There’s so much change going on, it can be a challenge to keep up with it all. But take heart, big changes and challenges are happening everywhere. You’re not alone. Not to be outdone, the California Association of Mortgage Brokers sponsored and sheparded to enactment AB 790, establishing the criminality of anyone misrepresenting themselves as a licensed real estate broker, mortgage broker or REALTOR®. DRE is expressly authorized (not required, unfortunately) to revoke the licenses of violators. The ‘normal’ real estate market is officially here. My latest check of the MLS statistics tells me that a single-family residence in Sacramento County is on the market an average of 51 days before it sells, up from 19 days during the market frenzy of less than two years ago. On the positive side, 51 days is not forever, and home sellers are beginning to realize that this is not the end of the world; it’s just the end of a remarkable five-year run of double-digit appreciation. Nervous though we may be growing about world affairs, reasonable people almost everywhere still seem to think that America - and California in particular - are good investments. As I write this, the stock market is near a record high, unemployment remains low, and interest rates are reasonable and flat. Our economy, if not robust, is at least growing steadily. And Sacramento remains California’s most affordable metropolitan region in terms of housing, save only San Bernardino-Riverside. County-wide, resale home prices have decreased 5 or 6 % from a year ago, after racing up over 100% in five years. So much for the bursting bubble. In theory, these new laws will Leigh Rutledge increase the foundational knowledge of sales licensees entering the 2006 SAR President profession, decrease the incidence of ill-equipped licensees engaging in licensed activity, and revoke the licenses of those who deliberately misrepresent their qualifications or status as a REALTOR®. As the dust of that frantic five years begins to settle, some concerns about not-so-subtle changes in the marketplace have come to light. For one, we have far more inexperienced agents and brokers in the business than ever before. The California Department of Real Estate’s (DRE’s) statewide tally of licensees now exceeds 510,000. About 85% of those licensed in the past few years hold conditional licenses, meaning they have completed exactly one required certification course and promised to complete two more within 18 months. What remains to be seen is whether DRE’s implementation and enforcement of these laws will be timely and effective. It is not particularly reassuring to know that, as I learned just recently, over half of DRE’s already-overworked staff of 260 is currently eligible for retirement. Think of the drain of institutional knowledge that represents, for any organization. Another C.A.R.-sponsored and REALTOR®-authored bill, AB 1963 that would’ve eliminated the two-years-experience exemption for real estate broker license applicants with 4-year college degrees (but no legitimate real estate experience), also made it through the Legislature. Unfortunately, the Governor vetoed that bill September 29th for reasons not completely clear. Had it passed, no one would’ve been able to obtain a California brokers license without a minimum of two years of documented experience in the real estate business. That was a good idea, and I hope C.A.R. still agrees it’s worth pursuing in the next Legislative session. As professional qualifications go, that’s a pretty low bar. And frankly, the caliber of client service that some of these new agents were getting away with in the hot market was abysmal. It was only the easy circumstances of ample capital and low interest rates that enabled them to stumble through a close at all. Now the market is tighter, casting a more discerning light on agents’ (and brokers’) lack of experience and deficient client service. Unprofessional behavior that was only recently considered inconvenient and annoying to experienced agents is now unacceptable. Everyone needs to pull their own weight, professionally speaking. To our credit, and for the long-term greater good, organized real estate saw this problem coming and has taken some timely legislative action to raise the minimum standards for California real estate professionals. Many of you will agree with me that this effort comes not a moment too soon. The changing market and legal environment demand a higher level of professionalism, particularly among the inexperienced and non-REALTORS®. In early September, Governor Arnold signed AB 2429, the Real Estate Salesperson Licensure Act, into law. Sponsored by the California Association of REALTORS®, the legislation requires salesperson applicants - after Sept. 31, 2007 - to complete all three of the Department of Real Estatemandated pre-license courses prior to taking the license examination. A companion bill (AB 223) requiring licensees to earn at least three hours of DRE recertification credit in the area of risk management was Like it or not, the pendulum is swinging. At the time Client A signed an exclusive listing agreement with REALTOR® B, they discussed market conditions and prevailing prices, and agreed on listing at $156,900. After six weeks with no apparent interest in the house, Client A called REALTOR® B to learn why his property was receiving scant attention from prospective buyers. REALTOR® B said, “It’s not hard to diagnose the trouble. Your property is overpriced. That was clear to me by the time we had it listed for ten days. In this market, it would take a really interested buyer to go as high as $149,000 for it. That’s why it hasn’t been possible for us to push it.” “When you reached that conclusion, why didn’t you tell me?” asked Client A. “Because,” said REALTOR® B, “it wouldn’t have done any good. I know from experience that sellers can’t be convinced that they are overpricing their property until they get tired of waiting for an offer that will never come. Now that the market has taught you something that you would not take as advice, let’s reduce the price to $148,900 and push it.” Client A complained about REALTOR® B to the Board of REALTORS®, detailing these circumstances, strongly insisting that REALTOR® B had fully agreed with him on the price at which the property was originally listed. Client A reiterated this point strongly at the hearing of his complaint which was held before a Hearing Panel of the Board’s Professional Standards Committee. REALTOR® B did not contest this, taking the position that at the time of the listing it was his judgment that a price of $156,900 was fair and obtainable in the market. He stated that a strong immediate sales effort had convinced him that the listed price was excessive, and he defended his action of reducing his sales effort as he had done in his discussion with the client. He said that many years of experience as a broker had convinced him that once a seller decides on a definite price for his property, no argument or analysis will shake his insistence on getting that price; that only inaction in the market is convincing to the sellers. The Hearing Panel concluded that REALTOR® B’s conduct had violated Article 1 of the Code of Ethics, which requires REALTORS® to protect and promote their clients’ interests. The panel also found that since REALTOR® B honestly felt the original listing price of $156,900 was the fair market value at the time he listed it, REALTOR® B had not violated the Code of Ethics by suggesting that the price be lowered. Masters Club Qualifying Criteria This is a re-cap of qualification changes for the 2006 application. Residential category applicants must have a minimum volume of $5 million in closed escrows, and the applicant must have a minimum of eight (8) ends to qualify. Alternatively, if the applicant does not have $5 million volume, but has a minimum of 30 closed ends, this qualifies. All sales must be within California. Masters Club application is an “individual” process. All MLS transaction credit (on each end) is either 50% or 100%. No other divisions take place. Prospector has been programmed to calculate the credit and to total the credit according to the names appearing on the MLS. It is vitally important that you keep an accounting of your production. If you are working with a TEAM, please be sure that the team member applying for Masters Club is ON THE MLS printout. In this ever-growing computer economy, you have to know how to e-mail. The average worker gets literally hundreds of these electronic messages a week from a range of sources for a host of reasons in a multitude of forms. We’ve all heard the horror stories. E-mail gets lost, intercepted, rerouted, and unanswered. The “e” in email may very well stand for exasperating for all its work and inconvenience, or it may stand for extraneous for its impersonal yet never-ending nature. The same was probably said when the telephone, fax, and other technologies arrived on the scene. They are, after all, merely means of communicating. Understand them and you relate effectively. Misunderstand them and get lost. But it can also stand for exceptional. “E” may also stand for exceptional if you know how to effectively use this most popular of mediums. Ask yourself which e-mail messages do you ignore, discard, rush through? Know before you go. This is a most unique communication form and its ease, directness, speed, and accessibility, it can lead to E problems. It’s always good advice to look “or think” before you leap. Decide if your message is most suited for e-mail. It could be a phone call, a personal visit, or a formal letter would be more appropriate. Because it is so immediate, it must be handled with judiciousness. This is especially true of emotional messages. It’s a good idea to think before you type. It can save everyone a lot of problems and since it is as easy to send your message to the entire universe as to a single member, many do. Limit your distribution. Who really needs to receive your message? More isn’t always better. Sometimes it is less effective and if you continue to send extraneous messages to unwanting people, they might not heed your message when it is pertinent. Say what you mean. Books use chapters, newspapers use sections, plays break down into scenes. Structure your message. Provide easy access with formatting. People need to know what’s what in an immediate basis not once upon a time. If you’ve done your preparatory work, this should be easy. Use informative subject lines so readers can determine priority. If you need action, state it in the subject line. In other words, make it easy for them to respond. Use good English. Just because it seems informal doesn’t mean people don’t care and aren’t making impressions based on your work. Off-beat acronyms. What may make sense to you may not to others. Remember that humor or tongue-in-cheek remarks rarely go over in black and white. Delete regularly. It’s a discipline. Some people keep everything they receive. Information pack rats. If it’s that important, react to it. E-mail is here to stay. Master it and use its ease and speed to your advantage. Physical & Financial Resources • Getting the Retail Center on-line has been a wish and now accomplishing some components of the project need to become a reality in the 2007 business plan • State of the art office equipment will benefit the Membership by enabling Staff to reach them more effectively and recommend to them the latest technological advances and tools made available through the store and affinity programs III. Member Services • Business Center – To have a homeaway-from-home for the many Members who work from home • Business trends and models – To keep the Membership informed on how their industry is evolving • Targeted internal and external communication systems and delivery vehicles focused on enhancing current knowledge and discussion of future trends • Develop and offer innovative marketing tools and other services based on analysis of current and future needs • Reschedule New Member Orientation once a week but on staggered days and at different times to accommodate new Members’ schedules • Focus on enhancing current knowledge and discussion of future trends • Increase outreach to allied industries and culturally and ethnically diverse groups • Link MetroList and SAR so that Member information updates can be entered in only one place • • Public Relations/Community Outreach Evolving Organization/Changing Membership These are the five categories of Member service that will be the focus of the 2007 Business Plan. It will detail each area with action items, deadlines and accountability to implement the Strategic Plan and to help move the organization and its Members into the envisioned future. Let’s take a brief look now at each of these categories before detailing them in the Business Plan. Government Relations/Political Action The Team handling this Core Competency had a number of innovative thoughts to add to the Business Plan: • • • • Increase attendance at C.A.R.’s Legislative Day by combining their Tech Day begun in 2006 with our longstanding Tech Faire Strive for a larger percentage of the Membership contributing to the PAC Start a Government Advocacy training program Continue legislative tracking and alerts IV. Internal & External Relations • Increase communication to the Membership of successful public relations and government relations outcomes • Consider publishing an Annual Report • Publish Public Advocacy/Political Action Reports • Communicate the value of Membership through publications and office visits • Establish an Ambassador program similar to that of the Sacramento Metro Chamber Association of the Future Characteristics of an Association of the Future were ranked by teams within the Committee with the following consensus ranking: 1. Promote the highest levels of professionalism 2. Set and enforce business rules 3. Provide business and technology tools to the Membership 4. Influence public policy 5. Become the trusted source of real estate information Discussions at both the Committee and Staff sessions stressed… • Communicate what the Association does and stands for to the Membership and consumers who benefit from its activities • Educate Members and consumers; institute a broad mentoring program for new agents; work towards more diversity in the leadership; support and expand the Internship Program and real estate courses at local colleges • Trust…promote it so that REALTORS® and the Association are seen as reliable sources of service and knowledge Core Competencies The Committee’s next task was to look at broad categories of service that the Association provides its Members to help carry them into the envisioned future.
