SAR is pleased to announce the launch of an innovative new
educational series – SAR’s Broker Training Institute or BTI.
Using the highly successful Real Estate Training Institute (RETI)
as its template, BTI offers brokers who are new, seasoned or just
completing their course work, critical information on how to
operate a brokerage and avoid common mistakes that could land
them into financial or regulatory jeopardy. BTI is one of the first
series of its kind in the country. The SAR Education Committee
welcomes your participation in our premier series.
As a student enrolled in BTI, you will meet for six half-day
sessions, most of which will be held on Tuesdays from 9:00am
– noon in SAR’s Mack Powell Auditorium beginning Tuesday,
October 17. The cost for the full series is $199. See the schedule

Get Fired Up…Without Burning Out!
By Carol Grace Anderson
More than ever before, we need to get… and figure out how to
stay…fired up!
There’s so much change going on, it can be a challenge to keep
up with it all. But take heart, big changes and challenges are happening everywhere. You’re not alone.
SAR WEBSITE:
www.sacrealtor.org
Stress and burnout are often a result of feeling over-whelmed…
not having enough time or energy to get everything done. When
this happens, every part of your life is affected. Your health, work
life, family life, and social life are challenged. That’s when we
become less productive for starters and can even become physically sick or depressed.
So what’s the solution? Here are three easy but important tips
to get you started and fired up again:
DECIDE. The first step is to decide to have a positive,
fired-up attitude through these overwhelming times. Yes, you can
make that choice. Let it become a habit. Realize that challenge
and change make you grow into a better, wiser, more experienced
person. When we eliminate the fear of failure in our lives, we
can make some powerful decisions. I met Garth Brooks when he
first moved to Nashville. Even after being turned down by every
record label, he stuck by his decision to hang in there no matter
what. That attitude helped make him a superstar.

TO RESTORE BALANCE, RAISE THE BAR
also passed and signed into law.
Not to be outdone, the California
Association of Mortgage Brokers
sponsored and sheparded to enactment AB 790, establishing the
criminality of anyone misrepresenting themselves as a licensed
real estate broker, mortgage broker
or REALTOR®. DRE is expressly
authorized (not required, unfortunately) to revoke the licenses of
violators.
The ‘normal’ real estate market is officially here. My latest
check of the MLS statistics tells me that a single-family residence
in Sacramento County is on the market an average of 51 days before
it sells, up from 19 days during the market frenzy of less than two
years ago. On the positive side, 51 days is not forever, and home
sellers are beginning to realize that this is not the end of the world;
it’s just the end of a remarkable five-year run of double-digit appreciation.
Nervous though we may be growing about world affairs, reasonable people almost everywhere still seem to think that America - and
California in particular - are good investments. As I write this, the
stock market is near a record high, unemployment remains low, and
interest rates are reasonable and flat. Our economy, if not robust,
is at least growing steadily. And Sacramento remains California’s
most affordable metropolitan region in terms of housing, save only
San Bernardino-Riverside. County-wide, resale home prices have
decreased 5 or 6 % from a year ago, after racing up over 100% in
five years. So much for the bursting bubble.
In theory, these new laws will
Leigh Rutledge
increase the foundational knowledge of sales licensees entering the
2006 SAR President
profession, decrease the incidence
of ill-equipped licensees engaging
in licensed activity, and revoke the
licenses of those who deliberately misrepresent their qualifications
or status as a REALTOR®.
As the dust of that frantic five years begins to settle, some concerns about not-so-subtle changes in the marketplace have come to
light. For one, we have far more inexperienced agents and brokers
in the business than ever before. The California Department of Real
Estate’s (DRE’s) statewide tally of licensees now exceeds 510,000.
About 85% of those licensed in the past few years hold conditional
licenses, meaning they have completed exactly one required certification course and promised to complete two more within 18
months.
What remains to be seen is whether DRE’s implementation and
enforcement of these laws will be timely and effective. It is not
particularly reassuring to know that, as I learned just recently, over
half of DRE’s already-overworked staff of 260 is currently eligible
for retirement. Think of the drain of institutional knowledge that
represents, for any organization.
Another C.A.R.-sponsored and REALTOR®-authored bill, AB
1963 that would’ve eliminated the two-years-experience exemption
for real estate broker license applicants with 4-year college degrees
(but no legitimate real estate experience), also made it through the
Legislature. Unfortunately, the Governor vetoed that bill September
29th for reasons not completely clear. Had it passed, no one
would’ve been able to obtain a California brokers license without a
minimum of two years of documented experience in the real estate
business. That was a good idea, and I hope C.A.R. still agrees it’s
worth pursuing in the next Legislative session.
As professional qualifications go, that’s a pretty low bar. And
frankly, the caliber of client service that some of these new agents
were getting away with in the hot market was abysmal. It was only
the easy circumstances of ample capital and low interest rates that
enabled them to stumble through a close at all.
Now the market is tighter, casting a more discerning light on
agents’ (and brokers’) lack of experience and deficient client service. Unprofessional behavior that was only recently considered
inconvenient and annoying to experienced agents is now unacceptable. Everyone needs to pull their own weight, professionally
speaking.
To our credit, and for the long-term
greater good, organized real estate saw
this problem coming and has taken some
timely legislative action to raise the minimum standards for California real estate
professionals. Many of you will agree with
me that this effort comes not a moment
too soon. The changing market and legal
environment demand a higher level of
professionalism, particularly among the
inexperienced and non-REALTORS®.
In early September, Governor Arnold
signed AB 2429, the Real Estate Salesperson
Licensure Act, into law. Sponsored by the
California Association of REALTORS®,
the legislation requires salesperson applicants - after Sept. 31, 2007 - to complete
all three of the Department of Real Estatemandated pre-license courses prior to taking the license examination. A companion
bill (AB 223) requiring licensees to earn
at least three hours of DRE recertification
credit in the area of risk management was
Like it or not, the pendulum is swinging. If we keep our collective balance and focus on improving the future, it won’t knock us
over. Now, go sell a house.

Get Fired Up
Continued from page 1
discover what brings the very best results.
Thomas Edison gave us the light bulb. But
it took thousands of tries before he discovered what worked. Discover all the possibilities that work best for you… on the job,
with your family, getting healthier, improving your technical skills, prioritizing your
life… whatever!
It’s not always easy, but deciding to go
for it in a positive way beats the alternative.
It’s a valuable choice for all of us to make.
A fired-up attitude reduces stress both on
and off the job.
To make everything easier, decide to
spend more time with positive people, read
motivating books, listen to fired-up music,
get your life balanced and lighten up!
We’ve got to stop taking ourselves and our
lives so seriously. Laugh more!
DISCOVER all the possibilities.
After we’ve decided to improve our lives
with a great attitude, then it’s time for the
next step... to discover all the possibilities to
take us to our goal. This helps us to change
effectively. Try out different options to
DEVOTE yourself to hanging in
there while you and the rest of the world
keep changing and moving forward. This is
where the big, valuable stuff really happens.
You can take giant steps forward if you
devote your time and efforts to the important areas that need firing up. Just do a little
at a time! Think like a superstar…no matter
what your goals are. It may seem tempting
and easy to quit, to lower your expectations,
to lose your dreams. But if nothing changes,
then nothing changes! Yep. To get different

results, we HAVE to do something different. NOW is the time. And don’t ever give
up. We need you.
Throwing in the towel just leads to a
bigger pile of laundry!
Remember the 3 D’s: Decide, Discover,
and Devote. That’s really all there is to getting fired up.
I wish you the best on your changing
pathway. You really can get and keep fired
up!

The great news is that the yield on the
10-year Treasury note is at a five-month
low resulting in a decrease in the mortgage
interest rates. Investors are being more
optimistic. This can be attributed to moderating energy prices and the Fed’s decision
to not raise the short-term interest rate last
month.

ETHICS CORNER
CODE OF ETHICS ARTICLE 1
When representing a buyer, seller, landlord, tenant, or other client as an agent,
REALTORS® pledge themselves to protect
and promote the interests of their client.
This obligation to the client is primary, but
it does not relieve REALTORS® of their
obligation to treat all parties honestly.
When serving a buyer, seller, landlord, tenant or other party in a non-agency capacity.
REALTORS® remain obligated to treat all
parties honestly. (Amended 1.01)
CASE INTERPRETATION: Case #110: Obligations Under Exclusive Listing
(Originally Case #7-12. Reaffirmed May,
1988. Transferred to Article 1 November,
1994. Revised November 2001.) (Copywrite
National Association of REALTORS®, Reprinted from
www.realtor.org with permission ).
At the time Client A signed an exclusive
listing agreement with REALTOR® B, they
discussed market conditions and prevailing
prices, and agreed on listing at $156,900.
After six weeks with no apparent interest
in the house, Client A called REALTOR®
B to learn why his property was receiving
scant attention from prospective buyers.
REALTOR® B said, “It’s not hard to diagnose the trouble. Your property is overpriced. That was clear to me by the time we
had it listed for ten days. In this market, it
would take a really interested buyer to go as
high as $149,000 for it. That’s why it hasn’t
been possible for us to push it.” “When you
reached that conclusion, why didn’t you
tell me?” asked Client A. “Because,” said
REALTOR® B, “it wouldn’t have done any
good. I know from experience that sellers
can’t be convinced that they are overpricing
their property until they get tired of waiting
for an offer that will never come. Now that
the market has taught you something that
you would not take as advice, let’s reduce
the price to $148,900 and push it.”
Client A complained about REALTOR®
B to the Board of REALTORS®, detailing these circumstances, strongly insisting
that REALTOR® B had fully agreed with
him on the price at which the property was
originally listed.
Client A reiterated this point strongly at the hearing of his complaint which
was held before a Hearing Panel of the
Board’s Professional Standards Committee.
REALTOR® B did not contest this, taking
the position that at the time of the listing it
was his judgment that a price of $156,900
was fair and obtainable in the market. He
stated that a strong immediate sales effort
had convinced him that the listed price was
excessive, and he defended his action of
reducing his sales effort as he had done in
his discussion with the client. He said that
many years of experience as a broker had
convinced him that once a seller decides on
a definite price for his property, no argument or analysis will shake his insistence on
getting that price; that only inaction in the
market is convincing to the sellers.
The Hearing Panel concluded that
REALTOR® B’s conduct had violated
Article 1 of the Code of Ethics, which
requires REALTORS® to protect and promote their clients’ interests. The panel also
found that since REALTOR® B honestly
felt the original listing price of $156,900
was the fair market value at the time he
listed it, REALTOR® B had not violated the
Code of Ethics by suggesting that the price
be lowered. However, since REALTOR®
B later concluded the property was overpriced, he should have immediately notified
Client A of his conclusion and not waited
for Client A to call him six weeks later.

Masters Club Qualifying Criteria
This is a re-cap of qualification changes for the 2006 application. Residential
category applicants must have a
minimum volume of $5 million in closed escrows, and
the applicant must have a
minimum of eight (8) ends
to qualify. Alternatively, if
the applicant does not have
$5 million volume, but has a
minimum of 30 closed ends,
this qualifies. All sales must
be within California.
Masters Club application is an “individual” process. All MLS transaction credit
(on each end) is either 50% or 100%. No
other divisions take place. Prospector has
been programmed to calculate the credit
and to total the credit according to the
names appearing on the MLS. It is vitally
important that you keep an accounting of
your production. If you are working with
a TEAM, please be sure that the team
member applying for Masters Club is ON
THE MLS printout. If the information
for LISTING AGENT(S) and SELLING
AGENT(S) isn’t correct, then get it corrected as soon as possible.

By Dianna Booher, CSP
Mastering face-to-face, phone, correspondence communications isn’t enough
to master business communications these
days. In this ever-growing computer economy, you have to know how to e-mail.
The average worker gets literally hundreds of these electronic messages a week
from a range of sources for a host of reasons
in a multitude of forms. We’ve all heard the
horror stories. E-mail gets lost, intercepted,
rerouted, and unanswered. The “e” in email may very well stand for exasperating
for all its work and inconvenience, or it may
stand for extraneous for its impersonal yet
never-ending nature.
The same was probably said when the
telephone, fax, and other technologies
arrived on the scene. They are, after
all, merely means of communicating.
Understand them and you relate effectively.
Misunderstand them and get lost. But it can
also stand for exceptional. “E” may also
stand for exceptional if you know how to
effectively use this most popular of mediums.
Ask yourself which e-mail messages do
you ignore, discard, rush through? Know
before you go. This is a most unique communication form and its ease, directness,
speed, and accessibility, it can lead to
E
problems. It’s always good advice to look
“or think” before you leap. Decide if your
message is most suited for e-mail. It could
be a phone call, a personal visit, or a formal
letter would be more appropriate.
Because it is so immediate, it must be
handled with judiciousness. This is especially true of emotional messages. It’s a
good idea to think before you type. It can
save everyone a lot of problems and since it
is as easy to send your message to the entire
universe as to a single member, many do.
Limit your distribution. Who really needs to
receive your message? More isn’t always
better. Sometimes it is less effective and if
you continue to send extraneous messages
to unwanting people, they might not heed
your message when it is pertinent.
Say what you mean. Books use chapters, newspapers use sections, plays break
down into scenes.
Structure your message. Provide easy
access with formatting. People need to
know what’s what in an immediate basis
not once upon a time. If you’ve done your
preparatory work, this should be easy.
Use informative subject lines so readers can determine priority. If you need
action, state it in the subject line. In other
words, make it easy for them to respond.
O E
EVP Exchange
By Nelson Janes,
SAR Executive
Vice President
Especially with multiple readers who may
not all have the same information, it is necessary to bring everyone up to speed.
Use good English. Just because it seems
informal doesn’t mean people don’t care
and aren’t making impressions based on
your work.
Off-beat acronyms. What may make
sense to you may not to others. Remember
that humor or tongue-in-cheek remarks
rarely go over in black and white.
Delete regularly. It’s a discipline.
Some people keep everything they receive.
Information pack rats. If it’s that important,
react to it.
E-mail is here to stay. Master it and use
its ease and speed to your advantage.

Riding the Waves of Change—2006 Business and Technology Expo
“Keep this going every year… great for
business.”
“Love it! I come every year. I am so
proud to be a Member of the Sacramento
Association of REALTORS!”
“Best Tech Faire yet!”
“Thanks so much for a wonderful and
exciting day of fun and learning and valuable ideas.”
These were just a few of the positive
comments we received from this year’s
Business and Technology Expo evaluations. We were thrilled to realize that
over 700 REALTORS® and Affiliates
took advantage of this information-rich
event – and one of the most successful
technology-based conferences available to
REALTORS® in northern California. Expo
Committee Members credited the high
numbers of participants in part to the move
back to the Fair Oaks Presbyterian Church.
This location proved more convenient for
Members working in the northeast areas of
Sacramento as well as for our colleagues in
Placer and El Dorado Counties.
As in years past, the Expo delivered the
resources, networking opportunities and
educational value participants were seeking. Attendees bounced to the medleys of
the Beach Boys and other surfing music,
while learning about the latest real estate
trends and products from 50 diverse vendors. They gained ideas they could imple-

2007 SAR Board of
Director Election a
Success
Taking the leap into the twenty-first
century, SAR decided to try boosting our
number of Member voters by going electronic. We did our research and discovered
that our neighbors at the Placer Association
of REALTORS® had been conducting a
paperless election for a few years, and
found it quite successful. Board Members
and staff reviewed several options and
selected the electronic voting service we
thought was most user-friendly.
It was a risk to move from paper to web,
but one we felt worthy of taking. To our
delight, you agreed. We had our highest
voter response rate in years. If you voted,
we thank you for being part of the process.
Below are the election results.

Public Relations/Community Outreach
Evolving
Organization/Changing
Membership
These are the five categories of Member
service that will be the focus of the 2007
Business Plan. It will detail each area with
action items, deadlines and accountability
to implement the Strategic Plan and to help
move the organization and its Members into
the envisioned future.
Let’s take a brief look now at each of
these categories before detailing them in the
Business Plan.
Government Relations/Political Action
The Team handling this Core Competency
had a number of innovative thoughts to add
to the Business Plan:
•
•
•
•
Increase attendance at C.A.R.’s
Legislative Day by combining their
Tech Day begun in 2006 with our longstanding Tech Faire
Strive for a larger percentage of the
Membership contributing to the PAC
Start a Government Advocacy training
program
Continue legislative tracking and
alerts
IV. Internal & External Relations
• Increase communication to the
Membership of successful public relations and government relations outcomes
• Consider publishing an Annual Report
• Publish Public Advocacy/Political
Action Reports
• Communicate the value of Membership
through publications and office visits
• Establish an Ambassador program similar to that of the Sacramento Metro
Chamber
Association of the Future
Characteristics of an Association of the
Future were ranked by teams within the
Committee with the following consensus
ranking:
1. Promote the highest levels of professionalism
2. Set and enforce business rules
3. Provide business and technology tools
to the Membership
4. Influence public policy
5. Become the trusted source of real estate
information
Discussions at both the Committee and
Staff sessions stressed…
• Communicate what the Association
does and stands for to the Membership
and consumers who benefit from its
activities
• Educate Members and consumers;
institute a broad mentoring program
for new agents; work towards more
diversity in the leadership; support and
expand the Internship Program and real
estate courses at local colleges
• Trust…promote it so that REALTORS®
and the Association are seen as reliable
sources of service and knowledge
Core Competencies
The Committee’s next task was to look
at broad categories of service that the
Association provides its Members to help
carry them into the envisioned future. After
review and discussion, the five existing Core
Competencies were retained:
•
•
•
Government Relations/Political Action
Professional Standards/Behavior
Education
12 Sacramento REALTOR® • October 2006
Professional Standards/Behavior
This team made several recommendations
to reach the Association’s primary focus on
professionalism and ethical behavior
•
•
•
•
•
•
•
•
More forward thinking electives such
as the technology module of the CRS
designation program
Bring the CIPS (Certified International
Property Specialist) course to
Sacramento
Provide a local program similar to
C.A.R.’s “Agent QuickStart”
Develop technology training program
similar to RETI covering the following
topics…
• IDS and Generating leads
• Blogs and podcasting
Institute tougher consequences for violating the Code of Ethics and MetroList
Rules, including…
Raise fines
Publish names
Institute the Quality Service Certificate
in Sacramento in conjunction with
C.A.R.
Design a simpler complaint process
Publicize the Ombudsman program to
generate wider use
Education
SAR’s education program is considered a
strength of the Association. Suggestions of
this team included:
•
•
• Call capture systems
• Website basics and domain names
• Technology to market listings (property sites and domain names)
• Technology to market to buyers
(IDX, call capture, niche marketing)
• Smart phones and how to use them
Community Outreach/External-Internal
Public Relations
Each team contributed to this Competency
with fresh ideas:
•
•
•
Establish a Young REALTOR® Club
Establish an Ambassador program to
reach out to Brokers and Managers
Place an article or Q&A by the President
in the local press as a regular monthly
feature

Many homebuyers have recently purchased with no money down, interest only
loans, while others have refinanced out
their equity. As the housing market slows
some of these homeowners may be forced
to sell (lost job, divorce, death, illness) and
find they are “upside down or underwater”
meaning loan balances and seller’s closing costs exceed the current value of the
home. This how-to-seminar discusses the
economic and income tax aspect of these
types of transactions and presents a step-bystep procedure for listing agents who must
negotiate a short sale with lenders on behalf
of their upside down sellers.
Topics
§ If a seller owes more than what the
home is worth, which is the best
way to go? Add cash? Short sale?
Foreclosure? Pros & Cons of each.
