BE IT REMEMBERED, at a regular meeting of the Commissioners Court of Dallas County, Texas, held
on March 1,2011, on motion made by John Wiley Price, Commissioner of District 113
,and
seconded by Dr. Elba Garcia, Commissioner of District 114 ,the following Order was adopted:
WHEREAS, a claim was presented by Dallas County against Leigh Buck in the amount of Twelve
Thousand Seventy-Five and NoI100 Dollars ($12,075.00) is the after salvage actual cash value ofa Dallas County
vehicle, 2009 Ford Crown Victoria involved in a motor vehicle accident that occurred on Sunday, October 17,
2010 and said claim was discussed by the Commissioners Court in closed session on February 22, 2011 as
permitted by Texas Government Code §551.071(l)(b); and
WHEREAS, the office involved in this claim is the Dallas County Sheriffs Department; and
WHEREAS, this claim has been investigated by the Civil Division ofthe Dallas County Criminal District
Atrorney's Office, and Fifteen Thousand Nine Hundred Ninety-Two and 83/100 Dollars ($15,992.83) was the
estimated cost for property damage, but only Twelve Thousand Seventy-Five and NollOO Dollars ($12,075.00) is
the 2009 Ford Crown Victoria's after salvage actual cash value and were found to be a valid and reasonable amount;
and
WHEREAS, the action authorized by this Order is consistent with and promotes Strategy 1.3 of Dallas
County's Strategic Plan.
IT IS THEREFORE, ORDERED, ADJUDGED and DECREED that the payment of Twelve Thousand
Seventy-Five and 00/100 Dollars ($12,075.00) is hereby accepted from Leigh Buck as settlement of propel1y
damage sustained by the Dallas County in connection with this claim and the County Judge is hereby authorized to
execute any and all documents approved by the District Attorney's Civil Division to effectuate this settlement.

BE IT REMEMBERED, at a regular meeting of the Commissioners Court of Dallas County, Texas, held
on March 1,2011, on motion made by John Wiley Price, Commissioner of District 113 ,and
seconded by Dr. Elba Garcia, Commissioner of District 114, the following Order was adopted:
WHEREAS, a claim was presented by Bobby Collard against Dallas County in the amount of One
Thousand Five Hundred Fifty-One and 36/100 Dollars ($1,551.36) for property damage and car rental
reimbursement, as a result of an accident that occurred on Tuesday, February 8, 2011 and said claim was discussed
by the Commissioners Court in closed session on February 22, 2011 as permitted by Texas Government Code
§551.071(1)(b); and
WHEREAS, the office involved in this claim is the Dallas County Constables Department, Precinct 3; and
WHEREAS, this claim has been investigated by the Civil Division of the Dallas County Criminal District
Attorney's Office, and One Thousand Four Hundred Thirty-One and 36/100 Dollars ($1,431.36) for property
damage payment and One Hundred Twenty NoI100 Dollars ($120.00) for car rental reimbursement were found to
be a valid and reasonable amount; and
WHEREAS, a release from aJI further liability of the County of Dallas concerning all existing and possible
claims will be obtained; and
WHEREAS, the action authorized by this Order is consistent with and promotes Strategy 1J of Dallas
County's Strategic Plan.
IT IS THEREFORE, ORDERED, ADJUDGED and DECREED that Bobby Collard be paid One
Thousand Five Hundred Fifty-One and 36/100 Dollars ($1,551.36) for property damage and car rental
reimbursement as full and final settlement by the County of Dallas, Texas, and that the County Treasurer is
authorized to release said check to an employee of the Civil Division of the Dallas County Criminal District
Attorney's Office.

WHEREAS, the Office of Budget and Evaluation briefed Commissioners Court regarding the submission of
the DIVERT Court Program's grant application on behalf of the Texas Association of Drug
Court Professionals 2011 Annual Training Conference; and
WHEREAS, the purpose of the grant application is to provide conference training funding for Drug Court
attendees from throughout the state of Texas's 107 drug courts; and
WHEREAS, the total grant requests is for $172,000 with no cash match; and
WHEREAS, Dallas County designates the County Judge, as the grantee's authorized official. The authorized
official is given the power to apply for, accept, reject, alter or terminate the grant on behalf of the
applicant agency; and
WHEREAS, this request is aligned with the County's Strategic Plan and specifically impacts Vision 3; Dallas
County is a safe, secure, and prepared.
IT IS THEREFORE ORDERED, ADJUDGED AND DECREED, that the Dallas County Commissioners
Court approves submission of the grant application for the DIVERT Court Program on behalf of the Texas
Association of Drug Court Professionals 2011 Annual Training Conference. The authorized official is given the

WHEREAS, the City of Dallas provides staff and resources to prosecute Internet Crimes Against
Children within its jurisdiction so as to assist the Internet Crimes Against Children Project;
and
WHEREAS, pursuant to the authority of the Interlocal Cooperation Act, Chapter 791, Texas
Government Code and approval of the Dallas County Commissioners Court this agreement
is made with the City of Dallas; and
WHEREAS, the term of this Interlocal Agreement is from April 1, 2010 through March 31, 2011; and
WHEREAS, funding for the services to be provided are included in the Internet Crimes Against Children
Project grant's budget and shall not exceed the maximum amount of $14,000; and
WHEREAS, this request is aligned with the County's Strategic Plan and specifically impacts Vision 3;
Dallas County is a safe, secure, and prepared. These funds will be used to coordinate and
undertake programs and services to improve Dallas County's quality oflife.
IT IS THEREFORE ORDERED, ADJUDGED, AND DECREED that the Dallas County
Commissioners Court hereby approves the attached Interlocal Agreement and authorizes the County Judge
to sign the agreement on behalf of the County.

This INTERLOCAL AGREEMENT is made and entered into by and between the City of Dallas,
hereinafter called "City" and the Dallas County District Attorney's Office, Texas, hereinafter
called "Dallas County District Attorney's Office."
WITNESSETH:
WHEREAS, the Interlocal Cooperation Act, Chapter 791, Texas Government Code, provides
authorization for any local government to contract with one or more local governments and with
agencies of the State of Texas to perform governmental functions and services under the terms of
this act; and
WHEREAS, the Internet Crimes Against Children Task Force is a grant program funded under
an award by the United States Department of Justice, hereinafter called "DOJ" through their
Office of Juvenile Justice and Delinquency Prevention, hereinafter called "OJJDP" under the
Federal Missing and Exploited Children's Program; and
WHEREAS, City and the Dallas County District Attorney's Office desire to enter into an
agreement regarding the Dallas Internet Crimes Against Children Task Force; and
WHEREAS, the City of Dallas, for its Police Department, has applied for and received from
DOJ a grant to target child solicitation and child pornography over the Internet in the State of
Texas, the grant period runs from April I, 2010 through March 31, 20 II; and
WHEREAS, the grant is entitled Internet Crimes Against Children (Grant Number 2010-MCCX-K037), hereinafter called "Project", and
WHEREAS, the Dallas Police Department has asked the Dallas County District Attorney's
Office to participate in fulfilling the purpose of the grant.
NOW THEREFORE, THIS INTERLOCAL AGREEMENT is hereby made and entered into by
City and the Dallas County District Attorney's Office for the mutual consideration stated herein:
I.
For the consideration hereinafter agreed to the Dallas County District Attorney's Office
undertakes, covenants and agrees to:
1. Provide staff and resources to prosecute Internet crimes against children within its
jurisdiction so as to assist the Internet Crimes Against Children Grant Project in
achieving its goals.
2. Accept criminal case referrals for prosecution as appropriate that may be forwarded
from the Dallas Police Department.
3. On a quarterly basis provide the Dallas Police Department with an activity report
describing cases prosecuted by personnel funded by this Grant.
4. Maintain documentation of all partial salary and overtime expenditures which are to
be reimbursed by the Internet Crimes Against Children Grant. This documentation
will include the name and title of the person earning the salary or overtime, the
date(s) worked, the number of hours worked, the exact payment amount to be charged
to the Grant, the employee's hourly and overtime pay rate as appropriate, and a brief
explanation of the activity undertaken to earn the salary or overtime. This expenditure
report must carry an original signature of a Dallas County District Attorney's Office
official and be supported by departmental payroll records which correspond to the
salary or overtime payments. This salary and overtime expenditure report and support
documentation will be submitted to the Dallas Police Department at the time
reimbursement is requested.
5. Maintain documentation of all travel and training expenditures which are to be
reimbursed by the Internet Crimes Against Children Grant. This documentation will
include the name and title of the person travelling or receiving training, the dates and
location of travel or training, the exact payment amount to be charged to the Grant,
and a brief explanation of the purpose of the travel or training. This expenditure
report must carry the signature of a Dallas County District Attorney's Office official
and be supported by receipts, invoices, or other appropriate documentation. This
travel and training expenditure report and support documentation will be submitted to
the Dallas Police Department at the time reimbursement is requested.
6. Maintain an up-to-date and itemized inventory list of all supplies, equipment, or
services purchased by the Dallas County District Attorney's Office with funds from
the Internet Crimes Against Children Grant. Inventory list entries of major hardware
items such as computers, monitors, printers, FAX machines, and the like must also
include the brand name and model, serial number, the Dallas County District
Attorney's Office's property inventory tag number assigned to the specific item, and
the current physical location of the property. This inventory list must be supported by
receipts, invoices, or other appropriate documentation. The inventory list will be
submitted to the Dallas Police Department when requested.

7. Allow the Internet Crimes Against Children Grant Manager or his designate to make
one or more on-site visits for the purpose of assessing the compliance of the Dallas
County District Attorney's Office with the provisions of this Interlocal Agreement
and the provisions of Circular A-l33 issued by the United States Office of
Management and Budget regarding audits of states, local governments, and non-profit
organizations.
8. When requested, provide the Dallas Police Department with a copy of Dallas
County's most recent Single Audit Report and, if appropriate, a written statement
describing any necessary corrective action identified in that Audit Report.
II.
As consideration for the services contracted for herein, the City agrees to reimburse the Dallas
County District Attorney's Office a sum not to exceed fourteen thousand dollars ($14,000.00).
This sum is to reimburse the Dallas County District Attorney's Office for expenses incurred for
partial salary of a grant-sponsored position, overtime, training, travel, andlor equipment as
deemed necessary and appropriate by the Dallas County District Attorney's Office for its
operations to combat Internet-related crimes against children. The Dallas County District
Attorney's Office may invoice the City for reimbursement of expenses under the terms of this
agreement up to six times, but no reimbursement request will be accepted after April 30, 20 II.
Reimbursement for allowable expenses incUlTed shall be made by the Dallas Police Department
to the Dallas County District Attorney's Office as quickly as possible after receipt of invoices
detailing the expenses to be reimbursed. Reimbursement requests, with all supporting
documentation, shall be mailed to:

III.
During the performance of this Interlocal Agreement, the Dallas County District Attorney's
Office agrees to the following:
1.
It will, to the extent permitted by law, accept liability, under the Worker's
Compensation Act, in the event personal injuries occur to its employee( s) while
engaged in Project activities.
2.
It shall, to the extent permitted by law and during the entire time of participation,
maintain sufficient insurance to cover its obligation and liability for its
employee(s). This will include, but is not limited to, coverage of the employee
and vehicle, while operating a vehicle, where applicable.

3.
It may, in lieu of purchasing liability insurance, elect to be self-insured but will be
responsible for all risks ofloss and actual loss as specified herein.
4.
Any and all equipment and supplies purchased with Grant funds by the Dallas
County District Attorney's Office will remain property of the Dallas County
District Attorney's Office.
IV.
The term of this Agreement shall be from April I, 2010 through March 31, 2011. TI1is
Agreement may be extended by mutual agreement of the parties hereto, or terminated by either
party upon thirty (30) days prior written notice thereof to the other of its intention to terminate
upon the date specified in such notice.
V.
Any notice, payment, statement, or demand required or permitted to be given hereunder by either
party to the other may be affected by personal delivery in writing or by mail, postage prepaid.
Mailed notices shall be addressed to the parties at the addresses appearing below, but each party
may change its address by written notice in accordance with this section. Mailed notices shall be
deemed communicated as of three days after mailing.

VI.
This Agreement may be amended by the mutual agreement of the parties hereto in 'I",riting to be
attached to and incorporated into this Agreement.

VII.
In case anyone or more of the provisions contained in this Agreement shall be held to be invalid,
illegal, or unenforceable in any respect, such invalidity, illegality or unenforceability shall not
affect any other provision thereof and this Agreement shall be construed as if such invalid,
illegal, or unenforceable provision had never been contained herein.
VIII.
This Agreement supersedes any and all other agreements, either oral or in writing, between the
parties hereto with respect to the subject matter hereof, and no other agreement, statement, or
promise relating to the subject matter of this agreement, which is not contained herein, shall be
valid or binding.

an injury to her right hand; and

The employee was hired on September20, 2010 and is not eligible for Fam ily and Medical Leave; the
requested leave of absence period is approximately three weeks (January 30, 20 II-February 18, 2011);
a medical leave of absence (without pay) is required since the employee (1) has less tl,an six months of
service, (2) does not qualify for family and medical leave, and (3) has no accrued leave balances; and
WHEREAS,
Section 82-472 (EmployeeEligibility)ofthe Dallas County Code states: "An employee's eligibility to
request a leave of absence is based on the following criteria(l) full-time regular, non-grant funded
employeesare eligibleto request a leave of absence up to 90 days .... (2) Elected officials/department
heads with employees in their first six months of regular, full-time employment, may request an
exception from Commissioners Court.,;" and
WHEREAS,
Section 82-473 (Reasons for Granting) of the Dallas County Code states: "An employee may be
granted a leave of absence for the following reason: (1) for the recovery from an illness or disability
not believed to be of a permanent or disqualifying nature;"and
WHEREAS,
The request supports Vision I, Strategy 1.5: Dallas County should maintain a strong, motivated
workforce; it is necessary that a capable workforce be maintained which may require flexibility in
application of policy guidelines.
IT IS THEREFORE ORDERED, ADJUDGED, AND DECREED that the Dallas County Commissioners Court hereby
approve the SheriffDepartment 's requestfor an exception to the Leave a/Absence Policy without payfor the employee

application that allows an employer, using information reported on an employee's Form 1-9
(Employment Eligibility Verification) to determine the eligibility of that employee to work in the
United States; the Citizenship and Immigration Services (USCIS) Agency in the Department of
Homeland Security (DHS) operates E-Verify in partnership with the Social Security Administration
(SSA); and
WHEREAS,
The County Judge will enroll Dallas County by accessing the E-Verify website to complete an
enrollment process and electronically signing a Memorandum of Understanding (MOU) that lays out
the responsibilities of both the employer and the government entities that support the program; and
WHEREAS,
Using E-Verify will assist the Human Resources/Civil Service Department in determining if
documents presented during new employee orientation are valid; and
WHEREAS,
This recommendation supports Strategic Plan Vision 1: Dallas County models interagency
partnership and collaboration-Strategy 15: Maintain a Strong, Motivated Dallas County Workforce.

Energy CARE Program, for the purpose for providing funding for energy assistance
payments to Reliant Energy customers; and
WHEREAS, the 2011 Reliant Energy CARE program is in compliance with Vision 2: Dallas County is a
Health Community; Strategy 2.1, Provide exceptional disease prevention, health promotion
and Human Service programs to the citizens of Dallas County, as contained in the Dallas
County Strategic Plan, and requires the approval of the Commissioners Court.

Letter Agreement for Reliant Energy Retail Services, LLC CARE Program
("CARE")
Dear Mr. Thompson:
Reliant Energy Retail Services, LLC (Reliant Energy is a certified Retail Electric Provider serving
residential customers in Dallas County is required to establish and maintain an energy assistance program in
accordance with the rules and regulation of the Public Utility Commission of Texas. Dallas County
Department of Health & Human Services (DCDOHHS) is an established nonprofit organization that has a
proven record of managing energy assistance and heat relief programs and is capable of processing Reliant
Energy's customer payment assistance in an efficient, effective manner. On or before March 31, 2011,
Reliant Energy will contribute $20,000.00 to Dallas County Department of Health & Human Services
(DCDOHHS) in support of the 2011 Reliant Energy CARE Program. An additional contribution payment in
the amount of $20,000.00 will be made to Dallas County Department of Health & Human Services
(DCDOHHS) on or before June 30, 2011. The purpose of these contributions is to provide funding for
energy assistance payments to Reliant Energy customers under the CARE program.
The funds contributed to Dallas Count)! Department of Health & Human Services (DCDOHHS)
for energy assistance payments must be deposited in a depository bank account held in trust for Reliant
Energy. Dallas County Department ofHealth & Human Services (DCDOHHS) will not discriminate during
the distribution of CARE funds because of race, creed, color, national origin, ancestry, sex, martial status,
lawful source of income, level of income, disability, financial status, and location of customer in an
economically distressed geographic area. Dallas County Department of Health & Human Services
(DCDOHHS) will accept enrollment applications from potential clients and qualify Reliant Energy
customers as eligible recipients in accordance with the following Reli311t Energy CARE Program
qualifications:
1. Each Dallas County Department of Health & Human Services (DCDOHHS) client recipient of CARE
contributions must be a Reliant Energy customer with 311 active account.
2. The Dallas County Department of Hea}lh & Human Services (DCDOHHS) client recipient name must
match the Reliant Energy customer account name.
3. All Dallas County Department of Health & Hwnan Services (DCDOHH[») client recipients of CARE
contributions are eligible for a one time annual payment in an amount not to exceed $300 in
accordance with the Dallas Count" Department of Health & Humal! Services (DClJOHHS)'s
hardship criteria or the recipient may receive multiple Assistance payments on their account as long
as the cumulative amount does not exceed the maximum annual payment limit of $300.
Letter ofAgreement for Reliant Energy Retail Services, LLC CARE Program
Dallas County Department of Health & Human Services (DCDOHHS) will submit a monthly report
to Reliant Energy on or before the last day of each month until the entire contribution fund balances is
depleted. Reports sbould be submitted for all months even if funds were not distributed. The monthly
reports should be submitted to the Reliant Energy Agency Desk before the lOth of each month. All funds
that are not utilized or pledged to provide assistance to qualifying Reliant customers by December 31,2011,
can rollover to the following year. Dallas County Department of Health & Human Services (DCDOHHS)
must also comply the CARE Program Guidelines outlined in Attachment A. Dallas County Department of
Health & Human Services (DCDOHHS) will keep records of all transactions relating to the distribution of
Reliant Energy CARE contributions for a period of2 year(s) and will allow Reliant Energy full access
during normal business hours to inspect, audit or reproduce any and all such records and books of Dallas
County Department afHealth & Human Services (DCDOHH5) related to this agreement.
Reliant Energy can terminate this agreement at any time during the year by providing 30 days
advance written notice to Dallas County Department of Health & Human Services (DCDOHHS). In the
event this agreement is terminated, Dallas County Department ofHealth & Human Services (DCDOHHS)
must comply with the directions contained in the notice and take any necessary action to terminate the work
under this agreement. To acknowledge your agreement to and acceptance of the terms and conditions
outlined in this letter and Attachment A, please sign below on both letters. Keep one copy of your records

WHEREAS, bids were received on March 4, 2010, for Bid No. 2010-025-4885 and a construction contract was awarded to
Tiseo Paving Company, lnc., pursuant to Court Order 2010-0702, dated April 20, 2010, in an amount of $5,523,868.45,
with the County participation in the project an amount not to exceed $2,682,943.93 to be paid from MCIP Fund 196,
Project 8201 and the balance of the contract $2,840,924.52 to be reimbursed by the City which was later amended by
Change Orders I and 2 for an amended Contract Amount of$4,635,416.65; and
WHEREAS, the City has requested that a 10" force main to be constructed as designed which necessitates Change Order No.3
in an amount of$511,800.00 which will be borne 100% by the City; and
WHEREAS, in seeking to provide regional mobility and improved air quality by partoering with Dallas County cities to
develop these important infrastructure improvements, Dallas County is remaining consistent with the County's overall
Strategic Plan; and in particular is directly fulfilling the following vision statements: Vision I-Dallas County is a model
interagency Partner, Vision 4-Dallas County proactively addresses critical regionalissues, Vision 5-Dal/as County is
the destination of choice jor residents and bUSinesses; and
WHEREAS, the Director of Public Works recommends that Change Order No.3 for the construction of Lake Ridge Parkway

$]8,238,956.20; and
WHEREAS,
the COlUity has worked with the City of Grand Prairie, the City of Irving, and numerous agencies and utilities on this project which is
consistent with Vision 1: Dallas County is a model interagency partner, and this project will improve County transportation and
other infrastructure which is consistent Vlith Vision 4: Dallas County proactively addresses critical regional issues and Vision 5:
Dallas County is the destination of choice for residents and businesses; and
WHEREAS,
the Director of Public Works concurs with the amount of the bid and recommends that a construction contract be awarded to T. J.
Lambrecht/Concho Construction in the amount 0[$18,238,956.20.
IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the Dallas County Commissioners Court that the County Judge is hereby
authorized and directed to execute a construction contract with T J. Lambrecht/Concho Construction for the construction of the Hunter Ferrell Road
Project 47601 in an amount not to exceed $18,238,956.20 to be paid $5,580,673.90 from MCIP Fund 196, Project 8201 (Hunter Ferrell Road MCIP
Project 47601), with the remaining $3,231,773.07 to be reimbursed by the City of Gr
mirie and $9,426,509.23 to be reimbursed by the City of
Irving.

WHEREAS, this matter was briefed to the Dallas County Commissioners Court in executive session on
March 1, 2011, as permitted by the Texas Open Meetings Act, Sections 551.07I(1)(A and B) and 551.072 of the
Texas Government Code; and
WHEREAS, the Dallas County Hospital District (the "District") has, pursuant to the duties and
responsibilities assigned to it, determined it necessary to acquire through an eminent domain proceeding certain real
property from LAZ ILA II Harry Hines Lot, L.P .("LAZ") as described in the District's Petition in Condemnation in
Cause Number 09-01417-B (the "Property") to provide for the expansion of the District's hospital campus and the
planned development of the District's new hospital project (the "Project"); and
WHEREAS, the District has determined that the acquisition of the Property for the Project is necessary and
convenient to meet a hospital purpose and a public purpose; and
WHEREAS, the Dallas County Commissioners Court approved the acquisition of the Property, including
the use of eminent domain, by a unanimous vote through the adoption of Commissions Court Order 2009 085 dated
] anuary 13, 2009; and
WHEREAS, the District has determined that a compromise acquisition price for the property is in the best
interests of the health, safety, and welfare of the public.
IT IS THEREFORE ORDERED, ADJUDGED AND DECREED, that the Dallas County Commissioners Court
does, hereby, approve the final acquisition of the Property and all associated rights of way for the purchase price
