As a service to members of the Dauphin County Bar Association, a brief
synopsis of verdicts from each civil trial term will be printed.
Summary of Verdicts from the October 2006 Civil Jury Term.
The Judges have completed the October 2006 civil jury term. A total of five cases
reached verdict. The summaries are as follows:
EAST HANOVER TOWNSHIP v. CIVIL & ENGINEERING DESIGN GROUP,
INC. and TODD STAGER (841 CV 2005)
This case arose out of allegedly faulty design plans for repairs to a wetlands sewage
treatment facility in East Hanover Township. The facility was originally designed
by the engineering firm of Erdman Anthony and the system was put into
operation in the spring of 2000. When the plant began to operate, problems
developed which could not be fixed by Erdman Anthony. In November 2000,
Defendant Civil & Engineering solicited East Hanover to appoint the firm as the
Township engineer. Plaintiff alleged that Defendant Civil & Engineering
represented that it had extensive experience in designing wastewater facilities. As
a result, Civil & Engineering was appointed as the Township engineer
commencing January 1, 2001. Civil & Engineering was also the operator of the
sewer system. The two major problems with the wetlands sewage treatment
facility were malodors and the inability of the facility to meet NPDES permit
limitations for ammonia nitrate. In July 2001, defendant made arrangements for
Bill Wolverton, Ph.D. to make the assessment of the system. Wolverton issued a
report which indicated that the facility could be brought into compliance with its
NPDES permit if certain alterations were made. Plaintiff alleged that these
revisions failed to bring the system into compliance and forced the township to
close the existing facility and construct a new one.

This motor vehicle accident occurred on Third Street in Lemoyne while Plaintiff was
waiting to make a left turn. Plaintiff’s vehicle was struck from behind. Plaintiff’s
vehicle was totaled, he had current medical expenses of over $40,000.00 and
continuing pain and unresolved back problems. Defense IME - Dr. Perry Eagle.

KEITH PAUL HARTMAN v. COMMUNITY LIFETEAM, INC. (5542 CV 2003)
Plaintiff, a fifty year old morbidly obese man, was in the process of being transferred
by Defendant ambulance company to a chronic care facility. The plaintiff was
placed on a litter which tilted dumping the plaintiff to the ground and causing a
chip fracture of his elbow. No casting was necessary however there were several
trips to the hospital. Plaintiff claimed he was not able to work for one month and
this fracture interfered with his rehabilitation following gastric bypass surgery.

This motor vehicle accident occurred in the vicinity of the Farm Show building. It
was alleged that Defendant’s car careened off of the highway into the parking lot
and struck Plaintiff’s vehicle. Defendant pled guilty to reckless driving and
careless driving. Liability was admitted.

driving against oncoming traffic resulting in a head-on collision with Plaintiff’s
vehicle. The tortfeasor died. Defendant’s estate admitted liability and causation.
