Scott Henninger Project Planner Date: December 18, 2012 Application: Houston Levee Business Center, Area 1—Sunrise Chevrolet Buick GMC; Site Plan Modification/Exterior Alterations Please find below the staff comments and the summary of the next steps needed for the above-mentioned application revisions received December 4, 2012. The submittal does not meet the requirements of the Design Guidelines and needs further revision. A copy of the Design Guideline pages is attached. Planning: 1. The franchise design shall be modified to meet our local design standards (see attached excerpt from Ch. IV, C., 1.). 2. Staff believes that the entry portal is not signage as defined by the Sign Ordinance (§ 151.170 - § 151.183), and thusly is part of the building and governed by the Design Guidelines. If the blue entry portal were to be considered signage it would exceed the maximum allowable area of 200 sq. ft. per frontage of building. Bright Blue and Bright White ACM Panels do not meet the intent of the Design Guidelines (Ch. IV, C., 5.). Bright Colors are discouraged and should only be used in limited quantities; muted earth tone colors are encouraged by the guidelines and staff suggests using either black or dark gray shown on your sample board as an alternative (see attached). Attached are examples showing how other dealerships and buildings with ACM have met the design standards. 3. The Highly Polished Aluminum ACM Panel (G-ACM4) is a highly reflective material and is not permitted by the Design Guidelines (Ch. IV, C., 5.). Use another material which is low luster. 4. The elevations for the Showroom and Service Center indicate that the walls including masonry will be painted white or gray. Regarding use of white, the Design Guidelines (Ch. IV, C., 5.) state “avoid white by using cream colors”. The CUP conditions in the Zoning Ordinance also preclude bright white. 5. The automotive dealership use for Bill Heard Chevrolet (later converted to Sunrise) was approved as a Conditional Use Permit (CUP) in 1998 by the Collierville Board of Zoning Appeals (BZA), as the use was allowed by CUP in the SCC zoning district as referenced in the Houston Levee Business Center Planned Development. The Town later (in 2000) removed the use “automotive dealership” from the use table for SCC, and then added special CUP conditions/design criteria (see attached) for new auto dealerships. For these reasons, the Town views the Sunrise automotive dealership use (and its site and structures) as legally nonconforming. Within this context, staff interprets that changes to the site must (at a minimum) keep the site consistent with the 2000 approved site, and new alterations must not make the site or building additionally nonconforming when compared to the CUP standards of 2012 in §151.024 (J). Specifically, this means with your application: continue utilizing “subdued and muted earth tone colors per the Design Guidelines” and not adding colors (bright white, royal blue) that replace existing materials/colors with nonconforming ones; not increasing the amount of glazed area (glass) beyond what exists currently; keeping a similar architectural style to surrounding commercial buildings; not decreasing the amount of brick veneer (excluding the glazed areas); keeping the comparable materials to the front facade on all sides visible from the public right-of-way; and not reducing the width of existing landscaped buffer areas along the perimeter. Additionally, new fencing shall consist of solid masonry or masonry/brick columns and ornamental wrought iron, no chain link fencing shall be permitted, elevated display platforms for automobiles shall not be permitted, and outdoor loudspeakers shall not be permitted. Engineering: No Comments at this time. Codes: No Comments at this time. Next Steps: Revise Plans: To receive a Notice to Proceed for building permits, submit 3 sets of plans for review, revise to meet the staff’s comments. Submit Sign Permit Applications: Separate sign permit applications are required to be submitted for any changes to signage. Brand color could be approved on signage as long as the color is not internally lit. Keep in mind maximum of 200 sq. ft. per wall frontage aggregate signage allowed. Appeal of Administrative Decisions: If you disagree with an administrative decision related to the staff’s interpretation of the Design Guidelines (architectural design, materials, colors, landscaping, screening), the applicant has the means to appeal the administrative decision to the Design Review Commission. If the applicant chooses to appeal the decision, a formal appeal application must be filed by December 21, 2012 in order to be put on the January 10, 2013 DRC meeting agenda. The applicant has the ability to appeal the DRC’s decision to the Board of Mayor and Aldermen for review. The Board of Mayor and Aldermen is the last means of appeal. If there is a disagreement with a provision of the Zoning Ordinance (signage, lighting, CUP conditions, etc), the appeal process is to the Board of Zoning Appeals (BZA). If an appeal to the BZA is planned, the deadline is December 26, 2012 for the January 24, 2013 BZA meeting. The BZA’s decision is final. Construction Plan Review: Before permits can be issued for new construction, plans must be reviewed and approved by the Codes Enforcement Division (901-457-2310); which is open Monday through Friday from 7am-4pm. The Codes Enforcement Division is responsible for the administration and implementation of the Town's adopted construction codes, Zoning Ordinance, and Town Code. Certified plan examiners and inspectors monitor the design and construction of all structures to insure the built environment meets design standards for life safety and property protection. Related to Final Site Plans, the following are the most important to things to note about the construction plan review phase: This phase can begin before the Final Site Plan is completed; as the Codes Division will provide a non-binding courtesy review of construction plans to expedite the permitting process. The Codes Division will insure that the construction plans match the Final Site Plan (building placement, architecture, lighting, etc). A Preconstruction Meeting must occur before a Building Permit is issued. Certain building permits and plan review fees will be applicable at that point and are in addition to the Site Plan review fees paid earlier in the process. (1) Front faades of buildings shall: (a) Be of similar architectural style to surrounding commercial buildings; (b) Contain no more than 50% glass (i.e., glazed area); (c) Minimum of a two-foot tall masonry base/bulkhead or decorative wood panels, or DRC approved equivalent provided; and (d) Utilize subdued and muted earth tone colors per the Design Guidelines; and (e) Be predominantly comprised of brick veneer (excluding the glazed areas). Trim and accent materials other than brick may be approved by the Design Review Commission (DRC) on a caseby- case basis as regulated by the Design Guidelines. (2) Comparable materials to the front faade shall be installed on all sides visible from the public right-of-way. (3) A landscape buffer shall be provided in accordance with the Design Standards Manual along the front property and shall be 40 feet in width for arterial streets and 30 feet in width for all other types of streets. The landscape buffer shall include undulating berms that are one to two feet in height and shall be supplemental with clusters of shrubs and the planting of ornamental trees 20 feet on center or in clusters or groupings and also street trees planted 40 feet on center in a straight line or staggered pattern. (4) Elevated display platforms for automobiles shall not be permitted. (5) A minimum 20-foot wide landscape buffer shall be installed along all side and rear property lines. Within the landscape buffer shall be undulating berms one to two feet in height supplemented with clusters of evergreen shrubbery and trees planted along all side and rear yards. If the enclosed parking area is completely enclosed in a solid masonry fence, the landscape buffer may be reduced to ten feet and shall be supplemented with the planting of deciduous and evergreen trees distributed along the perimeter of the fencing. (6) Fenced areas shall be limited to areas in the rear yard, as defined by the Zoning Code. Fencing shall consist of solid masonry or masonry/brick columns and ornamental wrought iron. The columns shall be installed a minimum of 50 feet on center. No chain link fencing shall be permitted.
