Resolution of Necessity Ms. Pizzuti moved to approve the following resolution. RESOLUTION DECLARING IT NECESSARY TO LEVY AN ADDITIONAL TAX IN EXCESS OF THE TEN-MILL LIMITATION (Ohio Revised Code §5705.21) Operating Levy WHEREAS, the amount of taxes which may be raised within the ten-mill limitation will be insufficient to provide an adequate amount for the necessary requirements of the School District; and WHEREAS, a resolution declaring the necessity of levying an additional tax outside the tenmill limitation must be passed and certified to the County Auditor of Franklin County in order to permit the Board to consider the levy of such a tax and must request that the County Auditor certify to the Board the total current tax valuation of the School District and the dollar amount of revenue that would be generated by the tax; 3 July 15, 2013 NOW, THEREFORE, BE IT RESOLVED by the Board of Education of the Upper Arlington City School District, Franklin County, Ohio, two-thirds of all of the members elected thereto concurring, that: Section 1. It is necessary to levy an additional tax in excess of the ten-mill limitation for the purpose of paying current expenses of the School District. Section 2. The question of such additional tax levy shall be submitted to the electors of the School District at the election to be held therein on November 5, 2013. Section 3. Such additional tax levy shall be at a rate not exceeding 4.0 mills for each one dollar of valuation, which amounts to $0.40 for each one hundred dollars of valuation, for the purpose of paying current expenses of the School District for a continuing period of time. Section 4. Such additional tax levy shall be placed upon the tax list and duplicate for the current tax year (commencing in 2013, first due in calendar year 2014), if a majority of the electors voting thereon vote in favor thereof. Section 5. The Treasurer of this Board is hereby authorized and directed to certify a copy of this Resolution to the County Auditor and the Board of Elections of Franklin County, Ohio. This Board hereby requests that the County Auditor certify to this Board the total current tax valuation of the School District and the dollar amount of revenue that would be generated by the levy if approved by the voters of the School District. Section 6. It is hereby found and determined that all formal actions of this Board concerning and relating to the passage of this Resolution were taken in an open meeting of this Board, and all deliberations of this Board and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements, including Ohio Revised Code Section 121.22.
