Project Director, National Highway Authority of India, 5/7 Trikuta Nagar,
Jammu vide his letter No.PD/JMU/11012/LA/7843 dated 08-05-2008 has placed
an indent for the acquisition of land measuring 802 Kanal & 08 Marla situated in
village Ban, Tehsil and District, Jammu.
Consequent upon the placement of an indent and authentication of
revenue documents by the Indenting Department, Notification under section 4 (I)
of the Land Acquisition Act Svt, 1990 was issued vide this office endorsement
No.DCJ/ADC/08-09/90-94 dated 27-05-2008 for 802 Kanal & 08 Marla of land
situated in village Ban. Tehsil and District, Jammu and objections were called
upon from the land owners/interested persons within a period of 15 days from

Some land owners filed objections that their land measuring 01 Kanal &
Marla under Khasra No.131 Min situated in the said village is also coming
under the widening of the National Highway. Report in this regard was called
from Tehsildar, Jammu and accordingly corrigendum to the effect for 01 kanal 15
marla land was issued vide this office endorsement No.DCJ/LA/ACR/200809/157-09/157-60 dated 22-08-2008. In this way the total land under acquisition
came to 804 Kanal & 03 Marla instead of 802 Kanal & 08 Marla situated in village
Ban, Tehsil and District, Jammu.

The case was submitted to the office of worthy Financial Commissioner
(Revenue) J&K Government, Srinagar who vide his office letter No.FC-LA/LA2974/08 dated 15-12-2008 has directed this office to obtain NOC from the Auqaf
Islamia, Dharamarth Trust, Forest & PWD before submitting the case to this
office. As some Auqaf land of graveyard is also coming under the instant
acquisition, therefore, the matter was taken up with the Project Director, National
Highway Authority of India, 5/7 Trikuta Nagar, Jammu with a copy of the same to
the Administrator, Waqaf Property, Jammu for issuance of NOC in respect of
Waqaf land.
However, the Project Director, National Highway Authority of India, 5/7
Trikuta Nagar, Jammu vide his letter No.PD/JMU/11012/LA/10649 dated 04-112010 intimated that the existing National Highway is already bisecting the
graveyard and change of alignment in nearby vicinity is not possible due to
topographical/technical constraints and it was finally decided to adopt eccentric
widening (LHS) in graveyard influenced area with restricted ROW 45 M instead
of 60 M.
Subsequently, in reference to this office communication Administrator
Auqaf Islamia, Jammu vide his letter No.AIJ/02/5206 dated 24-07-2009 intimated
that 4 Kanal & 02 Marla of Waqaf land is a live graveyard used by the Muslim
Community and the religious sentiments of the people are attached with it. So he
requested that the alignment of the National Highway in village Ban, Tehsil and
District, Jammu may be changed. The matter was taken up with the
Administrator Auqaf Islamia, Jammu from time to time and a detailed letter was
sent to him vide this office No.DCJ/LA/Ban/2010-11/14-16 dated 24-12-2010,
whereunder a copy of letter of Project Director, National Highway Authority of
India, 5/7 Trikuta Nagar, Jammu was sent to him with the request to issue NOC
of Auqaf land. Consequently the Administrator, Auqaf Islamia, Jammu vide his
letter No.AIJ/02/5206/165-68 dated 15-01-2011 issued NOC for Waqaf land
coming under the widening of said road in village Ban, Tehsil and District,
Jammu. However, he has also requested that compensation and rent on the
prevailing market rate be paid to Waqaf Islamia, Jammu.

During spot visit by the then Collector Land Acquisition, Assistant
Commissioner (Rev), Jammu, it was brought to his notice that ten (10) Marla of
land under Khasra No.792 Min in village Ban is under the occupation of Army.
The revenue documents of the said land were got prepared through Tehsildar,
Jammu and matter was taken up with the Defence Estates Officer, Udhampur
vide this office No.DCJ/LHS/Army/90-Misc dated 07-01-2011 with the request
that land in question is coming under the widening of National Highway, so the
same be got de-requisitioned.
The issue of land under the possession of Army was discussed in detail in
a meeting convened by the worthy Financial Commissioner (Revenue) J&K
Government, Jammu in his office on 26-02-2011 to review the land acquisition
cases of National Highway. The meeting was attended by the Divisional
Commissioner, Jammu, Deputy Commissioner, Jammu, Project Director,
National Highway Authority of India and other concerned officers. In the meeting
it was unanimously decided that said land be de-notified from the instant
acquisition as the de-requisition process of land under the possession of Army is
very lengthy and it will take much time. Therefore, 10 Marla of land falling under
Khasra No.792 Min at village Ban coming under the National Highway has been
de-notified vide this office endorsement No.LA/ACR/NHAI/Ban/2010-11/1366-70
dated 11-03-2011, to expedite the process of acquisition of remaining land under
the instant acquisition.
The Tehsildar, Jammu vide his letter No.Nil dated 01-01-2010 has
intimated the average sale rate of land for the last three years as Rs.29,240/- per
kanal.
The duly notified relevant Stamp Duty Rates by the Divisional
Commissioner, Jammu for the village Ban, Tehsil and District, Jammu are as

The then Collector Land Acquisition visited the spot and found that most of
the land is un-cultivable and Gair Mumkin. Therefore, he has proposed a rate of
Rs.1.50 lac (Rupees One lac and fifty thousand only). This case was placed
before the Committee of Collectors in their meeting held on 28-02-2011. The
Committee after much deliberation has approved a rate of Rs.1.25 lacs per
kanal. Thus, the amount of compensation of 803 kanal & 13 Marla of land comes
to Rs.11,55,24,687/- i.e. Compensation Rs.10,04,56,250/- and 15% Jabrana
Rs.1.50,68,437/-.

As intimated by the Tehsildar, Jammu vide his letter No.11083/0Q dated
15-01-2011, twenty one (21) structures are also coming under the instant
acquisition. This list of structures has also been sent to the Superintending
Engineer, PWD (R&B), Jammu vide this office letter No.LA/ACR/NHAI/201011/1119-21 dated 17-01-2011 for assessment of cost of structures.
It may not be out of place to mention here that instant land acquisition is of
urgent nature, and involve huge quantum of land measuring 803 Kanal & 13
Marla. Since, the amount of compensation involved in the said acquisition is
more than Rs.11,55,688/- for which the pecuniary Powers for declaration under
section 6, 7 & 17 of the Land Acquisition Act lies with the Revenue Department
J&K Government. Therefore, the case was submitted to the Deputy
Commissioner, Jammu vide this office No.LA/ACR/NHAI/Ban.2010-11.1391
dated 17-03-2011 for the issuance of Notification under section 6, 7 & 17 of the
Land Acquisition Act Svt, 1990 from the Revenue Department J&K Government
who further submitted the case to the worthy Divisional Commissioner, Jammu
vide his letter No.DCJ/LA/NHAI/Ban/2010-11/1473-76 dated 31-03-2011 for
favour of further necessary action.
The Commissioner/Secretary to Government, Revenue Department,
Srinagar issued declarations under section 6, 7 & 17 of the Land Acquisition Act
Svt, 1990 vide Notification No.30-RD of 2011 dated 17-06-2011 thereby
declaring that the land is required for aforementioned public purpose and
directing this Collectorate to take order for further acquisition of land of which
specifications are given above.
In compliance to aforesaid directions of Revenue Department J&K
Government. Notification under section 9 & 9-A of the Land Acquisition Act Svt,
1990 vide this office endorsement No.LA/ACR/NHAI/Ban/2011-12/495-501 dated
09-08-2011 and objections from the land owners/interested persons were called
upon within 15 days with regard to measurement of land, claim to compensation,
etc. But no objection was received from the land owners/interested persons
within time frame. However, later on, one person namely Sh.Sham Singh S/o
Balak Ram R/o Ban, Tehsil and District, Jammu has submitted an application to
this office with the request that his land measuring 01 Kanal & 15 Marla is under
Khasra No.131 Min, whereas in the notification Khasra No.792-Min has been
mentioned. Accordingly, the matter was brought to the notice of higher authorities
vide this office letter No.DCJ/ACR/NHAI/2011-12/867-71 dated 24-11-2011 for
necessary correction of Khasra No.131-Min instead of Khasra No.792-Min. The
Commissioner/Secretary to Government, Revenue Department, J&K issued
corrigendum accordingly vide endorsement No.Rev/LAJ/31/2011 dated 06-032012.

Now therefore, I, Dr.Tahir Firdoos, KAS, Collector Land Acquisition,
Assistant Commissioner (Rev), Jammu hereby issue the Final Award amounting
to Rs.12,71,83,635/- (Rupees twelve crore seventy one lac eighty three thousand
six hundred & thirty five only) for 803 Kanal 13 Marla of land including cost of
structures under the alignment of widening/four laning of National Highway
situated at village Ban, Tehsil Jammu now Nagrota District Jammu.
The Notices under section 12 (2) of the Land Acquisition Act Svt 1990
shall be issued to the land owners/interest persons through Tehsildar Nagrota
accordingly.
It is also certified that payment of compensation shall be made keeping in
view the guidelines issued by the Administrative Department under LB-10 of
1980 and Agrarian Reforms Act 1976. Moreover, no payment shall be made if
the land escheats/escheated to the state under the Agrarian eforms Act.
