The primary focus of the workshop was for PHMSA's Office of Pipeline Safety (OPS) to obtain input on how to implement Section 24 of the 2011 Pipeline Safety Act, which represents the agency's authorizing legislation for the next five years. Section 24 specifies that by January 2013, PHMSA's OPS must not incorporate any standards by reference in the federal pipeline safety regulations unless those standards are available to the public free of charge. For purposes of Section 24, the applicable sections of the CFR are Title 49, Parts 191, 192 and 195. PHMSA staff clarified that the provisions of Section 24 are meant to be prospective and not retrospective, which means that existing referenced standards would not be impacted, but only those contained in future rulemakings. One of the main standards that would impact the propane industry as it pertains to IBR is NFPA 58, which is incorporated by reference in Part 192 of the federal regulations and is used as the governing document should a conflict exist between NFPA 58 and Part 192 on similar requirements that exist in both documents. Additionally, we know that PHMSA is in the midst of developing a proposed rule that would seek to eliminate any conflicting primacy issues between NFPA 58 and Part 192. The potential exists that if PHMSA were to finalize a rule on this subject resulting in elimination of all reference to NFPA 58, NPGA does not expect that to happen no matter when a final rule is published. This is because NFPA representatives stated at the workshop that the organization makes all of its standards available for reading on the internet. However, this availability does not permit downloading, printing, searching or any other functions that might be more useful to the user. GPGA MARKETER Nevertheless, while it was noted that by other commenters that prohibiting the other more user-friendly functions when viewing a standard on NFPA's website does not go far enough, PHMSA confirmed that NFPA's approach does satisfy the intent of Section 24 of the authorizing statutes. Consequently, we would not expect that PHMSA would withdraw reference to an NFPA standard since they already deem it to be available to the public free of charge. NPGF Scholarship Fund Moves Application Schedule Forward The Scholarship Foundation is pleased to announce that effective with the 2013 - 2014 academic year, the period for scholarship application submissions will be September 1, 2012 through March 1, 2013. This moves the schedule forward; winners will now be notified almost two months earlier than in past years. Applications must be completed and all required information and documents must be received by March 1, 2013. Successful applicants will be notified by early May 2013. Updated brochures are being worked on and the new versions will be forwarded shortly. John Sullivan (R-OK-1) a six term member of Congress from Oklahoma was defeated Tuesday in a primary by military reserve pilot Jim Bridenstine. The victory was by a substantial 54-46% margin. Sullivan, who was the lead sponsor of H.R. 1380 (the socalled NATGAS Act) is the fourth non-paired incumbent to fail in a re-nomination bid during this election cycle. Reps. Jean Schmidt (R-OH-2), Tim Holden (D-PA-17), and Silvestre Reyes (D-TX-16) are the other three. NPGA 2012-2013 Officers Elected Ray Murray, Chairman: Ray has been in the propane business since 1976 when he joined his parents and brother at Ray Murray, Inc., the family’s propane equipment distribution business located in Berkshire Hills in western Massachusetts. He now co-chairs Ray Murray, Inc., with his brother Jim. Ray is highly involved within NPGA and has served on the Executive Committee, as Conventions Committee Chairman, and as Distributors Section Chairman. He has served on the executive board of the New York Propane Education & Research Council and as Treasurer and Secretary of the New York Propane Gas Association. Gary France, Chairman-elect: Gary has been in the propane industry since he was a child. He began his career when he was thirteen, sandblasting and painting tanks. In 1990 he formed France Propane Service, Inc. Gary has been active in the Wisconsin Propane Gas Association serving as President and as chair of the Education and Legislative Committees. He is also an active member in NPGA, serving as Member Services Committee Chairman and as PAC Chairman. David Lugar, Vice-Chairman: David is the Vice President of Supply and Logistics for AmeriGas Propane. He joined AmeriGas in September 2000 and has an office outside of Houston, Texas. David has been active in the National Propane Gas Association for many years, including service on the NPGA Board of Directors. He was a charter member of the Propane Education and Research Council (PERC) which was formed in 1996 and served in various officer positions during his time on the Council, including two terms as the PERC Chairman in 2003-2005. We are definitely in need of a much colder winter than we experienced last winter. I would like to thank you for allowing me to serve as President of the Association for 2012-2013. I am excited and optimistic about this coming year in the propane industry. I would also at this time like to thank Keith Strickland for his great year of leadership and service as president in 2011-2012. Thanks to everyone who attended the Southern Connection Convention at Hilton Head in July. We had several very informative speakers from the State Fire Marshal’s Office, PERC, NPGA, Bluebird Body Company (Manufacturer of buses), Roush, Co, and Alliance Gas. • Chris Stephens with the State Fire Marshal’s Office announced that the Fire Marshal’s office would begin offering classes in February 2013 for those who would need the continuing education requirements (6 hrs. every 3 years) for the Workers Certification Program. Details will follow from Chris soon. • Our strategic planning meeting will be held September 11, 2012 at the Rock Eagle 4-H. I would appreciate the attendance of all officers and directors so we can set our goals for 2012-13. You should have already received a registration form from Jenni. Krause This case arose from a propane explosion and house fire that spread to an adjoining house. The adjoining homeowner sued the person in whose home the fire originated, alleging that he was negligent in lighting a propane furnace without direction from his propane supplier. Explosion and Fire On the evening of October 11, 2007, Darrick Van Dyke had been waiting for a service person from his propane supplier to inspect and light the pilot light in the propane furnace in his house. Previously, a service technician from his propane supplier serviced his furnace and lit his pilot light. That evening, however, Mr. Van Dyke grew impatient with his cold house and lit his furnace. His furnace began operating normally and Mr. Van Dyke smelled no odor and noticed nothing unusual until 5:30 a.m. the next morning when a propane explosion destroyed his house and seriously injured him. A fire ignited by the propane explosion spread and damaged his neighbor’s home. Jerry VanDeOever drove Mr. Van Dyke to the hospital shortly after the explosion. When Mr. VanDeOever told Mr. Van Dyke’s father about the explosion, his father replied, “I told Darrick not to light that thing until he talked to Schultz (his propane supplier’s service technician).” The fire chief of the local volunteer fire GPGA MARKETER department also reported warning Mr. Van Dyke to not light his own pilot light, but to wait for the service technician from his propane supplier. Mr. Van Dyke Settles, Gets Sued In June 2008, Mr. Van Dyke sued his propane supplier and claimed damages for his personal injuries and property damage. When he settled those claims, his neighbor, Marguerite Cashman, then sued him for damage to her house, alleging that he was negligent in relighting his furnace without assistance from his propane supplier. Ms. Cashman argued “a jury could infer that Mr. Van Dyke knew he should not have lit the pilot light himself” from his post-fire statement, “I should have waited for Schultz to come and take a look at it.” She argued that Mr. Van Dyke was negligent and liable for the damage to her house under several theories. First, she claimed that he negligently lit his furnace without receiving assistance or notice from his propane supplier. Second, she claimed that he was strictly liable for damage to her house because he participated in an inherently dangerous activity – lighting a propane water heater. Third, she claimed that the explosion that damaged her house speaks for itself: Mr. Van Dyke had to be negligent because “houses do not normally explode.” Summary Judgment After a hearing, the trial court granted summary judgment in favor of Mr. Van Dyke, dismissed Ms. Cashman’s claims, and rejected her theories of liability. The court ruled that Mr. Van Dyke’s statements were not proof that he “did something that a reasonable person would not do,” that lighting a home furnace was not an abnormally dangerous activity, and that Mr. Van Dyke was not automatically liable to Ms. Cashman because an explosion occurred in his house. Appeal Ms. Cashman appealed, arguing that a jury could infer that Mr. Van Dyke acted negligently from the fact that an explosion at Mr. Van Dyke’s house started the fire that caused her damages. She argued that Mr. Van Dyke negligently lit his furnace, that lighting a propane furnace is inherently dangerous, and that Mr. Van Dyke must have been negligent because “houses do not explode on their own.” Therefore, according to Ms. Cashman, the only issue for the jury was how much Mr. Van Dyke should pay her for the damages to her house. Court Rejects Neighbor’s Claims The South Dakota Supreme Court upheld the trial court’s grant of summary judgment for Mr. Van Dyke. The South Dakota Supreme Court found that Ms. Cashman did not produce sufficient evidence of negligence because she based her inferences of the alleged facts surrounding Mr. Van Dyke’s lighting of his furnace solely on speculation. The South Dakota Supreme Court also held that lighting a pilot light is not abnormally dangerous because it can be made entirely safe by taking reasonable precautions. Last, the South Dakota Supreme Court stated that a jury may sometimes infer that a defendant caused an injury when the defendant controlled the thing that caused the injury, and the injury would not have occurred but for the defendant’s negligence, but that the explosion that injured Ms. Cashman had many possible causes: “the mere occurrence of an explosion is insufficient to support an inference that Mr. Van Dyke was negligent. While we can agree that houses do not normally explode, we find no support for Ms. Cashman’s argument that houses explode only if the owner or person in control of the home is negligent.” The South Dakota Supreme Court thus affirmed the trial court’s dismissal of Ms. Cashman’s case against her neighbor.
