April 29th 2012. June 2012 OutSpokin’ 4 The State Awareness Rally 2012 was a huge success, even though I was informed Wednesday May 2nd @ 3pm, by Lt. Carl Barth of the Columbus Police Special Events Division, that in a meeting that morning with the U.S. Secret Service, they demanded full commitment of resources from The Columbus Police Department, The Franklin County Sheriff’s Office and the entire Central District of the Ohio Highway Patrol, to serve in the escort for President Barack Obama’s visit to the Schotenstein Center, May 5, 2012 on the Main Campus of The Ohio State University, Columbus Ohio, to kick-off his Reelection Campaign. I immediately called Lt. Shelly Pfan, Special Duty Coordinator for the Delaware County Sheriff’s Office and told her of our predicament, and she said she would devise a plan to escort the Parade all the way to the Statehouse and that is just what she did, only problem, when she submitted the plan to Acting Sheriff Scott Vance, he would not allow his Deputies to cross Jurisdiction Lines. Lt. Phan called me with the bad news and said she would spread the word about our predicament to her fellow Deputies and see what could be done, AND!!! If you were there you saw 5 Cruisers and 1 Motor Deputy to shut down I-71, just like the Columbus Police Motor Unit has done for us in the past and Delaware County Motor Deputy Evans, led the Parade out of the A.D. Farrow NorthStar Dealership parking lot onto I-71 South and led us all the way to the Delaware County Line at Gemini Parkway on I-71, where he peeled off and our most professional Road Captains took over. From this point all the way to the Statehouse the Parade moved smoothly and safely just as if we did have our Columbus Police Escort. I want to thank all of The Delaware County Sheriff’s Office and all who rode in the Awareness Parade and a special Heart Felt Thanks to our Great Road Captains. Legislative News is all good, Scott “Woody” Wood, has some very good news for us, and I want to congratulate him on a Job Well Done, be on the Lookout for a “Call to Action” Soon. I will let Woody fill in the details during his Report. Hey! Do not forget the Membership Drive, AND!!! The June Jam Preregistration Program, urge every Member to buy a ticket to the June Jam NOW, whether they plan to attend or not, THIS IS OUR MAIN STATE FUNDRAISER! A great day and against what seem to be a tradition, no rain. Next year our police escort will be back and that should straighten out some of the chaos on the parade. Not an election year, no surprise visits. Due to the amount of experience in this group, no major issues were reported. We not only let the people of Columbus, some of who didn’t seem very happy, and the great state of Ohio know that we are on the road and to “LOOK TWICE.” But we let the powers that be known that there is still work we expect to get done before the year is up. Our handle bar height bill has good momentum and will hopefully be out of the House and on it way to the Senate by the time you read this. Be ready to start contacting your legislators for passage of this bill. This month is going to be short and sweet. I have the usual updates to the Bylaws. I have also been working with Seneca County for Veterans on the “Traveling Wall” escort. It has been a great experience. It has been great to see the motorcyclists band together to pay tribute to America’s veterans. The ones who protected and still protect our right we hold so dear. It doesn’t matter what you ride or how you ride, only that you ride. And that’s the way it should be. The flyer on this event is in this month’s OutSpokin’. I wanted to leave room for the list of the clubs in Tiffin where you can park and take a free shuttle to the Memorial Walls. The Vietnam Wall, 9/11 Tribute, Iraqi Freedom and Enduring freedom will be on display. We are expecting over 10,000 on the escort. Come and share the honor of escorting these great tributes. I look forward to seeing everyone at the June Jam. Ed Schetter And then there’s the Bylaws. The Bylaw review committee has been busy. Both the Constitution and Bylaws have been reviewed. The Policy and Procedure manual is next. This will move faster only one reading is needed instead of three. If you have any input please send it to me. Here is the hard work of the Bylaw Review Committee for your review: Many changes in the Organizational Manual were nothing more than correcting spelling and grammatical errors. The Bylaw review committee determined that these were a matter of housekeeping and motions are only proposed for changes that alter the intent, meaning or procedures outlined in this document. Bylaw Motions passed at the May 2012 BOD that were introduced at the January 2012 BOD meeting: June 2012 Motion 66: Add new Article 7: Appointment of Interim Officers. Self explanatory. Self explanatory. Motion 107: Add “To notify Region Secretary of any changes to the CBO officer list within 3 days.” To Article VII, Section 25 Duties of a County Secretary. Self explanatory. Motion 108: Insert “(State Office may act as Region Treasurer)” into Article IV, Section 4 The Region Board of Officers. Self Explanatory Motion 110: Add “Any officer leaving office must surrender all appropriate ABATE assets, including but not limited to re cords, property and monies not necessary to continue service to ABATE. (See Property Transfer Form and Instructions.)” to Article IX: Miscellaneous. Self explanatory. OutSpokin’ 6 BIG NEWS! OUR HANDLEBAR BILL (H.B. 316) UNANIMOUSLY PASSED THROUGH COMMITTEE ON MAY 9, 2012. The amendment changing it from the original bill which included a roadside test requiring a 45 degree turn of the handlebars to its amended form which increases the maximum handlebar height to be shoulder high. This vote passed it out of committee to the floor of the general assembly. We need everyone to contact your House of Representative delegate and let them know that you support this bill and ask them to support this bill as well. Let’s get this thing pushed through before we run out of time and have to start again next year. The House’s summer break is coming up, which means we’re running out of time before elections consume the time of our legislators. Call or email your Representative as soon as possible. Also it’s not too early to thank Rep. Cliff Rosenberger and Rep. Al Landis for sponsoring this bill. Please email me with the location of any traffic signal that does not activate with a motorcycle triggering it. According to ODOT, there were only 5 traffic signals reported last year. I am still hearing complaints that this is a major problem. I have contact info and will follow up to make sure the signals are adjusted or replaced. Email location of traffic signals that will not activate with a motorcycle to [email protected]. Last month I included a Voter’s Guide Survey. These surveys need to go out to all candidates at the state level for Senate and House of Representative. There is another copy attached to this report. Email the completed survey to [email protected]. Until next month, Scott “Woody” Wood Government Relations Director ABATE of Ohio, Inc. June 2012 OutSpokin’ 7 Hi Friends, Starting with this article and for the rest of the year, I will be giving you the statistics for fatalities year to date compared to last year. In 2012, January 1 to May 11, we have had 667 crashes, 573 injured, and 23 DEATHS, in 2011, January 1 to May 11, there were 552 crashes, 428 injured, and 20 DEATHS. This is 3 more than last year. We need to make it much lower. These statistics are for Ohio and are correct to the best of my fact finding. Starting soon I will be posting county stats on the web site. As good freedom fighters that we are, let’s inform everyone that we need to be AWARE not only as motorists but bikers as well. This is the time to let the motorists know we are everywhere, and check out your fellow biker. If you see someone not doing it safely, talk to them, maybe they don’t know they are not using their turn signal properly. To everyone that made the trip to Columbus for the Awareness Ride, I would like to thank every one of you. It was a great day - no rain and the sun did come out. Losing our Columbus police and state highway patrol escorts made the day a little trying, but with Jim Elgin’s hard work and Delaware Sheriffs great help and giving us extra help, it all worked out. And with our fellow motorcyclists riding as safely as they did, it was a great day. Now for some thank yous. I would like to thank Bob Secrest from the Motorcycle Ohio Program for coming out and saying a few words and the T-shirts that he threw out [Harley throws like a girl]. He is always there for us. I also want to thank Sam McCoy and the Brothers Forgiven for coming out and giving our prayer and blessing the bikes for our safe ride. Finally, a great big thanks to everyone that pitches in every year and makes it a great run. You know who you are, THANK YOU!!! In every article I bring up the yard signs. Every year I bring up yard signs on the State House steps. The first year about a handful of people said they have signs, the next year two handfuls, this year I was impressed, a lot of hands came up. Now let’s start on your neighbors. Push those signs. THANK YOU!!! We have a lot of volunteers going into drivers ed schools and talking about Motorcycle Awareness. That is our first line to get to kids and make them aware. But if I told you that the state wants to give drivers training on the internet, what would you think? We will lose our chance to have a face to face about Motorcycle Awareness. At this time it is in committee and it is HB487. When you talk to your state representative let them know that new drivers can get very little practical knowledge from a computer. Let us talk to them. In Northwestern Ohio we have a friend in the Charles Boyk Law Firm. They have been helping with hand-outs and advertising in spreading the word about Motorcycle Awareness and safe motorcycling. They have a Motorcycle accident handbook that can be very helpful. We will be seeing them around at our events. I had a great time at Region 9. It was a sunny day and nice number of members came out to the meeting. We talked about safety and education and covered the 3R’s program. I was going to show the power point program but it was too sunny out and no one wanted to go inside, so I will go back again. Thanks again for having me. Something that I have been over hearing when I’m not on the bike, but at work and around, is about our image out on the road. We already know that we are bunch of bad asses, so let’s not portray ourselves as such when we are around non-bikers. In town let’s think before we act regarding noise, speed and behavior. Have fun but think about our image. At the BOD meeting, the subject of pictures came up. It got me to thinking. So I went to the ABATE web site and took a look at the pics posted on there. TJ has done a great job. Send him more and thank him for the great job the next time you see him. For some reason I just never looked our pics. I even found myself in there. Ok I’m done for this month. I hope to see you on the road and I’ll be out with the Roadshow in a couple of places next month. They recently named the Conferees that will negotiate the differences between the House and the Senate. This is a crucial juncture for the legislation that would end the motorcycle-only roadside checkpoints. The language is in the HR 7, (the House bill) but not in the US House passed bill, HR 4348 and not in the Senate bill, S 1813. Its our goal to have the conference adopt the language into the final report. The conference is sure to be lengthy as the two bills are wildly different. The House bill, H.R. 4348, is a short-term extension of federal highway funds that includes a requirement to approve the Keystone oil pipeline. The Senate bill, S. 1813, is a two-year, $109 billion extension. Here is where you come in. Below is the list of every member of the Highway bill conference committee. If one or more of them are your elected officials. call them ask them to support the inclusion of the language that would prohibit federal funding of motorcycleonly roadside checkpoints. Call immediately. This will also be the key issue we lobby for next week at Bikers Inside the Beltway. The event is a national lobby day, sponsored by the Motorcycle Riders Foundation, for motorcyclists to come to Capitol Hill to meet with their elected officials and brief them on all issues affecting motorcyclists at the federal level. This year's event drew hundreds of motorcyclists from 17 States and met with almost 250 elected officials. One of the top issues the attendees were lobbying for was asking their members of Congress to work the HR 904 language into the now conferenced highway legislations. HR 904 is the bill to prohibit federal funding of motorcycle-only roadside checkpoints. During the Congressional Panel portion of the day, the group of riders gathered in a Ways and Means Committee room to hear from a select group of Members of Congress. Addressing the group was Congressmen Burgess, the Motorcycle Safety Caucus co-chair, along with his colleagues in the House of Representatives: Alan West-FL, Scott Rigell-VA, Jon Runyan-NJ, Bob DoldIL, Todd Young-IN, Richard Hanna-NY, Erik Paulsen-MN, and Adam Kinsinger-IL. The MRF thanks all of the Members of Congress who attended the event. Coinciding with Bikers Inside the Beltway week, Congressman Jim Sensenbrenner ran an op-ed in the daily paper, "Roll Call" urging conferees on the highway bill to include language from HR 904. Sensenbrenner said "May is Motorcycle Safety Awareness Month and we welcome motorcyclists from across the country to Washington for 'Bikers Inside the Beltway' week. During this week, Congress should be reminded that effective motorcycle safety can help keep all of us safer on the road, but efforts to expand a government program that arbitrarily roadblocks law-abiding motorcyclists are a misguided, ineffective use of taxpayer funds." This year's event received media attention in both the print and online editions of "Politico", a Washington, DC daily paper and website. Thanks to all who attended and to those who helped support those who attended. This year was a tremendous success. 9 You eat, sleep and breathe motorcycles. So should your insurance company. While there were questions and concerns brought up during discussion, in the end both bills passed by unanimous voice vote with no amendments. Mack Backlund, State Coordinator for ABATE of Minnesota, testified in favor before both committees and answered questions from the committee members. Mr. Backlund thanks Chairmans Gimse and Beard for hearing the bills in their respective committees and Senator Hoffman and Representative Nornes for authoring the bills. OutSpokin’ 12 2012-05-16 - Attention Ohio Motorcyclists! Motorcycle Handlebar Height Bill on the Move! Contact U.S. House Speaker John Boehner and your representative today! House Bill 316, sponsored by Rep. Cliff Rosenberger (RClarksville) and Rep. Al Landis (R-Dover), seeks to relax the current motorcycle handlebar height standard of no higher than 15 inches above the seat or saddle to a more reasonable limit. The bill has eight co-sponsors. At a February 15 hearing on HB-316 before the House Transportation, Public Safety and Homeland Security Committee, it became clear there was opposition to the introduced version of HB316. Representatives Rosenberger and Landis developed an amendment to the bill, addressing concerns raised at the hearing about measurement and enforcement issues. The amendment proposed a new handlebar height standard of no higher than shoulder height of the operator while the operator is seated in the operator’s seat or saddle. On May 9, the committee held a 3rd hearing on HB-316. Following public testimony in favor of amending the bill, Chairman Rex Damschroder (R-Fremont) called the amendment up for consideration. Committee members voted to amend the bill and then voted the amended version out of committee; both votes were unanimous. The next stop for HB-316 is the full House of Representatives. With the Ohio General Assembly soon to enter summer recess, here’s what YOU can do to help HB-316 along – make four contacts: 1) Contact your representative to request he or she support HB316. If you don’t know who your representative is, visit the Issues and Legislation page in the Rights section of AmericanMotorcyclist.com and enter your ZIP code in the box provided. 2) Contact Representative Rex Damschroder (614-466-1374) to thank him for calling HB-316 for public hearings and for favorable passage out of the House Transportation, Public Safety and Homeland Security Committee. 3) Contact Representatives Cliff Rosenberger (614-466-3506) and Al Landis (614-466-8035) to thank them for sponsoring and amending HB-316. When contacting your representative, you might consider using the following talking points to promote support for HB-316: Motorcyclists should be able to customize their machines, especially with equipment that enhances their comfort. Nineteen other states permit motorcycle handlebars to be higher than Ohio’s current maximum of 15 inches above the seat or saddle, while sixteen states have no restriction whatsoever. According to a 2006 Connecticut Office of Legislative Research Report, “We were unable to find any unequivocal information or scientific studies that establish a context for either Connecticut’s handlebar height standard [15 inches above the uppermost portion of the seat when it is depressed by the weight of the operator] or for the relationship between handlebar height and accident experience.” Take a few minutes TODAY to make contact with your representative and those responsible for introducing and moving HB-316 through the legislative process. Ask your representative for his or her support on HB-316 and thank those who sponsored and helped move the bill. On April 19, the American Motorcyclist Association (AMA) sent a letter to U.S. House Speaker John Boehner urging the House to consider H.R. 3199 that would require the U.S. Environmental Protection Agency (EPA) to seek independent scientific analysis on the effects of E15 gasoline as soon as possible. This bill needs the support of the House so the American people will know exactly how the use of 15 percent ethanol blend (E15) gasoline will affect the operation of their vehicles. The House Committee on Science, Space and Technology reported H.R. 3199 favorably, as amended, with a vote of 19-7 on Feb. 7. The bill was introduced by U.S. Rep. Jim Sensenbrenner (R-Wis.). "The EPA's decision to allow E15 into the marketplace will impact every American who owns a car, lawnmower or boat," Sensenbrenner said. “Automakers insist that using E15 will void warranties, lower fuel efficiency and cause premature engine failure. In off-road engines, the effects can even be dangerous for users. "There are serious concerns that the EPA used only one Department of Energy test and rushed E15s introduction into the marketplace," Sensenbrenner said. "This test was limited in scope and ignored a plethora of evidence -- albeit inconvenient evidence for the EPA -- that shows E15 gasoline has a negative effect on engines." The new E15 gasoline formulation may soon appear at a fueling station near you, and you need to be careful how you use this new fuel blend. That is because the EPA, in October 2010, approved E15 for use in model year 2007 and newer light duty vehicles (cars, light-duty trucks, and medium-duty passenger vehicles). In January 2011, it added model year 2001-2006 light duty vehicles to the approved list. Riders should pay attention to this list because no motorcycles or ATVs are currently listed. The AMA is concerned about E15 because it burns hotter than gasoline that contains a lesser amount of ethanol. In engines not designed to dissipate that extra heat, damage in the form of premature wear can result. Although this is a concern in all motorcycles, it's particularly problematic for air-cooled engines found in many bikes. Moreover, use of E15 may even void the manufacturer warranty. Since the approved list includes many light-duty vehicles in use today, refineries, distributors, and fueling stations may choose to offer primarily E15 gasoline because of this action by the EPA. This should concern all motorcyclists and off-highway enthusiasts since this may affect the availability of gasoline with less or no ethanol (E10 or E0). The AMA supports H.R. 3199 and urges its members and, all motorcycle and all-terrain vehicle riders, to contact Boehner and their representatives to voice their support for this bill. A prewritten email is available for you to send Boehner by clicking here. You can send a prewritten email to your representative immediately by following the "Take Action" option and entering your information. The AMA encourages riders to personalize their message by drawing on their own personal riding experiences. Please write Boehner and your representative today and urge them to support H.R. 3199. Please join the AMA to help us fight these efforts by the EPA. More members means more clout against our opponents, and your support will help the AMA fight for your rights – on the road, trail, racetrack, and in the halls of government. Since I was 15, Willie G. has had a paint brush all over Harley-Davidson. My best ride then was a borrowed knuckle, with no fenders and car tires. Willie G. was making them better and they were. He was the Michelangelo of the Super Glide, Low Rider, Fat Boy, Heritage Softail, and Street Glide, among others. It was Willie G. and some other brave souls that rescued Harley Davidson from the investment banker types that brought temporary ownership to AMF (the bowling ball guys). That was in 1981 and I, along with thousands of others, thought Harley was going down for the count. Turns out, not only did Willie G. and the rest of the new owners save Harley from following the path of all other U.S. motorcycle manufacturers, but they built Harley into the highly profitable American icon it is today. It is said that at first, many of Willie G.’s designs were rejected by upper management because they were too radical and impractical - ever heard that saying “go big or go home?” Well, Willie G. went big. And so did HarleyDavidson. ROADHAZARD.ORG FEATURE OF THE MONTH To Rod and the Roadhazard.org team, I went down Reformatory Road today and found that the section of road in question was repaved within the last couple of days. I was also told that about a week after I first contacted you, the town had a meeting and voted to repair the road. Your attention to this matter has probably saved the life of an unsuspecting motorcyclist. I can't thank you enough. Thank you, Tim Harrison P.S. from Rod - ABATE LEGAL HAS ATTEMPTED TO ENLIST INSURANCE COMPANIES OF THIS COUNTRY TO ASSIST WITH ROADHAZARD.ORG. You would think that companies that do a box office business selling motorcycle insurance would be interested in helping with this project. ROADHAZARD.ORG is supported with mostly volunteers and as such needs help. Every road hazard fixed reduces the potential for claims, saves lives, reduces injuries and property damage. This means that the insurance companies will pay out less money. So doesn’t it stand to reason that the insurance companies writing motorcycle insurance would be interested in pitching in to help with ROADHAZARD.ORG? So far, no insurance company that sells motorcycle insurance has offered to help with this service to motorcyclists. Accordingly, ABATE LEGAL calls on Progressive Insurance Company, State Farm Insurance Company, Geico Insurance Company, Allstate Insurance Company and the other insurance companies who sell to motorcyclists, to help with this program that saves lives and helps prevent disabling injuries. What can they do? They can take some of the load off ROADHAZARD and its volunteers by responding to the reports of road defects and providing notice to the responsible governmental entities. Many that work for state highway, city, town and village transportation departments ride. Instead of resenting the notices that ROADHAZARD.ORG sends, our experience is that they June 2012 You can not have too many waivers (releases and hold harmless agreements). ‘Tis the season of our motorcycle activities, and as such, we need to be ready to present to the attendees what amounts to be our silver bullet, our parachute, our get out of jail free card, OUR SUPER INSURANCE POLICY THAT WE CAN AFFORD, and our legal defense to claims that can be avoided with a properly executed waiver. Original waiver is to be retained by waiver overseer until further instructions from your attorney. Do not mail the waiver anywhere, and guard it with your life, as it may be your organization’s silver bullet etc. to avoid litigation. 10. Get names, addresses and telephone numbers of all witnesses. As we talked, I was looking at my bike thinking, ‘Poor old girl. There ain’t nothin’ more pathetic than a horse standing in a rainstorm. But I guess she’s gettin’ rinsed-off purty good.’ A lot of banks have covered “Drive-in” windows.....some of ‘em even big enough for separate lanes. And they work well as long as ya don’t hold up their customers. The same is true with the covered entrances to some of the fancier hotels, motels and restaurants. Even the meanest cop wouldn’t hassle ya for stopping there if it’s really raining (and if you’re not blocking anything). You are, in fact, riding responsibly BY stopping. But one of the weirdest for me was that time last autumn when I had to use the large, wide portico that was covering the side entrance to a funeral home. It was raining so hard that I didn’t even realize anything was going on there when I rode in, shut ‘er down, and climbed off. But the funeral director soon pulled his shiny, black Chrysler limo up next to the bike, got out and stuck a little magnetic flag on its front fender. It was only then that I looked around to see the crowded parking lot behind the place. I prepared to leave in the middle of the storm out of respect, but when the director saw me doing that, he told me not to worry about it because they were gonna wait until it let up (it was really coming down). So I waited too as he and I smoked a cigarette and “At least YOU had an overpass!” A friend of mine named Mary made that remark to someone in made “small talk”. We found we had a lot in common because I watch “Bones” all the time on TV....so of course I knew everything the midst of a conversation that I overheard at Columbiana there was to know about dead bodies and stuff. County’s Daytona Party recently, and I had to smile because withWhen the rain finally slowed down a bit, he said, “Okay, we’ll out even knowing what they were talking about specifically, I immebe heading out soon.” I zipped up and started putting on my gogdiately understood and identified with the gist of it. gles and gloves prepping to leave again as mourners began just One decision you’re going to have to make over and over again if you ride much (and this could be a life or death decision), is pouring out the door. They musta thought I was part of it all because a few asked me how I knew the old lady who died, and why whether or not to pull over and wait if it starts to rain. Of course a sprinkle is pretty damned annoying. But it could turn into something there was a motorcycle leading her funeral procession. At this point I feel I have to point out that I have a sick sense of more, affecting your tires’ stability on the road surface, your over-all vision, and the other drivers’ over-all vision....particularly their ability humor (for those of you who haven’t guessed), and sometimes I just can’t keep myself from saying and doing the wrong thing at the to see you if you have to slow down at all. And you’re not going to wrong time. So, without thinking I mounted, fired up the bike and know if that little old sprinkle is gonna ratchet up into a downpour yelled, “Follow me!” And people actually started running to their until it does or it doesn’t. “Riding the storm out” might sound poetically exciting....and it IS. But it also sucks, and it’s very dangerous. cars, not even stopping to realize that the old lady was still laying at rest in the viewing room! All I could say to myself was, ‘Oops!’ as I A cloudburst usually seals the deal for me....that is, if I see anywhere to stop. As I waited, I could see the funeral in a really bad sudden rainstorm while on the scoot and had to rely director in my rear-view mirror, just standing there slowly shaking on the cover of an overpass for a while, I also think of the times I’ve his lowered head. I mean, who the hell would And then the bar-maid would have to stop what she was doing to run around with a mop wherever I walked or stood. In my immature, be washing their car when it’s raining? As a matter of fact, I pay attention to where they’re located when I’m cruising around just for young mind it made the statement, “I’m a bad-ass biker! SO bad that I even ride in weather like this! Hear me squish, you boring that purpose, which DID come in handy once..... people!” LOL. But it never DID get me laid.....especially by the barSince I remembered that one was ahead of us up the road a bit, I suggested stopping there to my riding buddies when a steady maids. In my present immaturity, I still rev up my motor and try to rake downpour started in the midst of a poker run. And I ally trickled in behind us when they saw that we were stopped hope I never out-grow that. But the funny thing is....I’ve been using there. We filled up all four of its bays for a while, so of course we “stock” pipes for the last few years, so it sounds sorta silly. I guess got a little party goin’, and even had our own wet-T shirt contest! It ended up being the funnest run I was ever on....which goes to show it’s the thought that counts. Also remember that this is our MAIN money-making event each year for this organization. I might even get to come this year. But there IS a huge annual motorcycle event here in Newton Falls (my home town), and there’s a chance I’ll have to help man the ABATE recruitment and product booth for it, so I might have to be there instead. A BIG imperative these days...in fact a MUST if we’re even going to survive as an organization, is to sign up as many new members as we can. But like I’ve often said, I never know what the hell’s happening until it’s done happened already. How’s that for proper grammar? I really get off on ignoring my computer’s spellcheck and grammar thingy when it bitches at me LOL. (That’s probably why I’ve been divorced three times.) And this just in: Like I told ya’ll a few years ago, a group was formed in 2007 promoting TOTAL equality for women. This fine freedom fighting organization can be found at www.GoTopless.org. This year, their national day of focus will be on Sunday, August 26th. I just thought I’d give ya a heads up a few months early to prepare for this glorious day. So, all you ladies who might be interested should take notice and check ‘em out. I support this cause by going topless often. You can too. It’s your right. Don’t let the twisted morality of a puritanical culture keep you bound and concealed any longer. Ours is NOT supposed to be a repressive society! Would you allow yourself to be intimidated into wearing one of those damned “burkas”, like the women in Arab countries are forced to wear whenever they go out in public? HELL NO! This is the United States of America by God, Home of the BRAVE and FREE!! So BE FREE! (See? My patriotic enthusiasm gets me all excited just thinking about it.) One final note: (and I just might regret this, but I rarely get much feedback from anything I write anyway) Anyone interested in making a road trip to attend a house-party here at my home on July 28th in appreciation of those who support ABATE should read my submission for Trum/Mah County, Region Zero, in the “Region News” section of this issue for details. Just remember to phone or Email me to let me know, and for further info. My phone number and Email address are both listed there. Catch ya, Bummer (Continued from Page 15 - Ask Our Lawyer, R. Taylor ) and help the gyroscopically challenged. However, before a ride is exactly the wrong time to start giving instructions on how to ride. Remember, it is the state’s job to do that with trained instructors. There is a rule of law that places liability on your shoulders if you ASSUME a duty, a duty you may not have had under the law, and then fail to perform that ASSUMED duty properly. So, if you assume a duty of providing additional rules and riding instructions for the ride, you may have just set yourself up for a lawsuit, if they can claim your instructions were inadequate or just plain wrong. Remember, all you need to get sued is a lawyer with very little to do with a client that has a filing fee. Here are the three commandments for ride leaders that will best keep you out of the courthouse and away from the process server jockey. 1. Rely on and assume that the riders are trained and skilled. After all, the state has sprinkled holy water on them and provided them a license/endorsement to ride a motorcycle. 2. Reaffirm the obvious -- all riders are to follow the rules of the road and to obey all laws. Don’t make up any new ones. Common sense is your key to safety. The riders on the ride are the ones that have to use it. 3. Make sure all riders know the road that is being taken to the destination. Map quest takes it off you -- use it. If the ride is escorted by the law, put it in their hands and off your shoulders. P.S.: Check your homeowners insurance policy. You may have coverage under that policy as a volunteer for a not-for-profit organization like a veterans group. That may be nice to know, so call your agent. Ride Safe and Free, Rod Taylor ABATE Legal Services ABATE, though many know it not, is one of the greatest rights organizations ever; but what it reaches for by far exceeds what it has achieved, and what it has achieved is magnificent. Remember, injured ABATE members pay only 28 ½% of total recovery and expenses as approved by client, consistent with and conforming to applicable state law. Elsewhere, you may pay 33 ⅓%, 40% or even 50% of your recovery. And, ABATE members are not charged for recovery of damage to your motorcycle, and have access to a 24-hour toll-free telephone number. Regarding the rules for a ride, the following is a good guideline to keep you out of the courthouse -- and from getting sued. You should assume that all riders have been adequately trained by the state that has issued that rider If you have any questions you would like to ask the lawyer, please a license to ride. At the end of his legislative report, Lion Man asked the members to help organize participation in a parade in Chardon in support of State Rep. Capri Cafaro (who has repeatedly shown her support for our issues), that was scheduled for the next weekend on April 28. A number of people threw up their hands to offer their assistance. Later at the meeting I urged people to consider becoming part of the “Recruitment Committee” that I’m forming to do things like distribute flyers, applications, and to staff an ABATE concession at bike nights, swaps etc...and much interest and support for that was shown. It was further suggested by a member that we promote ourselves at other groups’ events and runs (with their approval of course). If anyone reading this is interested in joining this committee, please contact me at 330-872-1198 for details. Mah/Trum county’s “Not Just Another Damned Poker Run” will be out of the Bristolville Inn on the corner of Routes 45 and 88 in Bristolville June 16. Ya can’t miss it. Sign up starts at 11 a.m.; the first bike goes out at noon. This run is always a good ‘un, so I hope you can make it. I just talked to Mike “Zedo” Sklepko (our Road Captain) and he said that one of the stops will be at Pooch’s in Mecca, and to make sure y’all know where THEY are so you can find it for our “Hog Roast and Weekend Party” coming up there next month on July 21. ABATE of Ohio’s state party, “The June Jam,” will be held June 22, 23, and 24 in beautiful Hocking County. A flyer will be elsewhere in this magazine giving you directions and all the details. I hope you can make THAT too! On that Sunday, of that same weekend, if you don’t go to the Jam, or better yet if you DO go and you get back in time...my hometown of Newton Falls will have its “26th Annual Motorcycle Madness” bike run and show which is part of a weekend event. Their car show is always on Saturday (the day before), followed by the bike stuff on Sunday the 24th. The center of town is roped off and bikers, vendors and events take over downtown Newton Falls for the day! It still absolutely amazes me that things like this, and also Warren’s “Harley in the Park” September 15, are even permitted to happen. But I guess whenever making money for any municipality is concerned; social prejudices against bikers are temporarily parked at the curb LOL. ABATE Region Zero will be having a recruitment table, or possibly even our product booth, at both events if all goes right. Call me at June 2012 330 872 1198 if you wanna help out. DON’T FORGET: There will NOT be a meeting in June due to everything that’s happening this month. July’s meeting will be at Pooch’s on July 7th at 6:30PM, which will be the 1st Saturday in July (instead of our usual 3rd) because our Hog Roast is on the 21st and the “Brothers Regime Chicken Roast” is on the 14th. Note: There will be a free (of course) water-volleyball, pool, and bar party here at my house starting at noon on Saturday July 28 in honor of, and to show appreciation FOR, all of our members (local and not) who have volunteered to work events LIKE our Hog Roast, our poker runs, those who have organized and attended meetings ...and all of the other things that usually require someone to give up their time, effort and often some of their own money on behalf of ABATE. Come help me show these people how much we appreciate what they do. Overnight tent camping (or sleeping on a couch, on the floor, in a bed or wherever) is urged for those who might party too much to drive home, and I always throw out a GREAT breakfast. There will be a fire out back, the hot-tub and pool is open, the bar is stocked (but BYOB if ya can). There will be “Corn Hole” tossing on the deck, and we might even make some acoustical music around the campfire later in the evening (as long as we don’t piss off my neighbors LOL.) My place is VERY easy to find, but anyone interested MUST phone me at 330-872-1198 (Jeez! My phone number is all over this month’s report!), or email @ [email protected] ASAP so I can at least get an idea of how many are coming. You know I finally was able to get out to take a ride with a brother and got to take in some of the beautiful riding that we have here in our great state of Ohio. We just cruised and sometimes stopped to take in the sights. Being able to ride those roads at our own pace, taking in each and every curve like we owned it – we realized that OutSpokin’ 27 nothing gets better than this.
