1241 Mathew Robertson & Irby Dewberry to William Saffold Union County, South Carolina Deed Book A, 241-246. South Carolina Ninty six District This Indenture made the seventh / day of February in the year of Our Lord One thousand seven hundred / and Seventy nine Between Matthew Robison Eldest son and heir / at Law of David Robison late of Thickety Creek South Carolina / Deceased and Irby Dewberry Acting Executor to the last Will and / Testament f. 2 Testament of the said David Robison of the One part, and William / Safold of Thickety Creek South Carolina planter of the Other / Part Whereas the said David Robison was in his lifetime and / at the time of his Death Seized in his Demeans of Fee and possessed of one Tract of Land Situate laying and being on / Thickety Creek aforesaid under and by virtue of a Grant or / letters Patent under the Broad Seal of North Carolina and / whereas the said David Robison on or about the year of Our / Lord One thousand seven hundred and seventy one departed this / life leaving the said Matthew Robison his Eldest Son and / Heir at Law, and Appointing Irby Dewberry who is the / only Acting Executor to the last will and Testament of the / said David Robison, now two thirds of the aforesaid Lands / being Exposed to publick Sale Containing two hundred and / Sixty six Acres by the said Matthew Robison now therefore / This Indenture Witnesseth that the said Matthew Robison / for and in Consideration for and in Consideration [sic] of the sum / of five shillings lawful Current money of South Carolina / to him in hand paid at or before the sealing and delivery / of these presents the Receipt Whereof is Hereby Acknowledged / Hath Granted Bargained Sold and by these presents /doth Grant Bargain and Sell unto the said William / Saffold all that and those the Plantation or Tract of two / thirds of the land whereon the said David Robison lately / at the time of his Decease lived are Situate laying and / being on both sides of Thickety Creek in South Carolina / Containing in the whole two hundred and sixty six acres / Butting and bounding to the North on Vacant to the East / on Lands of John Thompson's to the south on lands vacant / and to the West on the One third part of the same Tract as / Excepted for the Dower lands in possession of James Terrill / Together with all and Singular the houses out houses Edifices / Buildings Orchards Gardens Lands Meadows Common / Pastures Trees Bays Wells Waters Water Courses lights Easements / Profits Commodities Emoluments Heriditaments Whatsoever to the said / Plantation or Tract of land Containing two hundred and Sixty six / Acres belonging or an any wise appurtaining or which now are / or heretofore have been Occupied Accepted Reputed Taken Known used / held or Enjoyed as part parcell or member of the same plantation / or f. 3 any part there of and the Reversion and Reversion Remainder and Rema / inders Rents Issues and profits of all and singular the said premises / and every part and parcel thereof with the appurtenances To Have / & To Hold the said plantation or Tract of and premises aforem / entioned in and by these presents Bargained and Sold and every part / and parcel thereof with their Appurtenances unto the said William Safold / his Executors Adminstrators and Assigns from the day next before / the day of the date hereof for and during and Untill the full sold & / Term of One whole year from thence forth next Ensuing and fully / to be Completed and Ended yielding and paying therefore One / popper Corn at or upon the last day of the of the said Term if the same / shall be lawfully demanded to the Intent that by Virtue of these / presents, and by force, of the Statute for Transferring of user into / Possession he the said William Safold May be in the Actual / Possession of all and Singular the premises above mentioned & / Sold with the Appurtenances and be [ ] Enabled to Accept and / Take a Grant and Release of the Reversion and Inheritance there / of to him and his Heirs to the only proper use and behoof of / the said William Saffold his Heirs and Assigns for ever / In Witness Whereof the said parties to these Presents their hands and Seals have / have [sic] herunto Interchangeably Set the day and year first above written Signed Sealed & Delivered In the Presence of Matthew [his mark] Robison (Seal) John Nuckols William Wilkins Irby Dewberry (Seal) Phelimon Martin Received on the day of the date of the within Deed five Shillings / lawful Current Money of South Carolina it being the within Consi / =deration paid by the within Named William Saffold to me Test John Nuckols Matthew [his mark] Robison State of South Carolina Ninty six District Personally Appeared before me and being / Sworn Saith that he was present and Saw Matthew Robison and / Irby Dewberry Sign Seal and deliver the within Lease and that he / saw John Nuckols and Philemon Martin sign their names Together / with him as Witnesses Sworn and Subscribed before me William Wilkins this 23d day of October 1782 I. thereof doth Acquit / Release and Discharge him the said William Saffold his Heirs / Executors and Administrators for ever and by these presents hath / Granted Bargained Sold Aliened Remised Released and / Confirmed and by these presents doth Grant Bargain Sell / Alien Remise Release and Confirm unto the said William / Saffold in his Actual possession now being by virtue of a / Bargain and Sale to him thereof made for one whole year by / Indenture of Lease bearing date the day next before the day / of the date of these presents and by force of the Statute for / Transferring uses into possession of force in South Carolina / and to his Heirs and Assigns for ever All that and those the / plantation or Tract of two thirds of the land whereon the said / David Robison lately of the time of his Whatsoever in Law / or Equity of them the said Matthew Robison and Irby Dewberry / of in and to all and Singular the said plantation and premises / above Mentioned and in and to every part and parcel thereof / with the Appurtenances To Have and to Hold the said plantation / or Tract of Land and premises aforementioned in and by these / presents Released and Confirmed and every part and parcel /
