Appendix “E” Page i Phase I ESA 1215 Appleby Line, Burlington, Ontario 1.0 June 28, 2013 130035-2 EXECUTIVE SUMMARY This Phase I Environmental Site Assessment was done at the request of Sam Mercado of OMS Management Services Inc. It was understood that this Phase I ESA report is to be used as part of the submission requirements to the City of Burlington for zoning and building permit application purposes. It was also understood that it will be used for mortgage purposes. The study and report included the review of two previous environmental reports carried out by AMEC Earth and Environmental which were provided to us by Sam Mercado. The study was done in accordance with CSA guidelines (Z768-01). Our main findings are that the site has been used mainly for farming and horse raising purposes. Because of this AMEC carried out testing for samples for metals and Inorganics and for the presence of OCPs (organochlorine pesticides). We compared the AMEC’s raw data of the laboratory results done by Agat Laboratories for metals and inorganics and found that they meet the current Ministry of The Environment O. Reg 511/09 for General and Inorganic parameters against Table 1 for residential land use. No herbicides or pesticides were detected in any of the samples tested for OCPs. Consequently, herbicides and pesticides are no longer considered to be potential contaminants at the site. Another concern AMEC had at the site was the possible presence piles of fill consisting of construction and soil materials on isolated parts of the site. However, at the time of our investigation we did not find any such piles of fill. Further we also took three samples of the surficial materials from the site and tested them for Metals and Inorganics by Agat Laboratories and found that each sample tested met The Ministry of The Environment O. Reg 511/09 for General and Inorganic parameters against Table 1 for residential land use. Based on our results and AMEC’s test results of the samples tested for Metals and Inorganics, potential contaminants from fill material is no longer a concern at the site. An abandoned former water well was found at the northern part of site. This well is of some concern at the site as it appears that it had not been properly decommissioned and we recommend that it be decommissioned by a licensed well contractor in according with O. Reg. 903. A Freedom of Information requests for records of any environmental issues at the site has been made through the Ministry of The Environment (MOE). These reports have not yet been received. They typically take about four weeks to obtain and they will be forward to you as soon as they become available. Page 1 Phase I ESA 1215 Appleby Line, Burlington, Ontario 2.0 June 28, 2013 130035-2 INTRODUCTION AND SCOPE OF WORK Canada Engineering Services Inc., was authorized by Ms. Sam Mercado, of OMS Management Services Inc., to carry out a Phase I Environmental Site Assessment of the site located at 1215 Appleby Line, Burlington, Ontario, with a legal address of Lot 5, Concession 2, South of Dundas Street, Part 1 on Plan20R-16945, Regional Municipality of Halton, City of Burlington, Ontario. The site is approximately 1.20 hectares in size. It was understood that this Phase I ESA report is to be used as part of the submission requirements to the City of Burlington for zoning and building permit application purposes. It was also understood that it may be used in the future for mortgage purposes. The scope of work undertaken, consisted of a Phase I Environmental Site Assessment, in accordance with CSA guidelines (Z768-01). The study consisted of the following four basic steps: a) b) c) d) 3.0 a records review; a site visit; interviews; and evaluation of information and reporting. SITE GEOLOGY The surficial geology at the site, as published in 1986 in Map 2509 Quaternary Geology, Hamilton Area, consists of: Halton Till: Consisting of clay or silt till. The bedrock geology at the site, as published in 1976 in Map 2336 Paleozoic Geology in Hamilton, consists of : Queenston Shale Formation. 4.0 SITE DESCRIPTION The site is located at 1215 Appleby Line, Burlington, Ontario, in a built up mixed commercial and industrial area. For convenience Appleby Line is taken as running in an East-West direction. The site is bounded by Appleby Line on the south side, a commercial car wash and a car maintenance facility (AutoSpa) on the west side, a storage building facility on the east side and an ice rink Appleby Ice Centre. To the north of the property is Appleby Creek which is within less than 30 m from the site. Page -2- Phase I ESA 1215 Appleby Line, Burlington, Ontario June 28, 2013 130035-2 Further north, beyond Appleby Creek is Walker Industries Norjohn Transfer Systems Limited [waste transfer station] (5030 Mainway) and various kinds of other industrial buildings and further south beyond Appleby Line are industrial buildings, the closest being Samuel Metal Processing Company Limited, a steel fabricating factory. Further west beyond the car wash and car maintenance facility is a modern Shell gas service centre followed by Mainway (name of a street). The subject lands are gently sloped towards Appleby Line, in the front and toward Appleby Creek to the north. Appleby Creek on the north side of the site is within 30 m from the subject property, which makes it a sensitive site. The site is currently a vacant field and at the time of the investigation was predominantly covered with tall grasses. Generally groundwater and surface water flow is expected to flow toward the Appleby Creek or to the East. The surrounding properties of relevance to the site are the following: 1. The AutoSpa located immediately to the west of the site with its building and operating facilities about 20 m away. 2. The Shell gas station located just next to AutoSpa and about 125 m west of the subject site. 3. The Appleby Creek located within less than 30 m to the northern part of the site, which makes it a sensitive site, which means that all environmental sampling and testing must Ministry of The Environment O. The Walker Industries Norjohn Transfer Systems Limited [waste transfer station] located across the Appleby Creek at 5030 Mainway which is about 75 m East of the site. 5. The Namasco Steel Factory located across Appleby Line approximately 40 m away from the site. The sign on the building now says Samuel Metal Processing. Based on the types of operations, the length of time they have been in business, and most likely direction of groundwater flow toward Appleby Creek and the relatively impermeable surficial soils of dense clay and silt tills found at the site from our geotechnical investigation, it is our opinion that the potential of contaminant migrations from these surrounding facilities onto the subject site is very low and is not a concern at the subject site. All sampling and testing carried out at the site have so far met Ministry of The Environment O. Regulation 511/09 for General and Inorganic parameters Table 1 requirements for residential land use. Page -3- Phase I ESA 1215 Appleby Line, Burlington, Ontario 5.0 June 28, 2013 130035-2 RECORDS REVIEW The records review consisted of the following steps: Aerial Photographs Property use records Title Search records Prior Phase 1 ESA reports Company records Geological and Geotechnical Reports Regulatory information 5.1 Aerial Photography The 1934, 1962, 1974, 1979, 1986 and 2001 aerial photographs reviewed from the Phase I ESA Report prepared by AMEC Earth & Environmental (Project No.: TB7102007, July 12, 2007), for the site indicated that the subject property and surrounding areas were used for farming purposes between 1934 and 1979. It was found that commercial/industrial development was observed southeast of the subject property in the 1986 aerial photograph. The 2001 aerial photograph shows an industrial building located south of the site on the other side of Appleby Line. In addition, Appleby Line, the ravine and Appleby Creek were all present in all the aerial photographs. The 2011 aerial photograph, which was obtained from The City of Burlington, shows the subject property with very little change since 2001 with the exception of the development of a storage facility and an A & W restaurant east of the site. See aerial photographs in Appendix “A”. 5.2 Property Use Records and City Directory Records 5.2.1 A search for fire insurance maps was undertaken in the Phase I ESA prepared by AMEC Earth & Environmental (Project No.: TB71020, July 12, 2007) but no fire insurance maps were found. This search was not repeated but the findings by AMEC was taken as accurate. See fire insurance map report in Appendix “B”. 5.2.2 Addresses at 1175, 1201, 1215, 1250 Appleby Line, 4499 and 5030 Mainway were checked in Mike’s city directories and found to exist from 1962. For the site, the oldest listing found was 1962. The listings found for the subject property were of private individuals from 1962 to 1982 and it was listed as vacant from 1983 to 1990. The site was not listed thereafter. Page -4- Phase I ESA 1215 Appleby Line, Burlington, Ontario June 28, 2013 130035-2 The listings found for 1175 Appleby Line indicate that a number of commercial/industrial companies like Mastron Scale Limited, Garlock of Canada, Stanley Air Tools, Waste Quality Management, Medallion Plastics, FEL Group, Are-o-Flo Environment, Price Manufacturing Inc., Bay Park Steel Manufacturing, Neath Industrial Safety, Amcast Industrial, Parts Headquarter Inc., Milacron Canada, Mueller Door Decor Inc., Fab-Tex Filtration, Bower’s Medical Supply, Detail Merchandising Inc., Ultra Pure Water Quality and Elkhart Products Inc., occupied the property from the mid 1980's to 2005. Only one listing was found for Golden Horseshoe Hockey League from 2002 to 2005 for the property at 1201 Appleby Line. The listings for 1250 Appleby Line indicated that Stelco Inc., occupied the property from 1980 to 1995 and was then occupied by Namasco Limited from 2000 to 2003. Only one listing was found for the properties at 4499 and 5030 Mainway, which was occupied by Pioneer Petroleums in 2005 and Norjohn Transfer Systems Limted in 1990 to 2005 respectively. 5.3 Title Search and Assessment Rolls 5.3.1 Title Search records were conducted and our detailed findings are shown in Appendix “B.” The property was owned by private individuals up to 1985, where it was re-planned and was owned by The Corporation of the City of Burlington. It changed hands to Cooper Corporation in 1989 and was then sold to Paletta International (1990) Inc. The property was then sold to 2145489 Ontario Inc., who are the current owners. 5.3.2 Assessment Roll records were not checked, as it was not considered necessary. 5.4 Prior Phase I Reports and Geotechnical Reports A check was made with the current owner and no geotechnical reports were available but an earlier Phase I ESA was available. Phase I ESA Report was prepared by AMEC Earth & Environmental (Project No.: TB71020, July 12, 2007). The main concerns that AMEC found with the site were as follows: 1. The possible presence of herbicides and pesticides on the property due to past uses as a farm and for raising horses. Page -5- Phase I ESA 1215 Appleby Line, Burlington, Ontario June 28, 2013 130035-2 2. “A historic water well was identified at the north portion of the property. The casing was concrete and appeared to be filled in with soil of unknown quality. As noted in Section 4.5, well coordinates and a log obtained (by others) from the Ministry of the environment identified a water well for domestic use that relates to a home that was located south of the Site. Well 28-3302 was drilled for domestic uses with a casing diameter of 762 millimeters and a static water level reported at 5.49 m on completion in December 1969.” The environmental risk was considered low and it was recommended that this well be decommissioned. 3. This AMEC reported stated, the presence of , “piles of fill material consisting of concrete, wood, brick, topsoil, gravel, and sod at the south central portion of the property (along the gravel entrance) and along the northern property boundary. No deleterious materials (such as refuse /debris or visible discoloration) were observed within the fill. No chemical analysis of the fill material was available, and therefore the quality is unknown. 4. As a result of first item above, a follow up report was carried out by AMEC (report no. 7102001 dated August 7, 2007). See Appendix “E”. This report was provided to us and was reviewed by us and in this report AMEC carried out testing on five (5) soil samples, including a duplicate, for organochlorine pesticides (“OCP”), and two samples for metals and inorganics testing. No OCP was detected in any of the samples tested and both of the samples tested for metals and inorganics met the Soil, Ground Water and Sediment Standards for Use under Part XV.1 of the Environmental Protection Act”, dated 9 March, 2004. The raw results were compared to and found to meet the current requirements for Ministry of The Environment O. Regulation 511/09 for General and Inorganic parameters against Table 1 for residential land use. In our opinion there is no longer a concern at the subject site with regards to OCPs. 5. The second item above is still of some concern to us and it is recommended that the well be decommissioned by a licensed well drilling contractor in accordance with O. Reg 903. 3. The third item above is no longer a concern as we did not find these stockpiles of fill on the site and presume that they have been hauled off the site. Further, CESI also took three samples of the surficial materials from the site and tested them for Metals and Inorganics by Agat Laboratories and found that each sample tested met the Ministry of The Environment O. Regulation 511/09 for General and Inorganic parameters against Table 1 for residential land use. See CESI report in Appendix “E”. Based on our results and AMEC’s test results of the samples tested for Metals and Inorganics, potential contaminants from fill material is no longer a concern at the site. Page -6- Phase I ESA 1215 Appleby Line, Burlington, Ontario June 28, 2013 130035-2 In their Phase I ESA report, AMEC Earth & Environmental mentioned that two previous reports were provided to them by the site representative and they are as follows: 1. “Supplementary Phase I Environmental Evaluation, Parts Lot 5 Concession II, 1215 Appleby Line, City of Burlington”, dated October 16, 2006, by Bruce A. Brown Associates Limited. 2. “Phase I Environmental Assessment, Parts Lot 5 Concession 2, 1215 Appleby Line, City of Burlington”, dated February 26, 2004, by Bruce A. Brown Associates Limited. Both reports did not indicate any significant findings except for construction of a building to house Jiffy Lube and Car Wash on the neighbouring land to the west and that no evidence of fill being dumped on the property was found. These reports were not available to us and since AMEC had not remarked on any major concerns mentioned in these reports, we did not consider it necessary to follow up in trying to find them. 5.5 Company Records There are no company records available, as there is no evidence that the subject property was used as a company or business. A site visit was conducted for the vacant plot of land on the subject properties and no signs of any potential contaminants were found. 5.6 Geological and Geotechnical Reports A check was made with the current owner and no geotechnical reports were available, but two Phase I ESA reports carried out by AMEC Earth & Environmental in 2007 and two Bruce A. Brown Associates Limited reports in 2006 and 2004 were reported to have existed. The only reports available to us were the two AMEC reports which referenced the two Bruce A. Brown Associates reports, with the only minor concern being the construction of the AutoSpa to the west of the subject site. We carried out a geotechnical investigation at the site and found that the surficial soils at the site consist of clay tills and silt tills and shale bedrock of the Queenston Shale Formation. This report is pending and will be issued soon. We were also commissioned to sample and test the surficial soils at the site for Metals and Inorganics Ministry of The Environment O. Regulation 511/09 for General and Inorganic parameters against Table 1 for residential land use. This was done by us on April 7, 2013 and its number is 130035-1. Page -7- Phase I ESA 1215 Appleby Line, Burlington, Ontario 5.7 June 28, 2013 130035-2 Regulatory Information None were available. 5.8 Optional Records Review None was done. 5.8.1 Inventories of Waste Disposal Sites The Ministry of the Environment (MOE) Waste Disposal Site Inventory of 1991 was checked and no such sites were found within 1 kilometer of the subject property. Reviews of the Anderson’s Waste Disposal Sites and the National Defence & Canadian Forces Waste Disposal Sites databases were also made as part of the Ecolog databases search. No such sites were found within 0.25 kilometers of the site. 5.8.2 Inventories of Industrial Sites Producing or Using Coal Tar and Related Tars The Inventory of Industrial Sites Producing or Using Coal Tar and Related Tars in Ontario was checked and no such sites were found within 1 kilometer of the site. 5.8.3 Inventories of Coal Gasification Plant Waste Sites in Ontario The Inventory of Coal Gasification Plant Waste Sites in Ontario was checked and no such sites were found within 1 kilometer of the site. 5.8.4 Inventories of Ontario PCB The National PCB Inventory and Inventory of PCB Storage Sites databases were checked as part of the Ecolog databases search. No such sites were found within 0.25 kilometers of the site. Page -8- Phase I ESA 1215 Appleby Line, Burlington, Ontario 5.8.5 June 28, 2013 130035-2 Database of MOE Waste Generator The MOE Waste Generator Database was checked as part of the Ecolog databases search. No records were found for the subject property and 17 records were found within 0.25 kilometers of the site. Five records were found for Stelco Fastener & Forging Company, fastener shipping and distribution centre, located at 1250 Appleby Line and approximately 50 m south of the subject property. These records were for the years 1986, 1987 and 1994. The wastes generated were described as acid waste - heavy metals and waste oils and lubricants. One record was found for Stelco Wire Products Company, a rod processing plant, located at 1250 Appleby Line and approximately 40 m south of the subject property. This record was found for the years 1986 and 1987. The wastes generated were described as spent pickle liquor, acid waste - heavy metals, alkaline wastes - other metals, other specified inorganics and waste oils and lubricants. Three records were found for Stelwire, The Wire Products Company, a wire product company, located at 1250 Appleby Line and approximately 40 m south of the subject property. These record were for the years 1989 and 1990. The wastes generated were described as spent pickle liquor, acid waste - heavy metals, other specified inorganics, aliphatic solvents, petroleum distillates, waste oils and lubricants and detergents/soaps. One record was found for Namasco Limited, a stamped metal company, located at 1250 Appleby Line and approximately 40 m south of the subject property. This record was for the years 2000 to 2005. The wastes generated were described as waste oils and lubricants, neutralized wastes - heavy metals, other specified inorganics, petroleum distillates and oil skimmings and sludges. Two records were found for The City of Burlington, Appleby Ice Centre, a recreational centre, located at 1201 Appleby Line and approximately 80 m east of the subject property. These records for the years 2000 to 2001 and 2002 to 2005. The wastes generated were described as waste oils and lubricants and oil skimmings and sludges. Two records were found for Parts Headquarters Inc., a machinery wholesaler, located at 1175 Appleby Line, UnitC2 and approximately 150 m east of the subject property. These records were for the years 1993 to 1996 and 1997 to 2001. The wastes generated were described as petroleum distillates and waste oils and lubricants. Two records were found for Cincinnati Milacron-Canada Limited, a petroleum products wholesaler, located at 1175 Appleby Line, Unit B1 and approximately 150 m east of the subject property. These records were for the years 1995 to 1998 and 1999 to 2001. Page -9- Phase I ESA 1215 Appleby Line, Burlington, Ontario June 28, 2013 130035-2 The wastes generated were described as alkaline wastes - other metals, neutralized wastes other metals, light fuels, halogenated solvents, halogenated pesticides, emulsified oils, phenolic wastes and amines. No records are available prior to 1986, when the Ministry of the Environment started collecting and recording this information. As mentioned earlier, based on the types of operations, the length of time they have been in business, and most likely direction of groundwater flow toward Appleby Creek and the relatively impermeable surficial soils of dense clay tills and silt tills found at the site from our geotechnical investigation, it is our opinion that the potential of contaminant migrations from these surrounding facilities onto the subject site is very low and is not a concern at the subject site. All samples and testing carried out at the site have so far met Table 1 of O. Reg. 153/04. 5.8.6 Occurrence Reporting Information System Database The Occurrence Reporting Information System database was checked via the Ecolog search that AMEC had commissioned and 8 incidents were found for Stelco Fastener and Forging Company and Stelwire, located at 1250 Appleby Line, approximately 40 m south of the site. Acids can easily be neutralized by water and there is a high range for ferrous compounds in the guidelines. Also, due to the distance apart of this site and the subject property, the relatively impermeable surficial soils found at the site, it is highly unlikely that any of these will reach the site. The other spillages are minor and will not reach the site. 5.8.7 Database of MOE Waste Receivers The MOE Waste Receivers Database was checked via the ecolog search we commissioned and no records were found within 0.25 kilometers of the site. 5.8.8 Scott’s Manufacturing Directory The Scott’s Manufacturing Directory database was checked via the Ecolog search that AMEC had commissioned and no records were found for the subject property and 14 records were found within 0.25 kilometers of the site. In the case of the property located at 1250 Appleby Line, which is upstream of the site for the likely groundwater flow direction, the documented spills mentioned earlier are not a likely source of contaminants to the subject property. Page -12- Phase I ESA 1215 Appleby Line, Burlington, Ontario 5.8.9 June 28, 2013 130035-2 MOE - Freedom of Information Act Freedom of Information request for records of any environmental issues at the site has been made through the Ministry of The Environment (MOE). These reports have not yet been received. They typically take about four weeks to obtain and they will be forward to you as soon as they become available. 6.0 SITE VISITS Site visits were carried out on April 17, May 29 and June 26, 2013. During these visits, the site was observed and were found to be vacant with a steel framed billboard structure located at the south portion. There were very little changes from the surrounding areas except for a recently built storage building (Storage Spot in Burlington) and a newly built restaurant (A & W restaurant) immediately east of the subject property since the AMEC report of 2007. From an earlier Phase I Environmental Site Assessment done by AMEC Earth & Environmental (Project No.: TB71020, July 12, 2007), it was reported that there were piles of fill material consisting of concrete, wood, brick, topsoil, gravel and sod at the south central portion of the site and along the north property boundary. However, during our site visits, none of the above-mentioned fill piles were found, which may indicate that fill piles were previously removed and hauled off site. In addition, an environmental sampling report titled “Environmental Chemical Testing for Proposed Commercial Development and Neighbouring Soil Stockpile”, done by Canada Engineering Services Inc., (Report No. 130035-1, dated April 24, 2013), was done for the subject property. Three samples were taken close to the boundaries of the subject property and one sample was taken in the neighbouring fill stockpile for chemical analyses. The samples were taken to Agat Laboratories and tested against the Ministry of The Environment O. Regulation 511/09 for General and Inorganic parameters against Table 1 for residential land use. All four samples met the requirements of the regulation for residential land use. 6.1 Spills, Surface Staining and Stressed Vegetation CESI carried out a site reconnaissance of the subject to check for the presence of stressed vegetation, any areas of surface staining, or any other potential indicators of former surface spills or leaks. No areas of surface staining or stressed vegetation were observed at the Site at the time of the site visit. Page -13- Phase I ESA 1215 Appleby Line, Burlington, Ontario 6.2.1 June 28, 2013 130035-2 Aboveground Storage Tanks No ASTs were found at the site and there was no information in any of the historical data reviewed that indicated the present of any. As well a check with Mr. Prem Lal of TSSA revealed that there were no records of these at the site. 6.2.2 Underground Storage Tanks No USTs or any vent pipes structures protruding from the ground were found at the site and there was no information in any of the historical data reviewed that indicated the present of any. As well, a check with Mr. Prem Lal of TSSA revealed that there were no records of any USTs at the site. 6.3.1 Liquid Waste The site was used primarily for farming and raising horses and did not generate, store or dispose of liquid wastes at the time of the site reconnaissance, or as found from the historical data on the site. The site is not listed in the 2004 MOE computer database as a registered generator of liquid industrial or hazardous waste. 6.3.2 Solid Waste No solid wastes were generated, stored or disposed of at the Site during the reconnaissance. Also, the site is not listed in the 2004 MOE computer database as a registered generator of solid hazardous waste. 7.0 INTERVIEWS 7.1 Third Parties During our site visits to the site, an interview was conducted with the current owner in regards to the history of the site and current operations. Mr. Toby Singlehurst of 2145489 Ontario Inc., current owner of the subject property was contacted. He said that he bought the property since August of 2007 from Paletta International and that prior to buying the property, two environmental reports were carried out by AMEC Earth & Environmental. He also said that the property was purchased on the basis that no environmental concerns were found for the subject property. Page -14- Phase I ESA 1215 Appleby Line, Burlington, Ontario June 28, 2013 130035-2 He mentioned that the current state of the site was relatively the same as in 2007, which was a vacant plot of land. He mentioned that the site is currently going through a zoning and permit application for a proposed commercial development. 7.2 Government Officials An attempt was made to contact a number of government officials who had some knowledge of the site, but at the time this report was completed, we had not received any response from any of them. Mr. Prem Lal of the Technical Standards & Safety Authority (TSSA) was contacted to find out if there were any identifiable outstanding instructions, incident reports, fuel/oil spills or contamination records for the site and surrounding areas and he reported that no information was on file with respect to the subject property. In addition, he also reported that no information was on file for the addresses at 1175, 1201 Appleby Line and 5030 Mainway. However, a record of a cancelled compressed natural gas filling station was found for the property at 1250 Appleby Line. 8.0 FINDINGS From interviews with the owner of the building, a review of historical records, and from a review of regulatory records, our findings of concern at the site were as follows: The site has been used mainly for farming and horse raising purposes. Because of this AMEC carried out testing for samples for metals and Inorganics and for the presence of OCPs (organochlorine pesticides). We compared the AMEC’S raw data of the laboratory results done by Agat Laboratories for metals and inorganics and found that they meet the current Ministry of The Environment, O. Regulation 511/09 for General and Inorganic parameters against Table 1, for residential land use. No herbicides or pesticides were detected in any of the samples tested for OCPs. Consequently, herbicides and pesticides are no longer considered to be potential contaminants at the site. Another of our findings was the valid concern AMEC had at the site with regards to the presence of piles of fill consisting of construction and soil materials on isolated parts of the site. However, at the time of our investigation, we did not find any such piles of fill. Further we also took three samples of the surficial materials from the site and tested them for Metals and Inorganics by Agat Laboratories and found that each sample tested met The Ministry of The Environment O. Regulation 511/09 for General and Inorganic parameters against Table 1 for residential land use. Page -15- Phase I ESA 1215 Appleby Line, Burlington, Ontario June 28, 2013 130035-2 Based on our results and AMEC’s test results of the samples tested for Metals and Inorganics, potential contaminants from fill material are no longer a concern at the site. An abandoned former water well was found at the northern part of the site. This well is of some concern at the site as it appears that it had not been properly decommissioned and we recommend that it be decommissioned by a licensed well contractor in according with O. Reg. 903. 9.0 EVALUATION OF FINDINGS Our evaluations of the findings found the following: 10.0 1 The concern about herbicides and pesticides at the site have been handled by adequate testing whereby no OCPs were found to exist on the site. 2 The concern about piles of fill on the site is no longer a valid concern as they no longer exist and the surficial soils tested at the site meet the requirements of Table 1 of the Ministry of Environment O. Reg 511/09 for Metals and Inorganics. 3 An abandoned former water well was found at the northern part of site. This well is still of some concern at the site as it appears that it had not been properly decommissioned and we recommend that it be decommissioned by a licensed well contractor in according with O. Reg. 903. CONCLUSIONS From our findings above, we conclude that there is no evidence to indicate the presence of any contaminants of major concern on the subject property. The one area of minor concern is an abandoned former water well found at the northern part of site. This well is still of some concern at the site as it appears that it had not been properly decommissioned and we recommend that it be decommissioned by a licensed well contractor in according with O. Reg. 903. Page -16- Phase I ESA 1215 Appleby Line, Burlington, Ontario 11.0 June 28, 2013 130035-2 QUALIFICATIONS OF ASSESSOR The records review, interviews and site visits for this Environmental Site Assessment were carried out by Lawrence Yu, P. Eng., who has five years of experience in carrying out Phase I ESAs and Ram Jagdat, P. Eng., who has 20 years of experience in environmental investigations. Canada Engineering Services Inc., is a consulting engineering firm that was founded in 1988. It provides a full range of environmental services from Phase I studies in accordance with CSA Standard Z 768-01 up to full site remediation of contaminated sites. Its environmental investigations are carried out under the general guidance of Mr. Jimmy D’Cruz, M.Sc., Senior Hydrogeologist and a former long term employee of the Ministry of Environment. Mr. D’Cruz was involved in various aspects of environmental assessments, and site remediations. Page -17- Phase I ESA 1215 Appleby Line, Burlington, Ontario 12.0 June 28, 2013 130035-2 LIMITATIONS This report has been prepared from visual non invasive observations of the site and surrounding properties and from information provided from various persons and agencies limiting in scope to a Phase I Environment Site assessment. In the course of carrying out this Phase I Environmental Site Assessment (ESA), the possibility of obtaining imprecise, partial or incorrect data cannot be totally eliminated but only reduced to an acceptable level. This report was prepared with due care and diligence, and is based on information gathered and with professional judgement of the best information available at the time of the investigation. This report was prepared in accordance with CSA Standard Z 768-01 which is currently an accepted standard for Phase I investigations. This standard and current environmental standards, regulations and practices may change, with resulting changes to our conclusions and recommendations given in this report. Should the client become aware of any such changes or any unexpected environmental conditions at the site, not within the scope of services at the site, the Consultant (Canada Engineering Services Inc.) should be informed so that any necessary modifications to our report can be made. Federal Government Source Databases: Environmental Effects Monitoring 1992-2004 Diagram Identifier: EEM The Environmental Effects Monitoring program assesses the effects of effluent from industrial or other sources on fish, fish habitat and human usage of fisheries resources. Since 1992, pulp and paper mills have been required to conduct EEM studies under the Pulp and Paper Effluent Regulations. This database provides information on the mill name, geographical location and sub-lethal toxicity data. Environmental Issues Inventory System 1992-2001 EIIS The Environmental Issues Inventory System was developed through the implementation of the Environmental Issues and Remediation Plan. This plan was established to determine the location and severity of contaminated sites on inhabited First Nation reserves, and where necessary, to remediate those that posed a risk to health and safety; and to prevent future environmental problems. The EIIS provides information on the reserve under investigation, inventory number, name of site, environmental issue, site action (Remediation, Site Assessment), and date investigation completed. Federal Convictions 1988-Jan 2002 FCON Environment Canada maintains a database referred to as the “Environmental Registry” that details prosecutions under the Canadian Environmental Protection Act (CEPA) and the Fisheries Act (FA). Information is provided on the company name, location, charge date, offence and penalty. Contaminated Sites on Federal Land June 2000-2005 FCS The Treasury Board of Canada Secretariat maintains an inventory of all known contaminated sites held by various Federal departments and agencies. This inventory does not include properties owned by Crown corporations, but does contain nonfederal sites for which the Government of Canada has accepted some or all financial responsibility. All sites have been classified through a system developed by the Canadian Council of Ministers of the Environment. The database provides information on company name, location, site ID #, property use, classification, current status, contaminant type and plan of action for site remediation. Fisheries & Oceans Fuel Tanks 1964-Sept 2003 FOFT Fisheries & Oceans Canada maintains an inventory of all aboveground & underground fuel storage tanks located on Fisheries & Oceans property or controlled by DFO. Our inventory provides information on the site name, location, tank owner, tank operator, facility type, storage tank location, tank contents & capacity, and date of tank installation. Indian & Northern Affairs Fuel Tanks 1950-Aug 2003 IAFT The Department of Indian & Northern Affairs Canada (INAC) maintains an inventory of all aboveground & underground fuel storage tanks located on both federal and crown land. Our inventory provides information on the reserve name, location, facility type, site/facility name, tank type, material & ID number, tank contents & capacity, and date of tank installation. National Analysis of Trends in Emergencies System (NATES) 1974-1994* NATE In 1974 Environment Canada established the National Analysis of Trends in Emergencies System (NATES) database, for the voluntary reporting of significant spill incidents. The data was to be used to assist in directing the work of the emergencies program. NATES ran from 1974 to 1994. Extensive information is available within this database including company names, place where the spill occurred, date of spill, cause, reason and source of spill, damage incurred, and amount, concentration, and volume of materials released. National Defence & Canadian Forces Fuel Tanks Up to May 2001 NDFT The Department of National Defence and the Canadian Forces maintains an inventory of all aboveground & underground fuel storage tanks located on DND lands. Our inventory provides information on the base name, location, tank type & capacity, tank contents, tank class, date of tank installation, date tank last used, and status of tank as of May 2001. Please note that due to the September 2001 terrorist attack, new National Security protocols have prohibited any release of updates to this database. National Defence & Canadian Forces Spills March 1999-Feb 2005 NDSP The Department of National Defence and the Canadian Forces maintains an inventory of spills to land and water. All spill sites have been classified under the “Transportation of Dangerous Goods Act - 1992”. Our inventory provides information on the facility name, location, spill ID #, spill date, type of spill, as well as the quantity of substance spilled & recovered. National Defence & Canadian Forces Waste Disposal Sites 2001, 2003 NDWD The Department of National Defence and the Canadian Forces maintains an inventory of waste disposal sites located on DND lands. Where available, our inventory provides information on the base name, location, type of waste received, area of site, depth of site, year site opened/closed and status. National Environmental Emergencies System (NEES) 1974-2003 NEES In 2000, the Emergencies program implemented NEES, a reporting system for spills of hazardous substances. For the most part, this system only captured data from the Atlantic Provinces, some from Quebec and Ontario and a portion from British Columbia. Data for Alberta, Saskatchewan, Manitoba and the Territories was not captured. However, NEES is also a repository for all previous Environment Canada spill datasets. NEES is composed of the historic datasets – or Trends – which dates from approximately 1974 to present. NEES Trends is a compilation of historic databases, which were merged and includes data from NATES (National Analysis of Trends in Emergencies System), ARTS (Atlantic Regional Trends System), and NEES. In 2001, the Emergencies Program determined that variations in reporting regimes and requirements between federal and provincial agencies made national spill reporting and trend analysis difficult to achieve. As a consequence, the department has focused efforts on capturing data on spills of substances which fall under its legislative authority only (CEPA and FA). As such, the NEES database will be decommissioned in December 2004. National PCB Inventory 1988-June 2004 NPCB Environment Canada’s National PCB inventory includes information on in-use PCB containing equipment in Canada including federal, provincial and private facilities. All federal out-of-service PCB containing equipment and all PCB waste owned by the federal government or by federally regulated industries such as airlines, railway companies, broadcasting companies, telephone and telecommunications companies, pipeline companies, etc. are also listed. Although it is not Environment Canada’s mandate to collect data on non-federal PCB waste, the National PCB inventory includes some information on provincial and private PCB waste and storage sites. National Pollutant Release Inventory 1993-2005 NPRI Environment Canada has defined the National Pollutant Release Inventory (“NPRI”) as a federal government initiative designed to collect comprehensive national data regarding releases to air, water, or land, and waste transfers of 178 specified substances. -2- Parks Canada Fuel Storage Tanks 1920-Jan 2005 PCFT Canadian Heritage maintains an inventory of all known fuel storage tanks operated by Parks Canada, in both National Parks and at National Historic Sites. The database details information on site name, location, tank install/removal date, capacity, fuel type, facility type, tank design and owner/operator. Transport Canada Fuel Storage Tanks 1970- May 2003 TCFT Within the provinces of BC, MB, NB, NF, ON, PE, and QC; Transport Canada currently owns and operates 90 fuel storage tanks. Our inventory provides information on the site name, location, tank age, capacity and fuel type. Provincial Government Source Databases: Abandoned Aggregate Inventory Up to Sept 2002 AAGR The MAAP Program maintains a database of all abandoned pits and quarries. Please note that the database is only referenced by lot and concession and city/town location. The database provides information regarding the location, type, size, land use, status and general comments. Aggregate Inventory Up to May 2005 AGR The Ontario Ministry of Natural Resources maintains a database of all active pits and quarries. Please note that the database is only referenced by lot\concession and city/town location. The databases provides information regarding the registered owner/operator, location, status, licence type, and maximum tonnage. Abandoned Mines Information System 1800- 2005 AMIS The Abandoned Mines Information System contains data on known abandoned and inactive mines located on both Crown and privately held lands. The information was provided by the Ministry of Northern Development and Mines (MNDM), with the following disclaimer: “the database provided has been compiled from various sources, and the Ministry of Northern Development and Mines makes no representation and takes no responsibility that such information is accurate, current or complete”. Reported information includes official mine name, status, background information, mine start/end date, primary commodity, mine features, hazards and remediation. Certificates of Approval 1985-Sept 2002 CA This database contains the following types of approvals: Certificates of Approval (Air) issued under Section 9 of the Ontario EPA; Certificates of Approval (Industrial Wastewater) issued under Section 53 of the Ontario Water Resources Act (“OWRA”); and Certificates of Approval (Municipal/Provincial Sewage and Waterworks) issued under Sections 52 and 53 of the OWRA. Coal Gasification Plants 1987, 1988* COAL This inventory of all known and historical coal gasification plants was collected by the Ministry of Environment. It identifies industrial sites that produced and continue to produce or use coal tar and other related tars. Detailed information is available and includes: facility type, size, landuse, soil condition, site operators/occupants, site description, and potential environmental impacts. This information is effective to 1988, but the program has since been discontinued. Compliance and Convictions 1989-2003 CONV This database summarizes the fines and convictions handed down by the Ontario courts beginning in 1989. Companies and individuals named here have been found guilty of environmental offenses in Ontario courts of law. -3- Drill Holes 1886-2005 DRL The Ontario Drill Hole Database contains information on more than 113,000 percussion, overburden, sonic and diamond drill holes from assessment files on record with the department of Mines and Minerals. Please note that limited data is available for southern Ontario, as it was the last area to be completed. The database was created when surveys submitted to the Ministry were converted in the Assessment File Research Image Database (AFRI) project. However, the degree of accuracy (coordinates) as to the exact location of drill holes is dependent upon the source document submitted to the MNDM. Levels of accuracy used to locate holes are: centering on the mining claim; a sketch of the mining claim; a 1:50,000 map; a detailed company map; or from submitted a “Report of Work”. Environmental Registry 1994-July 2003* EBR The Environmental Registry lists proposals, decisions and exceptions regarding policies, Acts, instruments, or regulations that could significantly affect the environment. Through the Registry, provincial ministries notify the public of upcoming proposals and invite their comments. For example, if a local business is requesting a permit, licence, or certificate of approval to release substances into the air or water; these are notified on the registry. Ontario Regulation 347 Waste Generators Summary 1986-2005 GEN Regulation 347 of the Ontario EPA defines a waste generation site as any site, equipment and/or operation involved in the production, collection, handling and/or storage of regulated wastes. A generator of regulated waste is required to register the waste generation site and each waste produced, collected, handled, or stored at the site. This database contains the registration number, company name and address of registered generators including the types of hazardous wastes generated. This information is a summary of all years from 1986 including the most currently available data. Some records may contain, within the company name, the phrase “See & Use…” followed by a series of letters and numbers. This occurs when one company is amalgamated with or taken over by another registered company. The number listed as “See & Use”, refers to the new ownership and the other identification number refers to the original ownership. This phrase serves as a link between the 2 companies until operations have been fully transferred. Mineral Occurrences 1846-Oct 2004 MNR In the early 70’s, the Ministry of Northern Development and Mines created an inventory of approximately 19,000 mineral occurrences in Ontario, in regard to metallic and industrial minerals, as well as some information on building stones and aggregate deposits. Please note that the “Horizontal Positional Accuracy” is approximately +/- 200 m. Many reference elements for each record were derived from field sketches using pace or chain/tape measurements against claim posts or topographic features in the area. The primary limiting factor for the level of positional accuracy is the scale of the source material. The testing of horizontal accuracy of the source materials was accomplished by comparing the planimetric (X and Y) coordinates of that point with the coordinates of the same point as defined from a source of higher accuracy. Non-Compliance Reports 1992(water only), 1994-2005 NCPL The Ministry of the Environment provides information about non-compliant discharges of contaminants to air and water that exceed legal allowable limits, from regulated industrial and municipal facilities. A reported non-compliance failure may be in regard to a Control Order, Certificate of Approval, Sectoral Regulation or specific regulation/act. Ontario Oil and Gas Wells 1800-Oct 2006 OOGW In 1998, the MNR handed over to the Ontario Oil, Gas and Salt Resources Corporation, the responsibility of maintaining a database of oil and gas wells drilled in Ontario. Information available for all wells in the ERIS database include well owner/operator, location, permit start date, well cap date, licence number, status, depth and the primary target (rock unit) of the well being drilled. Ontario Inventory of PCB Storage Sites 1987-Oct 2004 OPCB The Ontario Ministry of Environment, Waste Management Branch, maintains an inventory of PCB storage sites within the province. Ontario Regulation 11/82 (Waste Management - PCB) and Regulation 347 (Generator Waste Management) under the Ontario EPA requires the registration of inactive PCB storage equipment and/or disposal sites of PCB waste with the Ontario Ministry of Environment. This database contains information on: 1) waste quantities; 2) major and minor sites storing liquid or solid waste; and 3) a waste storage inventory. -4- Ministry Orders 1995-1996 ORD Control Orders/Documents are enforcement actions issued by the Ministry of the Environment to deal with environmental violations. They clarify and allocate individual/joint liability when issuing clean-up orders for contaminated sites. Occurrence Reporting Information System 1988-2002 ORIS This database identifies sources, effects/actions and approximate locations of spills and occurrences within Ontario. The locations identified on the locator diagram refer to the facility responsible for the spill. The actual location of the spill can be derived from the descriptions provided in the detailed report. Pesticide Register 1988-Oct 2006 PES The Ontario Ministry of Environment maintains a database of all manufacturers and vendors of registered pesticides. Private and Retail Fuel Storage Tanks 1989-1996* PRT The Fuels Safety Branch of the Ontario Ministry of Consumer and Commercial Relations maintained a database of all registered private fuel storage tanks and licensed retail fuel outlets. This database includes an inventory of locations that have gasoline, oil, waste oil, natural gas and/or propane storage tanks on their property. The MCCR no longer collects this information. This information is now collected by the Technical Standards and Safety Authority. Ontario Regulation 347 Waste Receivers Summary 1986-2005 REC Part V of the Ontario Environmental Protection Act (“EPA”) regulates the disposal of regulated waste through an operating waste management system or a waste disposal site operated or used pursuant to the terms and conditions of a Certificate of Approval or a Provisional Certificate of Approval. Regulation 347 of the Ontario EPA defines a waste receiving site as any site or facility to which waste is transferred by a waste carrier. A receiver of regulated waste is required to register the waste receiving facility. This database represents registered receivers of regulated wastes, identified by registration number, company name and address. This information is a summary of all years from 1986 including the most currently available data. Record of Site Condition 1997-Sept 2001 RSC The Record of Site Condition (RSC) provides a summary of the final environmental condition of a site, once an environmental site assessment and/or restoration approach has been undertaken. The database provides information on the site restoration approach used (Background, Generic, Site Specific Risk Assessment), location of contaminated site, whether contamination extends past 1.5m from the surface thereby requiring “stratified restoration”, soil type, and the date when RSC was submitted/acknowledged/ responded to by the Ministry of the Environment. A site restoration approach involves the use of soil and groundwater quality criteria, which have been developed to provide protection against adverse effects to human/ecological health and the natural environment. These criteria may be applied to agricultural, residential/parkland, industrial/commercial land uses; as well as potable (source of drinking water) and nonpotable groundwater use. Wastewater Discharger Registration Database 1990-1998 SRDS Information under this heading is combination of the following 2 programs. The Municipal/Industrial Strategy for Abatement (MISA) division of the Ontario Ministry of Environment maintained a database of all direct dischargers of toxic pollutants within nine sectors including: Electric Power Generation; Mining; Petroleum Refining; Organic Chemicals; Inorganic Chemicals; Pulp & Paper; Metal Casting; Iron & Steel; and Quarries. All sampling information is now collected and stored within the Sample Result Data Store (SRDS). Waste Disposal Sites - MOE CA Inventory 1970-Sept 2002 WDS The Ontario Ministry of Environment, Waste Management Branch, maintains an inventory of known open (active or inactive) and closed disposal sites in the Province of Ontario. Active sites maintain a Certificate of Approval, are approved to receive and are receiving waste. Inactive sites maintain Certificate(s) of Approval but are not receiving waste. Closed sites are not receiving waste. The data contained within this database was compiled from the MOE's Certificate of Approval database. Locations of these sites may be cross-referenced to the Anderson database described under ERIS’s Private Source Database section, by the CA number. -5- Waste Disposal Sites - MOE 1991 Historical Approval Inventory Up to Oct 1990* WDSH In June 1991, the Ontario Ministry of Environment, Waste Management Branch, published the "June 1991 Waste Disposal Site Inventory", of all known active and closed waste disposal sites as of October 30st, 1990. For each "active" site as of October 31st 1990, information is provided on site location, site/CA number, waste type, site status and site classification. For each "closed" site as of October 31st 1990, information is provided on site location, site/CA number, closure date and site classification. Locations of these sites may be cross-referenced to the Anderson database described under ERIS’s Private Source Database section, by the CA number. Water Well Information System 1955-2006 WWIS This database describes locations and characteristics of water wells found within Ontario in accordance with Regulation 903. Geographic coordinates are reliable according to the given percentage. Wells that are identified with lot and concession only are available upon request and would be provided as a separate report. Private Source Databases: Anderson’s Waste Disposal Sites 1930-2004 ANDR The information provided in this database was collected by examining various historical documents which aimed to characterize the likely position of former waste disposal sites from 1860 to present. The research initiative behind the creation of this database was to identify those sites that are missing from the Ontario MOE Waste Disposal Site Inventory, as well as to provide revisions and corrections to the positions and descriptions of sites currently listed in the MOE inventory. In addition to historic waste disposal facilities, the database also identifies certain auto wreckers and scrap yards that have been extrapolated from documentary sources. Please note that the data is not warranted to be complete, exhaustive or authoritive. The information was collected for research purposes only. Automobile Wrecking & Supplies 2001-Feb 2007 AUWR This database provides an inventory of all known locations that are involved in the scrap metal, automobile wrecking/recycling, and automobile parts & supplies industry. Information is provided on the company name, location and business type. Commercial Fuel Oil Tanks 1948-Sept 2006 CFOT Since May 2002, Ontario developed a new act where it became mandatory for fuel oil tanks to be registered with TSSA. This data would include all commercial underground fuel oil tanks in Ontario with fields such as location, registration number, tank material, age of tank and tank size. Chemical Register 1992, 1999-Feb 2007 CHEM This database includes information from both a one time study conducted in 1992 and private source and is a listing of facilities that manufacture or distribute chemicals. The production of these chemical substances may involve one or more chemical reactions and/or chemical separation processes (i.e. fractionation, solvent extraction, crystallization, etc.). ERIS Historical Searches 1999-2006 EHS EcoLog ERIS has compiled a database of all environmental risk reports completed since March 1999. Available fields for this database include: site location, date of report, type of report, and search radius. As per all other databases, the ERIS database can be referenced on both the map and “Statistical Profile” page. Canadian Mine Locations 1998-2006 MINE This information is collected from the Canadian & American Mines Handbook. The Mines database is a national database that provides over 290 listings on mines (listed as public companies) dealing primarily with precious metals and hard rocks. Listed are mines that are currently in operation, closed, suspended, or are still being developed (advanced projects). Their locations are provided as geographic coordinates (x, y and/or longitude, latitude). As of 2002, data pertaining to Canadian smelters and refineries has been appended to this database. -6- Oil and Gas Wells Oct 2001-May 2007 OGW The Nickle’s Energy Group (publisher of the Daily Oil Bulletin) collects information on drilling activity including operator and well statistics. The well information database includes name, location, class, status and depth. The main Nickles’ database is updated on a daily basis, however, this database is updated on a monthly basis. More information is available at www.nickles.com. Canadian Pulp and Paper 1999, 2002, 2004, 2005 PAP This information is part of the Pulp and Paper Canada Directory. The Directory provides a comprehensive listing of the locations of pulp and paper mills and the products that they produce. Retail Fuel Storage Tanks 2000-Feb 2007 RST This database includes an inventory of retail fuel outlet locations (including marinas) that have on their property gasoline, oil, waste oil, natural gas and / or propane storage tanks. Information is provided on company name, location and type of business. Scott’s Manufacturing Directory 1992-Jan 2007 SCT Scott’s Directories is a data bank containing information on over 70,000 manufacturers in Ontario. Even though Scott’s listings are voluntary, it is the most comprehensive database of Ontario manufacturers available. Information concerning a company’s address, plant size, and main products are included in this database. This database begins with 1992 information and is updated annually. Anderson’s Storage Tanks 1915-1953* TANK The information provided in this database was collected by examining various historical documents, which identified the location of former storage tanks, containing substances such as fuel, water, gas, oil, and other various types of miscellaneous products. Information is available in regard to business operating at tank site, tank location, permit year, permit & installation type, no. of tanks installed & configuration and tank capacity. Data contained within this database pertains only to the city of Toronto and is not warranted to be complete, exhaustive or authoritative. The purpose of the soil sampling was to determine any impacts in the surface soil resulting from the potential sources of impact (i.e. pesticide usage, fill piles) as identified in the report produced by AMEC, entitled “Phase I Environmental Site Assessment, Vacant Land, 1215 Appleby Line, Burlington, Ontario”. The purpose of the Surface Soil Sampling was to assess soil conditions at the Site with respect to “Soil, Ground Water and Sediment Standards for Use under Part XV.1 of the Environmental Protection Act”, dated 9 March, 2004. METHODOLOGY On July 24th, 2007, five (5) surface soil samples were collected using grab sample methods and submitted to AGAT Laboratories Limited located in Mississauga, Ontario. Five (5) soil samples, including a duplicate, were analyzed for metals (two of the samples were analyzed for metals and inorganics) and five (5) soil samples, including a duplicate, were submitted for organochlorine pesticides (“OCP”). Soil samples were collected in accordance with the Ontario Ministry of Environment and Energy (“MOEE”) “Guidance on Sampling and Analytical Methods for Use at Contaminated Sites in Ontario”, issued in December of 1996. Surface Soil Sampling 1215 Appleby Line, Burlington, Ontario August 7, 2007 REGULATORY CRITERIA The results were compared with Site Condition Standards, provided in the supporting document “Soil, Ground Water and Sediment Standards for Use Under Part Xv.1 of the Environmental Protection Act”, dated March 9, 2004. Due to the proximity of Appleby Creek to the Site, Table 1: Full Depth Background Site Condition Standards have been applied. Upon decommissioning of the water well located on the Site, the majority of the property would be classified under Table 3: Full Depth Generic Site Condition Standards in a Non-Potable Ground Water Condition, with the exception of the portion of the Site which is within 30 metres of the adjacent water body (Appleby Creek). RESULTS OF LABORATORY ANALYSIS All five (5) of the soil samples, including a duplicate, submitted for metals and inorganic parameters either were below the laboratory method detection limits and / or met the applicable Table 1 standards. All five (5) of the soil samples, including a duplicate, submitted for OCP were below the laboratory method detection limits and therefore, met the applicable Table 1 standards. Field QA/QC The relative percent differences (“RPDs”) were calculated (where possible) for all duplicate samples and are presented in Appendix B. The calculated RPDs for the field duplicates were within the acceptable alert limits (100%) for metals and inorganic parameters. The RPDs for OCP could not be calculated because both samples were not greater than five times the laboratory detection limits. The results of the analyses are presented in Tables 1 and 2. Laboratory Certificates of Analysis are included in Appendix A. QA/QC data is presented in Appendix B. CONCLUSIONS AND RECOMMENDATIONS Based on the results of the laboratory analysis, all soil samples submitted for metals and inorganic parameters and OCP met the applicable Table 1 standards and therefore, no further environmental assessment work is warranted at this time. For future use and environmental classification of the Site, AMEC recommends that a legal survey shall describe the portion of the property located within 30 metres of Appleby Creek as a separate Part. It was understood that sampling and testing were required prior to buying the property, to determine if the soil is clean. Three samples were taken from hand dug test pits of the soil materials found immediately below the surficial topsoil from the site. The first sample was taken in the middle of the west side of the site, the second sample was taken in the middle of the east side and the third sample was taken in the middle of the north side. The depths of each soil sample was at approximately 300 mm below the original ground surface. In addition, one sample was taken from the existing soil stockpile from the neighbouring site immediately to the south. The samples were taken to Agat Laboratories and tested against the Ministry of The Environment O. Regulation 511/09 for General and Inorganic parameters against Table 1 for residential land use. All four samples met the requirements of the regulation for residential land use and the test results are attached. The soil samples are therefore clean for the tests carried out, and the excavated materials can be disposed of at any landfill site if necessary, subject to any other limitations of specific landfill sites.
