services. The same entry fee/
spectrum charges continued
even after 2007-08. Same is
the case with dilution of equity by a company. It is not
per se illegal nor was it prohibited at the relevant time.
However, such acts may acquire criminal colour/ overtones when done with criminal intent.

the cut-off date, filing and

of spectrum and payment
and receipt of bribe. All these
incriminating acts were allegedly done by the minister/
officials of Department of
Telecommunications, Ministry of I&B, Government of
India and by private persons.
‘Taking decisions is
not criminal’
A DECISION taken by a public servant does not become
criminal for the simple reason that it has caused loss to
the public exchequer or resulted in pecuniary advantage to others. Merely attending meetings and taking
decisions therein is not a
criminal act. It must have the
taint of use of corrupt or illegal means or abuse of his official position by public servant for obtaining pecuniary
advantage by him for himself
or for any other person or obtaining of pecuniary advantage by him without any
public interest.

of unfavourable judgments in the last few
days, the trial court’s verdict
in Home Minister P Chidambaram’s case brought
much-needed cheer in the ruling establishment, which described it as a vindication of its
stand, and demanded apology from the BJP for running a
vilification campaign
against
Chidambaram.

colleague (Chidambaram) was
absolutely not culpable for anything in
the allegations made by Subramanian Swamy. I know the

BJP on Saturday harped on
his “political accountability”
in the 2G spectrum scam.
Party spokesperson Ravi
Shankar Prasad, who was extremely combative in attack-
ing the government just two
days ago following the
Supreme Court’s order cancelling 122 telecom licences,
said that the party would
continue to seek “accountability” of Chidambaram and
the government in the case.
“This verdict is not going
to change the corrupt image
of this government. Neither
are we going to bring down
the intensity of our campaign
against this corrupt govern-
ment. The issue of political
accountability of Chidambaram remains as alive
as ever,” he said.
“We will raise this matter
in Parliament and also with
the people outside,” he said.
Prasad said the order of
the trial court was not the final word on the issue in any
case. “This is the decision of a
lower court which would be
appealed. The High Court is
there, the Supreme Court is
there. This is not over,” he
said. “We cannot lose sight of
the fact that the Supreme
Court has cancelled 122 licences because it was a scam
and there was corruption.
The licences were allotted arbitrarily and through manipulation,” he said.
“We are very clear that
there is enough evidence
against Chidambaram in
public domain.... The BJP
shall continue to pursue the
matter before the people of
the country. The nation
seeks a reply,” he said.
Senior party leader
Jaswant Singh agreed that
Saturday’s order was disappointing for the party but
said this was not the end of
the story.
“But nobody in this government is still ready to answer on the loss of moral authority and credibility they
have suffered,” he said.
It is premature to
conclusively say who is
wrong and who is right.

Committee on Finance of Parliament for detailed examination and Report.

invite memoranda containing views/suggestions on these new proposals contained

The National Food Security Bill, 2011 as introduced in Lok Sabha on 22nd December, 2011
has been referred on 5th January, 2012 by the Hon’ble Speaker to the Parliamentary
Standing Committee on Food, Consumer Affairs and Public Distribution headed by Shri
Vilas Muttemwar, MP for examination and report to the Parliament. The text of the Bill as
introduced in Lok Sabha is available at the website http://www.parliamentofindia.nic.in.
2. The National Food Security Bill, 2011 has been introduced in Lok Sabha by the
Government in pursuance of its constitutional obligations and obligations under the international conventions. Article 47 of the Constitution also provides that the State shall regard
raising the level of nutrition and the standard of living of its people and the improvement of
public health as among its primary duties. The Universal Declaration of Human Rights and
International Covenant of Economic, Social and Cultural Rights, to which India is a signatory, also cast responsibilities on all State parties to recognize the right of everyone to adequate food. Eradicating extreme poverty and hunger is one of the goals under the
Millennium Development Goals of the United Nations as well. The Bill, therefore, proposes
to provide for food and nutritional security in human life cycle approach by ensuring access
to adequate quantity of quality food at affordable prices to people to live a life with dignity.

security from the welfare approach to a right based approach.
