parents, teachers and community.
Students who desire to comment at a Board meeting should make their presence known
to the District Clerk prior to the beginning of the meeting so that the Board President can
consider allowing the comments to be made at the beginning of the meeting.

3} WHEREAS, on September 20, 2012 a Tax Certiorari Reserve fund (TCRF) to be
known as the Tax Certiorari Reserve was established pursuant to section 3651 (1-a) of the New
York State Education Law for the purpose of defraying the potential costs of refunds that may
become due from the school district as a result of settlement of our judgments resulting from tax
certiorari proceedings;
WHEREAS, the Tax Certiorari Reserve is no longer needed for the purpose of defraying the
potential costs of refunds that may become due from the school district as a result of settlement
of or judgments resulting from tax certiorari proceedings;
WHEREAS, the Tax Certiorari Reserve was funded in the 2012-13 fiscal year in the amount of
ONE MILLION FIVE HUNDRED THOUSAND DOLLARS ($1,500,000);
WHEREAS, in compliance with General Municipal Law Section 6-r, public notice was given by
publication in Newsday on June 2, 2014, in The Massapequa Post on June 4, 2014 and in the
Massapequa Observer on June 4, 2014, that the Board of Education of the Massapequa Union
Free School is proposing to transfer the balance of the TCRF established on September 20, 2014
pursuant to section 3651 (1-a) of the New York State Education Law to the Retirement
Contribution Reserve Fund (“RCRF”) and thereafter abolish the TCRF and that a public hearing
on such proposed transfer and abolishment would be held on June 19, 2014 at approximately 8
p.m. prevailing time, in the Massapequa High School Auditorium, 4925 Merrick Road,
Massapequa, NY;
WHEREAS, in compliance with General Municipal Law Section 6-r, on June 19, 2014 at
approximately 8 p.m. prevailing time, in the Massapequa High School Auditorium. 4925 Merrick
Road, Massapequa, NY said public hearing was held;
NOW THEREFORE BE IT RESOLVED, that the balance contained in the Tax Certiorari
Reserve is hereby transferred to the RCRF, established pursuant to section 6-r of the General
Municipal Law; on May 22, 2008;
BE IT FURTHER RESOLVED, that the Tax Certiorari Reserve is hereby abolished; and
BE IT FURTHER RESOLVED that this Resolution shall take effect immediately
4} RESOLVED that the Board of Education approves an appropriation adjustment for the
2013/14 fiscal year amounting to $210,000.
5} RESOLVED that the Board of Education hereby accepts the revisions to Board of
Education Policy 5300, Code of Conduct, as written and directs the administration to reflect the
same in Board of Education policy and district publications as per the attached.

6} WHEREAS, the Superintendent of Schools has recommended that a $200 tuition
reimbursement grant for inservice training be awarded to the following teachers in accordance with
the procedures outlined in the Collective Negotiations Agreement between the Board and the
Teachers’ Unit, be it hereby
RESOLVED that the Business Office is authorized to provide reimbursement upon satisfactory proof
of completion of the course.
7} Resolved that the Board of Education approve the selection of 10 Massapequa High
School students to be the recipients of the Edmund J. O'Connor & Louise O. Butler Scholarship
in the amount of $5,000 as per the attached.
8} Resolved that the Board of Education approves the change in date for the Board of
Education Organization Meeting from July 1, 2014 to July 15, 2014.
9} Resolved that pursuant to Commissioner's Regulation 200.5(i) the Board of Education
does hereby appoint Elise Kestenbaum to serve as the Impartial Hearing Officer for Student
Number 224180073.
The Board of Education allows time at the conclusion of its regular meetings for
questions and/or comments from residents in attendance. Residents are encouraged to
share their ideas, comments and questions. Although a total of thirty minutes is allowed
for questions and/or comments, the Board President has discretion to adjust the total time
should the nature of the discussion merit it. Those commenting are requested to state their
name and address when the address the Board and each individual will be entitled to pose
one question or comments so all interested parties may be recognized.

Facilities Committee
A group of individuals from the facilities department, Board of Education, community, staff and
professional - charged with the task of identifying and prioritizing projects which need to be
completed district wide.
Resources used to identify these projects included review of the 2010 Building Condition
Survey (BCS), 2011 - 2014 Annual Visual Inspections (AVI’s), discussions with building
Principals, items which can no longer be addressed through routine maintenance and items
which fall under local / state mandates.
As a result the committee through consensus identified approximately 130 individual
projects, affecting all buildings which reflect the Districts needs to ensure the health and
safety of the students & staff is maintained while maintaining an environment which is
conducive to the education process. These projects are grouped into 6 categories.
Project Categories
Infrastructure
Projects which affect the daily operation of the facilities and maintain the mechanical,
electrical, structural and building envelope systems. These projects make up the largest
component of the proposed bond in quantity and cost and if not addressed could lead to
more costly future issues.
Many of these projects have a direct result on the efficiency of a building and can help
lower energy consumption while reducing operating costs over their life expectancy.

Projects which affect the health & safety of the students and staff. These projects have the
highest priority with SED and critical failures of these systems could result in the certificate of
occupancy being revoked.
Included in this group of projects are those which deal with school security. A recent initiative
from SED allows for an additional 10% building aid for qualifying projects and these will be bid
separately to take advantage of this program.

This category deals with upgrades to technology on a infrastructure level, including interior
renovation to the Network Operations Center (NOC) located within the Administration wing.
Monies earmarked under this category will provide funding available for potential upgrades
needed as a result of the technology audit currently being performed.

Projects which address the buildings grounds, vehicular & pedestrian circulation. These
issues become capital projects when they exceed the scope of work which can be completed

Requirements for a Building Permit
As required by the Secretary of State & the Office of Facilities Planning (SED) all capital
improvement projects undertaken by a School District, meeting certain criteria are required to
be submitted to SED for approval. Upon approval a building permit is issued which allows the
District to go out to public bid for the work.
Failure to obtain a permit, could result in a loss of potential building aid for the District and
possibly having the buildings certificate of occupancy revoked not allowing the building to be
occupied by students.
The importance of the building permit is to assure that the work will be done properly
to preserve the health and safety of a facility’s occupants or users.

Building Aid for School Districts
Building Aid is available for certain approved capital projects. In accordance with Section
3602, subdivision 6, of the Education Law.
The Commissioner of Education must approve plans and specifications for capital
construction projects undertaken by school districts via building permits (prior to bid).
Building Aid Units (BAU) x Construction Cost Index x
Regional Cost Factor
Building Aid is paid over the useful life expectancy of a project in terms of 15, 20
or 30 based on the type of project being done. Most of the projects within the
bond would qualify for a 15yr. reimbursement.

Construction Process & Oversight
§ Design professional will work with the District to identify and define each of the projects
scope, to ensure the Districts expectations are met both on a facilities side as well as in
line with current and future educational needs.
§ Projects will be submitted to the State Education Department to ensure compliance with
permitting regulations, SED guidelines and grouped to maximize building aid.
§ Upon approval projects will be publically bid in accordance with the NYS competitive
bidding laws to ensure the best possible pricing and similar projects bid to take advantage
of economy of scale.
§ Design professionals along with the District and construction managers would evaluate
the bids to ensure awards are made in the best interest of the District and to identify the
lowest, qualified contractor meeting specifications are awarded the work.

Construction Process & Oversight - Continued
§ The District, A/E, & CM will administer the contracts and inspect the work daily to ensure
compliance with the contract documents and ensure the work is progressing in a timely
fashion.
§ Oversight of the construction at multiple buildings simultaneously is crucial to ensure
compliance and this is where a construction management firm is most qualified to provide
the day-to-day coordination of the multiple trades and track schedules.
§ Payment to contractors are reviewed and only upon approval by the District, A/E & CM
are processed.
§ Quality of work and final product are approved by the District, A/E & CM.
§ Punchlists and closeout documents are prepared and enforced by the District, A/E & CM
§ Upon acceptance of closeout documents, the contacts are closed and final cost reports
submitted to SED for start to receive building aid.

WHEREAS, on September 20, 2012 a Tax Certiorari Reserve fund (TCRF) to be known as the
Tax Certiorari Reserve was established pursuant to section 3651 (1-a) of the New York State
Education Law for the purpose of defraying the potential costs of refunds that may become due
from the school district as a result of settlement of our judgments resulting from tax certiorari
proceedings;
WHEREAS, the Tax Certiorari Reserve is no longer needed for the purpose of defraying the
potential costs of refunds that may become due from the school district as a result of settlement
of or judgments resulting from tax certiorari proceedings;
WHEREAS, the Tax Certiorari Reserve was funded in the 2012-13 fiscal year in the amount of
ONE MILLION FIVE HUNDRED THOUSAND DOLLARS ($1,500,000);
WHEREAS, in compliance with General Municipal Law Section 6-r, public notice was given by
publication in Newsday on June 2, 2014, in The Massapequa Post on June 4, 2014 and in the
Massapequa Observer on June 4, 2014, that the Board of Education of the Massapequa Union
Free School is proposing to transfer the balance of the TCRF established on September 20, 2014
pursuant to section 3651 (1-a) of the New York State Education Law to the Retirement
Contribution Reserve Fund (“RCRF”) and thereafter abolish the TCRF and that a public hearing
on such proposed transfer and abolishment would be held on June 19, 2014 at approximately 8
p.m. prevailing time, in the Massapequa High School Auditorium, 4925 Merrick Road,
Massapequa, NY;
WHEREAS, in compliance with General Municipal Law Section 6-r, on June 19, 2014 at
approximately 8 p.m. prevailing time, in the Massapequa High School Auditorium. 4925 Merrick
Road, Massapequa, NY said public hearing was held;
NOW THEREFORE BE IT RESOLVED, that the balance contained in the Tax Certiorari
Reserve is hereby transferred to the RCRF, established pursuant to section 6-r of the General
Municipal Law; on May 22, 2008;
BE IT FURTHER RESOLVED, that the Tax Certiorari Reserve is hereby abolished; and
BE IT FURTHER RESOLVED that this Resolution shall take effect immediately

During the year the Board of Education is asked to approve adjustments to the district’s budgeted
appropriations. I have reviewed the district expenditures on a line-by-line basis for the fiscal
period July 1, 2013 to June 12, 2014. Based on my review, I recommend an appropriation
adjustment on 2 budget lines amounting to $210,000. Enclosed are the following documents for

5300.25 PROHIBITED STUDENT CONDUCT
The best discipline is self-imposed, and students must learn to assume and accept
responsibility for their own behavior, as well as the consequences of their misbehavior.
District staff who interact with students are expected to use disciplinary action when necessary
and to place emphasis on the students' ability to grow in self-discipline.
The Board recognizes the need to make its expectations for student conduct while on
school property or engaged in a school function specific and clear. The rules of conduct listed
below are intended for this purpose and focus on safety and respect for the rights and property
of others. Students who will not accept responsibility for their own behavior and who violate
these school rules will be required to accept the consequences for their conduct.
Students may be subject to disciplinary action, up to and including suspension from school,
when they:
A.
Engage in conduct that is disorderly.
but are not limited to:
Examples of disorderly conduct include
1. Running in hallways.
2. Making unreasonable noise.
3. Using language or gestures that are profane, lewd, vulgar, or abusive, or
offensive.
4. Obstructing vehicular or pedestrian traffic
5. Engaging in any willful act, which disrupts the normal operation of the school
community.
6. Trespassing. Students are not permitted on school property, other
than the school they regularly attend, without permission from the administrator in
charge of the building.
7. Computer/electronic communications misuse, including any unauthorized use
of computers, software, or internet/intranet account; accessing inappropriate
websites; or any other violation of the district’s Acceptable Use Policy.
B.
Engage in conduct that is insubordinate.
Examples

manner, with proper regard for the rights and welfare of other students, district staff and
other members of the school community, and for the care of school facilities and equipment.

punching, choking, and scratching) upon a teacher, administrator or other District

punching, choking, and scratching) upon another student or any other person
lawfully on school property, threatening to do so or attempting to do so.
3. Possessing a weapon. Authorized law enforcement officials are the only persons
permitted to have a weapon in their possession while on school property or at a
school function.
4. Displaying what appears to be a weapon.
5. Threatening to use any weapon or violence upon any person.
6. Intentionally damaging or destroying the personal property of a student, teacher,
administrator, other district employee or any person lawfully on school property,
including graffiti or arson.
7. Intentionally damaging or destroying school district property.
E.
Engage in any conduct that endangers the safety, morals, health or welfare of self
or others. Examples of such conduct include but are not limited to:
1. Lying to District staff.
2. Stealing the property of other students, District staff or any other person
lawfully on school property or attending a school function.
3. Possession of stolen property.
4. Defamation, which includes making false or unprivileged statements or
representations about an individual or identifiable group of individuals that harm
the reputation of the person or the identifiable group by demeaning them.
5. Discrimination, which includes discrimination against any student by a student or
students and/or an employee or employees on school property or at a school
function including, but not limited to discrimination based on a person’s actual or
perceived race, color, weight, national origin, ethnic group, religion, religious
practice, disability, sexual orientation, gender or sex.

6. Harassment, bullying, cyberbullying and/or discrimination against any student by
employees or students, or the creation of a hostile environment by conduct or by
threats, intimidation or abuse, that either: (1) has or would have the effect of
unreasonably and substantially interfering with a student’s educational performance,
opportunities, or benefits, or mental, emotional, and/or physical well-being, that
reasonably causes or would reasonably be expected to cause emotional harm; or (2)
reasonably causes or would reasonably be expected to cause physical injury to a
student or cause a student to fear for his or her physical safety. Such conduct shall
include acts of harassment and/or bullying harassment, bullying, cyberbullying
and/or discrimination that occur: (i) on school property (ii) at a school function; or
(iii) off school property; or (iv) online where such acts create or would foreseeably
create a risk of substantial disruption within the school environment, where it is
foreseeable that such conduct, threats, intimidation or abuse might reach school
property.
7. Sexual Harassment, which includes unwanted and unwelcome behavior of a sexual
nature that interferes with a student’s ability to learn, study, achieve, or participate
in school activities. It may result from words or behavior of a sexual nature that
offend, stigmatize, demean, frighten or threaten a person because of his or her sex.
Examples of sexual harassment include, but are not limited to: touching and
grabbing body parts, sending sexual notes, writing sexual graffiti, spreading sexual
rumors, sexting, being forced to do something sexual, and sexual assault.”
8. Bullying, which includes the intentional targeting by a student/students of an
individual (or group) using physical, verbal, written, and/or psychological
aggression with the intent to dominate the victim/s. This also includes, but is not
limited to cyber bullying/harassment which involves the use of information and
communication technologies including, but not limited to, e-mails, telephone and
text messaging, instant messaging, (IM), internet, defamatory online personal
polling web sites, and sexting to support deliberate, repeated, and hostile behavior
by a student/students, that is intended to harm others.”
9. Intimidation, which includes engaging in actions or statements that put an
individual in fear of bodily harm.
10. Hazing, which includes any intentional or reckless act directed against another for
the purpose of initiation into affiliating with or maintaining membership in any
school sponsored activity, organization, club or team. Hazing includes, but is not
limited to: being physical abused, being yelled, cursed or sworn at, depravation of
food, sleep or cleanliness, shaving yourself or others, destroying or vandalizing
property, being exposed to extreme cold or heat, and any use of alcohol and/or
drugs.
11. Selling, using or possessing obscene material.
12. Using vulgar, demeaning, or abusive language, cursing or swearing.
13. Smoking a cigarette, cigar, pipe, using chewing or smokeless tobacco or
smoking/tobacco substitutes.
14. Possessing, consuming, selling, distributing or exchanging
alcoholic beverages or illegal substances, or being under the influence of either.
"Illegal substances" include, but are not limited to, inhalants, marijuana, synthetic
cannabinoids, cocaine, LSD, PCP, amphetamines, heroin, steroids, look-alike

drugs, and any substances commonly referred to as "designer drugs."
15. Possessing drug paraphernalia
16. Inappropriately using or sharing prescription and over-the-counter drugs.
17. Illegal gambling activities.
18. Indecent exposure, that is, exposure to sight of the private parts of the body in a
lewd or indecent manner.
19. Initiating a report/warning of fire, bomb, or other catastrophe without valid
cause, misuse of 911, or tampering with or improper use of safety equipment
including, but not limited to fire extinguishers, security devices, and automated
external defibrillators.
20. Possessing a pocket knife with a blade measuring less than 2 1/2 inches and which
is not a "weapon" as defined as section 5300.05 of the Code of Conduct, or other
sharp bladed device.

Engage in misconduct while on a school bus or school-sponsored transportation.
It is crucial for students to behave appropriately while riding on district buses, to ensure
their safety and that of other passengers and to avoid distracting the bus driver.
Students are required to conduct themselves on the bus and at bus stops in a manner
consistent with established standards for classroom behavior. Conduct described in
paragraphs A. through E. of this section including, but not limited to excessive noise,
shoving, fighting or using profane language or gestures will not be tolerated. Students
must remain seated at all times while the bus is moving.

The Collective Negotiations Agreement states that the Board of Education will provide 25
inservice grants valued at $200 each. Traditionally, we have posted the inservice grant
availability at the beginning of the school year, on or about December 1st and repeat the
posting on or about April 1st, as well as June 1st.
Seven members in Unit I have submitted an application, and we are recommending all for
approval. These teachers are planning to enroll in Dellecave Educational Institute, Adelphi
University, New York Center for Teacher Development, and University of the Pacific. The
courses are Development of Positive Behavior; Implementing Computers for Instruction;
Cognitive Behavioral Therapy; TPR Storytelling Workshops; Social Concerns for Educators;
ADHD Student: Know the Facts; Can Resiliency be Taught; The ADD/ADHD ChildStrategies to Help the Educator.
These proposed courses are known to this writer as acceptable courses. Accordingly, may I
request that the Board of Education provide this office with the authority to advise the
applicants that they will receive approval at the June 19, 2014, Regular Public Meeting.
May we also request that the attached resolution be adopted on June 19, 2014.
