During the first week of August we have meetings with two Legislators. We will be meeting with U.S. Congressman Bill Foster as well as Illinois Legislator Margo McDermed. The second week of August has our General Membership Meeting at Joliet Country Club on Tuesday August 9. We will be honoring our REALTOR® of the Year, Affiliate of the Year, our Rising Star, and the REALTOR® Lifetime Achievement award winner. It will be an honor to make these presentations. We will also be pulling the names of the winners of our RPAC raffle that is currently going on. You can win Sox or Cubs Tickets, NASCAR Tickets, or Book of Mormon tickets plus a gift card. Invest in RPAC for just $25 per ticket or 5 for $100. This is a great and fun way to make your RPAC investment for 2016. Call Pat at the Office to purchase your tickets. I hope you can join us. On Wednesday August 10, the YPN Committee is having their Annual Cookout at the Association Office. This is always a fun relaxing event. I hope you can make it. I was glad to hear last week that House Bill HR3700 finally passed the U.S. Senate. This bill helped with FHA condo rules in regards to financing and other issues. We had a Call For Action on this bill and it really helped. NAR President Tom Salomone said our huge response to the Call For Action had a lot to do with this bill even being called in the Senate. It is a good win for us. It is really important when you get a Call For Action that you respond to it. This can be in the form of an email or a text or both. If you text the word REALTORS® to 30644 you can get your Calls For Action via text message. All you have to do then is click twice and you are done. This is critical to your business. It is under attack from many sides. In July, we had the opportunity to see the results of our GAD Gideon Blustein’s efforts in regards to NAR Grants. We were able to help the Coal City Farmers Market get off the ground. I was able to attend the first Market with other members. It was great to see. We have also helped the Will County Center for Economic Development, the City of Joliet with their Housing Expo, the city of Diamond with sitting areas on their new walking trail, and much more. REALTORS® do make a difference in people’s lives and Private Property Rights. If you are not involved actively at Three Rivers, I encourage you to do so. The Committee sign up is now going on. It is a great way to start. Show people you care. By the end of this month, most students will return to their classes, ready for new beginnings. As we all know, this is the last true month of push to get people into new properties so that their children can get signed up for school. Keep pushing and working hard! As I review the real estate landscape, I cannot help but relate some of the stories and attorney review matters that I have seen to shed light on what is going on in our real estate world. First, I had a buyer who made his offer on a property based on a review of the home. The home was professionally staged. At the final walk-through the day of the closing, all of the furniture and decorations in the home had been removed. Once all of the decorations and furniture were removed, major cracks in the drywall became readily visible and issues with the foundation and walls became apparent (once the couch was moved). Though the seller acknowledged and credited my client at closing ($1500 for the cracks alone), a word to the wise------it IS ok to ask to move furniture prior to making an offer. It is ok to seek permission to see behind the decorations to determine the condition of the property. In this case, based on the size and willingness to pay the credit at closing, the seller clearly knew of the condition of the property and felt compelled to address the repair items at closing. Second, as a referral source to many attorneys, it is absolutely appropriate (in my opinion) for you to ask the attorney with whom you are dealing if he/she, in the attorney modification letter, understands that the letter may be deemed a counter-offer and, therefore, subject the entire deal to the decision and review of the person receiving the modification letter? For example, I have seen a growing number of letters from attorneys demanding that certain provisions of the contract be deleted or stricken--especially paragraphs 8 and 11 of the Multi-Board contract. When I have received such requests, I have typically called the other attorney to ask about the requested deletion. To a person, the attorney has admitted that he/she feels that the provisions negate the role of the attorney in trying to address revisions to the contract. One local attorney even suggested (without knowing that attorneys and REALTORS ® were involved in the creation of the Multi-Board contract) that the drafters of the form clearly did not complete as many closings as she does each year and, therefore, their suggested, standard language should be disregarded. Let me assure you, the attorneys involved in drafting the Multi-Board contract had over 150 years of experience (for 5 attorneys) and the REALTORS ® were similarly situated. In short, if your referral attorney does not understand the terms or conditions of the standard form contract, have him/her call someone from the committee so that the provisions can be explained. Third, I am inundated with requests from attorneys to amend the prorations portion of the contract concerning real estate property taxes. Once again, please feel free to educate the attorney to whom you are referring cases. The only proration that the seller has to provide to the buyer is a credit toward the real estate property tax bill the SELLER would have had if the Seller was still owned the property. Therefore, if the Seller would be entitled to a homestead and senior exemption as well as a senior freeze, that is the basis for the credit owed by Seller to Buyer. Thus, when the attorney demands in the attorney modification letter that taxes be prorated as if only a homestead exemption applies, that attorney is needlessly putting the entire transaction at risk----the Seller could decline and declare the contract null and void. Fourth, make sure you check your commission AT THE TABLE. Additionally, be leery of out of area brokerage houses who may have written in their listing agreement (albeit in rather fine print) that the entire commission will be paid to the listing agent with a check to the selling agent presented “at a later date---once the file is cleared in house”. I have experienced too many deals where this provision, clearly market in the MLS, caused tension at the closing when no commission check was cut at the closing. Finally----as we wind down the summer and look to football season (and the end of a potentially successful baseball season for at least one Chicago team), keep working hard. Keep each deal fun and enjoyable. Keep reminding yourself that every contact with the client is yet another opportunity to not only earn the current clients trust, respect, and admiration but also, potentially, referrals from this one, special, singular client. As you’ll recall, the U.S. House passed this legislation - which makes homeownership more attainable - unanimously but it had stalled in the Senate. Nearly 140,000 REALTORS® contacted their US Senators, breaking the log-jam. To learn more about this legislation, please visit: www.realtor.org/articles/hr-3700heading-to-president. Illinois Update: On June 30th fiscal year 2017 was able to begin with a fully funded education budget for K-12 and a “stopgap” budget in place until the end of the calendar year for FY 2016 and part of the FY 2017 state operating costs. Included in the stopgap budget is funding for road and school construction projects, higher education, the Monetary Award Program grants and human services. The budget was adopted overwhelmingly in the House and unanimously in the Senate and signed into law by the Governor. This action provides a temporary solution and more work is needed to enact a comprehensive budget. This, along with a discussion of the backlog of bills and possible new revenue sources, will be the key focus in the fall session which convenes after the November election. Local Update: TRAR helped facilitate an area landlord conference for the City of Joliet and REALTOR® Sue Miller gave an encouraging keynote message July 11 and 12. About 400 Joliet-area landlords attended the event, which TRAR helped fund through a National Association of REALTORS® (NAR) Diversity Initiative Grant. Miller provided a local market update and helped attendees understand local, state and federal fair housing laws and HUD’s new guidance on landlord use of criminal background checks. Meanwhile in the Village of Elwood, builders are beginning to run into problems with a far-reaching commercial and residential sprinkler system mandate adopted by the City in early 2015. The mandate applies to all new residential construction and even applies to certain renovations. TRAR is opening a dialogue with the City to see if there is a willingness to negotiate easing the ordinance. Finally, the Village of Diamond is cracking down on the illegal use of sanitary sewers by residents for stormwater discharge. Earlier in the year, the Village’s sanitary system was overwhelmed by an influx of storm-water which has led to the Village passing increased penalties. Concerned that the Village may try to enact a point of sale storm-water discharge inspection, TRAR reached out and received confirmation that no point of sale inspections would be pursued. LEGAL COMMITTEE: This committee responsibilities include reviewing new contract, riders, listing agreements, and other legal agreements. Works in conjunction with the Will & Grundy Bar Associations. Meets 7-10 times a year or as needed. The Chair is expected to attend the January IAR Public Policy Meetings. SPECIAL EVENTS COMMITTEE: This committee is composed of REALTORS® and Affiliate members to plan and promote participation in Association activities, which includes the Holiday Party. Meets as needed. YOUNG PROFESSIONALS COMMITTEE: The Young Professionals Committee of the Three Rivers Association of REALTORS®, our main objective is to get more of our Gen X, Gen Y members involved in Association committees and activities. Affiliate Committee I would like to start off with I have been in the mortgage industry since 1995. I have done almost anything and everything in the lending industry from Originating loans, to Processing, to Underwriting, to Packaging and Selling loans to our end investor to managing a group of 10 loan originators. I cut my teeth on FHA and Sub-Prime. Talk about some creative loans… If you were breathing, you qualified. A little different now. I have been a member of Three Rivers Association of Realtors for 4 years. I have been an active participant of the Events Committee, the YPN Committee and the Affiliate Committee and currently reside as the Chairperson of the Affiliate Committee. I have enjoyed sponsoring many of the events that the Association and the YPN Committee host. I have also volunteered many hours for many different wonderful events that the Association has been involved in. Outside of the Realtor Association I have been a member of the Naperville Chamber, the Romeoville Chamber and the Plainfield Area Chamber of Commerce. I am currently an Ambassador with the Plainfield Chamber and also a member of the board of directors. I have held many positions on the board of directors such as secretary, treasurer and the Chairman of the Board. I am in my 8th or 9th year on the board of directors, I guess you could say I’m a lifer. I also belong to a motorcycle rights organization – ABATE. I used to be the Safety and Education director. I am happily married to Laurie. The love of my life! I have 2 kids (Tiffany 27 and Tyler (He would have been 24 this year, he is now an angel in heaven) and 2 step daughters (Sarah 31 and Jennifer 28). I have lived in Plainfield since 1991. It is such an honor to be presented with TRAR Affiliate of the Year award. I enjoy working with such a great Realtor Association.
