Trading Standards
Welcome to BCA
This booklet is intended to be your guide to buying and/or selling a motor
vehicle at any of BCA’s auction centres. We hope to make things simple and
straightforward but if there are any points which are not clear, please ask our
staff; they are experienced motor auction personnel and will be more than
happy to help. Remember, all our auctions are operated in accordance with our
Conditions of Entry and Sale. These are displayed in the auction halls and
copies are available on request, free of charge, from the auction centre
reception or from Head Office at Farnham. They may also be downloaded
from our website - bca.co.uk
We have auction centres up and down the country and throughout mainland
Europe. We are the largest European auction group – so we are never far away!
Each auction centre holds at least two auction sales per week (many hold
more) and sellers may bring their vehicles to the auction at any time during
normal working hours, ready for the next auction or we can arrange for the
vehicle to be picked up and valeted prior to sale. Potential buyers may view
vehicles entered into the auction on the morning of each auction sale. In
certain circumstances, viewing is possible on the day before the sale - please
ask at the centre at which you intend to buy.
You will find cars offered for sale at all regular auctions and there are
regular sales of light vans. Heavy commercial vehicles as well as plant and
equipment are sold at some centres. See pages 21, 24, 25 and 26 for details.
Many of our auction centres have specialised sales or sections of sales and it
is always worthwhile telephoning your nearest centre to obtain advice on the
most appropriate auction for your purchase or sale.
Periodic auction sales also take place of caravans, coaches, buses, motorbikes
as well as sundry plant and equipment. For further information contact our
Customer Services on: 0844 875 3480 or visit our website at: bca.co.uk

BCA endeavours to assist Trading Standards’ efforts to protect
consumers and (subject to its obligations under the Data
Protection Act 1998) will provide information for use as
evidence in the event of a Trading Standards investigation into
the actions of a buyer or a seller of a vehicle through one of its
auctions.
Types of Auction Sale
In an effort to streamline the operation of the auction sales and
to assist customers wanting to buy and sell different classes of
vehicles, the Company holds the following types of sales:General Car Sales
Held two or three separate days a week, these sales are
generally for cars which do not fit into the categories
below.
Distributor/Part Exchange
For cars of varying age and mileage entered by local
distributors and national dealer groups.
Top Car
For executive cars, better quality sports cars, four wheel
drive vehicles and other luxury cars.
Fleet, Finance, Contract and Lease
For cars entered by fleet, finance, contract hire and leasing
companies.
Motorbike
Dedicated Motorbike Sales are held monthly at
Peterborough. Please contact the site for more details.
3
NOTE: The Company has two specialist centres for the sale of HGVs
Plant and Equipment, Coaches and Agricultural Tractors and Equipment at
Manchester-Belle Vue and Measham – details on pages 25 and 26.
BUYERS
The following is a guide to the first time buyer, who has never bought at
auction. We have tried to keep it simple and straightforward but if
there is anything about which you are unsure, please ask our staff.
Commercial and Leisure Vehicles
You may wonder where all these vehicles come from. That’s easy! Fleet
disposals by companies, large and small, national and local authorities,
manufacturers and distributors of vehicles and, of course, members of the
public. They all use our services to make their life easier.
Heavy Commercial Vehicle Sales
For vehicles in excess of 3.5 tonnes gross weight
including trailers of all kinds.
We act as their agent and use our skill and expertise to bring the buyer and
seller together with the maximum protection to both.
Light Commercial Vehicles Sales
For all types of light commercial vehicles and vans with a
gross weight of less than 3.5 tonnes. Sales held once a
week at most auction centres. Sales include a mixture of
car-derived vans, panel vans, lutons, pick-ups and crewbuses.
There are a number of things about which you should know before buying
at any of our auctions and details of these follow.
All vehicles are available for visual inspection before the sale. You should take
the opportunity to look carefully at the type of vehicle in which you are
interested and you should examine the important parts thoroughly.
Bus and Coach Sales
Specialist sales are held at the Manchester-Belle Vue
auction centre.
Caravan and Motorhome Sales
These are held regularly at our Measham auction centre.
Plant, Equipment, Tractors & Agricultural
Auction Sales of contractors’ plant and equipment are
held monthly at Manchester-Belle Vue and Measham contact branches for details.
There are also sales of agricultural equipment and
plant, tractors and trailers.
A list of BCA auction centres appears on pages 21-29 of this booklet. Each
centre has listed the various types of auction sales it holds. These can change
so it is worth checking to avoid a wasted journey. The map on the back cover
will help you quickly find the BCA auction centre nearest to you. All the above
auction sales are open to both trade customers and the general public.
4
Tax
You should decide on how much you want to spend. Remember that in
addition to the hammer price you will have to pay a buyer’s fee (see page 11)
which is subject to VAT. The standard rate buyer’s fees are displayed at auction
centres, but please ask our staff if you are unsure. You will have to pay VAT in
addition to the hammer price on most commercial vehicles and plant (and, on
the odd occasion, some cars). Please note the section on VAT on Page 11.
If the vehicle has been entered into the sale with a valid excise licence, then
it will be sold with the benefit of the unexpired part of that licence which
will become your property. REMEMBER: You are obliged by law to
ensure that the vehicle is taxed properly for use on the road.
Insurance
Remember that from the fall of the hammer or the acceptance of your bid
in a provisional sale (see page 7) the liability for the vehicle is yours. You are
responsible for it; any damage caused by it or any loss of it (e.g. fire or theft)
or damage to it will be your liability. REMEMBER: You cannot use it on the road
until you have insured it properly.
5
Finding the Right Vehicle
BCA has tens of thousands of vehicles to choose from. To find the vehicle that
is right for you, visit our website and either download the monthly sales guide
or follow the links to Auction View. In addition, auction centres will produce
a catalogue on the day of sale. Once you have bought one of these, you will
know what vehicles are going through that sale and in what order, although
others may be added during the course of the sale. Catalogues are issued for
guidance only and you should satisfy yourself as to the detailed description of
the vehicle in which you are interested.
Compound
Once you have your catalogue, we suggest you take it with you to examine the
vehicles in the line-up before they go to auction. You should try
to find 2 or 3 of the type you are interested in, so you will have a choice.
Auction Hall
Once you have examined the vehicle that interests you, go to the relevant
auction hall to watch, listen and wait for your chosen vehicle to arrive.
Always listen very carefully as the auctioneer will read out the details of the
vehicle before starting the bidding. We strongly advise you to look, listen and
learn from the auctioning of several vehicles before you make any bid of your
own and you may find it useful to attend one or two auctions without making
a bid, simply to gain an understanding of the process.
Selling Descriptions
When describing the vehicle the auctioneer may use one or more of the
following terms:(i)
(ii)
“No major mechanical faults” – vehicles sold under this description
should not have any major faults in the following – the engine – the
gearbox – the clutch – the brakes – the steering – the transmission.
“Specified faults” – the auctioneer will read out any particular defects
notified by the seller.
(iii) “Sold as seen” (and with all its faults if any) – such vehicles are purchased
as they are with no warranties whatsoever by the seller. Auctioneers
sometimes describe such vehicles as being sold “without warranty” this
phrase means exactly the same as “As Seen”
6
Buying
For certain sales you may need to pre-register in order to bid. This preregistration process may involve paying a deposit, which is refundable should
you not buy a vehicle. To bid, simply make your bids clear by raising your arm,
and be certain that the auctioneer has seen your bid.
You have made the highest bid. What next? Go to the Rostrum and identify
yourself to the Rostrum Clerk.
If you have not pre-registered and pre-paid a deposit you will then need to pay a
deposit to the Rostrum Clerk. The minimum deposit is whichever is the higher
of £500 and 20 per cent of the hammer price and may be paid in cash or by debit
or credit card. Payment of the deposit by credit card will incur a fee - see the
payment section on page 8 for details. They will ask you to write your name,
address and telephone number on a purchase slip which you must sign to confirm
your purchase. The slip also acts as a receipt for your deposit.
Your invoice and any vehicle documents will shortly be available at the
Cashier’s Office in the Reception Area where the balance of the purchase
price together with the buyer’s fee must be paid (see Payment section below).
You should remember that if you bid for a commercial vehicle (and this
includes light vans) you will have to pay VAT in addition to the bid price, but
this does not apply to cars, except in a few specialised cases, such as where
the car is sold with delivery mileage only.
Provisional Sales
The seller is allowed to place a reserve price on the vehicle, below which the
auctioneer must not sell it. If your bid is the highest bid received but is
below the reserve price, the auctioneer may ‘provisionally’ sell the vehicle,
subject to the seller accepting the highest bid. Each auction centre has a
provisional sales clerk, whose job is to negotiate between the seller and you,
the ‘provisional buyer’, to try to agree a price at which a sale can be
concluded to the satisfaction of both parties. A concluded provisional sale is
known as a Private Treaty Sale.
You are required to pay a cash deposit to the rostrum clerk (see previous
section), which goes towards the purchase price in the event of a Private
Treaty Sale being concluded, or is refunded to you if a sale is not agreed.
7
Payment
Congratulations – if you have got this far your bid has been accepted
either under the hammer or as a result of a Private Treaty Sale.
Before you can take the vehicle we will need full payment of the agreed price
PLUS the additional buyer’s fee (see paragraph “Buyer’s Fee” –
page 11). We will accept payment by cash, telegraphic transfers or most debit
and credit cards.
Hire Purchase Arrangements
The Company does NOT offer hire purchase arrangements. If you wish to
purchase a car using hire purchase or similar facilities, you must make your
own private arrangements with a finance house or bank PRIOR to attending
the auction. If satisfactory prior arrangements have been made, the finance
company’s cheque or letter of commitment must be shown to the cashier
BEFORE BIDDING.
Release of Vehicles Purchased
When you have paid in full, the cashier will hand you:
Payments by cash incur a 1.25% + VAT fee, payments by credit card incur a
2.5% + VAT fee, so to avoid additional charges we recommend you pay by debit
card.
Please note that we will not accept more than £9,000 in cash for any single
transaction or series of linked transactions.
Settlement must be made at the cashiers office. IF YOU HAVE ANY
QUESTIONS ABOUT PAYMENT YOU SHOULD CONTACT
THE CASHIER BEFORE BIDDING FOR ANY VEHICLE.
V5C New Keeper Transfer Fee
BCA, as agent for the seller, has an obligation to notify the DVLA of any change
of ownership/keeper and to provide new name and address details when we
sell a vehicle
Upon the completion of your purchase, we will need to complete the changes
section of the V5C Registration Document before we can release the vehicle
into your possession.
BCA will then forward the relevant part of the V5C Registration Document
to the DVLA at Swansea on your behalf.
A new V5C Registration Document will then be sent to you by the DVLA,
bearing your own details.
A fee will be charged for this service. This fee applies to all Private
Buyers/Non MyBCA card holders only. The current fee is advertised on the
BCA website and available on request from auction centres.
8
(i)
a receipted invoice
(ii)
where applicable, the relevant part(s) of the Vehicle Registration Document
(Form V5C) and any MOT Test or other certificates and documents
(iii) a Pass Out
(iv) a note as to whether any detachable item(s) (such as a radio) are to be
collected and where they may be found.
The Pass Out should be taken to the Key Office to obtain the car keys and
it will also be needed at the gate as your authority to take the vehicle off the
auction premises. You must hand it to the gateman who has the right to
inspect and search the vehicle to ensure it is being correctly removed from
the auction. The Pass Out is important – you will not be able to remove
your purchase without it so do not lose it!
All vehicles purchased must be promptly removed from BCA centres.Vehicles
not paid for by 5pm on the second day after the auction or paid for but not
removed from site by 5pm on the second day after the auction will attract a
standard daily storage charge (see auction centre for a current list of charges)
for each day or part day they remain unpaid past the due date. Concessions
may apply to My BCA Cardholders.
MOT Certificate and Road Fund Licence
We remind you that it is an offence to drive a vehicle on the
road without valid insurance, a current Vehicle Excise Licence
and MOT Certificate (if applicable) and you must remove the
vehicle from the auction premises in a manner which does not
contravene the law.
9
Vehicle Registration Document (Log Book)
If the seller has handed in the vehicle registration document (V5C) this will be
completed on your behalf and sent to DVLA Swansea by us. You will be given
the green section which you can use to re-licence the vehicle. DVLA Swansea
will send you a new V5C a few days after the sale. If you are a trader, we will
complete the yellow part of the V5C and send it to DVLA Swansea on your
behalf. You will be given the remaining parts for you to complete when you
sell the vehicle on.
If there is no V5C, you will have to apply to DVLA Swansea. The process can
take 4 or 5 weeks to complete.

Most vehicles over 5 YEARS OLD and all vehicles with a purchase price
of less than £1,000 are sold “As Seen” and with all their faults if any.
Odometer Readings
Odometer readings are only warranted as accurate if so announced by the
auctioneer at the time of sale. In all other cases odometer readings are NOT
WARRANTED or INCORRECT. They must not be relied upon and you should
disregard them.
Buyer’s Fee
We charge a buyer’s fee on each vehicle (or lot) you buy, to cover the cost of
our services. This also includes our guarantee that:
(a) the seller has the absolute right to sell the unencumbered legal and
beneficial interest in the vehicle;
(b) the vehicle has not been a total loss or treated as such by an insurance
company prior to the date of auction sale, and this fact has not been
disclosed; or
(c) the vehicle does not have an odometer reading that is warranted as
accurate but subsequently proved to be false.
The amount of the buyer’s fee payable will depend on the value of the vehicle
and the number of vehicles you have purchased in the previous 12 months (See
Page 12). All Buyers Fees are subject to VAT.
Legislation
You are reminded that it is your responsibility to ensure that any vehicle
purchased at auction complies with the requirements of the Road Traffic Acts
before it is used on the road. You must also ensure compliance with the Health
and Safety at Work Act and any other relevant legislation and you may be
required to sign an undertaking certifying compliance with any such legislation.
All Heavy and Light Commercial Vehicles, Plant and Equipment are sold “As
Seen”.
To the extent that the condition or functionality of any aspect of a vehicle
is either not described by a BCA Assured Mechanical Report, not
disclosed as a specific fault, or not warranted pursuant to a ‘No Major
Mechanical Faults’ description, then that aspect shall be sold “As Seen”.
The age of vehicles sold is the “Date first registered in the United
Kingdom” as per the Registration Document. This date is not necessarily
the date of manufacture or date of first use.

The VAT rules on purchasing a used vehicle are:(i)
Used Motor Cars: Although all used cars bear VAT it is not usually
accounted for separately and VAT is not generally added to the hammer
price. In some circumstances (qualifying cars) the VAT element may be
broken out from the hammer price and shown separately. This is done
to enable a VAT registered buyer, purchasing the vehicle for a qualifying
purpose, to recover the VAT. In all other cases (margin cars) the VAT is
not shown separately and cannot be recovered.
Qualifying Cars include cars bought by:l
Leasing and contract hire companies – Cars for onward lease/rental.
l
Daily rental companies – Cars for onward rental.
l
Taxi firms/driving schools – Cars solely for business use.
l
Fleet operators – Cars that have no private use (e.g. pool cars).
l
Dealers buying for any of the above purposes or for retail, from any of
the above on a tax invoice.

MyBCA Cards
The MyBCA Card scheme is designed to reward all buyers, both cheque
account customers and non-account customers, for purchasing vehicles
through BCA. Customers who have subscribed to the scheme will benefit
from competitive buyer’s fee rates and other benefits dependent on the
number of purchases they have made in a twelve-month period. MyBCA Card
will also act as evidence of the cheque account customer’s status, where
appropriate.
There are currently 5 types of MyBCA Cards:- Blue, Silver, Gold, Platinum and
Black.
For further information on MyBCA Cards, call our Customer Services team on
0844 875 3480.
Cars that are not eligible for recovery of VAT even if purchased by a
VAT registered person and bought on a tax invoice are called Margin
Cars.
(ii) Used Light and Heavy Commercial Vehicles, Plant and Equipment: VAT at
current rates is charged ON TOP of the auction selling price in almost all
cases. The auction rule is that all light and heavy commercial
vehicles, plant and equipment are subject to VAT unless the auctioneer
declares otherwise.
BCA Cheque Account
If you are a member of the motor trade and/or a regular trade purchaser you
may apply for a BCA Cheque Account and obtain a “MyBCA” Card. Holders of
such accounts are permitted to pay for purchases by cheque, up to an agreed limit
on production of the card to the branch cashier at the time of payment, and to
remove their purchases from the auction on the day of the auction sale. In
addition, MyBCA card holders have access to a range of valuable on-line services
including Auction View, the Stock Locator and a price and catalogue information
service. They may also benefit from a reduced buyer’s fee as the number of their
purchases increases.
An “Application for a Cheque Account Facility” form can be obtained from any
BCA centre or by contacting:

SELLERS
Our service is designed to make selling your car as easy as possible.
We aim to provide a fast and efficient service from our network of
21 auction centres each of which holds at least two auctions a week.
We can normally arrange collection of your vehicle, arrange for it to
be valeted and offered for sale and for you to receive payment all
within 7 working days.
How to enter a vehicle for sale
Details of how to sell your car at any one of our 21 auction centres,
including quotes for collection, valeting and auction services, can be found at
www.sure-sell.co.uk or by calling the BCA Sure Sell team on 0845 803
5338 open 8:30 am to 5:30 pm Monday to Friday.
You can simply drive or deliver the vehicle to the nearest auction centre or
you can ask us to collect it. In the latter case, telephone us to ask for a
quotation. We will send you an Entry Form and will arrange a convenient time for
collection. You must complete the Entry Form and either give it, together with all
the relevant vehicle documents, to the collection driver or post all the documents,
including the completed Entry Form, to the auction centre you want to use.
If you deliver the vehicle yourself you should go to Entry Control on arrival at
the auction centre and ask for an Entry Form. The staff will be happy to help
you complete this form and to answer any questions you may have.
Please remember that the Entry Form is very important. You must
complete all the sections accurately and fully. It is your instruction to the
auctioneer and he will use it to read out the relevant details when offering
your vehicle for sale.
Your attention is particularly drawn to the following points:(i)
Details of date first registered in the United Kingdom should be as shown
in the Vehicle Registration Document. The engine and chassis numbers
should also be taken from the Vehicle Registration Document and, ideally,
you should check them on the vehicle itself.
(ii) You MUST answer the questions about Insurance Total Loss, Accident
Damage, Police Ownership, Taxi use, importation or re-registration or
changed registration number whether or not the vehicle is to be ‘sold
as seen’ (see ‘Selling Descriptions’ opposite).
14
(iii) If the vehicle is the subject of an outstanding hire purchase agreement,
you MUST show the details in the box provided and state whether or
not BCA is to settle the outstanding hire purchase out of
the sale proceeds. If you do not instruct BCA to settle,
the sale proceeds will be withheld until you have paid the outstanding hire
purchase. This is to ensure that the buyer will obtain good title to the
vehicle.
(iv) You, the seller, MUST sign the Entry Form. This is the auctioneer’s
authority to offer the vehicle for sale and without it, the auctioneer may
not accept the vehicle for sale at the auction.
(v) The cheque for the net sale proceeds (after deduction of the auctioneer’s
commission and charges) will be posted to the seller’s name and address
as shown on the Entry Form – so please write legibly. It’s in your own
interest!
(vi) Show your day time telephone number where you can be contacted.
(vii) If you are registered for VAT purposes, you must record your VAT
registration number in the box provided and advise whether you
recovered any VAT charged when you purchased the vehicle.
Vehicle Documents
The Vehicle Registration Document (Logbook or V5C) is an important
document without which buyers are less likely to want to buy your vehicle. You
should ensure that it is handed to us with the completed Entry Form. When
your vehicle has sold, we will complete the appropriate sections of the V5C
and send it to DVLA Swansea, thus removing your interest in the vehicle from
the DVLA records.
To maximise the saleability of your vehicle, any supporting documentation
concerning its service history and previous ownership, any applicable MOT
certificate(s) and any other relevant paperwork should be presented at the
time of completing the Entry Form.
Selling Descriptions
As mentioned in the previous section, the Entry Form is very important as the
auctioneer uses it to describe your car. He has no other information available
and so your description should be as accurate and comprehensive as possible.
You should detail any significant extras and the value of your car will be
enhanced if you provide its service history.
When completing the mechanical condition section of the Entry Form, you
must describe your vehicle in one of the following ways:(a) No major mechanical faults or
(b) Specified faults – where you have listed any faults in – the engine – the
gearbox – the clutch – the brakes – the steering – the transmission, or
(c) Sold as seen – where you wish to sell the vehicle with all its faults and
without warranty and where you do not wish to describe the mechanical
condition of the vehicle. However, you must not use this
description to hide any known latent defects - these must
be disclosed.
15
If a vehicle is described as having ‘No Major Mechanical Faults’ and
subsequently turns out to have a major mechanical fault with one or more of
the engine, gearbox, clutch, brakes, steering or transmission, the buyer will,
subject to the conditions described in our Conditions of Entry and Sale, be
entitled to cancellation of the contract of sale.
Note: All vehicles over five years old or likely to realise less than £1,000 are
sold ‘As seen’ unless agreed otherwise in writing with the Branch Manager.
No complaints can be entertained from the purchaser in any circumstances
where vehicles are sold ‘As Seen’.
Odometer Readings
You must complete the ‘Odometer Reading’ box on the Entry Form with the
reading shown on your vehicle. You must also decide whether the reading is
warranted, not warranted or incorrect. The auctioneer will read out what you
state on the Entry Form and you should note that the penalties for
misdescription can be severe with prosecution through the Courts being
likely. You should not warrant the mileage as correct unless you are sure that
it is correct as you will have to meet the cost of any claim in the event that it
is subsequently proved to be incorrect.
Vehicle Pre-Sale Preparation
It is beneficial either to present the vehicle in a clean and saleable condition
yourself or to take advantage of our range of professional vehicle preparation
services called BCA Smart Prepared. Full details of BCA Smart Prepared are
available from each Auction Centre.
Reserve Price
You should decide on a reserve price and write it in the box provided on the
Entry Form. The auctioneer is not authorised to sell a vehicle below the reserve
price without your consent. The reserve price must take into account the
auctioneer’s commission and charges – ‘net’ reserves will not be accepted.
You may always request guidance as to what reserve price to place on a
vehicle; please discuss this with any senior member of the auction centre staff.
Note: You are not allowed to place a reserve price on vehicles over eight
years old (from date of first registration in the UK) or where the likely
selling price is less than £1,000 unless otherwise agreed in writing by the
Branch Manager.
16
Provisional Sales
If you are present at the auction sale, you should always go to the side of the
Auctioneer’s Rostrum when your vehicle is offered for sale. The auctioneer
may receive a bid which is less than, but close to your reserve price, and he will
in those circumstances, ask you if you are prepared to accept that bid. If you
are not present personally at the auction sale, a member of our staff (the
provisional sales clerk) will telephone you with details of the highest bid and
ask for your further instructions. You may accept the highest bid, or ask the
clerk to try to secure a higher offer. If the clerk is able to negotiate a price
which is satisfactory to both parties, such a sale is called a Private Treaty Sale
(as opposed to an outright sale under the auctioneer’s hammer). Alternatively,
you may instruct us that the vehicle should be re-offered at a later auction sale
when there may be an additional entry fee to pay......The decision is yours. You
should be aware that a buyer who is party to a Private Treaty Sale will have
more statutory rights than a buyer at auction.
Your Payment
Our cheque for the sale proceeds less our commission and other charges, will be
sent to the address you have given on the Entry Form, usually 3 working days
after the sale of your vehicle. It is obviously in your own interest to ensure that
the name and address and (if applicable) the department or individual you wish
to receive the cheque, is clearly written in the appropriate box on the Entry
Form.
Notification to DVLA Swansea
If you have a current Vehicle Registration Document (V5C) please give us the
whole document when you deliver the vehicle to our collection driver or to
the auction centre. There is no need for you to do anything else. We deal with
the V5C and advise DVLA Swansea of the sale of your vehicle and we ensure
the buyer is given the appropriate part of the V5C.
Our Charges
Details of our charges and the optional extra services that we can provide are
advertised on our website and available on request from our auction centres.
Fleet Owners
Special facilities are available to owners of fleets of vehicles for whom terms
