CBS sees indecency victory as an “important win” for broadcasting. Janet Jackson’s 2004 Super Bowl “wardrobe
malfunction” led to stepped-up indecency enforcement from the FCC. CBS paid the $550,000 fine but appealed to the
U.S. Circuit Court in Philadelphia, which ruled yesterday the FCC “acted arbitrarily and capriciously” for issuing a fine for
an unexpected, fleeting flash of nudity. The three-judge panel decides the FCC changed its policy retroactively without
warning. Chief Judge Anthony Scirica explains “The FCC may change its policies without judicial second-guessing.
But it cannot change a well-established course of action without supplying notice of and a reasoned explanation for its
policy departure.” CBS calls the decision an “important win for the entire broadcasting industry” and says it hopes the
ruling will “lead the FCC to return to the policy of restrained indecency enforcement it followed for decades.” But the
Parents Television Council says it “borders on judicial stupidity” and is urging Congress to give the FCC more power to
enforce indecency rules. It’s the FCC’s second setback — last year the Second Circuit in New York reached a similar
conclusion. The FCC has appealed that decision to the Supreme Court, which is expected to hear the case in the Fall.
NAB spokesman Dennis Wharton says “We’re pleased the courts are providing badly-needed clarity on efforts to regulate
broadcast content.” Progress & Freedom Foundation president Ken Ferree, a former Media Bureau chief, agrees, adding
it’s time to read the writing on the wall, “The courts are not going to allow the FCC to play the role of media super nanny.”
Indecency waters may’ve just become even murkier. Washington attorney John Garziglia calls the lengthy Super Bowl
ruling one of the most ponderous, legally-obtuse indecency decisions he’s have ever read. “Many of the 102 pages trek
through various FCC indecency decisions without adding much more light to the subject of what is actionably indecent,”
says Garziglia. “This case is one more indication that the Commission’s indecency enforcement efforts may be crumbling.”
The big challenge will come in the next Supreme Court term when the nine justices take up indecency enforcement for
the first time in 30 years. In the meantime, Garziglia tells Inside Radio caution is the best strategy. He says “Despite the
questionable legality of the Commission’s indecency enforcement, broadcasters need to keep their delay boxes humming,
lest a fleeting, unintentional, indecency cost many thousands of dollars in fines and legal fees.”
Rivals no more: Sean Hannity’s new co-syndication deal seen as a template. Inside Radio hinted weeks ago Hannity
would split his syndication between Citadel’s ABC Radio Networks and Clear Channel’s Premiere Radio Networks. What’s
also noteworthy is the fact it may be just the tip of the iceberg. In a joint statement the two companies say “Going forward,
Premiere Radio and ABC Radio will strategically join forces in special cases.” Citadel CEO Farid Suleman says “This
new partnership is groundbreaking in the syndicated programming arena.” Insiders say Suleman approached Clear
Channel Radio CEO John Hogan in April about working together. The outline of the deal was quickly
developed, while specifics were worked out. His motivation was to share the risk and spread the
opportunities associated with a high-value talent. ABC spokesman Omar Thompson says “We
wanted to protect profitability and revenue associated with the Hannity show. The bulk of
revenues for us is on the local level.” Thompson says “It’s a very unique time in the market,
so we are very open and willing to look at different solutions.” Westwood One CEO Tom
Beusse says those “odd times” can lead to “strange bedfellows” but predicts “You’re going
to see more partnerships and working together.” He tells Inside Radio the coziness

isn’t limited to ABC Radio and Premiere. “We’re even more independent, we don’t own any stations, so I think you can
look forward to us partnering with either or both of them.” Beusse says that could include content development as well as
ad sales and syndication.
Hannity: “This deal is truly a dream come true.” People close to Sean Hannity say his biggest dilemma was taking his
show to the next level, without burning bridges with those who got him this far. By striking a deal with both ABC Radio
and Premiere, he was able to find an innovative way to do so. Under the terms of the agreement, Citadel will continue to
distribute Hannity’s show to stations it owns while Premiere will syndicate to Clear Channel stations and the rest of the
industry. In late-December, advertising sales duties will transfer from ABC Radio to Premiere. Hannity says “If anybody
told me in 1987 when I began my radio journey I would be in this historic partnership with the two best syndication
companies in radio, I would never have believed them.” The five-year contract begins December 28 and will pay Hannity a
reported $100 million plus a portion of the show’s revenues.
Latest HD Radio upgrade — cordless. It’s hard to get excited about development of a cord-free receiver in the iPod era,
nevertheless it is a step forward for HD Radio. Coby next month will release a pair of new receivers including the HDR700 portable unit (which also play MP3s) that will sell for $149 — the lowest-price to date. The other unit is a sleek-looking
brushed aluminum receiver that sells for $99. The radios debut in the midst of HD Digital Radio Alliance’s $57 million, 13week marketing blitz across more than 700 stations urging listeners to “upgrade” to HD. Meanwhile, one alert Inside Radio
reader points out a Sony unit is selling for $50 on Amazon.com, thanks to a $50 rebate.
Milestone: New York gets its final diary-based ratings report. The Spring survey is the last based on diary data
collection as the market transitions to PPM. Same is true for Los Angeles and Chicago later this week. Emmis’ urban AC
“Kiss” WRKS was #1 among 12+, 25-54 and 35-54 demos. It also does surprisingly well (#3) among 18-49s. PD Ebro
Darden says “After 25 years of Kiss dominance in the diary, it is a fitting way to close the history books.” Clear Channel
AC “Lite FM” WLTW dropped from first to third, behind clustermate CHR “Z-100” WHTZ. The book also marks the first
anniversary of the return of classic hits WCBS-FM. It comes in tied for #10. In Long Island’s final diary-based report,
Clear Channel AC WALK-FM kept its perennial place at the top. Read all the latest ratings numbers on Page 4.
Minority Media & Telecommunications Council plots “road map” for diversity. The group has formulated a proposal
to “show how present-day race discrimination and the extensive lingering consequences of segregation can entirely be
swept out of” radio and other industries. “The Road Map for Telecommunications Policy” arrives in time for this week’s
annual “Access to Capital Conference” in Washington, D.C. Among the MMTC’s recommendations are to restore the
tax certificate policy in an effort to grow minority broadcast ownership. MMTC says the tax certificate, which ended in
1995, “did more to advance minority broadcast ownership than any other policy in the history of the Commission.” When
it comes to advertising, the MMTC wants to authorize the Federal Trade Commission to prohibit racial discrimination in
spots, saying advertisers “routinely” discriminate against minority-owned radio stations. The proposal also includes a
recommendation to hire more minority employees and collect data on EEO, transactions and advertising.
MMTC urges PPM review. The Minority Media & Telecommunications Council is asking the FCC to explore PPM’s impact
on minority listening by conducting a “fact-finding inquiry” on PPM. In its new “Road Map” report, MMTC writes that PPM
“under-samples minorities.” The report goes on to explain that “unlike the traditional diary method it is replacing, PPM
contains no implicit or explicit specific measure of listener loyalty to particular stations — a critical oversight since minority
consumers tend to be considerably more brand loyal than other consumers.” MMTC stressed the importance of PPM
because of valuable advertising dollars at stake, adding that without fixing PPM issues “The nationwide rollout of PPM
would decrease minority radio stations’ annual revenues by as much as $500 million.”

Despite a tough economy XM adds 322,000 subscribers in second quarter. Fears a looming recession could soften
sales of a $13-a-month radio service have been dampened somewhat, as XM announces a 3% jump in its subscriber
base from first quarter. That’s better than most analysts predicted. Citigroup’s Tony Wible says “Results were ahead of
our expectations, which we view as a reassuring sign given the challenging macro environment.” XM now has 9,653,000
subscribers. The number of people turning off their subscriptions also fell, as the churn rate dropped from 1.77% to
1.67%. Even so, XM still expects its second quarter losses to be about $35 million. Stanford Group analyst Fred Moran
tells Bloomberg “It confirms they need the merger to go through in order to help their financial outlook with the benefit of
cost savings.” There’s a growing belief on Wall Street the FCC will approve the XM-Sirius merger.
Capitol Broadcasting seeks extra year to spin Wilmington FM due to new FCC policy. Jim Goodmon’s $12 million
deal last week for NextMedia Group’s six Wilmington, NC stations is one over the current ownership limit. NextMedia was
grandfathered to own the five FMs and one AM there, but Capitol Broadcasting will need to sell one FM. In an FCC filing
it asks for an extra 12 months to find a buyer citing the new FCC diversification of ownership policy that took effect last
month. Capitol tells the Commission it intends to divest “at least one” FM in the grandfathered cluster to an “eligible entity”
including a minority or women-owned company. Capitol proposes to put at least one FM into a trust over the next year
while it looks for the buyer.
Pool accident claims life of Baltimore’s “K-Swift.” Baltimore and Radio One are remembering urban “92Q” WERQ
evening jock Khia “K-Swift” Edgerton, who died early yesterday after a pool accident at her home. She was 29. Edgerton
was hosting a pool party with friends when she was found unconscious in the water. The cause of death won’t be known
until an autopsy is completed. The Baltimore native began working at Radio One ten years ago as an intern. She also
owned her own graphics, production, and management company, Club Queen Entertainment. PD Neke Howse says “This
is an incredible loss not only for Radio One, but for the entire community and music industry.” WERQ GM Howard Mazer
adds “Her love and passion for everything she did was the key to her success.”

Idaho — Along the central Idaho-Washington border, Bolland Enterprises buys CHR “Cat 101.3” KATW, classic rock “Rock
102.9” KVAB, oldies “Cool 94.1” KCLK-FM and “Sports Fan 1430” KCLK from Pacific Empire Communications for $3
million. Mark Bolland will operate the cluster under a time brokerage agreement until closing. Pacific Empire still owns six
Idaho and five Oregon stations.
