And it was thanks to the much appreciated endorsement and support provided by the more than three hundred hapu members who attended hui during the previous year that the Crown has accepted our Trust has a valid mandate to negotiate a comprehensive agreement to our Treaty claims. It was following extensive and comprehensive consultations with the claimant community, the Trust was established in December 2010 to negotiate all historical Nga Hapu Karanga Treaty claims – whether registered or unregistered with the Waitangi Tribunal. Our ongoing objectives include, but are not limited to: − Representing and promoting the interests of all Ngäti Kahungunu ki Wairarapa-Tämaki Nui ä Rua in settlement negotiations with the Crown, − Resolving overlapping issues with other claimants, − Maintaining the Ngäti Kahungunu ki Wairarapa-Tämaki Nui ä Rua Register, − Developing a Post Settlement Governance Entity structure for the approval of the Ngäti Kahungunu ki Wairarapa-Tämaki Nui ä Rua. On 29 November 2012 the Crown recognised the mandate of the trustees to represent and progress all the Ngati Kahungunu ki Wairarapa – Tamaki Nui a Rua hapu karanga claims during settlement negotiations. The Hon Chris Finlayson, Minister of Treaty of Waitangi Negotiations, and the Hon Hekia Parata, Minister with Delegated Responsibility for Takitimu, endorsed our Deed of Mandate. In May 2013, the Trustees appointed Ron Mark, Ian Perry, Robin Potangaroa, Haami Te Whaiti and Marama Tuuta to undertake the negotiations with the Crown. The appointments were made following a series of hapu karanga discussions, and a publicly advertised process in accordance with the Trust Deed. Led by Ron Mark, our negotiators will be supported by the other trustees and others within the hapu karanga with expertise in a range of areas, as well as having access to external specialist advisers. We know we must achieve a settlement that not only assists local hapu, but also boosts the Maori commercial presence in the greater Wairarapa and Tamaki Nui a Rua community. At this upcoming AGM in November 2013, as determined by the provisions of the Ngäti Kahungunu ki WairarapaTämaki Nui ä Rua Trust Deed, the terms of office of the establishment trustees will come to an end. Accordingly, nominations have been sought for each of the nine Hapü Karanga represented on the Trust, and the successful ANNUAL REPORT 2013 nominees will take up their roles in order to continue the progress already made. Ngati Kahungunu Ki Wairarapa – Tamaki Nui A Rua Trust 5 Strategic Focus The primary focus during this financial year has been engagement with the Crown to finalise the Terms of Negotiation. I am pleased to report that on 8 July our Trustees signed Terms of Negotiation, which were formally recognised by the Crown on 17 July 2013. Furthermore throughout the year the Trust has committed significant time and resources toward engaging with neighbouring claimant communities/Large Natural Groups, in particular - Rangitane. It has been a complex process fraught with competing priorities however, I believe that the overall progress has been positive for Ngati Kahungunu. I would like to take the opportunity to thank all members of the Ngati Kahungunu Ki Wairarapa Tamaki Nui a Rua claimant community who have stood by and supported us through that process. The Trust is now focused on entering into substantive negotiations with the Crown to achieve an Agreement in Principle before the next general election. Trust Capability The Trust has retained sufficient internal capability in governance, organisational management and finance in accordance with our contractual obligations to our principal sponsor the Crown Forestry Rental Trust, and our key stakeholder the Office of Treaty Settlements. Our additional stakeholders and external contractors include: Haami Te Whaiti of Ngati Kahungunu Ki Wairarapa Charitable Trust (Mapping Facilitator), Bruce Stirling of History Works Limited (Researcher), and Christine Barnett (Archeologist). While acknowledging that there may still be room for improvement, the Trust continues to develop and maintain the processes, policies, systems and records necessary to ensure it will persist in meeting its objectives, particularly regarding the Trust’s registrations process. Finance The Trust has continued to prudently manage its financial resources as its dependence on Crown and Crown Forestry Rental Trust funding, requires a high degree of responsibility to ensure any spending is managed wisely. So the Trust remains in a positive financial position to fund the ongoing activity needed to achieve our objectives. Conclusion On behalf of the Trustees I am very pleased to present this Annual Report of the Ngati Kahungunu Ki Wairarapa – Tamaki Nui a Rua Trust. I trust that the claimant community will have confidence in both the transparency and the effectiveness of the process we are following to achieve a timely and efficient settlement. I also want to record my gratitude and commendations for the outstanding efforts of the Trustees, the Project Management Team and all those Trust Committee Members who have given of their time and expertise to ANNUAL REPORT 2013 advance the achievement of the goals and objectives of our Trust. 6 Ian Perry Trust Chair Ngati Kahungunu Ki Wairarapa – Tamaki Nui A Rua Trust Significant Achievements September to November 2012: A series of Hapu Karanga hui were held throughout Wairarapa and Tamaki Nui a Rua. 8 December 2012: Annual General Meeting held. 17 December 2012: The trust had opening discussion with Crown Chief Negotiator preparing the ground for settling the Terms of Negotiation. In December 2012 the trust engaged in substantive negotiations with the Crown regarding the Terms of Negotiation. 25 January: Formal handover at Office of Treaty Settlements from GSO Team to OTS’s Takitimu Team. 13 March 2013: The trust signed protocols for engaging with Rangitane regarding discussing overlapping hapu. The Trust’s shared interest committee continues to progress through those hui and I would like to take this ANNUAL REPORT 2013 opportunity to specifically thank all who have attended and supported the Trust at those hui. 8 Ngati Kahungunu Ki Wairarapa – Tamaki Nui A Rua Trust Discussions continued with the crown’s Chief negotiator and negotiations were kept alive whilst the appointment process was designed, implemented and concluded. In the final month of the financial year for 2012/13 various discussions were had with the Crown regarding quantum, timelines and issues effecting the Trusts negotiations work plan. Funding and Finances The Trust continues to rely on Crown and Crown Forestry Rental Trust (CFRT) funding. Internal issues within funding organisations have, on occasion impacted on the timing of the receipt of payments the Trust has engaged with its bankers (ASB) to establish an overdraft facility to reinforce our ability to meet ongoing financial obligations. I wish to commend our Treasurer Pani Himona for keeping our finances in order, and in particular for the way in which he has worked with the Trust’s accountant and the Project Manager to ensure that both the accounts and payments are kept up to date. I also wish to compliment him on how quickly he was able to come to terms with “Xero” and the work he has done with the Project Manager and the accountant to modify it to meet the trusts reporting needs. The Trust has continued to take a prudent approach to controlling its financial affairs. Procedures and systems are in place to ensure the effectiveness of internal controls, and the accuracy of reported financial information. Detailed monthly financial reports are provided to the Crown Forestry Rental Trust in accordance with the contractual requirements of our funding. As at 30 June 2013, the Trust’s total income received for the year was $395,631. Trust funding was received from the Crown Forestry Rental Trust, the Office of Treaty Settlements, and Te Puni Kokiri. The Trust’s funding contracts often operate over two financial years. The Trust’s operating costs for this current financial year were $480,519. This suggests that the Trust operated at a deficit of $117,480 for the period ending 30 June 2013. As with previous years, contract deficits are offset against project funds still to be received beyond the balance date of 30 June for the current financial year. Current project funds still to be received for this 2012/13 financial year include, Crown Forestry Rental Trust funding ($84,107.50), Te Puni Kokiri ($20,000), and the Office of Treaty Settlements ($33,611). Unspent project funding from the Office of Treaty Settlements remain available to the Trust even if unspent up until settlement. On that basis I am pleased to report that the Trust is operating in a healthy state and remains on target to reach it’s overall objective on time and within budget. An independent auditor is currently finalising an annual audit of the Trust’s financial statements, which will be presented at the upcoming Annual General Meeting for your consideration. Enhancing Capability As funding of the current phase of the process has been considerably less than what will be provided for future settlement phases such as Agreement in Principle or Deed of Settlement, staffing and contracting expenditure has been held to a bare minimum. In the coming year the Trust will employ two full-time staff, they are Leah Bain (Trust Administrator), who replaces Diane Rewi, and Robin Paratene (Trust Project Manager). All remaining personnel Steps are being taken to enhance communications as a priority, both operationally and strategically, in order to enhance the Trust’s ability to better keep its registered members informed, enhance public awareness of the Ngati Kahungunu Ki Wairarapa – Tamaki Nui A Rua Trust ANNUAL REPORT 2013 and advisors will be engaged on a contract basis, including additional support staff if and when required. 9 Trust, and grow the registration base. It will also be aimed at improving local understanding of the claims, and through that, local support for a beneficial outcome. The beneficiary register and the registration process have provided the PMT with a series of ongoing challenges and we are currently reviewing how to enhance them. Thank you to those who have provided feedback. This is a priority for the Trustees, as we remain committed to developing appropriate, secure and accurate registration tools, processes and policies. We have committed some time and resource toward analysing our organisation, structures, facilities, policies and operations in the light of our experiences to date. This has been in order to ascertain whether or not we are fit for purpose and capable of delivering the most effective support to the respective sub committees, work streams, processes and operational staff going forward. Summary The PMT has been busy throughout the year ensuring that each sub-committee has been sufficiently supported to advance their respective work streams in the most effective and efficient manner possible. There have been challenges and extra-unforeseen workloads brought about by circumstances beyond the Trust’s control but they have been handled well to date. Clearly going forward there will some structural and organisational changes needed as the Trust meets the changing requirements brought on by the Negotiation phases. The greatest challenge will be to identify those promptly and to implement improvements with as little disruption as possible. Ron Mark ANNUAL REPORT 2013 Executive Team Leader 10 Ngati Kahungunu Ki Wairarapa – Tamaki Nui A Rua Trust Commercial Negotiations Team Report On behalf of the Commercial Negotiations Team comprising myself as Leader, Jack Morris, Troy Hobson, Chris Seel, Robin Paratene (Trust Project Manager) and Jennifer Braithwaite (Trust Legal Adviser) I am pleased to present this report. In August the Commercial Negotiations Team undertook a strategic planning session to determine our function, responsibilities and objectives and, as a result, began developing a Commercial Negotiations Strategy. We have also initiated an analysis of Crown properties, which could form part of a future settlement package, and an assessment of other completed Treaty Settlements, which could be comparable to the NKKW-TNAR Settlement. The team is continuing to analyse the range of complex property information needed to assist in our negotiations with the Crown. Further work is also underway to identify key properties or assets of interest to the Trust, which may form part of a commercial settlement. This analysis includes the valuation of NgÐumu forestry. From this work the CNT will be able to develop a clearer understanding of the commercial value of the settlement or quantum to be negotiated with the Crown. Ian Perry Commercial Negotiations Team Leader Shared Interest Team Report The Shared Interest Committee was formed to address overlapping claims. During this past year the main priority has been to progress NKKW-TNAR’s engagement in the Treaty Settlement Engagement Policy (TSEP) with the Rangitane Settlement Negotiation Trust. This process has involved holding several hui with Rangitane to discuss hapu and marae common to both iwi and using our best endeavours’ to agree on relative interests for settling the claims. Regional hui for these discussions and agreements to occur are being held and the final stage will ideally be an agreed position between both Trusts and there is also provision for mediation in the TSEP protocols if required. The Committee also worked on the NKKWTNAR Claimant Definition, which required changes before the Crown was prepared to agree to Terms of Negotiations.
