Fullwood ______________________ ,/ STAFF RECOMMENDATION FOLLOWING INVESTIGATION Pursuant to section I 06. 25(4)(c), Florida Statutes, undersigned staff counsel files this written recommendation for disposition of the referral in this case recommending that there is probable cause to charge Respondent with violating Section 106.141(1), Florida Statutes Based upon a thowugh review of the Report oflnvestigation submitted on September 6, 2013, the following facts and law support this staff recommendation: On January 8, 2013, the Florida Elections Commission ("Commission") received 1 a refenal from the Department of State, Division of Elections ("Division"), alleging that Reginald N Fullwood ("Respondent") violated Chapter 106, Florida Statutes 2 Respondent was a candidate for State Representative, District 13, in the 2012 election cycle 3 By letter dated March 26, 2013, the Executive Director notified Respondent that Commission staffwould investigate the following statutory provision: Section 106.141(1), Florida Statutes: Reginald N. "Reggie" Fullwood, candidate for the Office of House Representative, District 13, failed to file a report reflecting the disposition of all remaining funds within 90 days after he was elected during the 2012 election cycle. The I ermination Report was due September 6,2012 4.. Respondent filed his State of Florida Appointment of Campaign I reasurer and Designation of Campaign Depository for Candidates forms ("DS-DE-9"), on February 17, 2011, and on April 23, 2012, appointing himself as treasurer for his campaign on both forms . (ROI Exhibit 1 & Attachment "A") 1 5. On February 18, 2011, Kristi Bronson, Chief~ Bureau of Election Records, sent Respondent a letter acknowledging that Respondent had been placed on the 2012 active candidate list The letter advised Respondent that all candidates filing reports with the Division are required to use the electronic filing system ("EF S") and provided Respondent with a user identification number and initial password to grant access to the EFS (ROI Exhibit 3) 1 The Report oflnvestigation is referred to herein as "ROL" Staff Recommendation FEC 13~034 1 6 Ms . Bronson's Febmary 18, 2011letter fmther advised Respondent that all of the Division's publications and repmting fmms were on its website arid directed Respondent to print out the 2011 Calendar of Reporting dates as well as other documents Id 7.. Respondent's 2012 Termination Report was due to be filed by September 6, 2012; however, Respondent failed to file his report (ROI Exhibit 7) 8 By letters dated September 13, 2012, October 2, 2012, arid October 17,2012, the Division informed Respondent that his 2012 I ermination Repmt still had not been received The October 17, 2012 letter included copies of the previously mailed notices arid was sent via certified mail with delivery confirmation Each of the three notices was sent to the address Respondent listed on his DS-DE 9 form (ROI Exhibits 4, 5 & 6) 9. As of September 10, 2013, Respondent still has not filed his 2012 Termination Report 10.. "Probable Cause" is defined as reasonable grounds of suspicion supported by circumstaiices sufficiently strong to warraiit a cautious person in the belief that the person has committed the offense charged Schmitt v State, 590 So 2d 404, 409 (Fla. 1991) Probable cause exists where the facts arid circumstaiices, of which an [investigator] has reasonably trustworthy information, are sufficient in themselves for a reasonable man to reach the conclusion that aii offense has been committed Department of Highway Safety and Motor Vehicles v. Favino, 667 So2d 305, 309 (Fla. 1' 1 DCA 1995). 1L The facts set forth above show that Respondent was a caiididate for State Representative, District 13, in the 2012 election cycle Respondent's 2012 I ermination Repmt was due by September 6, 2012, but he failed to file his report By letters dated September 13, 2012, October 2, 2012, October 17, 2012, the Division notified Respondent that his 2012 I ermination Report had not been received Despite receiving three letters fiom the Division, Respondent still has not filed his 2012 I ermination Report Based upon these facts and circumstaiices, I recommend that the Commission find probable cause to charge Respondent with violating the following statutory provision: Count 1: On or about September 6, 2012, Respondent violated Section 106 141(1), Florida Statutes, when he failed to file his 2012 I ermination Report Respectfully submitted on September ' f. ( c I I, \ I ' FLORIDA ELECTIONS COMMISSION REPORT OF INVESTIGATION Case No.: FEC 13-0.34 Respondent: Reginald "Reggie" Fullwood Counsel for Respondent: N/A Complainant: Division of Elections Counsel for Complainant: N/A Pursuant to Section 106.25, Florida Statutes, on January 8, 2013, the Florida Elections Commission received information from the Division of Elections that Respondent violated Chapter 106, Florida Statutes The Division's referral was mandated pursuant to Section 106. 07(8)(d), Florida Statutes Commission staff~ therefore, investigated whether Respondent violated the following statute: Section 106 ..1 41 (1 ), Florida Statutes, failure of a candidate to dispose of fimds remaining in his campaign account within 90 days after he withdrew, became unopposed, was eliminated, or elected and to file a report reflecting the disposition of all remaining fimds I. Preliminary Information: L Respondent was a candrdate for the Flonda House of Representatives, District 13 in the 2012 election Respondent won his bid for election Respondent appointed himself as his own campaign treasurer . 2 Respondent filed his current Appointment of Campaign I reasurer and Designation of Campaign Depository form (DS-DE 9) with his filing officer on April 23, 2012 To review a copy of Respondent's DS-DE 9 form, refer to exhibit L 3. II. Complainant is the Division of Elections Alleged Violation of Section 106.141(1), Florida Statutes: 4.. I investigated whether Respondent violated this section of the election laws by failing to file his termination report reflecting the disposition of all remaining fimds in his campaign account within 90 days after he.became unopposed Complainant alleges that Respondent has not filed his 2012 IR Report with his 5 filing officer . 6.. In a January 7, 2013 affidavit from Theresa Holdeen, representative from the Division of Elections, I was advised that Respondent had not filed his 2012 IR Report. Ms Holdeen attested that his 2012 TR Report was due by September 6, 2012 To review a copy of Ms . Holdeen's January 7, 2013 affidavit, refer to exhibit 2 Inv002 (7/08) 1 7.. In a February 18, 2011 acknowledgement letter from the Division of Elections, Respondent was notified that his name had been placed on the 2012 active candidate list. The letter advised Respondent that all candidates filing reports with the Division are required to use the electronic filing system (EFS), and provided Respondent with his user identification number and initial password allowing him access to the EF S. On September 13, 2012, the Division sent Respondent a notice letter via regular mail advising him that his 2012 TR Report that was due on September 6, 2012, had not been received To review a copy of this September 13, 2012 notice letter, refer to exhibit 4 On October 2, 2012, the Division sent Respondent a second notice letter via 9 regular mail advising him that his 2012 TR Report still had not been received To review a copy of this October 2, 2012 notice letter, refer to exhibit 5 10 On October 17, 2012, the Division sent Respondent a final notice letter via certified mail, advising him that his 2012 IR Report still had not been received This letter included copies of previous mailed failure-to-file notices that were sent to Respondent I o review a copy of this October 17,2012 final notice letter, refer to exhibit 6. 11 I have reviewed records from the Division of Elections regarding Respondent's campaign activity According to the campaign finance activity, Respondent reported receiving $4,750 00 in contributions year-to-date, but he has not reported spending any monies during the entire campaign I o review records from the Division of Elections regarding Respondent, refer to exhibit 7 12.. As of the date of this report, Respondent has not filed his 2012 IR Report with his filing officer. 13 Records reflect that Respondent has previously violated this section of the election laws III. FEC History 14.. Respondent has established a pattern of being involved in FEC investigations involving automatic fines, and failure-to-file cases Conclusion: 15 Respondent was offered several opportunities to make comments regarding the findings of this investigation Respondent did not respond to any of the attempted contacts . 16. In a Febmary 18, 2011 acknowledgement letter, Respondent was advised that all of the Division's publications and reporting forms were available on the Division of Elections' web site..
