NOTICE OF HEARING (AUTOMATIC FINE)
A hearing will be held in this case before the Florida Elections Commission on May 6, 2014, at 8:30 am, or as soon
thereafter as the parties can be heard, at the following location: Senate Oflice Building, Room S-110, 404 South Monroe
Street, Tallahassee, FL 32399
Failure to appear in accordance with this notice will constitute a waiver of your right to participate in the hearing.
Continuances will be granted only upon a showing of good cause
This hearing will be conducted pursuant to Section 106..25, Florida Statutes, which governs your participation as
follows:
If you are the Respondent, you may attend the hearing, and you or your attmney will have 5 minutes to present your
case to the Commission However, some cases (including those in which consent orders or recommendations for no probable
cause are being considered) may be decided by an en rnasse vote and, unless you request to be heard or the Commission
requests that your case be considered separately on the day of the hearing, your case will not be individually heard
If you are the Complainant, you may attend the hearing, but you will not be permitted to address the Commission . In
addition, some cases (including those in which consent orders or recommendations for no probable cause are being considered)
may be decided by an en masse vote and, unless the Respondent requests to be heard 01 the Commission requests that the case
be considered separately on the day of the hearing, the case will not be individually heard
If you are an Appellant, and you have requested a hearing, you may attend the hearing, and you or your attorney will

Please be advised that both confidential and public cases are scheduled to be heard by the Florida Elections
Commission on this date As an Appellant, Respondent or Complainant in one case, you will not be permitted to attend the
hearings on other confidential cases.
The Commission will electronically record the meeting. Although the Commission's recording is considered the
official record of the hearing, the Respondent may provide, at his own expense, a certified court reporter to also record the
hearing.

If this is a heaiing to consider an appeal from an automatic fine, the Filing Officer has imposed a fine
on you for your failure to file a cainpaign treasurer's report on the designated due date aJid, by filing an appeal,
you have asked the Commission to conside1 either (1) that the repo1t was in fact timely filed; or (2) that there
were unusual circumstances that excused the failure to file the 1epo1t timely You aie required to prove your
case. If the Commission finds that the report was filed timely or that there we1e unusual circumstaJices that
excused the failure, it may waive the fine, in whole or in pait. The Commission may reduce a fine after
conside1ing the factors in Section 106..265, F101ida Statutes If the Commission finds thatthe report was not
timely filed aJid there were no unusual ci1cumstaJices, the fine will be upheld
If this is a heaiing to conside1 a consent order before a determination of probable cause has
been made, the Commission will decide whether to accept or reject the consent order . If the Commission
accepts the consent order, the case will be closed and become public If the Commission rejects the consent
order or does not make a decision to accept or deny the consent order, the case will remain confidential, unless
confidentiality has been waived

If this is a probable cause hearing, the Commission will decide ifthere is probable cause to believe that
the Respondent committed a violation of F101ida's election laws. Respondent should be p1epared to explain
how the staff in its recommendation inconectly applied the law to the facts of the case Respondent may not
testify, call others to testify, or introduce any documentary or other evidence at the probable cause hearing
The Commission will only decide whethe1 Respondent should be charged with a violation and, before the
Commission dete1mines whether a violation has occmred or a fine should be imposed, Respondent will have aJI
oppo1tunity for aJiother hearing at which evidence may be introduced.
If this is aJI informal hearing, it will be conducted pmsuant Sections 120 569 aJid 1205'7(2), Florida
Statutes; Chapter 28 and Commission Rule 2B-l 004, Flmida Administrative Code At the heaiing, the
Commission will decide whether the Respondent committed the violation(s) charged in the Order of Probable
Cause The Respondent will be permitted to testify However the Respondent may not call witnesses to testify.
Respondent may aigue why the established facts in the Staff Recommendation do not support the violations
charged in the Order of Probable Cause. At Respondent's request, the Commission may determine whether
Respondent's actions in the case were willful The Respondent may also add1ess the appropriateness of the
recommended fine . If Respondent claims that his limited resou1ces make him unable to pay the statutmy fine,

Dear Mr . Dunn:
We ar·e in receipt of your Campaign Treasurer's Repo1t of Contributions and Expenditures (G3-4th
Day Prior Report), covering the pe1iod f!om October 12, 2013 through October 31, 2013, which
was received and filed in our office on November 12, 2013. Said 1epo1t was due on November 1,
201.3 and is therefore deemed to be eleven (11) days late
Per Florida Statute 106.07(8)(a)(b) fo1 the reports immediately preceding each primary and
general election, the fine shall be $500 per day foz each late day, not to exceed 25 per·cent of
the total receipts or expenditures, whichever is greater, for the period covered by the late
report
You are hereby assessed a fine of $5,500.. Said fine shall not be an allowable campaign expenditure
and shall be paid only from personal fonds of the candidate. Said fine must be paid to this office
with a check payable to the City of Miami, within 20 days after receipt of this notice
The Florida Elections Commission has the authority to waive this fine in whole or in part for this
to occUI, you must, within 20 days after receipt this notice of payment due, request an appeal 01
dispute of a possible healing before the Florida Elections Commission
You are entitled to appeal or dispute the fine, based upon, but not limited to, unusual
circumstances surrounding the failure to file on the designated due date In doing so you must send
notice to the F lo1ida Elections Commission specifying the unusual ciicumstances surrounding the
failure to file on the designated due date This notice may be accompanied by any evidence
supporting the claiin.
The Flolida Elections Commission must consider the mitigating and aggravating circumstances
contained ins 106.265(1) when determining the amount ofa fine, if any, to be waived.

The General Municipal Election in which Mr. Dunn was a candidate was held on
November 5, 2013 upon which M1 Dunn received enough votes to place him on the
ballot fo1 the November 19 Runoff Election for City of Miami Commission District 5
On November 15, 2013 the Office of the City Cle1k sent a First Notice letter to Mr
Dunn, copying his campaign t1easmer, Claytosha Owens-Fields, regarding a fine fo1 the
late 1eport, suggesting that he could appeal to the Florida Elections Commission, which
he notified us in writing that he did on December 26, 2013
Richard Dunn II also filed to rnn as a candidate fo1 City of Miami Commission District 5
in a January 12, 2010 Special Election, an November 2, 2010 Special Election and a
November 1, 2005 General Municipal Election
All reports received from Mr Dunn in 2010 elections were deemed timely
The original repo1ts for the 2005 election were timely received, however Mr Dunn's
campaign failed to timely file amended reports requested by the Office of the City Clerk,
resulting in the Florida Election Commission case FEC 06-090

I HOW TO QUALIFY AS A CANDIDATE
Candidates for the City Commission shall have resided within the district at least one ( 1) year
before qualifying and be electors in that district, and shall maintain a residence in that district for
the duration of their term of office, if elected
The first document a person must file to become a candidate is the Appointment of Campaign
Ireasure1 and Designation of Campaign Depository (Fo1m DS-DE9) A candidate may
appoint a campaign treasurer and designate a campaign depository at any time, but the
appointment must be filed in the City of Miami Clerk's Office no later than the date the candidate
qualifies fot office
Pursuant to Florida Statutes sections 106.19(1)(c) and 106 265(1) each candidate must file a
Statement of Candidate with the qualifying officer within 10 days after the Appointment of
Campaign Ireasurer and Designation of Campaign Depository is filed. Willful failure to file this
form is a first degree misdemeanor and a civil violation of the Campaign Financing Act which
may result in a fine of up to $1,000
The first day to qualify for office in the November 5, 2013 election is Friday, September 06,
2013 The last day to qualify is Saturday, September· 21, 2013 at 6:00 p.m. During this time
period, the City Clerk's Office is open weekdays, Monday through Friday, from 8 am to 5 p m.
We respectfully request of all prospective candidates to please call this office, in advance, in
order to set up an appointment time for qualifying as a candidate It is necessary that this office
have sufficient time to adequately review the paperwork involved in connection with his/her
qualification before the City Clerk This will avoid confusion and conflicts in scheduling
The following forms are REQUIRED to qualify as a candidate:
l) Appointment of Campaign Treasurer and Designation of Campaign Depository (Form
DS-DE9)
2) Statement of Candidate (Form DS-DE 84)
3) Affidavit of Candidate
4) FORM 1 Statement of Financial Interests (for prior year)
5) Loyalty Oath (DS-DE 24B)

I QUALIFYING FEE I ELECTION ASSESSMENT
Pursuant to Ordinance Number 12.363, prospective candidates shall pay, at the time of qualifying
for office, a qualifying foe of$100 In addition, Section 99 093 of the Florida Statues requires
each person seeking to qualify fo1 nomination or election to a municipal office to pay, at the time
of qualifying for office, an election assessment equal to one percent (1%) ofthe annual salary of
the office sought, said amount to be later forwarded by the City to the Elections' Commission

I RESIGN TO RUN (Section 99.012, F.S.)
No "officer" may qualify as a candidate for another public office, whether state, district, county,
or municipal, if the terms or any part thereof run concunently with each other, without resigning
from the office he/she presently holds The resignation is inevocable The written resignation
must be submitted at least 10 days prior to the first day of qualifying for the office he/she
intends to seek The resignation must be effective no later than the earlier of the following dates:
(1) The date the officer would take office, if elected; or, (2) The date the officer's successor is
required to take office With respect to a municipality, the term "officer" means a person,
whether elected or appointed, who has the authority to exercise municipal power as provided by
the State Constitution, state laws, or municipal charter
(NAME APPEARANCE ON THE BALLOT
The name printed on the ballot ordinarily should be the given name and surname Any name by
which a candidate is known is sufficient on the ballot, and a person is legally permitted to have
printed on the ballot the name which the candidate has adopted and under which he or she
transacts private and official business A candidate may use a legitimate nickname

Election officials, however, may be justified in refusing to print on the ballot a candidate's
nickname when it is not shown that the nickname ever was used by the candidate as part of his
legal name, and such officials may be equally justified in refusing to print on the ballot a
candidate's choice of a name which has not been adopted by him or her and under which the
candidate has not transacted private and official business. Descriptive information such as a title
(for. example, Dr or M D ), although not part of a persons' name, is permissible only when two
persons of the same name or whose names are so similar as to reasonably cause confusion, seek
the same office
j APPLICABLE FINES ON LATE FILING OF REPORTS
Pursuant to F S I 06 07 (8)(b), election law provides that:
"Upon determination that a report is late, the filing officer shall immediately notify the
candidate as to the failure to file a report ~y the designated due date and that a fine is
being asses sedfor each late day lhe fine shall be $50 a dayfor the fits/ 3 days late and
thereafter, $500 per day for each late day, not to exceed 25 percent of the total receipts
or expenditures, whichever is greater, for the period covered ~y the report. Howeve1, for
the reports immediately p1eceding each primary and geneml election, the fine shall be
$500 per day for each late day, not to exceed 25 percent of the total receipts 01
expenditures, 1thicheve1 11 gteater; for the period coveted by the report."
Reports shall be filed not later than 5 p m of the day designated; however, any report
postmarked by the U S. Postal Service no late1 than midnight of the day designated shall be
deemed to have been filed in a timely manner A certificate of mailing obtained from and dated
by the U S. Postal Service at the time of mailing, or a receipt from an established courier
company, which bears a date on 01 before the date on which the report is due, shall be proof of
mailing in a timely manner The F1orida Elections Commission has determined that failure of
the U S Postal Service or a courier service to properly postmark an envelope of a campaign
treasurer's report to show proof of mailing, or timely deliver a campaign treasurer's report, does
not constitute unusual circumstances to waive a fine for late filing

remaining funds. Such candidate shall not accept any contributions, nor shall any
person accept contributions on behalf of such candidate, after the candidate withdmws
his candidacy, becomes unopposed, or is eliminated or elected "

contributions by the candidate to the campaign. "

I OATH OF OFFICE
Pursuant to City Charter Section 4(b), the Mayor and all City Commissioners are to hold office
from twelve o'clock noon five days after the canvass of the vote by the supervisor of elections
and the declaration of the result of either (1) the general municipal election or (2) runoff election
and until their successms are elected and qualified. City Code Section 16-8 states that if, at the
close of the qualifying period, there is only one candidate's name listed on the general municipal
election ballot for a specific seat, no election shall be required, and said candidate shall be
declared elected for that particular term of office as of five days after the date of the scheduled
general municipal election
