The counterpart (or D740) was introduced in 1998, alongside the photocard driving licence, in order to display information that could not be included on the photocard, such as provisional driving entitlement categories and current endorsements/penalty points. This information will be held on DVLA’s driver record and available to check online. Photocard licence-holders are advised to destroy the counterpart once the 8th June deadline has passed (keeping the photocard, of course). Paper driving licence holders (issued before 1998) will remain valid, and should not be destroyed. Upon updating a paper driving licence, a photocard only will be issued. ‘You’re never too good’ – bikers agree THINK! evaluation reveals positive response to latest campaign The THINK! campaign has carried out an evaluation of its latest road safely videos. ‘Never too good’ comprised a series of films featuring Chaz Davies, World Superbike rider, and comedian Alan Davies undergoing further training alongside a group of eight regular riders. The campaign ran from mid-August until late-October and attracted more than 466,000 views on YouTube. Of the 500 riders who responded with their thoughts on the campaign, 66 per cent liked the style of the videos and 45 per cent said they made further training look like fun. Sixty per cent agreed strongly that further training can improve defensive riding skills and reduce the risk of having an accident; 62 per cent agreed that, no matter how good or experienced you are, there is always more to learn about riding. Meanwhile, 43 per cent of those who recognised the campaign said they had signed up to further training as a result of seeing the videos. Victoria Judd, THINK! motorcycling campaign manager, said: “Never too good was well received and appears to have influenced attitudes and intentions among some bikers to take further training. “While to date this has not translated into actual sign-ups among the main training providers, this could be because the campaign ran in late summer and continued into autumn when many bikers begin taking their bikes off the road.” For more information about the THINK! campaign, visit www.roadsafetygb.org.uk. E-mail [email protected] January – February 2015 05 News All the latest from the trade & industry Highways Agency reforms afoot A new bill currently being put before parliament provides the legal framework for the government’s £15bn ‘Road investment strategy’ and includes major reforms to the Highways Agency. If the bill is passed, the Highways Agency will become a governmentowned company, which could save the taxpayer at least £2.6bn over the next 10 years, it is estimated. The Highways Agency will be replaced with Highways England from April 2015, and will be responsible for delivering over 100 new road schemes between now and the end of next parliament. Dartford crossing goes non-stop The Dartford Crossing has been equipped with a new electronic payment system so that motorists no longer have to stop at a toll booth to pay their charge. Under the new system, motorcyclists will continue to use the crossing free of charge. The crossing will remain tollfree for all vehicles every night, from 10pm to 6am. ‘What’ll it do, Mister?’ 122mpg, actually! Fuel-economy enthusiast ekes out winning range from CG125 A motorcycle developed by enthusiasts for a fuel-economy contest has achieved 122mpg. The Institute of Advanced Motorists’ (IAM) London Advanced Motorcyclists’ annual economy run is titled ‘What Will It Do Mister?’ The idea was the brainchild of long-standing member Andrew Craster, and the run has been staged every year since 2009. The group has some strict guidelines about how the economy run is conducted – everyone must ride to IAM test standards, must not impede other road users and keep to all road safety rules and guidelines. The route set by London Advanced Motorcyclists took in nearly 60 miles of varied conditions including A and B roads, busy town centres and rural sections. The winning rider was the group’s observer Peter Gibbons, who achieved 122.9.mpg on his Honda CG125. Runner-up was Peter Raynham on a Honda NC750X with 101.8mpg, with Dave Wilkins on a Honda C90 taking the final ‘podium’ spot on a Honda C90 with 98.9mpg. Ultrasonic cleaning on the south coast New high-volume facility opens for business in Chichester Honda wings its way to 300m Honda Motor Co. reached its 300m-unit milestone in September 2014. The company held a ceremony at its Kumamoto production plant in Japan to celebrate the 300-millionth machine produced, a Gold Wing 40th Anniversary Edition. Last year was Honda’s 66th year of production, which began in 1949 with the Dream Type-D. 06 January – February 2015 Ultrasonic cleaners have been around since the Fifties, and are now common in the bike trade for the cleaning of small parts, cables, carbs, hoses, etc. This means of cleaning is probably best known, though, for use on carbs and fuel injectors, with which accessibility can be tricky. News All the latest from the trade & industry Santander backs KTM youth series Major finance firm to sponsor championship for teen racers Santander Consumer Finance UK has been announced as the new title sponsor of the upcoming KTM British Junior Cup, the single-model KTM RC 390 series, which will be run alongside the 2015 MCE Insurance British Superbike Championship. The Santander Consumer Finance KTM British Junior Cup will be open to riders aged 13-18 years old, and every rider will line up on an identical ‘Cup’ variation of the recently-launched KTM RC 390. The series is designed to offer equal opportunity and a level playing field for emerging talent, and it will be promoted by MSVR across eight events incorporating 20 points-scoring races. Registration for the Santander Consumer Finance KTM British Junior Cup is now open and the race entry fee is £2,100, including personal accident cover. Two official tests, subject to confirmation, are planned for March 2015. At a ceremony held at The Savoy in London, HRH Prince Michael presented the award to REALsafe co-founders Zoe Farrington and Andrew Richardson (pictured below) for their crash detection app RealRider. This safety app for detects if a rider has crashed and sends location and medical information directly to the NHS Ambulance Control Room. Report recommends wide-ranging improvements to learner-training course A new study suggests that compulsory basic training (CBT) should include a hazard-perception test, and that more should be done to encourage learners to undertake an extended period of training after CBT. The recommendations are from a research report published on 5th December by DfT and DVSA, which was commissioned to understand more about the riders who take CBT and to gather the views of CBT instructors. The report states that the majority of trainers would like to see the introduction of a theory test which learners would take prior to attending CBT. It also calls for more clarity about how the theory element of CBT should be taught. The core CBT course should be kept to one day, the report concludes, but with a “strengthened requirement to extend training when needed”. It adds: “The duration of CBT courses should be determined by the pace at which learners reach a competent standard as they progress through the syllabus and courses can take longer than one day to complete.” On the important issue of cost, the report states: “It should be made easy and not overly costly for those who want extended training to be able to come back for another two hours on the road for example.” To read the detailed findings of the full report, visit: http://tinyurl.com/nxwbjkt. E-mail [email protected] 08 January – February 2015 News All the latest from the trade & industry MCIA and police unite behind safety agenda Industry association joins forces with ACPO to back biking The Motorcycle Industry Association (MCIA) and Association of Chief Police Officers (ACPO) have jointly launched a new motorcycle safety and transport policy framework. This policy document has been devised to encourage greater use of motorcycles on UK roads, which it is hoped will also improve road safety. Though rider safety has improved considerably since 2000, motorcyclists are currently over-represented in road fatality statistics (one per cent of traffic, 19 per cent of fatalities). This could be reduced, given sufficient government support, claims the MCIA. Police and industry agree that traditional road safety policies directed at motorcycling will only partially deliver improved safety, whereas encouraging motorcycling has the potential to contribute to better safety outcomes. Switching to two wheels clearly helps solve the congestion problem too. A Belgian study, which modelled a shift from cars to motorcycles on one of the most congested roads in Europe, found that when just 10 per cent of car drivers swapped to a powered two-wheeler, congestion was reduced for all road users by 40 per cent. When 25 per cent of drivers swapped, congestion was eliminated altogether. The idea that more motorcycles on the road improves rider safety was initially based on European data, which shows that when a greater percentage of traffic is made up of motorcycles, mopeds or scooters, riders are less likely to be involved in accidents. What’s more, there is a growing body of evidence showing that people who begin their road careers on a two-wheeler become safer drivers. Charging network upgrades announced Government to tackle ‘range anxiety’ by installing more charge-points The government has set out its aim to install enough chargepoints, within the next five years, to ensure that electric vehicle users are no more than 20 miles from a charge-point wherever they are on the UK’s trunk roads. Currently there are 8,500 charge-points installed at nearly 3,000 locations across the UK, 750 of which are rapid chargers. An investment of £15m by the Highways Agency will expand the existing charge-point network. Wherever feasible, these will be rapid chargers, capable of charging an electric vehicle to 80 per cent of capacity in less than 30 minutes. This investment is expected to add thousands of new charge-points. Alex Michaelides, a spokesperson for the Go Ultra Low campaign, said: “We know from our research that ‘range anxiety’ is one of the major concerns electric vehicle users have when considering an ultra-low emission vehicle. The site includes advice, specifically tailored for businesses, on choosing or switching to a new provider, as well as information on navigating and negotiating contracts, and resolving complaints with a provider. It clearly sets out Ofcom’s role and the rules communications providers must follow when dealing with business customers, offering advice on landline telephone, broadband, mobile and postal services. A summary of the rights of businesses, both large and small, is also available. http://consumers.ofcom.org.uk/ ofcom-for-business-consumers/ State pension overhaul date beckons With less than 500 days to go before the state pension system is overhauled, the government has launched a new campaign – “Your Pension, Your Future” – to help workers understand the reforms that will introduce a flatrate state pension. The government believes that the reforms will “tackle inequalities of the past, with women, carers, lower earners and the self-employed to benefit the most.” It expects that in the first 10 years, around 650,000 women will benefit from the transition valuation, receiving on average £8 a week more in state pension. Ministers are urging everyone – and the over-55s in particular – to 10 January – February 2015 assess what the changes will mean for them and to secure a detailed state pension statement so that everyone can plan accurately for retirement. Under the new system, pensioners would in time receive around £150 a week, or more if they have 35 years of full-rate national insurance contributions. Those soon to retire will need to check what it means for them, with transitional arrangements in place as the systems switch over. The campaign coincides with the publication of new research carried out for the government which confirmed the lack of understanding many people have about the British state pension system. Some 42 per cent of people, yet to retire, admit they need to find out more about saving for retirement, while 38 per cent concede they “try to avoid thinking about” what will happen when they stop working. Individual personal pension statements can be found at https://www.gov.uk/ state-pension-statement Businesses taking advantage of Employment Allowance New data released by the government has revealed that over 850,000 UK employers are benefitting from the Employment Allowance in each region and sector across the UK. The Employment Allowance is a reduction in National Insurance Contributions (NICs) that an employer pays on their employees, and is worth up to £2,000 for eligible businesses and charities. The allowance was announced at Budget 2013 and businesses only need to confirm their eligibility for the allowance through their regular payroll processes to receive it. Those not already receiving the Employment Allowance can use a calculator at http://bit.ly/1fL6NYu to work out if they could benefit. Tax before turkey! Festive filing increase HM Revenue and Customs (HMRC) received 1,773 online tax returns on Christmas Day – a 13 per cent increase on last year’s total of 1,566. Logs reveal the busiest time for online returns on 25th December was between midday and 1pm, when 148 Yuletide returns were delivered electronically. Christmas Eve, traditionally a much busier day for festive filing, saw 17,644 online returns successfully submitted. This was up four per cent on 2013. Another 4,811 online returns ticked all the boxes on Boxing Day – a seven per cent increase on the 4,493 received last year. In total, 24,228 online returns were received over the three-day festive period – up five per cent on the 2013 total of 23,059. The deadline for sending 2013/14 tax returns to HMRC, and paying any tax owed, is 31st January 2015. All outstanding 2013/14 tax returns must now be submitted online (the paperfiling deadline was 31st October). To send an online tax return, you must be registered for HMRC Online Services. The same can’t be said for producing, marketing and retailing the slippery stuff, as Bruce Wilson finds out W hen it comes to consumables, few products can claim such importance to motorcycling as oil. It is the lifeblood of our twowheeled ambitions, ensuring both the longevity and the performance we’ve come to expect from contemporary, hi-tech motors. And, just like engine performance, oil has evolved massively over the years, from the days of being wholly mineral in its make-up, to predominantly synthetic. Putoline’s John Hayden recently explained to Trader: “We don’t actually produce a mineral oil anymore; our most primitive products are semi-synthetic. To achieve the best performance, a unique blend of synthetic additives are required. Engines have never been quite so specific or demanding, to the extent that it is essential we produce a wider range of products, offering a more exact formula for individual motors.” The challenges placed on oil manufacturers have never been greater, with pressure applied from both the consumer and retailer to deliver affordable, dependable and easy to digest products. In Hayden’s opinion, the latter demand is as crucial any other. “We’re proud to produce one of the largest motorcycle product ranges in the market, and we’re perhaps equally proud of our systems which deliver key information to our end users. We do this by two means: through our dealers and via an aggregator on our website. In times gone by, putting the wrong oil in an engine might not have done too much damage, but that’s not the case anymore. Which is why we need to ensure our customers go home with the exact oil they need.” Putoline is unique in that it is a bike-only brand. Its specialists spend time with their retailers, explaining the product range thoroughly, giving salespeople the knowledge they need to guide end users with real clarity. The brand’s online product selector, for those who are savvy with such things, helps deduce the exact best options by determining an owner’s brand, model and year of motorcycle. Face-to-face interaction Russell Bower from Rock Oil reiterated the importance of online interaction, yet he believes that most customers still prefer to do business face-to-face. “There is no doubt that the internet has changed buying habits for just about everything, but we are finding that many people still like to visit their local dealer. “Many of our retailers have January – February 2015 21 Feature Lubricants sector Rock Oil is the UK's sole remaining major motorcycle lubricants manufacturer websites [which they regard as] an additional way to sell products. The feedback from our distributors is that the motorcycle industry is still one where people like to go and visit an outlet and purchase there. The other side to this is that many of our products are ‘relatively’ inexpensive so the postage costs can add a significant percentage to the cost.” Keeping costs down is a priority 22 January – February 2015 for all, whether you’re a commercial or individual buyer. But keeping prices down in a modern world is increasingly challenging, especially with notable fluctuations in the price of crude oil recently, as Bower explained. “As the feedstock to some base oils, crude costs can have an impact on the price of some products. But there are many more factors that influence the base oil pricing, such as supply and demand and what refineries are producing. As refineries come under the microscope, their operations teams are looking to generate as much profit as possible to ensure that the refinery stays open. “This can be done by ‘turning the wick’ up or down, and in some cases shifting the production to fuels or base stocks as necessary. Additives also form a key component in lubricants and in most cases are the biggest cost component. Additives are in short supply and the development programme to get them from the lab to the retail shelf can be extremely costly.” To put things in perspective, the typical cost for a new four-stroke oil’s development can easily exceed $5m. To achieve an industry-standard specification for a new product within three years, typically five engine tests are required, to the tune of $1m a time, with additional lab bench tests also needing to be factored in. Multiplying that by the number of performance specifications listed on each oil gives an idea of the R&D costs associated with oil production. These huge costs undoubtedly have a significant impact on the welfare of the UK’s oil industry. Naturally, this makes the task of sourcing raw material extremely challenging, which is why Rock Oil’s technical team spends much time working with all of the major technology providers to guarantee it remains at the forefront of any changes. Even so, Bower explained that Rock’s consistently strong performance also has a lot to do with the pragmatic mindset of its directors. “In the oil industry, some brands rise and fall, and this might be down to a heavy marketing spend at a given point which then subsides. There are always established brands and these have a consistent presence, but again they might ebb and flow dependent on marketing spend and the quality of the sales force. “We have tried to stick to our core values of high-quality, innovative products with our experience in race support. I think over time it’s been the only way to remain a constant in the marketplace. We have a strong identity and are regarded as a proper motorcycle brand. On top of this, we have some fantastic distributors who have been in the industry a long time and are trusted by the trade.” With more than 3,000 products within the brand’s line-up, its dependence on trusted, knowledgeable and eager outlets is understandable. High-performance demands Another essential element in any brand’s armoury is a strong marketing strategy. Every oil brand executive I spoke with was eager to talk about their firm’s proactive methods of targeting individual motorcyclists. It appears the most common application through which to portray a brand’s ability is racing, which makes perfect sense. Back in 1925, BMW released the ‘sporty’ R39, producing 6.5bhp at 4,000rpm. Fast-forward 90 years and the German firm’s new S1000RR makes a mind-blowing 199bhp. In superbike-trim, the S1000RR makes even more power, with an even greater dependence on the oil used to guarantee essential lubricating and cooling of the highly-strung motor. From a punter’s perspective, it makes sense to use the same oil as used by the race team of the bike on TV, which helps explain why oil companies are so keen to get involved with top-flight race teams. There is no better advert. Oil companies also support dealerships with strong branding in showrooms. I’ve yet to walk in a dealership that doesn’t have its oil neatly displayed within a purposebuilt display stand, logoed to the hilt to ensure the customer knows what they’re buying. Likewise, the use of cardboard cut-outs and banners has never been so popular, not to mention the merchandise that goes with it. Baseball caps don’t grow on trees, but giving away the odd hat or jacket in return for a walking, talking billboard obviously makes commercial sense. Compared to conventional advertising, cultivating brand loyalty has the potential to offer far better longevity on your return. He explained the important of image from a sales perspective. “We’re Yamaha dealers, so we stock Yamalube as well as Motul. Motul has always had a strong and attractive look and people associate the image of the product with the performance it delivers. “Not too long ago, Yamalube was in a very different situation. It came in boring containers with no exciting graphics to help draw a customer’s eye. The result was that we sold very little. But then they completely overhauled the look of the products and now everyone wants the stuff. It’s essentially the same oil as it was before, but its new look has made it a far more attractive proposition.” Tempest went on to explain how price is still a critical factor for people choosing their oil. He estimates that 25 per cent of his customers stick to a motorcycle manufacturer’s recommended oil, while the rest are liable to buy different brands depending on image and pricing. “One of our customers owns a Triumph and a Kawasaki. He always puts Motul in the Triumph, but opts for Yamalube in his Kawasaki because it’s cheaper to purchase. “Brand loyalty has to be earned, so not every customer is eager to switch to one of our oils if they’ve always used a different brand, in some cases since they started riding. That’s 24 January – February 2015 understandable, but it’s our job to highlight the virtues of our products, else we’ll not get the sales. “To do this, we depend on experts from our stocked brands to come and educate us comprehensively on the oils and ancillaries on our shelves. Thankfully, Motul are massively proactive and really help us to technically grasp important information, which we will in turn instil in potential customers. Being able to stand and deliver reassuring knowledge to a buyer often gives them the reassurance they need to take a chance on our oil. And once they’re on board, they stay on board.” Hearing Tempest’s take was fascinating and had me pondering what it actually requires for an oil manufacturer to succeed in today’s market. Evidently, image can make the difference between making a sale and not, regardless of the technology of the product. Similarly, affordability can still steer a purchase. The demands on oil companies are extensive; each brand must have a strong look, stronger marketing campaign and an even more robust support in the showroom. In a tough environment, with fewer people buying big bikes, oil manufacturers have got their work cut out. On the evidence discovered here, they’re rising to the challenge, which is great news for the rest of the market. New registrations are up and there seems to be a sustained interest in motorcycling for both leisure and commuting. The hard work of 2015 beckons, but first I thought I’d review what has been achieved during the past 12 months, as a snapshot of the highlights from 2014 – which form part of the growing body of evidence that motorcycles and motorcyclists are not a problem for road and transport planners – they’re the solution. February April Motorcyclists commute happy More MORE The MCIA drew attention to an Office for National Statistics report showing that travelling to work on a motorcycle, scooter or moped was one of the modes of transport least likely to negatively affect wellbeing. MCIA members behind the Motorcycle Off-Road Experience (MORE) announced it would hold another four-day try-out festival for off-road newbies. The decision to put on the event for the third year running was based on results from the MCIA’s contact centre, which discovered that a significant percentage of past attendees subsequently took further training, bought a bike and/or influenced friends and family to do the same. January Minister acknowledges social value of motorcycling As the keynote speaker at January’s Wheels to Work Association, Robert Goodwill lent his support to the Wheels to Work concept and to the potential value of motorcycling to social inclusion. The minister has also revealed that he and his son both hold a motorcycle licence, and he has endorsed the idea that those who start their road-going career on a moped make better drivers. 26 January – February 2015 March Motorcycle training industry gets new training courses A specialist accreditation centre was set up at MCIA HQ in Coventry to help provide two courses, one for those running motorcycle training businesses (ATBs) and the other for instructors. Steve Kenward elaborated on the MCIA’s Motorcycle Safety and Transport Policy to delegates at the National Safer Roads Partnerships’ Conference. The conference, held in Manchester, brought together professionals from road safety partnerships, police forces, local authorities, government officials, academics and road safety charities. October Case made for motorcycle fleet Following the launch of Honda’s national fleet dealer network, there was considerable interest from specialist media in the idea that this form of fleet transport could be viable for businesses looking to save time and money. Honda UK became the first manufacturer in the country to introduce a specialist motorcycle fleet dealer network. The service will emphasise the many benefits of doing business on two wheels. These include high fuel economy, low running costs, low CO2 emissions and increased productivity, as motorcycles waste less time stuck in traffic. August December Festive spirit and reason for optimism We had 12 months of continual growth in new registrations, with an overall increase of around 10 per cent for 2014. Annual registrations are set to exceed the benchmark figure of 100,000, which bodes well for 2015; a further 10 per cent in registrations growth is anticipated this year. Last year ended on a high note with a very well attended Parliamentary Reception at which the MCIA and Association of Chief Police Officers (ACPO) launched a landmark policy document, ‘Realising the Motorcycling Opportunity: A motorcycle safety and transport policy framework’. This sets out a clear safety agenda, based on the fact that more motorcycles on the road will benefit all road users. Increasing motorcycle use is clearly a developing trend, fuelled by the climb out of recession and the ever-increasing problems of congestion. Spreading the word about motorcycling CEO Steve Kenward took the MCIA’s proposed Motorcycle Safety and Transport Policy safety strategy to the National Motorcycle Safety Conference, organised by the Association of Industrial Road Safety Officers (AIRSO). But one company – Petrol Scooter – stood strong against the negative impact of rogue traders by refusing to compromise on integrity and quality W est Midlands-based Petrol Scooter is one of a few companies continuing to trade in junior and light-utility ATVs in the UK, principally with the Chinese-made Kazuma brand. The family-run importer/retailer provides machine and parts supply and offers technical support. Trader spoke to the company’s David Smith and discovered that Petrol Scooter is also often the first port of call for dealers who are desperately searching for obsolete Chinese spare parts. 28 January – February 2015 Motorcycle Trader: Tell us a little about the history of Petrol Scooter. David Smith: Petrol Scooter was started in 2002 as a small family-run business based in the West Midlands. Originally, the company specialised in selling board-style petrol scooters and associated parts. At that time, we had a small web presence, with most sales being generated on eBay. The company then started importing the Kazuma brand of ATVs, with which we had great success, particularly in the junior and light-utility markets. We expanded to stock an extensive range of Chinese and Taiwanese spare parts for ATVs, road-legal scooters and mini-bike sports. MCT: Where is the business located and what is the size of the operation? DS: We are currently located in Coventry and employ 20 staff, including several apprentices. MCT: Which sectors of the market do you target? DS: The Kazuma quad range is sold both direct to retail and also via our trade partners. They are generally best suited to consumers looking for a reasonable balance of quality and cost. They are very popular for junior riders and businesses where a light-utility vehicle will prove more useful than heavyweight agricultural machinery, such as equestrian centres. Our spare parts business is focused mostly at retail customers who are seeking reasonably priced parts for their Chinese-manufactured scooters and other machinery. However, we are also often a first port of call for motorcycle shops and mechanics who are faced with an unknown or generic Chinese bike that has been brought to them for repair. MCT: What initially attracted you to these particular brands? If you want to get your news read today instead of next month, then send it to [email protected] Column Next Generation Next Generation Could Be Tweaked Mark Williams spent Christmas mulling over a report on Compulsory Basic Training, and he reckons that a few new year’s resolutions are in order for the 25-year-old course T he ‘Learners’ and Trainers’ Perceptions of Motorcycle Compulsory Basic Training’ is a bit of a mouthful as a report title. Nonetheless, it’s a comprehensive, 64-page document, prepared for the DoT and the DVSA by research body SPA Future Thinking, offering useful insights into how well we’re doing at getting new bums on saddles. SPA polled 865 learner bikers who’d completed CBT in March 2014 and were assisted by the DVSA, which sent a questionnaire to all recent test candidates, from which 428 learners’ surveys were received. Of these, 358 came from males (84 per cent), 69 from females (16 per cent). Twelve per cent were 16-18 years old, 13 per cent were 19-23 and 74 per cent were aged 24 and over. These percentages broadly reflect the overall profiles of CBT candidates. Gender trouble The survey reminds us that “7,000 to 8,000 road collisions each year where the police were in attendance involved moped riders and motorcyclists aged 16-24”. Fifty-eight per cent of such collisions involved 16-19 year olds. Moreover, 88 per cent of collisions involved males. While this gender distribution is proportional to the profile of all CBT learners, the data reveals that a higher proportion of collisions involving males were severe, with more resulting in death or serious injury, than collisions involving females (24 per cent compared to 13 per cent). Therefore, it’s evidently critical that CBT must be of the highest possible effectiveness. The survey’s remit was to determine how good CBT was in its current format, what trainers and trainees felt about it, and how it might be improved. In-depth interviews with a small sample of trainers found that 23 per cent felt that CBT is too basic, while 17 per cent opined that it is not long enough. Suggestions for how CBT might be improved also emerged, including recommendations for “stronger theory element/theory test” (21 per cent of respondents), a “more practical element” (10 per cent) and “flexibility adapted to the individual” (10 per cent). The latter was a common theme among trainers, 27 per cent of whom felt that “the fixed syllabus was too prescriptive” and that there is “no distinction between first-timer CBTs and renewals/levels of experience” (25 per cent). Some of the conclusions drawn concerned multiple test-takers, the incidence of male learners who behave in a macho manner and/or think they already know what biking is all about and the quality of modular instruction. For now, though, let’s look at the findings to which the trade may be able to react to make improvements. Practical necessity One especially interesting motivation for getting a motorcycle licence, cited by over half the sample, was to be able to use a bike (which henceforth includes mopeds, scooters and pukka motorcycles) for commuting or riding “It’s evidently critical that CBT must be of the highest possible effectiveness” to school or college – just like in the Fifties and Sixties! Dealers, take note; it may be worth upping the ante for small-capacity sales. Indeed, pile-’emhigh-sell-‘em-cheap might prove more lucrative than the bigger margins gleaned from selling just a few pricey hyper-bikes to the well-heeled. While 48 per cent of CBTtakers learnt about the course from a friend or relative, only seven per cent received this information from a bike dealer – surely a missed opportunity. The survey also found a wide disparity between charges, with 36 per cent of companies charging £120 or more, and 29 per cent less than £100. These charges do not always reflect the duration of the course or any guarantee of success. Clearly, dealers could have influence here recommending the local courses that offer the best value for money. (Nevertheless, 54 per cent of riders thought that their course represented good value for money, which dropped slightly to 49 per cent for 16-18-yearolds.) To conclude, the SPA survey makes stimulating reading for legislators and dealers, who between them could positively improve the training offered to wannabe bikers. Warranties come in many different forms. They often perplex dealers and frustrate customers. Joel Combes guides you through the different types, your legal obligations and the devilish small-print W hen an insurance warranty claim takes too long to resolve or is turned down, the customer is liable to get very irritated. In 2006, Auto Trader conducted a survey among more than 1,200 motorists across the UK. Almost 45 per cent of respondents said warranties are not worth the paper they are written on. Over 30 per cent claimed they had not been dealt with satisfactorily and over 40 per cent said that their claims had been invalidated by small-print details. Many warranties do not live up to their promises, and unfortunately when your customer becomes dissatisfied with their warranty, it reflects badly on you. As a motorcycle retailer, you have Sale of Goods duties. Many warranties (which should enhance basic Sale of Goods rights) provide fewer customer rights than those automatically granted when a bike is sold. A customer’s legal rights cannot be restricted by a warranty; he or she is always able to claim for compensation arising from the breakdown of a component that has failed. Around 90 per cent of customers who take up a six-month warranty will not make any claims; they will be pleased with their purchase and happy with the warranty. However, the remaining 10 per cent or so will have an issue and try to make a claim under the warranty. If a claim is handled incorrectly, an issue can quickly develop into a complaint. What’s ‘reasonable’? Of course, not every claim will be valid; some customer demands are unreasonable. The warranty should offer an alternative solution and help your customer understand what is legally (and practically) reasonable. Unfortunately, making a claim under a warranty can be frustrating for a customer. With so many exclusions, terms and conditions, the customer has little choice but to contact you, the supplying dealer. Dealers should regard warranties as a defence mechanism, not something to safeguard consumer rights protection. The customer’s rights are assured under the Sales of Goods Act; the warranty simply provides a set of instructions on how to make a claim if there is a problem. The Sale of Goods Act covers new and used motorcycles/scooters, and stipulates several conditions that all machines sold by a trader to a consumer must meet. These include the requirements that the motorcycle must be: 1. As described. This refers to any advert, paperwork, signage or verbal description made by you. 2. Of satisfactory quality. This covers minor and cosmetic defects as well as substantial problems. It also means that products must last a reasonable time. But it doesn't give your customer any rights if a fault was obvious or pointed out to them at point of sale. 3. Fit for purpose. This covers not only the obvious purpose of a bike but also any purpose your customer queried and has been given assurances about. If you sell a machine that doesn't conform to the above conditions, you are legally obliged to resolve the problem if the customer “Customers can make a claim for compensation up to six years after purchase” seeks redress. The Sale of Goods Act states that if a customer wants to reject a faulty bike, they have to do so within a "reasonable time". The legal definition of "reasonable" varies from case to case and could be just a few weeks from the date of purchase. If a customer rejects a faulty bike within this "reasonable" period, they are entitled to ask for their money back and, in some cases, compensation to cover costs. However, the right to reject goods and get a full refund usually only lasts for a short period, as agreed at the time of purchase. This doesn't mean that the customer has no legal redress, just that they are not entitled to a full refund. Time limit for claims Customers can make a claim for compensation at any time until six years after purchase (in Scotland, five years from discovery of the problem). This is the legal limit on court claims for breach of contract. Don’t panic, though; a claim must always be supported by persuasive evidence. Any repair or replacement you arrange must not cause your customer unreasonable inconvenience. You may have to pay for other costs such as transportation. However, if a replacement is impossible and the machine cannot be repaired economically, or vice versa, then you January – February 2015 35 Business Journal can offer a full or partial refund. Under the amendments to Sale of Goods Act (EC Directive 1999/44/ EC), if you want to dispute a claim by a customer within six months of purchase, it is up to you to prove that the fault was not present at the time of sale. However, after six months have passed, it's up to your customer to prove the bike was faulty when sold. Needless to say, the evidence would have to be strong to lead to a conclusion after such a length of time. A customer has no rights in respect of defects that were brought to their attention before the sale, nor for defects that should have been readily noticeable. A customer cannot claim for damage they may cause to themselves, or if they themselves damage the bike, or they simply change their mind about wanting the machine. Neither can a customer claim for faults that appear as a result of fair wear and tear, nor can they claim for “inaccurate description” if they were aware of it before the sale was agreed. In addition to having legal rights, a customer may be offered a warranty by a dealer on a voluntary basis. It is up to the dealer offering the warranty to decide on the duration. Many used bikes are sold with a one-year or three-month warranty. Selling a used bike without a warranty is also entirely legal. Although warranties do not have to be offered, dealers should provide a written guarantee, claims procedure or simple terms and conditions. This can help manage difficult customers and prevent unsubstantiated claims. A new MOT will prove the bike was roadworthy and a documented PDI/service will add weight in your favour in the event of a claim. Under the amendments to the Sales of Goods Act (EC Directive 1999/44/ EC), warranties given free of charge must be legally binding on the person offering the warranty, written in English and in plain intelligible words 36 January – February 2015 "When selling used bikes with a six-month warranty, approximately 90 per cent of your customers will not make any claims" and available for viewing by consumers before purchase. They must also state that they do not affect the consumer’s legal rights, and state its territorial limits. A dealer’s own warranty must comply with this. Insurance backing With so many warranty companies offering various warranties, it can get very confusing and extremely difficult to know which one to choose. Start by checking the level of cover. If you are looking at insurance-backed warranties, make sure the cover is comprehensive, i.e. all mechanical and all electrical components are covered. A poor level of cover could result in you having to contribute towards a claim. However, if you are considering a dealer-backed warranty, you should choose one with listed components, as this will help manage difficult claims. You should always take legal advice on your customers' legal rights before refusing a claim. Next, read the terms and conditions because you need to make sure that the warranty terms and conditions are not unfair. The Unfair Terms in Consumer Contracts Regulations 1999 protect consumers against unfair standard terms in contracts and The Office of Fair Trading, together with certain other bodies, can take legal action to prevent the use of such terms. Watch out for servicing loopholes, i.e. that the bike must be serviced six months or every 6,000 miles after the date of purchase and then in accordance with the manufacturers recommendation. If you are looking at insurancebacked warranties, you need to check that there are no restrictions on labour rates. Make sure that diagnostics, recovery and bike hire are included, else you could end up paying for them yourself. Make sure you understand the exclusions because although the level of cover in some warranties may look comprehensive. This can soon change when you look at the exclusions. If wear and tear is excluded, you can almost guarantee that most claims for second-hand bikes will be turned down. If consequential damage is excluded, you can be sure you will be contributing something towards the claim. A list of typical exclusions might contain general maintenance and Business Journal components failing due to wear and tear; consequential damage or damage to parts covered caused by parts not covered; faults that were on the machine at time of purchase; timing belts if there’s no service history and they’re not covered for damage caused by the failure of a worn-out timing belt; over-heating damage, cracked blocks, cracked cylinder heads, burnt valves, oil and fluid leaks; and recovery and bike hire. While excluded from most insurance-backed warranties, these issues may be covered by your customers' legal rights. Lastly, research the warranty provider. Find one that understands your liabilities and can give sound advice in awkward situations. Your warranty will be only as good as your warranty provider. Check that the warranty provider and their warranty comply with the EC Directive and Financial Conduction Authority (FCA) regulations. Make sure they have a 24/seven claims helpline and administration service or you could find yourself administering your own warranties while paying someone else to do it. Check your warranty provider has access to technical advice and a good relationship with a reputable network of service and repair garages. Other types of warranty Warranties, broadly speaking, can be divided into three types: manufacturers, insurance-backed and dealer-backed. With a manufacturer’s guarantee, the manufacturer promises that if anything goes wrong with the product due to faulty design or manufacture, or the item otherwise does not live up to its expected performance, it (the manufacturer) will replace the product or make it perform as intended. The manufacturer’s guarantee is usually the best type of warranty, but it is offered only from new and may cover the bike for a limited period only, sometimes on a declining scale. Insurance-backed warranties are underwritten by an insurance company and are an agreement that the insurance company will indemnify the policyholder against loss caused by a covered peril. This type of warranty offers peace of mind, with the backing of an insurance company, that a customer can seek help from the FCA and Financial Ombudsman if they feel they have been unfairly treated; and if you are FCA-approved you can sell other insurance products. "Warranties given free of charge must be legally binding" On the flipside, you will need to be FCA-approved or become an appointed representative of an insurance provider, with the associated training, record keeping and general bureaucracy. The cost of insurance-backed warranties is usually significantly higher than that of dealer-backed warranties, as there is an insurance cost and middlemen costs too. Also, many insurance warranties have exclusions that you would be legally obliged to honour under your customers' legal rights. Dealer-backed warranties come in four flavours. An obligor warranty/ guarantee is a contractual warranty between you and your customers which a warranty provider administers on your behalf. Financial protection is provided through an insurance policy or service contract to cover any losses you may suffer due to bikes failing while under the control of your customers. This type of warranty offers the backing of an insurance company and doesn’t require FCA registration. However, this type may be costly and may have exclusions which you would have to honour. A self-funded warranty is a contractual warranty between you and your customers which a warranty provider will administer on your behalf. Your warranty provider will charge you as each warranty is registered, holding your money to cover any claims made under the warranty. At the end of each year, you will receive back any unclaimed money, less an administration charge. The advantage is that you do not have the extra expense of the insurance company/policy, nor do you have to register with the FCA. The downside is that your money is held by a third party and you administer the warranty. An in-house warranty saves on the extra expense of the insurance company/policy or warranty administrator and requires no registration with the FCA. However, it is your responsibility to make sure your warranty complies with necessary legal requirements and FCA regulations and you administer all your claims Lastly, a verbal warranty is a gentlemen's agreement between you and your customer. It costs nothing and also doesn’t require FCA registration, but it is illegal (under the amendments to the Sales of Goods Act) and therefore not recommended. Whichever type of warranty you choose to provide, remember that none is perfect, and the most important recommendation is to follow the law and the spirit of the warranty process. January – February 2015 37 Column Sticky’s Scooter Scene Sticky’s Scooter Scene The best brands are built, not bought As Lambretta is reduced to a T-shirt motif and Foggy becomes “that bloke off I’m a Celebrity”, Sticky yearns for more meaningful forms of bike-related fame I ’ve covered the saga surrounding ownership of the Lambretta name in these pages before, so I won’t repeat myself. Suffice to say, previous attempts at reviving the legendary scooter brand have failed, primarily because there were so many competing parties trying to rinse every cent out of the name. What does it mean when repute is so easily bought? Modern society has sunk to a level where hard-fought, worthwhile achievements count little towards success. Carl Fogarty, presenting a trophy at the recent British Comedy Awards, made a valid point: winning three WSB titles earned him no invitations to present such awards, but suddenly, having eaten camel cock on I’m a Celebrity Get Me Out of Here, he is a household name. The years of sporting effort, injuries and sacrifice seem like a waste of time. Depressing. More than ever before, business success is all about fame, image and merchandising rather than substance. Many more people wear T-shirts than ride scooters, and the profit line in a branded T-shirt is far higher – so why bother making scooters at all? Old-new hybrids The answer is that there remains a healthy demand for classically-styled scooters with modern technology. This market is currently being satisfied by Vespa, LML, Peugeot and WK Bikes in the UK, and many more players worldwide. The fact is that some customers are willing to sacrifice practicality to evoke a historic style. 38 January – February 2015 The success of vehicles like the ‘new’ Beetle, Mini and Fiat 500 further prove that point. A fresh competitor has recently entered retro-modern scooter market: UK brand Scomadi. This firm has recently distributed its first 50cc models to dealers. Its scooters are unapologetically based on the styling of the 1969 Bertone-designed Lambretta Grand Prix, but sport modern engine and suspension wrapped in painted ABS bodywork. Over the course of a decade, Frank Sanderson of Scooter Innovation and Paul Melici of PM Tuning have dragged their labour-of-love project from a cottage industry, making limited-edition carbon-fibre specials, into a full production-line scooter. Key to the ambitious elevation of their target was Dutchman Robert Olsthoorn of AGM Scooters. He helped to set up the production deal with Hanway in China and is now busy establishing Scomadi’s European dealer network. Sanderson and Melici are personally handling UK distribution. They have established a network of 14 dealers which they plan to expand to 40 by the end of 2015. The £1,895 TL50 model is due to be followed up by a springtime launch for an aircooled 125 priced at £2,495. However, the model that really has scooterists excited is the 300cc version, which is purportedly powered by an Italianmade, fuel-injected engine. No prizes for guessing who is supplying that. While designing and setting up the production of complete 125cc and 50cc models in China has not been easy, it was simple compared to the complexity of getting European engines into a scooter chassis built in China. One of the main hurdles was sheer cost, so Scomadi began a crowd-funding campaign on Indiegogo aimed at raising £200,000 by selling everything from T-shirts and key-rings, through to taking deposits on the first 100 of the 300cc model. The crowd-funding campaign received a very mixed reception on social media. Certainly, there were some who thought that raising money this way smacked of ‘dodgy’ financing. However, the campaign closed having met 27 per cent of the target amount. The pledges secured the production of the first 100 of the 300cc models, which will be assembled in the UK. They also proved that, despite Scomadi being a relatively unknown brand, there are people willing to support it. Interestingly, Sanderson and Melici were once approached about licensing the Lambretta name for their scooters, but declined. I think that was a good move. In my eyes, Scomadi are to Innocenti’s original scooter what Westfield and Caterham are to the original Lotus 7. Scomadi’s scooters look like Lambrettas but aren’t. It is better that Scomadi grows in its own right rather than trading on the historic achievements of an ancient brand. In this era of vacuous fame, that might be the harder path – but is also undoubtedly the right one. Column End User Mark Williams Old bikes, new tricks As he considers resuming a long-planned custom project, Williams hits upon the realisation that there’s good money to be made from used bike bits A s I’ve mentioned in these pages before, I was planning to pander to current fashion and build myself a street-tracker. My main problem was that I couldn’t find a suitable, affordable donor bike. Truth be told, if I’d been able to locate and personally import a Honda VT500 Ascot from the USA – they were never a UK model, sadly – then I’d have done so and saved myself the bother of the build. The Ascot, an unashamed Harley XR750 lookalike, is pretty much my inspiration for my project. But the import business is, I discovered, best left to the professionals. The handful of yank dealers and private vendors I found that had an Ascot for sale were extremely suspicious of some dodgy old Limey trying to do a deal that made sense… at least to a dodgy old Limey. So it’s back to square-one, and thus I managed to find and successfully ‘win’ a Honda CB400N – the laughably misnamed Superdream – on fleaBay. It’s a suitably shabby but a sound starter and runner, and it’s also all of apiece (apart from dodgy wiring and a hand-painted frame). It will thus make a suitable donor for my streettracker ambitions. I’ve invested much research and fantasising in determining the build process and parts sourcing, but the whole experience has reminded me what a fantastic commercial advantage the trade in used bikes enjoys compared to the used car market. As it happens, to raise finance – and indeed liberate workshop space – for the street-tracker enterprise, I had to sell one of my crap old cars, specifically a 1997 Renault Twingo, one of those cheeky little frogeyed hatchbacks so ubiquitous on the Continent but never imported here. Based on Clio mechanicals, they’re huge fun to drive and 50mpg-economical, but the going rate for my 1968 model – partly of course because, being left-handdrive, they’re an acquired taste – is £600-700. In the end, I had to let it go for £550, which is just £20 more than I paid for the CB400N. Nice little value-holder Think about that for a moment. The Honda is 16 years older than the Renault, its electrics a spider’s web of brittle corrosion, the paintwork dented and scratched, the forks seals leaky and the ‘zorst system rusty. None of which matters because of my plans to transform the bike. But the Twingo, with its full-length sunroof, electric everything and near-perfect bodywork will give a caring owner years of service with little expenditure, and yet in, say, five years’ time, it will be worth maybe £200-300. Meanwhile, the unmodified Honda would still be worth over £500, and probably more if some chancers start calling it a ‘classic’ and the likes of David Silver remain able to support it with spare parts (as they probably, inevitably will). So as long as the bike trade can leverage the differential between the value of old bikes versus old cars, it should damn well survive and prosper. And yet one wonders what’ll happen “As long as the bike trade can leverage the differential … it should damn well survive and prosper” with hugely complex and expensive short-run hyper-bikes like Kawasaki’s new H2R or Yamaha’s YZF-R1. Will they be still running around on our roads in 30 years’ time? Actually, they might… if a cunning old friend of mine has his way… He’s just put down deposits for not one, but two H2Rs. Not that he plans to salt them away in the hope that they actually rise in value over the decades. “Someone out there will want a brand new complete engine, engine management system and loom, for a special,” he wryly notes. “That’ll be £15k. Then there’ll be plenty of people wanting the brakes, suspension, wheels and suchlike to upgrade their own tweaked Kawasakis. And finally, someone will stack one within a week, because somebody always does, so that’s the bodywork taken care of. And that leaves a frame and V5. “If I play my cards right, I think I could clear £10-12k profit in a few weeks. Depends on how Kawasaki prices its parts, but for an absolutely top-line, limited numbers, hand-built thing like this, parts won’t be cheap.” Indeed they won’t, and that’s another reason why being an independent bike trader is, these days, perhaps the best automotive business to be in. But now many are also making attempts to market their products to the Chinese. Sean Kerr explains Q uite a lot has been written recently about the arrival of foreign advisors in the Chinese motorcycle industry. Well, now there’s a new phenomenon: foreign motorcycle technology companies actively marketing their products to the Chinese market. This was obvious at the recent China International Motorcycle Trade Exhibition (CIMAmotor) 42 January – February 2015 which featured representation from Continental, JJuan (brake systems), Holland mechanics (spoke wheel machinery), Shad (motorcycle storage boxes) and Ixil (silencers). Continental featured with a huge expo stand; I spoke to one of its employees who commented, “We’re really not here expecting a huge influx of business for Continental. Our products are mainly too expensive for the Chinese market. It’s really just a case of us having to be seen to be represented at these exhibitions, and just hope that in the future the motorcycle industry might change to suit our products. “The Chinese industry is changing; it’s almost unrecognizable from what it was like five years ago in terms of technology, style and quality upgrades but it has a way to go before it uses Column KerrChing “We have to have a presence at CIMAmotor; the Chinese market has changed beyond recognition over the past five years” — Continental spokesperson Continental products in a big way. As I say, we are just here to have a presence in China.” Taste for the traditional Holland Mechanics is a Dutchowned company headquartered in Amsterdam. It specialises in the precision machines to make spoke wheels. CEO Wouter van Doornik reported “Certain Chinese motorcycle factories are interested in our product, mainly the more progressive companies that are looking for the European market. The vogue in Europe has once again gone to spoke wheels – a symptom of the retro bike fashion – and for companies chasing that market, we have the ideal product. CIMAmotor has been great for us. It’s our first time here, and there has been big interest.” Inaki Leopold from JJuan Brake Systems was similarly positive about CIMAmotor: “We exhibit every year at CIMAmotor. We were the first foreign motorcycle technology company to do so, and it’s given us a huge advantage in the market. Five years ago, Chinese companies just looked at us like we were a producer of ‘luxury’ products but now it’s different. We have become an essential part of the Chinese motorcycle manufacturing industry’s infrastructure. “We collaborate with all the top companies and are now looking to expand our influence to the many middle-sized motorcycle manufacturers that now need to upgrade their brake systems in line with international expectations. It is in large part due to our persistent marketing campaigns like this one that we have established ourselves as the number-one international brake system company in China.” Ixil silencers have something in common with JJuan and Shad, in that they all belong to the huge motorcycle industry cluster in Barcelona, Catalonia. General manager Enric Llevadot Porta commented, “Although upgrades in exhausts are not yet a factor in the same way as they are for brakes and EFI – with regard to the changing world laws and the export manufacturers need to meet those laws – we are finding that there is a fast-growing interest in our products from the bigger Chinese motorcycle manufacturers which have the ambition to compete on motorcycle markets that demand more quality. We are looking to become the top international brand in China, and everything is going very much to plan.” Pau Xicola Serrano, general manager of motorcycle storage box manufacturer Shad, commented: “The Chinese are now getting into motorcycle touring in a big way. Also, their commuter bikes are of a higher quality than in the past, so they are requiring boxes of the best quality. “Of course, there are many motorcycle storage box producers in China but Shad has become a market-leader, as Chinese riders are changing their view on consumption and are now choosing to buy goods of a greater quality rather than the cheap but practical stuff of the past. In many cases, Chinese consumers are now asking for Shad by name, and we have been getting many inquiries from motorcycle accessory distributors throughout China.” Touring market China’s new-found interest in motorcycle touring was evident from the buzz around another expo stand. For the first time, the exhibition had a separate section for international tour companies looking to promote their motorcycle package holidays to the huge and growing Chinese motorcycle tourism enthusiasts. One exhibitor, Route 66 International, a Norwegian tour operator, organises motorcycle tours on America’s famous route 66. CEO Arve Stallvik commented: “This was our first time publicising our tours in China, and we were amazed by the interest. People were actually offering to pay us in cash for the tour, there and then. We had heard that there was a growing interest in motorcycle tourism in China but we could never have guessed the amount of attention our product would receive.” All of the international companies represented at CIMAmotor have production plants established in China. Despite having had a manufacturing presence in China for many years, only relatively recently have these European manufacturers started marketing Chinese-made products to the Chinese industry. Inaki Leopold commented: “It is a bit ironic, I suppose, but for many years the Chinese workers were making these products, in China, for European companies without the Chinese industry needing to purchase the parts.
