For the purpose of the Residential Tenancies Act 1986:
- The Property Manager shall be deemed to be the Landlord.
GENERAL CONDITIONS
The provisions of The Residential Tenancies Act 1986 shall apply to this Tenancy.
NOTICE
No notice is applicable. This Tenancy is for a Fixed Term terminating on 20 November 2004.
RENT INCREASE
The Landlord must give the Tenant at least 60 days written notice of a rent increase but no such increase can take effect earlier than 180
days since the commencement of the tenancy or the date of the last increase.
BOND
The Bond shall be paid to Tenancy Services and the Bond will be refunded to the Tenant on the termination of this tenancy after deduction
to compensate the Landlord for any loss or damage resulting from the Tenants failure to observe and perform the Tenants obligations under
this Agreement.
BOND INCREASE
The Landlord on lawfully increasing the rent, may require payment by way of Bond of a further sum not exceeding the amount by which
the rent payable for four weeks has been increased.
OUTGOINGS
The Tenant shall pay all charges for electricity, gas and metered water including waste water charges supplied to the premises and any
telephone connected to the premises. The water meter reading at the commencement of the tenancy is unknown.

MAINTENANCE
The Tenant shall keep the premises in a reasonably clean and tidy condition and free from any accumulation of rubbish. The Tenant shall
keep the gardens and grounds of the premises in a reasonably tidy condition and regularly cut the lawns and hedges (if any).
RENOVATIONS
The Tenant shall not make any renovation, alteration or addition to the premises. The Tenant shall not install or have installed any
external radio, television, sky, or other aerial without the express written consent of the Landlord.
RESIDENTIAL USE
The Tenant shall ensure that the premises are occupied principally for residential purposes and shall ensure that anything done or
committed on the premises does not disturb, annoy or cause a nuisance to any of the neighbours.
ASSIGNMENT
The Tenant shall not assign, sub-let, or part with possession of the premises and the chattels (if any) or any part thereof during the term of
the tenancy.
CHATTELS
The Tenant shall not remove any chattels from the premises and shall replace any damaged or lost chattels with others of like value.
KEYS
The Tenant shall deliver the keys for the premises to the Property Manager (or as the Landlord may otherwise direct) by not later than
4.30pm on the day the premises are vacated by the Tenant.
NOTIFICATION OF DAMAGE
The Tenant shall notify the Landlord as soon as possible after discovery of any damage to the premises or the need for any repairs to be
carried out.
FEES
The Tenant shall pay the letting fee or charge for any services by a Real Estate Agent or any Solicitor relating to the grant of this Tenancy.
LOCKS
Neither the Landlord nor the Tenant shall change the locks without the consent of the other party.
REPAIR FITTINGS
The Tenant shall repair or replace all electrical apparatus, glass and all fixtures and fittings (including chattels, if any) have drains cleared
and repaired if such are damaged or rendered unserviceable through the neglect or negligence of the Tenant.
FIXTURES TO WALLS AND DOORS
The Tenant must obtain the Landlords written approval to affix any nails, drawing pins, pins, bluetack, cellotape, picture hooks or any
similar item to any door or wall in the premises (otherwise this is not permitted).
PETS
The Tenant shall not keep pets on the premises without the written consent of the Landlord.
OCCUPANT APPROVAL
Where the Tenant is other than the occupier then the Landlord acknowledges that the actual occupiers of the property will be employees of
the Tenant and/or their families and the Landlord must approve the initial occupiers and subsequent change of occupiers and such written
approval is not to be unreasonably withheld.
The total occupants permitted to reside in the premises shall be restricted to Three (3) in number. The initial Occupant(s) shall be:

Subsequent changes of occupier must be approved in writing by the Landlord, such approval is not to be unreasonably withheld.
SIGNING OF AGREEMENT BY FACSIMILE
The parties acknowledge that this Tenancy Agreement may be signed by the Landlord and the Tenant in one or more counterpart facsimile
copies which, read together shall constitute one and the same Tenancy Agreement. The transmission of the Tenancy Agreement by
facsimile each to the other or their respective agents shall be sufficient to constitute offer and acceptance of the terms of this Agreement.

RENTAL PAYMENTS
The Tenant undertakes that rental payments shall be made as one (1) single payment only of $340.00 each week by bank automatic
payment directly into the Landlords bank account.
INSPECTIONS
The Tenant agrees that the Landlord will regularly inspect the property in order to monitor maintenance requirements and confirm the
property condition. These inspections will be during normal working hours at a pre-set day and time to suit the Landlord and it is
understood that the Landlord will be undertaking a sequence of multiple inspections in order of location. The Tenant may or may not
choose to be present at the inspection. The Landlord undertakes to provide written notification of the inspection in accordance with the
Residential Tenancies Act. In addition the notice shall include an approximate time that the inspection will take place.
ACCESS TO SHOW PROSPECTIVE TENANTS
The Landlord may enter the premises for the purpose of showing the premises to prospective tenants in accordance with the rights of entry
set out in the Residential Tenancies Act 1986. An "Open Home" may be used to show prospective tenants the premises. The Landlord is
not the guarantor of the safety of the tenant's goods and chattels during the conducting of an Open Home.
DAMAGE TO PREMISES AND/OR CHATTELS
The Tenant shall be liable for any intentional or careless damage TO THE INTENT THAT any insurance policy taken out by the tenant
should include Public Liability cover. Any insurance cover taken by the landlord will not cover the tenant's liability.
VEHICLES
Vehicles must not be parked on grass or garden areas.
BODY CORPORATE RULES
Where the premises are part of a complex all occupiers are required to obey the Body Corporate Rules.
FALSE CALL OUTS
The Tenant shall be responsible for all costs arising from, trades people called out falsely (i.e. no faults found), or as a result of misuse or,
damage caused by the Tenant, or false alarm call outs.
ISSUE OF KEYS
The Landlord or his agent shall not be responsible for arranging secondary keys for the property in the event the tenant loses the keys or
locks the keys inside the property. In the event a locksmith is required to gain access this will be at the Tenants cost.

We report that we were pleased with the overall condition and presentation of the
property. The tenant is clearly taking their responsibilities seriously and fulfilling their

informed them that you will be advised.
We identified some maintenance issues that require attention. Specifically:

7.
SALE OF PROPERTY

REPORTING
The Agent is required to render to the Owner a monthly statement of monies collected, charges deducted, and accounts paid, and remit
to the owner all receipts less disbursements.

9.
AGENTS AUTHORITY
The Agent is authorised to:

Select Tenants.
Sign Tenancy Agreements for the premises or any part thereof.
Collect rents due.
Issue receipts for monies collected.
Exercise the Landlord’s right to terminate Tenancies.
Serve notices upon Tenants.
Issue notice to terminate the Tenancy.
Take such action against the tenants and do all such things necessary to commence and obtain an order for possession or an
order to terminate the Tenancy from the Tribunal and any appeal arising therefrom.
10. RELETTING
At the end of each tenancy or in the event of a vacancy the agent is to:

11. BOND
The Agent is to:
- Collect the bond from each tenant and deposit the same with the Ministry of Housing – Tenancy Services.
- Initiate the refund of the bond monies to the tenant by the Ministry of Housing – Tenancy Services upon satisfactory
completion of the tenancy; and
- Where necessary to lodge claims against bond money under the rules of the Residential Tenancies Act 1986.
12. DISBURSEMENTS
The Agent is authorised to advertise the availability for rental of the premises and prepare and distribute promotional material, credit
check prospective tenants and to photographically record the condition of the premises at the commencement of each tenancy.
The owner agrees to pay for these disbursements (plus GST).
13. REPAIRS
The Agent is authorised to make or cause to be made any repairs or alterations and to do the decorating of the said premises, to purchase
supplies and pay all accounts therefor. The Agent agrees to secure prior approval of the owner on all expenditure exceeding $550.00 for
any one event, except monthly operating charges and/or emergency repairs in excess of the maximum if, in the opinion of the Agent,
such repairs are necessary to protect the property from damage or to maintain essential services to the tenants as called for in their
Tenancy Agreement.

14. INSPECTIONS
The Agent is authorized to carry out inspections of the premises at Quarterly intervals at the rate set out under Fees in clause 6 of this
authority for each inspection.
15. INSURANCE
The owner undertakes responsibility to ensure the premises and chattels are adequately insured.

16. AGENT INDEMNITY
(a) The owner will hold and keep indemnified the agent against all suits proceedings, claims, demands, costs and expenses
whatsoever which may be taken or made against the Agent in the course of or arising out of the proper performance or exercise
of any of the powers, duties or authorities of the Agent herein.
(b) The owner acknowledges that this authority is subject to the Residential Tenancies Act 1986 and any other Act passed by
Parliament affecting residential tenancies.
(c) The indemnity given by the owner pursuant to clause 16 (a) hereof shall be extended to include any illegal activities
undertaken by the tenants at the property TO THE INTENT that the Agent shall be kept indemnified against liability for all
such illegal acts, property damage caused by, or attributed to the illegal acts, together with any consequential losses which are
alleged to flow from the said illegal activities.
