Dear Sirs:
You are hereby directed to cease all operations of a temporary residence, children's overnight
camp and children's day camp at the above noted facility due to your failure to obtain permits as required
by State Sanitary Code (SSC) § 7-2.4(a) and § 7-1.4(a). In accordance with SSC § 7-2.4(d) and § 7-1.4(c)
applications for permits to operate have been denied by this Department due to the presence of public
health hazards and numerous and serious violations of the State Sanitary Code and other applicable codes,
rules and regulations as documented during inspections conducted at this facility on 3/12/07, 3/30/07,
4/26/07,6/14/07, 7/5/07 and 7/23/07. These public health hazards and violations include, but are not
limited to, the following:
1. Operation of a temporary residence and children's camps without a permit, in violation of SSC § 71.4(a) and § 7-2.4(a).
2. Construction and renovation work done prior to obtaining the applicable permits and approvals, in
violation ofSSC § 7-2. I2(a) and (b), § 7-1.7, and § 7-1.8.
3. Failure to maintain a fire alarm system and failure to develop and implement a fire evacuation plan, in
violation ofSSC § 7-1.10 and § 7-2.18 (b)(l) and (4).
4. Use of an unapproved children's camp food service facility (indoor tennis courts), in violation of SSC
§ 7-2.19(a).
5. Emergency response access blocked or obstructed by guest and staff vehicles; interior and exterior
routes of egress obstructed by furniture, tricycles and personal effects, in violation of SSC § 72.1 (b)(2) (xxii), 7-2. 1(b)(xxviii), and § 7-2.18 (c)(l).
6. Failure to maintain and properly operate the sewage disposal system resulting in the discharge of
improperly treated sewage to the ground surface, in violation of SSC § 7-2.7 (b) and (c) and § 71.16(c).
7. Failure to install and maintain fire safety equipment such as emergency lights, self-closing, selflatching fire and smoke doors, in violation ofSSC § 7-1.6(a), 7-1.11, and § 7-2. 18(a) and (c).
8. Swimming pools and swimming pool equipment not properly operated and maintained in a safe,
sanitary manner in accordance with SSC Subpart 6-1, in violation ofSSC § 7-2.1 1(a)(3) and § 7-1.31.
9. Food service facilities, including food storage and food preparation areas, are in disrepair, unclean,
and not maintained in accordance with SSC Subpart 14-1, in violation of sse § 7-2.19 (a) and §71.20.
An inspection of your facility will be conducted within three business days of this letter. Unless
this inspection finds the facility is permit eligible, or the facility is closed and not occupied, this case
will be referred to the NYS Office of the Attorney General for appropriate enforcement action.

Dear Mr. Schwartz:
This office has been in continued receipt of an appl.ication for a Pennit to Operate an
overnight Children's Camp at Spring Mountain Resort, Town of Mamakating. As indicated in
this office's previous Pennit Denial Letter of 17 May 2007, this office cannot approve any Permit
to Operate until the facility is in substantial compliance with the New York State Sanitary Code.
Of particular concern, and documented in this office's 5 July 2007 and 14 June 2007 Inspection
Reports are the following:
• The facility was in operation without a valid Permit to Operate from the
Monticello District Office.

During this office's inspection conducted 5 July 2007, it was noted that
the facility was not properly evacuated after activation of the fire alarm
system, indicating the facility's fire evacuation plan (Written Safety Plan)
is not being properly implemented. More concerning, the local fire
department did not respond to the alarm, due to the facility's history of
continuing and repeated false alarms.
After repeated requests from the Town of Mamakating to keep the area
in front of the building (under the over-hang) clear for emergency
vehicles, this office noted numerous motor vehicles blocking the entrance
to the facility during the 5 July 2007 inspection.
No fire drill was conducted with Campers within the first 48 hours of
camp, as is required in NYSSC Section 7-2.18(b)(4).
Numerous of the smoke doors previously cited in this office's 14 June
2007 Inspection Report have not been properly adjusted to be tight fitting
and thereby prevent the spread of smoke.
Plans for installation of an acceptable chlorination system on the facility
water supply have not been reviewed and approved by this office at this
time. NYSSC 7-2.6(c)(1) requires installation of an approved
chlorination system on all children's camp water supplies.
In addition to the above, the facility's Temporary Residence Penn it expired on 30
June 2007. This office requires the following deficiencies be corrected prior to approving
a new Permit to Operate, please refer to this office's Inspection Reports indicated above:

Individual room doors in the Elite section must be properly self-closing.
The chlorination room for the indoor swimming pool is not properly
sealed to prevent the spread of toxic smoke (chlorinated gas) in the event
of a fire.
No emergency lighting is installed in the indoor swimming pool enclosure.
The kitchen floors are not properly sealed in order to meet the
requirement of being smooth and easily cleanable.
The rear kitchen stairs are not properly sealed, and are heavily encrusted
with dirt and grime. Previous inspections identified a continued rodent
infiltration into kitchen are, which has been exacerbated by the
unsanitary conditions that exist in the area of the kitchen rear entrance.

Smoke barrier doors adjacent to the house keeping area were propped open with a wooden
wedge. The magnetic holds were not functional at the time of inspection

obstructs the door from closing.
Elite Wing I - smoke barrier door into stairwell, near room number 502, was propped open
with a wooden wedge. The door is not self-closing or positive latching.
Several battery-operated
smoke detectors located in sleeping rooms were not properly
maintained and were chirping.
There were several exit signs that were not properly illuminated.
Before occupancy occurs, a fire safety inspection must be conducted by the hotel staff to ensure
compliance with all fire safety regulations and the facility's written Fire Safety Plan. This office will
conduct a re-inspection
in the near future to ensure substantial compliance with the NYSSC, Subpart 7-1.

sure that you are aware that the Fire protection Equipment is Disabled and
that the building is vacant and all interior & exterior openings are protected
to prevent entry and on all exterior doors on bright yellow poster paper
written/typed in bold black ink are posted notices alerting the public of the
above conditions. A copy of such is also attached. These notices should be
posted by, end of business December 17,2008; I will be doing an inspection
of the premises to verify the notices are in place on December 18, 2008
Please note that Mr. Goldman has assured me that all combustibles and
debris have been removed from the building which is a requirement for
temporarily unoccupied buildings, structures premises or portions thereof.
