Villages where time has stood still for centuries, woods filled with chestnuts, rich flavours and tastes from a cuisine that has created great recipes using the typical products of its own territory. Liguria is a land that will fill you with powerful feelings and emotions, a land to love! “We love what we know. We defend what we love.” these are the words of Giulia Maria Crespi, President of FAI and tireless organiser of the Trust since its foundation (1975). This is why FAI has always encouraged people first and foremost to get to know the territory, its monuments and landscapes, so that from this knowledge there might arise the passion and desire to take steps to defend and preserve it. This is why FAI appreciates the constant work and commitment of the Liguria Regional Agency to promote the knowledge of this extraordinary territory. SEA The 13 blue flags flying on Ligurian beaches are international recognition for the quality of our waters and of our sustainable tourism. They bear witness to the commitment of this region, which has always been in the front line when it comes to sustainable development, not least in tourism, with a careful eye towards the environment. Which explains why there are two Marine Reserves, Monte di Portofino and Cinque Terre, and how Liguria came to be at the centre of the natural marine area of international interest known as the "Sanctuary for marine mammals", or cetacean sanctuary. ART & CULTURE Discover a different side to Genoa, city of art, and to Liguria, which has been transformed into a land of culture, events and traditions for every season. After the 1992 Columbus celebrations, and 2004, when Genoa was a European city of culture, the latest very recent success has all the feel of an international event: part of the city's historic centre, with its famous "palazzi dei Rolli" has now been declared a UNESCO world heritage site. What better way to highlight the resurgence of a cultural capital, which has now joined the exclusive club of Italian cities of art? In the shadow of their medieval walls you can find gems of nature, art, food and wine that will amaze the discerning eye of those seeking something out of the ordinary, for a spellbinding holiday. 4 5 PARKS AND MARINE RESERVES AT THE END OF THE 1990’S TWO IMPORTANT AREAS OF THE EASTERN RIVIERA WERE DECLARED PROTECTED NATURAL PARKS AND PROTECTED MARINE AREAS, AND THUS ASSURED TO POSTERITY. FOOD AND WINE There is a road that leads to the flavours of Ligurian cuisine, light and simple, an authentic expression of the sea and country life that sets value on the produce typical of this land, and of the sea. It is the aroma of extra-virgin olive oil, pride of Liguria, king of Mediterranean flavours, that distinguishes traditional dishes such as the typical Genoese focaccia: a product that has always had a place on Ligurian tables. From the olive groves of the Ponente [western riviera] to the vineyard terraces, built by country folk to make use of every square inch of fertile soil on land that often drops sheer into the sea, Liguria produces a range of wines. The real pride of Ligurian cuisine is the world-famous Genoese pesto, the tasty traditional basilbased accompaniment to pasta and rice dishes, prepared in age-old marble mortars using an olivewood pestle. ACTIVE HOLIDAYS Liguria is a wonderful region: with its mountains that drop sheer into the sea, and the flourishing Mediterranean scrub inland, it offers an endless choice of natural landscapes and hidden corners, allowing everyone the chance to spend days out in the open air, surrounded by nature, a stone's throw from the sea, be it for a simple half-day trip, a quiet stroll in the woods, or an ascent among the peaks of the Alps and Apennines. Inland, the still-lively rural culture is reflected in the network of unique itineraries to be enjoyed on foot, by bicycle or car, with a nature guidebook to hand. These trips lead us into regional parks such as l’Aveto, l’Antola and Monte di Portofino in the province of Genoa, Bric Tana, Piana Crixia and del Beigua in the province of Savona, and Montemarcello, Porto Venere and Cinque Terre in theprovince of La Spezia. ltogether there are 16 protected areas, including parks, and land and marine nature reserves, waiting to be discovered. Portofino Regional Natural Park Portofino Protected Marine Area Cinque Terre National Park Cinque Terre Protected Marine Area The Portofino Regional Natural Park was established in 1935. It includes 1055 hectares of land within the municipal areas of Camogli, Portofino and Santa Margherita Ligure, and is responsible for three Sites of Special Interest for the Community (Portofino Park, the stream Rio Tuia-Montallegro and the holly- and pine-wood Pineta-lecceta delle Grazie). The particular geomorphologic features and micro-climatic conditions of this area mean that a wide range of plantlife can coexist here: from the mesophilic woodlands of the north-facing side to the Mediterranean scrub of the south-facing side, which are home not only to a vast range of flowers, but also to a remarkable variety of birds and invertebrates. An area of immense value in landscape terms, further enhanced by the presence of important monuments. The Portofino Protected Marine Area was established in 1999, and covers areas of coast and sea off Camogli, Portofino and Santa Margherita Ligure. Run by a consortium comprising the Province of Genoa, the municipalities of Camogli, Portofino and Santa Margherita Ligure, and the University of Genoa, its purpose is to protect marine resources and environments, and to promote and enhance local economic activities, provided that they are compatible with the area's significance in terms of landscape and nature. The protected environment consists of a largely steep coastline full of ravines, hanging walls and caves that facilitate the development of numerous living species. It is a world full of surprises, where you can view delicate micro-environments and sea-floors populated by a multitude of organisms, including red coral and gorgonia. The Cinque Terre protected Marine Area was declared in 1997. It covers one of the most varied and valuable areas of the Mediterranean sea. Along the spellbinding coastline of the Cinque Terre we find a succession of cliffs dropping sheer into the sea, bays, coves, caves and ravines among the rocks. This stretch of water, from the area around Punta Mesco in Monterosso, to that around Capo Montenegro in Riomaggiore, is home to a particularly rich and varied range of marine animal and plant species: uncountable gorgonias populate the rock faces, and along the coast Posidonia oceanica forms impressive, densely-packed meadows, a place of refuge and reproduction for innumerable life-forms. The steep rock faces of Punta Mesco and Capo Montenegro are home to extremely rare species such as the Gerardia savaglia, or black coral, and the magnificent fans of Paramuricea clavata, or red gorgonia. These two areas are the most heavily protected, since they are considered the marine areas of greatest value and variety. The ancient inhabitants of these places, driven by the absolute necessity to establish cultivable areas in a hostile environment, replaced the natural vegetation of these steep slopes with tightly-woven terraced vineyards, held up by a network of some 6,500 kilometres of dry stone walls. This mammoth task gave rise to a unique and unreplicable landscape. Nowadays, human activity here has dwindled, due to changes in the social and economic balance that have led to the gradual abandonment of traditional crops. The National Park seeks to safeguard and conserve this “territorial architecture”, with its historical, cultural, territorial and environmental values, by maintaining the vine-growing tradition. This is the only human activity that can preserve this landscape, which is part of the heritage of all humanity, and it will also ensure the continuity of typical local products, such as the highly-fragrant passito wine Sciacchetrà. INSIDE THE ABBEY THE TOMBS OF THE DORIA FAMILY THE UPPER CLOISTER THE DORIA TOWER FAI has a mission: to preserve wonderful places and open them to the public. And not only that: it is committed to keeping these places alive, maintaining and protecting them so that they will still be there for future generations to enjoy. In 1983, FAI was called upon to protect a unique jewel of Italian history and art, located in a soul-stirring little bay nestled beneath Monte di Portofino: the monumental complex of San Fruttuoso di Capodimonte. Opening hours are subject to change according to sea and weather conditions, and thus to the times of service boats from Camogli. HISTORY Legend has it that the complex dates back to the eighth century, when Prosperus, bishop of Tarragon, who was fleeing from Spain following the Arab invasion, chose the bay as a place to take refuge and build a church in which to house the relics of the martyr San Fruttuoso. The saint was soon venerated throughout Liguria, and attributed with special powers of protection for sailors. The presence of monks in San Fruttuoso is first documented in the year 984, when they were busy rebuilding the complex following the destruction and pillage of the Saracens. Much of the current abbey was built in the 10th-11th century. As from the 13th century, the destiny of San Fruttuoso was intertwined with that of the Doria family, who commissioned the reconstruction of the building, having the abbey complex built to overlook the sea, with its gallery featuring two orders of three-mullioned windows. In 1467, following the death of the last regular abbot, the Benedictine community left the monastery, and thus the abbey began an inexorable decline. Works at various different HOW TO GET THERE times altered the internal and external appearance of the church. Its gothic mullions disappeared under a layer of plaster, and the inside of the monastery was converted into a dwelling. In 1915 floods caused the first span of the church to collapse, and the debris carried down by the swollen stream formed the beach that lies in front of the complex. In 1933, the Liguria Monuments Office promoted restoration work to try to rectify the damage caused by the flooding, and the original triple mullions were restored in the seaward facade. This was the first sign of the revival of San Fruttuoso, which was completed when the complex was donated to FAI in 1983. Our first restoration project, carried out between 1985 and 1989, reinstated the original layout of the cloister, abbey, the Doria tombs and the capitular hall. Twenty years after the first restorations were begun, FAI completed some new and important work on the abbey church and the Doria tombs, in addition to updating the museum exhibits. SERVICES FOR THE PUBLIC Guided tours for groups (subject to reservation), guided tours and active tours for schoolchildren (subject to reservation), bookshop and selection of local products. Some areas of the Abbey can host private events, meetings, incentives, receptions, banquets, art exhibitions, cinema/publicity sets. All rentals contribute to supporting FAI's mission. Possibility of staying in a traditional Ligurian house. The village near the Abbey offers bars and restaurants. 8 9 INSIDE THE ABBEY On the two floors of the 13th century body of the abbey, recent restorations have revealed earlier Romanesque structures. Here a museum has been laid out, bringing together documentation of the abbey's history, the period and the life of the monks. In particular, the display tables on both floors contain table and kitchen ceramics used by the monks in the 13th and 14th centuries. The ceramics come from a range of origins (Liguria, southern Italy and the Islamic world), and were found in a store-cupboard discovered in the abbey during the restoration work. THE TOMBS OF THE DORIA FAMILY The lower level of the cloister leads to the deep vaulted chamber granted to the Doria by the monks as a place for burial. The typical two-tone tombs, with their alternating white marble and grey stone, are arranged in a row around three sides of the chamber. They consist of single or double masonry arches, most of which bear an epigraph, surmounted by small, pointed arches, supported on slender marble columns, with a saddleback roof. This is the final resting place of seven members of the Doria family, whilst there are two other tombs and a Roman sarcophagus whose occupants have not been identified. THE UPPER CLOISTER The upper cloister, built in the 12th century, was almost entirely rebuilt in the 1500s under admiral Andrea Doria, who added a cross-vault to the upper level, using capitals and columns from a range of sources. The capital in the photograph, for example, is Roman (late 2nd century AD), whilst others are Romanesque. The fine 10th-century Romanesque loggia in the background was closed during the restoration work in 1933, but has now been reopened, and overlooks the sea. THE DORIA TOWER Along the 16th-century road that leads from the abbey to the fishing village is a steep flight of steps up to the Andrea Doria tower, built in 1562 by the admiral's heirs, Giovanni Andrea and Pagano, to defend the village and its precious source of fresh water from Barbarian pirate raids. We recommend taking the 10.00 am boat, which will stop in the following locations: Riomaggiore, Manarola, Vernazza and Monterosso. We suggest a quick look around Riomaggiore before moving on to Monterosso where a lunch stop is programmed for around 1.00 pm. After lunch, free time to explore the village and its typical little shops. 3.00 pm, boat to La Spezia. On the way home, we suggest a quick stop in Vernazza, the most characteristic and famous of the villages. Return to Genoa, dinner (not included) and overnight stay. Some useful information: the programme described above can be followed by boat from 20 March to 31 October. During the rest of the year boat services do not run, but the same itinerary can be followed using the train that connects the villages. Thus, instead of the boat, the offer will include a train ticket and Cinque Terre card. 3rd day: Camogli and San Fruttuoso Breakfast at the hotel and independent transfer to Camogli. We suggest a stroll around the village before enjoying a tasty fish-based lunch (12.30 pm). In the afternoon, visit to San Fruttuoso, the last resort waiting to be discovered, which you can reach by sea or on foot. We suggest taking the 3.00 pm boat to the delightful bay with its famous abbey. Visit to the abbey and return to Camogli on the 4.00 pm boat. In 1993, on the 50th anniversary of the wartime devastation, the city received the Gold Medal for Civil Merit in memory of the victims. Nowadays, Recco has become a modern residential town, proud of its cultural, religious and gastronomic traditions, conscious of the benefits that its geographical position, with access to the sea and to the Apennines, has always brought it in terms of tourism and trade. Recco gastronomic evenings Recco's cuisine has earned it the title of Gastronomic Capital of Liguria, which in itself has become an attraction for tourists. "Serate Gastronomiche Recchesi" [Recco gastronomic evenings] is a big event, supported by the Recco Gastronomica consortium, and involves the presentation of sumptuous menus of typical Ligurian fare by the seven best-known local restaurants: a triumph of taste, flavour and tradition, a veritable hymn to the elevation of the local culinary culture. PLACES TO VISIT Saint Roch's Church Originally dedicated to Saint Terentian, it was changed to Roch, the patron saint of pilgrims at the time of the black plague in the 15th and 16th century. It now houses a permanent exhibition of nativity scenes, displaying 1,500 different examples from all around the globe. Tourist activities have gradually come to replace traditional seafaring work, but the appearance of the historic town has remained the same, clustered around the port, the parish church, the Dragone castle and the seafront promenade. Situated at the centre of the natural amphitheatre formed by Monte di Portofino, at the end of the Golfo Paradiso, it is sheltered from the cold north winds and from the humidity of the sirocco, and enjoys a mild climate, especially ideal for winter stays. Recent archaeological digs in the area of the hill known as “Castellaro” have uncovered evidence of a human settlement here as far back as the 12th century BC. The name of the town first appears as “Villa Camuli” in a medieval text dated to between 1018 and 1045. Over the centuries, this typical maritime village followed the fortunes of the nearby republic of Genoa. From the first half of the eighteenth century until the early years of the 19th, the vessels of the people of Camogli travelled the length and breadth of the Mediterranean sea and ventured out across the ocean, earning the town the epithet “City of a thousand white sailing ships”. The vast wealth gained from these voyages brought affluence to the town, leading the authorities to undertake an architectural transformation of Camogli, giving it the appearance we still see today. Bearing witness to its seafaring tradition are the Nautical Institute, the only home for retired seamen in Italy, and the Maritime Museum. ENVIRONMENT AND NATURE FEASTS AND TRADITIONS Camogli attracts considerable interest from tourists, thanks to its natural beauty, and particularly since both the Portofino Regional Natural Park and the Portofino Protected Marine Area extend into its territory, working for the conservation of Mediterranean biodiversity. There is an abundance of footpaths offering walkers a vast choice of itineraries all over the mountain area. The extraordinary beauty of the scenery to be found underwater is the main attraction for the thousands of divers who come to these waters each year. The most famous traditional feast in Camogli is held on the second weekend of May, and is dedicated to the martyr Saint Fortunato, here considered to be the patron saint of fishermen. On the Saturday evening, the distinctive ark of the saint is carried in procession, after which the two neighbourhoods light bonfires and a spectacular firework display is given. On the Sunday a fish-fry is held, a big gastronomic event, with crowds gathered around a 4metre wide frying pan with a sixmetre handle that serves as a chimney for the fire below. In August the equally redolent Stella Maris festival takes place, beginning with a parade of decorated boats, and ending late in the evening with the gulf lit up by thousands of coloured candles floating out to sea. ART AND CHURCHES FOOD Camogli has a number of religious buildings of considerable importance: the Basilica of Our Lady of the Assumption in Piazza Colombo, with its distinctive courtyard, laid using the “risseu” technique of white and grey stones collected from the beach and skilfully arranged to form images and geometrical designs; the Oratory of Saint Prosperus and Saint Catherine; the Olivetan Benedictine Monastery of Saint Prosperus; the Chapel of Saint Ann; and the Sanctuary of Our Lady of the Woods, which houses a collection of sailors' ex votos from the 16th and 17th centuries. In the outlying hamlets, some particularly old and beautiful places of worship include the “Millenaria” church, the Romanesque church of St. Nicholas and the Abbey of St. Fruttuoso. Those who appreciate good food will be spoilt for choice amongst the various restaurants with their authentic, traditional cuisine. The main specialities are typical Ligurian dishes prepared with great simplicity using local produce: trofie, pansoti, fish dishes, stuffed dishes and vegetable pies. Snacklovers can enjoy a typical focaccia with its simple, natural seasoning, or a tasty bite out in the warm sunshine. A haven of peace, this is a favourite destination for artists from far and wide, a stage for national and international happenings and events. Saint George's Church Romanesque in origin, badly damaged during the Second World War and reconstructed in 1950, it houses relics of its patron saint, brought by sailors returning from the Crusades. Brown Castle Surrounded by a Mediterranean garden brimming with flowers, rose-gardens and pergolas, it offers spell-binding views over the bay and on towards Punta Baffe. In the 17th century, it was further embellished with paintings by great Genoese masters of the period, such as Domenico Piola and Andrea De Ferrari. Magic Flute Park A fun park dreamt up by Emmanuele Luzzati, inspired by the famous opera by Mozart. San Girolamo della Cervara Abbey Complex The monastery was designed and built by Benedictine monks in 1361, but its finest moments were in the 15th and 16th centuries, during the latter of which the Saracen defence tower was built. In 1912 it was declared a national monument. In over thirty years of activity it has rescued and restored to society some important examples of Italian artistic and natural heritage, running and keeping alive places that would otherwise have been destined to disappear, including villas, castles, historical parks, old homes, gardens and natural areas. 39 properties currently belong to the Foundation, all of them having been donated, bequeathed or loaned for use: many of them, following meticulous restoration work, are now open for the pleasure of whoever wishes to view these educational models of conservation, which bear important witness to our history. This is both the work and the aim of FAI: to promote and spread a culture of respect for the beauty, art, history and traditions of our country, in the firm belief that knowing is the first step in learning to appreciate, and thus to defend, a heritage that belongs to all of us, and is part of our roots and our identity. Donated to FAI by Frank and Orietta Pogson Doria Pamphilj in 1983, it was opened to the public five years later, in 1988. Once a Benedictine Monastery, then a humble fishermen's abode, a pirates' den, it later became the property of the Doria princes for a number of centuries. The Doria tower dates from the 16th century, and was built to defend the village and its precious source of fresh water from Barbarian pirate raids. Today the Capodimonte complex is a truly unique site, where man's handiwork combines harmoniously with that of nature. . Inhabited until the late 20th century by the brothers Siria and Emanuele Carbone, the apartment on the piano nobile of the 17th-century house in via Riboli, free of any ostentation, lovingly and faithfully maintains the domestic atmosphere and lifestyle of the late 19th and early 20th century bourgeoisie. On the piano nobile, objets d'art, ceramics and fin-de-siècle furnishings make an intimate and animated setting for an important set of paintings from the 17thcentury Ligurian school. The flooring, of the same period, reflects the ornamental tradition of the Italian riviera, with lively mosaics rich in geometric and floral designs. The Carbone house lends itself to research work into a common past, consisting not so much of individual masterpieces, but rather of a history of day-to-day tastes, of a sense of home life in a period worth preserving in cultural terms. Located in Vicolo dei Caprettari, a typical alley of Ligurian towns, or “carruggio”, in the historic centre of Genoa, this little barber's shop is one of the oldest historic properties in the city. Measuring just ten square metres, the shop was opened by the barber Giacalone in 1882. A few decades later, in 1922, his son Italo had the interior decor updated to an art déco style. The shop belonged to Giacalone from 1922 until 1992, when the barber died, and it was acquired by the Genoa branch of FAI. Having restored it and reopened it to the public, FAI has entrusted its running to a well-known traditional barber from the city, who plies his trade there on a daily basis. The shop still enjoys the custom of many illustrious Genoese names, and its period decor features a spectacular array of mirrors and stained glass. On a background of traditional white tiles, the lively effect of the coloured glass on the walls and ceiling, in addition to the lamps and the reflections in the oval mirrors, surrounds and astounds visitors. The castle complex is the fruit of a succession of extensions to the original 13th century stronghold; it was embellished in the 16th century with the construction of the elegant "grotesque" hall and a fine gallery with frescoes. The nearby parish church also features some splendid 15th century frescoes. Over a thousand years of Piedmontese and Italian history are encapsulated at the centre of this vast and impressive 19th century park: the former residence of the Valperga counts, descendants of King Arduino, the castle dominates the Canavese plains, and is embellished with frescoes and sumptuous furnishings. Immersed in the green woods of the Varesotto, below Castelseprio archaeological park, this was a military outpost towards the end of the Roman empire, then passed through the hands of the Goths and Longobards before becoming a place of work and prayer for Benedictine nuns. Inside we find the famous secular frescoes of the “Guards' House” and the “Room of Love”, both dating back to the 14th century. Listed in the 1997 “Guinness Book of Records” as the smallest historic public theatre in the world, the Vetriano playhouse was built in 1890. A footpath allows us to fully enjoy its solemn beauty: the sea, rocks, sands, great rolling rocky hills covered with Mediterranean scrub and olive trees, farm cottages and the 16th century Montalto tower. This authentic jewel of archaeology and agriculture is located within the Valley of Temples park, where it has been restored to its former splendour after decades of neglect. The separate billing of elements of the same package shall not absolve the organizer or retailer from the obligations in this unit. The Cinque Terre are not just a gift of nature. Age-old rural wisdom and an active presence within this territory have struck a balance 2 LEGISLATIVE AND ORGANIZATIONAL SOURCES The contract contained in the brochures published herein, concerning the offer of a tourist package, is regulated by outstanding general conditions and Law n°1084 of 27/12/77 ratifying and implementing the International Convention on travel contracts signed in Brussels on 23/04/70, as well as the above-cited Legislative Decree 206 of 06-09-05 implementing Directive 90/314/EEC. The tourist packages provided for by the contract are organised by the operator Acquaclub - Incoming Liguria - via Filippo Turati 2/9 16128 Genoa- tel. 010-2345666 – Provincial Authorization n°205/40078 of 09-06-2000. Insured with Navale Assicurazioni spa, policy n° 4093265A, for a limit of liability of • 2,065,828.00. in the complex relationship between nature and culture. Sergio Fregoso 3 RESERVATIONS AND PAYMENTS The acceptance of reservations is subordinate to the availability of vacancies, and shall be perfected only at the time and place from which the organizer sends written confirmation, including by means of computer. It is noted that the retailer travel agency is legally a broker with regard to the organizer in accordance with art. 1.3 CCV as well as a retailer pursuant to art. 4 of Legislative Decree 206/2005, acquiring rights and assuming obligations exclusively as the agent of his principal - client. Manner of payment:ento: Upon reservation and confirmation by Incoming Liguria, payment must be made of the total amount of the matter. Failure to pay in the manner specified constitutes an express termination clause of the contract, which will result in its termination, without prejudice to any payment of the damages suffered by Incoming Liguria and by retailer travel agencies as a consequence of the forced cancellation of the contract. 4 PRICE The price of the tourist package is set forth in the contract. It can be modified up to 20 days prior to departure and only due to changes in: transportation costs, inclusive of the price of fuel; dues and fees on any kind of tourist service such as taxes, landing taxes, disembarkation or embarkation fees at ports or airports; and the exchange rates applied to the particular package. With regard to such changes, reference will be made to the rates of exchange and the cost of services effective as of the date of publication of the brochure, as reported therein. C I N Q U E T E R R E N AT I O N A L PA R K C i n q u e Te r r e P r o t e c t e d M a r i n e A r e a 5 WITHDRAWAL WITHOUT PENALTY The consumer can withdraw from the contract without paying the price in the following cases: -increase in the price of the packages in an amount in excess of 10%; -material change of another essential element of the contract (understood as being any change in price on items that can objectivelybe considered to be fundamental for the purposes of the enjoyment of the tourist package considered overall) proposed by the Organizer after the conclusion of the contract but prior to departure, which is not accepted by the consumer. It is specified in this regard that the consumer must notify Incoming Liguria in writing of his decision to accept or withdraw within two business days from receipt of the proposed change. In the case of withdrawal, the consumer will be entitled to the refund of the amounts already paid or, in alternative, to a substitute tourist package of equivalent quality. 6 WITHDRAWAL BY THE CONSUMER In the case of withdrawal from the travel contract, Incoming Liguria will apply the following penalties, in addition to a fixed amount of 25.00 Euro for opening the file: -10% of the total amount of the services up until 45 days prior to departure; -20% of the total amount of the services from the 44° through the 30° day prior to departure; -30% of the total amount of the services from the 29° through the 15° day prior to departure; -50% of the total amount of the services from the 14° through the 4° day prior to departure; -100% of the total amount of the services after such term. 7 CANCELLATION OF THE TOURIST PACKAGE In the event that, prior to departure, the organizer advises that it is unable to provide the services included in the tourist package, the consumer can alternatively exercise the following rights: he can accept a substitute tourist package of equivalent quality, or, if unavailable, of a higher quality without any price increase, or of a lower quality, with the refund of the difference in price; or the refund of the part of the price that has already been paid. Such refund must be made within 7 business days from the time of receipt of the notice of the decision requesting a refund. The consumer must give notice of his decision (to accept the change or to withdraw) within and no later than two business days from the proposal for an increase and/or change. In the lack of express notice within the above term, the proposal made by the Organizer will be considered to have been accepted. 8 CLARIFICATIONS WITH REGARD TO WITHDRAWAL The effects of the consumer’s withdrawal or the cancellation of the tourist package are regulated in full by the above articles 6 and 7, which substantially reproduce the provisions of articles 90-91-92 of Legislative Decree 206/2005. They therefore represent a fair balance between the contractual parties, also in accordance with the provisions set forth in art. 1469 ter. of the Italian Civil Code (introduced by Law 52/96, implementing Council Directive 93/13/EEC regarding vexatious clauses in consumer contracts), according to which “clauses that reproduce provisions of law are not vexatious”. 9 CHANGES AFTER DEPARTURE In the event that after departure the organizer finds that it is unable to provide an essential portion of the contractual services,regardless of the reason unless due to the consumer, it must make alternative arrangements without price increases to be borne by the consumer, and in the event the services provided are for a lower value with respect to those that had been planned, it must compensate him for the amount of such difference. In the event that no alternative arrangement is possible, or the solution planned by the organizer is not accepted by the consumer for serious and justified reasons, the organizer shall provide, without an increase in price, a means of transportation that is equivalent to the original transportation back to the place of departure, or to another place that might eventually be agreed upon, compatibly with the availability of the means and vacancies, and will pay the consumer the price difference for the services performed through the time of an early return. 10 SUBSTITUTIONS IA consumer who waives the package can be substituted by another person as long as: -the organizer is informed in writing at least 4 business days prior to the date set for departure, receiving at the same time a communication with the details of the transferee; -The transferee satisfies all of the conditions applicable to the service (art. 89 Legislative Decree 206/2005), specifically the requirements regarding passport, visas, health certificates, hotel accommodation, transportation services or in any event such as to render the use of the package impossible by a person other than the customer waiving the package; -the transferee shall reimburse the organizer all of the expenses sustained in order to arrange the substitution in the amount quantified upon notice of the transfer. The consumer waiving the package must in any event pay the registration fee, if any. He will further remain jointly liable with the transferee for the payment of the balance of the price, as well as the amounts set forth in clause c) of this article. 11 LIABILITY The organizer shall be responsible for damages caused to the consumer due to the non-performance or improper performance of the contractual services, whether they are performed personally by it or by third party service providers, unless it proves that the breach was due to the consumer (inclusive of autonomous initiatives taken by the latter during the course of performance of the tourist services) or to facts that do not fall within the provision of the services provided in the contract, due to unforeseeable events, force majeure, or circumstances that the organizer could not, in accordance with professional diligence, reasonably expect or remedy. The retailer used to book the tourist package is not in any event liable for the obligations arising from the organization of the trip, but is exclusively liable for the obligations arising from his position as a intermediary and in any event within the limits for such liability provided by the above cited laws or conventions. 12 LIMITS ON DAMAGES The payment of damages due by the organizer cannot in any event be in excess of the compensation allowed by international conventions governing the services whose breach resulted in the liability, both contractually as well as extra-contractually, specifically the Warsaw Convention of 1929 on international carriage by air, with reference to the text amended by the Hague Protocol in 1955; the Bern Convention (CIV) on railway travel; the Paris Convention of 1962 on the liability of hotel-keepers, with reference to the text set forth in articles 1783 et seq. of the Italian Civil Code; the Brussels Convention of 1970 (CCV) on the organizer’s liability. In any event the limit of compensation for damages other than personal injury cannot exceed the amount of “5000 germinal gold francs for any other damage” provided by art.13 no. 2 CCV. In the event the original texts of the above conventions are amended, or new international conventions regarding the services included in the tourist package become effective, the limits on compensation provided by the sources of uniform law in effect at the time of the occurrence of the damaging act will be applicable. 13 CLAIMS AND COMPLAINTS Every breach of performance of the contract must be contested by the consumer without delay so that the organizer, its local representative or the accompanying person can cure it in a timely manner. The consumer can also make a complaint by sending a registered letter with return receipt to the organizer or retailer, within and no later than 10 business days from the return date to the place of departure. 14 INSURANCE FOR CANCELLATION EXPENSES Unless expressly included in the price, at the time of the reservation it is possible – and indeed advisable – to take out, care of the organizer’s or retailer’s office, a special insurance policy to cover the expenses deriving from cancellation of the package. The cost is calculated as 4.9% of the total of the trip. 15 GUARANTEE FUND A National Guarantee Fund is being created care of the Presidency of the Council of Ministers that the consumer can apply to, in accordance with art. 100 of Legislative Decree 206/2005, in the case of insolvency or bankruptcy of the retailer or organizer. Validity of the programme: from 01-01-2008 through 3112-2008 GENERAL CONDITIONS OF CONTRACT FOR THE SALE OF INDIVIDUAL TOURIST SERVICES a) REGULATION PROVISIONS Contracts concerning the offer of just transportation service, accommodation, or any other separate tourist service, which cannot be considered as a contract for the organization of a trip or tourist package, shall be regulated by the following provisions of the CCV: art. 1 no. 3 and no. 6; articles 17 to 23; articles 24 to 31, with regard to provisions other than those related to an organization contract as well as the other agreements specifically referring to the sale of the individual service provided for by the contract. b) CONTRACTUAL CONDITIONS The following clauses of the general conditions of contract for the sale of tourist packages set forth above shall also be applicable to said contracts: art. 3, art. 6, art. 7, art. 8, art. 9, art. 10 1°clause, art. 11, art. 12, art. 14. The application of said clauses shall by no means result in the relative contracts being considered as tourist packages. The terminology of the cited clauses relative to the tourist package contract (organizer, trip, etc.) must therefore be understood with reference to the corresponding figures of the sales contract for individual tourist services (retailer, accommodation, etc.). PRIVACY The personal data collected above will be processed, with or without the assistance of electronic systems and can be communicated to the service providers. The data controller is INCOMING LIGURIA SRL. The client can have access at any time to the data that regards him, update it, correct it, supplement it and more generally, exercise the rights provided by article 7 of the Privacy Law (Legislative Decree no. 196/2003). Mandatory notice in accordance with art. 17, clause 1 of Law no. 38 of 06/02/2006. The law punishes crimes relating to child prostitution and pornography with imprisonment, even if committed abroad.
