Notice to All RAHB MLS ® System Users

RE: New MLS ® Remediation Policy re: Unauthorized
Access and Use of the Associations MLS ® System
On December 9, 2011 all RAHB MLS®
system users were advised RAHB had
activated the remediation dashboard
for Scout SAFEMLS. Since activating the
remediation it has been discovered there
are many shared accounts among our
membership, as well as suspect accounts.
Beginning April 2, 2012, we will
begin investigating member accounts
which have been flagged as shared
or suspected of being shared.
If you believe you may be one of the users
who is sharing or suspected of sharing
your User ID and password, please consider
the RAHB Rules and Regulations, Section
7 MLS® Data and Other Board Publications (see below) before allowing anyone
to access the Association’s MLS® system
using your codes. You are reminded that
if anyone is found to be in breach of these
Rules, “such Member’s access to the Association’s MLS® System shall be immediately
suspended pending investigation by the
Association” (section 7.11).

Regulations:

SECTION 7 – MLS® DATA AND
OTHER BOARD PUBLICATIONS
Access
7.06 Personal computer access codes, log-on account number and/or passwords issued to a Member in
order to provide access to the
Association’s MLS® System or the MLS® Data contained therein and/
or other Association information and services (collectively, the “Access Codes”) are for the Member’s sole
and exclusive use and their sale to, distribution or disclosure to, or use
by, any other person is prohibited.
7.07Any computer software or hardware
provided by the Association to any Member to access the Association’s
MLS® System and the MLS® Data contained therein and/or other
Association information (regardless
of whether such software or hard-
ware is provided with or without
a cost to the Member) (collectively, the “Access Program”) are for the Member’s sole and exclusive use
and their sale to, distribution or disclosure to, or use by, any other person is prohibited.
7.08 Personal computer access codes
are the sole responsibility of the Member and disclosure to anyone
is prohibited.
7.09 The Member who is the Broker of Record of each Brokerage shall ensure
that any individual who has been provided with Access Codes and/or
Access Programs complies with the Association’s Bylaws and these Rules
while Employed (as defined in the
Association’s Bylaw) by such Brokerage.
7.10 The Broker of Record of each Bro-
kerage shall notify the Association
within forty eight (48) hours after any individual who has been
provided with Access Codes and/or
Access Programs ceases to be
Employed by the Brokerage.
Remedies
7.11Any theft, sabotage, unauthorized use of, or unauthorized access to the Association’s MLS® System or
the MLS® Data constitutes a breach of these Rules and shall be dealt with
in accordance with the provisions of the Association’s Bylaws. Notwith-
standing any sanctions or penalties
imposed by the Association, the Association reserves the right to
seek any and all redress and

remedies available to it in a civil action against the unauthorized person (whether such person is a Member or non-Member) and/or any Member permitting the
unauthorized access or to unauthorized use of the Association’s MLS® System or
the MLS® Data contained therein by an
unauthorized person. In the event it is
discovered there is a breach of these Rules by a Member, such Member’s access to
the Association’s MLS® System shall be
immediately suspended pending
investigation by the Association.
7.12 In addition to the Association’s rights and
remedies set out in Sub-section 7.11, the Association reserves the right to
immediately terminate a Brokerage’s or
an individual Member’s Access Codes and/or Access Programs, without notice,
in the event of any unauthorized use of,
or granting unauthorized access to, the Association’s MLS® System or any MLS®
Data contained therein or any other breach of the provisions of this Section 7.

Attention all rental property
owners and managers!

OREA

Marijuana Grow Operations Registry
Prior to the election, the Provincial Advisory Group (PAG) on Marijuana Grow Operations and Clandestine
Laboratories, of which OREA is a member, made a recommendation to the Minister of Community Safety
and Correctional Services to create a registry of
former marijuana grow operations.
In December 2011, the RCMP announced the creation of a national registry of former marijuana
grow operations. Unfortunately, due to the limited jurisdictional coverage of the RCMP in Ontario, the registry shows only two properties in the province. OREA is hopeful that the provincial government will
regard the RCMP registry as an impetus to forge ahead with their own registry.
OREA has met the new Minister of Community Safety
and Correctional Services (Honourable Madeleine Meilleur) to discuss PAG’s recommendation to create a registry. In the meeting, ministry staff indicated that they are still reviewing PAG’s recommendations.
However, the Minister expressed support for
consumers who want to know if their prospective home purchase was a former grow op.

Electronic Signatures
OREA received the latest update from the Ministry of
the Attorney General in September, 2011. Andrea Strom (Director, Justice Policy Development Branch)
informed OREA that the Uniform Law Conference has
agreed to amend the Uniform Electronic Commerce Act to delete the current exemption for real property transactions and that the Ministry was considering
following suit. The Uniform Electronic Commerce Act is an international document that forms the basis of our provincial legislation.
The Attorney General has invited OREA to meet with his staff to discuss the proposal in more detail.

Personal Real Estate Corporations
The Hamilton and District Apartment Association
(HDAA) will be holding their annual trade show
on Wednesday, March 28 at Michelangelo Banquet
Centre. The show runs from 6:30 – 9 p.m. and
is FREE.
Every property owner or manager should come to
this event to:
•get up-to-date on the newest products;
•find out about services and discounts from
local providers; and
•learn about the HDAA and meet its members.

Ministry staff indicated that the issue of personal
real estate corporations is well known within the government. However, ministry staff have received
no direction from the Minister’s office to look further
into the matter.
OREA requested and the Minister has agreed to a meeting to discuss the issue of personal real estate corporations and the Real Estate and Business Brokers Act (REBBA), 2002 reform. OREA and ministerial staff are currently working on a date.

Lock box codes
made easy
B
obby Broker was a successful broker. He was
tops in sales in his brokerage and he was
pretty sure he was close to being the top salesperson in
his market area – his signs were everywhere. He was
personable, he was businesslike, he was a sharp dresser
and drove an expensive car. Bobby oozed success.
Bobby had a fantastic memory for faces and names;
that was part of what made him so good at his
profession. He could remember clients from way
back and greet them by name when he met them in
the grocery store. Bobby’s memory was not, however,
very good with numbers. He could barely remember
his PIN number for his bank card and he had to write
down his pass codes for almost everything else.
When it came to setting combinations for lockboxes,
Bobby had a problem. He had picked up a number
of push button lock boxes from different salespeople
who left the business, so he had plenty of lockboxes
to go around. He also had a few of the dial-type
lockboxes. The problem was that he wasn’t very
good at setting the codes for the lockboxes and then
remembering them. Names and faces he could
remember; codes and passwords … not so much.
Bobby hit on a great idea. He decided to use the
same code for every lockbox and, what was even better,
he’d make it as easy as A-B-C and 1-2-3 – he surely
wouldn’t forget those codes. And they were so simple
that anyone else would remember them too, so he was
making it easy for his office staff and other REALTORS®.

Highlights from RAHB town hall meetings

AHB President Cameron Nolan, President-Elect
Bruce Moran and CEO Ross Godsoe went on the road
February 16 and 17 to meet with members at town hall
meetings in Burlington, Ancaster and Binbrook.
The purpose of the meetings was to update members on the
RAHB building, Fusion/MLXchange, Board Governance, the
CREA DDF, the CREA Home Price Index (HPI), CREA Futures
(page 7) and the RAHB strategic plan and to receive member
feedback on these and other issues such as electronic lock
boxes. Seventy-five members attended the meetings.

What is HPI?
he Home Price Index, or HPI, is the
most accurate way to identify trends
in the real estate market. Developed by
CREA in association with the Vancouver,
Fraser Valley,Calgary, Toronto and Montreal
real estate associations, the HPI measures
Canadian home prices based on quantitative
housing features such as number of rooms,
number of bathrooms, living area, age of
home, and qualitative housing features,
such as finished basement, new or resale,
proximity to schools, golf courses, etc.
The HPI is comparable to the Consumer
Price Index (CPI), but for homes.
Instead of using actual sale prices of particular
kinds of homes and comparing them to the
previous month or previous year, the HPI
establishes a benchmark of an “average”
property – one that doesn’t really exist – in
a particular area and of a particular property
type, and then shows how that benchmark
moves up or down according to market
activity. HPI is not a report of actual sale
price; it is a report on what can statistically
be called an average property and how it
performed in the last month, year or
multiple years.
When the benchmark for a two-storey home
is 100 and, say, a two-storey home is valued
at 123 in 2011, it means that a typical twostorey home for the area has risen 23% since
2005 (the year CREA is using as its benchmark). HPI will also provide an average
house price that reflects that percentage rise.
With the HPI, the effects of swings in the
market place – a large number of sales of
high- or low-end homes, for instance – will
no longer affect the average sale price and
that is what makes HPI such a valuable tool.

CREA looks to the future
EALTORS® across Canada were asked the question: Given future consumer expectations,
what is the role of the REALTOR® in 5 to 10 years
and what will be the implications for organized
real estate? The answer may surprise you. The
key message that came back is that organized real
estate has to move from being REALTOR® centric
to consumer centric.
But what does that mean?
The market place has become very consumer
oriented and consumer conscious. REALTORS®
serve the public and need to have the tools to
properly do their jobs. It follows that real estate
boards and associations need to understand what
consumers want and need so they can provide
their members – REALTORS® - with the information
and services that will help them serve their buyers
and sellers.

have accepted the resignation of
Jenny Pearce (Judy Marsales Real Estate
Ltd.) as 2012 RCC Chair. As per RAHB Article 7,
Section 18.10, Chair-Elect Hank Balfoort (Chase Realty
Inc.) has assumed the duties of the 2012 RCC Chair;
Chris Allen (Royal Lepage State Realty) was elected as
new 2012 RCC Chair-Elect.
Best wishes and sincere thanks are extended to Jenny for
her dedication and contributions.

As a way of putting a face to a name, we will be introducing all RAHB staff over the next few months and telling you
a bit about what they do.
Trish Hlohinec
Trish is the newest staff member
at RAHB. She provides MLS®
support, which means she
enters listings, amendments
and revisions; takes phone
enquiries from members about
MLS® listings; handles interboard listings; answers questions
about MLS® Rules and Regulations, MLS® policies
and REALTOR.ca and follows up on and corrects
errors reported on data uploaded to CREA.
Trish began her career at RAHB by filling a maternity
leave in Print Services. After that position came to
an end, Trish switched gears and moved into the
MLS® department and has been there for the last
ten months. Trish also covers the lunch hour in
the Realty Shoppe and occasionally relieves in
reception. As Trish notes, she’s everywhere!
Angela McArthur

Angela wears many hats as
RAHB’s Education/Professional
Standards Coordinator. In her
role as Education Coordinator
she acts as staff liaison to the
Professional Development
Committee, processes course
registrations, assists members
with their education questions and makes arrangements for speakers for MCE credit courses. In her
role as Professional Standards Coordinator, she is
staff liaison to the Professional Standards Committee, handles all member and consumer complaints,
prepares documentation required for the complaint
process and sets up discipline hearings. She also
handles arbitration enquiries and sets up arbitration
hearings. If that wasn’t enough, she also acts as
back-up support for the membership department.

Angela started at RAHB doing part-time reception
and part-time listing processing before she moved
to work only in the MLS® department. She moved
through several departments and held different
positions – sometimes simultaneously – until she
arrived at her current position in 2008. Angela
recently reached the 25-year milestone with RAHB
and received her 25-year long service pin at the
President’s Gala in January.
With such a broad background and wide range of
responsibilities, Angela says there is never a dull
moment at RAHB.
