LCBR bylaws, Article X, Section 3, sets
November 1st as the dues payment date.
2017 Realtor dues are due November 1st,
2016. There is a $100 late fee for dues paid
after November 30, 2016. Members who are
delinquent after December 29, 2016 will be
dropped, without exception and will have to
pay all dues, fines and application fees to be
reinstated.
In 2015 the Florida Realtors BOD increased
the advocacy fund annual member
assessment from $10 to $30 effective in 2017.
Affiliate invoices will be mailed in November
and due by December 29.

This past week, I spoke to the 2016 Graduating Class
of Florida REALTORS Leadership Academy. They are
an amazing group of REALTORS, all looking to
develop their leadership potential.
They had many questions about leadership but the one
that struck a chord with me was a question
on professionalism. They were very concerned about
the professionalism of the REALTORS in our state. As
a REALTOR that sells real estate every day, that is one
of my biggest concerns. Is professionalism being
courteous and respectful to customers and other
REALTORS or, and I believe this is the crux of the
problem, is it knowledge of the license laws, the
industry and conducting a transaction?
Part of the problem that exists today is when a Broker
hires on a new agent, they take no time to educate
them on office policy, contracts, liability etc. I truly
believe that a REALTOR that is not trained in all of the
above is a walking lawsuit, a truly credible liability for
their Broker and for other REALTORS that they interact
with.
So my fellow REALTORS, if you are a Broker with
agents, please make sure they are trained…if not, you
could lose your license along with your agent. When I
deal with an educated REALTOR, the entire
transaction is a pleasure for me and my customer. But
when I deal with someone that knows little to nothing, it
is truly a nightmare.

Can you solicit another broker's sales associates?
Realtor Tom was disappointed when his top producing sales agent announced she was moving her license to a
competing brokerage. The sales associate explained it was a difficult career choice to make after 10 years with Tom,
but she received a solicitation letter from the competitor and the business incentives and the possibility of joining
management swayed her.
Tom was frustrated and wondered whether it was illegal or unethical for the other broker to recruit his staff.
The simple answer? No.
According to National Association of Realtors (NAR), while the Code of Ethics prior to 1982 did require brokers to
provide advance notice before recruiting associates from another broker, the act itself was not considered unethical.
In fact, the obligation to notify was so misunderstood, said the NAR, that “After years of trying to explain, clarify and
focus on what conduct was permissible and what was not, the NAR Delegate Body concluded that the appropriate
course was to abolish then Article 24.”
The only rule directly affecting recruiting is 61J2-17.015 of the Florida Administrative Code, which deals with
recruitment during real estate classes. It prohibits school operators and instructors from soliciting during classes and
requires the school permit holder to post notice and inform students at the beginning of each course that recruiting
must take place outside instructional time.

Noncompete agreements
If you are an associate and you have a noncompete clause or other limitation in your independent contractor agreement, it could
affect your ability to move to a competing firm.
Because noncompete agreements are extremely complicated, brokers should have the language vetted by an attorney before using
one and associates should consult an attorney before signing one.
