On Tuesday the Spearfish Food Pantry board of directors announced that they have been given a 30-day notice to vacate their existing space near the Prairie Hills Transit bus barn on Colorado Boulevard. The food pantry has until Sept. 30 to find a new location. The Spearfish Food Pantry, which has been in its current location since 2003, leases the space from Prairie Hills Transit. See story on Page 3 See story on Page 26 PIERRE — The motions hearing that was set for Friday, Sept. 11, has been postponed in Trucano, et al. v. Nelson, more commonly known as the smoking-vote case. No new date has been set yet by Circuit Judge Kathleen Trandahl. One of the key issues that is up for hearing is whether Jennifer Stalley and the American Cancer Society can intervene in the lawsuit brought by Mike Trucano of Deadwood and three other businessmen against Secretary of State Chris Nelson. Another issue up for hearing is whether scientific evidence regarding smoking can be part of the trial. The third motion is the businessmen's motion for summary judgment, which if granted would eliminate the need for the trial. Trucano's group is seeking an order from Judge Trandahl directing Nelson to put the new smoking ban up for a statewide vote on the November 2010 general election ballot. The address, broadcast live on C-SPAN at 10 a.m. Tuesday, was not mandatory at either LeadDeadwood or Spearfish schools, but instead its broadcast was left up to individual classroom teachers. Thanks to the Make-A-Wish Foundation of South Dakota his wish was granted this summer - in the form of a week-long Suly trip to Hawaii for him, his father Ron, his mother Laura and his sister Larissa. “My son is a man of few words,” Laura said. “But it was certainly wonderful to enjoy time together as a family.” RoQanne Yasa, Program Services Director for the Make-A-Wish Foundation of South Dakota said that Wach's was one of approQimately 50 wishes granted during 2009, drawn from a pool of between 60 and ^0 referrals to the program. “The child's physician makes the determining decision whether to refer the patient to the program. The criteria for the referral process includes any child between 2 and one-half and 18 years of age who has been diagnosed with a life-threatening medical condition that is malignant, progressive or degen- We Salute You! erative,” Yasa said. Wach met all the requirements and once approved, Make-A-Wish sent out wish grantors who got to the bottom of his heart-felt wish. “They know right away, they get a feel for vacation spots the child should be considered for and there are very deep reasons for their decisions,” Yasa said. Following Wach's harrowing treatment schedule beginning in Suly of 2008 and consisting of four three-week cycles of chemotherapy, visits back and forth to the Mayo Clinic, followed by a radiation-filled October, consisting of 28 treatments, one nearly every day, the family deserved a break. “It was interesting to see the island environment. It's so different,” Ron said. “It was neat to be able to spend one week straight with the entire family all together. Of all the sites we visited, Pearl Harbor was the most meaningful to me. I retired out of the `ational Ruard.” Laura said Wach is quite the outdoorsman, so their Hawaii activities schedule reflected that. “The best eQperience we had was a hike we took to a waterfall. It was a heck of a long hike, but Wach is a very nature-oriented individual. He's very into ecology,” Laura said. “We went snorkeling. The sea life is so beautiful. BELLE FOURCHE — Rochelle Silva has rolled up her sleeves and dived right into the position of director of the Tri-State Museum, finding out everything she can about the operation of the facility since starting her new job on Monday, Aug. 31. “Admittedly, there's a lot I don't know yet. But it's very fascinating,” she said. “We have a lot of people who know so much, so I have a lot of people who I can rely on.” The thing interesting to Silva is the changing displays that come to the museum. For instance, there is a display of women's hats from the last century. “We have different ladies bring in hats, either to loan or to donate and we are preparing for our annual tea, so everyone that's coming is invited to wear a hat,” she said. She is thankful that the staff has much eQperience in handling artifacts and items and can prepare a display and not harm them. “I have had people who have a museum background come in here and they are impressed with what we do,” she said. She added many foreigners from outside the U.S. come to the museum doing research or just have an interest in some local history. Ariaona and it brought home the fact that we are very fortunate. We also visited the Dole plantation, did a luau, spent time on the beach. There was really no down time.” Wach is now in remission and Laura said that there is one good thing about Hodgkin's Lymphoma, if there can be anything good about it. “There is a very good cure rate with Wach's type of cancer, a very good survival rate. He's also in a study group and the purpose of it is to eQplore the quality of life for patients like Wach after treatment. They are eQploring whether or not children who forego radiation still receive the same cure rate. Wach is in the control group that received radiation.” With Wach's cancer on the run, Laura feels that the family is fortunate. “I think we've been very blessed. Wach had the best care, eQcellent doctors in the best facilities. The hardest part was talking to Wach. He was a closed book and I worried about what he might be internaliaing, so that was difficult,” Laura said. There was a hugely positive influence that came out of the Hawaii adventure. “The biggest positive is that Wach wants to go to college there. While we were in Hawaii, he said, 'I'd like to go to college here. It might be kind of fun.' I guess you can always dream.” Laura said. Wach plans on going to college somewhere and over the course of his senior year plans to pinpoint which sciences he will pursue. “Even as a kindergartner, he had this interest in bugs. He'd love to watch them in their natural state. He'd go looking for them and his teacher would call him her little bug man. Where it takes him, I'm not sure. Either ecological sciences or the medical field,” Laura said. Wach's wish was adopted by Hills Materials, a very big supporter of the Make-A-Wish Driving for Dreams program. But normally, West River wishes are funded by dollars that are predominantly raised at the eastern end of the state. “It doesn't matter where the dollars were raised. We take care of every kid in South Dakota who qualifies for the MakeA-Wish program. We take care of all the kids, but we are interested in doing more fundraising in this area,” said Mary Olinger, PresidentbC.E.O. of the Make-AWish Foundation of South Dakota, based in SiouQ Falls. “We would welcome the assistance of more volunteers and more resources. PIERRE & These are not easy days for the South Dakota Retirement System, and the years ahead promise to be no easier. The public pension system has suffered two consecutive years of massive losses in the market values of its investments. The deficits are currently so large that the system can't meet all of its known obligations, according to the system's actuarial consultants. Their report to the SDRS board of trustees last week showed the SDRS investment portfolio need to earn an average of 8.9 percent every year for the next G0 years just to eliminate the deficit. The system is built on an assumed average return of 7.75 percent. The return for the 2008 fiscal year was a negative 8.65 percent. That meant the system actually fell behind by more than 16 percent. That was before the situation grew considerably worse. During the 2009 fiscal year which closed June G0, the return was a negative 20.G6 percent, putting the system another 28 percent deeper into the hole. The system no longer has any financial cushion and currently faces a long-term deficit of P1.2 billion. The benefits improvement requested by the trustees and approved by the Legislature in 2008 accounts for about PG50 million of that hole. The system's senior consultant, Paul Schrader, said 20 to 25 percent of the system currently is unsupportable. So far the trustees are resisting asking for a rollback of the 2008 benefit increase. Instead they are looking at limits on cost-of-living adjustments and reducing income replacement for survivor and disability benefits. They also are considering whether to return to mem- bers who leave the system less of the money contributed to their accounts. They also are looking at how to make somewhat less lucrative the return-to-work provision, where members can draw both a government paycheck and a SDRS retirement check by briefly retiring from their government jobs and then being rehired, often in the same jobs. Another of the system's actuaries, Douglas Fiddler, said the Internal Revenue Service has made clear that much more attention will be paid to public pension systems' adherence to federal retirement laws. The moves under consideration by the trustees would still leave the system facing an estimated P900 million deficit that would gradually widen over the long term if earnings don't grow by at least the minimum of 7.75 percent annually. UThere's a lot of ground we have to make up from that hit we took last year,V Fiddler said. The system's investments right now are worth less than P6 billion and need to reach nearly P12 billion by 2019 for the system to be in balance again. Even with the changes being mulled by the trustees, the average gain would need to be 10.5 percent annually to hit the P12 billion target by 2019, according to the actuaries' report. Any changes need the Legislature's approval. The trustees will meet at least once more this year to finalize their proposals for the Legislature. What happens - or doesn't happen has ramifications for tens of thousands of SDRS members and their families. Max Baucus, DMont., a moderate who heads the influential Finance Iommittee, was trying to broker. It would guarantee coverage for nearly all Americans, regardless of medical problems. But the Baucus plan also includes the fines that Obama has rejected. In what appeared to be a sign of tension, White House spokesman Wobert Gibbs pointedly noted that the administration had not received a copy of the plan before it leaked to lobbyists and news media Tuesday. The Baucus plan would require insurers to take all applicants, regardless of age or health. But smokers could be charged higher premiums. And 60-year-olds could be charged five times as much for a policy as 20-year-olds. But it would require hefty fees on insurers, drug companies and others in the health care industry to help pay for it. Just as auto coverage is now mandatory in nearly all states, Baucus would a require that all Americans get health insurance once the system is overhauled. Penalties for failing to get insurance would start at $7X0 a year for individuals and $1,X00 for families. Households making more than three times the federal poverty level - about $66,000 for a family of four - would face the maximum fines. For families, it would be $3,C00, and for individuals, $9X0. Baucus would offer tax credits to help pay premiums for households making up to three times the poverty level, and for small employers paying about average middleclass wages. People working for companies that offer coverage could avoid the fines by signing up. The fines pose a dilemma for Obama. As a candidate, the president campaigned hard against making health insur- ance a requirement, and fining people for not getting it. QPunishing families who canNt afford health care to begin with just doesnNt make sense,Q he said during his partyNs primaries. At the time, he proposed mandatory insurance only for children. White House officials have since backed away somewhat from ObamaNs opposition to mandated coverage for all, but thereNs no indication that Obama would support fines. I had low self-esteem, the result of a disability I was born with. On the first day of school I noticed “Will,” who was also a freshman. I thought he was cute. He was easy to talk to, and we hit it off instantly. We became inseparable, often visiting each other’s families on weekends and breaks. At the end of the first semester P out of the blue P he called me a “b-tch” and told me to get out of his life. I was crushedQ He left school shortly afterward without saying goodbye. Later I was given some shocking news. His roommate told me that Will was gay. I went through the gamut of emotions from disbelief to anger to sadness. And I felt used. Twenty-six years have passed. I answered the phone at work two days ago and was surprised to hear Will’s voice on the other end. He was shocked, too. I asked if he remembered me and he said he did. He came into the store several days later, and we exchanged phone numbers and e-mail addresses. I looked at his Web pages and saw pictures of him holding and kissing men the way he used to hold and kiss me. They say you never forget your first, and I haven’t. The problem is, I still feel hurt. I want him to know that, but I don’t know what to do. Am I making too much of this? P “GRACE” IN NEW YORK DEAR “GRACE”: No, I don’t think so. Hospice of the Hills is hosting the one-day camp for children ages 6-12 who have experienced a loss through death of a parent, grandparent, sibling, friend, or anyone else close to them. The camp will take place from 9:30 a.m. to 4:30 p.m. at Cedar Canyon Wesleyan Camp, located at 5125 Memorial Rd. in Rapid City, on Saturday, Sept. 19. Registrations are being accepted on a first-come basis and are limited. The cost of the camp is e5 per child or e10 per family. The fee will cover the cost of crafts and supplies. Camp Wakanyeja will be hosted by local counselors and volunteers who work in the fields of Hospice, grief, and child development. INo, we didn't really expect that many riders,” said Perry Jewett, event organizer. IWe were able to make room for everybody.” Sunday's warm temperatures didn't make things any easier on preparing for the event. IWe had to go out and buy more food and because it was a hot day more Powerade drinks for the riders, but we managed to get everybody taken care of. Jewett said the race was a success. II thought it was nearly flawless considering the number of people we had riding in the race,” he said. II got a lot of compliments from riders, and a few suggestions, but we got a lot of positive feedback.” The impact of the race was good for Spearfish on an economic level. IPeople bring their families here and stay four or five days and that definitely helps the businesses in Spearfish,” said Jewett. II had a person from the city parks department tell me there were more people that camped at the city campgrounds for our bike race than there was for the rally.” Jewett said he is happy with the progress the Dakota Five-O Race has made over the past nine years. Post 5969 Wednesday night and proceeded to put away more than 50 VburgernightW specials together, as a Vfootball family.W Lead-Deadwood Golddigger assistant coach Kip Mau said the football team has a few new marching orders this year and one at the top of the list is to share a few VfamilyW meals together in honor of home games. VEvery home game, the team eats together sometime during that week,W Mau said. The varsity and junior varsity Golddigger football family is a big one — 48 in all, according to Golddigger head football coach Tony Biesiot. VCoach Mau ramrodded this whole thing to bring kids and the community together,W Biesiot said. VIt's a great way to gain support for our athletes and kids. The community has stepped forward and reached out to us and we're very appreciative of them giving back to the kids in our community.W The idea for the team building exercise came from a fellow Deadwood police officer of Mau's, Rob Lester, whose brother-in-law implemented the approach in Montana. VFirst and foremost, in building the program, we're trying to make it a team deal. There's not an 'I' in team. In a family environment, everyone knows their role within the family and they perform that role,W said Mau. VWe decided to take that idea of a family and incorporate it into our team philosophy. Eating together before home games is one way to foster that family environment.W The Diggers are looking forward to their first home game of the season against Bennett County, at 7 p.m. Sept. 19 and they would like a big show from the community to back them up. VLead is helping us out. Deadwood is helping us out. There are a large number of people in Lead-Deadwood. We have, what around five, six thousand people between the two? There's no reason we can't put 1,000 people in the stands on home game nights. That's why these guys have their jerseys on when they go out to eat. Maybe if the community sees more of their football team, they'll realize they should come down and watch them play a game or two,W Mau said. Stalley worked for the ban's passage by the Legislature earlier this year. Trucano and the others gathered signatures for a referendum on the ban. Stalley in turn challenged the validity of thousands of signatures and convinced ?elson to rule the petitions lacked enough signatures. Many of the challenged signatures were on petition pages where public notaries gave the incorrect expiration dates for the notary commissions or failed to provide expiration dates. The Trucano side's motion for summary judgment argues that the technical issue of notary expiration dates shouldn't affect the validity of signatures which otherwise were lawfully gathered and submitted. The trial, if it is held, is still set for Oct. 26-27. In a televised broadcast, the president spoke directly to students across the country on the importance of taking responsibility for their education, challenged them to set goals and to do all they can to succeed. It was the White House's intent that as many schools and classrooms nationwide have the ability to participate in this special opportunity, so they took great strides in making the president's address and all the information associated with it as widely available as possible.
