CONTROLLED WOOD RISK ASSESSMENT LOSAN ROMANIA CONTROLLED WOOD RISK ASSESSMENT SC LOSAN ROMANIA SRL Background: SC Losan Romania SRL since 2005 held the FSC (Forest Stewardship Council) certificate for Chain of Custody and ever since, constantly increased the volume of purchased FSC certified wood. First, the company focused on purchasing 100% certified wood, with the intention to purchase controlled wood as well, during the next five years. In this respect, the company is implementing procedures on the traceability of the wood product at the level of company and suppliers, in order to avoid purchase and trade with wood from the following sources: 1) Illegally harvested wood; 2) Wood harvested in violation of traditional and civil rights; 3) Wood harvested in forests where High Conservation Values are threatened by management activities; 4) Wood harvested in forests being converted to plantations or non-forest use; 5) Wood from forests in which genetically modified trees are planted District of origin District level: o County: Arad, Arges, Bacau, Bihor, Botosani, Caras-Severin, Covasna, Dambovita, Hunedoara, Iasi, Ilfov, Maramures, Olt, Satu-Mare, Suceava, Timis, Valcea. The district of origin may be considered low risk in relation to illegal harvesting when all the following indicators related to forest governance are present: 1.1 Evidence of enforcement of logging related laws in the district Comments or justifications for county risk level Logging enforcement is done according with Law 46/2008 (Forest Code) and Ministry of Environment Order nr. 606/2008 regarding the logging periods and harvesting technique. Every logging activity is done with approval from Environmental Protection Agency and Territorial Inspectorate for Forest and Wildlife Management (ITRSV) Page 2 of 30 CONTROLLED WOOD RISK ASSESSMENT LOSAN ROMANIA Concerning the general Rule of Law enforcement in Romania according with the General Rule Law of Index of World Bank in 2010 Romania index was 54 :100 which is under the <75% but with a constant increasing tendency in the last years. Comments or justifications for county risk level Romania is having in place a good system of harvesting control (the harvesting licenses and the authorization of forest harvesting starting with 2008).According to the Romanian legislation the following steps are implemented in order to be issued the authorization of harvesting within a forest area: o Having a Forest Management Plan for 10 years approved by the Forestry Authority (Law 46/2008 - Forest Code art.97) and the list of yearly cuttings plan has to be approved by the Environmental Agency according with Minister Order 1789/2007. o Standing wood evaluation document - APV (in Romanian) - registered in the SUMAL National system (On-line Wood tracking system approved through Gov.Decision 996/Oct.2008 regarding the wood transportation and harvesting) o Harvesting authorization for a determined period ( up the six months) and for a certain type of silviculture treatment is issued according with Minister Instruction Order for Forest Exploitation and Harvesting Periods no. 606/2008. Logging sector and the logging company is checked by the forest engineers from the FMU and inspectors from Regional Inspectorates for Forest and Wildlife Management. If it is a private forest the owner of the forest is also present at the logging sector reception. Comments or justifications for county risk level According with the "Status of Romania's Forest in 2007" report, prepared by the Ministry of Agriculture and Forest in 2008, the volume of wood illegally logged and harvested without legal permits or in violation with the national law was at the level of 175743 cubic meters representing 0,01% from the total volume of 16,7 million cm harvested in 2007. Ministry of Agriculture, Forestry and Rural Development elaborated in 2007 National Plan Against Illegal Logging. Information from this study reveals that total area of clear cutting was 32524 ha since 1991 from 6,27 million ha of total area of forest from Romania. From last information according to Suceava Territorial Inspectorate for Forest and Wildlife Management (ITRSV) the volume of illegal logging for Suceva, Bacau, Neamt, Botosani, Iasi for the period 01.01.2010-30.09.2010 is19.930 m³. According to Ramnicu Valcea Territorial Inspectorate for Forest and Wildlife Management (ITRSV) the volume of illegal logging for Vâlcea ,Gorj, Dolj,Olt şi Mehedinţi for the period 01.01.2010-30.09.2010 is 1.944 m³. For remaining districts covered by other Territorial Inspectorate for Forest and Wildlife Management Losan wrote an official letter demanding public and official situation with illegal logging, but no answers received from authorities. Since 2008 SUMAL –“Electronic system at national level for tracking wood” is implemented in every FMU and company which is transporting, selling or processing wood. Periodically results of the SUMAL are verified by inspectors from Inspectorates for Forest and Wildlife Management. Page 4 of 30 CONTROLLED WOOD RISK ASSESSMENT LOSAN ROMANIA According to forest protection and other specific regulations there are specific activities aiming to protect the forest : - Minimum two inspections in each Canton Silvic (Canton Silvic = forest area in responsibility of one ranger)- Inspections in harvesting areas (minimum two in each harvesting place during harvesting activities)- patrols- Checking points on forest and national roads- Barriers on forest roads in areas with risk of illegal activities. A study was done by WWF Danube Carpathian Programme and Forest Information and Certification Center Brasov together with Forestry Inspection Directorate from the Ministry of Agriculture and Rural Development in order to have an official overview about the situation of illegal logging. The areas have been set up during the public consultation/workshop organized in Geoagiu, Hotel Diana 15-17 November 2006, by the WWF Danube Carpathian Programme and Forest Information and Certification Center Brasov together with Forestry Inspection Directorate from the Ministry of Agriculture and Rural Development. The risk areas were delimitated on maps together with the forest inspectors from the Regional Forest Inspectorates. The activity of identifying risk areas was part of the Ministry of Agriculture Action Plan for fighting against illegal logging and illegal timber trade. Forest property size. 3. Number of complaints and letters addressed to the regional forestry inspectorates claiming illegalities in a certain forest area. 4. The volume of illegally logged wood registered official during the forest inspections. 5. Number of penalties and sanctions applied by the forest inspectors. 6. Number of small size timber and wood sawmills 7. Social problems and poor communities. 8. Illegal or abusive forest restitution of important areas. 9. Political pressure in cases of investigations done by the forestry inspectors 10. Lack of forestry cadastre 11. Comments or justifications for risk level According to Corruption Percentage Index Romania has a rate of 3.8. Because the index is under 5 we consider "unspecified risk" the criterion 1.4 and entire category 1. For this Losan developed his own monitoring programme for a part of his suppliers to control the origin of wood at the level of FMU. According to the latest (2010) evaluation results from Transparency International, the CPI for this Romania is below 5. The indicator 1.4 is thus considered as unspecified risk, resulting the whole category 1 to be of unspecified risk status. Further the company develop an internal monitoring system for suppliers which includes field verification at the level of FMU. Briefly some of the requirements which have to be fulfilled by the FMU’s and companies suppling Losan with controllled wood are presented below: a) General requirements for companies at the entrance in group of controlled wood suppliers and every time when a new logging sector is contracted: o Copy of harvesting licence from Ministry of Forestry o Copy of logging contract, tender contract o Copies after maps of logging sector and management plan which are compared with WWF's county maps on HCVF and potential threats. b) Ongoing requirements: - Copy of each transport document and invoices with at least following elements: o Number of logging sector o Name and adress of FMU/supplier company o Species o Volume - Copy after APV (document with all logging sector details in terms of wood origin) Page 9 of 30 CONTROLLED WOOD RISK ASSESSMENT LOSAN ROMANIA All suppliers and FMU’s included in Losan internal monitoring programme are assessed by Losan before starting to purchase controlled wood. Assessment is done also periodically and according to sampling monitoring schedule. Field verification is done periodically according to procedures developed by Losan to control the origin of timber coming from FMU. Besides, Romania is implementing through Hot. Guv. no. 996/2008 and Order of Minister of Agriculture and Forestry no. 583/2008 software called SUMAL- Romanian Electronic Wood Tracking System. This system register all volumes of wood transported, processed and sold in Romania starting with the level of FMU and continuing with companies. B. Wood harvested in violation of traditional and civil rights District: County level (Arad, Arges, Bacau, Bihor, Botosani, Caras-Severin, Covasna, Dambovita, Hunedoara, Iasi, Ilfov, Maramures, Olt, Satu-Mare, Suceava, Timis, Valcea) Level of assessment: Low 2. The district of origin may be considered low risk in relation to the violation of traditional, civil and collective rights when all the following indicators are present: 2.1 There is no UN Security Council ban on timber exports from the country concerned; Comments or justifications for county risk level There is not any UN Security Council export ban in Romania according with United Nations and Global Witness sites. Romania ratified at 17 Dec 2009 the Agreement to the International Tropical Timber Agreement. Agreement was adopted on 27 January 2006 at Geneva by the United Nations Conference for the Negotiation of a Successor Agreement to the International Tropical Timber Agreement, 1994. Women and men’s both have the same rights, to work and to be part of Labor Unions and to be beneficiary of social rights Romania has ratified all ILO Conventions concerning the child labor and ILO Fundamental Principles. National legislation concerning the ratification of ILO Convention 182/199 regarding the Child Labor and different forms of child labor - ratified through Law 203/ 2000 - 15.11.2000 concerning child labor. Romania is not mentioned in IPEC database as a country with problems in child labor. According with Ministry of Environment and Forests there are 1582 local communities (associations of forest owners) who are in the possession of 526042 ha of forests after the restitution process in 2002-2005.These forest areas are managed only by authorized FMU (state or private) according with Gov.Order 139/2007. Romania ratified The World Cultural and Natural Heritage Convention (UNESCO, Paris, 16 November 1872) by Decree 187/1990 There are no conflicts in all the districts related to traditional and cultural rights. There are registered conflicts only related to private property (restitution process) of local communities which is also covered by the Romanian legislation. Implementation of restitution laws (Law 18/ 1991; Law 1/2000 and Law 247/2005) sometimes leaded to unavoidable disputes. The number of disputes related to the first two laws significantly decreased while the implementation of Law 247 may lead to some other actions into Court when restitution right is not clearly provided. Although the number of such actions may be smaller, the envisaged areas may be larger (e.g. situation of Romanian Orthodox Church Fund) Law 247/2005 is providing for restitution of all properties to former owners. The law includes mechanisms to solve potential disputes. Currently the law is under implementation. Comments or justifications for county risk level Romania has on its territory important biodiversity values and threatened or endangered forest ecosystems. According with www.worldwildlife.org there are following eco-regions on Romania's territory: Eco-region - PA 0504 - Carpathian Mountain Forests , PA 0404 - Balkan Mixed Forests, PA 0412 - Central European Mixed Forests, PA 0419 - East European Forest Steppe. Romania lies at the geographic centre of Europe and includes five of the ten bio-geographic regions (BGR) officially recognized by the EU: alpine, continental, panonic, pontic (euxinic), and steppe Figure 5. Map of bio-geographic regions The Alpine bioregion (54,213.68 km2) includes 33 habitat types of EU importance (3,110.6 km2 ); the Continental bioregion (127,810.84 km2) includes 38 habitat types (3,247.86 km2); the Pannonic bioregion (14,345.84 km2) includes 16 habitat types (1,028.95 km2); the Pontic bioregion (1,798.58 km2) includes 23 habitat types (603.84 km2); the Steppic bioregion (40,147.65 km2) includes 18 habitat types (1,168.97 km2). In Romania there is a coalition of 52 NGO"s called "Natura 2000 Coalition" for monitoring activities in Natura 2000 sites and in Protected Areas, mainly in Natural and National Parks. All the members, more then 100 in Romania are monitoring management activities and potential threats in this areas. Other districts are not covered by IFL. According to WWF Global 200 Ecoregions Romania is part of the Carpathian montane conifer forests (PA0504) which includes Czech Republic, Poland, Romania, Slovakia, and Ukraine. Comments or justifications for county risk level Romania have a good network of protected areas covering 5,2% of its territory and 15% of the forests. There are 13 National Parks, 13 National Parks, 3 biosphere reserves, 617 nature reserves, 234 nature monuments and 55 scientific reserves. In 2007 an area of 13 % from Romania's territory was designated as part of EU Natura 2000 network of protected areas according with Habitat and Bird Directives. Harvesting in core areas or sustainable development zones within protected areas is done only with the approval of the Protected Area management team and Environmental Agency - Minister order 1798/2007 Special Protected Areas (SPA) represents 11,89% from Romanian territory. Sites of Community Interests (SCI) represents 13,21% from Romanian territory. Most of them administration and will have in two years Management Plan according to legislation. In 2006 WWF DCP Romania create a map of HCVF's category 1,2 and 3. It was included core areas from Natural and National Parks, Intact Forest Landscape identified by Greenpeace There is a guide for HCVF identification developed by WWF DCP Romania in 2005 ("Toolkit for HCVF Identification") which includes also management measures. All core areas from Natural and National Parks are protected through legislation and no logging activities are allowed. There is identified at the level of each county (district) HCVF’s category 1, 2 and 3 by WWF Danube Carpathian Programme in project „WWF/IKEA Responsible Forest Management and capacity building in Romania, Bulgaria and Ukraine” as fallows: HCVF 1 – Forest areas with high biodiverity values or with globally, regional or national importance and includes: o o o o o o Scientific reservations Natural reservations Natural monuments in forest Special Protected areas included in protected areas Integral protected areas SCI and SPA Natura 2000 sites HCVF 2 - Large landscape level forests, with global, regional or national importance There is one Intact Forest landscape identified in Romania: the Intact Forest Landscape identified in Caras Severin-Hunedoara county by GreenPeace and Romanian Research Institute and Forest Mangement Planning. The entire surface is included in the Retezat National Park and Valea Cernei Domogled National Park. The others districts are not covereed by the Intact Forest Landscape. HCVF 3 - Forest areas that are in or contain rare, threatened or endangered ecosystems All of this forest ecosystems are mentionated in Habitats Directive 92/43/CEE regarding implementing Natura 2000 Network. All of this habitats were identified through LIFE project „Forest habitats, alpine and sub-alpine from Romania” All HCVF’s identified are strongly protected through legislation and Losan suppliers are not logging in strictly protected areas. Further Losan establish procedures to control the origin of wood coming from the FMU’s and considered low risk: Page 28 of 30 CONTROLLED WOOD RISK ASSESSMENT LOSAN ROMANIA o Field verification at HCVF’s forest o Stakeholder consultation and interviews with FMU’s employee Between 2005 and 2010 state forest from Arad, Arges, Dambovita, Hunedoara, Suceava, Timis were FSC certified. Two of them (Timis and Suceava) are in the process of reassessment. D. Wood harvested from areas being converted from forests and other wooded ecosystems to plantations or non-forest uses District: County level (Arad, Arges, Bacau, Bihor, Botosani, Caras-Severin, Covasna, Dambovita, Hunedoara, Iasi, Ilfov, Maramures, Olt, Satu-Mare, Suceava, Timis, Valcea) Level of assessment: Low 4. The district of origin may be considered low risk in relation to conversion of forest to plantations or non-forest uses when the following indicator is present: [Note: the change from plantations to other land uses is not considered as conversion] 4.1 There is no net loss AND no significant rate of loss (> 0.5% per year) of natural forests and other naturally wooded ecosystems such as savannahs taking place of the eco-region in question. Comments or justifications for county risk level According with FAO report for 2009 (State of the World Forests) the forest area in Romania annual net increase was 0,0%. In Romania the management of all forests (public or private) is done according to the Forest Code (Law 46/2008) Forest Code contain a series of decisions regarding the conservation and increase of biodiversity in forests through their functional zones, by promoting species from natural types of forests in forest regeneration. In Romania are around 300.000 hectares of old growth forests according to a study made by Romanian Research Institute and Management Planning which are included in Protected Areas. Wood from forests in which genetically modified trees are planted District: County level (Arad, Arges, Bacau, Bihor, Botosani, Caras-Severin, Covasna, Dambovita, Hunedoara, Iasi, Ilfov, Maramures, Olt, Satu-Mare, Suceava, Timis, Valcea) Level of assessment: Low 5. The district of origin may be considered low risk in relation to wood from genetically modified trees when one of the following indicators is complied with: a) There is no commercial use of genetically modified trees of the species concerned taking place in the country or district concerned. OR b) Licenses are required for commercial use of genetically modified trees and there are no licenses for commercial use OR c) It is forbidden to use genetically modified trees commercially in the country concerned. Comments or justifications for county risk level Romania is low risk concerning the use of genetically modified trees. Afforestation is done mainly with indigenous species according to Management Plan keeping the natural composition of forest. NO use of GMO trees according to Romanian legislation. At the level of European Union there is 1999/105/CE Directive from 22.12.1998 regarding trading forest reproduction. According to Romanian legislation is not allowed use of GMO. In Romania there are some reglementation regarding seeds and commerce with young tree coming from nursery: Minister Order no. 269/2001 regarding National Catalogue for seeds and trees coming from tree nursery sourcing in Romania Minister Order no. 610/11.07.2005 regarding approval of the area and regions with sources of forest species and seeds. For the moment there is no strategy for bio-security, especially related to the use of genetically modified organisms (GMOs), although there is a regulation system for GMOs starting with 2000. According to Global Forest Registry for Controlled Wood and according to the latest available FAO study ("Preliminary review of biotechnology in forestry, including genetic modification", 2004) there is no commercial usage of any GM trees in the country.
