Season’s Greetings Fellow Freedom Fighters, I
want to talk about the 2010 Post-Season Motorcycle Safety Rider Group Meeting, held at The Ohio
Department of Public Safety in the Motorcycle
Ohio Room, November 3, 2010. In attendance
representing the State of Ohio: Bob SecrestCoordinator Motorcycle Ohio also Meeting Chairman, Michelle May- Director ODOT, Karen CastleODPS Public Information Officer, Felice Moretti
Jim “SNAFU” Elgin
and Bob Painter-OTSO Federal Programs, Mike
Brining-OTSO LEL, Tom Hollingsworth-OTSO
Chairman of the Board
Traffic Statistics, Wendy Forbes-OTSO Driver
Training Coordinator, Michael Weinman-OTSO
Legislative Affairs, Dianna McConnaughey-OTSO
License Support. Invitees were Jim Elgin, Mike Stock,
Ken Howell, Scott Wood - ABATE of Ohio, Inc., Imre Szauter- AMA, Tom Whiteman- Stephanie’s Wings, Mike ”Beast” Stanley-COCC, Chuck Geggie-GWRA, Bill Bish-Ridin’ On Magazine, George Nitzsky-COC, Ohio.
The agenda was quite ambitious and scheduled for 2 hours, we worked on it for 3 ½ hours
and could of gone on longer. Some of the items we covered were, Recap/Review from Preseason Meeting: what were the issues? One of the issues presented at the previous meeting
by Kristy Hawthorne-ABATE of Ohio, Inc., Legislative Director was that the Digest of Ohio
Motor Vehicle Laws had no reference to Motorcycle Awareness, ODOT responded by adding
a section for Motorcycle Awareness on page 25 of the newest edition of the Digest titled,
SHARING THE ROAD WITH MOTORCYCLES, this is one example of the great working
relationship the Motorcycle Community has with the current administrators at ODOT,ODPS,
OTSO and Motorcycle Ohio, we get together twice a year, voice our concerns and State
Agencies act on them, some items we have discussed in the past were Crack Sealer, Steel
Plates, Lane Markings, Signage, Traffic Light Motorcycle Detection, the list goes on and in
every case improvements were made, this is how the System should work and in Ohio it does
Other items we discussed adding a Motorcycle Awareness segment to all Drivers Education Courses taught in Ohio and at this point Mike Stock followed by Ken Howell reported on
the Awareness Class they teach to young people during their Drivers Ed classes at some
Driving Schools in their area and how many students they have reached through the classes
and Mike Stock sent a copy of the coarse in May to Bob Secrest as a possible pilot program
that could be rolled out Statewide, also we watched some PSA Video Clips that ODOT ran
this riding season on public access television and talked about some new ones they have
planned as well as a Bill Board Add Campaign they are working on, HB 204, SB62, SB68
adding a breakdown of distractions to pin point inattention on State Crash Reports, definitions
of a Motorcycle, 3-wheeled Motorcycles, why adding a stabilizer kit to your Motorcycle turns it
into an Automobile (spring loaded 2-wheel kit for someone pulling a trailer). We were also
given the best collection of statistics ever covering a breakdown of Endorsements, Registrations, Crashes, Fatalities by County for every County in the State and the web-sites we can
go to, so we can verify the data and even refine it if we want, a most excellent meeting. A
Huge THANK YOU to all involved preparing this meeting and a JOB WELL DONE.
United We Stand,
Jim “Snafu” Elgin

Coming up on
the end of the year already, doesn’t seem like
another year has should
have slipped by already.
Thank you to all who
have volunteered, served
as officers and all who
have helped us have the
success that ABATE of
Ed “Enjoyin’ the Ride” Schetter Ohio has had this year.
Thank you for the time
you spend forwarding the
cause or working at an
event when you could be with
friends, family or partying at the events you are working. It is your
efforts that keep this organization strong and a government watchdog here in the Great State of Ohio. We have had the privilege of
quality riding in a choice state that is very motorcycle friendly (look
how many out of state plates you see here in the Buckeye State)
and I appreciate your efforts keeping it that way.
The election is over and a new Ohio legislature will be
seated in January. We will need to start our legislative efforts
again. Take the opportunity this holiday season to spend good
times with friends and family. Take a well deserved reset and recharge those batteries. We have a lot of work to do this legislative
cycle and I can’t think of a better group of people to role up my
sleeves and help fight for the freedoms we deserve than the members of ABATE of Ohio. Have a safe and happy holiday season.
(I’ve heard an ABATE membership makes a great Christmas present HO HO HO)
Enjoying the ride,
Ed Schetter
You didn’t think I’d forget the Bylaw review committee report?
The Bylaw review committee has been busy. The Constitution has been reviewed and the Bylaws are next. If you have
any suggestions, think there is a procedure we need to define in a
better way or you want to join the Bylaw Review Committee, drop

Many changes in the Organizational Manual were nothing more
than correcting spelling and grammatical errors. The Bylaw review
committee determined that these were a matter of housekeeping

Karen Bolin,
Past President of the

We, every dues paying member of ABATE, have an
office in Columbus, the Capitol City of our State. Because of
its existence, and having a full time staff, we have been able
to get the following
laws, and amendments to laws passed over the last few
years:
 A Veterans Licenses Plate Bill
 A Handicapped Licenses Plate Bill
 An Amendment to the Motorcycle Ohio Program
allowing those that complete and pass the course to
get their Motorcycle Endorsement without having to
take the OSHP on-cycle test
Also, several bills currently in the works:
 A Search & Seizure Bill for Motorcycles
 A Right of Way Violations Bill for Motorcycles
The Office needs your HELP! The office
operates approximately 240 days per year, not including
the days when it is used for the BOD Meetings or special committee meetings. Just counting the Utilities
(electric, gas, water & sewage, trash & etc.) and the Rent
it costs $50.00, a day to put the key in the door!
For your donation of $50.00 you can buy a day at
the OFFICE. Or, give it as a gift or in memory of someone.
Pick a day in 2010 and it will be put on the Office Calendar
and on the Web Page that it’s “Your Day” at the Office. It
will be there for everyone to see that you supported “Your
Office” for that day. Can’t afford the whole day? Go together with another couple or individual member or pass the

Agenda for 2010-2011
At the recent 2010 Motorcycle Riders Foundations (MRF) Meeting
of the Minds held September in Peoria Illinois, a Legislative
Strategy Session was hosted by the MRF's Legislative Committee. As has been done for the past several years, the MRF requested that it be attended by Sustaining State Motorcyclists Rights
Organizations (SSMRO) Legislative and/or Executive Officers. The
goal is to set the MRF's Federal Legislative Agenda for the coming
Meeting of the Minds "to" Meeting of the Minds cycle. Our Sustaining SMRO partners responded once again and the Legislative
Committee was extremely pleased at how aligned and clear the
direction from our SSMRO partners was. This level of alignment
will allow for a solid and focused Strategic Action plan to be developed, disseminated, and effectively employed. Additional features
of the session this year was to have the session moderated by
MRF Vice President Jay Jackson and supported by MRF President,
Kirk "Hardtail" Willard, and MRF Vice President of Government
Relations and Public Affairs, Jeff Hennie. Also instituted this year
was a one vote per organization policy and those votes were then
recorded. Shown below in the order raised by our SSMRO's is our
upcoming Federal Legislative Strategy Agenda.

10NR32 - MRF News Release - ELECTION DAY WRAP-UP FOR IMMEDIATE RELEASE
10 November 2010 Contact: Jeff Hennie, Vice President of Government Relations and
Public Affairs
ELECTION DAY WRAP-UP
It’s been one week since the 2010 federal elections, and all but 8
Congressional contests have been settled. It appears that the motorcyclists of America have fared well. Many motorcycle-friendly
legislators have been elected and re-elected to both the House and
the Senate. With record-breaking attendance at the polls, this year
truly was an historic election. We at the Motorcycle Riders Foundation (MRF) believe strongly in a working with a bipartisan Congress
that supports the interests of the people of this country. The MRF
will continue to work with both parties for the benefit of the American motorcyclist.
A couple of races of note included the defeat of House Transportation Chairman James Oberstar (D-MN), who was a friend of motorcyclists, and the return of Congressman Tim Walberg (R-MI), who
actively rides his motorcycle.
CALIFORNIA AIR RESOURCES BOARD APPARENTLY COOKS
THE BOOKS?
The California Air Resources Board (CARB) grossly miscalculated
estimated pollution levels in a scientific analysis used to toughen
the state’s clean air standards, and scientists have spent the past
few months revising the data and planning a significant weakening
of the state’s landmark pollution regulation.
Apparently the pollution levels were overestimated by 340%, according to CARB. The estimate was a key part in the creation of a
regulation adopted by CARB in 2007. It is unclear if this was an
intentional overestimation or an accidental miscalculation, but the
error mainly affects diesel fuel users with a potential trickle-down
effect for all fuel users.
NEW CALIFORNIA MOTORCYCLE EXHAUST SYSTEMS LAW
Recently Governor Schwarzenegger signed a bill (SB 435) into law
that targets aftermarket motorcycle exhaust systems. Law enforcement officers now have the ability to issue “fix it” tickets to bikes
that do not display an EPA-approved stamp, regardless of whether
the motor is running. Until this year, motorcycles were exempted
from this law.

NEW YORK RIDERS FIGHT DISCRIMINATION
In addition to the unprecedented harassment on highways
by police manning motorcycle-only checkpoints, which is the subject
of ongoing litigation by Aid to Injured Motorcyclists (A.I.M.) Attorney
Mitch Proner, Big Apple riders are now faced with elimination of legal
bike-only parking spaces.
As if it weren’t’ difficult enough for New York City motorcyclists, over the past decade bikers contend the city has turned up the
heat on regulatory and legislative fronts, leading to growing complaints of harassment and accusations of discrimination.
There are only about 37,000 motorcyclists in a city of over
8 million people so they are a tiny minority, but the motorcycle community has begun to organize and fight back with a group known as
the “New York Motorcycle & Scooter Task Force” (NYMSTF), working to ease some of these problems. Most large cities in the U.S.

has suggested that legislative efforts to combat distracted driving are
not affecting crash rates. In January, the institute found virtually no
change in crash frequency for states that had enacted bans on
handheld phone use.
Lund suggested multiple explanations, pointing to prior
studies that found many drivers are not heeding the texting ban, and
may be lowering their hands and taking their eyes off the road to text
more discreetly.
HIGH COURT RULES AGAINST SOUTH AUSTRALIA GANG LAW
Six of seven High Court judges have ruled that aspects of
anti-“bikie” laws, which prevent members of "declared" motorcycle
gangs from associating with each other, were unconstitutional as
applied in South Australia.
Under SA laws passed last year to disband outlawed motorcycle clubs, the state attorney-general can "declare" an organization to be an illegal gang if satisfied that its members associate for
serious criminal purposes and represent a risk to public safety and
order.

Motorcycle Ohio Training Class Signup Starts in February 2010
In case you or someone you know or love is considering riding a motorcycle legally in the state of Ohio, or if that person has ridden for years, but
never bothered to get a motorcycle endorsement, or if you'd just like to
take a class to find out what it's like to ride a motorcycle, here's your
chance.
The state of Ohio sponsors a program called Motorcycle Ohio, which
offers the "Basic Rider Course", a 3-day motorcycle training course, with
12 hours of on-motorcycle instruction and 4 hours of classroom instruction.
Passing this course gets you a waiver from having to pass the state's oncycle test, which some say is quite difficult on "large" motorcycles.
The course costs $25 and signups begin in February. Classes fill very
quickly as this course is extremely popular and inexpensive.
Go to www.motorcycle.ohio.gov for more information. Click on "Basic
Rider" to register or find out more on the basic rider course.
The experienced rider course (ERC) is also available and is a fun oneday on-cycle course for riders endorsed for a minimum of one year.
The Advanced Rider course - Sport bike techniques (ARC-ST) is a
challenging one-day course aimed at improving riding skill by utilizing
some tactics common in riding sport bikes, but is not limited to sport bike
riders. I took the course last summer and had a blast, and learned a
surprising amount in such a short time.

event and personally, I learned quite a bit.
Get younger riders involved, end the bickering, and don’t waste time and
energy on personal issues and attitudes. Focus on what’s important to us, and
spend 95 percent of our legislative effort on 5 percent of the issues that matter
to us so we can accomplish more.
Membership: what can be done to improve that? Auto renewals with
credit cards, keep members informed on all issues possible and
have activities to keep membership participation high.
Keep expenses under control by saving as much on everything as we
can and show that to the members.

U.S. DOT Senate bill 1938, distracted driving: the MRF does not support
as currently written. It needs to include all distractions, not just

We need to be united more than ever before. Stop the infighting and

Anyone can lobby their elected officials.
I was asked about helmet use and I said “The day they legislate and mandate
non-helmet use, we will fight that too”. See, freedom of choice can go both
ways.
Does some of this sound familiar I bet it does. And then some of it sounds
new I hope. Here is a start, so get busy learn as much as you can from this and
let others know what you have found out at the next meeting.
One of the breakouts I attended was the Legislative Strategy session. We
discussed all federal motorcycling related issues and voted on what stances we
wanted the MRF to take. We discussed distracted driving, noise limits,
SAFETEA LEU, road side stops, profiling, right to repair, HIPPA loop-hole
legislation, international involvement.
On distracted driving we voted to oppose any type of "blackmailing" by the
federal government that may be used to encourage states to adopt distracted
driving laws. Distracted driving laws are difficult because of the rate technology
is changing. By the time a texting law is passed, texting may be obsolete. There are also some cases where accidents have increased due
to distracted driving laws. People are still texting in these instances; they are
holding their phones down so they cannot be seen. When they hold the
phones low, they no longer have peripheral vision and are more dangerous. Distracted driving laws are most effective at the state level.
The subject of noise limits was controversial. The final vote was to oppose
any type of federal legislation that may resemble the bill recently passed by
California, which makes any type of exhaust system, other than stock, illegal.
The MRF is planning on pushing to get a new Highway Bill passed that will
provide funding for Motorcycle Safety and Education. We did not get a Highway Bill passed for 2011. The MRF is working to get one passed in 2011 that
will be available for use in 2012.
The MRF is opposed to NHTSA's efforts to get funding to states for motorcycle only roadside stops. They have been working with Congress to oppose
these stops, and they will be continuing these efforts.
On the subject of profiling, the MRF will oppose any type of profiling that
targets non-criminal groups.
On the subjects of right to repair and the HIPPA loophole, we voted to stay
the course we have been on. Right to repair legislation is not likely to be
passed at this point, due to the financial difficulties being experienced by the
automobile industry. The MRF will continue to monitor the situation. On the
HIPPA loophole, the MRF is monitoring, but not actively pursuing legislation. At this point the MRF does not have any cases where Health Insurance
was denied to anyone for the sole reason that they are motorcyclists. Without
a "poster child" case, this is a difficult issue to prove. The MRF will continue
to monitor this issue.
Overall I was impressed with the MRF's desire to represent the majority. All
issues were voted on and the MRF was willing to represent whatever stance
we decided.

MOTORCYCLISTS ARE SCREWED AGAIN – TOWING
PROTECTION? HOW ABOUT IN YOUR STATE?
Rod,
Q:
I recently went to see an official at the Illinois Commerce Commission to talk
about the legality of towing cars from an apartment complex. I am
a tenant and was looking to find out under what circumstances the
owners association can tow someone’s car. While talking to the
official I asked about motorcycles being towed. She told me that
the I.C.C. does not regulate motorcycles being towed like they do
with cars. Does this mean that my motorcycle can be towed away
much easier than a car then be charged higher rates because they
aren't regulated? After speaking with an officer from the Illinois
Commerce Commission, he advised me that motorcycles are, in
fact, exempt from regulation from the ICC. This is due to the fact
that special equipment is needed to tow a motorcycle so towing
companies are allowed to charge as they see fit. The exemptions
are found under 625 ILCS 5/18, which states that “this Chapter
shall not apply to the relocation of motorcycles. Such relocation
shall be governed by the provisions of Section 4-203 of this Code.”
Section 4-203 does not impose any cost restrictions on towing
motorcycles.
– Ron, A.B.A.T.E. of Illinois member
A:
Ron, it looks like we motorcyclists were left off
the list of protected species in Illinois where the legislature saw fit
to protect autos from gouging rates. The protecting statute limits
the tow bill for cars but does not apply to motorcycles. It seems
the same pirates gouging cars would want to gouge us as well.
Now the tow companies in Illinois can do it with a vengeance by
saying that the legislature allows them to charge what they want.
Indiana and Ohio have not enacted any protections against gouging tow bill rates. Maybe the tow companies are kinder and gentler there.
GETTING BLASTED, AND NOT IN A GOOD WAY
Q:
I was traveling on southbound 31 when I saw
several DOT trucks with their directional lights flashing. They
were spreading chip and seal material on these locations they
were repairing. As I moved to the east side lane as directed, I
came up behind two semi-tractor-trailers and was "sand blasted"
by the semis traveling directly in front of me. Loose material flying
all over the place. My motorcycle and protective equipment received over $5,000.00 worth of damages from the sand blasting.
Is the state liable for damages caused by neglect of warning traffic
of what they are doing?
– ABATE member
A:
I believe the State may be liable to you for
failure to warn of their hazardous activity. There have been cases
where the state was sandblasting bridges and caused damage. I
would put them on notice and if they fail to pay you, consider filing
your claim in Small Claims court. Some states require you to put
the responsible governmental entity(s) on notice per the statute

Well, yesterday I
finally had my day in court for
my accident a couple of weeks
ago. The prosecutor met me in the lobby, we shared
evidence, and then her and the trooper meet with the
magistrate in the court room to let the magistrate know
what to expect. The trooper stated that the only reason I was cited was because I laid the bike down. He
further stated that speed was not a factor. The prosecutor objected to the US DOT guidelines because they
were not a statute or regulation. The prosecutor argued that the only defense in Ohio is one where immediate emergency action was needed, such as a deer
jumping in front of you. Although I cited State v. Burwinkel (2005-Ohio-4153) as opening the door to other
factors such as hydroplaning, the magistrate stopped
me from reading the pertinent section, saying he can
look it up.
The prosecutor made the case that if a car could
have made the crossing safely, a motorcycle is no
different. That under Ohio law, a motorcycle is the
same as a car. The magistrate agreed with the issues I
raised, but decided that because I had traveled that
road before, I should have been aware of the slippery
surface because it had rained earlier. I was fined $25,
2 points, and $95 court cost. I feel somewhat good to
have gotten the trooper to acknowledge that the only
reason for the citation was because the bike went
down. I feel that this was a miscarriage of justice because that State failed to provide any evidence other
than the accident of unreasonable control. In other
words, if you lay your bike over, you are guilty.
I learned that in traffic court, you are guilty until
proven innocent. It is not innocent until proven guilty. I
know that we need to educate the courts and the
states about the differences between motorcycles and
cars. In my case, both the prosecution and apparently
the Court agreed that there is no difference. Until we
change that perception, the safety of motorcyclist will
not be a major consideration in highway design.
I intend to write my State Legislature in hopes of
bringing motorcycle safety, in regards to highway design, to the forefront. I am also going to ask them to
amend 4511.202 for clarity. If the State wants to make
it failure to control, they should strike out the word
reasonable, otherwise, make it clear that there needs
to be some evidence other than the accident. My

Ya know, every late January/early February ABATE
holds a state seminar (usually in Columbus) where anyone dedicated to our causes can immerse themselves in
the ABATE experience. This seminar educates members
on various organizational topics like how to properly conduct meetings and have successful runs and rallies. It
also addresses public relations, treasury and event issues
as well as state and national news. And it allows all of us
to personally meet and get to know the state and regional
officers from across the whole state about whom we
might have only read about in this magazine. Officers are
urged to go for obvious reasons, as well as any other
members who would enjoy a relatively inexpensive weekend ABATE get-a-way in mid-winter. Sometimes the

rock. It also gives all of us the valuable tools and resources we need to make this organization function properly. And what better way to spend a weekend in a motel
than with a bunch of fellow bikers? (Don’t answer that.
This is a PG rated magazine.)
NOW is when you should be making plans to come. I
know every time I wait until the last minute something or
someone always messes things up. But now that I’m flying solo again, I’m starting to think about it early and to
make my plans. I don’t have all the details as of this writing, or even where it will be, but the seminar is always
held in a motel that’s not too hard to find on the outskirts
or in the vicinity of Columbus since that’s mid-state geographically. Look elsewhere in this issue and the next for
more. A lot of us get there on Friday to take advantage of
the whole weekend and stay until Sunday morning. But
many who can’t get away that long or don’t wanna rent a
room just show up for Saturday. Rates are always reasonable and the cost of the room is usually the most expensive part of the weekend (especially if you’re a cheap
bastard like me and bring most of your own drinks and
stuff). Mention that you’re with the ABATE of Ohio people
and you might get a discount.
Speaking of ABATE events, I went to Region Zero’s
18th annual Hog Roast yesterday and saw something
amazing. A four piece band (two guitars, a bass and
drums) who call themselves “ESD” from the Cleveland
area played and their members were young. In fact, believe it or not, the bass player was only ten years old! And
they were absolutely GREAT! They played at the Ohio
Bike Week up in Region 7 over the summer and blew
away the audience there too. The rest of the band are all
eighteen and fine musicians, which really isn’t THAT surprising since many rock stars of the 60’s and 70’s were
that young and even younger when they began recording
and even had major chart success.
But that bass player, a little kid named Patrick, was so
small that I was surprised he could even handle his instrument, let alone do it so well. The kid was really getting
into it and actually knew what he was doing. The band
played material like AC/DC, Skynard etc. And they kicked
ass!
The reason I’m mentioning all this isn’t just to give
them a plug. I’m doing so because it’s great to see younguns who are getting into real music and not copping out

become mature enough to actually start to listen to the
music, they begin to seek out other forms. A lot of them
then realize their parent’s music is, and always has been,
great stuff and they start getting into it or new forms of it,
like alternative (or whatever they call it today). And of
course more than just music is affected by “generational
preference”. In the October issue of the Outspokin’, an
article reprinted from Fortune magazine mentioned that
many of today’s younger people actually prefer imported
café style motorcycles.
I was dumbfounded years ago when my sons both
agreed that most of today’s youth look on Harleys and
other big twins as “old people’s bikes” and would actually
rather own and ride sport and café style scoots. The result
is that now, Harley is having trouble finding young customers. My son Ben says, “Harley should have marketed
a bike long ago that is priced as an intermediate and not
an expensive bagger.” Well, I told him that in fact Harley
DID sell a lot of 250 and 350 Sprints made in Italy in the
60’s and 70’s. They made the K Model (which soon became the Sportster). And even before all of that, the little
Hummer was originally designed for this purpose. The
“Motor Company” just decided to concentrate on the more
expensive bigger bikes. Now they’re in trouble and having
to close plants because they’ve been more or less neglecting entry-level buyers by pricing themselves out of
that very important market. Well, duh! A prospective customer often stays with the brand they’re familiar with, and
it doesn’t matter what you’re talking about.

A PARENT USING COMMON SENSE SHOULD DECIDE?
Graham Ewing, an ABATE of OHIO member, posed the
following question to several including ABATE LEGAL.
Q.
Please advise me as to what age, in the eyes
of the Ohio Laws, it will be legal to transport my child in my sidecar. I had my small child in my sidecar and received a ticket for
failing to have him in a child restraint.
Remember, injured ABATE members pay only 28 ½% of total recovery and expenses as approved by client, consistent with and conforming to applicable state
law. Elsewhere, you may pay 33 ⅓%, 40% or even 50% of your recovery. And,
ABATE members are not charged for recovery of damage to your motorcycle, and
have access to a 24-hour toll-free telephone number.

A.
Graham, I believe that the ticket regarding the
restraint issue is improper. I understand your son was restrained
in his child seat, and helmeted, for a slow ride along country roads
at no more than 30 mph. I see very little difference in that activity
than if you had taken your son for a horse and carriage ride. Carriage rides happen scores of times a day in every major city in this
country. What about the Amish? Are they required to use child
safety seats in their buggies? Where was your son safer – in a
seat restrained in a side-car with helmet, or in an open carriage
pulled by horses? Or in a small car? Parents have the right to
decide, within reason, what is best for the child. In this case, the
officer was out of line and the tickets were unwarranted.
When Graham posed the same question to the local
Chief of Police, the Chief responded:
I will not give you a definite answer
on that. There are many factors involved. ... I
guess to use a court term, it would depend on
the "totality of the circumstances".
Chief.
Not very informative from the supervisor of the cop who wrote the
ticket. If the freaking Chief of Police can’t tell you when it’s legal to
have your child in a sidecar under the existing statute, the statute
is unconstitutionally vague and needs to be changed.
BREAKING UP – WITH YOUR LANDLORD, TOO
Q:
I'm an ABATE member. My ex and I had
been living together and just broke up. We signed a lease together on an apartment. I moved out this week and I called my
landlord and told him. What do I need to do to make sure nothing
comes back on me? Thanks for your help.

A:
I understand that you signed the lease as did
your ex. That means you have promised to do what the lease
says. Unless the lease lets you off the hook when you move out,
you are bound by the terms. If your ex fails to pay the rent, you
are responsible. If your ex damages the apartment, you may have
to pay for the repair. You could ask the landlord to take you off the
lease. The worst thing he can say is no. If he says yes, get that in
writing. If he says no make sure he has your address and agrees

developing ABATE Huron County. There is a group of members
and others in Huron and Erie that have been loyal to the former
Roeder business family and would like to organize a sort of "riding

to an organization that preserves the right to ride. This sounds like
an exciting venture with promising growth. It’s a great opportunity

Re-elected or not I'm looking forward to the next year and always looking for improvements to running the organization. If there

start over in the next legislative cycle, so please make every
effort to get this done.
Once again I would like to thank all the officers at the State,
Regional, and County levels for stepping up and I am looking
forward to working with holdover and new officers in the coming
year.

Kolman’s December Article:
Hello Region Nine:
Amazingly, this is the last article I will be writing this year; it
seems that only a minute ago I was writing the first one of the
Region Nine
Sorry Region 9, Kolman’s article was accidently left out last
year. Still some good riding though, even if it is a little brisk!
month, here is the November Article:
Hello Region 9!!
Pickaway County's Poker Run was held on a beautiful fall
day. Those attending enjoyed the fall weather and the excellent
route layed out by Big Mike. After the run we returned
to Woody's and had good food and excellent after run activities.
Thanks to all of Pickaway County who worked to put on a quality
run as usual. Thanks also to all those who attended, those of
you who didn't, missed a good time.
As far as upcoming events are concerned, the next big one is
the Franklin County Toy Run, November 13th. We assemble at
Toy's "R" Us located at Groves and Hamilton Roads at noon.
Leaving there for the firehouse@ 1:00 pm SHARP! Admission is
one new unwrapped toy! All motorcyclists are welcome. The
fund raiser/food will be held immediately following at Screaming Willies, 1921 Channingway Center Drive. For more information please contact 614-561-4285. Please join us to help make
this event the success that it always has been in the past. We
need auction items for the fundraiser. We can accept all donations up to and including the morning of the event. We also need
volunteers for various fundraising functions as well as food service. In addition we also need food items. Please come to the
November Franklin County meeting to be held at the Granville
Street Tavern on November 7th for final details. Donations and
food can also be brought to Hawg Wild on November 11th. I
know that Dave and I can count on all of you to make this event
a success again this year.
Also on the horizon are elections-both ABATE related as well
as national, state and local. Please take the time to research the
issues and candidates. These elections will be the most important ones ever held for our nation, state and cities. Please take
the time to exercise your right to vote. As far as ABATE elections are concerned we started nominating for Regional and
County offices in September and October. In Franklin County
the following individuals have accepted nominations: Legislative
- Tim Horetski, J.R. Gantner. Sgt. of Arms - Tom Onstott, Bo
Essing, Floyd Norman, Marc Snyder, Brain Nissely. SecretaryMolly Onstott, Jackie Luckhakupt, Kim Chafin. CoordinatiorRick Jesse, and Roger Wright, Brain Nissely are pending acceptance. On the Regonial level; Legislative - Tim Horetski and
Randy Paul. Products - Karen Norman. Treassurer - Michelle
Ray and Cynthia Piper pending. Sgt of Arms - Floyd Norman,
Bo Essig, Marc Synder, Tom Grimm. Asst Directior - no nomina-
December 2010
Hang tough, Spring is only five months away.
Apparently my article did not make it into the November issue; I apologize for this, I am not sure what happened.
I thought I slid it under the deadline, but maybe not; or it got lost
in cyberspace somewhere. I hope this one makes it into the
December issue.
I would like to thank all the Officers, both County and Regional
who have given their time and effort this past year. It was a
pleasure working with all of you, and I hope to be able to work
with those of you who choose to return in 2011. I would like to
also thank all the Officers statewide who also served, this past
year. Your contributions are also greatly appreciated-a job well
done! If selected, I am also looking forward to working with
those who choose to come aboard in 2011.
Next year will be an especially challenging one, from a legislative standpoint and also from an organizational one. From the
usual issues (helmets, noise, insurance discrimination, ROW
Legislation, etc.), the biggest challenge facing our organization
is declining membership. We MUST stop the loss of our member
base. We need to increase our numbers; hopefully, with the help
of our leadership, we will make inroads in this area next year.
As you all know, nominations (or as it’s known by its other
name-screw your buddy) for County and Regional Offices have
been going on since September. I was going to refer to last
month's article for the list of nominees, but.......no article. As far
as the Region goes, those accepting nominations are as follows:
Tammy Post-Webmaster; Tim Horetski-Legislative; Randy PaulLegislative; Karen Norman-Products; Molly Onstott-Secretary;
Michelle Ray-Treasurer; Floyd Norman, Bo Essig, Mark Snyder,
and Tom Grimm, all for Sgt. at Arms; and myself for Region
Director.
In Franklin County, those accepting nominations are: Tim
Horetski and J.R. Gantner, both for Legislative; Tom Onstott, Bo
Essig, Floyd Norman, Mark Snyder, and Brian Nissely, all for
Sgt. at Arms; Molly Onstott, Jackie Luckhaupt and Kim Chafin,
all for Secretary; and Rick Jessee-Coordinator. These do not
include anyone who was nominated, but was undecided. Thank
you to all who accepted nominations, and to those who may do
so at the November and December meetings. Voting will be at
the December meeting-remember so bring your valid ABATE
membership card for verification purposes. As of this writing, I
am not aware of any nominations in Madison, Pickaway and
Delaware Counties.
Outspokin’
33
As I am writing this before the Franklin County Toy Run, a report on this event will have to wait till the January Outspokin.
The Region 9 website is back up and running-the new address is:
region9.abate.com/. As soon as I am done writing this article, I am
going to check it out. Thanks to TJ, our State Webmaster for getting
it back up, and also to Jason Holt for his work on the region site -it
was a rough go for Jason, with the website being hacked and destroyed-thanks for your efforts, bro.
As far as events, the only one is Madison County's Christmas
Party on December 11.
On the Legislative front, it looks like we will have to start anew
with our ROW Bills, in the next legislative cycle. I would like to
organize an ABATE presence at the first session of the Legislature
in January. I will talk with Kristie and get the facts and see if we can
pull this off. We can storm the Legislature, talk with our respective
legislators, and sit in the chamber en masse for the first
session. This will let them know that we are watching them, and we
care about our Bills. Details at the November and December meetings.
As this is going into the December issue, please take time to
remember the true meaning of Christmas, and take the time to
reflect on those members of our Military who are unable to be with
their loved
ones as they fight to keep us and our country free. If you encounter
a veteran, or a current member of the Armed Forces, shake their
hand and thank them, and please say a prayer for those who have
made the ultimate sacrifice. I hope everyone has a safe and joyous
holiday, and a prosperous new year!

Well, here we are, another year nearly behind us, and good
chance to thank all of you who have put efforts toward our cause.
We also appreciate all of you who have supported our events and
activities in ABATE. Please continue to stay involved - or get more
involved, whichever the case may be! The EasyRider Bike Show
will be in at the Greater Columbus convention center, (otherwise
known as Veterans Coliseum!) from Feb. 11-13th. ABATE will
have a booth there and we desperately need volunteers. Please
consider donating some of your time. It shouldn't be the same
people doing all the work at every event! It seems Billy Gibbons of
ZZtop and Vince Neil of Motley Crue will be making appearances
along the show circuit. Should be a good time! Make sure to mark
your calendars now and give the office a quick call to offer a few
hours at the booth!
But, I'm getting ahead of myself here. Before all that, we have
Christmas and elections. Speaking of elections, we had a big turnaround at the state and national level on Nov 2nd. Make sure that
you know who your representatives will be come January so that
you can continue to write and call them in order to fight and protect
your motorcycling rights! Christmas parties are right around the
corner. Remember, our region Christmas party and elections
are Dec. 11th at the Super 8 in Marion. Please show up, be a
part, and get a little wild with your brothers and sisters in the wind.
Have a great holiday season.
I know winter is long, especially for members of the motorcycling
community. But, there are still things going on. Some of you may
have just attended the Cyclefest in Dayton. There is also have a
15th annual swap meet coming up in Delaware on the 16th of
January. And, there's the big International Motorcycle show at the I
-X center in Cleveland on Jan. 28-30. So, there are biker related
things to do during the cold months. Your region is sure to be getting together the first of the year to plan their upcoming year of
events. If you have any ideas or input, make your voice heard! If
you don't attend meetings, you're gonna miss a lot.
See you next month!! Stay warm.
