Voter Turnout Highest in Recent Years

The Annual Membership meeting of the
Long Island Board of REALTORS®, Inc.
was held on Tuesday, October 24, 2006 at
the Huntington Hilton in Melville, New
York. This was the first year that voting took
place in the Realtor Service Centers, in addition to the Melville location. Expanding voting opportunities resulted in an increase in
voter turn out for this year.
The association update began immediately
following a presentation entitled “Prospering
in a Changing Market” by National Speaker,
David Knox. LIBOR President Gil Picard
welcomed Realtors® in attendance and gave
the highlights of the past year. During 2006
the Board served the interests of its members
successfully in the areas of Public
Awareness, Education, Ethics and Political
Legislative Advocacy. For a more comprehensive overview of the 2006 accomplishments, see Gil’s article on page 4.
Mohsen Zandieh gave the Treasurer’s
report. The audited report for fiscal year

ending 12/31/05 showed a budget of
$6,794,660 for income and $6,915,310
for expenses. The actual income was
$8,552,872. The expenses were $8,206,264.
Both were primarily due to the increase in
membership. The result was that income
over expenses was $243,524.
Board Counsel Howard Goldson provided
a legal overview. He advised the membership of the new Human Rights law that now
includes “Source of Income” as a new protected class in Nassau County. He also
informed members of the new Agency
Disclosure Form that will be in effect as of
1/1/07. Additionally, Howard gave an
update on several MLS items and covered
the status of pending litigation.
Chief Executive Officer Joseph Mottola
announced to the group that membership is
up 6% from last year. Mottola updated the
membership about expanded capabilities in
the area of Education, and informed members about the new Realtor Service Center
that recently opened in Woodbury.
It was reported that there was a Fair
Housing major issue in the Five Towns area
of South West Nassau. And work has
already started on a Legal Risk Reduction
conference for early next year. Additionally,
Mottola reported that LIBOR will continue
to increase our political presence through
further economic support for legislators who
support issues important to us.
Polls officially closed at 2 p.m. in all
voting locations. When the votes were tallied, the following official election results
were read and heard at the very same time
in both locations.

MLS Nominating Committee Report

The Multiple Listing Service Nominating
Committee, chaired by Dan Ryan, 2005
MLS President, met on Wednesday, October
18, 2006, and nominated the following
Realtors to serve as 2007 leadership.
Donald Scanlon has been nominated to
serve as 2007 MLS President. Don has been
the Owner/Broker of Century 21 Your Home
from 1984 to 2005, which then merged with
Century 21 American Homes where Don
remains one of the Owner/Brokers. He has
served as an MLS Director in 1992, 19971999, 2002-2003 and a LIBOR Director
from 2003 through 2005. Don has served as
MLS Treasurer (2004) and Vice President for
Nassau (2005 -2006). There are many
LIBOR and MLS committees that Don has
served on such as Technology, Advertising,
Budget and Finance, Rules, Professional
Standards, Vice Chairperson of Education,
Legal Assistance, Governance, RPAC and
Legislative committees. He has been a
NYSAR Director since 2004. Don will be
the Vice Chairperson for the State
Association’s Professional Standards

Frank Urso has been nominated to serve as
Nassau Vice President. Frank is the

Nassau from 2000-2003 and an MLS Director
since 1999. Frank is currently serving as
Treasurer on the MLS Executive Committee.
Frank has served on many of the LIBOR and
MLS Committees including the Risk
Reduction, Education, Content Security Task
Force, Technology and Services, Advertising
and Professional Standards. Currently he is

to the present. Dorothy has been active in
LIBOR serving as a LIBOR Director and a
member of Professional Standards, Fair
Housing and Cultural Diversity and Common

and LIBOR committees over the past 25
years. Frank has served as Suffolk Vice
President as well as Secretary on the MLS
Executive Committee. He has chaired the
MLS Rules Committee, MLS Technology
Committee, LIBOR Grievance Committee

Q:How did it get to be $100.00 in one year?
A: Unfortunately there was a “Perfect
Storm” situation due to the following elements:
1. Budget & Finance Committee projected a loss of 4,000 members.
2. Directors approved the new Photo
Security ID and Lock Box program.
3. NYSAR raised their assessment to the
Board.
4. NAR raised their assessment to the
Board.
5. LIBOR opened a new Service Center
in Woodbury.
6. The normal operational expenses of
the Board increased.
Q:Why a 4,000 member loss?
Q:Have there been operating increases in
the past?
A: Operating expenses like most businesses tend to increase each year.
Q:When
was the last time the Board
raised dues?
A: In 2002, they went up $5.00 and then
in 2004 dropped $25.00 and remained at
that level until 2007.
Q:If expenses went up each year, why
were there no increases?
A: The continual projected increases
each year in members generated enough
income to cover the projected expenses.
Q:Is the Board adding staff in 2007?
A: No...The Board added staff in 2006
which includes the new Service Center
which is carried over into 2007.
NYSAR will be conducting a lost and/or
reduced commission survey in the near
future to better document the dire need for
this law. Opponents to the Commission
Escrow Act have stated that the extent of the
lost commission issue has not been well
proven. In addition, an attempt will be made
to have local Multiple Listing Services
throughout New York State implement the
ability to document any commission losses
when REALTORS® report closings.
The Commission Escrow Act will be
reintroduced in the State Legislature in
2007. Senator Dale Volker (R-Depew) and
Assemblyman Michael Gianaris (DAstoria), our original legislative sponsors,
have both agreed to reintroduce this bill next
year. The bill, (S.193-B/A.3395-B), which
requires disputed real estate commissions be
placed in an escrow account with the county clerk until a resolution is reached, overwhelmingly passed the Assembly by a vote
of 112-15 and the Senate with a 60-1 vote.
We will address the concerns that
resulted in a veto of this year’s bill before
requesting the re-introduction of this legislation. According to the Governor’s
office — the memos of opposition from
the Department of State and the
Consumer Protection Board will not be
made public until January 1, 2007.
Thanks to all REALTORS’® efforts and
the tremendous support of our REALTOR®-friendly legislators in Albany, the
bill was forwarded over to the Governor’s
office. However, we must once again seek
co-sponsorship from the majority members
in both houses of our state government.
It is more important than ever to contribute to RPAC! Remember there are
many adversaries out there who would
like to see our bill fail once again. Please
contribute to RPAC each and every calendar year. It is the best way to protect your
business and ensure that our fight for a
much needed Commission Escrow Act
can and will succeed!

Listing Service of Long Island, Inc., any five
(5) Directors may submit additional candidates for such offices by subscribing to a
petition set forth by names
and the office of their candidate(s) and filing such
petition with the Secretary
of the Corporation at least
ten days prior to the elections. As of November 3,
2006, the deadline for the

Mohsen Zandieh, Arash Real Estate &
Management for Queens Vice President.
Mohsen Zandieh is the Owner/Broker of
Arash Real Estate and has been a Real Estate
Broker for over 25 years serving Northeast
Queens and Great Neck for almost 20 years.
Mohsen has been elected to serve as LIBOR’s
2007 President-elect. Currently, he serves as
LIBOR Treasurer and Vice President, Queens
for MLS. He has served as Zone Chairperson
and has been an MLS Director since 1994.
Mohsen has served on many committees
including Liaison, Procedures, Long Range
Planning, Risk Reduction, Legislative,
Bylaws and Professional Standards. His
involvement on the State level includes serving on the State Membership Committee in
2003-2005. In 2003, he was the recipient of
the LIBOR Community Service Award.
Voting will take place at during the
November MLS Board of Directors meeting
on November 15, 2006. Please note that this
is not a general election, and only incoming
2007 MLS Directors will be entitled to vote
for these candidates. Results of this election
will be reported in the December issue of
“The REALTOR” paper.
A: Yes, a major portion, $294, is tax
deductible.

Professional Standards, Technology and
RPAC committees. Frank is a past recipient
of the Tasso Harismides Award. In addition
to his association involvement, he is actively
involved in many community, school and
civic organizations throughout the Town of
Babylon. He holds the CRB and GRI Real
Estate designations.
Barbara Ford has been nominated to
serve as 2007 MLS Treasurer. Barbara is
the Owner/Broker of Ford Phase II Realty
Corporation. Barbara has been a Realtor®
since 1980 and voted Realtor Associate of
the year in 1982. She currently serves as a
Director for MLS and has also served on
the MLS Budget and Finance Committee.
She also served on the LIBOR Legislative,
Professional
Standards,
RPAC,
Commission Escrow and Common Interest
Ownership committees. On a state level she
has been on the Legislative, Professional
Standards, Education and Fair Housing
committees. Barbara has served on several
working groups of LIBOR and NYSAR
such as Data Task Force, Independent Audit
Group, Article 12A Working Group,
Commercial Issues Working Group,
Commission Escrow Working Group and
the Co-op Issues Working Group.
Mathew Horn has received the nomination to serve as 2007 MLS Secretary. Horn is
the Owner/Broker of Berry Hill Associates
Real Estate Company since 1986. Mathew is
currently a LIBOR Director and is a member
of the Education, Bylaw, Common Interest
Ownership, Professional Standards, Public
Relations, Legal Assistance, Joint
LIBOR/MLS Audit Committee and
Legislative Committees. He serves as chair
for the Fair Housing and Cultural Diversity
Committee and is also a Mediation Officer.

increased by almost 300% LIBOR staffing
increased from 22 to 36...a 64% increase. In
that time we added Service Centers, a
Government Affairs Department, help in
Accounting and Membership and expanded
Communications.
Q:Doesn’t the Board have Reserves that
could be used to offset the amount of the
increase?
A: The Board has Reserves and committed almost $1,000,000 from Reserves to the
Photo Security ID system so the members
would not have that added into the dues
increase.
Q:How does the Board dues compare to
other Boards across the country?
A: The Board portion (as well as MLS fees
for agents) is among the lowest in the country.
Each Board pays the same to NAR but each
State Association is different. NYSAR dues
are also among the lowest in the country.
Q:When will the Dues bills be sent out
Q: What
does it cost to run the new
Woodbury Service Center?
A: Approximately $6.00 per member per
year.
and when is payment due?
A: November 27th, they are mailed and
payment is due by December 27th. If payment is not received, a notice is sent to the
Broker with a list of names who have not
paid and the Broker has until mid January
to secure payment. Following this, the suspension process begins.
Q: Why did we open it?
Q:Can I put my dues on my credit card.
A: For the same reason that we opened
Queens in 1994 and Riverhead in 2001...it
enables us to provide more convenient services to members. Both locations are also
funded by dues.
A: Yes...this is becoming a very popular
method of paying dues. You can also pay
dues online from Stratus Info Center by
clicking the red button.
Q:What about the balance of the increase?
A: It covers the increase in operating

This has been a noteworthy year for LIBOR and our
membership. With so many
dedicated volunteers and
our terrific staff, we have
made great strides as an
Association in maintaining
that focus. There were so
many accomplishments, but
in the interest of time I want
to touch upon just some of
the highlights.
This is our first effort at
providing voting capabilities at additional
sites by using our Realtor Service Centers.
We hope it proved convenient and valuable. I am happy to report that overall we
had the largest turnout in years.
LIBOR’s role is primarily to serve the
interests of its members in the areas of
Public Relations, Education, Political and
Legislative advocacy and Ethics. In each
of these areas we saw growth and significant successes.
Our Public Relations efforts, headed by
Chairperson Frank Urso, have seen a major
increase in the number of releases that are
picked up by the media. Our “We’re more
that Realtors” campaign in 2006 focused
on our efforts in support of our communities and charities. Our Habitat for
Humanity, Rebuilding Together of Long
Island and Ronald McDonald House support programs were also very successful.
We have raised close to $110,000 in our
charitable efforts so far, this year.
In Education, committee chaired by Don
Scanlon, we were able to expand our capacity at the Education Conference which
resulted in it not only being “Sold Out” but
with an even greater attendance and with
more Exhibitors. We increased the availability of CBR accredited Buyer Brokerage
courses and scheduled more Senior Real
Estate Specialist designation courses. We
began a series of Certified International
Property Specialist (CIPS) courses for the
convenience of our members.
In the Ethics area, committee chaired by
Tony Smith, we increased
our efforts to mediate commission disputes rather than
having the parties go to
Arbitration. We continue
training our Professional
Standards panelists and
Chairpersons in an effort to
insure the best possible service to our members.
Our Political and Legislative
advocacy efforts focused
upon getting the Commission
Escrow Act through the NY Assembly and
Senate. While we made it to the Governor’s
desk, he vetoed it... a bitter disappointment.
However, we garnered unprecedented support among our legislators and we will continue the fight for its passage.
What materially helps our legislative
efforts is our ability to financially support
legislators which are supportive of issues
of importance to Realtors...such as the
protection of our commissions. That support comes from you in the form of your
RPAC contributions, RPAC is chaired by
Pat Levitt. This year we have a set a new
record and as of yesterday our collections
stood at $341,000.
Communication is a critical component
of our efforts to keep in touch with you.
Our REALTOR paper, our internet based
Realtor Online and our numerous “POP
UPS” on Stratus highlight important
issues and information.
We are the largest Board in the country
and it takes the efforts of a lot of people to
keep it energized and relevant. To all of
you who contribute your time and effort,
I thank you. To make you aware of whom
these volunteers are, we will publish a
special pull out section in our December
REALTOR paper identifying them.
Consider volunteering your time. It can
be very rewarding.

Over $12,000 was raised at LIBOR's 11th
Annual Realtor Rumble held on Sunday,
October 22, 2006 at Syosset Lanes in
Syosset, with all proceeds to go to Diabetes
Research! The fun day was hosted by

What is Solar Nanotechnology?

A new take on a familiar renewable energy source may render batteries and chargers
useless.
Imagine not having to worry about
charging your cell phone, laptop, PDA,
Blackberry, MP3 player, portable DVD,
etc., perhaps ever. Solar nanotechnology
just may be the innovation that would make
it possible. Solar power certainly isn't a new
concept, but what is new and exciting is the
potential of using solar power for many of
our technology needs.
No longer the realm of tree huggers, technology companies are investing heavily in
this power of the future. Solar technology,
though still in limited use, has been powering and heating homes and even commercial
buildings for decades, but its application in
portable tech devices is nearly non-existent,
other than in the humble solar calculator.
The real question one might ask is: "What
took so long?" Even the Department of
Defense is showing interest, funding a project at the Rochester Institute of Technology
to determine if solar nanotechnology can
supply improved satellite imagery.
What Is Solar Nanotechnology?
Consider a marriage between solar power
and technology — you end up with solar
nanotechnology, also known as photovoltaics. The concept involves creating
flexible, thin rolls of solar panels, which
will power everything from a building's
electrical and heating systems to your cell
phone, laptop or virtually any power-driven
device. The flexible films are embedded
with tiny solar cells to create a self-contained, self-charging battery. These films
are then enclosed or attached to a device
such as a laptop, cell phone, etc. providing
power to the gadget.
Potential Uses & Impacts on the Real
Estate Industry
The potential is endless. Solar nanotechnology could provide power to homes,
businesses, the military, hospitals, etc. Solar
panels already are used to help power
buildings now, but shrinking down the
technology would allow solar cells to be
more integrated with the rest of the building, embedded in tiles and siding.
Of particular interest to consumers is its
application in our portable gadgets. No
more “oops” moments of suddenly losing
power on your cell phone or laptop, since a
little sunlight would give your gadgets the
juice they need. Working away from the
office would be much less of a hassle, as
REALTORS® will not need to be concerned with charging devices for their tech
tools or carrying the required plugs,
replacement batteries and chargers.
Drawbacks
The precarious state of today’s nonrenewable energy resources makes solar
nanotechnology an exceedingly compelling
concept. As appealing as this notion is however, routine use of solar nanotechnology is
likely several years away. Until it can be
produced and sold at prices similar to conventional power sources, use and availability of solar nanotechnology will be limited.
Costs
Currently solar nanotechnology is more
expensive than other energy sources — part
of the reason it is still in the research stage.

For example, I’m a homebuyer searching for properties in Nassau County on
MLSLI.com. It’s 10pm — all offices are
closed, but I know that I like this property
AND I know I want to see it. Instead of
waiting until the next business day to call
and schedule a showing, Showing Assist
lets me request a time and date to see the
property — right from the listing!
Showing Assist makes it easy for homebuyers and agents to “Request a Showing”
online 24/7 — right from MLSLI.com
and/or Stratus. Once an agent or homebuyer schedules a showing in the web-based
property calendar, an automatic e-mail
with the time and date of the showing
request is generated to both parties — you

Demographics,
Fair Housing and
the Internet
Today, public information concerning
the ethnic makeup of communities and
school districts is commonplace. The
sources range from public information
such as the United States Census to private
websites such as eneighborhoods and
Sperling’s bestplaces. For decades, it has
been a fundamental tenant of real estate
brokerage not to discuss the ethnic makeup of communities or school districts with
potential purchasers. The avoidance of
such discussions has been taught as the
best protection the broker has against
potential claims of violations of fair housing laws. Such advice is still sound, however, Realtor’s customers and clients
become more diverse in their ethnic makeup, Realtors are called upon to answer
questions by buyers concerning the demographics of particular areas. What is the
Realtor to do in the face of such questions?
The first cardinal rule which has been
long in place is that such discussion
should NEVER be initiated by the
Realtor. The purpose of the Fair Housing
Act was to provide the same opportunities
for housing to members of the protected
classes as is afforded to the majority population. Therefore, any discussion by a
Realtor concerning the demographics of a
particular neighborhood or school district
was subject to the interpretation that it
was an attempt to limit the choice of persons who are members of protected classes. It made no difference whether that was
the actual intent of the Realtor since intent
is not required for there to be unlawful
discrimination. Therefore, the safest thing
that a Realtor could do was to remain
silent. Prospective purchasers, however,
are not prohibited by the Fair Housing
Laws from choosing the ethnic makeup of
communities in which they want to live.
This is so even if the buyer’s motivation is
bigotry. Thus, the buyer may request only
to be shown homes in a neighborhood that
meets certain demographic criteria. The
problem for the agent is that there was
never a way prior to the internet for the
agent to determine the exact demographic
makeup of any community or school district and certainly, even if the could pinpoint such demographics in any point of
time, the more distant the time of the sur-
vey, the less reliable it was with respect to
the present demographics of a particular
neighborhood or school district. To some
extent, the internet has changed that since
current demographic information is much
more readily available. The basic legal
problem, however, remains the same.
Here are some rules to follow in the event
a prospective buyer makes such a request:
• Familiarize yourself with websites
such as that of the United States Census
Bureau which contain up-to-date accurate
information.
• ONLY IF REQUESTED BY THE
BUYER, advise the buyer of such websites. For example, if the buyer asks what
is the racial makeup of school district no.
3, the agent can respond: “There is a website known as www.eneighborhoods.com
which may contain that information. If it
is really important for you to have the
information, I suggest that you look at that
website or make an inquiry on google,
yahoo or some other web search engine.”
• If the buyer asks you to make that
search, REFUSE TO DO IT.
• If you are in your office or in a place
where there is both a computer and internet access and the buyer makes such
request. Simply hand the mouse to the
buyer and have the buyer make his own
search.
• If a situation like this occurs, after
you leave the buyer, go back to your
office and make a detailed note for your
file concerning everything that occurred.
If you are not the representative broker of
the office, make sure that you alert your
broker immediately to what has been
done, how you responded and forward to
the broker a copy of your memorandum.
Buyers are free to choose the areas in
which they would like to live. Realtors
may respond to the buyers’ choice, but in
doing so, be careful not to ignore properties outside the buyers’ choice for which
the buyers are qualified and which meets
their general housing needs. Provide all
buyers with the widest number of choices. Any limitations with respect to choice
must be the buyers’ and not the Realtors’
and should be made only after the buyers
have been made aware of the full scope
of their choices.
Open House Sign Problems in the
Town of North Hempstead

LIBOR’s Government Affairs Division
recently met with North Hempstead
Councilmen Wayne Wink (D) and Angelo
Ferrara (R) together with several REALTORS® from the North Hempstead area to
discuss the ongoing sign problem in the
Town. The Town has been receiving complaints from residents that REALTORS®
have been posting as many as six to eight
open house signs in front of their houses, on
the corners, and on the grass adjacent to the
sidewalks. Balloons have frequently been
attached to the signs. Residents’ concerns
are that these signs and balloons distract and
detract from the neighborhood, obstruct
traffic, and ultimately violate the town code.
Both Councilmen have shown a positive
attitude towards working with the REALTORS® on this issue, and initially contacted
LIBOR’s Government Affairs Division to
become involved in finding a mutually beneficial alternative to this situation. There will
be ongoing meetings about the sign problems with the Town Council, LIBOR’s
Government Affairs Division, and REALTORS® from the North Hempstead area.

Attention REALTORS® In The Babylon Area

The Village is concerned about the
increase in the number of open house signs.
They have brought it to LIBOR’s attention
that REALTORS® are placing four or five
signs on various corners and on the grass
adjacent to the sidewalks. One important
issue is balloons and streamers being
attached to the open house signs: they distract and detract from the neighborhood,
and obstruct traffic. One directional arrow
for the open house is sufficient.

It is becoming more and more commonplace that banks are not wiring the
funds until the closing has been completed. This negligible practice of “holding”
or not expediting the mortgage and/or
bank funding to the location of the closing
in a prompt manner is causing many closings to be postponed or delayed.
This is especially detrimental when a
bank from the west coast is involved in
the transaction and funding may not be
sent until the next day. The disruption and

Case#2-5: Ascertainment and
Disclosure of Pertinent Facts
Mrs. A, a retired college professor, came
to the office of REALTOR® B, a cooperating broker, in search of a large house in
which she could occupy a small apartment,
using the remainder of the building to operate a residential club for graduate students.
What she had in mind was a deluxe “rooming house” in which the tenants would have
a parlor, dining room, kitchen, and laundry.
She felt confident, from previous experience
in the community, that she could obtain
from 10 to 16 “roomers”, and indicated that
she would be guided in her charges to the
tenants by the amount of mortgage payments she would have to make.
Most of the large houses on the market
were inadequate. Finally, REALTOR® B
located a massive old mansion listed with
REALTOR® C that appealed to Buyer A.
After repeated visits to the house and after
discussing financing with a local lending
institution, Buyer A said she was interested in the house if it could accommodate as
many as 11 tenants. REALTOR® B
accompanied her for another inspection to
check on this point.
By planning double occupancy of the large
bedrooms she found she could accommodate
eight roomers. In addition, there were three
small rooms upstairs that had been used for
storage which REALTOR® B suggested
might make acceptable single rooms. Buyer
A agreed, and the sale was made.
Two months later, the buyer filed a complaint with the local Board, charging REALTOR® B with failing to disclose pertinent
facts. The complaint alleged that REALTOR® B knew the buyer was taking on a
substantial obligation with the expectation
of housing 11 persons in the structure; that
REALTOR® B had suggested that three
rooms might make acceptable single rooms;
and that she had been subsequently advised
by the building department that these rooms
could not be used as dwelling rooms since
the windows were too small to meet code
requirements. She had been advised that it
would cost $1,480 to replace the windows.
She charged REALTOR® B wit negligence
in not advising her of this deficiency. After
reviewing the complaint, the Grievance
Committee referred it for hearing before a
Hearing Panel of the Professionals
Standards Committee.
At the hearing, REALTOR® B acknowledged the facts set out in Buyer A’s complaint, but advised that the complaint did
not state all of the relevant facts. With
respect to the house in question, as with
many other houses shown to Buyer A, he
had made a special check at city hall as to
zoning regulations to be sure that the kind
of occupancy intended by the buyer would
be lawful; that the buyer’s specifications
were unusual and that in attempting to meet
them, he had devoted an unusual amount of
time and effort to help her realize her objective; and that he had acted in good faith and
had not deliberately failed to disclose any
pertinent fact but had, in fact, urged the
buyer to consult with an engineer and to
check with the zoning authorities prior to
making an offer to ensure that the property
could be utilized as a residential club.
The Hearing Panel found that REALTOR® B had satisfied his duty to the buyer
by recommending that the advice of experts
be sought out and considered by the buyer
prior to making and offer to purchase.
REALTOR® B was found not in violation of Article 2.

ty had been prominently featured. He also
made a point that Prospect C, in consulting
with him, had emphasized that Prospect C’s
physical disability necessitated a home near
a bus stop. Thus, in his judgment, the
change in bus routing materially changed
the characteristics of the property in the eyes
of the prospective buyer, and he felt under
his obligation to give honest treatment to all
parties in the transaction, that he should
inform Prospect C, and that in so doing he
was not violating his obligation to his client.
The Hearing Panel concluded that
REALTOR® B had not violated Article 1,
but had acted properly under both the spirit and the letter of the Code of Ethics. The
panel noted that the decision to refund
Prospect C’s deposit was made by the seller, Client A, even though the listing broker,
REALTOR® B, had suggested that it was
only fair due to change in circumstances.

Case#1-2: Honest Treatment of All
Parties
As the exclusive agent of Client A, REALTOR ® B offered Client A’s house for sale,
advertising it as being located near a bus stop.
Prospect C, who explained that his daily
schedule made it necessary for him to have a
house near the bus stop, was shown Client
A’s property, liked it, and made a deposit.
Two days later, REALTOR® B read a notice
that the bus line running near Client A’s house
was being discontinued. He informed
Prospect C of this, and Prospect C responded
that he was no longer interested in Client A’s
house since the availability of bus transportation was essential to him. REALTOR® B
informed Client A and recommended that
Prospect C’s deposit be returned.
Client A reluctantly complied with
REALTOR® B’s recommendation, but
then complained to the Board of REALTORS® that REALTOR® B had not faithfully protected and promoted his interests;
that after Prospect C had expressed his
willingness to buy, REALTOR® B should
not have made a disclosure that killed the
sale since the point actually was not of
major importance. The new bus route, he
showed, would put a stop within six
blocks of the property.
In a hearing before a Hearing Panel of the
Board’s Professional Standards Committee,
REALTOR® B explained that in advertising Client A’s property, the fact that a bus
stop was less than a block from the proper-

their core characteristics. In the same way
that knowing and understanding real estate
consumers allows us to serve them better,
knowing your Xer professionals’ generationally-driven attitudes, values, demands
and preferences will allow you to manage,
train, motivate and lead them more effectively.
Fierce Independence. One of the most
important Xer core characteristics is fierce
independence. As the original “latchkey
children,” Xers essentially “raised themselves” in then emerging dual-income and
single parent households. As a result, Xers
developed fiercely independent, do-it-yourself attitudes.
The Bottom Line. Another core characteristic of today’s Xer real estate professional is what I call the BLA, or the Bottom
Line Attitude. The BLA is well known to
most real estate managers. It pervades
many real estate organizations and creates
instant conflict with Baby Boomer managers who seek to impart wisdom and experience through Boomer-centric management tactics. The setup is unfair, but real, as
Boomer managers who are generationally
driven towards “experience management”
constantly swim upstream trying to manage, train, and lead Xers who simply want
the bottom line, and who grow tired and
impatient when faced with these experience-based management efforts.
Multitasking. Another important characteristic that real estate managers should be
aware of is the Xer propensity for multitasking, a characteristic often misperceived

You don’t have to look very far these
days for a story or an article on “Baby
Boomers,” “Gen Xers” or one of the other
two American generations. On topics ranging from workforce management, to Social
Security, to community development, organizations across the Country have recognized the value of identifying these established age cohorts, as well the value of
understanding the mission-critical information that can be learned from their generationally rooted values and preferences.
Xer Facts. First things first: the facts.
Although there are a number of different
definitions, the most accurate defines
Generation X as being born between 1965
and 1976. According to this definition then,
Gen Xers are, at present, between the ages
of 29 and 40. Yes, that’s correct: there is
now such thing as a 40 year old Xer.
There are roughly 48 million Xers in the
United States, compared to more than 78
million Baby Boomers (ages 41 to 59) and
73 million young Millenials (ages 11 to
28). According to the most recent census
data, Xers comprise more than 30% of the
national labor force and just more than 29%
of the Texas labor force. As expected, Baby
Boomers still dominate our workplaces (for
better or worse), comprising more than
40% of labor pools in some regions.
Xer Core Characteristics. The key to
managing Xers, or any generation for that
matter, is understanding their generationally rooted values and preferences; that is,

as an inability to focus. Along with the
youngest generation (Millenials), Xers are
prolific multi-taskers, who constantly work
on a number of tasks simultaneously.
Change Agents. It should not surprise you
to learn that one of the most useful workplace characteristics of Xers is their ability
to handle change. Consider two of the items
on the list above of seminal events in the
lives of Xers: (1) unprecedented divorce
rates; and, (2) mass corporate layoffs and
downsizing. Most Xers came of age during
a time of tremendous change, in their homes
where it was felt the most. For many, there
was a change in family structure. For many
others, there was constant instability in family finances and occupations.
Technoliteracy. The last Xer core characteristic that real estate mangers should be
aware of is Xer technoliteracy; i.e., their

generation to come of age in the personal
computer era. They are, as a result, tremendously adept at using technology and, perhaps more importantly, turned off by management efforts that fail to use it.
So how can we use what we know about
Xers to better manage, train, lead and motivate them, to the collective benefit of our
real estate organizations? There are, in fact,
a number of solutions you can and should
embrace now to help manage your Xer real
estate professionals. I recommend rejecting
the stereotypes. As with most stereotypes,
those regarding Xers are not helpful and
inaccurate. Additionally, embrace the realities. Manage your Xer professionals by
embracing the reality that Xers can and will
help you and your organization.
