Mladen Bandov is an environmental engineer from San Luis Obispo. His focus is on water recycling systems such as graywater treatment, rainwater harvesting, and alternative
onsite wastewater treatment systems for residential and commercial projects. With ten
years of experience in bioremediation technologies and wastewater treatment systems, he
designs water recycling solutions for architects, engineers, contractors and homeowners.

reen industry professionals who want to make a
lasting impact on the future of
their industry are encouraged
to establish a Legacy Fund with
CLCA’s Landscape Educational
Advancement Foundation
(LEAF).
The Benefits of a Legacy Fund
Many donors find their
philanthropic wishes can be
met by establishing a Legacy
Fund through LEAF. Legacy
Funds are permanent funds
from which only the income is
used. The annual investment
income, or interest, is used for
the purpose designated by the
donor. Additional gifts may be
made to the fund to increase the
principal and thereby increase
the annual investment income or
as a one-time pass-through donation. Legacy Funds represent
rewarding gift opportunities
because they offer the donor the
satisfaction of knowing that his
or her gift will continue working
for future generations.
How a Legacy Fund is
Established
The Legacy Fund may be
established with a contribution
in the form of cash, appreciated
securities or other charitable
gifts such as a bequest. The
fund is invested by LEAF, which
serves as a steward of the Legacy
Funds. The Foundation is a nonprofit, 501(c)(3) organization.
Contributions to LEAF are taxdeductible as allowable by law.
The Purposes of a Legacy
Fund
With the assistance of LEAF,
donors can specify the details of
the fund’s objectives. The following ideas are a sampling of what
a Legacy Fund can accomplish to
enhance educational excellence.
Income from Legacy Funds will
enable LEAF to support
undergraduate scholarships, graduate student
fellow-ships, professorships, chairs and promising research. Funds
range from $5,000 to
any amount established
by the donor:
• An annual
student scholarship to
financially assist those students
attending a particular program
• A multi-year award for
distinguished students
• Provide funds for faculty
development to aid the scholarly, professional and personal
growth of horticultural faculty
at the educational facility of the
donor's choice
• Create a faculty recognition
award to acknowledge the contributions of an outstanding faculty member at any institution
• Establish a fund for a
distinguished visiting scholar
that finances the annual cost of
a visiting scholar in an academic
field
• A fund to support a specific
campus, academic department,
program, equipment or service
• Create a fund to support
an annual conference or lecture
series
• A fund to provide additional resources for horticultural
libraries

New Law Clarifies that
Home Improvement
Construction Managers
Must be Licensed
G
ov. Jerry Brown last month
signed a measure clarifying
that “consultants” who provide
certain construction management
services for the home improvement market are contractors and
therefore must be licensed.
CLCA supported this legislation, Assembly Bill 2237, which
was authored by Assemblymember
Bill Monning (D-Santa Cruz) and
sponsored by the Contractors
State License Board.
Previous law defined a contractor to include a “consultant” who
offered to construct a building
or home improvement project.
However, in 2009 an appellate
court decision found that someone
overseeing a contract between a
project owner and a contractor
was not required to be licensed as
a contractor. Then, more recently,
an unlicensed contractor facing
criminal prosecution for engaging in the business of a contractor
without a license claimed to be a
project coordinator. Even though
this contractor was not overseeing
a contract between an owner and
a licensed contractor, the defense
strategy resulted in a plea bargain
that dismissed the charge for
contracting without a license.
The CSLB sponsored AB
2237 to protect the public from
persons presenting themselves as
“consultants,” but actually acting
in the capacity of a contractor by
scheduling subcontractors and
exercising responsibility for the
construction project. Specifically,
the new law clarifies that “consultants” are individuals other
than public agencies or owners
who provide or oversee a bid for a
home improvement construction
project or who arrange for and set
up work schedules for contractors
and subcontractors and maintain
oversight of a home improvement
construction project.
AB 2237 goes into effect on
January 1, 2013.

inventor, Blair Shurtleff, there
has not been a new olive tree to

as drought tolerant, multi or
single trunk, beautiful bark,
able to withstand temperatures
of extreme highs (100-120) and

The Inventor
Shurtleff, a horticulturalist and the inventor of this
phenomenal weeping olive was
a California Polytechnic State
University (San Luis Obispo),
Ornamental Horticulture/Fruit
Science major in the 70’s and
is a long time resident of SLO
County.

It weeps: Long, flexible weeping habit with 6’ (when mature)

Why Is This New Olive Tree
The Most Exciting Tree To
Next to no leaf drop: Very few
leaves ever drop from this tree.
There is next to no clean up. This
is also excellent for landscape
plants in fire prone areas.
The leaf color: The Western
Weeping Olive Tree leaf has a
deep, dark green and SMOOTH
top side with the soft grey ‘olive
color’ underside. It will shimmer
in the wind.
The leaf size: Over twice the
leaf size of all other olive trees.
Fruitless: All of the Western
Weeping Olive Trees set no olives
but a rare few set some ‘shot
berries,’ a very immature fruit
that never matures or drops on
the ground, dry, so no hazards or
mess! This is the only fruitless
olive under patent in the world.

Care: The olive requires little
care and can be left natural for

in zones 8-11.

operation and maintenance.
The Rain Bird Factory Trained
Program is designed to help
contractors build their skills and
open up new opportunities. “Contractors who participate
in our Factory Trained Program
receive high-level and in-depth
training on central control
system features and installation best practices,” said Robert

resources. The Factory Trained
Technician courses hone the
skills of maintenance professionals who are in charge of

earn multiple designations, and
ultimately to develop the skills
and expertise to offer their
