What makes a great leader? If you look at our association, the answers
are as varied as the people who make up the Sacramento Association of
REALTORS®.
We have a tremendous amount of talent within our own ranks. The
wonderful aspect of this is that our abilities vary widely, from a love for
governance to a love of marketing; a commitment to ethics to a belief
in education; an aptitude for technology to the energy for fundraising.
What makes this particularly interesting is the fact that we are all
entrepreneurs and as such, have a tendency to be leaders in our own
right. We create our own business, promote ourselves and our company
and most of us take on the responsibility of bringing forward people
who we see as having potential in their chosen field.
An exciting phenomenon occurs when positive encouragement is
given to those who are empowered to reach a higher potential. Just a
small nudge can create a momentum that helps people surge to heights
even they had not expected. Given the opportunity to learn, grow
and mature, leaders are born by sheer recognition of their abilities and
promise.
The Sacramento Association of REALTORS® is always looking forward
to our future leaders. We offer the Leadership Academy which allows
its students to learn all of the opportunities to move forward within the
association. It is a chance to spread a person’s wings, to learn how much
more they can accomplish than they ever dreamed of.
Whether it be through the Leadership Academy, a mentor or other
offerings, take the chance and the time to find out just how great you
can be.
Election Spotlight – Help Elect Your Leaders
The time to elect SAR Leadership for the 2015 – 2016 Board of Directors
is fast approaching. As an SAR Member, you have the opportunity to vote
for the candidates. SAR recently promoted the opportunity to apply for
this prestigious position and revised the qualifications in a sincere
effort to find a more diverse group of applicants. The voting period will
begin Friday, July 25th and remain open until Thursday, August 14th.
Please watch your SAR emails for information regarding the election,
instructions to vote and the outcome of the election.

The month of May is undoubtedly the most active month of 2014 for
governance issues for SAR. We start off the month with the C.A.R. Legislative
Meetings in Sacramento. Approximately forty SAR members and staff
participated in the meetings with the goal of helping California REALTORS®
move forward with legislative and administrative action to help promote the
interests of our clients and the real estate industry.
During the second week of May, SAR sent representatives to participate
in the Sacramento Metropolitan Chamber of Commerce sponsored event
referred to as Cap2Cap. That stands for Capitol to Capitol and sees more than
100 representatives of various government and business interests travel to
Washington, DC to express the concerns of the area and lobby for legislative
support in dealing with those issues.
The third week NAR legislative meetings are scheduled in Washington, DC.
There our representatives will work with other REALTORS® to lobby for legislative
support for our issues. Some of the key items are Fannie Mae and Freddie Mac
reorganization, mortgage interest deductibility and implementation of the
Dodd-Frank provisions related to the mortgage industry.
Hectic as all this sounds you must consider that some individuals will be
participating in all three of these events on our behalf. What a commitment of
service to our members and to the industry. If any of this sounds interesting to
you then I encourage you to get involved as a volunteer serving the interests
of SAR.
May also sees the Nominating Committee interviewing and selecting the
candidates for your consideration to serve as Directors for 2015-16 as well
as Secretary/Treasurer and President-elect for 2015. Later this summer the
election shall occur and the leadership for 2015 will be determined.
Watch for announcements coming soon regarding the outcome of each
of these events. It will be a great month to be tracking the work of SAR
volunteers. Interested in participating? Contact any SAR volunteer leaders or
staff, and let us know you want to be a volunteer. Greater participation of all
members is always encouraged.

Election Tides
It is already an election year again! And with
that we find the always predictable rotating of
seats throughout the Sacramento Region. This
year is particularly busy because Senator Darrell
Steinberg is termed out of the California State
Senate, creating more movement than usual.
Turnout for the June Primary is expected to be
low – very low, with a governor’s race that is
only contested on paper and no particularly hot
propositions garnering attention. Turnout will
likely not reach 30%.
With Senate Pro Tem Darrell Steinberg
leaving the Senate due to term limits, current
Assemblyman Dr. Richard Pan and Assemblyman
Roger Dickinson are vying for the 6th Senate
District, which includes the City of Sacramento,
the Pocket-Greenhaven community, the Airport,
South Sacramento, and a small portion of Elk
Grove.
Roger Dickinson is leaving the 7th Assembly
District in his bid for the State Senate. This
district includes the City of Sacramento, West
Sacramento, Natomas, Rio Linda, Elverta,
Antelope, and North Highlands. Sacramento City
Councilmembers Kevin McCarty and Steve Cohn,
as well as West Sacramento Councilmember
Mark Johannessen are running for this Assembly
Seat.
Dr. Richard Pan is leaving the 9th Assembly
District in his run for the State Senate. This district
includes the Pocket, Florin, Elk Grove, Clarksburg,
Galt and Lodi. Sacramento City Councilmember
Darrell Fong, Elk Grove Councilmember Jim
Cooper, and Sacramento City Unified School
District Trustee Diana Rodriguez are running to
represent the 9th Assembly District.
This election will bring further changes to the
Sacramento City Council which has seen several
new members in the last few years. Longtime
Sacramento City Councilmember Steve Cohn
would be up for election this year and there are
a number of people running to take his place on
the City Council, including financial planner Cyril
Shah. The 7th District Seat is also up for election
currently held by Councilman Darrell Fong.
Rick Jennings and Julius Cherry are running to
represent this Pocket district.
I hope you plan to vote in the June 3rd election.

MASTERS CLUB CORNER

in this business as we head into
a strong spring selling market!

With our Masters Club Awards
Luncheon at the Hyatt just behind us and the
installation of our new President, Luis Sumpter,
we feel like we are in good hands and off to a
great start for 2014! Last year, 2013 was a turning
point for all of us and even more so for our “new”
Master’s Club members who met the criteria of
$3.5 million in closings for the first time. Only 10%
of agents earn this designation.
One of the new Masters Club inductees to
receive her designation was Keri Steinberg, who
just made a big move to Re/Max Gold, Sierra
Oaks. I just met Keri for the first time at the awards
luncheon last week.
Keri came to Sacramento in 1997 to attend
McGeorge Law School. She passed the bar and
worked as a DA in that office for 10 years. She met
her husband there, married and they had their
first child in 2005. At 3 years of age her son was
diagnosed with a brain tumor which completely
upended their lives. They moved to San Francisco
for her son’s treatment at UCSF. They also had a
one-year-old by this time and all moved into an
apartment for a year in San Francisco.
When they returned to Sacramento a year later,
Keri took time off to care for her boys for a couple
of years. Her first son is doing fine and in a great
school for his needs. The boys are six and eight
years old now and playing sports too.
Keri then decided to go for her real estate license,
thinking it would be more flexible than a 9-5 job
and would allow her to spend more time with
them. She started at Century 21 and then moved
on to Lyon Sierra Oaks for a couple of years. In
March of this year she made the decision to move
to the new Re/Max Gold, Sierra Oaks office to work
with a selling agent there. She is very excited in
this new move and the people she will be working
with there.
Keri will continue to be a Buyer’s Agent, her
specialty, working in the Del Dayo and Arden
Neighborhoods where she lives with her family.
Congratulations Keri on your accomplishments
and here’s to a very successful 2014!

Neighbors or Nuisance
At last month’s Nor-Cal Real Estate Expo, several different agents asked
me about disclosing that there is an obnoxious neighbor. While the rule
generally is disclose, disclose, disclose, this issue strays into a gray area... but
there is some legal guidance for us.
Sellers, as well as their agents, must disclose any adverse conditions of the
property that might “materially affect its value to a Buyer”. Often, Sellers are
hesitant about disclosing defects because they fear that it may make their
home unsellable. However, failure to disclose adverse conditions is a sure
way for the Seller and the agents to get sued by the Buyer after the sale
closes. But how do you handle the issue you can’t fix.. such as the obnoxious
neighbor?
First, understand what we’re talking about legally...a Nuisance. A Nuisance
can be (1) Private: when someone prevents or disturbs your use or
enjoyment of your property - such as the shouting or fighting neighbors or
barking dog; or (2) Public: when the disturbance affects others as well - such
as operating a crack house, or the rock band practicing, or the retail home
business with lots of traffic.... even Justin Bieber speeding down the street
in his Ferrari. The obnoxious neighbor can be both... and if it is a nuisance,
then you are required to disclose.
But like so many legal issues, this can be a gray area: Ask yourself these
questions:
(1) Is the neighbor’s conduct personal to this Seller? Maybe it’s a personal
dispute. If so, then this might not materially affect the value of the Property
for a Buyer. But if Police have been called, it’s probably serious and should
be disclosed and explained.
(2) Does he have the same problems with other people in the
neighborhood? If so, then it’s probably not personal and it is likely that
the Buyer would encounter the same issue. This should be disclosed and
explained.
(3) Is this the reason the Seller is moving? If it is substantial enough that
it is driving the Seller from the neighborhood, this should be disclosed and
explained.
The key here is Disclosure. The Buyer may be so in love with the home
and the neighborhood that they might not really care about problems the
Seller had. By meeting your Disclosure obligations, the Buyer will have the
opportunity to determine whether to check this out more or not... it does
not mean that your sale will die. On the other hand, the penalty for failing to
disclose a nuisance can be very severe... including rescission of the sale (give
me my money back) plus attorney fees, court costs, and other damages!

SAR Has Lost a Legend
On April 5, 2014, the world lost a true innovator, philanthropist and visionary. A
woman who contributed her all to her profession and her community, retired SAR
Member Neva Cimaroli passed away at the age of 87.
Neva joined SAR on January 1, 1955. While an SAR Member, you might say she
boldly went where others had never gone before. Neva was a natural leader, never

timid about stating her mind. Quickly earning the respect of her peers, she became
the Association’s first woman director and the first woman president. In 1979, Neva was awarded
“REALTOR® of the Year.” She also served as Director of the National Association of REALTORS®.
She and partner Adelle Taylor, owned Cimaroli & Taylor Real Estate at 911 22nd St., Sacramento.
Neva partnered with her brother, Dale Morris, to create a real estate and investment business.
They purchased their childhood ranch in Folsom from their parents and developed Pinebrook
Village Manufactured Home community in 1971. Neva and Sevy eventually moved their home from
Sacramento to Pinebrook Village where they made many lifelong friends and were active members
of the community they loved. Neva always said she was a “failure at retirement” and continued
working until the age of 86.
Neva’s passion for the economic, civic, and cultural development of Folsom kept her actively
involved with the Folsom City Council and the Folsom Redevelopment Agency. She was named
“Woman of the Year” by the California Legislature in 2001. Neva was a generous contributor to the
Mercy Foundation and served on various leadership boards for nearly 20 years. She worked with the
Sisters of Mercy to facilitate the acquisition and restoration of deteriorating apartment buildings in
Folsom to provide housing for low-income families. She was instrumental in securing the 26 acres of
land where Mercy Hospital of Folsom is now located. Neva also served as a volunteer and contributor
to the Los Rios Community College Board, Folsom Community College and Three Stages Performing
Arts Center. She loved and supported the programs of the Music Circus, Folsom Lake Community
Concerts, Folsom Symphony and KVIE. Neva was the first recipient of the Foundation’s “Inspirational
Philanthropist Award” in 2011. Neva possessed great talent, wisdom, knowledge, insight, spirit,
dedication, generosity, compassion and love. According to her friend and colleague Judy Thompson,
“Neva was small in stature (5’3”) but lived largely for the benefit of others, touching the lives of many
during her lifetime.”
She will be forever missed by all who knew and loved her. A Celebration of Life will be held Friday,
May 16, 2014 at 2:00 P.M. at the Folsom Community Center, 52 Natoma Street, Folsom. In Lieu

Closed escrows jump for spring, pending sales still on the rise
Closed escrows increased to 1,244 total sales
for the month of March. This is up 26.4% from
the 984 sales in February, but still 14.2% down
from March 2013. The lowest monthly total in
recent history was just 707 closed escrows in
September 2007. Making up the sales this month
were 97 REOs (7.8% of all sales), 106 short sales
(8.5%) and 1,041 equity sales (83.7%). Compared
to last month, REO sales have increased 18.1%,
short sales dropped 32% and equity sales have
increased 3.4%.
The Active Listing Inventory in Sacramento
County decrease for the month to 1,907 listings,
down 5.3% from 2,013 listings of February. Yearto-year, the current number is down slightly
(.2%) from the 1,956 units of March 2013. With
the increase in sales and largely unchanged
inventory, the months of inventory decreased
significantly, 25%, down to 1.5 months. The
months of inventory reflects the length of time
(in months) that it would take to deplete the
current inventory at the current sales rate.
The month-to-month median sales price
increased .9% from $260,000 to $262,450. The
current level is 20% above the $218,750 median
sales price of March 2013. The current figure is
up 64% from the January 2012 low of $160,000.
When compared to the all-time high ($392,750/
Aug. ’08), the current figure is down 33.1%.
Homes priced between $200,000 and $299,999
accounted for 38.4% (480) of the 1,244 sales this
month. Homes between $100,000 and $199,999
totaled 280 (22.5%) units and homes $99,999
and under totaled just 17 units (1.3%). This
month also recorded 11 sales between $600,000
- $999,999 and 5 sales over $1,000,000.
Month-to-month, closed escrows from cash
financing (306 units or 15% of all sales) decreased
.3%, conventional buyers decreased 1.1% (615
units/45.3%) and FHA financing decreased 2.9%
(281 units/20.7%) sales. These numbers include
the 115 condo sales this month. The average
amount of days spent on the market (from list
date to opening escrow) decreased to 38 days
from 39; the median DOM decreased 9% to 19
(from 21). In a breakdown of length of time on
market, 63.1% (857 units) sold in 30 days or less.
16% (218 units) sold between 31 and 60 days.
The remaining 20.8% (284 units) sold in 61 days
or more. The average price per square foot of
all sales recorded was $170/ft2. This is up 2.4%
from the $166/ft2 recorded last month. View all

Condominium Resale Market
Sacramento condominium sales increased
16.1% for March to 115 units. This is down 6.5%
from the 123 units sold in February 2013. REO
property sales accounted for 9.5% (11) of all units
sold, while short sales (5.2% or 6) and equity
sales (85.2% or 98) accounted for the remainder.
The condominium median sales price decreased
month-to-month, down 9.2% from $140,000 to
$127,000. This current price is 21% higher than
the March 2013 ($105,000) median sales price.
The Active Listing Inventory increased 4.7%
month-to-month from 212 Active Condo Listings
(includes 24 Active Short Sales) to 222 (includes
23 Active Short Sales). The Total Value of Closed
Escrows was $16,420,952; this is down 8.2% from
the February Total Value of $17,881,011.

The April Main Meeting was Electric
The SAR April Main Meeting was electric. We
welcomed a unique panel discussion and had
electric vehicles on site, as well as car dealers to
answer questions about the vehicles.
There were nearly ten different models of
electric vehicles in the SAR parking lot including
two Teslas, a Nissan Leaf, a Fiat 500e and Cadillac
ELR. REALTORS® in attendance were able to ask
the dealers a variety of questions about the
cars, including the ever popular Tesla question
“exactly how fast does it go.”
The morning kicked off with a panel discussion
about electric vehicles, available tax rebates,
and how they could be an asset to a REALTORS®
business. Panelists included West Sacramento
Mayor (and Tesla owner) Christopher Cabaldon,
Lisa Chiladakis with the California Plug-in
Electric Vehicle Collaborative and the California
Air Resources Board and Bill Boyce, Supervisor of
Electric Transportation at Sacramento Municipal
Utility District. Like Mayor Cabaldon, Chiladakis
and Boyce drive electric vehicles themselves
and were able to provide personal insights on
how they can fit into one’s daily routine, and
how going to the gas station has become an
arcane notion for them.

Mayor of West Sacramento Christopher Cabaldon, an EV owner, explains the many
benefits associated with driving an electric vehicle. Cabaldon, along with Lisa
Chiladakis of the CA Plug-In Eletric Vehicle Collaborative and Bill Boyce of SMUD,
provided valuable insight into the EV industry.
The weather, unfortunately, did not allow
REALTORS® to test drive the different cars and
enjoy a BBQ lunch, but the event was a hit
despite the rain. We are working on rescheduling
the driving portion of this event for the coming
months. Stay tuned and we will let you know
when the electric vehicles will be back at SAR.

Drone Operator

An administrative law judge has
considered whether the Federal
Aviation Administration (“FAA”)
had the power to fine an
individual for operating an
unmanned commercial
aircraft, or drone, in
U.S. airspace without
authorization.
The FAA fined Raphael Pirker (“Operator”)
$10,000 for using a drone to shoot a promotional
video. The Operator appealed the fine, arguing
that the FAA lacked the authority to impose such
fines because there were no rules regulating the
use of drones.
In 2012, Congress created legislation directing
the FAA to create rules regulating the operation
of drones by 2015, and the FAA plans to issue
proposed regulations by November 2014.
A judge from the Office of Administrative Law
Judges, National Safety Transportation Board
(“ALJ”), reversed the FAA, agreeing with the
Operator that the FAA did not have the power
to impose a fine upon him at this time. The FAA
rules define an “aircraft” as a “device intended to
be used for flight in the air.” However, the FAA
has historically not regulated “model” aircraft,
and has issued separate guidance to operators
of model aircraft for voluntary safety standards.
The ALJ determined that because the FAA
has historically excluded model aircraft from
its regulations, it could not now use its rules
to impose a fine on the Operator for his use
of a drone. Model aircraft is only subject to
voluntary compliance by the FAA and the FAA
does not regulate all flying devices as aircraft.
For example, the FAA has created specific rules
for Ultralights, a device used for flying in the
air. Even though the Ultralight can fly, its rules
are separate from those governing aircraft and
the agency does not refer to these devices as
aircraft but rather as an “Ultralight Vehicle”,
demonstrating that the FAA does not treat all
flying devices as aircraft.
The FAA has also issued policies for unmanned
aircraft systems (“UAS”) and the FAA claimed
that these policies gave it the authority to
regulate drones. However, these policies were
not directed to the general public but intended
as internal guidance for FAA personnel. In
addition, these policies did not go through the
proper rulemaking process that would have
given FAA regulatory authority over drones,
such as providing notice of the proposed rules
and receiving comments. Because the FAA
did not have formal rules regulating the use of
drones and UASs, the ALJ reversed the FAA’s fine
imposed upon the Operator.

Recent and Upcoming Volunteer Opportunities
American River Parkway Clean-Up
On Saturday, April 5th, SAR volunteers could
be seen picking up debris along River Bend
Park. How could you tell they were with SAR?
Those bright green REALTOR® t-shirts are a dead
giveaway! We certainly appreciate you getting
your hands dirty and helping “Sacramento’s
Jewel” shine for years to come. SAR will be
having another clean-up day, this time along the
mile SAR sponsors (13 South), later in the year.
Watch your weekly emails!
Our diehard volunteers weren’t going to let the beautiful day stop them from going
out on the Parkway and picking up some trash! It is really a great opportunity to see
how vibrant the entire American River Parkway is.
Volunteers Michele Ambry and Amber Coppedge take a quick break to show off their
bags full of “treasures” found down by the river.
Those bright green shirts provided two uses: to help identify our volunteers as
REALTORS® helping the community and to act as an emergency beacon should one
of them fall into and start floating down the river…
Wellspring Women’s Center
A small group of SAR volunteers were needed to
help greet clients and serve breakfast at the Wellspring
Women’s Center on Friday, May 2nd. This organization
serves over 200 women and their children every weekday,
providing a nutritious breakfast, free counseling and
safety net services. We are certainly proud
of our volunteers who helped with this
great duty.

Rebuilding Together
This great effort on April 26th offered volunteers
a chance to showcase their skills – or learn
some new ones. From painting to plumbing,
this Rebuild Day helped rehabilitate the owneroccupied home of a very grateful citizen in South
Sacramento. Volunteers have been known to
build fences, hang new rain gutters, install a
bathroom vanity and paint an entire house. There
is truly a job for everyone! The next Rebuild Day
will be in October – please stay tuned for details.
The whole crew poses with the homeowners (blue shirts). This family was truly
grateful for the help and did not hesitate to lend a hand during the day, helping cut
lumber and building their fence.
This crew does not have a problem “getting off the fence” and you can tell by the great work they are doing!
Rico Rivera sheds some light on the situation by
installing a brand new light/fan ceiling fixture and
receives some support from his colleagues.

it is central to everything, the mountains/
snow, the beach, lakes.

I love sleeping, watching TV, cooking,
and animal training.
Any favorite vacation spots?
I was an Exotic Animal Keeper for PAWS.
I took care of lions, tigers, and bears, oh
my! ;)
Why were you attracted to the position? What
do you hope to bring to SAR?

Are you a fan of social media? Why or why not?
I previously worked for MetroList from
2005-2013, so I’m familiar with the MetroList
functions. I hope to learn more about SAR’s
function in our community. I hope to bring
a sunny disposition to the office and be of
assistance to our members.
How long have you lived in the Sacramento
area? Where have you lived before?
I enjoy using Facebook to keep in contact
with friends from school.
Do you have a favorite restaurant in
Sacramento?
I was born and raised in Sacramento. The
only time I’ve lived outside of Sacramento
was in 2004 when I attended military school
through the Air Force in San Antonio, TX.
That I’ve trained a number of exotic
animals including cheetahs, bobcats,
mountain lions, ocelots, primates, camels,
and much more.
My favorite restaurant is in Rocklin. It’s
called Lucille’s.

you?

COMMIT TEE SPOTLIGHT
Equal Opportunities/Cultural Diversity Committee
This committee is responsible for reaching out
and connecting SAR with various cultures in the
Sacramento Region. They strive to “celebrate and
promote diversity” throughout SAR’s jurisdiction
and keep SAR visible in the local real estate
industry. This year the Committee is led by
Chair Asia Allen. In the past this committee has
worked with the local Asian/Pacific Islander
Chamber of Commerce, Hispanic Chamber,
Black Chamber, Rainbow Chamber, Indus Valley
Chamber and Vietnamese Chamber. In addition
to these chambers, SAR also collaborates with
a variety of real estate organizations including
Asian Real Estate Association of America
(AREAA), Sacramento Realtists and the National
Association of Hispanic Real Estate Professionals
(NAHREP).
SAR volunteers, led by 2014 Committee Chair Asia Allen, inflated hundreds
of balloons emblazoned with the REALTOR® “R” and handed them out to the
community in preparation for a March to the Capital that celebrated Dr. Martin
Luther King, Jr.
The Equal Opportunities/Cultural Diversity
Committee also likes to stay involved in many
community events. They recently participated in the
2014 Black Expo, the NAACP Prayer Breakfast, the
Martin Luther King, Jr. Day March/Parade and the
Hmong New Year. These events help connect SAR
to the community, while promoting the benefits of
using a REALTOR® for your real estate needs.
This group is also committed to educating
REALTORS® about diverse cultures and, more
importantly, avoiding offensive or insulting
behaviors. A biannual seminar titled “The
Language of Real Estate” explores the nuances
of different cultures. This particular seminar will
feature real estate professionals representing
the East Indian, Hmong and Korean cultures. The
seminar will be presented in a “Lunch & Learn”
format. Be sure to Save The Date: Wednesday,
June 11th from 12noon – 1:30pm.
With an average attendance over 10,000, the Hmong New Year at Cal Expo is an
exceptional event to reach out to the committee. SAR’s booth became popular over
the 4-day event due to our fun prize wheel and numerous prizes, including CFLs.
