment meted out to them in respect of allotment of funds and also allotment of Parliamentary and Assembly constituencies.” The Chief Minister ought to have admitted this error committed by previous governments and her government also. Further she ought to have made an announcement that now her government would rectify all this. Will she do it before it is too late? Whatever partially good speeches are made on such auspicious occasions, should not remain confined to speeches only but it would be transformed into action. Not only at state level but also at the Central level, speeches of politicians must be followed by honest practical work. The “Swachh Bharat Mission” launched by Prime Minister, Narendra Modi ji is highly appreciable but still there is no check on corruption in the construction of toilets etc. Rao said that unless the Parliament, Assembly and Bureaucracy are cleaned of dirty, corrupt & criminal elements and unless commission based corruption at high level is cleared, this external or physical cleanliness is not going to yield much fruit. The internal cleanliness of the mind & the soul is much more important than the external one. What Rajiv Gandhi lamented some 30 years back is still in vogue. He had candidly stated that only 15% of developmental funds get utilized on ground whereas 85% goes into private pockets. This is all due to unchecked political corruption. Education of children suffers due to frequent calls of bandh by the separatists. As curfew continues the students in Kashmir are not attending schools, the new concept of 'Curfew schools' has emerged in the valley. A number of college-going students, government teachers and retired personnel have come together so as to teach the needful to the students. Education of children should be the main concern as rioters often attack schools which are found open. The idea of curfew schools in the valley is being practiced in community centres, houses and even in courtyards across the state. These schools are scattered across various centres in the valley. Those depriving innocent children of thie right to education are the enemies of humanity. We all need to stand united against them reject their calls for shutdowns. As the students were unable to attend school since July 1, the educated youth took the responsibility to teach the kids. A number of schools are running in Srinagar, including Khanyar community hall in Kow Mohalla, Imambara in Hassanabad, and a mosque in Bemina. It is not that all the youth are pelting stones in street but educated youth are working for the welfare of society. Security forces also cooperated and allow free movement of children who carry school bags with them. As many as 300 students study at Khanyar community hall, where the classes are divided into groups and four shifts, including morning, noon, afternoon and evening, as per grades. In Baramulla region, a residential school is running in Khawjabagh, where as many as 93 students are receiving education. In Anantnag, a courtyard residential school is running, around 70 students from Nursery to class 10 are taking the classes. We should salute these teacher who are doing a noble job despite threat from separatists and terrorists. The so called fight for Azadi has ruined the careers of children in Kashmir and parents have no choice except sending their children to other parts of country for education. Sympathizers of separatists plan to exploit Kashmir students who study in metros of India and try to disturb peace in the name of seminars like one happened in Bangluru. Those fomenting trouble in Kashmir are enemies of children. Violence in no way is solution to any problem, so violence must stop. An avoidable war of attrition By : sanJay Hegde Francis Bacon wrote in 1625, “Let judges also remember, that Solomon’s throne was supported by lions on both sides: let them be lions, but yet lions under the throne; being circumspect that they do not check or oppose any points of sovereignty.” Throughout history, strong rulers facing resistance from an unappreciative judiciary have resorted to all kinds of measures to bring judges to heel. Global precedents When components of his New Deal got struck down by the Supreme Court of the United States, President Franklin Delano Roosevelt threatened to increase the number of its judges from nine to 15. He reasoned that packing the court with six new judges would bring about a new majority that would side with the government. Shortly thereafter, ‘a switch in time saved the nine’. In 1937, Justice Owen Roberts switched his vote to side with the government-leaning judges, and FDR thereafter did not need to pursue court packing. In Pakistan the Army got used to tame judges when Chief Justice Muhammad Munir invented the Doctrine of Necessity to legitimise General Ghulam Governor Muhammad’s dismissal of the Prime Chief Justice T.S. Thakur’s public complaints over executive delay in clearing judicial appointments must be seen not as plaintive cries, but an admonition to the government to respect constitutional redlines Minister. Chief Minister Mehbooba Mufti made a memorable speech in the Bakshi Stadium urging Kashmiris to covet the azadi they already have. Prime Minister Narendra Modi in his 95-minute long speech failed to reach out to the Kashmiris. Instead, he raised from the ramparts of the Red Fort, the disquiet and human rights violations in Balochistan, Pakistan-occupied Kashmir and Gilgit Baltistan. No Prime Minister has sought a moral equaliser of Kashmir in Pakistan. Modi’s unwillingness to apply the healing touch from the Red Fort is part of the strategy of not acting under pressure. Union Home Minister Rajnath Singh has, on the advice of agencies, decided to wait it out till fatigue sets in and a lid can be put on the protests, no matter what the cost. A tactical breather is being sought by shifting the focus from the uprising in Kashmir to the human rights violations in Balochistan, PoK and Gilgit Baltistan. While providing political, diplomatic and moral support to the oppressed in these regions is not going to be easy due to lack of contiguity, no infrastructure and doubtful political will, still it is an exercise worth attempting. What is more vital is raising the cost for Islamabad for its cross border terrorism. Voices are being raised in Pakistan by retired diplomats including former Foreign Secretary Najmuddin Shaikh who are advocating that Pakistan prevent the use of its soil for hostile activities against its neighbours. Afghanistan, Bangladesh, India and Iran are periodically accusing Pakistan for exporting terrorism. Despite being ‘frenemy’ country, Pakistan has its sympathisers in the US intellectual community most notably nuclear experts George Perkovich and Toby Dalton who had recommended incentives for Pakistan to go slow on its nuclear weapons programme. Now the two Prachanda 08 vs Prachanda 16 By : Hari BansH JHa Political instability has become the order of the day in Nepal. On an average, no Government in the country lasts for more than a ysear. On August 4, Maoist leader Pushpa Kamal Dahal, popularly known as Prachanda, became the Prime Minister of Nepal, after the fall of the nine-month old Government of KP Sharma Oli on July 24. The overwhelming majority of the population in Nepal is satisfied with the change in Government. Expectations are high that Prachanda will deliver on all those fronts where Oli failed addressing Madhesi issues, war-era criminal cases against Maoist fighters, implementation of the new Constitution, rehabilitation of earthquake victims, and maintaining a balance in foreign relations vis-à-vis India and China. Only time will show if Prachanda is able to meet these challenges and that too within the fixed time frame of nine months, after which he will have to transfer power to Sher Bahadur Deuba of the Nepali Congress, as per the seven point agreement between the Communist Party of Nepal-Maoist Centre (CPN-MC) and the Nepali Congress. If Prachanda performs well as Prime Minister, it is likely that the CPN-MC under his leadership will regain its image. During the Constituent Assembly elec- tion of 2008, the party had emerged as Nepal’s largest political force but it substantially lost its image and was pushed to the third spot in the Constituent Assembly election of 2013. His failure, on the other hand, will not only weaken his party, but might also invite further political instability in the country. Notably, Prachanda’s performance during his nine month tenure as Prime Minister in 2008-2009 was far from satisfactory. He annoyed India by undertaking his first foreign trip to China in 2008. By tradition, a Nepalese Prime Minister always visits India before going to any another country in view of the special relationship that exists between India and Nepal. Prachanda also incurred the wrath of the Nepalese people when he made an unsuccessful attempt to sack Army chief Rookmangud Katawal and replace him with who shared his own communist ideology. It was only at the intervention of President Ram Baran Yadav that Prachanda’s move to remove Katawal was foiled. Also, Prachanda visited China at a time when in Nepal hundreds were were dying in the Koshi floods and thousands were struggling for their life. He had no time to address the problems of those who needed immediate relief from the Government. As if this was not enough, Prachanda even allowed Maoist cadets to become priests of the Lord Pashupatinath Temple in Kathmandu for some time. This was against the Hindu tradition of assigning this job to particular castes of Bhatt Brahmins from south India. Significantly enough, Dahal made several attempts to bring Nepal closer to the Chinese axis in 2008-2009. He strongly advocated in favour of the extension of Chinese railways deep into the Nepalese territory, right up to Lumbini, the birthplace of Lord Buddha, which lies at a stone’s throw from the Nepal-India border. He knew well that this could jeopardise India’s security interests. Chinese penetration in Nepalese affairs multiplied during his tenure be it in the Army, the armed police force, the police and other administrative services. Prachanda vocally opposed India and raised contentious issues such as Kalapani and Susta. Later in 2012, he made a deal with the China-backed Asia Pacific Exchange Cooperation Foundation to bring three billion dollars for the development of Lumbini. This caused great embarrassment of India. However, before becoming Prime Minister this time, Prachanda publicly acknowledged that he had made some mistakes while in power in 2008-2009 because he lacked experience of governance that time. He also made a promise that he would do all within his means to address the crucial challenges faced by the country, both on domestic and foreign fronts. Accordingly, he entered into three- point agreements with the Madhes-based parties before becoming Prime Minister, promising to address their grievances. Soon after becoming Prime Minister, Prachanda also declared those killed during the Madhesi agitation to be ‘martyrs’. His Government has made arrangements to pay each of the martyrs’ family one million rupees. He is paying for the medical expenses of those who were injured during the movement and has withdrawn cases against Madhesi activists detained on false charges. These gestures are welcome. Yet, Prachanda’s real test will lie in addressing the main demands of the Madhesi agitators such as re-drawing of provincial boundaries, the determination of parliamentary, provincial and local electoral constituencies on population basis, proportional representation of Madhesis and other excluded groups in the state mechanism, and correction of mistakes made in the new Constitution’s citizenship clauses. However, given the mindset of the ruling elite group of Bahun-Chhetris that represent only 28 per cent of Nepal’s total population, it is unlikely that they would like to share power with the overwhelming majority of disadvantaged groups such as the Madhesis, Tharus, Dalits and hill Janajati who form nearly 72 per cent of Nepal’s population. Even the Maoist party suffers from this mindset. THE BEIJING BALANCING ACT By : sHyam saran Chinese Foreign Minister Wang Yi’s August 11-13 visit to India was closely watched for clues on the current state of India-China relations and the outlook going forward. There are two forthcoming multilateral summits, the G-20 summit hosted by China in September and the BRICS summit hosted by India in November. Neither country would like the summit it is hosting to be overshadowed by bilateral differences. Therefore, at the very least, both need to downplay their differences and seek to create a positive ambience for the forthcoming summits in whose success each has a stake as host country. Mr. Wang’s visit does appear to have achieved that. Putting mechanisms in place . On the vexed issue of China’s opposition to India’s membership of the Nuclear Suppliers Group (NSG), it was agreed that a focussed dialogue take place between the Indian Joint Secretary dealing with disarmament and international security and China’s Director-General of Arms Control and Disarmament. On other issues having a bearing on bilateral relations, another mechanism has been established between the Indian Foreign Secretary and his Chinese counterpart, Vice Foreign Minister Zhang Yesui. This appears to be in addition to the existing annual Strategic Dialogue at the Foreign Secretary level and the regular Special Representatives dialogue which, in the past, has gone beyond the mandate of border negotiations. One presumes that the issue of China’s “technical hold” on the listing of Masood Azhar, the Jaish-e-Mohammad leader, as a terrorist at the United Nations, and Chinese activities in Pakistan-occupied Kashmir (PoK) under its One Belt, One Road (OBOR) initiative will be on its agenda. It is unlikely that China will materially change its stand on these outstanding issues but the proposed dialogue creates a more propitious ambience for the forthcoming summits. Since these dialogue mechanisms are engaged with these contentious issues, the leaders themselves need not have to deal with them beyond generalities. At least that would be the Chinese expectation. For the Chinese, summit meetings are expected to be orchestrated encounters where leaders avoid unpleasant exchanges and project all that is positive in the relationship. One has learnt from Chinese friends that both at Ufa last year and Tashkent this June, Chinese President Xi Jinping was unprepared for the blunt talking and persistent airing of differences by Prime Minister Narendra Modi. Mr. Wang would have wanted to ensure that forthcoming leadership meetings do not cause discomfort to his boss. China is faced with a complex and deteriorating political and security situation in its Asia-Pacific periphery. The categorical and entirely negative arbitration award against China over its claim to the South China Sea handed in July by a tribunal constituted under the provisions of the UN Convention on the Law of the Sea (UNCLOS) is a major setback for Beijing. Its relations with ASEAN (Association of Southeast Asian Nations) are now under unprecedented strain. To add to its woes, the deployment of the THAAD antimissile defence system by the U.S. in South Korea has led to a worsening of relations with a neighbour with which China has, over The Beijing on Page 7 Constitution. The court’s rulings on property rights led to several constitutional amendments. But, all told, the initial decades showed a healthy institutional respect, with the legislature and judiciary working in tandem. Indira Gandhi was a different matter. Her relationship with the judiciary was fraught with confrontation and conflict. It did not help that she saw some judges, such as Justice K.S. Hegde, as owing allegiance to the Congress (O) which opposed her. The Supreme Court’s judgments striking down the nationalisation of banks and the abolition of privy purses made it look like an “arena for constitutional quibbling for men with long purses”. Cabinet led by Mohan ministers Kumaramangalam called for a “committed judiciary” which was deferential to the socialistic temper of the times. When the Supreme Court’s 11-judge ruling in the Golaknath case put property rights on a fundamentally unbreachable pedestal, she promoted to the Supreme Court, judges who publicly vowed to undo the judgment. Things came to a head in 1973 in the Kesavananda Bharati case. All 13 judges of the court sat for months on end to reconsider Golaknath. For India to blame Pakistan for all the ills in Kashmir will be patently wrong, though it is time for New Delhi to declare cross border/LoC infiltration as acts of war and take the fight to PoK, which in any case is India’s own territory, as an act of legitimate self defence. The parliamentary resolution on J&K on August 3 was anodyne and must be linked to the one unanimously passed on February 22, 1994. Dr Karan Singh is right: While J&K is an integral part of India, as nearly half of the original J&K is in adverse and illegal possession of Pakistan, J&K is not an internal matter. Besides proactively reclaiming and obtaining vacation of Pakistan-occupied Kashmir including Gilgit and Baltistan, the Government in Srinagar should reserve appropriate number of seats in the State Assembly for PoK and Gilgit Baltistan areas. The Centre should also similarly reserve seats in the upper and lower houses of Parliament. The essence of ‘reform, perform and transform’ that the Prime Minister so passionately articulated was, to them, yet another oratory trick that did little to enthuse this group of perennial skeptics. To this writer, the intense and at times inexplicable reaction of this group can be traced to three major factors. First, we are a generation enamored by the status quo. Our growingup was anchored in believing the given compliance to social norms was often rewarded, deviation frowned upon. We were conformists to the core. A reflection of this was the kind of professions that the majority of us got into. We became bureaucrats, academics, managers, NGO workers, journalists all old school vocations. When Modi disturbs the status quo through his words and deeds, and dares to dismantle the old and the irrelevant, we squirm and moan. Two, we are also a generation whose political upbringing has been conditioned by identity politics. We grew up in an atmosphere of intense animosity that was triggered by the implementation of Mandal Commission recommendations by VP Singh. Government jobs, much like politics, were the preserve of the upper caste. The Mandal Commission threatened to tilt that balance. For the upper castes which dominated the elite universities of Delhi and elsewhere in the 1990s, this came as a jolt. The status quo was massively challenged and so was the hegemony of the elite. We grew up to be sceptics, and all those who failed the civil service examinations, blamed it on this factor. That culture of ascribed superiority continues to guide our sub-conscience. When a low-caste Modi, who does not conform to our framework of the elite political class, attracts astounding glory, it doesn't comfort us either. We, including this writer, admired Rajiv Gandhi and drool over Rahul Gandhi; we idolise kings and aristocrats of the Congress. Modi doesn't fit into our notion of the political class, and when he speaks to us from the Red Fort, we fret and frown. Third, we have been conditioned to celebrate quiet Prime Ministers. With the exception of Atal Bihari Vajpayee, most of the Prime Ministers of our times Chandra Shekhar, PV Narasimha Rao, Deve Gowda, IK Gujral, and Manmohan Singh have not been good communicators. We are wary of outspoken leaders and the influential minority of Delhi has often exhibited enormous disdain for the likes of outspoken mass leaders like Lalu Prasad and Mayawati. It is little surprise then that when Modi speaks, and makes a whole lot of sense, it tampers with the legacy of the silent Prime Minister that the status quoists so adore. To these sceptics who accuse Modi of just spewing rhetoric and thrive on criticising him, this writer would like to present a few facts from the Prime Minister's Independence Day speech, and pose a few questions. Modi said that cooking gas cylinders were made available to 60 crore people in the last 60 years whereas 14 crore have got it in the last 60 months. Is this not good? Modi said, it took 70 years for a village in Uttar Pradesh, which is three hours from Delhi, to get electricity. Is this a fairytale? LED bulbs which cost Rs 250 are now available at Rs 50 is it not worth a pause, forget praise? When Modi says he has implemented the long-pending demand of One Rank One Pension, is he not stating a fact? Should the increase of pension to freedom fighters by 20 per cent be condemned? Is the clearing of arrears to Uttar Pradesh’s sugarcane farmers a bad thing? About 10,000 villages, out of the 18,000 unelectrified lot, now have power is this good news or bad? Will doing away with job interviews, which perpetuated corruption, of over 9000 Group C & D jobs adversely affect our society? That the thrust to solar power and rural roads construction has intensified in last two years is a fact. Should it not be celebrated? HAM (Secular) national spokesman Danish Rizwan, however, said that Singh was not the district unit chief of the party and the process to elect new president was currently on. The other policemen rushed to his quarters soon after hearing the firing sound and found Reddy dead.The body was later shifted to a hospital at Gajwel. The deceased's family members alleged that he committed suicide due to harassment by senior officers. They also claimed that the deceased had written a suicide note in which he mentioned the reasons for taking the extreme step. However, police remained tight-lipped about any suicide note found at the spot. Medak district Superintendent of Police Chandrashekar Reddy visited Gajwel hospital. The government won its basic case, but on a small majority of seven judges against six, it lost the larger argument of unbridled power. The day after the judgment, three of the seven judges in the majority (including Justice Hegde) were superseded for the office of Chief Justice. The fourth in seniority, Justice A.N. Ray, was appointed Chief Justice, leading to the resignation of the three superseded judges. C.K. Daphtary, India’s first Solicitor General, quipped, “The boy who wrote the best essay won the first prize.” These events cast their shadow on the declaration of Emergency in 1975, shortly after the Allahabad High Court invalidated Ms. Gandhi’s 1971 election to the Lok Sabha. While her appeal was pending in the Supreme Court, Ms. Gandhi retrospectively amended the Constitution to immunise her election from legal attack. That attempt was invalidated by the court, which nevertheless upheld her election on other grounds. In those tumultuous times, the Supreme Court’s darkest moment was when by a four-one majority, it upheld the government’s contention that a citizen’s right to life could be suspended during an emergency. The lone dissenter, Justice H.R. Khanna, was thereafter soon superseded for the office of Chief Justice, and he too resigned from the court. The Emergency also saw inconvenient high court judges being transferred to faraway courts. Other less documented measures to render judges docile were also used. The judicial pushback The lifting of the Emergency and the election of a non-Congress government saw the judiciary attempt to salvage its independence. Public Interest Litigation (PIL) became a new mantra for judicial intervention in fields of executive neglect. Soon the judiciary became an active stakeholder in governance. Despite the 1976 judgment in Sankalchand Seth, upholding the Government’s powers of transfer, the 1982 judgment in S.P. Gupta began defining the judiciary and executive’s roles in consultations on the appointment and transfer of judges. The fall of the Babri Masjid, the agitation over the Mandal report, and an era of fragile coalitions set the stage for the 1993 judgment in the first Supreme Court Advocates-onRecord case. The court ensured that the judges would have the dominant voice in judicial appointments and administration. A collegium consisting of the Chief Justice and senior judges would have the last word on appointments and transfers. Subsequent judgments built on the structure and strengthened the collegium system. Internally, the government and the judiciary worked out a memorandum of procedure, which regulated the process of appointments and transfers. For two decades, ruling coalitions chafed at judges anointing newer judges as their successors. In the meanwhile, PILs and election disputes ensured that politicians remained ever wary of the courts. Executive reassertion The 2014 general election, which threw up a stable single-party majority, saw the political class strike back. One of the first acts of the Narendra Modi government was to shaft the collegiumcleared nomination of Gopal Subramanium to the Supreme Court. Mr. Subramanium’s prosecution of Bharatiya Janata Party leader Amit Shah and his appearance as the United Progressive Alliance’s Solicitor General in several matters arising out of the Gujarat riots of 2002 rendered him unpalatable to the new rulers. A constitutional amendment, backed by the Opposition, including the Congress, next followed. It sought to take away the power of appointments and transfers from the collegium and vest it in a new body called National Judicial Appointments Commission (NJAC), where judges would be represented but would not have a dominant say. A constitutional challenge to the amendment was entertained by the Supreme Court. Pending the hearings, the then Chief Justice, H.L. Dattu, announced that he felt inhibited from participating in meetings about the independent members to be appointed to the NJAC. Resultantly, no substantive appointments came to be made through 2015, and many additional unconfirmed judges had to be continued in office by virtue of judicial orders of extension. The constitutional amendment was struck down in 2015 by the Supreme Court as violative of judicial independence, which is part of the Constitution’s basic structure. The court’s institutional memory, of the Emergency and its aftermath, played a significant role in the decision. A subsequent order also directed the government to finalise a new memorandum of procedure in order to regulate fresh appointments. After the first judgment, the unconfirmed judges were confirmed in their posts. Appointments were recommended and processed in many cases, including some appointments to the Supreme Court. However, the drafting of the memorandum of procedure is as yet not finalised. The government has sought to retain powers to veto candidates recommended by the collegium on grounds of “public interest” or “national security”. The judiciary led by the collegium has refused to let in a Trojan horse into its citadel of independence. Over 75 appointments to the high courts and some transfers appear to be stuck in the process for over eight months. In a country with around 1,200 judges in the constitutional courts, and nearly 400 vacancies at that level, this is an unacceptable position. Judges retire regularly, and if no fresh appointments are made, it is possible to bring the system to a complete halt. In this situation, one cannot fault Chief Justice T.S. Thakur who, in April this year, got emotional in the Prime Minister’s presence at a conference of judges. This week, in his Independence Day speech at the Supreme Court, he has again lamented the government’s lack of alacrity in the matter of appointments. A government which wants to be seen as dedicated to the rule of law can ill-afford a war of attrition. The Chief Justice’s public remonstrances must not be seen as the plaintive cries of the least dangerous branch of government. They must instead be received as an admonition on Rajdharma from the Bhishmapitamaha of the judiciary. An unnecessary Mahabharata must be avoided by addressing institutional distrust. Caesar must render unto the judges what is theirs a constitutional assurance of independence. Winning back hearts ................................................ veiling the long-awaited political package works, and does not become one that comes too late and is too little. Besides losing human lives averaging more than one a day and Rs 120 crore daily in revenue, it is the forfeiture of trust, moral authority and governance that is more troubling. This is not a law and order problem but one of insurgency and terrorism acquiring religious overtones, threatening to transform Kashmiriyat into Islamiyat. But most of all, it is a political problem as well as of development. The responses to the political, economic and human rights issues are available in many reports prepared by interlocutors in the past. Addressing the internal dimension entailing an intraKashmir dialogue followed by a Centre-State interaction to re-affirm the contours of self rule is both urgent and complex. A fulltime Union Minister in charge of Jammu & Kashmir is necessary, as was the case in the past when George Fernandes was appointed Minister for Kashmir Affairs. The parameters of the external peace process need to be reinstated also. Given the new low in India-Pakistan relations, resuming the dialogue process is the big challenge. Most Pakistanis including Prime Minister Nawaz Sharif agree that the four-point formula evolved during backchannel talks a decade ago under the watch of Prime Minister Manmohan Singh and President Pervez Musharraf can be made acceptable if the Pakistan military is on board. No one has come up with any other model than the Musharraf formula that can be the basis of resuming talks on J&K. If nothing else, at least an interim solution can be hammered out based on the Northern Ireland model. De-escalation of the ongoing protest campaign the priority for now which is essentially faceless and devoid of leaders is a sticky starting point. No one knows where to start. This should not be delayed any further as it will damage the counter-insurgency grid painstakingly established in the valley as Army is mostly confined to the barracks. Terrorists are taking advantage of this by fanning the protests and opening infiltration routes. CM Mufti should utilise her intellectuals for her outreach to youths and parents. The CRPF and police require specialised training and kits for crowd control with minimum or no use of pellet guns till an alternative deterrent is found. This is the last chance to win back the confidence and trust of Kashmiris in the valley and recover the lost plot. There is a limit to how often security forces can pull the political chestnuts out of the fire. the years, assiduously nurtured close political, economic, commercial and even cultural relations. (Korean pop music is extremely popular in China.) These are new and adverse developments even while the U.S. and Japan continue to be perceived as major security threats to China in the region. Against this background, China would want to keep its western periphery with India relatively stable and benign. It is for this reason that Chinese official media has persisted with the message that there is no fundamental clash of interests between the two countries and that their convergences outnumber their differences. There is anxiety that India may move closer to the U.S. and participate in security arrangements more directly challenging China in the South China Sea. Beijing has cautioned that India should avoid getting “entangled” in the South China Sea issue, but there is also an expectation that it will continue to adhere to its stated policy of strategic autonomy. In fact, India’s reaction to the tribunal award has been measured, calling for utmost respect for the UNCLOS but also stressing the need for resolving differences through peaceful dialogue. It is reported that Mr. Wang did not raise the South China Sea issue in Delhi. This appears to confirm the view that China’s current preoccupation is to prevent India from escalating its stand on this issue. China expects that at the forthcoming G-20 summit at Hangzhou, the U.S. and its western allies and Japan may raise the South China Sea issue and embarrass the host country. India’s role could prove to be significant in this regard. That gives India a tactical advantage and this may well have been the reason for Mr. Wang to appear forthcoming on issues India is concerned about. I doubt whether China will change its substantive stance on these issues any time soon. New Delhi’s reality check In dealing with China, India has to be conscious of the fact that in terms of both economic and military capabilities, the asymmetry between the two countries continues to expand. China’s economy is five times as large as India’s and even with slower rates of growth China will be adding more muscle from a larger base while India will have to grow much faster over a longer period of time to begin to narrow the gap. There are only two ways to deal with this power asymmetry; one is to acquire and deploy capabilities which will make any aggressive military move by China a risky proposition. The other is to enmesh oneself more tightly in the U.S.-led countervailing coalition targeting China. The latter does run counter to India’s view of itself as an independent power but there is a steady creep in that direction. In terms of developing asymmetrical capabilities, my sense is that we are not quite there and remain vulnerable. This vulnerability increases if there is a coordinated move by China and Pakistan. In previous India-Pakistan wars, post-1962, China supported Pakistan politically and with supplies but refrained from attacking India across the border. This reassuring pattern of behaviour needs to be under our constant review and assessment. China’s willingness to stand alone in blocking India’s membership of the NSG on behalf of Pakistan, and in shielding it from international pressures consequent upon its use of cross-border terrorism as an instrument of state policy against India, point to an enhanced strategic role for Pakistan in Chinese regional and global calculations. Pakistan has so far been important to China as a low-cost and effective proxy against India. It is now becoming important for China’s ambitious OBOR project, which is long term in nature. It is also assuming importance in China’s Central Asian strategy. No surprise therefore that China is reported to be encouraging the Pakistan Army to take charge of implementing the China-Pakistan Economic Corridor (CPEC) since the civilian government of Nawaz Sharif is said to be too slow on delivery. With Mr. Modi now explicitly committed to the return of PoK including Gilgit and Baltistan to India, how would the Chinese react? Without Pakistani control over this disputed territory there would be no CPEC. If India additionally encourages anti-Pakistan militants in Balochistan, this would adversely affect the utility of Gwadar port, another key link in the OBOR. China would at least be under pressure to assuage heightened anxieties in Islamabad, and this may have a negative fallout on IndiaChina relations. The setting for managing India-China relations has become more complex and risky. Over the past several years, leaders of both countries have seen it in their mutual interest to keep relations on an even keel despite their essentially adversarial nature. A careful balance has been maintained between the competitive and cooperative components of the relationship. This has just got much harder to deliver. "Thirteen persons have died so far. The deaths have been reported from different areas of five police stations of the district in the past 24 hours. One person is admitted at a Sadar hospital," Gopalganj District Magistrate Rahul Kumar told PTI. Kirtish N Patel, 54, and Nita K Patel, 53, from New Jersey pleaded guilty in November to health care fraud related to their Biosound Medical Services and Heart Solution PC. Federal prosecutors say Nita Patel received a sixand-a half years sentence on Tuesday, while Kirtish Patel was sentenced to more than eight years. They must pay more than USD 4.8 million in restitution. According to court papers, Mr Patel admitted to, from October 2008 through June 2014, fraudulently interpreting and writing diagnostic reports produced by Biosound despite having no medical license and knowing that the reports woul be used by the referring physicians to make important patient treatment decisions. Nita Patel admitted assisting her husband in forging physician signatures on the fraudulently produced reports to make them appear legitimate. Kirtish and Nita Patel also admitted falsely representing to Medicare that the neurological testing performed by Biosound was being supervised by a licensed neurologist. Federal prosecutors alleged that more than 10,000 diagnostic reports generated by Biosound between October 2008 and June 2014 were never actually reviewed or interpreted by a physician. China and a grouping of Southeast Asian nations aim to finish by the middle of 2017 a framework for a code of conduct to ease tension in the disputed South China Sea, state media said on Wednesday. Since 2010, China and the 10 members of the Association of Southeast Asian Nations (ASEAN) have been discussing a set of rules aimed at avoiding conflict among rival claimants in the busy waterway. In an apparent move to reduce its prison population to make space for thousands of people who have been arrested as part of an investigation into last month’s failed coup, Turkey issued a decree paving the way for the conditional release of some 38,000 prisoners, the Justice Minister said on Wednesday. The government decree, issued under Turkey’s three-month long state of emergency that was declared following the coup, allows the release of inmates who have two years or less to serve of their prison terms and makes convicts who have served half of their prison term eligible for parole. Some prisoners are excluded from the measurespeople convicted of murder, domestic violence, sexual abuse or terrorism and other crimes against the state. The measures would not apply for crimes committed after July 1, excluding any people later convicted of involvement in the failed July 15 coup. Justice Minister Bekir Bozdag said on his Twitter account the measure would lead to the release of some 38,000 people. He insisted it was not a pardon or an amnesty but a conditional release of prisoners. The government says the attempted coup, which led to at least 270 deaths, was carried out by followers of the movement led by Muslim cleric U.S.-based Fethullah Gulen who have infiltrated the military and other state institutions. Gulen has denied any prior knowledge or involvement in the coup but Turkey is demanding that the United States extradite him. The Turkish government declared a state of emergency and launched a massive crackdown on Gulen’s supporters in the aftermath of the coup. Some 35,000 people have been detained for questioning and more than 17,000 of them have been formally arrested to face trial, including soldiers, police, judges and journalists. Tens of thousands more people with suspected links to Gulen have been suspended or dismissed from their jobs in the judiciary, media, education, health care, military and local government. In separate decree, also issued Wednesday, the government dismissed 2,300 more officers from the police force, in addition to another 136 military officers and 196 employees from its information technology authority. Wednesday’s decrees also allow the air force to hire new pilots or take back pilots who had resigned or were discharged before the coup to replace pilots who have been arrested or dismissed for alleged participation in the coup or links to Gulen. The government crackdown has raised concerns among European nations and human rights organizations, who have urged the Turkish government to show restraint. Turkey’s 180,000-person prisons were already filled to capacity before the crackdown on Gulen’s movement, with some rights groups claiming that inmates were forced to take turns to sleep on beds. Turkey has issued several prison amnesties over the past decades to ease conditions in its prisons, but the measures proved unpopular with the public. The recruiting agencies are devising strategies for timely filling of vacancies in view of the inability of candidates to reach the designated offices due to the prevailing situation. According to officials in the Jammu and Kashmir Public Service Commission (JKPSC), the Commission has notified 277 posts of Kashmir Administrative Service (KAS) and 24 posts of Veterinary Assistant Surgeons for which last date of filling online application forms was fixed as 25 July 2016 which was later extended to 10 August 2016. Deputy Commissioners of all the districts also facilitated more than 2300 candidates for filling up online forms at respective NICs.
