smile? “My grandchildren,”
said the 67-year-old. “I love
to read and hang out with my
grandkids.” She is vice president
of Main Street Productions in
Westfield. Van Howe acts and
directs, and she also handles
the theater’s summer youth projects and is a part of the youth
ministry at her church. “My two
favorite things are children and
the theater, and every summer I
get to combine the two.” She is
currently producer and co-stage
manager for “Home Games,”
a romantic comedy on stage
weekends through Feb. 15 at
Westfield Playhouse in Eagletown. What’s next? She said,
“There are some great shows
coming up at the playhouse for
which I plan to audition.”

celebrates swim school
opening in Fishers
Goldfish Swim School is
celebrating the grand opening
of its Fishers location with a
family-friendly pool party.
While the activities and
events are for fun, the mission
of the swim school is to teach
the serious message of water
safety at every age and ability
level.
Open swim times for the
community will be offered from
6:30 to 8 p.m. today and noon
to 4 p.m. Saturday and Sunday
at 11581 Geist Pavilion Drive,
Fishers. Besides open swim
times and tours of the facility, the school will offer food,
games and crafts, plus a photo
booth, door prizes and a Name

met Wednesday night
to hear the
introduction of
the five-year
parks master
plan, to vote
on a new lease
for the Indiana
Bennett
Transportation
Museum at
Forest Park, and hear updates on the Fox Prairie Golf
Course improvements and
Federal Hill Park.
The master plan is in the
process of being finished
by Parks Director Brandon
Bennett and will be presented to the board in about two
weeks. The board members
will then review the plan for
two weeks after they receive it
and conduct a public hearing
at the next meeting, which is
Feb. 25. They will then vote
on the adoption of the plan at
April board meeting.
• The board unanimously
approved another lease for the
Indiana Transportation Museum to remain in Forest Park.
• The Fox Prairie Golf
Course is in its final stages of
making improvements inside
the pro shop and outside
on cart paths and bridges.
Bennett said the bridges were
about 80 percent completed
with two pedestrian bridges
left to install, which should be
finished within the next week.

just went through the final
design phase.

Sportscaster Wil Hampton will run for Noblesville Common Council, District 4

Wil Hampton has declared his
candidacy
for the
Noblesville
Common
Council,
District 4
seat in the
Hampton
upcoming
May 5
primary. He will run as a
Republican.
Hampton has lived in
Noblesville for nearly 20
years. “This is the right
time to step up,” Hampton said in a prepared
media statement. “I think
I offer a fresh perspective
and positive attitude.”
Hampton, a longtime
local sportscaster on
television and radio with
WISH-TV 8, WRTV 6,
the Indianapolis Colts and
Ball State University, is
currently the executive
director for athletic events
and marketing for Marian
University. “My career
has always been about
connectivity and results,”
Hampton said. “I believe
I can use my ability to
communicate and discover what voters of Noblesville want to see from
their elected leaders.”
Hampton has served on
the Noblesville Schools
Education Foundation
since 2007 and was the
chairman of the Educate
Noblesville PAC that
led to school expansion
and brought IVY Tech
to Noblesville. He is an
active member of Our
Lady of Grace Church
where he teaches religious education. He has
also coached youth sports
since 1999 for CYO, Noblesville Youth Baseball,
Noblesville Babe Ruth
and Noblesville Boys and
Girls Club.
Hampton’s father
served as mayor of his
hometown of Muncie.

something better for
Muncie and its citizens,”
Hampton said. “That’s
really what this is all
about; it’s a chance to
give back and be more
than just a part of the
process and to communicate with all involved and
really dig into what we
need to do in the coming

Becky, is OLG’s coordinator of elementary
religious education. They
have three children, John,
is a Noblesville High
School graduate who
attends Ball State University, and twins Will and
Maggie, both freshmen at
NHS.

about an agent and songwriter Albert Peterson who

when hip-thrusting rock
and roll superstar Conrad
Birdie is drafted into the
Army. Albert’s secretary
and sweetheart, Rosie,
comes up with a last-ditch
publicity stunt to have
Birdie record and perform a song before he is
sent overseas. She makes
Albert promise to give up
the music business and to
start teaching English at
schools. They plan to have
Birdie sing Albert’s new
song “One Last Kiss” and
give one lucky girl from
his fan club a real “last
kiss” on The Ed Sullivan
Show before going into the
Army.
“Our kids have worked
so hard, and we’re so
proud of this show,” said

Indy’s artistic director.

these students to the arts
builds character, along
with teaching responsibility

an adjective, she felt that
they should be “Canadian
geese.”
As she pointed out,
“Canada geese” isn’t good
English.
While I’m on the subject
of birds, I didn’t have
room in the earlier column
to mention the Christmas
Bird Count in which Cool
Creek Park participated in
December.
The CBC is an annual
census of birds run by the
National Audubon Society at sites all around the
country. The data collected
is used to judge the health
of bird populations and to
guide conservation efforts.
Amanda Smith, superintendent of Natural Resources for Hamilton County
Parks & Recreation, sent
me a copy of the results of
this year’s count. The report is too long to get into
here, but I did note that
sightings of woodpeckers
and other trunk feeders are
way up. Amanda speculated that the presence of the
Emerald Ash Borer might
be the reason.
David Francis
Mary Alice 'Maxine' Fleming
David Francis, 77, Noblesville, died
peacefully at home, surrounded by his
loving family, on Wednesday, Feb. 4,
2015.
He was born on July 31, 1937, to Richard and Elizabeth Francis in Noblesville.
Mr. Francis graduated from Elwood
High School and proudly served in the
Francis
U.S. Navy.
He was employed at Guide Lamp as a
supervisor for 29 years, retiring in 1992.
Following retirement, he was heavily involved in racing. Mr. Francis enjoyed being a part of his sons’ racing
hobbies. His son, J.D. Francis, raced every weekend for
the last 20 years, and Mr. Francis only missed two races
during that time. He was known at the dirt race tracks
as PR. Every racer he met absolutely loved talking
with him.
He was an avid outdoorsman and
loved to fish. Last summer, Mr.
Francis and his best friend of 51
years, Jim Roy, spent a weekend fishing
in Grand Rapids, Mich., with his son
Kevin, son JD, and Roy’s son-in-law,
Rick Geils.
Above all, Mr. Francis was a family man. He adored
his sons, Jon David Francis and Kevin Francis. He will be
dearly missed and forever celebrated by a loving family
and many friends.
Survivors include his wife, Dorothy Francis, to whom
he was united in marriage on Jan. 29, 1977; children,
Jon David (Camille) Francis, and Kevin Francis; and
grandchildren, Madysen Francis and Colleen Cummings.
Brothers, Richard and Robert Francis, also survive. Mr.
Francis also helped raise Anthony, Matthew and Kevin
Ammerman, his nephews.
In addition to his parents, he was preceded in death by
his brothers, Kenny, Don, and twin brother Dale Francis;
and the recent death of his nephew, Matthew Ammerman,
who was killed in Afghanistan.
The family wants to give a special thank-you to Stacy
and Becky of Guardian Angels Hospice for David's recent
care.
Friends and family will gather from 2 to 4 p.m. Saturday, Feb. 14, 2015, at the Fishers Conference Center,
9775 North by Northeast Blvd., Fishers. A private family
service was conducted on Thursday, Feb. 5, 2015, at
Randall & Roberts Funeral Center.

Mary Alice “Maxine” Fleming, 96,
Noblesville, died on Wednesday, Feb. 4,
2015, at Harbour Manor Care Center in
Noblesville.
She was born on May 10, 1918, to
Harry and Gladys (Beaver) Pittman in
Lebanon.
Mrs. Fleming was the owner of Star
Fleming
Cafeteria in Frankfort, and had also been
employed with Charles Howard Insurance
in Noblesville.
She was a more than 50-year member of First Christian Church in Noblesville and a 50-year member of the
Eastern Star.
She is survived by her three sons, Ronald “Ron’
(Jean) Fleming, Don (Jamie) Fleming and Dave (Teresa)
Fleming; seven grandchildren, Scott Fleming, Jill Fleming Fulk, Nick Fleming, Amy Fleming Ramsey, Brett
“Bo” Fleming, Mitch Fleming and Ty Fleming; and 17
great-grandchildren.
In addition to her parents, she was preceded in death
by her husband, Kenneth Fleming who died in 1999; son,
Daniel J. Fleming; one brother; and two sisters.
Services will be conducted at 11 a.m. Monday, Feb. 9,
2015, at Randall & Roberts Funeral Home, 1150 Logan
St., Noblesville, with visitation beginning at 10 a.m.
Pastor John Davis will officiate. Burial will be in Bunnell
Cemetery, Frankfort.

Peck said, “We’re where

many over 10 years. We just
keep bringing in great people
to take it to the next level.”
The sisters said they are
thrilled with all of the new
dealerships coming to Noblesville, including the Terry Lee
Hyundai opening its newly
constructed dealership in
March just west of the Goeke
property.
“It’s great,” said Cole.
“The more car dealers.”
“The more traffic,” Peck
chimed in.
She said, “All of those
(dealerships) have moved in to

just gone up.”

Notice is hereby given that the City of Carmel Redevelopment Commission
(the “Commission”), being the governing body of the City of Carmel Department

Wildcats baffle Millers

Keep a close
eye on Class 2A
A lot of folks were probably wondering
if we’d ever really see much parity again in
Indiana high school basketball.
Well, in most cases, the gap seems to
be closing, and there does seem to be a lot
more balance, if you will.
This is until you start talking about Class
2A.
I mean just look what’s been happening.
Look what’s happening right here in Central Indiana. Certainly, the 2015 state tournament appears to be wide open, at least in
the upper classes for girls’ and boys’ teams.
But in Class 2A, well … it doesn’t appear
to be quite that wide open.
Just to show you how well some teams
are making their presence felt, look at Class
2A. Basically, just start and end your look
at the Heritage Christian girls and the Park
Tudor boys.
There’s a pretty good story line there for
both schools.
They’ve been prime-time challengers and
state contenders and champions in recent
years.
This might be considered to be good
fodder, possibly, for an argument. But if
we were still playing in a one-class state
championship format, well, both schools
likely would not only be competitive against
the bigger schools, but they’d potentially
be good enough to challenge for state titles.
Yeah, it’s conceivable I would think.
Possibly in 2015, especially.
Both are ranked No. 1. Both have defeated some bigger schools. Both appear to be
favorites to win state championships for the
second straight year.
And both have some players who could
play on some of the better big-school girls’
and boys’ teams in — or beyond — our
area, for sure.
Those schools have combined for eight
state championships, all in Class 2A – all
coming after Class Basketball became our
new way of life in the 1997-98 season. Heritage Christian has won state five times in
the past nine seasons; Park Tudor followed
up a state runner-up finish with three championships since 2010.
As we prepare to kick off the 40th IHSAA state girls’ tournament, with sectionals
first up next week, look what Rick Risinger
has done at the private Heritage Christian
School, which is located pretty close to
Hamilton County, specifically the City of
Fishers.
His accomplishments haven’t just been
exceptional….maybe “phenomenal’’ would
be a more descriptive way of putting what
he’s done.
Yep, certainly one for the Indiana high
school basketball. Not just girls’ basketball,
but in ALL basketball.
Consider:
>>>The Fishers resident has posted an
unbelievable 222-39 won-loss record.
That’s an .851 winning percentage in
10 seasons at the only school he’s ever
coached. That’s an average of 22 victories per season, folks. Incredible. Simply
incredible.
>>>In a 22-2 season so far this
season, the Lady Eagles have defeated 17
Class 4A teams, including then No. 2 Lawrence North and No. 6 Noblesville.
They also own wins over top-10 4A
teams Mooresville and Pike. They even lost
a top player to injury in the LN game, but
had enough punch to derail a Noblesville
team that is capable of going a long, long
way in the tournament.
The Lady Eagles have also upended four
Class 3A schools and they blistered Scecina
Memorial and Cardinal Ritter, their only
regular-season 2A opponents, by 59 and 35
points, respectively.
>>>Risinger led Heritage Christian to
a 27-1 record last season en route to one of
his five state championships.
If the obviously talented and skillfully-coached Lady Eagles cut down the nets
this season, Risinger would tie Fort Wayne
Bishop Luers with a record six championships in girls’ basketball and the late Bill
Green, who won six boys’ state titles.
Risinger, who was helping with the
Lady Eagles in the 2005-06 season, said
he never really thought about becoming a
head coach. Then his good friend and Lady
Eagles’ coach, Dr. Mark Richards, passed
away in September of 2005. That’s when
Risinger agreed to step in and take over the
program.
It’s been quite a ride, all about success,
and I’m sure a lot of memories since then.

Richmond High School, coached the Lady

The third-ranked Class 4A Lawrence
North Wildcats had all the answers on
Thursday night.
Taking away the fifth-ranked 4A
Noblesville Millers’ outside shooting,
their inside drives and ultimately their
confidence, the Wildcats (22-1) ran away
from the outset, beating the hosts at their
own game 61-40 at The Mill.
“I don’t even know what happened
out there,” Noblesville senior point
guard Becca Bergman remarked. “We
just were not ourselves. I don’t know if
we were tired or if we were just going
in scared, nervous? I really couldn’t tell
you.”
Entering their regular-season finale,
the Millers had scored 100-plus points
on three different occasions, averaged
nearly 75 points per game and racked up
19 wins with their only losses to No. 4
4A Homestead and top-ranked 2A Heritage Christian.

Tigers, Royals push through to sectional finals

FISHERS – On Thursday evening
the Hamilton Southeastern Royals and
the Fishers Tigers girls’ swimming
teams competed in the Fishers Sectional
preliminaries where the top 16 in each
event advance to the sectional final on
Saturday.
In the 200 yard free, Fishers advanced
Lauryn Parrish (1:51.53), Carissa
Schneider (1:58.53), Elisabeth Peskin
(1:59.37). HSE advanced Hannah
Ballard (2:02.05) and Emily Barnes
(2:04.03).
The 200 IM was dominated by both
schools. Fishers advanced Lauren
Edelman (2:07.47), Margaret Jahns
(2:09.19) and Abbegayle Schneider
(2:12.15). HSE put through Natalie
Mudd (2:08.90), Audrey Lo (2:13.61)
and Anna Young (2:17.91).
HSE’s Robyn Clevenger won the 50
free with a time of 23.81. Teammates
Sydney Knurek (24.98) and Lauren
Blanchard (25.22) advanced as well.
Fishers’ Elizabeth Pfeifer (25.21), Allison Sperring (25.26) and Kayce Ingram
(25.42) also advanced.
Clevenger also won the 100 butterfly
with a time of 56.53. teammates Kylie
Sutherlin (59.02) and Phoebe Garrett
(59.31) also advanced. Also making the
top 16 from Fishers were Ingram (59.56)
and Zoe Cochran (1:02.05).
Parrish won the 100 free with a time
of 51.87. Also advancing from HSE is
Emily Moser (54.61) and Emma Roehrdanz (54.91). HSE advanced Barnes
(53.70), Sydney Knurek (55.19) and
Caroline Cross (56.17).
The 500 free was dominated by Fishers as they placed first, second and third

KOKOMO – The unranked Westfield
girls’ basketball team will enter next
week’s Sectional 8 Tournament with plenty of momentum.
Led by a team-high 15 points by Maddy
Grennes, the Class 4A Shamrocks defeated 4A Kokomo 55-28 on Thursday night
to win their ninth consecutive game to
finish the regular season.
Westfield hasn’t lost since falling to
Class 3A No. 12 Bishop Chatard on Jan.
6. Since the loss, the Shamrocks have
knocked off seven 4A teams, including
rival Hamilton Southeastern – their firstround sectional opponent on Wednesday
night.
On Thursday, Westfield grabbed a
26-10 lead by halftime and were never
challenged, holding the Wildkats to a
mere three points in the third quarter and
35 percent from the field.
Grennes shot 6 of 14 from the floor
with 12 rebounds. Haliegh Reinoehl added 13 points, going 5 of 12 from the field.
She also had a double-double after hauling
in 11 rebounds.
Jalyn Foland was the third Shamrock
to reach double figures, chipping in 10
points. She shot 2 of 3 from the 3-point
arc. Abby Reeder contributed eight points
and Allison VanDyke had nine points and
seven rebounds.
Annaleise Drudge led the team with
behind Abbegayle Schneider (5:11.53),
Carissa Schneider (5:14.04) and Elisabeth Peskin (5:18.04). HSE also put

The 100 backstroke was won by Mudd

14 and 15 points, respectively.
Walton was 6 of 7 from the floor with
six assists while Taylor had six rebounds.
Kyndall Williams was efficient shooting
and went 3 of 4 and added a free throw
for seven points.

Greyhounds dominate sectional prelims

The defending state champion Carmel Greyhounds set the tone early and
often during the Noblesville Sectional
on Thursday night.
Winning every event, the Carmel
girls’ swim team took its first step
toward a historic 29th consecutive
Indiana High School Athletic Association state championship.
The Greyhounds set the standard
in every relay event, winning the
400-yard freestyle in 3:33.36, the 200
medley in 1:51.28, and 200 freestyle
in 1:38.11.
Individually, Claire Adams and
Amy Bilquist led the team.
Adams won the 200 freestyle with
a time of 1:51.61. She also finished
first in the 100 backstroke with a time
of 53.89.2.
Bilquist was first in the 50 freestyle,
coasting to a time of 23.36 seconds.
She won her second sprint in the
100 freestyle with a flight of 50.92
seconds.
The sectional finals will take place
on Saturday with diving, consolations
and the finals at 9 a.m. and 1 p.m.

The Millers only had
one player reach double
figures in junior forward
Katelyn O’Reilly, who
had 12 points on 6 of 10
shooting. She added five
rebounds.
Erin Wood showed
some well-needed aggressiveness inside to finish
with eight point and eight
rebounds, but it was far
from enough.
“We just didn’t play
anywhere close to how
we’ve played the other
22 games this year,”
Keck said. “For whatever
reason, I felt our kids got
intimidated a little bit.”
With five days until
they open the Sectional 8
tournament against rival
Carmel on Tuesday night
at Hamilton Southeastern,
the Millers will be pressed
to find a response to the
skepticism now concerning
their mental toughness.
“They’re obviously a
very good team, and when
you don’t shoot well and
all of those things, but to
not fight like this group
normally does … this is
a fighting group. That’s
what was most concerning,” Keck said. “Normally, they’re going to
get after it, but mentally, I
don’t know if the wear and
tear of playing two of the
best teams in the state kind
of got to them? I have no
explanation for that.
“I think we have enough
leadership where it’s
something we can fix.”

against Heritage Christian.
Noblesville was only down
by one point at halftime

17-point hole in the second

Against the Wildcats,
the hill grew to a mountain
of unanswered questions.
Normally a steady threat
from the perimeter, the
Millers only made 1 of
9 3-point attempts. They
endured a similar trend
against Heritage Christian
two days ago, finishing
1-for-10.
On the season, they
have averaged 35 percent
efficiency from beyond the
arc.
Noblesville shot 36
percent from the field in
the first half versus Lawrence North and dropped
below 30 in the second to
finish at 32 percent overall
against the Wildcats’ pressure defense.
“I think we were rushing
things inside and out. We
missed a lot of shots in the
paint as well,” Noblesville
head coach Donna Keck
said. “Again, I think we
just rushed things. They do
a very good job of speeding you up and we didn’t
handle that real well.”
The Wildcats lived up
to their national ranking,
recently listed as the ninthbest team in the nation by
Maxpreps.
Shooting 40 percent
from the floor, they were
led by Purdue signee Lamina Cooper with 18 points
on 7 of 15 shooting. Junior
forward Ae’Rinna Harris,
who is verbally committed
to Purdue, followed with
12 points and 11 rebounds.
The tandem steered the
Wildcats to a 15-0 run in
the second quarter and
a 54-29 lead early in the
fourth quarter.
“They’re a team that
really gets out of the gate,
and they have all year
long,” Lawrence North
head coach Chris Giffin
said. “Obviously, they
are a high-scoring team,
they’ve scored 100 a couple of times, which isn’t
easy to do. I thought our
defense did a really good
job, limiting their 3-point
touches and keeping them
off the foul line.”

ORDINANCE NO. 55-12-14
AN AMENDED ORDINANCE TO ESTABLISH AN EQUITABLE IMPACT FEE FOR THE PURPOSE OF PLANNING AND FINANCING PARK AND RECREATIONAL INFRASTRUCTURE NEEDED TO SERVE NEW DEVELOPMENT

WHEREAS, the Common Council of the City of Noblesville (hereafter referred to as “the Common Council”) finds that it is reasonable and necessary to promote and accommodate orderly growth and development and to protect the public health, safety
and general welfare of the citizens of Noblesville (“the City”) by providing for an equitable program to fund the capital costs of new park and recreational infrastructure necessary to serve newly developing areas of the City; and,
WHEREAS, the Common Council further finds that it is reasonable and necessary to promote the orderly development of the City by establishing standards by which the City may require that new development shall pay an Impact Fee representing the
development’s proportionate share of the cost of capital costs of new park and recreational infrastructure necessary to serve the new development; and,
WHEREAS, the Common Council finds that new development should not be required to pay a fee for the capital costs of such new park and recreational infrastructure greater than the development’s proportionate share of the capital costs of such
infrastructure which is needed to serve such development; and,
WHEREAS, the Common Council previously passed an amended Ordinance No. 45-9-00 in October 2000, Ordinance No. 61-8-03 in September 2003, Ordinance No. 34-03-06 on the 28th day of March, 2006, and Ordinance No. 37-10-10 on the 4th
day of November, 2010, which Ordinances approved an equitable Impact Fee, for the purpose of partially financing park and recreational infrastructure; and,
WHEREAS, the City of Noblesville, Hamilton County, Indiana, has caused to be prepared an update to the Recreational Infrastructure Improvement Plan, dated October, 2014, (hereinafter referred to as “the Plan”) by Lehman & Lehman, Inc.,
Consultants and reviewed by the Noblesville Engineering Department, which “the Plan” is included as Exhibit A to this Ordinance and made a part hereof; and,
WHEREAS, the cost of implementing the park and recreational recommendations of said Plan in their entirety exceeds (1) the income capacity of the City through its ad valorem property tax receipts or other tax distributions allocated to park and
recreational improvements relative to the chronological needs of the City for said improvements; (2) the general obligation bond capacity of the City based upon net and limitation on the use of property taxes imposed by the General Assembly of the State of
Indiana; assessed valuation or (3) the revenue bond potential of the City based upon any existing means of acquiring revenue related to such improvements; and,
WHEREAS, because of the size of the City, considering both its population and geographic area, as well as the distribution of public and private institutions, services, and other facilities through the City, all park and recreational improvement within the
City primarily benefiting the citizens of the City include any areas to be amended within the next five (5) years; and,
WHEREAS, the Plan provides a one (1) zone improvement plan for the entire City and areas of Noblesville Township and Wayne Township reasonably anticipated to be amended within the next five (5) years; and,
WHEREAS, it has been the stated objective of the City that the Plan should result in determination of an Impact Fee, which meets the rational nexus test as that test, is understood by current applicable case law and statutory law; and,
WHEREAS, the Plan Commission of the City of Noblesville, Hamilton County, Indiana, has conducted a public hearing on the Plan (Application No. 001317-2014), the recommendations contained therein, and the terms of this Ordinance, and after due
deliberation and consideration, has forwarded a favorable recommendation for the Zone Improvement Plan encompassed by the Plan and has recommended its adoption by a vote of 11 ayes and 0 nays; and,
WHEREAS, the Mayor has heretofore appointed the Noblesville Park Impact Fee Advisory Committee to advise the Common Council as required by state law; and
WHEREAS, the purpose of this ordinance is declared not to deter growth, remedy existing infrastructure deficiencies or pay for maintenance or other non-capital costs.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Noblesville, Hamilton County, Indiana meeting in regular session as follows:
SECTION 1. LIMITATION ON IMPOSITION OF IMPACT FEE. This Ordinance shall expire and become void five (5) years after its effective date as required by IC 36-7-4-1340, unless action is undertaken to extend its provision consistent with the
provisions of said code section which contemplates a replacement ordinance.
SECTION 2. ESTABLISHMENT OF AN IMPACT ZONE. There is hereby established one (1) Infrastructure Impact Zone, (“the Zone”) the borders of which are coterminus with the existing corporate boundaries of the City of Noblesville, Hamilton
County, Indiana, and as they may be extended from time to time through annexation, and over which the City of Noblesville exercises or will exercise zoning and planning jurisdiction. In this regard, the Council has specifically finds there is a functional
relationship between the components of the Plan within the existing and proposed boundaries of the City and such park and recreational plan provides a reasonable uniform benefit to the citizens of the Zone and any future annexed area of the City as of the
adoption of this Ordinance. The Council further finds that all areas of the Zone are contiguous as required by IC 36-7-4-1316. Except as provided below, this Ordinance shall apply uniformly to all residential and multi-purpose developments for which the City
of Noblesville may require a structural building permit and which creates a need for new and additional park and recreational infrastructure. This Ordinance shall not apply to:
(1) developments meeting the requirements set forth in IC 36-7-4-1322(g);
(2) improvements, which do not require a structural building permit;
(3) improvements, which do not create a need for new and additional infrastructure, including the erection of a sign, construction of an accessory building, structure or fence or the alteration, renovation or expansion of an improvement where the
use or intensity thereof, has not changed;
(4) the replacement of a destroyed or partially destroyed improvement provided that the replacement improvement does not create a need for new and additional infrastructure over and above the infrastructure needed by the original improvement
prior to the destruction or partial destruction thereof; and
(5) non-residential development.
SECTION 3. ZONE IMPROVEMENT PLAN As a precondition to the adoption of this Ordinance, the Common Council undertook a comprehensive and detailed park and recreation impact analysis through the employment for that purpose of Lehman
& Lehman, Consultants, (“the Plan”), which Plan was reviewed by the Noblesville Engineering Department. The Common Council does now find that the resulting updated study and database substantiates a conclusion that all of the City is, or will be,
served by the recreational infrastructure described in the Zone Improvement Plan, and therefore, adopts the Plan. The Common Council does hereby adopt the update to the Recreation Zone Improvement Plan dated October, 2014, and finds that the plan
contains the contents as set forth in IC 36-7-4-1318. The Common Council also adopts the Plan as the Zone Improvement Plan for the portions of Noblesville Township and Wayne Township not yet annexed into the City and finds in this regard that said Zone
Improvement Plan contains the following elements:
(a) reasonable estimates relating to the nature and location of development that is expected within impact zone during the planning period, which for the purposes of this Ordinance is defined to be a period of ten (10) years commencing with the
date of adoption hereof.
(b) a reasonable determination of the community level of service for the various recreational components of the City’s impact zone.
(c) a reasonable determination of the current level of service provided within the City’s impact zone.
(d) a reasonable estimate of the nature, location, sequencing, and time of the park and recreational requirements and costs necessary to provide the community level of services for the developments contemplated in Sub-paragraph (a) above.
(e) a reasonable estimate of the share of the park and recreational costs identified in Sub-paragraph (d) hereof that will be used to:
(1) raise the current level of service for existing development or provide service to existing development; or
(2) provide service to new development
(f) a reasonable estimate of revenues that:
(1) are from sources other than impact fees; and
(2) will be used to finance the costs identified in Sub-paragraph (e)(1) above.
(g) a description of the nature and location of existing infrastructure in the impact zone.
(h) the City further agrees that all infrastructure costs identified in the Plan which are not paid from impact fees shall either be paid from the proceeds of Bonds issued by the City from potential tax increment, if appropriate, or from the City’s
share of County Option Income Tax.
In addition, the Common Council does hereby specifically adopt the Plan, as the Zone Improvement Plan, as an official part of the Comprehensive Plan of the City of Noblesville, pursuant to IC 36-7-4-500 and following.
SECTION 4. ESTABLISHMENT OF PARK AND RECREATION IMPACT FEE.
Based upon the financial calculation on Page 42 of the Plan, the Common Council determines that the total cost per equivalent dwelling unit is for Zone 1 One Thousand Seven Hundred Eighteen Dollars ($1,718). However, the Common Council hereby
establishes the Park and Recreation Impact Fee in the amount One Thousand Five Hundred Forty-six Dollars ($1,546) per equivalent dwelling unit, which shall include all free standing single family residences. The fee for dwellings other than free standing
single family residences are:

The Common Council further finds that any deficiencies as identified in the Plan are not to be funded from the impact fees collected above and shall be funded from the various Redevelopment District (TIF) Funds, the issuance of the City’s Bonds, or
the County Option Income Tax (COIT).
The Common Council does hereby make as a part of the record of these proceedings, all of the data collected, the calculations made, and the conclusions reached in the process of developing the Zone Improvement Plan, and specifically instructs the
employees of the City to make such data and other information inclusively available to anyone for review during regular business hours.
In the event any parcel of real estate considered in the Zone Improvement Plan undergoes a change in use, redevelopment, or a modification which requires a structural building permit and creates a need for new infrastructure, an impact fee will only be
assessed for the increase in the burden on the infrastructure resulting from the change in use.
SECTION 5. CREDIT IN LIEU OF PAYMENT: EXEMPTIONS Any person or entity obligated to pay the fee pursuant to the terms of this Ordinance may have the options of financing, constructing, and dedicating park and recreational infrastructure
which either dedicated to the City or owned and operated by a neighborhood association for the benefit of the residents of the City, all as described and defined in the Plan. This option is available instead of making all or part of any impact fee payment, which
may be due, so long as such financing, construction and dedication are accomplished pursuant to the Plan of the City, and in accordance with the park and recreational infrastructure to be improved in force within the City’s jurisdiction at the time.
Such fee payer, or other person or entity providing the infrastructure or improvement, shall be given credit for the actual costs of planning, financing, construction of such park and recreational improvements to the City. Such request for credit shall be
presented prior to the issuance of the structural building permit and the amount of credit shall be agreed in writing in advance of granting of the credits. In the event the actual cost of such planning, financing and construction do not equal the amount of the
impact fee due pursuant to the calculation provided for in the schedule set forth in Section 4, hereof, the remaining balance shall be due in accordance with the provisions stated hereafter.
In addition, a fee payer or other person or entity responsible for installing infrastructure or improvements may designate in writing a method of allocating its credits to future fee payers who may be successors in interest to the credits earned by the fee
payer or others, as part of the certification provided for above.
Any person or entity otherwise obligated to pay the fee established by this Ordinance whose property was totally or partially destroyed by fire, storm, or other casualty beyond their control, shall be exempt from said fee if they repair or replace the
destroyed structure without creating a burden on the infrastructure greater than imposed by the destroyed structure. In the event of such additional burden, the fee shall be calculated based only on the increased burden created by the structure.
SECTION 6. IMPACT FEE DUE UPON ISSUANCE OF STRUCTURAL BUILDING PERMIT. The impact fee imposed pursuant to the terms of this Ordinance shall be due and payable upon the issuance of a structural building permit by the City of
Noblesville, Hamilton County, Indiana. In this regard, it is understood that the term structural building permit is synonymous with the term as that term is used in IC 36-7-4-1323, in that the issuance of a structural building permit authorizes the applicant to
commence construction activities, structural and otherwise. The entire fee, which is calculated pursuant to the terms of this Ordinance, shall be due at said time unless the amount of the fee upon calculation is greater than Five Thousand Dollars ($5,000), in
which case an installment plan may be requested by the applicant in accordance with the terms set forth in IC 36-7-4-1324 (a), (b), (c), and (d). The Noblesville Impact Fee Review Board shall establish specific rules consistent with said code provisions for
installment payments. The interest rate on any installment payments shall be five (5%) percent per annum unless amended by the Board of Public Works and Safety. In addition, any late payment of an installment payment shall be assessed a late payment fee
of ten (10%) percent as provided by Indiana Code 36-7-4-1324.
If the fee payer requests, the amount of the impact shall be assessed upon the voluntary submission of a development plan or upon the issuance of the structural building permits, whichever is earlier. For purposes of this section, “assessment” means the
act of calculating the amount of the impact fee, which shall be due. The City shall make such assessment within thirty (30) days of the date of such voluntary request or at the issuance of the structural building permit with or without a request.
SECTION 7. LIEN RIGHTS ESTABLISHED. Pursuant to IC 36-7-4-1325, the City of Noblesville acquires a lien against the real estate which is the subject of the impact fee. Upon adoption, this Ordinance shall be recorded and thereafter, it shall
constitute constructive notice of lien rights with respect to a parcel of real estate which is the subject of an installment payment of an impact fee, and such instrument shall constitute actual notice in addition to the constructive notice provided for by the
recording of this Ordinance.
SECTION 8. FORM OF RECEPT. The Clerk Treasurer of the City of Noblesville shall issue a receipt for any and all impact fees collected, and the form of such receipt shall be as follows:
“Received of _____ (fee payer), this day of _____the sum of $ ____ in (full) (partial) satisfaction of Park and Recreation Impact Fees due pursuant to Ordinance No. relating to improvements to be constructed on real estate described on
Exhibit A, attached hereto, made part hereof, and subject to lien rights in favor of the City of Noblesville in the event of partial payment with payments remaining due. The remaining balance due (if any) is in the following amount: $ _____. The
impact fee is dedicated to the creation of the following infrastructure elements in accordance with the Zone Improvement Plan: _____ Clerk-Treasurer, City of Noblesville, IN
SECTION 9. APPEALS. Any fee payer who believes itself to be aggrieved by the calculation of the impact fee, may appeal from said calculation to the City of Noblesville Impact Fee Review Board who will conduct a hearing with regard thereto. At
such hearing, the fee payer shall bear the burden of going forward with the evidence and shall present evidence addressing either of the following propositions:
(a) a fact assumption used in determining the amount of the impact fee is incorrect; or
(b) the amount of the impact fee is greater than the amount allowed under IC 36-7-4-1320,1321, and 1322.
Upon conclusion of the presentation of evidence, the City of Noblesville Impact Fee Review Board shall make a determination within not more than thirty (30) days, upon the facts presented and may make such adjustments in the impact fee as they
believe are appropriate under the circumstances, if any.
An appeal under this section must be filed not later than thirty (30) days after the issuance of the structural building permit. The appeal shall be initiated with the filing of a Petition for Review with the Clerk-Treasurer’s Office, together with a filing fee
in the amount of One Hundred Dollars ($100). The filing fee shall be refunded in full: (1) if the Petition for Review is granted and the impact fee is eliminated, reduced, or adjusted by the City of Noblesville Impact Fee Review Board, by independent action of
the City, or by a Court having jurisdiction, and (2) if the reviewing body determines that the amount of the fees, reductions, or credits were arbitrary or capricious. The Petition for Review shall be in a form calculated to inform the City of Noblesville Impact
Fee Review Board of the nature of the complaint, the Parties to the action, and the relief requested. In addition, the Petition shall describe the new development on which the Impact Fee has been assessed, all facts related to the assessment of the impact fee,
and the reasons the Petitioner believes that the amount of the impact fee assessed is erroneous or is greater than the amount allowed by the fee limitations set forth in the enabling statute.
If an appeal is filed, the City shall not deny the issuance of a structural building permit on the basis that the Impact Fee has not been paid, or condition issuance of the permit on the payment of the Impact Fee. If an appeal is denied or Impact Fee is
modified, and a building permit has been issued without payment, an occupancy permit shall not be issued until the fee is paid.
SECTION 10. ESTABLISHMENT OF PARK AND IMPACT FEE RECREATION FUND.
The Common Council ratifies the previously established Park and Recreational Fund of the City of Noblesville. These Funds shall be a non-reverting fund and shall receive any and all sums collected pursuant to this Ordinance and proceeding
Ordinances to be utilized in connection with the purposes set forth herein. In the event, and only in the event, that an additional impact zone is created hereafter, a separate account shall be maintained for each separate impact zone established within the City
of Noblesville. Interest earned on the Fund or on any account within the Fund, shall be deposited and maintain within the Fund or the separate account. The Clerk-Treasurer of the City of Noblesville shall maintain records of the status of the Fund or any
account, which may establish therein, and shall make an annual report of said Fund and accounts which shall be available to the public in general and fee payers, upon request, in particular.
Pursuant to IC 36-7-4-1322 (e), the Clerk-Treasurer is designated as the City Official responsible for acting upon refund requests. In order to facilitate refunds when they may be due, the Clerk-Treasurer is directed to identify the purpose of any impact
fee paid in order that a refund, if any, may be paid from the Fund or account into which the fee was originally deposited.
SECTION 11. USE OF IMPACT FEES COLLECTED PURSUANT TO THIS ORDINANCE. Any and all fees collected pursuant to the provisions of this Ordinance may be utilized for the following purposes only by the City of Noblesville, acting by
and through its Common Council, which for the purpose of this Ordinance is identified as the “infrastructure agency” contemplated by IC 36-7-4-1317.
(a) providing funds to be utilized by the City of Noblesville for the purpose of paying the capital costs of new park and recreational infrastructure that is necessary to serve the new development within the corporate limits of the City and that is
identified in the Plan;
(b) an amount not to exceed five percent (5%) of the annual collections of the fee to be utilized for expenses incurred by the City for the consulting services used to establish this Ordinance;
(c) to pay any refund due pursuant to the terms of this Ordinance;
(d) to pay the debt service cost on an obligation issued to provide new park and recreational infrastructure described in Sub-paragraph (a) above.
SECTION 12. HOUSE ENROLLED ACT NO. 1467. The Common Council of the City of Noblesville, Hamilton County, Indiana, specifically acknowledges the existence of a law adopted by the General Assembly of the State of Indiana which
regulates the imposition of Impact Fee Ordinances by municipal corporations within the State of Indiana. It is the intent of the City of Noblesville to comply with such legislation, and this Ordinance shall be constructed in all respects to be consistent with the
Act. The substantive and procedural requirements of IC 36-7-4-1300 et. seq. shall control in the event of conflicts, which are unintended by the Common Council and the City.
SECTION 13. AMENDMENTS AND REVIEW. The impact fee provided for herein is based upon data which, in large part, is subject to inflation and other economic and market forces over which the City has no control. The Common Council may,
not more than once each year, cause to be reviewed by City staff or consultants as may be required, to determine the continuing validity of the Impact Fee, the Impact Zone, and the Zone Improvement Plan. The Common Council may consider and adopt such
amendments as are necessary to cause a substantive compliance with the rational nexus test to continue, to insure that procedural due process is maintained or enhanced to insure that this Ordinance meets the requirements of the Indiana Code 36-7-4-1300
series. To the extent required by the facts and circumstances, this process shall include the steps necessary to update the Zone Improvement Plans and the City’s Comprehensive Plan.
SECTION 14. EFFECTIVE DATE. This Ordinance shall amend Ordinances No. 45-9-00, No. 61-8-03, No. 34-03-06, and No. 37-10-10. The provisions of Ordinance No. 37-10-10 shall remain in full force and effect until the 1st day of August, 2015,
after which the terms of this Ordinance shall be in full force and effect until amended or repealed.
