Lot Order
The Lot Order was determined by using the letter of the second dam’s name of each horse selling.
A random draw was made at the APHA office on August 24, 2010 to determine the beginning letter.
For this year’s sale, the letter “O” was drawn; therefore, all second dams are alphabetized beginning
with the letter “O” and ending with the letter “N” (i.e. a horse with a second dam beginning with
the letter “O” would be at the beginning of the sale, while a horse with a second dam beginning
with the letter “N” would be at the end of the sale).

CARE OF HORSES AFTER SALE:
REPURCHASES
The title passes at the fall of the hammer, at
which time the purchaser assumes all risk
and responsibility for the horse. All horses
must be removed from the sale premises by
noon, November 14, 2010.
Seller reserves the right to bid and must be
the last bidder signing the sale ticket to retain
the horse as unsold. The seller has to pay
$450 in addition to the $500 consignment fee.
ENGAGEMENTS:
ACKNOWLEDGMENT OF PURCHASE:
Unless announced otherwise, all eligibility
payments due after date of sale are the
responsibility of the buyer, who should
promptly notify the proper associations of
new ownership in order to receive direct
billing. APHA does not validate or verify
engagements. The information is supplied by
the consignor.
After making the final bid on a horse, you
will be asked to complete and sign the
Buyer’s Acknowledgement of Purchase. Valid
drivers license number will be required on all
transactions. Be sure to confirm the correct
hip number and price before you sign. Please
print your name and address clearly because
this document is used for American Paint
Horse Association transfers, invoicing, and in
publishing sales results.
RIGHT OF RETURN:
Removal of a horse from the grounds by
the buyer, shall be deemed to constitute
acceptance of the purchase and no rejection
of a purchase will be permitted for any reason after a horse has been removed from the
grounds.
ANNOUNCEMENTS:
To avoid making costly errors, please pay
close attention to all announcements made
from the sales office and from the auction
stand, especially concerning horses on which
you intend to bid. Also, be sure to obtain all
catalog update information which will be
made available in the sales office prior to the
sale.
HYPP STATEMENT:
The American Paint Horse Association and
Sara Vaessen Pedigrees do not warrant or
guarantee the authenticity or validity of
any HYPP certificate or statement by the
consignor.

Important facts
INSPECT HORSES PRIOR TO PURCHASING
READ SALE CONDITIONS
Buyers are to leave hip number on all horses and leave horses in original stalls.
BUYERS MUST REGISTER with the Sales Office and obtain a Buyer’s Number prior to
bidding. No sales will be accepted without a Buyer’s Number.
CATALOG UPDATES AND RESERVES must be turned in by 11:00 a.m. sale day. None
will be taken after that time.
Examine horses prior to purchasing. Veterinary assistance is available at bidder’s expense on
request to the sales office.
All horses in this sale have been required to be tested for Equine Infectious Anemia (Coggins
test). Test must have been performed no earlier than May 6, 2010.
Authorized agents appointed by an absentee purchaser are empowered to act on behalf of
that purchaser, and said purchaser will be responsible for the agent’s purchases (agent
authorization form appears in this catalog).
Buyers are cautioned to pay close attention to announcements made by the auctioneer or
announcer at time of sale as these announcement take precedence over printed information in sale catalog.

The reserve bid and how it works
Consignors are given an opportunity to protect the price their horse will bring, but they are
required to think it through thoroughly and put their reserve bid in writing before the sale
starts. If their horse fails to sell for the amount stipulated, the consignor pays $450 in addition
to the $500 consignment fee.
The APHA reserves the right to hold the papers of any horse whose owner does not comply with the intent of this rule, and owners may be barred from participation in future sales.
APHA, in its capacity as sale manager, is obligated to be as fair as possible to both consignor and potential buyer. The sealed bid is fair in that it allows the seller to control the minimum bid he will accept. It is fair to the auction bidders because no one but the consignor
knows the amount of the sealed bid.
Confidentiality is the keynote of the reserve bid as it is handled in the sale. When bidders
have gone as high as they will go on a particular horse, the reserve bid is opened. If the last
bid recognized by the auctioneer is higher than the reserve bid, the auctioneer declares the
animal sold. If the reserve bid is higher than the last “live” bid, the amount of the reserve bid
is announced, and the last bidder—and only the last bidder—is given the option of meeting
the reserve bid and thereby buying the horse.
RESERVE BID FORMS WILL BE AVAILABLE UNTIL 11:00 A.M. SALE DAY.
ONLY ONE RESERVE BID PER ENVELOPE, PLEASE.
NO RESERVE BID MAY BE RETRACTED ONCE IT HAS BEEN
SUBMITTED TO SALE MANAGEMENT.

Settlement procedures
BUYER’S ACKNOWLEDGMENT OF PURCHASE: At the conclusion of bidding on
each lot, the successful bidder will immediately complete and execute the Buyer’s
Acknowledgment of Purchase presented by the clerk. Successful bidder must provide a
valid drivers license number on the Buyer’s Acknowledgment of Purchase. The Buyer’s
Acknowledgment of Purchase is not transferable without the approval of APHA and the
copy retained by the buyer must be presented by the buyer at the time of settlement.
PAYMENT OF ACCOUNT: Not later than one (1) hour after the conclusion of the sale,
each buyer must make payment of the full purchase price for the animal, plus any applicable charges, prior to the release of the animal. Payment must be made in United States
Dollars, by cash, certified check, money order, personal check or traveler’s check.
Mastercard, Visa and American Express will be accepted, however, a 3% processing fee will
be added to all purchases (however, this fee will be discounted for purchases paid for by
cash, check or cashiers check).
ORDER FOR DELIVERY: After payment of the buyer’s account in full, APHA will issue
to the buyer an Order for Delivery, possession of which will permit removal of the animal
from the stables after payment of all applicable charges. Buyers are cautioned not to lose
the Order for Delivery and APHA assumes no responsibility for any delivery made on presentment of an Order for Delivery.
AGENT’S AUTHORIZATION: Persons acting as agents must so indicate on the Buyer’s
Acknowledgment of Purchase and file an Agent’s Authorization in form satisfactory to
APHA simultaneously with settlement of the buyer’s account.
EXPENSES: All expenses relating to the animal incurred by APHA after the hammer falls
will be paid by the buyer. All accounts not paid within ten (10) days after the date of sale
will bear interest at the rate of eighteen percent (18%) per annum. All court costs, filing
fees, expenses of collection (including reasonable attorneys’ fees) and all expenses of insuring, maintaining, transporting or reselling any animal incurred by the consignor and/or
APHA arising from the buyer’s default will be paid by the buyer.

Conditions of sale
BIDDERS TAKE NOTICE. THIS SALE IS CONDUCTED IN ACCORDANCE
WITH, AND ALL ACTS OF INTERESTED PARTIES AND/OR CLAIMS BY
THEM SHALL BE GOVERNED BY, THE FOLLOWING CONDITIONS OF SALE.
Auctioneer as buyer and sign the
Acknowledgment of Purchase. In the event
that a person other than the recognized
buyer signs the Acknowledgment of
Purchase, such action shall not give such
other persons any right or title to the horse;
and immediately that such an erroneous
signing of Acknowledgment of Purchase
becomes known to the Auctioneer, he shall
cause the Acknowledgment of Purchase to
be presented to the recognized buyer for
signature.
FIRST—APPLICABLE LAW:
All horses in this sale are offered according to the laws of the state wherein the sale
is conducted. The right to bid, as provided
under law, is reserved for all consignors
unless otherwise announced.
SECOND—

CONDITION, EXPRESS OR IMPLIED, BY

FOURTH—BIDDING DISPUTES:
Should any dispute arise between or
among two or more bidders, the Auctioneer
shall forthwith adjudicate the dispute, and
his decision shall be absolute, final and
binding on all parties. Bids tendered after
fall of hammer are not grounds for dispute.
Bids received by personnel employed by the
Auctioneer have the same stature as bids
received by Auctioneer. In case of dispute,
the bidding shall be reopened for advance
bids and, if there be no advance bid, the
horse is sold to the person from whom
Auctioneer recognized the last bid. Advance
bidding shall be restricted to the disputing
parties, unless the bid be reduced below the
level of the recognized bid at commencement of dispute, in which case bidding is
reopened to all. The Auctioneer reserves the
right to reject any and all bids.
THIRD—BIDDING PROCEDURE:
The person making the highest bid recognized by the Auctioneer shall be the buyer.
Consignors to this sale have the right to
place a reserve minimum on any horse they
have consigned, prior to the start of the
sale. A horse offered with reserve bid which
is not met, will be retained by consignor as
unsold, with appropriate commission to be
paid by consignor. The Auctioneer shall
immediately present the buyer with a document entitled Acknowledgment of Purchase
for his/her signature. Should such presentation not be made prior to commencement of
bidding on the next lot offered, the buyer
shall forthwith identify himself/herself to
FIFTH—TITLE AND DELIVERY:
Title passes to buyer at the fall of the
hammer. All risk of injury to the horse
becomes buyer's risk at passing of title.
Buyer or his representative shall assume
care, custody and control of the horse
immediately at the fall of the hammer. Buyer
shall immediately present himself/herself or
in the case of a corporation, a duly author-

shall be responsible for all costs, including
attorney’s fees, incurred by APHA in
collection of amounts owing for horses purchased, or in enforcement or interpretation
of this Condition of Sale.

sixty (60) minutes of conclusion of the sale.
Upon settlement by buyer, horse will be
delivered pursuant to an Order For Delivery
provided by the Auctioneer to buyer or
his/her representative. Buyer or his/her
representative shall present the Order For
Delivery to designee of the Auctioneer to
remove horse from sale premises after
taking possession but, in any case, taking
possession of the horse by buyer or his/her
representative shall constitute delivery.
Upon delivery, buyer shall cause horse to be
removed promptly from the sale premises,
or shall be subject to stable charges as
determined by the Auctioneer. In addition,
should buyer fail to cause horse to be
removed promptly, the Auctioneer may
cause horse to be removed from sale premises at buyer's risk and expense.
EIGHTH—WARRANTIES AS TO
DESCRIPTION:
Unless otherwise announced, there is no
representation or warranty as to the breeding qualities of any horse. Warranties with
respect to certain defects pertaining exclusively to horses of racing age as provided in
Condition Ninth below shall not apply to
any horse described at time of sale as a
broodmare, broodmare prospect, stallion or
stallion prospect. Any horse at least 13
months of age at time of sale which is
described at time of sale as a colt and does
not at such time have two testes descended to the scrotum, and any horse of any
age which is described at time of sale as
ridgeling, and is at such time a gelding, or
is described at sale time as a gelding and is
at such time a colt or ridgeling, or any male
horse described at time of sale as a female,
or any female horse described at time of
sale as a male, shall be subject to return to
consignor as provided in Condition
Eleventh below.
SIXTH—TERMS FOR SETTLEMENT:
Buyer shall make settlement with the
cashier of the Auctioneer. Payment to others, including consignors or their representatives, do not constitute settlement. Buyer
shall present himself/herself to make settlement, as provided in Condition Fifth above,
for the full price, such settlement to be in
form of U.S. Currency or equivalent acceptable to cashier of the Auctioneer. Bidding
will not be authorized for buyers who have
overdue accounts for prior sales conducted
by the Auctioneer.
NINTH—WARRANTIES AS TO
SOUNDNESS:
Unless expressly announced from the
auction box or by official publication of the
Auctioneer or hereinafter provided, there is
no warranty or guarantee of any kind as to
the soundness or condition or other quality
of any horse sold in this sale. Horses with
impaired vision or injury to the eye must be
so announced. Cribbers must be so
announced. Horses of racing age which on
laryngoscopic examination, may be found to
have any defect of wind materially affecting
suitability for racing, must be so announced.
Horses of racing age which are “bleeders” or
are nerved, or are currently on the Starters’,
Stewards’ or Veterinarian’s list at a licensed
race course must be so announced.
SEVENTH—DEFAULTERS:
Purchasers who fail in any respect whatsoever to pay for horses as provided for in
Condition of Sale Sixth above, and/or
Settlement Procedures shall be declared in
default. Any horse purchased by a defaulter
may be resold by the undersigned at public
or private sale without notice for purchaser's
account, costs of such resale to be borne
by defaulter. Should such resale fail to satisfy the defaulter's account in full, defaulter
shall pay forthwith to APHA the amount
owing, failing which, the undersigned may

TENTH—WARRANTY AS TO
BROODMARES:
grounds, whichever comes first, after which
the buyer shall have no Right of Return
under this Condition Eleventh. In addition,
all warranties on any horses of racing age
terminate immediately when such a horse
starts in a race after fall of hammer, whether
or not twenty-four (24) hours have passed
since date of sale, except that the warranty
as to “Bleeders” shall remain in effect until
the end of such race. Further, any use of
any horse of racing age “under tack” by
buyer or his/her representative, after discovery of any condition of such horse,
which would permit its return as provided
herein, shall void all right of return, terminate any warranties which might otherwise
exist, and ratify and make final the sale of
such horse without recourse of any kind
against the consignor, his representative or
the Auctioneer. The rights of the buyer to
return the horse as provided herein to the
consignor shall be his sole and exclusive
remedy against the consignor, his representative or the Auctioneer and the consignor,
his representatives and/or the Auctioneer,
shall not be liable for any other actual or
consequential damages. In any case of
returned horse to the consignor in accordance with these Conditions of Sale, reasonable expenses for keep, maintenance
and transportation of the horse, from fall of
hammer until return to the consignor, shall
be paid by the consignor.
It is agreed that each broodmare in this
sale will be offered with veterinarian certificate provided by the consignor and satisfactory to the Auctioneer, showing her to be
either 1) in foal, in the opinion of the examining veterinarian, based on manual examination within 15 days prior to the date of sale,
or 2) not in foal, apparently free of infectious
vaginal disease and in sound breeding condition in the opinion of the examining veterinarian, based on speculum examination within
15 days prior to the date of sale. It is further
agreed that the purchaser may have any
broodmare examined by a veterinarian
acceptable to the consignor and the
Auctioneer before the broodmare is removed
from the sale premises and within twentyfour hours after the start of the sale. If the
broodmare is found not to be as certified, she
shall be returned to the consignor as unsold
and the consignor shall be liable for the commission as if sold. If the broodmare is found
to be as certified, the purchaser shall pay the
examination fee and complete the sale; if not
as certified, the consignor shall pay the fee.
ELEVENTH—RIGHT OF RETURN:
Any horse sold in this sale which has a
condition that must be announced as provided in Conditions Eighth, Ninth and Tenth
above, and is not so announced, shall be
subject to return to consignor with refund of
purchase price and reimbursement for reasonable expenses for keep, maintenance
and transportation of the horse from the fall
of hammer, provided that within twenty-four
(24) hours from the conclusion of the sale,
or upon removal from the sale grounds,
whichever comes first, the Auctioneer
receives written notice from the buyer and a
written veterinarian's certificate, based on
examination by the certifying veterinarian,
that such condition exists, and the same
existed at time of sale. The time of delivery
of such notice and of such certificate is of
the essence. All warranties terminate twenty-four (24) hours from the conclusion of the
sale, or upon removal from the sale
TWELFTH—CATALOG AND
ANNOUNCEMENTS:
The accuracy of all information of the
catalog page(s) is the sole responsibility of
the consignor. Errors, omissions or typographical errors are not the responsibility of
Sara Vaessen Pedigrees or the American
Paint Horse Association. Consignor shall
have the affirmative duty to examine the
catalog page(s), on which horses consigned by him appear, prior to sale and
report any inaccuracies to APHA so that it
may make an appropriate announcement
at time of sale. While certain information
may have been procured by undersigned
from third parties on behalf of consignor, it

select a licensed veterinarian acceptable to
the Auctioneer. If such veterinarians fail to
agree promptly as to the validity of the
claim, they, or the buyer and the consignor
involved in the controversy, shall agree upon
a third licensed veterinarian. If two such veterinarians, or the buyer and the consignor,
are unable to agree promptly upon the third
veterinarian, the Auctioneer shall appoint
the third veterinarian. The third veterinarian's fee, expenses and costs shall be paid
by the party whose property the horse is
determined to be. The panel of three veterinarians shall conduct any tests, investigation or examinations deemed necessary,
and may, in their discretion, conduct a hearing by notifying the Auctioneer to arrange
for the hearing, and shall, by majority vote,
determine the validity of the claim. The
Auctioneer shall determine the amount of
reimbursement due to a buyer whose claim
is found to be valid and may, in its sole discretion, conduct a hearing to aid in making
such a determination, and such determination shall be incorporated in the award.
Any other controversy between or among
the buyer, consignor and the Auctioneer, or
any two of them, arising out of a claim made
under these Conditions of Sale or
Consignor’s Contract, shall be settled by
arbitration among the parties in accordance
with the Commercial Arbitration rules of the
American Arbitration Association.
Arbitration shall take place in Fort Worth,
Texas. Judgement upon any award rendered
by the arbitrator(s) may be entered in any
court having jurisdiction thereof. The
Auctioneer will be entitled to reimbursement
from the party whose property the horse is
determined to be for reasonable attorney’s
fees and other costs incurred in the arbitration and any related court proceedings.
Any such controversy, claim, defense or
dispute shall not in any way affect the
absolute obligation of the buyer to pay the
full purchase price to the Auctioneer.
is nonetheless solely the responsibility of
consignor to verify the accuracy of such
information and to notify the undersigned
of any corrections prior to sale. Sales
engagements, produce records and all
other information so listed are as represented by the consignor, to whom only the
purchaser shall look for redress in case of
errors or omissions.
THIRTEENTH—DRUG AND
MEDICATION TESTING:
As a service to buyers, they will be given
the option of requesting a drug test, in
accordance with APHA Rule SC-085, on any
animal that they have successfully bid on
and purchased. Such test must be requested in writing at the time the sale ticket is
signed. Upon receipt of a request for testing, the animal will be tested by the APHA
Drug Testing Staff, in accordance with
APHA procedures, immediately following
the sale of the animal. All costs related to
such testing will be paid for by the buyer.
Proceeds from the sale of any animal upon
which such test is requested and conducted
will be paid to consignor after test results
are received. If a positive test result is
received, the buyer will, at his option, be
entitled to a full refund of the purchase price
and return of horse to consignor (at consignor's expense) as unsold and the consignor shall be liable for the commission as
if sold. Further action may be taken against
the responsible parties by the APHA
Executive Committee if a violation of Rule
SC-085 is suspected.
FOURTEENTH—ARBITRATION:
Any controversy arising out of a claim
arising under Conditions Eighth, Ninth,
Tenth and Eleventh above, shall be settled
by arbitration between the buyer and the
consignor pursuant to the following procedure. Upon the Auctioneer's determination
that a claim under such Conditions of Sale
has been timely and properly presented by
the buyer pursuant to these Conditions of
Sale and upon notice from the Auctioneer,
the buyer and the consignor shall each

AGREEMENTS:
NINETEENTH—HYPP STATEMENT:
Neither the American Paint Horse
Association nor Sara Veassen Pedigrees
warrants or guarantees the authenticity or
validity of any HYPP certificate or statement
by the consignor.
The Auctioneer shall not be bound by any
oral or written agreement between the buyer
and the consignor varying from these
Conditions of Sale unless agreed to by the
Auctioneer, and any controversy or claim
between the buyer and consignor arising
out of such agreement shall be a matter for
their resolution by settlement, litigation,
arbitration or otherwise as they determine
without any participation by Auctioneer.
TWENTIETH:
The American Paint Horse Association
assumes no responsibility for errors, omissions, or typographical content of this catalog and/or any other promotional
advertising.
SIXTEENTH—AUTHORIZED AGENTS:
Persons acting as Authorized Agents for
consignors must file notarized letters of
authorization from the consignor stating the
agent is acting in their behalf and that said
consignor will be responsible for the agent's
sales or purchases on his/her behalf. These
letters must be on file with the sales office
prior to the start of the sale.
SEVENTEENTH—REGISTRATION
CERTIFICATES:
The APHA will process registration
papers for transfers of ownership after the
purchase price has been paid in full. If the
horse is registered with the American
Quarter Horse Association (AQHA), the
appropriate certificate transfer form and
fees (paid by buyer) will be forwarded to
AQHA for processing. All other certificates
of registration received from the consignor
will be forwarded directly to the buyer.
EIGHTEENTH—SEVERABILITY:
If any provision of these Conditions of
Sale is determined to be illegal or invalid,
such illegality shall not affect the remaining
provisions of these Conditions of Sale, and
they shall be continued and enforced as if
such illegal or invalid provisions had never
been inserted herein. The masculine and
feminine of any word shall include the neuter.

Consignor’s Contract
2. I warrant title to each Animal free from all
adverse claims to ownership, use or possession and agree to defend title against all claims.
I authorize you to advertise and sell each
Animal at public auction, to make the representations and warranties set forth in the Sale
Conditions on my behalf, to deliver possession
of each Animal to the highest recognized bidder, to transfer title thereto and to receive and
disburse the proceeds of sale for my account.
I hereby consign the foregoing livestock (the
“Animal(s)”) to the American Paint Horse
Association (APHA) Breeders’ Trust Select Sale
for sale in the designated Sale and inclusion in
the Sale catalog subject to the following terms
and conditions:
1. I agree to pay the designated Consignment
Fee for each Animal and agree that the
Consignment Fee will be deemed earned by
you on the Withdrawal Date (August 30, 2010).
I understand that I have the right to withdraw
any Animal at any time prior to the Withdrawal
Date and receive a refund of the Consignment
Fee by delivery of written notice to you.
Effective on the Withdrawal Date, I agree that
your authority to sell each Animal will be irrevocable and that each Animal will be offered at
the Sale unless the Animal is excused by you.
After a horse has been consigned, Consignor
agrees not to dispose of the horse by private
sale. Withdrawals will be permitted in hardship
cases but must be presented in writing to
APHA and be accompanied by a signed
Veterinarian Certificate stating that the horse
has either died, received injury which affects
the horse’s marketability, or has acquired an illness which prevents the horse from meeting
proper health requirements. Withdrawals presented in this manner must be further accompanied by a withdrawal fee of $250 which shall
be in addition to the consignment fee, and
which shall be used to pay for cataloging and
advertising expenses and other costs incurred
in removing the horse from the sale. In the
event that my horse is not withdrawn from the
sale prior to the withdrawal date, and not
excused thereafter by a veterinarian's certificate, and shall fail to be offered for sale for any
reason, then I agree to pay APHA a $1,500
withdrawal penalty. A reserve bid can be
placed on any consignment the morning of the
sale prior to 11 a.m., pursuant to consignment
terms and conditions as published in the Sale
catalog. Horses will sell to the highest bidder
unless such bid fails to meet or exceed consignor's reserve bid, which the consignor will
have placed prior to the sale time. All fees
must be paid prior to Animal’s release.
3. In addition to the Consignment Fee, I agree
to pay you the designated Sale Commission on
each Animal, computed on the final recognized
bid at the Sale, by whomsoever made, regardless of whether such Animal is or is not sold at
such bid. Commission is ten percent (10%) of
selling price. A flat pass out fee of $450 will
apply to repurchases or horses offered with
unmet reserve bids. You are authorized to
deduct all sums owing to you from my account
and in the event of any deficiency, I agree to
immediately pay you the balance due. All
returned checks will be charged a $35 processing fee and must be replaced with cash or
certified funds. In addition, past-due accounts
will be charged interest at the rate of eighteen
percent (18%) per annum.
4. I understand that you reserve the right to: (a)
reject the entry of any Animal in the Sale at any
time; (b) approve any assignment of my rights
and obligations under this agreement; (c)
determine the order of sale of all Animals; (d)
assign stabling facilities subject to such stabling policies as you may establish; (e) examine each Animal and make such catalog
corrections and announcements as you deem
appropriate; (f) change the time, date or location of the Sale should circumstances, in your
sole discretion, necessitate such a change;
and (g) cancel the Sale if less than 25 quality
consignments are received as deemed by the
Sale Screening Committee.
5. I agree, at the time of entry, to deliver to you
the following documents in a form satisfactory
to you with respect to each Animal: (a) all original certificates of registration (APHA, Pinto,
AQHA, etc.) or my certificate that all matters
required by the applicable registry have been
furnished and issuance of the certificate of reg-

7. All responsibilities and guaranties lie solely
between Buyer and Consignor. I represent and
warrant to the buyer and APHA the following:
(a) title to the animal is free from all adverse
claims to ownership, use or possession, (b) the
animal is sound of eyes and hearing, (c) the
animal is not a “cribber,” (d) the animal has not
been “nerved,” (e) the sex and condition as a
gelding or ridgeling of the animal is as
described in the Sale Catalog, and that colts
or stallions at least 13 months of age at the
time of sale possess two palpable testicles
descended to the scrotum, (f) the animal is
sound of wind, and is not a “bleeder.” I understand that my consignment is subject to veterinarian inspection prior to the sale at a
potential buyer's discretion and expense. In the
event that a horse possesses any of these
defects, it shall be the Consignor's sole
responsibility to inform APHA, auctioneer or
announcer of such defects in a timely manner
so that proper announcements can be made
while the horse is in the auction ring. A recorded tape will be made of the entire sale which
shall be used to determine what announcements were made. Any horse sold in this sale
which has a condition that must be announced
as provided in the Conditions of Sale, and is
not so announced, shall be subject to return to
the consignor so long as procedures of Right
of Return as described in Conditions of Sale
are met.

the Animal to the Buyer; (c) properly signed
stallion service and breeders certificates to
bred mares; (d) a photograph of Animal, suitable for publication. Decisions regarding selection of the photos used for publication
purposes shall be reserved by APHA. All consignors must be current members of the APHA
at the time of consignment of sale horses.
Upon entrance to the sale grounds, all horses
must have a NEGATIVE COGGINS test dated
NO EARLIER than May 6, 2010; a health certificate and evidence by a licenced veterinarian
of pregnancy for any animal represented to be
bred or pregnant within 15 days (no earlier than
October 22, 2010) prior to the date the animal
sells. Separate and Original Coggins Report
and Health Certificate will be required on each
horse. No photocopies will be accepted. All
health paperwork must be turned in at the sale
office at the sale grounds and no horse will be
permitted entrance to the auction ring until all
health requirements have been met and properly filed with Sale Management. I UNDERSTAND THAT YOU WILL WITHHOLD ANY
MONIES DUE ME UNTIL ALL SUCH DOCUMENTS ARE DELIVERED.
6. PAYMENT TO CONSIGNORS:
A. Payment to our consignors will begin on the
21st banking day, or the 30th calendar day
after the sale, or sooner as checks are
cleared.
B. Registration Certificates will not be transferred until the buyer's check has cleared
the bank. Papers will be processed within
45 working days following sale.
C. Payment to our consignors will be held until
all necessary papers are in the APHA
offices.
D. AN ASSESSMENT OF $100 WILL BE
CHARGED ON ANY PROBLEMS IN PROCESSING PAPERWORK.
I agree to provide such information as you might
request with respect to the ownership, description, pedigree, produce, performance, health and
conformation of each Animal. I understand that
you will provide to me a copy of the Sale Catalog
prior to the Sale date, setting forth my representations and warranties with respect to each
Animal and I agree to review such catalog and
promptly notify you of any corrections thereto.
8. To accommodate visitors and prospective
buyers, I agree to deliver each animal f.o.b. to
the sale location by NOON, Thursday,
November 4, 2010. I understand that the maintenance of each Animal is my responsibility
until sold and I agree to care for each Animal
while stabled on the Sale premises in accordance with approved husbandry practices and
your stabling policies. On my failure to so care
for any Animal, I agree that you may, at your
option, undertake such care and I agree to
reimburse you for all expenses of stabling,
feed, veterinary care, transportation and maintenance of any Animal. I agree that you will not
incur any liability whatsoever for the loss, damage, injury, death or illness of any Animal.
9. I understand that you will use reasonable
efforts to verify the financial responsibility of
the buyer of each Animal and that possession
of each Animal sold will be released to the

Committee if a violation of Rule SC-085 is suspected.
buyer against receipt of future payment after
satisfaction of your Settlement Procedures. In
the event a purchaser fails to pay for and
receive a horse struck down to him, APHA shall
not be held liable for said sale, but shall have
the right to accept the same amount from
another person, accept the next highest bid,
put the animal up for sale a second time or
retain it for the seller as unsold.
13. I understand that the terms of the Sale
Conditions, information as to seller, buyer, purchase price, repurchases and unmet reserve
bids may be disclosed as part of information
reported on the Sale.
14. I understand that the terms of the Sale
Conditions and Settlement Procedures published in the Sale Catalog will govern the sale
of each Animal, and I hereby approve the same
and agree to be bound thereby. Any disputes
and/or conditions not specifically covered by
the Consignors Contract, Conditions of Sale,
or Settlement Procedures shall be governed by
actions of the APHA Executive Committee, and
all decisions shall be final.
10. I agree to indemnify and hold you harmless
from all claims, expenses and costs (including,
without limitation, attorneys fees) arising out of:
(a) any question of title to or my authority to sell
any Animal; (b) any lien attached or claim
asserted against any Animal or the proceeds
of sale; (c) any claimed default in my representations or warranties with respect to any
Animal; (d) loss or damage to property and
injury or death of persons caused directly or
indirectly by me, my agents or employees or
any Animal; (e) my entry or sale of any Animal;
or (f) my default in performance hereunder. I
agree to pay you on demand, the full amount of
any loss which you may incur in settlement of
any claim or demand on account thereof.
15. This agreement will be binding on me, my
heirs, personal representatives, successors,
permitted assigns, any successor in ownership
of each Animal and will inure to the benefit of
your successors and assigns.
16. HYPP Statement: The APHA does not warrant or guarantee the authenticity or validity of
any HYPP certificate or statement by the consignor.
11. APHA reserves the right to positively identify each horse consigned and determine age
by tooth examination to be made in accordance with the current “Official Guide for
Determining the Age of the Horse” as adopted
by the American Association of Equine
Practitioners. Any discrepancies noted
between the animal and information reported
on its certificate of registration may result in the
animal being removed from the sale.
12. APHA may conduct random drug testing or
DNA testing on any or all consignments.
Prospective buyers will be given the option to
request a drug test at their expense, in accordance with APHA Rule SC-085, on any animal
that they have successfully bid on and purchased. If a request for drug testing is made
(this request for testing must be made in writing at the time the sale ticket is signed) the animal will be tested by the APHA Drug Testing
Staff, either by urine/blood/saliva, one or all,
immediately following the sale of the animal. If
a positive test is received, the buyer will, at his
option, be entitled to a full refund of the purchase price and return of horse (at seller’s
expense). Further action may be taken against
the responsible parties by the APHA Executive

*by July 10 of foaling year - $300
*by September 10 of foaling year - $400
*after September 11 of foaling year - $1000
